    Woman Suing my Insurance Insurance

    Woman Suing my Insurance

    Posted: 10 Aug 2020 08:05 PM PDT

I rolled into a woman in traffic on 9/25/2018. We were going less than 4mph. Not a scratch on her bumper. Woman said she was fine. Everyone went on their way after exchanging info. Just today 8/9/20 I got a letter from Geico saying she was suing for personal injury and I would be liable for anything over my coverage. They advised I get an attorney if that happens. They also requested that I sign a paper that would disclose my bodily injury limit to their attorney. Looking for advise on how to proceed. And how she could possibly be suing 2 years after the fact especially given there was no way she was injured in what amounted to a "love tap". Thanks in advance for any advice.

    Edit: I am in California

Fire in townhouse next door. Our ins paid our repairs. Neighbor's did not b/c he was renting it out. He foreclosed. 1 year later, next door still not repaired. New damage coming through shared party wall b/c of it. We've since switched to landlord insurance and rented it out. Will our ins pay?

    Posted: 10 Aug 2020 10:16 PM PDT

Long story. Could not come up with a title that really covered the extent of the issues we are having. This is in Maryland, if it matters. Let me preface that we are looking into possibly hiring an attorney already.

Our neighbor was renting his townhouse out to some irresponsible tenants. They burned down his house and did serious damage to ours a little over one year ago. Our homeowners insurance paid for our rebuild, no issues. The problem is that the owner next door never switched his homeowners insurance to cover renting the property out and his insurance company denied his claim. He started a legal battle against his tenants, insurance, property manager, etc.

Fast forward six months. Our rebuild moved forward and was finished. We moved back into our house. No work had started next door. No damage mitigation had been done on his side. No temporary roof, nothing. We raised our concern over this to our insurance company, which authorized our contractor to enter the premise (with approval from the owner at the time) to do some work to protect the shared party wall and the work we had done.

Fast forward another six months. We have been in regular contact with the HOA to figure out what the status next door is. The owner apparently lost his legal battles, declared bankruptcy, and foreclosed. He is incommunicado. The HOA been largely useless, but informed us that permits were in place and work next door would being 'soon'. Some demo work was done to clear the house out but that's it.

Now, the real complication. One month later, we had to move out. I'm in the military and received orders. We did not think selling was viable because the burnt out husk next door would have decreased our property's value to the point it probably would not have covered what we owe. We decided to rent it out, even if it were at a loss for the short term, and sell after the issues next door were resolved. We switched our homeowners insurance to landlord insurance. In order to provide coverage, they wanted confirmation our rebuild was complete, which we provided. In the approximately 6 months we had been living in the house we had not had any issues from next door, other than it being an eyesore. We believed the work on the shared party wall was sufficient to protect our home.

Last week, our new tenants indicated there was water leaking into the first floor garage from next door through the shared wall into the first floor garage. They raised concern over the possibility of mold as a result of the water. We purchased a dehumidifier for the garage and are waiting for the results of a mold test for the moment. It is unclear how extensive the damage could be or when it could have started.

QUICK EDIT: Both policies were secured through GEICO, but the homeowners was with Homesite and the landlords is with Travelers.

    My questions are:

    1) Would this fall under our original homeowners insurance policy because it is an ongoing issue still resulting from the original fire next door? Does the fact that we previously raised this concern and that the insurance company acknowledge it give us any additional footing? The claim is actually still open while we finish up a supplemental personal property claim for a few household items.

    2) If it does not fall under the original homeowners insurance policy and we file a new claim with our new landlord insurance company, are they likely to deny our claim?

    3) If the bank foreclosed on the house and the owner declared bankruptcy, is the bank liable for not taking action to mitigate damage to our property?

    Tboned by Delivery Driver

    Posted: 10 Aug 2020 08:12 PM PDT

Hi all, on July 21st some kid ran a red and tboned me going 50. He was found to be at fault. I'm a Geico customer with liability coverage, kid who hit me is also a Geico customer. The whole situation has become kind of a shit show and I'm looking for advice.

He started a claim with Geico that day and all was going well for a bit. They got my car towed to Copart, got the estimate, totalled it out. Done. The Wednesday following the accident I accepted the settlement for the value of the car and agreed to return the rental on the following Friday as the agent I was working with on the value of the car said "you will get the money in the next couple days". I hadn't spoken to anyone else at Geico for a few days at that point so I just went with that solution. Power of Attorney paperwork was all signed that day (July 29th) and ready to go.

