I don't care that they have chickens (I do too!), but the rooster is driving me crazy. I work nights, so I go to bed around 4am, and then I spend all but 2 of my sleeping hours trying to ignore this loud rooster. How do I go about getting the city's help to get rid of it? Warner Music Targeted a Copyright Infringement on MY OWN MUSIC Posted: 06 Aug 2020 05:14 AM PDT Location: Texas I made a post about this on /r/instagram, but based on the comments; I feel that I may need to look into what legal recourse I have. Quick context: I make music and promote it with weird videos on Instagram. Five minutes after posting a song, Warner Music had my video taken down. Now I have to wait a week for them to review and approve my original work. Additional info: All of the writing, recording, and production was done by me exclusively. Any samples used in the tracks were my samples that I recorded with my cell phone and then processed in my DAW. Everything in the track is uniquely and exclusively mine, and yet WMG's algorithm flagged my song within five minutes of it being uploaded. There's no reason it should've triggered the algorithm unless the algorithm isn't actually set to catch copyrighted material. The fact that everything was recorded and produced by me, and every sample used is from a recording on my phone, shows that there's nothing identical to whatever their algorithm is set to detect. They're casting a wide net, and I believe it's an overaggressive way to kill competition. The only option presented to me was to click a button that says "submit dispute" on the Instagram app and then wait a week for WMG to review my song for copyright infringement. I'm looking into what other options I have because that's completely inappropriate as the only recompense for being unfairly and unjustly targeted. Something tells me this will continue to happen to me if I don't do something about it now. I'm not a big name in music and I'm not looking to get rich or famous from it. I make music because it's what I love to do and something infringing on my ability to do that and share it with others is incredibly disheartening. Given a fine for littering after helping at an accident scene [NC, USA] Posted: 06 Aug 2020 07:30 AM PDT I work at a large hospital and have to cross a very busy 6 lane road to get from where I park to the hospital. As I was waiting for the crosswalk signal to change another pedestrian on the opposite side walked into traffic and was struck by a vehicle. There was a police officer sitting at the red light and when this happened he pulled into the intersection and put his emergency lights on. Since this stopped traffic and I'm also an EMT, I ran into the intersection to help out. I rendered aid the to the person who was struck and when the officer finally got out of his vehicle I asked if he could use his radio to call for an ambulance. After the ambulance arrived and took over the officer asked me questions about what I saw and asked for my ID. I assumed this was for his accident report. As I was waiting for the crosswalk, I had been carrying an energy drink can and when I ran into the intersection and arrived at the victim, I apparently threw the can to the side and the officer has now decided to write me a citation for littering for $250. I asked what it was even for, because I had forgotten all about my energy drink at the time. When he told me, I said I'd gladly pick up the can now, I never meant to discard it, just set it aside while I helped the victim. He said I couldn't do that, as the can rolled into a storm drain. I told him I also had to jaywalk to help the guy out and asked if he as gonna cite me for that too, he said if I didn't check my attitude he would and find a few more things as well so I left and went to work at the point. So yeah, I get it, I'm guilty of what I've been fined for. But it seems to me that, due to the circumstances I don't deserve the fine. $250 seems like a lot, but it's certainly not worth getting a lawyer over or I'd end up spending more than I'd save I'm sure. So what's my best course of action for fighting this ticket? When I relayed this story to my boss at work, she already told me she'd give me all the time off work I need to fight it, haha. We are a small Norwegian company and while on LinkedIn today we noticed that there is a company with a very similar name, within our industry, and literally the same logo (down to the color and all). On their website they were copyrighted in 2020 and we have been around since 2017. Do we have any legal action? What are we supposed to do? When I catch them small, I will either mow or weed whack them. However, they gave gotten out of hand with several dozens of them over 7 feet tall now. Succulent Thief Caught on Camera Posted: 06 Aug 2020 12:18 PM PDT Hello everyone, so basically my wife and I are in a bit of a pickle. Last night in San Jose, CA someone stole one of our succulents from our front yard. They yanked it right out of the ground. Sadly, this is not the first time it has happened (around 7 plants/succulents have been stolen). However, what made last night's case