The police are asking my neighbors about my sexual orientation?

    Posted: 08 Jul 2020 10:04 PM PDT

    US - Indiana

Okay, so this is a weird one.

I was out grilling this evening and my neighbor in the apartment next door came out. She's in her late 40's/early 50's and unemployed, so she's at home all day. We chatted for a minute and she randomly asked me if the police had managed to get in contact with me. I was confused and asked why they'd want to. She told me that last week, while I was hiking with a friend, the police showed up and were knocking on my door/peering in my windows.

They then approached her as she was sitting on her back porch and asked her if she knew me or knew where I was. She said yes she knew me, and that I was probably out hiking (she knows I do this a lot) but didn't know where I would be. They said okay, and then asked her if:

    1) She knew I was gay (I am).

    2) If I was dating anyone (I'm not).

    3) If I have a lot of guys over (I don't).

She told them she didn't know and that it wasn't their business anyway and to please leave (my neighbor kinda rocks).

She forgot to mention it to me because she hadn't seen me since, and I got a new phone number so her text to me had bounced back as undeliverable.

I thanked her for telling me this and then began to panic. WTF? It's weird and I feel strangely violated - like someone is invading my personal life down to how many people I sleep with? Am I a suspect in something? What would've happened if I was home and answered the door alone??

Who do I contact? Do I get a lawyer? Should I just call the police and ask why/file a complaint?

Edit: Forgot to include this as relevant information but my friend just told me to add it - I'm currently involved in a lawsuit against my City for an unrelated manner. This lawsuit has been in the local paper multiple times.

Being held responsible for mother's Ohio welfare debt from 1985

    Posted: 09 Jul 2020 08:38 AM PDT

I am trying to find out if this practice is truly legal. In 1985 my mother was receiving welfare. She had my sister and I on her case as her dependents. In 1989 she begin working and did not report this to welfare dept. She was accused of fraud, and was taken to court by ODJFS where she was found guilty and ordered to pay the money back. In 1991 she stopped making payment and missed the required hearings and was taken to jail for the welfare fraud case. After jail she began paying on her case again as ordered. She died of cancer in 2011. As of June 2020 I received a letter from Ohio Job and Family Services stating I am responsible to pay the remaining amount of $4000 for her case because I was on the case with her as a child. I am 42 years old and this is the 1st time I am hearing of this, my grandmother got custody of my sister and I in 1990, so whether or not she owes this money is unbeknowst to me. She had no estate or money when she died. I am trying to find out is this legal?

    Suspended for using FMLA.

    Posted: 09 Jul 2020 05:53 AM PDT

I have an FMLA for my husband(non related to covid ). This past month he went through a rough patch. I was home for over a month caring for him. I had been calling out and doing what is required by my company during this whole period. When I went to return this week, I was unable to get into the building. Security said my badge was suspended. I work a off shift so HR was not available to talk to so I went home. When I awoke I had a certified letter stating that i had been suspended and that they wanted me to contact them. They stated that they had called multiple times ( they never left a message and used a non company number) and sent emails to an address i no longer use ( I had updated it in all our systems about a year ago, I had also contacted them the month previous with the year old updated address and received a response). I'm about to call them on the private cell number they told me to call them on( I know right!!) and was wondering if I should watch out for anything.. they have had a very bad reputation as of late.

Is it legal for them to suspend me?

What would my legal course of action be if they escalate and terminate me?

    Thanks for you help!

15yo drank liquor from my house when we were not home and without our knowledge or permission.

    Posted: 09 Jul 2020 10:03 AM PDT

My son's friend (15yo) drank liquor from my house when my husband and I were not home. I was out of town and my husband had ran an errand leaving my son and his friend (both 15) at home alone for less than an hour. When my husband got home, the 2 boys were playing video games in my son's room. Later the friend walked home where he proceeded to get sick and told his parents he had drank at our house.

My husband was quite shocked when the friend's father unexpectedly showed up at our house very angry and confrontational. The friend's father accused my husband of serving his minor child alcohol, threatened to call his family in law enforcement and have them come to arrest my husband for supplying alcohol to minors. My son admitted that his friend had consumed some of our liquor while my husband was out. My son said he did not drink with the friend, which my husband was inclined to believe as my son did not show any signs of inebriation. (but he's 15 too so, who knows.)

