My friend showed me a picture of the girl and her mom and I have never seen these people in my life, nor have I ever tried to coerce anybody to have sex with me in a park. Recently I have had the feeling that my reputation had been slandered around my town. Odd things started happening like when I went to apply for a job and they heard my name they denied me immediately with no explanation. If this lady truly has been spreading these false accusations against me, and it has ruined my reputation oh, what can I do about this besides move away? These are serious accusations and I don't want this person to get away with this. Update: so I found out who it was. It was my friend Maddie who was 16 at the time and I was 24. We were just friends completely as innocent as that I had no other intentions. We went to go get frozen yogurt and when I brought her back I got a text from her saying that her dad said she's no longer allowed to hang out with me. I said that was really dumb but I understand why and I'm very sorry and that's the last time I spoke to her. And now it's actually her stepmom that's married to her dad that is doing this. Her actual mom is a very dear friend of mine and would never ever go against me like that. If anything she would want her daughter to marry me one day when we grow up. WHEN WE GROW UP. My sister and I are American citizens, but my mom and dad are Chinese citizens. My dad also lives in Texas. They are divorced, and my mom has full custody of us, but my dad has visitation rights. My mom is also currently unemployed, and has no job offer in China. However, since we have relatives in China and she thinks that the American education system is a failure and instilling us with "anti-chinese views", she wants to move us to China with her. She also thinks America is horrible and loathes living here. My sister and I don't want to move, as China is completely different culturally from the US and we also have friends and are comfortably established here in the US. We also have limited knowledge of Chinese, and we barely know anyone in China asides from a few older relatives. I have already shed many tears trying to convince her to stay, but today she booked tickets for us leaving in December. I would like to do something to prevent that from happening by then. I would like to know if it is even legal for her to move us out of the country like that (literally just booking tickets to China and nothing else), and what our options are to stay here (potentially with our dad) and what the process would be like. Laid off, not furloughed. Called to work Posted: 07 Jul 2020 03:37 AM PDT Hey everyone, this is my first post in this sub. I worked part time (full 29 hours) at a Radio Station in Albany, NY. Before COVID hit, my hours were 9-3 everyday doing promotional giveaways, social media, PR kinda stuff. When COVID came around, my company decided to save money by terminating me and taking away any access I had to the building, email, or anything regarding that nature. So I was not furloughed, but actually laid off. When I got that news, I went down to live with my fiancé in the military that was stationed in a different state. I also have been getting unemployment from them. This week, I was called by my boss to offer me 3 weekend shifts for about 15 hours total every weeknight. (Obviously different shift than what I was used to) I declined. I stopped filing for unemployment since I thought I was being asked to come back, but my boss told me that in their system I have been terminated since March. Am I still able to file to unemployment after all that happened? I am currently in Florida with my fiancé still and looking for work but I am an NY resident. I just am not sure what to do. How do I fight the DMV, over something that I didn't do, when they won't even answer me? Posted: 07 Jul 2020 07:49 AM PDT I am having a bad day. This morning, I attempted to change my address on the Virginia DMV website. I was then met by the shocking news that my license has been suspended. I was immediately confused. I haven't done anything wrong, I've paid all my tolls, my record has a mild speeding ticket from 4 years ago on it, but otherwise is clean. After further review, it was determined that the cause of this suspension is that I need to provide proof of insurance on my 2003 Nissan as of February 4, 2020. The only issue is, I traded that vehicle to a dealership in November of 2019. My insurance was immediately updated at the time of this transaction, and my plates were surrendered to the DMV, before COVID shut everything down. Now, I can't get any response from the DMV. They are asking me to pay $650 to reinstate my license, and obtain an SR-22-- on a vehicle I no longer own. I could make an appointment to come into a branch, but their soonest available is not until Mid-September. I have requested an administrative hearing, but have not heard anything on that yet. Posted: 07 Jul 2020 11:51 AM PDT My employer is reopening after COVID, but is instituting a health screening before anyone is allowed to enter the office, which is awesome. All employees have to be working in the office by 31 July unless they have extenuating circumstances, which I do not, so I am required to go in if I want