different is that we caught it on camera. Two people were involved: a middle-aged woman with a face mask (she was the one who did the actual action of stealing), and a large man who had a small, overweight dog with him. The video that was captured shows her entering our yard, bending down, and coming up with something in her arms while the man was a few feet away serving as lookout. Coincidently, we recognized them both (not on a name basis) and we know where they live. We are not quite sure how to proceed. My wife filed a police report this morning. She wants to leave a letter on their doorstep detailing that we know they are stealing our plants, and that if they don't stop AND return the ones they have stolen, then we will continue filing our police report and that we have video evidence. I wanted to confront them and tell them to stop and hand over our succulents. Legally speaking, we are not quite sure what the best course of action is. My boss is looking for someone to work at our warehouse distributing product to clients, but is concerned that turning down applications because someone doesn't speak Chinese may constitute racial profiling and could be illegal. My boss speaks only Chinese and mostly relies on us, his billingual employees, to translate for him. We didn't list the language requirement in our job listings. We are not looking to hire only Chinese people, but proficiency in the Chinese language is required by my boss. I would assume that a white person who knew sufficient Chinese would be qualified as well, but we've received no such applications. Handing over records that would disclose which doctors I see, whom I buy things from, whom I'm sleeping with, and so on, does not seem reasonable. He is putting up a fence on our shared driveway that is protected by an easement, and as well as part of the driveway not covered by an easement but is still on our side of the property. Me and my family went out to stop the fence guys, there are stakes in the ground that shows where his property begins and ours ends. The fence is several inches over past the stake on our property. Fence guys refused to stop. When we brought the issue to our neighbor, his exact words were "If you have the money, take me to court" How exactly do I stop my dickhead neighbor from mobilizing his fence forces and building this wall? Also sorry for being facetious with my post, I'm not joking (another post with said dickhead neighbor to help emphasize not a joke post), just really annoyed and making jokes helps, I'm very worried about just how far he'll take advantage of the property line. There is no lease or any paperwork at all. She will have a made up name to make this easier. "Jessica Mary Bennett" will be my mom's maiden name. "Jessica Mary Andrews" will be my mom's married name. My mom has always gone by her middle name and is divorced, so Mary Bennett is what she does by. The name on the notices was similar to my moms first name, and used her old married name, so think "Jasmine Andrews". No family we know of has this name, we assume the landlord sifted through our mailbox one day and got a glance of my mom's real name and remembered it wrong, resulting in the incorrect name on the notices. She got an eviction notice a few weeks ago with the wrong name on it. We waited on the notice that gave us a court date but we never got one. Yesterday we got a writ of ejectment saying we had to vacate by 3 pm today, it also had the same wrong name on it. Today my mom went to the magistrate and told them it had the wrong name, they told her to provide ID when the constable came to evict us at 3. She told them she has absolutely no form of ID at the moment. She came home and called the magistrate. Was on and off the phone all day with the same lady. This lady told us that a form with a court date was sent by mail and had to be signed for, signed by my mom, then mailed back with my mom's signature. We never got this form, but they said they got it back in the mail with the wrong name signature, "Jasmine Andrews". Our landlord lives across the street from us and is a terrible woman, we live in a duplex and her cousin lives in the other half. His brother wants to live where we are but lives down the street for now. So we are surrounded by the landlords family, meaning any one of the people could have (and most definitely) forged my mom's (wrong) signature. We told the lady this and then had to email her an electric bill with my mom's name on it as proof of ID. She said she would show it to the judge and call us back. We waited all day, and nobody came to evict us and we never got a call back. What happens now? Can someone come tomorrow and evict us? Does another eviction process have to be started, or can we get another writ of ejectment tomorrow with the correct name on it? My mom had to be rushed to the hospital unexpectedly a few hours ago. She had gradually and suddenly lost strength in her arms and legs throughout the day, now she can't move anymore. I couldn't go to the hospital with her and I can't even talk to her because she can't lift a phone to her ear. However, only