In no way shape or form have my husband or I ever condoned, encouraged or even had knowledge of my son, or any other minor drinking alcohol at our home. My husband tried to calmly explain that to the angry father, but unfortunately he was not open to a conversation, continued to yell at and threaten my husband, then tore out of our driveway.

We are in Texas, and like most people we have an unlocked cabinet in which the liquor is kept. I'd like to understand the laws pertaining to this situation. Are we liable for his son's bad decisions? Are we required to have alcohol in our home under lock and key? I'm inclined to believe the actions of the father were way out of line, but would like advice on the matter.

Landlord told me to take my hammock down... publicly

    Posted: 09 Jul 2020 07:19 AM PDT

Hey so I (26m) had something really weird happen.

I've been having issues with my upstairs neighbours because the guy on the lease signed it last year and then immediately left for 10 months to Europe. So we were left with noisy subletters. Recently he came back and was just as loud as they were, until one day I get a phone call from my landlord who owns the building. Her step daughter was my landlord initially when I moved in and I had never spoken to the building owner.

When she called she asked me for a copy of our lease, which her step daughter never sent her for some reason. Anyway, we sorted it out and I explained what we'd been going through. She was shocked and spoke to them about it, and afterward they were quieter, finally.

Anyway, one of the subletters moved out, but the guy on the lease is still hanging on there trying to keep his apartment, even though he'll probably leave as soon as quarantine is over.

So yesterday I'm in my hammock on my balcony. The hammock is tied to two metal beams under the neighbors balcony. This neighbour comes out onto the balcony stomping around and dragging his furniture and I make a light gesture with my drink to let him know I'm below. Then he proceeds to stomp on purpose, which is obvious by now, to upset me potentially. I make a noise back. He does it again. And so I'm just like fuck this guy and start ignoring him.

Out of nowhere someone is yelling at me from the street (I'm on the second floor of three story building) and it's the landlord. I'd never met her in person before and it was like she assumed I knew who she was. She tells me that I can't have a hammock on the balcony, even though it's been there for 2 YEARS. Even before I moved in a year ago, my old roommates had the same set up.

I text her after I take it down and ask why she was so upset and all she says is: "do you have a problem with what I'm telling you"

I said I didn't necessarily, but she should check google street view of the apartment because it has a photo of the hammock from over a year ago. I don't know what that was about, but is it illegal to have a hammock set up? I feel like the upstairs neighbours messaged her about it out of spite or something. She said she'd never seen it before but it's been on the balcony for the last 4 months. The building is quite old and the upstairs balcony looks like it's falling a part with the wood, so maybe that was her concern? The beams holding it up are thick metal and look extremely stable.

Psychological and physical abuse at home

    Posted: 09 Jul 2020 10:56 AM PDT

English is not my first language, just in case.

I'm a friend of a 15yo girl that suffers abuses from his father, mother and older sister in that order generally and very often.

Every day his father goes who knows where and is back at night (Just in time for dinner). It's supposed to be working, but he is not home for much more than 8 hours, and when he is, the only thing that pass through his head is recriminate her because she was "not doing nothing" (She does everything that have to do [And more] when he is not present), then the chain that I've mentioned happens.

Their parents "want" to divorce but they didn't do anything by now.

She lives in Córdoba Argentina. If you can give me at least a place to look for information, I'll be very greatful.

PD: She should take photos of the injuries and record audios right?

PD2: She reads the National Constitution each year searching for something, so you can tell me about that stuff and I'll tell her

I got a Spinal procedure to the wrong disc

    Posted: 09 Jul 2020 09:02 AM PDT

I recently had an epidural to alleviate pain from my L5-S1 disc being misaligned. The notes they sent me home with (which I'm going to ask about at my follow up appointment Monday) indicate that they gave the procedure to my L4-L5 disc instead. The doctor said before the procedure that she knew which disc was the problem and what to do. The pain went down slightly, but not to a significant degree.

