Roofing company accidentally did work to my roof

    Posted: 31 Jul 2020 12:00 PM PDT

A roofing company did work on my home instead of the home next to mine.

This is a rental property of mine and the tenant was not home during the times the work was done. I was contacted by the roofing company that they had accidentally worked on my roof. They told me that they can give me a good deal for this error and i refused saying that they did the mistake and i didnt ask for this to be done to my home.

they told me they have the right to remove all the work done because it's their material. I told them they are not to come back on my property or else I will call the cops. They have been constantly calling me to pay or they want to take all the roofing off as it is their material and they are entitled to it.

do they have the right to remove the shingles? do i have to pay them or can i simply tell them to fuck off

(MA) My elderly father was laid off in a position elimination three weeks ago. 24 hours ago they posted that they are hiring for the same position.

    Posted: 30 Jul 2020 04:51 PM PDT

    (Massachusetts)

    Hi all,

Need a bit of guidance here. I am writing this on behalf of my dad.

Three weeks ago, he received a call from HR letting him know that he is being laid off due to his position being eliminated. I work in HR, and probed him for a bit more info - he forwarded me the emails from his HR rep, which indicated that about 80 employees were impacted. My dad just turned 65, and the other employees impacted that he is aware of are older.

I asked him to ask his HR rep for a list of impacted ages and positions. Based on the information provided from him, it seems his HR Dept would be required to send this over according to the Older Workers Benefit Protection Act. The HR rep explained that this wasn't a large-scale layoff, and that each layoff was an individual situation (unsure what this means) and that this was a position elimination. He asked her again through email and she again said no.

About an hour ago, we saw that his position (incredibly similar yet reworded) was posted. He signed his severance agreement two days ago, and it appears that it was posted immediately following. He has seven days to retract his agreement. If it's relevant, my dad was basically a superstar at his job and received glowing performance reviews.

Really looking for advice here. My dad is at a loss. Thank you.

Edit: We will be reaching out to lawyers tomorrow. Thank you to everyone that contributed and continues to contribute, we appreciate all the advice that is coming in. And thank you to the kind soul for the gold, which my dad is ecstatic about (he is not familiar with Reddit) - I let him know that someone liked his post so much that he received a gold medal and he keeps asking me about it. So thank you for making his day, especially during a stressful situation.

Edit 2: thank you everyone for the well wishes and the advice. The majority of support here has been overwhelming. We have been in touch with a local lawyer and I will update in the future once we come to a resolution.

My girlfriend's workplace took back $720 of hazard pay ("COVID leave") from her paycheck for not staying home. What can she do in response to get that money back?

    Posted: 31 Jul 2020 10:12 AM PDT

She works as registered nurse. They are now claiming that since she did not take any time off work due to COVID that they have the right to take back her hazard pay.

Is this legal? Is this illegal? This seems suspicious and completely unfair.

What can be done to address this? Thanks.

Follow up: My former employer owed me ~20k worth of salary

    Posted: 31 Jul 2020 09:54 AM PDT

This is a follow up of https://www.reddit.com/r/legaladvice/comments/f8sbki/my_former_employer_owed_me_a_few_months_20k_worth/

I've filed the LS223 claim 2 months. But I haven't heard from NY state. I have been having on going email exchange with my employer who owed me money, especially after seeing that they had a 2 million series A fund raising recently. The employer said he will start paying me back in August over the next 3 months.

I was mindfully excited because by saying that in an email, he is acknowledging that he owed me money, and 2. he was planning to pay me back.

However, today I emailed him, and he didn't hear from him again. I feel like he is ghosting and I am very worried. And since I haven't heard from the state about my case, I am so hopeless and lose. :(

    Anyone can help me?

Money was accidentally deposited into my bank account, the intended receiver now demands it back in cash.

    Posted: 31 Jul 2020 10:25 AM PDT

South Carolina. Due to corona, all college students at my college got refund checks as direct deposits; reimbursing us for our second semester housing costs. My suite mates refund was deposited into my account along with my own due to a school error. I never noticed it until his father called me demanding the money back in cash. I know the money is not mine and I have no right to keep it and have no intention of keeping it. The problem is he lives far away, far enough where I don't want to go there to give him cash. I have explained to him I am willing to either transfer the money through our banks or some other way without having personal contact with him but he just isn't having it. He has threatened to take me to court when I have been as helpful as I can to him. Should I record a call between us of him declining the money via transfer or any other way to prove to somebody that I am not refusing to pay him? What steps should I take. Thanks for taking the time to reply.