to keep my job. The COVID health screening my employer is using includes a smell test. It's a pretty great way to screen for COVID, but I can't pass it. I lost my sense of smell when I was kid, and cannot pass a smell test, not because I have COVID, but because I haven't had a sense of smell in years. Because I can't pass the test, I'm not allowed in the building, and so am not allowed to do my job. I've tried explaining this to my boss, but it's a building security thing, outside the control of my particular company. The boss has gone up the corporate ladder to see if this counts as an extenuating circumstance, but I've been told that the odds aren't good. I can provide all the documentation about the surgeries I had to try to fix my sense of smell, but it's not expected to work. I'd rather not lose my job, but it is a weird case. Is lack of a sense of smell a disability? Would me continuing to work from home since I can't pass the COVID test be a reasonable accomodation? I'd like to understand what my options and protections are. I'm all for public safety, but equally, I don't want to lose my job. I got my settlement which wasn't much but every bit helps, anyway i just moved into an apartment with the same friend, and I wanted to get something i felt safe in. we know nothing about cars, Anywho we went to a dealership only owned by 1 guy who also is the only worker. I got some volkswagon Passat 2006 105k mi for price in title, and test drove it, it was like being in a comfy boat, nothing seemed out of place. so i bought it as is and was driving it around, everything seemed fine. day 4 the engine light came on and i took it to volkswagon shop and come to find out, not only would it take 15k to fix because it needs an engine rebuild and timing, but he cleared the code for the engine light and he wont take the car back This being in the everett area of washington state. Now I don't know what I can do aside from filing small claims that wont pickup or respond to my emails. He already could not take care of himself before catching covid. Side note to this story - my grandpa is a piece of shit. He's a lying, cheating, abusive racist who has abused my grandma in every way possible for the past 65 years. My uncle has followed in his footsteps. Grandma was released a couple of weeks ago and my dad went up and took care of her. She knew she wouldn't be able to take care of my grandpa by herself at home. He in unable to get up himself, is a fall risk, cannot go to the restroom himself, etc. The cost for an at-home nurse is $16k/month and they can't afford that so the only option is a nursing home. My grandpa is still testing positive for covid so he can't go to any nursing home yet and was in extended nursing care at one of the local hospital systems. My dad, two of his other siblings, and my grandma have power of attorney for my grandpa and are the only ones who can make decisions for him. According to the social worker, this morning, my alcoholic, unstable, abusive uncle (not power of attorney) called the hospital, LIED and told them he was MY dad. They didn't check any ID or anything so my uncle took my grandpa from the hospital and brought him to my grandmas house. So now my grandma has to stay at one of my other uncles houses because my uncle and my grandpa have taken over her own house and she can't take care of my grandpa. She is ready to go the legal route against the hospital, my uncle, and my grandpa. What options does she have to get her house back? What options does my dad have for someone pretending to be him? My university announced that all coursework will be completed online this year, and shortly after the ICE announced that students taking only online coursework won't be allowed to re-enter the country. I understand that this is not final, however I'm trying to explore my options. I have a lease starting on September 1st, and if the ICE decision stands I will email them in a month or so to try and get out of my lease. Is there any legal stature that I can leverage to get out of my lease? (e.g. I'm not allowed entry to the country and it's outside of my control as I have a valid F-1 visa) In the case the ICE decision stands and I am not allowed out of my lease, would I have legal defense under a particular law if I don't pay my rent and my landlord (a company) sues me? He hired a private property manager and I have his emergency phone number and email and the landlords email only. I did a walk through with the property manager on May 26th where he stated no issues and that it was so clean they wouldn't have to hire a cleaning company. I sent my forwarding address to the landlord May 26th. The last communication I got from my landlord was June 15th where he asked for my venmo to send the money. I sent it his way and never heard back. The property manager and him have been both ignoring me. The security deposit is $800 and for someone who isn't working this is a lot to me. I have contacted Iowa Legal Aid and I don't qualify for their assistance since I have too much in my savings (only 6k which goes fast with no job). I have relocated from Iowa to Montana. My landlord lived in NYC. I don't know how to do this and I really want advice. I don't want to let my landlord