Is there anything in particular I should ask the doctor about to make sure I get the proper treatment? If she tries to double charge me to give the correct epidural (if that's even an option still), do I have any claim to injury? What's necessary for a claim?

My original surgeon I got my diagnosis with recommended this procedure and didn't have the proper equipment outsourced me to this doctor.

A software company is constantly bothering my engineering company for using an unlicensed copy of their software. But the Gateway MAC address provided, is nowhere to be found in our office.

    Posted: 09 Jul 2020 06:16 AM PDT

We are a family run engineering company specializing in the maritime industry. This software company reached out to us prior to the covid pandemic with allegations stating that one of our computers used pirated copies of their software. The first communications were from the IT Compliance Agency? Whatever the f*** that is.

Even the manufacturer of the laptop they referenced is not in our inventory. But for some reason, they have one of the email addresses of our company.

Please advise on how to avoid taking this allegation further. As this was not done by our office or employees.

I test positive for Covid-19 and my employer fired me before the leave was up. He claims it was due to not having enough payroll, but i feel i was singled out.

Employer fired me while I was on leave for quarantine. He still paid me the two weeks I was on leave, but I think he fired me so I couldn't get the 10 weeks of paid family leave for my daughter, since she was sick too and we would've needed to stay home to take car of her. Could I still get those 10 weeks of pay or take any legal action for being terminated? Edit: I'm located in Arizona

[MA] HOA trying to ban marijuana inside and out of units

    Posted: 09 Jul 2020 06:58 AM PDT

Hi, /r/legaladvice! Hope everyone is doing well and staying safe! Okay, so to get straight into it, I live in a condo in Massachusetts (marijuana is legal here). Note, I own the condo and live in it to. My HOA is pretty strict and now they are trying to ban the use of Marijuana both inside the unit and on the grounds of the property, medical use being exempt from the ruling. They are also banning growing of marijuana (which i 100% get, it's a fire hazard and potentially a water hazard depending on your method of growing). And i get banning it on the grounds, such as outside, because i get the smell can be unpleasant. But here is what is getting me, can they really ban the use of marijuana inside my own condo? And do you think I could have some sort of discrimination case against marijuana users? since it is the only type of smoking they are banning.

I have called several lawyers, one said they don't deal with HOA's, another said it sounded strange but doesn't take marijuana cases but gave me a name of a pretty good firm. But turns out that firm is representing my HOA, so here I am!

Please let me know if i should put a NSFW tag on this post due to the topic

Edit: I just want to thank everyone who responded! I had strong feeling that I did not have much to go on. But I really appreciate everyone who responded! You the bestest! Stay safe everyone

I think my job is affecting my lung health, is this legal?

    Posted: 09 Jul 2020 10:48 AM PDT

Hi! I'm so sorry if this is the wrong place to ask.

I am a sales rep for a beverage company in Florida. I work in the small accounts side of the business. I go into corporate and independent business gas stations primarily.

I have no idea how they pass heath inspections but of the 30 independent accounts I have, at least 5 are absolutely disgusting. Black mold and rodent and insect infestations are the biggest issues. When I say black mold, I mean I have one account for example where 50% or more of the walk In cooler ceiling is covered in a solid layer.

I'm required to go into all of my accounts and beyond selling I must stock, rotate and otherwise manage my product. This requires me to spend anywhere from 30 minutes to an hour plus in these stores and their walk in coolers.

I was recently out of work for a couple months on workers comp due to an injury that occurred on the job traveling between accounts. Before this, I remember having frequent shortness of breath and a sharp cold sensation in my lungs often after leaving these accounts. Sometimes it would last for the remainder of the day or longer. I was convinced it was this exposure causing the issues.

Fast forward and I'm now back to work on my second week. I didn't realize it until today but those breathing issues went away or at worst I didn't notice them while I was out of work. I just walked out of one of these filthy accounts and for the first time since before my accident I'm feeling the sharp cold sensation in my lungs and shortness of breath. These are some pictures I snapped on the way out and this is best one of the roughly five I mentioned. The mold is everywhere. https://imgur.com/a/pGrpSDU

All the reps will share horror stores of their own accounts and management is quick to jump into the gossip about how gross they are. But no one has offered any solutions. I have asked several times not to go back into certain accounts and I've been told it's part of the job.