Friday rolls around for me to return the rental, still no money in my account and no contact from anyone else at Geico. So I call in to get the rental agreement extended and was told that they can't do that. It was only then that I was told "by the lady handling all the payouts who hasn't called me for a week even though I was supposed to hear from her that Monday) that "there's a coverage issue because he was delivering food at the time" and that "we will get it sorted out and contact you ASAP".

That was on the 31st. At this point I still have not had any update on the situation as far as what's actually going on, no details, no payouts, and not even any discussion on my medical payout (or damaged items, missed work, etc.). I called earlier today as well as on Friday with no response or returned calls. At this point I still have no car, no rental, no money, no new glasses (mine were damaged in the crash so I'm wearing an old pair).

What next steps should I take? And how long do situations like this usually last? Any tips on expediting it? Any and all advice is appreciated. Thanks!

EDIT: Forgot to add my location, this is all in Arizona. Accident happened in Mesa but I live in Tempe.

Out of network therapist has been pocketing reimbursement checks

    Posted: 10 Aug 2020 09:41 AM PDT

I've been seeing an out of network therapist for the last few months. I asked for an invoice/superbill for 5 months of service, and they proposed submitting the claim on my behalf. I originally thought nothing of this and agreed.

During the months of March-June anthem has been reimbursing tella-medicine sessions at 100%. During these months I had about 9 sessions, billed to me at $100/session and to the insurance company at $200/session. I see on my claims form within the anthem portal that my therapist was reimbursed the full $900 by anthem.

I just had a session with them this morning and inquired about the claims they submitted, as the reimbursement check was sent our 4 weeks ago. They stated that they were unsure if they got anything back, or if they would. I noticed that whenever I inquire about billing they keep their language super vague. I've been seeing them for over 7 months and am just now able to get some sort of billing information out of them.

Anyways, should I be entitled to the $900 my therapist was reimburse? Or is that theirs to keep. The shitty part is that I though this money would be going towards my deductible. I've already been scammed by one therapist before, where they billed both my primary and secondary insurances for the same services, so I can be a little paranoid about this kind of stuff.

EDIT: just for clarification- the provider bills the insurance company at $200/session but charges me $100/session. Their maximum allowed reimbursement amount is $100/session, just by looking at the claims form. For the months of march-june (9 sessions) they were reimbursed at 100% of the max allowed amount ($900).

Basically, had I submitted these claims on my own, I would have gotten the money as opposed to my therapist, which is why I'm confused.

Boyfriend had no license. He totaled my car with me as passenger, not knowing his license was never fixed.

    Posted: 10 Aug 2020 10:26 AM PDT

Last week boyfriend supposedly ran a red light, colliding with another SUV, totaling my car and barely damaging the other party somehow. I never saw the light red but I was playing Pokémon go with my feet on the dash (sooooo stupid, don't ever ride like that.) We were hit on my side. I was injured badly in my tailbone, groin and left leg plus seatbelt injuries to my ribs. Boyfriend had a minor cut from his head hitting the windshield and concussion but was sent to the psych floor after he had a breakdown, screaming he has ruined my life and doesn't deserve to live. After that I found out he failed a drug test for pretty much everything (including my prescription narcotics) and had no license. So all of this was concerning freaking obviously but it was never handed to insurance nor was he ticketed for having drugs in his system. The officer knew my family and convinced my dad I was high even after he called to say he was mistaken, everyone's shunned me. It hurts. I even took a private test and passed of course and they are still treating me like scum of the earth.

I have USAA and I pay for top coverage. The man that's handling my case promises that because it's my first wreck and we had paid the DMV to reinstate his license last year (he lost it over a forgotten seatbelt ticket. Sigh.) that I will not be dropped or have to get special insurance from another company as a high risk driver. He said my coverage will rise and I'll have to accept his at fault wreck but nothing terrible.

My stepmom is an insurance agent (mostly health insurance) that's scared they'll drop me. She's ready to fight to get my claim. Also, nobody asked us what happened. Not until the adjuster got involved. The intersection is dangerous because people will turn right on red without stopping (it's not a busy road). Once witnesses arrived they said the light was red but they were at least 70 feet behind us, obstructed by a hill. So of course the light was red by then, right? I chose not to fight this but a lot of alarming things happened afterward, too. First, as I mentioned, the cop called my father to say I had no insurance and was high or drunk and I was driving. All false. Once he spoke with me at the hospital he realized I wasn't high or driving, I was badly injured in my groin and tailbone plus seatbelt injuries to my ribs and couldn't breathe to talk. I also take anxiety meds, possibly making me appear stoned in that state. I've no idea. I was sober as always. This officer tried to convince me to dump my boyfriend and kept touching me while I was in the hospital. Even trying to lay in my bed. A nurse noticed and asked that he leave if he had what he needed. He only issued my boyfriend a DUS ticket with a fine we can't possibly pay in the two weeks we have been given. That's irrelevant but the cop part really concerned me. I'm not a minor at all.