get away with it especially with how awful he was with communication the last 6 months including having people paint the building and front porch so I couldn't leave the apartment without telling me, not making repairs, not plowing in the winter, etc. I even got declined on rental applications when trying to relocate to Montana because he wouldnt return emails recommending me when I never had ANY issues with paying rent, the apartment, noise, ANYTHING. My ex frequently uses his grandma for childcare during his time with the kids. This has never been a problem in the past. Recently, however, his grandma has taken on responsibility for another little boy in their extended family (10, M). This boy was forcibly removed from his home by social services because he sexually assaulted his younger sister (6) and attempted to assault another small child in the family (5 or 6). This boy has many, MANY behavioral and mental health issues including a history of torturing animals and attempted arson. I am not privy to his legal interventions or treatments, and examining the sources of his behavior are beyond the scope of this post. For now, all I know is that I do not want him near my children. I believe he is too dangerous. I do not think my ex is taking this seriously because the offender is a child still. I do not care that he is a child, I still think he is a threat to my children. My ex still wants to use his grandma for childcare out of convenience, since she is closest to him, even though there are many safer options. Is there any legal action that I can take to keep my children away from this kid? She works as a caretaker for mentally disabled individuals who have an array of behavior issues (incontinence, violence, theft, etc. the type of behavior of someone you don't want in your vehicle). The company she originally worked for had clients ride in vans or take the bus. The company that took over still has company vans but apparently doesnt want clients on the bus anymore. The company is now saying staff must use their cars to drive around clients or they will be forced to work graves. She never agreed to this when she initially started working there and the new company just implemented this months after taking over the old company. The buyer opened a case against me saying that their was a problem with the item. I know I should of got him a return label sooner, but eBay sent me a message saying the case was being put on hold for them to get more information from the buyer, so I thought that meant that I should just wait for further instructions. eBay gave him a full refund before he sent the item back to me. I have since paid for and provided him with shipping labels (which have costed me around an additional $100 dollars since it was a large item). The buyer refuses to send it back. eBay agrees that he should send it back, but will not do anything to make him. I would like to either get my item or payment back from the buyer. I figured hiring an attorney would most likely be more expensive than it is worth. Would it be legal for me to send him and invoice and report him to collections if he does not pay for it? The rental is in a duplex and there is a parking area for 8 cars between the house and the one next door. The landlord told me when I inquired about the property that the rent did not automatically include a reserved parking space in the parking area, mentioning that many of his tenants don't have cars, but I could reserve one for $25/month. I agreed and the lease states "Landlord agrees to furnish one (1) parking space for Tenant's use for Tenant's expense of twenty-five dollars ($25) per month, due on the first calendar day of each month. Tenant is assigned parking space number ONE as designated my parking lot signage and paint. Tenant agrees not to park in any non-designated parking space except the stall assigned. Tenant agrees not to park in parking area any vehicle that is not licensed, insured and fully operational." I received notice via email last Friday that the parking space I was assigned is no longer available, that I will not be charged $25/month for parking, and that I should plan to use on-street parking (which is over a block away at its closest, but on street parking is heavily used in that area and I may need to park even further to find a space). This was extremely important to me as a renter because I am disabled and use a wheelchair, so I need safe and reliable access to parking very close to my home for my van. In my previous rental the parking was unreliable and I was sometimes stuck with on-street parking, which due to the nature of Iowa's snowy winters left me stranded in the street several times trying to get to and from my vehicle. I am not able to easily transfer from my wheelchair to a vehicle and my wheelchair is not collapsible; safe access to my own van is critical to my independence. The parking situation at my current apartment complex was the sole reason for moving, and the assigned parking space was crucial to my signing this particular lease vs some other place. I have spoken to the landlord Friday, yesterday and today. They were apologetic at first and said the reason the parking is no longer available is because the parking is