    I got an offer way above what I normally make. But I can find next to nothing on the company. Its an investment and loan firm. I really want to believe its real but something doesn't feel right.     I have a question regarding an RFT I'm handling at work, which is new to me as I have never before had to take such a scenario into consideration. Here's the backstory:

    A long-term client of our company, who is a business consultant for Canadian private security firms, usually forwards us RFOs and RFTs for domestic supply contracts. The requisitions consist of run-of-the-mill security goods - uniforms, equipment, accessories. Companies either recruiting new personnel or issuing new equipment based on specific schedules.

    We were having a casual business chat over the phone and he mentioned that a close family relative, who oversees procurement at the Ministry of Interior, Public Safety and Decentralization of Niger, has hit a major roadblock because their primary suppliers (based in Asia) are unable to fulfill their RFTs in an acceptable time-frame due to COVID-19. The schedule overruns are in excess of six months, the Ministry is not willing to wait that long, and they're pressing for alternatives. I offered to do the research and provide him with a response. He was ecstatic, and more than willing to recommend a familiar supplier to his relative than another "faceless foreign corporation".

    The product requirements aren't anything new to me: general duty and dress equipment for MIPSAD bodies: internal security, police, disaster response units, public safety. Garments, footwear, backpacks, shoulder bags, flashlights, safety goggles, comms, utility tools and such. The fulfillment deadline is more than adequate for our abilities, and I have already confirmed with our US supplier. I am currently awaiting a requisition letter from MIPSAD and a phone call from their procurement manager.

    The issue is that it makes no sense to me, logistically and financially, to import such a large amount of goods from the US to Canada only to have them warehoused until the client's freight forwarding agency collects and ships them to Niger. Our supplier has already suggested they can co-ordinate on our behalf directly with the client's FFA if the documentation and security checks out.

    If we were to import the goods to Canada, the 5% GST and ~4% duties would apply, and the export would be tax-exempt since it meets CBSA requirements:

    • the goods are not excisable goods, such as beer and tobacco;
    • the purchaser is not a consumer;
    • the purchaser exports the goods as soon as is reasonable;
    • the purchaser does not buy the goods to consume, use, or supply in Canada before export;
    • after buying the goods and before exporting them, the purchaser does not further process, transform, or alter the goods in Canada.

    If our supplier exports directly from the US to Niger but the transaction is performed by a Canadian business (we receive the bank transfer for the tender, we forward a bank transfer to our supplier for the cost of goods, and the remainder is our profit), what taxes and tariffs is the Canadian business responsible for? We are not importing into Canada, therefore there are no GST or duties to be paid. The goods are originating in the US, but SOR/97-107 wouldn't apply and it's been repealed anyways. I am uncertain on how the system works in these circumstances, and am absolutely driven to make this work. Why?

    Professionally: it will be one of the highest-valued, highest-ranking contract our company has completed in its 59 years of operation. 6-figure contract and status boost? Yes sir!

    Personally: I am a 27-year old junior manager, and this would be an invaluable boost to my position, image, and resume. 6-figure contract and a commission? Yes sir!