my mother is on the closing documents so they are stating that I am not allowed to be in the condo because I am not on the closing documents/don't own the property. Are they allowed to do this? I don't see any details regarding occupancy of children in my HOA documents. When I moved here five years ago, I signed documents indicating that I am an occupant of the condo but recently management changed and they are saying they lost a lot of personal information on occupants (one of which is probably that document). I contacted a lawyer 3 months ago to get this process going (edit: to clarify, I've used this lawyer before for other things). We met for 1 hour. The lawyer said for me to send her a variety of documents and she will contact the institution to get the process rolling, which I did. I did not hear back for 1.5 months and then started to call the lawyer's office to check on status (probably my bad waiting for so long to follow up, admittedly). Each time I got the receptionist and she took a message, and then I did not hear back. Recently I have tried e-mailing the lawyer directly, still without a response after a few days. I've called at least 5 times now and e-mailed twice. I'm at a loss. Is it unreasonable that I expect to know the status of this process here? I can't wait forever to wrap up this process. At what point do I call and say, sorry, I'm finding a new lawyer? If I have to do that, do I need to do any cleanup? I've already sent sensitive documents to this current lawyer, and I have no idea what they did or who they have contacted, if anything or anyone. One has both psychically and verbally abused the other. He has called him and I apologize for the language a "dumb N*****r, F****T Lesbian, and more. Just the other day while the one being abused was in his wheelchair the other grabbed the back of it pushing him sending the wheelchair across the room spinning around and hit a wall. This isnt the first instance of him being pysical with the other client and they have yet to remove the abuser after months of reports of his behavior towards the other client. I'm a 24 year old grad student living in off-campus student apartments in Virginia. I've lived in various apartments around the area and have always made a habit of reading over the entirety of the lease before signing, something it seem like a lot of students don't do. Anyways, as I was reading over the lease they had sent me, I noticed they had left the security deposit amount blank. I texted my roommate, who said his security deposit amount was $250 on his lease. I figured hey, that's lucky, they made a mistake. So I went ahead and signed and sent it back to them. They eventually sent a signed copy back to me with the amount still blank. Months later, they're asking me to pay my application fee ($40) and my security deposit ($250). I called them up to ask them to remove the security deposit amount as there wasn't one included on my lease. The first girl I talked to said that she would send that request up the ladder. I went ahead and paid $40 online with a comment noting (re: application fee, not security deposit). A few weeks after I called back to check on the situation, and this time talked to someone else. She informed me that if I wanted to live there, I HAVE to pay a security deposit, because that's their policy. I said that's great that it's your policy, but you made a mistake and left it off our lease agreement, which is signed and agreed upon. She says that she will make an addendum that changes it, but I know any addendum must be agreed upon by both parties, so I said she could create whatever she wanted but that I wouldn't be signing it. Now this week, months later, I logged in to pay my rent. My balance showed that I owe my application fee ($40), security deposit (now $210), and my rent ($620). I called back and was informed again that it's their "Policy" that I have to pay a security deposit, but that she would send the issue up the ladder again. I'm pretty pissed they used my previous payment towards my security deposit even though I specified that it was to go towards my application fee. What should I do in this situation? I got tricked into take out student loans Posted: 06 Aug 2020 10:56 AM PDT I don't know if tricked is the right word to use, perhaps it was just an accident and I got left with the debt My student loans have been in forbearance until now, and my income driven repayment plan has been adjusted to over $1000 a month. Which is insane to me since I work part time (actually two part time jobs which combined is still part time) I can already barely afford my bills alone and have no money for food for "Fun" with these loan payments added on I am out of my mind to try to pay them. The worst part is I didn't even mean to get students loans!!! I was in a foster care program and was told by my advisor I was able to go to college free tuition because I was a warden of the state. The college I chose was a few miles outside the state but was assured I could still go tuition free because it was so close. Anyways at the beginning of my 3rd year I received a