I'm thinking about approaching my HR. I just want to know going in, in the back of my mind, am I right to think my employer shouldn't be allowed to place us in environments like this? And at worst they should supply personal protective equipment at the least for these moldy environments?

[Texas] I’m about to report a sex crime against a minor, I need to know what to be prepared for as far as retaliation against me in my workplace.

    Posted: 08 Jul 2020 04:48 PM PDT

Posting on an alt for privacy.

I work for a medical practice, and part of my job is putting labs into a template to prep their chart for an appointment. While prepping a patient's chart, I came across notes from the patient's last visit in which she told the doctor that she and her husband caught her stepson (husband's son, minor) sexually abusing their toddler (daughter of both parents). It is noted in the chart that the mother has suspected the stepson for over a year. The way this was uncovered paired with the speaking ability of the child makes it undoubtable that this is a true account of what happened, and the daughter is not just making this up. The husband, who is a celebrity, does not want to report this to the police. I also have reason to believe that the doctor did not report this to the police, which I am aware is illegal. Due to the fact that everyone in Texas is a mandated reporter, and due to my sense of moral obligation (I have a 6yo niece), I am going to make a report to CPS. Please tell me if I am wrong, but I believe that I am legally able to provide CPS with the parents names and address (both are patients), as the presence of a crime nullifies doctor-patient confidentiality.

Reporting is not something I am questioning at all. What I want to know is what would happen to my job if it somehow got back to my boss (say, if the doctor is the only person that has been told about this) and I was fired. I am unsure if I legally have to let him know that I am reporting this, and what litigation against him would look like were I to be fired. The practice is private, and has under 20 employees, and the doctor who this was told to is the owner of the practice. Here is what I specifically want to know:

    • If I were to report this, it got back to my boss, and I was fired, would this be wrongful termination?

    • My boss is a millionaire. If I were to sue for wrongful termination, what would this look like? My husband and I are upper-middle class, we are unsure if we would be buried in legal bills

    • If I were to sue for wrongful termination, would I be able to choose what the suit would be for? I'm worried about suing and the resolution to the lawsuit being to get me my job back.

Due to covid and my health issues making me high-risk, if I was fired, I am unsure that I would be able to find another job before the end of the year. I need to know how to go about this in a way that protects me financially without bending on reporting. If I have to lose my job so that these kids (the toddler at the very least) get some help, then so be it. Thanks for any help.

Edit: I did not violate HIPAA, I am authorized by the doctor and by patients to have full access to charts via the contracts that patients sign when they join the practice. Posting this is not a HIPAA violation, it does not contain the names, dates of birth, or sensitive health information of any patients involved.

My boyfriend smashed my phone and cut my finger

    Posted: 09 Jul 2020 09:13 AM PDT

    I'm in Colorado

My boyfriend smashed my phone two days ago and this morning when I was trying to leave he stopped my when I was in the driver seat of the car. He grabbed the keys out of my hand and I tried to hold onto them but he managed to pull them out of my hands and sliced my finger open in the struggle.

I want to go to the police but I'm scared because I don't know what to expect. He didn't cut my finger on purpose and I have no way of proving he broke my phone. I don't feel safe at our house and we have four kids together including newborn twins.

I'm a stay at home mom with nothing and no life. He supports us financially.

What would happen if I reported this?

Owner of my restaurant refusing to follow any COVID precautions or enforce masks or quarentine for traveling employees. I’m immunocompromised and terrified, what can I do?