technically attached to the plot next door, but they have sold that property. I have asked if I could rent the space from the new owners, but the new owners apparently plan to remove the parking area altogether and build a garage, so that will not be an option. I have asked the landlord to nullify the lease since they are no longer able to provide the parking space the lease outlines, but they are saying the rest of the lease still stands regardless of the parking and that if I no longer want to live there, I will be responsible for rent until a replacement tenant is found. Word is going around that we are planning on opening up to the public at the end of the month. However, their is uncertainty about if we are legally allowed to deny entry to those who refuse to wear a mask. To my understanding, under the ADA Sec.36.208 Direct Threat, if an individual possesses a direct threat to any individuals health and well being, services may be denied if reasonable accommodation may be made. It is also supported by the fact that the Commonwealth's Secretary of Health and the Governor has expanded that masks must be worn in public as well as in businesses. I'm trying to clarify this. We have a clear sign outside that patrons entering our lobby for curbside pickup must wear a mask, and our reasoning is that the expanded mask order given last week protects us legally to do so. Posted: 07 Jul 2020 06:29 AM PDT New Jersey - I received a letter from the Water company 7/3/2020 that stated that between 7/1/2019 and 12/31/2019, the drinking water tested positive for copper and lead, and failed the state standards for pH level 43 days over a 6 month period. (pH as low as 6.7) The letter also went on to state that the acceptable max days for failing pH is 9 days over a 6 month period. Since September 2019, I have been having diarrhea consistently. About 1-2 days per week on average. I have not felt well in months. I have felt lethargic, and have called out of work a few days (I never call out) to stay at home and basically be glued to the toilet. I did not see a doctor, because I thought my feeling was due to poor diet. (I also do not have health insurance) I changed to a much healthier diet with less carbohydrates, greasy foods, more water and less coffee. It did not make much difference. I use a Brita water filter pitcher... Approx 6 months ago I noticed green residue in the bottom of the pitcher. I was grossed out because I'd been drinking the water more often to try and get higher water intake daily. I changed the filter, cleaned the pitcher- but a few weeks later the green came back. I had to change the filter and clean the pitcher because of green residue 6 times over 6 months. Earlier in the year, I looked up symptoms of algae in drinking water and saw GI / abdominal issues. I thought this was what was causing the GI issues I've been having. I thought the solution was to be more diligent about algae in my water filter. Now, in July of 2020 I see that there has been copper in my water for the last 1 year. It explains the green. When copper oxidizes it turns green. In the letter from the water company, they advise not to drink the water even to this day. I can copy the letter and paste it here (but right now I'm at work) My question is: What are my chances of winning a civil suit from the water company? What kind of information would I need to present to a lawyer? I see that civil suits against water companies in other cities with worse problems still haven't been resolved, which makes me pessimistic about this. Either way, after getting this letter from the Water Company which advised to Not drink water (even if boiled) - came in July 2020 - where the testing was from July-December 2019. Forced to move out of rental house due to bat infestation (Michigan, USA) Posted: 07 Jul 2020 07:34 AM PDT Please excuse any brevity here, I'm writing this with a small screen and big thumbs. My wife and I moved into a rental house in the middle of May as our apartment lease had ended. We are excellent tenants and have never had a problem renting. We had a few small issues when we moved in, which we brought up with the landlord and were promptly fixed. A few days into living at our new rental house and a bat finds its way into one of our kitchen cupboards. This was 11 at night and I wasn't about to call a pest expert so I put on some thick leather gloves, grabbed the bat and put it outside. We inspected how it got into the cupboard and found a six inch gap in the top back of the cupboard that was open to a cavity in the wall. Apparently there was an old chimney that was built into the wall as well as a roughly 2 foot by 4 foot void in the wall, going from the basement to the second story. We sealed up the entrance into the cabinet and disinfected the kitchen. We also asked that the landlord have a bat expert come out since we could hear them scratching in the roof. The bat expert shows up the next day and puts several one way tubes in for the bats to leave and never come back. Ok great, or so we think. They tell us it may take some time for the bats to leave, but this should work. For the next month we continue to hear the bats every night, our bedroom is in the finished attic space, right by where we hear