notice to make a payment or take out a student loan to continue paying for tuition there. Of course I was confused and called my supervisor my foster care system put in charge for me. I soon learned she was fired and she had give false information and I wasn't getting my tuition free since it was out of state. I didn't get any more advice on what to do, and since I was so invested at that college I was at and was halfway done with my degree I took out the loans. (Because I still had to pay for the first two years I was there) I wasn't given any resources on help with tuition as a foster kid and I had no parents for advice so I ended up with all this student loan debt because felt I had no other option. I wish there was some way to go back in time and just have gone to a different college in state or just not at all. My wife and I were out of town recently and we came home to realize that a tree in our back yard had been cut down by our neighbor. The neighbor recently installed a privacy fence and this tree was near the fence line (not impeding upon the fence). The neighbor cut the tree about half way up the trunk (15 or so feet) and everything else was gone. The tree was pretty much straight up in the air. He told me that he cut it down because the branches were on his property. I understand the branches leaning over his property, okay, but is there any legal I can do so that he has to cut down the rest of the tree since I am stuck with a 15 ft tall stump essentially? Mentally Ill Neighbor Disrupting the Peace, What Are My Rights? California Posted: 06 Aug 2020 10:36 AM PDT I have a mentally ill neighbor, "David". I don't know for certain but I believe he is an unmedicated schizophrenic. That's my best non-professional guess from the sidelines. He is constantly disrupting the peace of the neighborhood and I want to know if I have any rights here or how to proceed. Now the details: David moved in across the way about 5 months ago. This is rural agricultural with some horsey areas that are ritzier (everyone has fruit trees, not any other crops). Most properties are 2-10 acres. David's property is about 7 acres. I have never met David personally and I plan to keep it that way. Thankfully, there is a fence between David's property and mine. He has never crossed it and I don't believe that he would but I can't know that for sure. For all that land, whoever built our two homes, built them only about 500 yards from one another. I quietly did some research about 2 weeks ago when it became clear I had a problem next door. The owner of David's house is an LLC. The LLC is very newly formed. It appears that the LLC was formed for the sole purpose of purchasing this property for David to live on. The primary on the LLC is his 70 year old father who lives about 3 hours away in a home worth about 2 million dollars. The father is a businessman. The other names on the LLC are his mother. David is also a member of the LLC. David had some drug and alcohol related arrests shortly after he graduated from high school back in the 90s. Just typical kid stuff. David had some other brushes with the law in the early 2000's, but they were misdemeanors and all were dropped. From what I can tell, he has not been arrested since then. He has no history of violence against other people which was my primary concern and was the reason why I did a background check on him to begin with. There's a huge difference between a loudmouth jerk living next door and a person who has been to prison for felonious assault. I am a woman living alone in a rural area and I was concerned for my personal safety. David will frequently stand out in his driveway, screaming and cursing at people who are not there. There is so much flora between David's driveway and my house, that I cannot see him, but I can hear him loud and clear. I can hear him over the TV set. Yes there is distance between homes here but voices carry. I am no prude but the language is beyond foul. The screaming is a new development---until 2 weeks ago, I had no idea that anyone was living in that house. I knew it had been for sale, I knew someone bought it, but it was total radio silence from over there. No lights, no car in the driveway, nothing. There is still no car in the driveway and I think that David must not be allowed to drive. David started screaming at 6am yesterday morning. This time, I sat by my living room window and recorded it. IT just seemed like a smart thing to do for some reason?? You can't see anyone but you can hear him loud and clear. This went on for about 3 hours (I did not record the whole time lol). It would go for awhile, then stop. Then he'd start up again, then stop. So I wasn't sure if I should bother the police or not. I was almost at the point of calling, when the police rolled up, so someone else must have called. They called to him by name and spoke to him very gently and that is when I realized that they knew him, which means they've probably been here before and I just didn't know it. They did not talk to him the way they'd talk to some loudmouth jerk who'd been day drinking. They talked to him the