Insurance disputes damages don't support my story. Posted: 25 Aug 2020 07:40 PM PDT Hi. I was in an accident last week wherein the other driver struck my car as they attempted to make a left hand turn. The imgur album linked below has a google maps pic of the crash trajectory as well as the damage to the vehicles. The other driver is claiming that she was not in motion at the time of the accident. Somewhat frustratingly, my insurance has already determined me to not be at fault- but only due to the fact that our stories contradict. It appears like her insurance will do the same in her favor. However, as per the pictures of the damages, if she truly wasnt in motion, I would argue that the damage to my car would've started further forward towards the front area of the fender, as this point is much wider than the actual point of impact. The fact that the damage begins and ends where it does to me is clear proof that she was moving forward. I've pointed this out to the agent (from her insurance) assigned to my case and she dismisses it. How can they dismiss something that would be physically impossible otherwise? What options do I have so that the other drivers insurance can fairly and impartially (re)evaluate their decision? Health Insurance Denying Surgery Because it's not "medically necessary", but it is (New York) Posted: 25 Aug 2020 11:08 AM PDT Hello (I am cross posting this from r/legaladvice as recommended), 6 months ago I was approved for a surgery by my health insurance provided I worked with my doctor and followed their care instructions. I did what was requested and am now ready to have the surgery. When my doctors office submitted the paperwork to the company, it was rejected for not being medically necessary (despite the pre-approval and meeting their own criteria). My surgery coordinator also said they were denying it because it is inpatient and not outpatient (idk how they expect major surgery to be an outpatient procedure, but oh well). My doctor filed two appeals, but both were denied. I now need to file a grievance with the insurance company, but I don't know how to do that. I was planning on hiring a lawyer to write the grievance letter, but I dont know if theres a specialty I should choose or how to locate a good lawyer for this task. [link] [comments] |

Posted: 25 Aug 2020 10:34 PM PDT My detached garage shares a wall with a neighbor whose pipes run through it as well as the pipes of another neighbor. Three and a half years ago one of the neighbors had a pinhole leak that caused leaked through my garage. I had to take care of the dryout and drywall repairs which I did through a claim with my own insurance. This week the same problem happened with a pipe from the other neighbor. Again the plumber had to cut out drywall in my garage wall to get to the pipe. So now I need to get another dryout and drywall repair done. If I make another claim with my insurance for this restoration work, what are the chance my insurance will go up? What are they chances my insurance will drop me? If I do get dropped for 2 claims within 5 years, how hard is it to find another insurance? BTW I'm in California. [link] [comments] |
Home insurance cancelling our policy over electrical box Posted: 25 Aug 2020 01:23 PM PDT I'll make this pretty short and answer any additional questions in the comments My wife and I (both pretty young and new to house buying) just bought our first house here in North Carolina and not only did we get an appraiser for the house we also got an independent home inspector to look over everything and everything was good to go. We got our home insurance at the very beginning of August and a few days ago received an email from them telling us they are cancelling our insurance due to having an FPE (Federal Pacific Electrical) panel and they're giving us 30 days to either replace it or go find new home insurance. I don't want to go straight into spending $2000 on a new electrical panel and was wondering if there was anything else I could do. I also have a home warranty who sent us an electrician today and he also said everything was fine with the panel so they aren't able to replace it. Since our policy already started with them and they accepted us at the beginning of August should our policy be able to cover anything that deals with electrical or fire hazards as they described is an issue with the electrical panel? We have the full home coverage so it should have everything. I was unable to locate our actual policy on their website (maybe got removed due to them cancelling our policy) but I plan on calling them tomorrow when they open for them to email me the policy. I recently got a letter saying they need me to do a virtual inspection of my home. They say this is because our policy has Guaranteed Replacement Cost Coverage and that it will be replaced by Extended Replacement Cost Coverage. They say it is due to Underwriting practices being revised in my area and they are no longer offering the former coverage. Does this sound normal to you? Should be concerned? Any advice? [US] I'm curious how "roommates" structure their car insurance... Posted: 25 Aug 2020 12:19 PM PDT Hey everyone, A question