So my questions are mainly, was any of this proper/legal whatsoever? My ex failed the drug test in psych. He wasn't issued anything concerning being under the influence. I dragged his ass to outpatient rehab and he's doing much better. But I felt the entire "investigation" was aimed at discrediting us entirely. Our son died this last year and we have truly suffered, not to give him an excuse for this, just context on why he was so distraught. We are 26 and 28, not children by any means yet were treated as such. The turmoil the officer himself said has made my life hell. this wreck has caused me to lose friends, family, my nice car and possibly my claim. I even lost a lucrative job offer because of this total disaster.

My most important question: will I receive my claim even being at fault with the worst driver scenario possible? I'd have never ever let him drive if I'd known any of that! I'm in South Carolina. First post here and I'm so sorry for my rambling. I'm having insane anxiety and while I'm educated in many other areas, I know nothing of auto claims. Any advice, even bad, would be nice to know so I can prepare for the worst.

    Total loss on a Condo

    Posted: 10 Aug 2020 10:01 PM PDT

I am buying a condo and am looking at insurance. The agents quoting for me are telling me I need to cover the amount to rebuild the unit (bare walls master policy) which makes sense. I understand that in the event of a total loss (that is covered) of the building the master policy would rebuild up to the studs of my unit and then my policy would take over from there through everything inside. What I am concerned about is what if the master policy elects to not rebuild (cash payout to building owner) and I can't rebuild my unit with my policy because there is no building to build it in. Are these policies, master or personal, usually set up to cover my property value that is not represented by the unit itself such as location and amenities? Would a typical replacement cost policy be of any benefit in this scenario? I would imagine the mortgage bank would still come after me for amount left on the loan and not the insurance companies. This seems like a gaping hole in coverage and I'm sure it's just because I'm not understanding something correctly. Any insight is much appreciated.

    Homeowners claim?

    Posted: 10 Aug 2020 06:12 PM PDT

Can I / should I file a claim for a couple nice trees (12-18 in diameter) that got snapped in a storm? No damage on the property (aside from the trees). My guess is that "replacement value" would be in the thousands- though I don't think you can buy 30 ft trees.

New here - so sorry if this is a repeat or shouldn't be asked.

    Thanks

Does Progressive's Electronic Device Insurance cover lost phones?

    Posted: 11 Aug 2020 01:13 AM PDT

I got the 2 year insurance for a nice new phone I got 3 weeks ago. And then yesterday I dropped it in a water in a place it can never be recovered from (got swept away by the current). The contract states that it covers for:

    1) Accidental Damage - Drops, Spills, Cracked Screens and Liquid Submersion (but this doesn't kick in for the first 30 days so I am not eligible for this part)
    2) Theft, Burglary and Robbery Coverage

It doesn't say anything specific about lost phones, and not sure if this should be covered?

Filing a claim for items stolen from storage unit in Hawaii

    Posted: 10 Aug 2020 11:14 PM PDT

    Hey r/insurance

I'm about a month into filing an insurance claim for about $1000 worth of items (boogieboards, fishing pole, tools, maybe more items I havent remembered yet) that were stolen out of my storage unit. Looking for advice here because I just got slapped with the "we probably can't do anything for you" from the insurance people.

Brief overview: I live on Oahu and leave the island often to work out at sea. I was gone for about 180 days, maybe even more since I last accessed my storage. I came back in June to clear it all out and move to a new place and slowly noticed not everything was there.

IMPORTANT NOTE: The storage unit is an upper level unit where you need a ladder to access. It is a 10L×8W×5H and has a gap on the top of the front face of the unit above the doors with about a 1 foot clearance or so. That gap is 100% how the thieves stole the items. The only items that were missing were skinny items that could fit through that gap. So NO cut locks. No sign of forceable entry. Which is where I'm running into issues with the claims people.

The ExtraSpace storage people working at the time said they would make a note, check me out of my unit, but that I "probably don't need a police report" and they told me just to call the insurance company and they will sort it out. (Hindsight is 20-20)

So I called the insurance company the next day and started a claim (then left again for work for 40 days where I have no cell service or Wi-Fi) and got back 2 weeks ago to finish it up.

They first told me: I'll need a police report. So I filed one, delayed of course. No pictures or fingerprints though because i filed it a month or so late...

Secondly: the insurance company told me because I have no proof anyone broke in they most likely won't be able to help me at all. So I contacted my storage unit politely requesting to have them review months worth of footage (unlikely this will help) and thats where I'm at now.