the bats. We contacted the landlord again about having a bat expert come out, she says they are going to come, but they never show. Next, we are preparing for a Fourth of July vacation and notice a bug on the bed while packing. I kill it, but not before taking a picture so I can identify it. It turns out to be either a bed bug or a bat bug, they can't be distinguished without a microscope. Because we know there is still a bat problem we assume it to be that, but are now starting to get very nervous about the extent of the bat problem. We go on vacation to try and clear our heads and come back a week later. First things first, I checked the bed for more bugs, and we find several more in the bedding. Cue the night of almost no sleep and constant anxiety. We contacted the landlord again, asking that she have someone come out for the bats, and now the bugs. We haven't been contacted back for a day and a half now. We are now very concerned and don't want to rely on the landlord for our health and safety. We pay $210 to have a bat expert that we vetted come to the house and do a thorough inspection. What they found was horrifying. Bat poop everywhere in the walls of the second story, bat poop in the basement, they said the smell we attributed to the 100 year old house was from the bats. They said the remediation for a roost of this size is to gut the upstairs. We made the call that it was time for us to not be living there to protect ourselves. Thankfully, we have somewhere close to stay where we are thoroughly washing everything to not risk transmitting the bugs anywhere else. We have held off on contacting the landlord again until we consult with an attorney, we want to have a strong approach when we do. My questions... 1. Will we get our security deposit back? 2. Will we get the rest of our July rent back since we had to move out? 3. Will we be able to nullify the lease? 4. Is there any grounds for reparations due to having to move out because of an infestation? The bat problem has been going on for much longer than we were there, they've tried evicting the bats in the past, so they knew they were there. The landlord made a comment to us before moving in saying "oh I wouldn't live upstairs if I were you" even though the upstairs bedroom was clearly the master. To keep in touch, we have several WhatsApp groups. Some are based on different regions where people live now so that they can meet from time to time, some others are based on topics, such as technical discussions, sharing investment skills, and so on. Some groups serve no purpose other than general conversations. We have a classmate (let's call him FS) who kept on bringing up themes that everyone else found completely distasteful (such as virtues of cannibalism, just as an example). FS either completely ignored or pooh-poohed everyone else's requests to move on from the topic. Not only he'd always be on one distasteful topic or another but he'd also keep posting dozens of very long messages every day. Eventually, people formed another group for general conversations and did not add FS to the new group. When FS came to know about it, he went all out in his campaign to be added to that group. While the group has many admins, he decided to pick one as the target. That target, as you can guess, is me. My first reply was polite with letting him know that while we liked meeting him in person, we found his online behavior to be atrocious. I even offered to organize a get together for him if he ever visited my region, New England; He's from Texas. FS is from a religion that is a minority in the US. We do have other people in various groups that are from that religion and some other minority religions and we did not have any problem with them. FS accused some others and me of bigotry. Having tried enough tactics, which included pointing out his behavior as the cause and at times matching his fire with fire, I blocked him from communicating directly with me. And that totally took care of the whole problem... Not! FS continued his barrage of trolling and threats in other groups and he was removed from almost all of them. Some of these removals were taken care of by me. There was widespread agreement on this course of action. At times, he even mentioned he knew where we lived and would take care of us. He also threatened to take various actions including legal ones. He also claimed to have ongoing discussions with "senior management" of WhatsApp, which has been a nice comedic relief. This has been going on for 1.5 years. Now, FS has sent me a letter that he has himself drafted and it's written like a legal document but is full of gibberish. He's threatening to sue if I don't resolve the matter within 45 days, which -to him- means adding him back to all groups and putting up with his behavior. I'm happy to ignore it. But it's known that he once sued his employer on frivolous grounds and lost $14K in the process. He lost the lawsuit. So, at the very least, he can create nuisance and financial loss. Posted: 07 Jul 2020 12:39 PM PDT Hi all, I'm looking for what my options are in this unfortunate situation, made worse by COVID. I set out to make a purchase for a necklace online, which in hindsight, may not have been the smartest thing to