Husband owns sole proprietorship REFUSES to switch to LLC or incorporate. How can I protect myself?

    Posted: 31 Jul 2020 08:44 AM PDT

(TX) on mobile sorry for bad formatting and grammar.

The title sums it up. We are in a community property state. Recently he has made a couple of bad business deals that almost put us in a really bad position financially. I have my own job and make decent money. We have 3 cars, a house and other small assets (a couple of cows, motorcycle, stocks, 401K).

How can I protect my income, 401K, stocks, car, and maybe even (our) house in the event his business is sued for whatever reason?

His "reasoning" for not switching is that there are too many tax breaks as a sole proprietorship even though I have shown him he could switch to an LLC S-Corp and have the benefits of the LLC and pretty much keep operating the same way with the exception of filing some extra paperwork for taxes.

Landlord charging an additional fee and refuses to explain what it is for.

    Posted: 31 Jul 2020 07:31 AM PDT

This is in Alabama. Several months ago an additional charge showed up on our account for what my roomate and I owe for the month. We asked our landlord why this charge was there and they said they would look into it and get back with us. They never got back with us and have not responded to the numerous emails my roomate has sent since then. We have called the office multiple times and the leasing agent tells us that she will let the landlord know we called and have her call us back but we still have not heard from her. I refuse to pay anything beyond my usual rent and utilities (especially when it is now in the hundreds of dollars with late fees added) without knowing why we even owe it. We are going to try just showing up to the leasing office and hope she is there and willing to talk but I doubt that will work. Does my landlord have a legal obligation to communicate with us about why we owe this additional charge?

    Husband walked away from mortgage

    Posted: 31 Jul 2020 06:06 AM PDT

Husband and I separated 15 months ago. He moved out and stopped paying the mortgage. Our divorce has been delayed by Covid. I've asked him to sign the deed over to me so that I can refinance and save money with a much cheaper interest rate. He refused and stated he was going to "get the equity out of the house." We've only owned the house 3 years and have maybe $35,000 of equity in the house. How do judges rule on things like this? I've paid out over $22,000 of mortgage payments myself. This is in Florida

(NV) I was furloughed at the beginning of April and unemployment still hasn't processed my claim.

    Posted: 31 Jul 2020 10:19 AM PDT

I was placed on furlough and was assured that I'd be eligible for unemployment. Once my furlough started I filed an unemployment claim and went through all the steps. I had to file a couple years ago so I knew how to do it. I have been filing my weekly claims every week since then but still haven't received any payments. I have tried more times than I can remember calling customer service to find out what the issue is that's making it take so long and I finally managed to get through to the first agent about 12 weeks after my initial claim. She immediately placed me on hold and then disconnected me. I was unsuccessful with getting through to another agent for a week. Now on week 13 I spoke with another agent and found out that the delay was caused by them needing my start and end dates for the last company I worked for.

There were no letters sent to me and in the part of the webpage that says "issues delaying payment" there was absolutely nothing there that would have told me they needed this information. It was literally just sitting in pending for no reason for several weeks until I called and asked why. The lady was very rude with me and wouldn't explain how this could have happened. I needed to find a date and we scheduled for her to call me back at 2pm that very day. Well, it's been three weeks. She never called me back and I have been unsuccessful in getting through to another agent. I call every single business day, multiple times a day. Sometimes I call upwards of 100 times a day just for their automated message to say they are busy and to call back later.

Is there anything I can do legally to get them to process my claim? I am literally out of money. My back account is almost at $0. I have two kids, one of which is a baby. Yes I have looked into programs but I am not going to accept unemployment not processing my claim laying down.

[NYC] Landlord claiming he sent my security deposit IN CASH by postal mail to my new address. Three weeks have gone by and I have not received anything. The landlord has texted me that it "sucks to be a little girl like you". What must I do?

    Posted: 30 Jul 2020 02:54 PM PDT

My previous landlord is playing games with me and I am very frustrated. I lived in Oswego for a year and have been waiting for my deposit to arrive.