Sooo I suppose I'm either looking for advice on how to get this claim to work or someone to tell me that I'm completely and utterly screwed out of about $1000 worth of items🙃

    FLYING METAL OBJECT

    Posted: 10 Aug 2020 06:46 PM PDT

Will a comp claim raise my GEICO rates?

A SUV drove over a metal object which caused it to fly, hit, and get stuck to my front bumper while driving on the highway in SoCal.

Spoke with an agent but she never gave me a definite answer on whether or not it would raise my premium. All the agent said was "it shouldn't increase if it's comprehensive." My last claim was last year for a hit and run scam in which I won my claim and was not at fault.

Geico lowballing me on total loss claim. Time for appraisal clause?

    Posted: 11 Aug 2020 01:12 AM PDT

    Hi,

Currently going through a very frustrating total loss claim with Geico as I believe they are lowballing me on the value of my car. My car is a 2000 Impreza 2.5RS coupe.

At the beginning of the claims process, the adjuster mentioned that Geico uses a 3rd party appraisal company (CCC: www.cccis.com) to find comparable cars for sale to appraise my car. Since this particular Impreza 2.5RS coupe trim is very rare and few for sale, CCC could onlyfind three Impreza outback sport wagons for sale as "comparable". Those who know these cars know that the 2.5RS coupe is worth several thousand more than impreza wagons and the values are not comparable at all. As expected they came back with a value much lower than what I was looking for.

I believe this is unfair since the impreza wagon is a totally different trim than my 2.5RS coupe, and the values reflect this.

The adjuster then told me to find comparable cars for sale myself. I found two Impreza 2.5RS cars for sale that met all of CCC's criteria. CCC then disqualified these ads, claiming that they are "outliers" because they are more expensive than the cars they found. I don't understand how the cars I found are outliers, considering they are the same trim as my car. Compared to the three cars they found which are totally different trims.

Geico is now saying that their hands are tied since they can only use the value that CCC came up with.

At this point, would it be a good idea to invoke the appraisal clause? I also found about 10 more cars for sale across the country that support the value I'm trying to get. Doing some more research about appraisal clause, I have some concerns about the following:

    1. I would have to pick an appraiser. Who is qualified? Can I simply ask a local body shop or mechanic to be my appraiser? I'm planning on just giving my appraiser all the ads I found to support the value I'm claiming
    2. I'm a bit confused about the umpire part. Who selects the umpire and who qualifies to be the umpire?

Need advice about filing a claim - involves parental death :/

    Posted: 10 Aug 2020 01:38 PM PDT

So. I hope this is an okay question to ask/topic to have. I couldn't find any rules written anywhere.

My mother was hit by a car, recently. She died.

Today, the driver's insurance company contacted me and asked if I wanted to file a claim. They're bringing up who did the funeral - not me - and whether I have any siblings (I don't.)

I'm concerned that I don't know what to expect going forward, and am looking for advice.

Edit: I am in the United States. I live in Nevada, but the incident occurred in California.

Adding comprehensive onto my plan after a tree fell on my car?

    Posted: 11 Aug 2020 01:18 AM PDT

Is this a feasible thing to do? I had a tree fall on the back of my car and shatter the window and smash the roof in. But for some reason I never got comprehensive so my insurance won't cover it. Should I add comprehensive this month and then file this in a month or so and just drive with a smashed in roof? Has anyone ever done something like that? I'm in no position to fix it or buy a new car.

    I am in Missouri, USA.

Right now I'm with NYL. Currently hitting a wall because my market is dry and I'm not getting any leads. AIO all i have to do is answer calls and sell over the phone. This appeals to me because right now I am calling cold and not getting any results. With the new company im answering inquiries so the leads are hot. I havent been with NYL long enough to build a book of business. Currently my ledger with NYL is negative and I dont know if this will prevent me from leaving.

Teen-Uninsured in California What Happens Now?

    Posted: 10 Aug 2020 02:58 PM PDT

So my teen son who turned 18 got a motorcycle. He just got his license and he was practicing around the neighborhood. Someone cut him off and he slid and a vehicle that was turning left at the intersection also cut him off and his body hit the rear bumper of the car. The lady's insurance took 25% of the responsibility and paid him $800, we used that money to pay rent. Now my son gets a letter from a collection agency for $2700 saying if he doesn't pay the insurance they will get his license suspended.

Now, as a parent, I'm furious at my kid, because I told him a million times don't drive this thing until you can afford to get insurance. Of course, I'm glad he is alive and nothing more serious happened. But I have no idea what to do since I have a clean record and had insurance for 40 years. I have no idea how to help him. He is still in high school without a job. I don't work because of Covid so can he get out of this situation? His bike got total and the lady's bumper got a small dent. Any advice would be appreciated.