    Posted: 09 Jul 2020 12:09 PM PDT

I work at a restaurant in SW Ohio, in a county surrounded by counties that are level 3(of 4) hotspots. The owner allows all staff to go about without masks and gloves, particularly FOH, won't do wellness checks upon entry for staff, is leaving table clothes on between tables and refuses to tell employees who are traveling to states like Florida (one of the biggest hotspots in the country) that they have to stay home from work for two weeks or get tested, and not doing anything sanitation wise- not even bathrooms. I had a bad injury in February, which resulted in multiple surgeries and I am now immunocompromised between that, an undiagnosed lung disorder (confirmed just not sure what it is, been seeing specialists for a year now) and the meds I was put on. This was all established when we came back and I was told that everything would be safe and I would be protected, by choice AND mandate. But none of that is happening and As cases and hospitalizations rise, I become more of an anxious mess so I guess what my questions are 1. If I report this to the health department, can I be fired? 2. Do I truly have a right to a safe workplace under Ohio employment laws, and do COVID regulations fall under that? 3. What kind of trouble is he facing for not taking precautions? 4. As much as I will try to avoid it, if I do get fired or quit, am I eligible for unemployment? It will be a last resort but the job market is bleak right now.

2020 Trade Show Cancelled due to COVID, Charged 10% Cancellation Fee.

    Posted: 09 Jul 2020 07:21 AM PDT

There is a yearly trade show in August that is cancelled. They are postponing it to the same time next year, which it's a yearly trade show so essentially it's not a postponement.

We have paid 30k towards our booth, and they send an email out telling everyone they can roll it over into next year (with added benefits thrown in) or we can donate if.

I emailed requesting that our payment be returned, and they want to charge a 10% cancellation fee.

Is this legal? They "postponed" the event.

Saint Louis Missouri. The event is in Nevada.

Character Reference Letter & Possible Retaliation (WI)

    Posted: 09 Jul 2020 01:26 PM PDT

My friend recently lost custody of their child due to neglect & mental health issues that have arisen rapidly. My friend has also been placed on involuntary holds at a hospital multiple times in recent months. My friend's mother is currently fighting my friend for custody of the child, & she has asked me to provide a character reference letter to provide to the court. I have known my friend's mother for most of my life & truly believe that my friend's mother is the best option for the child at this time. I am happy to write a character reference letter for her. However, I am concerned that my friend will retaliate. I don't know a lot about character reference letters, & the research I've done isn't clear. Will the letter be provided to both sides or be made public record? Will it be read aloud in court? Can I submit the letter anonymously? Is there any protection that can be granted to me? Any help/advice is greatly appreciated. I have tried to keep the details to a minimum as I'm not sure if my friend uses reddit, & once again, I'm worried about possible retaliation.

CA – I am a remote worker and my employer is requesting I come in to the office regularly (100+ miles away). Can I refuse?

    Posted: 09 Jul 2020 01:11 PM PDT

For the past few years I have been working remotely with the same employer. About a year ago, the company was bought out and is under new ownership. I signed a new contract, which acknowledges I work remotely with occasional travel.

Since the start of 2020, my travel has been about 300% more than is stated in my contract and I have been told that this will not change. I have included an excerpt of my contract below:

We understand that you live in XXXXX and will work primarily remotely. You have agreed that

you will be available in XXXXX or other company offices to support client visits,

special project meetings, etc. and for 1-2 days when I visit. I expect that I will be

maintaining a schedule of visiting the office every other or every three weeks on average.

I agreed to a flat reimbursement for the travel stated above. I interpreted visits to equate to approximately 32 days per year (52 weeks / 2.5 weeks * 1.5 days), plus client visits and special projects.

Well, the owner ended up buying a house locally so he's in town far in excess of our agreement. I have traveled over 70 days this calendar year, excluding client visits & special projects. It's a 225-mile round trip for me each day, and the flat reimbursement we agreed to a year ago doesn't even cover my gas.

I have brought this excessive travel up on a number of occasions, and there have been no accommodations to normalize my travel.

I have been told explicitly that this is the new normal. Do I have to keep doing this? I don't want in increase in my reimbursement, I want to go back to the amount of in-person work we agreed to initially. What's crazy is that we're in the middle of a pandemic (and coworkers have tested positive for covid), and my remote position is not being honored.

What are my rights here? This has reduced my quality of life significantly and I don't want to do it anymore.

TLDR: Employer has significantly increased my travel demands (approximately 300%), despite acknowledging my remote position. Can I refuse travel without being fired?