He claims he sent my deposit in cash through snail mail. He also tells me no, he did not certify it and there is no tracking number. He just dumped money into an envelope and mailed it. He refused to send a money order or a check.

There is no way this is the legally correct way to do this, right? I never even had a chance to sign anything! You'd think with such a large amount of money you would have a tracking number for this sort of thing.

GM financial lost two of my car payments and are saying that they were never made. I have the email confirmations from them, and my bank is even saying the payments went through without any issues. I contacted them and several of their supervisors. They are trying to say the information I sent them were forged. they repo'd my vehicle last night due to those payments.

Where do i even go from here? I am supplying bank statements and their very own email confirmations.

Dealership made me deactivate my dash cam before my car would be accepted for service

    Posted: 31 Jul 2020 12:28 PM PDT

    Location: California

Apologies in advance if this is not the correct sub.

So, I have a 2018 BMW M2, that needed to go in for annual maintenance last week at the dealership. When I brought it in to the service drive, all appeared to be normal, but before I got into the loaner vehicle, the service adviser came over to me and asked if I could take the dash cam down. I asked her why they needed it off, and she told me that it was because it could potentially take images of the other cars in the service lot.

Instead of pulling the unit out, I just disconnected the USB power cord from the port in the center console. But, this is the 4th time that the car has gone in for service since I bought it and it was not an issue during those other times.

Is this a common thing for dealerships to do, or am I just overthinking things?

(FWIW, I have a Waylens Horizon with the wireless OBD II telemetry module, so it will record data in real-time)

My friend’s ex boyfriend used her sensibile information (birthday and social security) to open a phone line to get a new phone without her permission

    Posted: 31 Jul 2020 12:24 PM PDT

My friend has been dating this guy for 4 years and in January they broke up. Just a week ago, she wanted to get off her mom's phone bill and get her own. She goes to her cellphone provider and they say that she actually has an account. With the address attach to it and the credit card, we understand that her ex opened the line UNDER HER NAME AND WITHOUT HER PERMISSION. She already spoke to him and denied. In the end he broke and admitted that he did it. She got the phone back and blocked the line right away. (Also checked if the phone was the same in the bill)

Now, is there anything else she can check that maybe he used her name and social, and she still doesn't know about it?

She already checked her credit and, at least, there is no new credit card or anything that Credit Karma can tell her.

Also, anything my friend can charge him for if next time we find something under her name (without she gave any permission for) that the police can question him right away?

Now she has a blocked phone and a charged bill of 700$ because of the phone bought by the ex. Can she get rid of the charge someway?

    This happened in Florida.

Edit: add location and more information

Split inheritance 50/50, then found out parent didn't want that

    Posted: 30 Jul 2020 11:58 PM PDT

My parent passed away 28 months ago. Their living trust said to split assets 50/50 between me and my only sibling. And, it turms out, the assets were never put in the name of the trust. But the beneficiary distributions of the assets were set to 50/50. So my sibling and I each received our equal shares shortly after my parent's death.

A few weeks ago, while cleaning out old boxes of paperwork and files my parent left behind, I discovered an amendment to the living trust. It said that I was to receive an extra amount that my parent had already given to my sibling years ago to help with a downpayment on a house. The amended trust was completed by an attorney and notarized.

Then, to make the waters even muddier, I discovered a signed, subsequently dated handwritten note from my parent saying I was to be the sole inheritor of all assets and take over as the executor of the trust (after a fight, my sibling told my parent that she wanted no inheritance, asked to be removed from the trust, and no longer be its executor).

My parent had a shitty lawyer, I'm learning. Never advised to actually put assets in the name of the trust. Never advised to change beneficiary distributions of those assets. All I have are these newly discovered documents expressing my parent's wishes.

Is there anything that can be done to change the outcome at this point? Thanks in advance for any insight or direction. This is stressful.

Edit: sorry, I didn't include my location - California

[RI] Neighbor’s camper set up in yard appears to be leaking waste water, smell is evident from my property.

    Posted: 31 Jul 2020 11:40 AM PDT

My neighbor has a tow-behind camper trailer set up in his driveway. I believe someone (family of his) is living in it, but that is beside the point. It has become clear over the past few days that some waste water is leaking from the trailer and onto his driveway. This is on the side of the trailer that faces my yard. We live in a densely laid out neighborhood so this trailer is all but 8 feet or so from my back deck. We can clearly smell whatever it is that's leaking from the trailer when we are in our yard and it is rather off-putting. Do I have any recourse here, or is this more a matter I'd simply have to take up with my neighbor?