My experience with Safeco(a subsidiary of liberty mutual)

    Posted: 10 Aug 2020 12:41 PM PDT

For short version read the last part.

So I'm going to skip right to the interesting part, every thing before this was fine. So I was trying to add a new driver(my son)to my account, and I decided to switch to progressive because it would be about $200 cheaper annually. It took a few days for my insurance agent to switch me over and as far as I could tell everything was fine, and then I look at my policy. On my driving record they put a major at fault accident on my record the day that I left Safeco(that never happened), and they also changed my daughters major not at fault accident to a major at fault accident. So after I saw that I spent about 3hrs making about 20 useless phone calls someone finally told me that LexisNexis is the company responsible for my driving record. So then I try to call and email them, I sent probably 3 emails and called about 3 times a day for 2 weeks before someone finally picked up the phone. Spent about an hour on the phone with them and they tell me they will send me my real record in the mail and that they were not the ones who sent the record to progressive, that Safeco was responsible for that. Then about a week later I get a letter in the mail from LexisNexis that was instructions on how to log into their website (which was unnecessarily complicated). So I get into their website and see the document that I am looking for, and it is 70 pages long, and I have to look through it to try to find what I need to send to progressive. So I find it and I just send it to them and finally got it resolved.

    SHORT VERSION

I was switching from Safeco to Progressive and the day that I switched Safeco added a major at fault accident to my record and changed a major not at fault accident to a major at fault accident and I had to spend about 3 weeks trying to resolve it.

Help! Can I be held liable for my answers on an insurance claims followup?

    Posted: 10 Aug 2020 04:23 PM PDT

Kinda long, but here goes: Six months ago I went to a sleep medicine clinic to look into getting an oral appliance to help with my snoring. They assured me that it would be fully covered by insurance, all I had to pay were the copays(like 20ish dollars each for several visits), and a one time fee of 100ish dollars(cant remember to cover the take home test. Sounds good. Let's do it. Over the course of the visits,(which spanned several months) I had recieved an explanation on benefits from my insurance that was indicating that I would pay a substantial amount on my end, (maybe $500-600) in addition to what my insurance would cover. I questioned the clinic, noting that they had told me there would be no out of pocket expenses except for the copays. It seemed a little fishy, but they just said don't worry about it, I didnt owe anything more on my end. Insurance ended up being billed over 8000$ for the appliance/visits. I am getting claims follow up letters from my insurance company asking me if I was told it would be in-network by the company, if I was told what the cost estimate was, and asking how much I was personally billed/paid on my end. My guess is the clinic may have just waived the portion of the bill I should have paid and simply charged insurance for their portion, knowing(correctly) that I wouldn't have gone forward with the procedure if I knew it was going to cost me personally $500+. Can I be on the hook for more money if I correctly tell the insurance company that I was told it was covered and pay no out of pocket outside of the flat copays? Not sure how to answer all of these questions on this questionnaire. Any advice appreciated.

Company to double check for healthcare overbilling?

    Posted: 10 Aug 2020 03:24 PM PDT

Are there any companies that double check the accuracy of health care billing for you? I can get 50% of the savings found from any hospital overbilling that I'm able to correct through my insurance. I was wondering if there's a company that can check the accuracy of billing and takes a cut. I'd gladly submit itemized bills to split a percentage of those savings.

Filed a claim to replace roof, but decided not to go through it

He said no major issues, but that he could make a case to the adjuster to have it replaced. He met with the adjuster and they accepted the claim. The total to replace the roof is a little over $9k and I just have to pay my deductible. The problem is... I'm an idiot and thought my deductible was $2000 when it's actually $5000. I've decided not to go through with getting the roof replaced. Will there be any negative impacts on my policy from this other than having the claim on my history? Located in Georgia, US

Neighbors trampoline damaged siding, gutter and fence in storm, whos imsurance?

    Location: Illinois

This happened a few minutes ago so trying to figure out how to proceed.

Our area was just hit by large storms with up to 100mph winds and tornadoes, this was known to be coming approximately 4-5 hours before the storm hit. Our neighbor just got a trampoline and apparently did not secure it, considering its currently in the middle of our now broken fence. It also pulled off a gutter and did some pretty significant damage to our siding that will almost certainly require it be replaced. We have pictures of the trampoline in our fence with the gutter and the siding in the shot so you can clearly see how all three damages occurred.

I dont want to be a complete dick to my neighbor because we are friendly and I'd like to keep it that way, but whose insurance would this go under? Do we need to file a police report?