do in the first place. But it was our wedding anniversary and my wife really wanted this necklace from Tiffany and Co with value of 876 dollars. I placed the order on May 14, 2020, and according to the tracking number provided to me, Delivery was estimated to be for 5/22/20 due to "delays" due to COVID. Of course, I am curious and so I check on the status of the order each day by manually putting in the tracking number through the UPS website. And to my surprise, I find a status update on 5/21 morning stating that my package had been "Delivered" on 5/2/20 - 9:53 PM. The funny thing is I had been home the whole time and there was no buzz on the intercom (I live in a gated apartment complex with an intercom where the delivery drivers can dial our apt number to connect with us). There was no call or notification, just a surprise the next morning that something was delivered oddly so late after hours. I of course rush downstairs to check the mailroom as soon as I find out, check the hallway outside my door and there's no package to be found. Of course I panic and realize that something was fishy here. Why would they be delivering so late, and why is there no confirmation of receipt of delivery? I immediately call Tiffany and Co customer service that morning 5/21 to formally file an investigation and after much back and forth between the merchant and UPS, UPS is claiming that they track their drivers with GPS and that the driver drove by my apartment building that day. Tiffany and Co initially agreed to refund/replace the missing item, but I never got the refund credited to my account. I call them back to follow up and after some delay, was just informed this morning 7/7/20, weeks after the initial missing package, that "senior management executives" later retracted that offer to replace/refund my item. Unfortunately, there is no CCTV footage available through my apartment for that day. Due to COVID, UPS is claiming that they cannot collect signature on delivery of items and Tiffany is saying that they don't routinely even require certification of delivery unless items are worth over $5000 in value. In this situation, is the responsibility up to the supplier, the delivery company, or the customer for the missing goods? How can I remedy this problem? [link] [comments] |
Intolerable Smell From Neighbors Apartment Posted: 06 Jul 2020 06:48 PM PDT I am renting an apartment in Upstate NY. It is on 3rd floor (top) with a single neighbor across the stairway. I was living here just fine for 3 years. About 3 months ago a new neighbor moved in on my floor. Within a month the stairwell began to reek. I am not talking about someone cooking fish, I am talking gagging, raw sewage, decomposing corpse level of stench. It has gotten so bad that it seeps into my apartment through 2 locked doors with a dumpster at 100F heat level of stench. I am not someone who ever complains about neighbors or talks to the landlord so I waited maybe too long to contact the landlady. She tried talking to the guy but he would just lock door and not come out, when she finally got in there she found mountains of rotting trash cluttering the apartment. Since then a month has passed but nothing improved. She told him to clean the apartment but he is unwilling or unable to do. There is adult protective services and some kind of social worker involved (I am sure there is mental illness in the picture). The landlady is pleasant and communicates, she even gave me July off rent. But seems unable to resolve situation. I was about to renew the rental and have not signed the agreement. Speed up unemployment determinations Posted: 07 Jul 2020 12:27 PM PDT Not sure if this belongs here but I'm not sure where else to ask. I got laid off indefinitely due to COVID. I was on unemployment for a month or two while searching for jobs. I had an interview set up through and old co-worker and I just assumed it was for a similar position that I was just in. I nailed the interview and got a job offer but after reading through it I realized it wasn't exactly the same job I thought it was and didn't really align with my career path. I had 2 other interviews later that week so I was happy to decline the offer. Unfortunately the other 2 positions did not take me. I reported to my unemployment (Wisconsin) that I turned down a job offer because "it was not the job advertised and I was not qualified for the position". Since then, all my benefits have been placed on hold until a resolution has been determined. This was 1 month ago. I called the unemployment office and asked if it has been reviewed yet and they told me that due to the surge of people claiming benefits it can take up to 5 or 6 months. Unfortunately I cannot wait that long. I haven't gave up on my job search but it's difficult during this time for my field to find a job for someone with my experience (graduated college only 1 year ago, so still fairly inexperienced). Is there anything I can do or say to have them speed it up or move mine up the list to be reviewed? This is through Wisconsin's unemployment services. Thanks in advance. TLDR: reported that I declined a job offer to unemployment and was told it could take 5 or 6 months to find out if I will continue to receive benefits.