that I had for a while, but has never been able to find a good answer to. From what I understand about car insurance in the US, most insurers go by your residential address to determine your rates, who should/can drive your cars etc. etc. There are also some (probably, local/state) rules regarding spouses that must be added to your auto policy. However I never understood how "roommates" (or, basically, any people who are not related by marriage or by "parent-teen child" relationship, pay separate taxes etc., yet technically share the same residential address) "structure" their auto policies? I also may have some practical interest here soon - due to many circumstances I may at some point be moving together with my relatives. I am a good driver with perfect (knock on wood) driving record and a relatively expensive leased vehicle. They are not so perfect drivers with less expensive vehicles. That said, just "merging" everyone under the same policy (if even possible!) will likely be a disaster for everyone involved, where cost of (A+B) policy combined will be much higher than cost of A and cost of B separately. How to avoid this? In other words, how to convince the insurance company, that even though I, John Smith, live at the same address with my uncle, William Smith, he is not going to drive my Toyota and I am not going to drive either of his trucks, thus our policies should be kept separate? Claims, Deductibles, and co-insurance Oh My! (PA) Posted: 25 Aug 2020 06:04 PM PDT TL;DR Amount sitting in co-insurance, even though they are saying we owe detectable again. Asshole we spoke with who may or may not be a supervisor may or may nor help by 4pm tomorrow because effort. Where to go next if we get no help from said asshole? Hi all, hoping that I am writing this for no reason and everything will be fixed by 4pm tomorrow when they are supposed to call me back. Unfortunately I have been dealing with insurance enough that I should probably know better. So looking for your help, have been dealing with this since the end of July beginning of Aug yhis year with Aetna/CVSHealth. Thing were going well getting billed correctly claims coming through correct and everything up until then and then all hell broke loose. I will put here also that my husband works for them too, so I can usually get the best help and info straight from the source. So the situation, we met the dedctable so everything good just need to get through the co-insurance now but even with that it makes a lot of my doctors bills more manageable with the discount from it. So all good or so we thought. All of a sudden a week later, we are showing that we didn't meet the deductible. Ok, that is strange, speak with someone and found something they proccessed wrong so they fixed that. But it didn't help much, still a little over $400 saying still needed to meet the deductible. I am not one that takes things at face value, so I looked a bit more and things just were not seeming right. So I calculated everything since the start of the plan year which for this one was June. The amount I got totalling up the claims was more then the deductible. So where was the missing money for the deductible, so I go through the claims and this one big one which had been around the time of when it showed the first time that we met the deductible. So some of the claim amount went towards the deductible, and the rest went to co-insurance. It wasn't a little amount either the amount sitting on the co-insurance is a bit over $800. So if course I am thinking why wasn't that moved back? And that is when I called them at the beginning of Aug, to get this fixed. I also had a procedure coming up within that week I called, so I needed to make sure this got taken care of right away or I couldn't afford it. So gave the info pointed out the stuff CS rep sent it off to be handled. Now not going into the finer points of it, or looking for if this is something that should be automatically done or not. Went over it with my husband, and how the company might look at it. But we both agreed that the claim with the amount sitting in the co-insurance should be reprocessed. So two weeks go by, called last Friday, and spike with someone and was being told that the person handled it and nothing to change so nothing was correted. Spoke with her more, she was going to talk to the person who did it and get back to me before the end of the day. Strike 1, they didn't get back to me. Which only reinforced my frustration and stubbornness. So called Monday a couple if times trying to get a supervisor. I was fed up, and the procedure I was supposed to have at the beginning of the month I had rescheduled for the end which is this Thursday which from my understanding should have been plenty of time to get this resolved.... So last person I spoke to Monday said they would mark my call Urgent and have Supervisor call in 24 hours. Can we guess how that went? It is disappointing because I have spoken to supervisors before and not only did they get back to me quick but they were nice and very helpful. So that leaves us at today, let 24 hours go by and actuallt let more then that go by. Called when no one called me, went over