way that you would speak to a distraught child. I realized that David was mentally ill. I realized that he is not on drugs or being a jerk. He literally can't help himself. That is why the cops didn't get stern with him. They calmed him down, he went inside and that was the end of it. This morning he started up again. And I thought, as much compassion as I have for him, I am not going to tolerate this. Instead of waiting 3 hours, I went ahead and called the cops. They came out again. calmed him down. And he went inside his house and now it's quiet again. As loud and scary as David is, I am not afraid of mentally ill people. Yes there are stories here and there of schizophrenics becoming violent towards others but they usually do not. They are a much greater risk to themselves than to other people. Suicide is common. If indeed he is schizophrenic as I think he is, then he lives in constant fear. Fear of people watching him. Fear of people being after him. Fear that someone will harm him. Fear that people are controlling his thoughts. What a horrible way to go through life. I have tremendous compassion for both David and his parents. I don't know what to do. This is obviously going to be ongoing. I want peace and quiet. I live out here on 14 acres so that I can have peace and quiet. It's clear to me that his parents did what they thought was best for him, buy him his own place as far from civilization as you can get at least in Southern California so that he can have his privacy and he's less likely to cause disruption. But he IS causing disruption. I want to be able to have people over and sit in my yard without hearing "F you, you F'ing pussy, I'm gonna smash your F'ing face in, get off my F'ing property" and on and on. What do I do? Posted: 06 Aug 2020 12:59 PM PDT I'm doing a home remodel job in California, I'm self employed and the jobsite is a house behind a vacant house, accessible by a shared driveway. As a minor add-on, I ordered a toilet lid from a distributor. It's for an off-brand toilet, not from one of the big manufacturers. The distributor and I had multiple digital convos about it, including about the fact that delivery was to be to the back house, and the fact that it was weeks late, even after I paid for it, supposedly mostly due to manufacturing delays because of coronavirus. One day someone coming onto the jobsite informed me there was a large shipping carton on the front porch of the vacant house in front -- which turned out to be an entire toilet, addressed to me, made by the same manufacturer as the toilet part I'd ordered. That model is worth about a grand, so I moved the toilet inside the fence lines where it wouldn't get stolen, and that day I messaged the distributor that the wrong item was dropped, and at the wrong place too, and to please call me asap. He never answered, and hasn't been in contact since. But several days later the manufacturer emailed me directly, to inform me that "an item was delivered from their warehouse by mistake" and instructing me to give it to a carrier who would pick it up. The email didn't identify the item, didn't identify the carrier, and gave no day or time for the pick up. I replied that the front house was vacant, said I was working in the back, gave my cell phone number so they could pass it on to the carrier, and asked for a day and time I should expect pick up and who the carrier was, and that I'd do my best to accommodate. No reply. No phone contact from anyone. A week later my part finally shows up, also dropped onto the vacant house's front porch, and sent from the same warehouse address. There's a shipping label stuck in an envelope attached to the package, and that day I get another email from the manufacturer, saying they've sent me a shipping label for the toilet and asking me to do them "a favor" and haul their toilet to a shipper. In my mind, this is the distributor's problem to work out. And, if it matters, it was the distributor who invoiced me, and who I paid for my part -- not the manufacturer. Normally if there's any issues on that end, the manufacturer ought to be dealing with the distributor on it. I don't mind people making mistakes, it happens a lot, and normally working things out isn't a problem. BUT, the distributor ghosting me, combined with the manufacturer blowing off my inquires, their incompetent and incomplete emails, and their not having any respect for the position they've put me in makes me want to be done with this. What are my legal responsibilities here? Should I send the manufacturer a legal abandonment notice that if they don't make arrangements (agreeable with me) to pick up this merchandise from where they delivered it, it will be considered abandoned and I'll dispose of it? If I decide this is too much of a headache, and do agree to drive their merch to a shipper, will I be responsible if something happens to it on the way? What if the contents are already damaged? What's my legal position then? After all this, I'm disinclined to do anything more than the barest minimum of what's legally required. So, what would that minimum be? [link] [comments] |