Dad passed away a couple months ago. I have a half-brother in Colombia that my dad had no contact with almost his entire life. Can he try and claim anything as his here in the US?

    Posted: 09 Jul 2020 10:04 AM PDT

    US - New York

I probably explained that as poorly as possible but I'm getting fed up with my mom fearing that he's going to lawyer up and come after my dad's money/belongings. We all only met the guy once in person when he flew up to stay with us for a couple weeks, which was a few years ago after my sister reconnected him with my dad on Facebook. My dad did not leave a will and my half-brother has no way of coming back to America, much less become a citizen now that my dad's passed away.

So the question is, are my mom's concerns valid? Is he entitled to anything that belonged to my father? We've been dealing with a lot as a family since his death, so we're wondering if we should just leave things alone or if there are any steps to take in the matter regarding the brother. Thanks in advance!

Hawaii Harassment Charges From Another State *Pupule Haole*

    Posted: 09 Jul 2020 12:48 PM PDT

I am (26F) in Pennsylvania is being harassed by a woman in Hawaii. It started about a year and a half ago when I had a job placement in Hawaii. Woman "A" started dating my coworker in Oahu Hawaii. I am a female in a male dominated field- usual work jealousy isn't an issue. This was more than that. Her harassment towards me constituted of calls and text messages. Accusing me of being a drug dealer, using drugs, sleeping with her boyfriend.. none of it true. I have most of the messages saved. They meet the online definitions I've found of "harass" and "substantial emotional distress". They include nasty words, threats, etc.. I am not a weak person but I am at my wits end with her ruining my life.

The issue is that I moved off island back to Pennsylvania a year ago, partly due to her harassment. But the harassment and messages have not stopped. In Hawaii it was about every two weeks she would attack me. Now it happens every few months when she finds a new way to contact me or she contacts a family member. Even my fiancé. What she is saying, which is not true, is costing me my 7 year relationship and previously costed me my job placement in Hawaii.

How do I file harassment charges living in Pennsylvania with her living in Hawaii?

So basically I quit my job on the spot a couple weeks ago because my boss was abusive. He told one coworker he's not allowed to see his dying grandfather and then also when my coworker was suicidal and attempted suicide my boss told him he can't have off work for it. My boss also told every customer as if it were an interesting story. He had an ex-employee who quit because he told her to get an abortion because he didn't want to pay maternity leave.

He's been had more abusive situations but these are the worst I can think off the top of my head.

I also believe he is stealing tips. I first recognized it a couple weeks before I quit because we just began working again and our first checks back had zero tips on them. Despite on the check saying for that pay period was the weeks i was working and I know for a fact we received tips because every customer had a 15% automatic gratuity.

And then I looked at all my previous checks from the last 8 months working and recognized I had almost the exact amount in tips every week despite certain weeks having 3 times the customers.

I can't prove anything without seeing the numbers but everything seems too fishy. I live in Colorado, USA. Denver to be exact and want to know what exactly I can do. Oh yeah and to top it off he still hasn't given me my last check despite the fact I was supposed to be paid 2 weeks ago. Please help and any help will be grateful. TLDR: Abusive boss stealing tips and still hasn't paid me 2 weeks later.

Hot coffee thrown at wife's face by customer who didn't read the sales sign correctly and lashed out

Its been 6 months and we've been waiting for a response from Nordstrom where my wife worked so she ended up quitting. Basically a customer threw hot coffee at her for not giving her what she thought the sales signs read.

She's gotten no response from the company and from what we heard from old co-workers that they basically are ignoring the whole ordeal.

Anything we can do om our end or is it just something to let go of after this long wait

Next door Neighbors clearing down woods.

This is in Florida. Our houses line up on woods that go back for miles. The woods are neither of our property. He's currently got an excavator about 30-40 feet in the woods and he's knocking down trees left and right. We have a fence on both sides of our neighbors with the back open since it's just woods. Now it's all open on his side behind our fence. He's knocked down a ton of large thin trees which were all healthy and not on his property. I feel like he could get fined tons of $$ for each tree he's knocked down that isn't his. Should I call the EPA or something?? This is absolutely crazy. I think the land is conservatory.