everything again this this was 5 calls now. Was told they would mark it Super Urgent now, and get a call by the end of the day.... So it was getting close to 5pm and no call. Asked my husband how much longer I should wait for the call, and he said call back now more then likely if haven't gotten a call by now they were not calling tonight. So called again, and have to say I feel really bad for the CS rep because they are doing the best they can and end up stuck in the middle if this. I do my best not to release my anger on them. This one finally put me on hold, and told me she would not end the call until she could get a supervisor on the line. So after about a half hour she did, though we are still not sure if he was an actual supervisor. So again go through or try to go through everything, he was condescending and kept trying to talk over me. When I try to point out to them that they could do certain things (per what my husband told me to tell them). To just reprocess the one issue claim as an emergency. Which would fix all these issues, and my husband knew this because he used to work the job that did them. All I got from the guy that they can't it would be to much to do. Which translates to me is that it isn't that they couldn't do it but that it would be an inconvenience to him. Next part I will admit, I am not proud of it but I got angry and could feel my rage rising and could feel the tears pushing in. I did raise my voice slightly, which brought my husband into the room. That isn't me, I like working with others to fix something. That unfortunately wasn't happening here. I ended up passing the phone to my husband so I could calm down. The guy spoke to my husband like he dud me, even though he was told that my husband knows the system and the process. Finally the guy was like well, I will need to get approval to do this. This is why we think he might not actually be a supervisor, because usually supervisors should be able to reprocess one claim no issue. The guy tells him we will hear back ny 4pm tomorrow, which means again I need to reschedule my procedure. So if you got through this wall if text, thank you. And the help we are needing is if we don't hear back tomorrow or even if we do and am told nope not gonna do it. Where should we go next, the whole thing comes down to a system error on how they process certain claims. Which is a while other story. My husband could try to get in touch with someone he used to work with to see if they can help, but he knows he would chance losing his job doing that. Which is sonething we really don't want. We just want this fixed, so if a supervisor isn't helping then what next? Thank You for any help you can give, hopefully everything works out and we won't need it. Insurance Won't Cover PCP appointment Posted: 25 Aug 2020 04:56 PM PDT Location: San Diego, California About 8 months ago I went to the doctor to see my primary care physician for a check up. About a month later, I noticed that there was an outstanding balance that went uncovered. I proceeded to call the doctor's office as well as the insurance provider. It was explained to me by the insurance that there had been a mistake and it was billed to the mental health network rather than the traditional care network and to contact the doctor's office. I did this and found out that the doctor's office had done everything correctly. Upon contacting the insurance again they seemed confused and still claimed that it had went to the wrong network, but said that it would be an easy fix and would take about a month to process. After that ensued the most frustrating series of contact with my insurance provider. I would call and they would say that it would be a couple more weeks to process. I would call a couple weeks later and they would say, "huh, it should have gone through. I'll do it right this time." This cycle repeated about three times over the next several months, until I found out that the doctor's office had taken me to collections. I then called and explained the scenario multiple times over the next couple weeks eventually making contact with a lady who gave me her email and who I sent the collection notice to. I was hopeful that it would be resolved, but here I am today and it has still not been dealt with. I contacted the collection agency and I have some time before my credit will be negatively affected. Today I contacted the doctor's billing office and they reduced my price 40% and I payed them directly so that the collection agency would be called off. However, I still need to be reimbursed by the insurance company. Any advice on what to do would be so appreciated. Also am I entitled to any compensation as a result of this terrible service? P.S.: The lady in the doctor's billing office recommended I call the insurance company, and immediately ask to speak to a supervisor. Then get the person's name and reference number for the call and explain the situation about how it was billed as behavioral health and not a pcp visit (for the 10nth time). Rep West Adjuster Giving me hard time about repair Posted: 25 Aug 2020 03:20 PM PDT Backstory: My car was hit while parked beginning of July, by a uhaul truck, the