In Ohio, can employers demand that employees do not leave during unpaid breaks?

    Posted: 31 Jul 2020 09:22 AM PDT

I'm trying to find the exact language but so much language in legal documents are hard to follow. In Ohio can an employer make an employee take a unpaid break and at the same time demand that the employee is not to leave the premises? I feel like this shouldn't be legal but what I feel should be legal or illegal isn't always the case. Can anyone help me find the exact language I'm looking for?

    Fraudulent Loan

    Posted: 31 Jul 2020 12:29 PM PDT

[MI] A loan company deposited $1200 in my checking account about 3 weeks ago, which I assumed to be a stimulus check. About 3 weeks late, $240 was taken out of my account and it said that it had gone to the loan company. This was the first time of me ever hearing of them. This loan has 600-780% interest. I never took out this loan and I spent none of the money. I assume what happened was this company got my banking information, made it look like I took out this loan and they are now coming after me for the "money I owe." This company is on an Indian Reservation which is why they are allowed to make the interest so high. My bank doesn't even believe me because I never questioned anything after getting that money, I just thought it was stimulus money. What should I do?

HOA sent a Claim of Lien letter for unpaid annual assessment fee. What can I do?

    Posted: 31 Jul 2020 10:38 AM PDT

I received a letter today from a law firm stating they have filed a Claim of Lien. $798.59 because they claim we haven't paid our $35 annual assessment fees since 2019 (moved in Oct 2018).

We have never been informed that we have a delinquent account. We pay our HOA fees automatically ever my quarter. We have never been notified of this, never been sent letters or received a phone call. I've even spoken to the property manager herself recently to get an approval for something. Not a word about being delinquent on any fees.

What are our options here? The letter states to respond in writing but should we be getting a lawyer? Will disputing it be enough?

Showed a apartment, not the one I got the keys for. What can I do?

    Posted: 31 Jul 2020 09:10 AM PDT

I'm in Hartford, CT, So I viewed an apartment in late June with a August first move in. The apartment in question was occupied and I was told that this would be the apartment I would have, fast forward to today, I sign the lease and get the keys, walk into the apartment and it's not the same. It feels slightly smaller with an older AC unit.

Edit- I don't see a no smoking clause, just that I can't have odors which disturb other tenants, if I have a medical marijuana card can I still smoke?

Ex moved across the country with my daughter and blocked all contact.

    Posted: 31 Jul 2020 12:23 PM PDT

Hi everyone, needing some legal advice, UK based
My ex and I split up in December, we have a 1 year old daughter, just before lockdown started she told me she was moving back home with her parents so she didn't have to live alone with our daughter throughout the whole thing, and would be moving back to the city we live in after it's over as she still pays rent for a flat here, which sucked for me as i wouldn't see my daughter in person for a few months, but i'd prefer that to giving her the rona so agreed.

About two months in to lockdown she blocked me and my family everywhere, told all her family to block me as well etc, lockdown is now over and I've not seen my daughter since mid march, with no way of getting in contact with the ex. I've got no idea where she is living but i'm assuming it's still with her parents, i know the city but not the address.

I've submitted a C100 form but it's taking a long time and I have no idea what the C100 form does, and due to being furloughed for the last 3 months and moving house myself i can't afford a solicitor.

Any advice at all would be greatly appreciated i.e do I have any legal grounds to call the police etc, there was no history of abuse in the relationship or outside of it, and I did an amazing job looking after our daughter.

However just before lockdown she called the police and told them i'd sent her threatening messages but wouldn't tell them what I said, I spoke to the police at the time and read them the messages; they told me i'd done absolutely nothing wrong in any messages sent to her.

So yeah, don't really know what to do.

Neighbors removed a line of willow trees and now water is flowing down his hill and flooding my driveway

    Posted: 31 Jul 2020 12:14 PM PDT

My driveway is technically an easement on his property as mine would be landlocked without it. The issue is with so much water flowing, we are having to get gravel delivered and spread about once every two months to keep the driveway from deteriorating to a point that isn't usable. Do we have any legal action we can take to get this issue fixed? He told me because it is his property, I'm out of luck. This is in Michigan