guy left his info and filed the claim. After going back and forth it was discovered that he had to file it through uhaul rep west insurance instead of his insurance which is progressive. I get called by the rep west guy Bill and he gives me two options 1. send details pics they do estimate and send a check 2. i have my shop of choice send estimate. I choose option 2 and he wound up doing option 1 and they cut me a check. Well it was $250 less than what my shop quoted. I let him know that and he kept saying send in the estimate from the shop. So I get it faxed over and hear nothing. Now they have finally received my invoice (after calling the supervisor) with the price difference and the insurance agent Bill is saying that my shop ripped me off and over charged me and that it's not what it costs... but I already paid bc I had to get my car back... He was very shady and doesn't answer my calls just responds via voicemail a few days later. I'm worried that he's going to claim that it's the shop fault and not cover the remaining damages. I understand that I should have waited to get my car fixed, but he informed me that they'd cover the cost regardless so I felt like it was okay. Looking for advice with this current situation. Posted: 25 Aug 2020 02:09 PM PDT Ok, so I have a question on car insurance, specifically for Farmers if that matters. (Dallas, TX) So during a very heavy storm, my car hydroplaned into a barbed wire fence, scratching the fenders, rear bumper, and quarter panels a decent amount. I know that insurance will cover the scratches and painting those, which will mostly cover a paint job for 5/8 of the car. The car is somewhat old and decently worn, so even a color matched paint job won't totally match, and I was wondering if there's any chance of my insurance covering a full paint job to ensure that it all matches. Posted: 25 Aug 2020 07:35 AM PDT My home was hit by a giant storm (a derecho,which is essentially a land hurricane) a few weeks ago. I lost hundreds of dollars worth of food between my refrigerator and three freezers. My siding was also damaged and I imagine my roof and gutters, but have not assessed yet. My brother's home nearby was also damaged in the same storm and is getting his roof repaired soon. I plan to use the same company he's using if he has a good experience, so kind of waiting this one out and letting him be the guinea pig as it's one of the companies that works with insurance for you. All that said, I've heard and read it's possible to receive reimbursement for up to $500 worth of spoiled food due to power outages depending on coverage. I can't find anything in my policy about the specifically though. My questions are:

My boyfriend has decided his truck is not insurable because he has done some work on it and it is so old that insurance companies will require a certified mechanic to fill out a form prior to insuring it. I'm trying to help him realize that it cannot be impossible to at least get the required bare minimum insurance. The work he has done isn't crazy or anything, he just reinstalled some of the electrical stuff. I think the horn may not be in working order. Any thoughts on who he could call for more information? Odd Job Business Liability Insurance Conundrum Posted: 25 Aug 2020 11:23 AM PDT New Jersey. I've got a business that connects local residents looking for simple odd jobs - like yard work, lifting an item, etc. - with local college and HS students. It is run with the students being treated as independent contractors. Revenue has been 25-30K @ ~10-20% profit over two months. For the business to continue, I'd like to obtain some sort of general liability insurance. However, these "independent contractors" (the students) don't carry their own liability insurance. They're students, not professional contractors, after all. However, most insurance companies won't provide general liability insurance to a company that technically subcontracts all of its work to uninsured independent contractors. Is it possible to obtain general liability insurance for a business of this nature? Additionally, what other forms of liability and legal coverage would you consider relevant? Thanks for your help. Posted: 25 Aug 2020 11:04 AM PDT I recently canceled my North Carolina auto policy with GEICO after renewing my 6 month policy on the 13th of July, they gave me my 15% back for their covid-19 relief. I ended my policy after making a payment as well as paying an outstanding balance. I checked my email Sunday to find that they are now charging me an additional balance due in just barely a week. I called to ask why and their agent informed me it's due to the relief they gave me. As in, they're now making me pay it back. I thought that was outrageous so I called my bank about it and they advise I do not pay it seeing as they gave it to me as their "giving back because covid schmeal." They advised that I make sure they can't automatically take it. But from a legal standpoint can they do this? I tried looking through their giving back page and couldn't find anything saying if you cancel your renewal they'll take the money back. Any help would be great. Thank you. [link] [comments] |
