You can read the responses to my original r/legaladvice post here Hi everyone. So, I recently moved back to NY state to live with my father in his house to help take care of him (he's very elderly). My brother moved back into the house as well for the same reason. Out of us three, my brother is the only one who owns a motor vehicle and who has car insurance, whereas I just ride a bicycle. A little over a month ago, a car ran a solid red light and collided with me while I was cycling. There were several witnesses to the event and their statements were taken once police arrived. I've seen the police report and it makes clear, as far as I can tell, that the motorist was solely at fault. Anyway, an ambulance arrived and took me to a hospital where I was diagnosed with a shoulder dislocation. A few days after the accident, I hired a personal injury attorney. He informed me that once he was able to obtain the policy number for the insurance of the vehicle which struck me, I could then provide that number to whichever medical facility I decided to seek treatment from, at which point that facility would then bill that insurance. So that's what I did and, until now, there haven't been any complications so far as I am aware. A few weeks back my lawyer's paralegal called me to get further personal information. One of the questions she asked me was whether or not I lived with anyone who owned a motor vehicle. I hesitated to answer because it seemed a strangely irrelevant question, but eventually said "Yes, I live with my brother who owns a truck." Later on I called my lawyer and asked him about the reason for such a question. He told me that because New York is a "no-fault" state, it may turn out that my brother's insurance will be on the hook for my medical bills simply because our living together causes his insurance to act as a kind of proxy, absent my having any insurance of my own. However, my lawyer was unsure about this, so we tabled the issue for the time being. Yesterday I received a letter from my lawyer's firm claiming that they need my brother's insurance information because, apparently, his insurance will be billed for my medical costs rather than the insurance for the person actually at fault. How is this right? Why should I have to rope my brother into this mess when neither he nor his vehicle had any involvement whatsoever in the accident? Why must I put him through the stress of wondering how this might impact his insurance? Isn't my lawyer sort of double-crossing me by making it seem like the insurance of the person at fault would be held liable, when in fact he's now trying to get my brother's insurance to be held liable? Shouldn't this be a simple matter whereby the insurance of the person at fault covers everything because, well, you know, he caused the accident? Sorry for the long post. I went to that hospital because they accepted my insurance. The entirety of my surgery, surgeon, week long hospital stay, medications, tests, x rays, ct scans, etc, was $800. Now 10 months later, a doctor that I saw for a MAX of 15 minutes in the 8 days I was at the hospital that didn't do ANYTHING for my care, diagnosis, or recovery, just sent me a bill for over $2,000, and says she doesn't accept my insurance. How can the hospital give me a doctor without my consent that doesn't take my insurance??? They didn't tell me that beforehand, I found out when I got the bill. She literally did nothing. Every time we had questions we were met with "Idk, I'm waiting on instructions from the surgeon". This doesn't seem right to me. I tried to appeal through her office but was denied. What can I do? Posted: 05 May 2020 06:43 PM PDT TLDR/Question at the top: From what I've pieced together I think this is how it works: Am I right? - There is no legal/contractual requirement to do anything with your insurance payout - Insurance companies heavily frown upon the practice of individuals not making repairs they paid out for and will choose to drop you if they catch wind you did this. Here's my timeline of events: (anti TLDR) -5 years ago I had some water damage in rental property. The floors looked terrible but only in an area underneath an area rug so the tenant did not care and was happy to not deal with the replacement. I asked the insurance adjuster if I were required to make the repairs and they said no, but I would lose additional money that I could receive after submitting proof of repair. I decided since the tenant didn't care I might as well wait in case anything else ever happened. Even if I sold the place I'd rather discount it by the amount of the payout so the new owner could put in exactly what they liked. - very recently I had an additional larger event that caused additional water damage to new rooms. I filed a claim to also replace those floors. The adjuster asked me if I ever replaced the floors from the claim 5 years ago and I said no, and they said "OK that's fine, just know we will reduce the payout attributed to any additional damage made to the original room we paid for". I added a million leak alarms to my rental :) and they paid this out. They also told me I did not have to use the money for anything, but I could get extra by submitting proof of repair. - Even more recently I received a notice that my insurance company was dropping me due to finding out I never replaced the floors 5 years ago. I thought this was odd, but figured it was their weird way telling me they were unhappy with me being a loser customer. (imo reasonable) -I reach out to my independent insurance broker agency to set up a new policy, and they told me I was off the wall crazy for not making the repairs and that the claims adjusters are not reliable sources. The truck was making a right turn and clipped him shoving his car against the curb, there was sit I can't damage to the hood and front fender. When he approached the managers at his job he had to go through hula hoops just for them to tell him that he has to have his insurance call amazon so that amazon can release the information about the driver and his companies insurance. I was unemployed for awhile in 2018 and I had to get my own health insurance, which I did thru Obamacare and was under the Cigna plans. My monthly insurance premium was about $50. I began FT employment in March 2019, enrolled for benefits in June 2019, and due to the Coronavirus got laid off in April 2020, insurance ended May 1 2020. However when I go into my bank account I noticed there were $50 auto-payments being made every month to the individual health insurance plan. Does this mean that I am still covered and won't have to sign up again during my current unemployment? Will I get penalized for having two insurance plans during employment, even though the bills got paid for Cigna? At the moment I'm not focusing on getting reimbursed for the unnecessary months as that was my fault for forgetting to cancel it. I feel so confused, and like an idiot. I am normally on top of these things, but I've had a rough year last year with depression and other things, so I think this slipped my mind, or I thought the payment was for some other type of bill?. I made a mistake and now I need to make sure I don't make it worse or create more problems. Please let me know what you would do in my situation if you discovered this, during this timeline. Note that I don't have any pre existing medical conditions, or children, not married, or history of any long term medical issues. I'm the only person on my insurance plans. Posted: 05 May 2020 09:21 AM PDT I recently had my roof replaced after it was damaged in a storm. The replacement was mostly covered by my home insurance policy. For context, my contractor and I both confirmed that my policy does cover 'code upgrades'. The initial insurance claim quote did not include decking replacement, but my contractor explained that my decking may not be to code given the age of the house. They would have to determine this the day of install, once all the shingles are removed. If it were found to be out of code, they would replace the decking and the insurance claim would be adjusted at the end to cover upgrading the decking to code requirements. Day of install comes and they find that my decking is 3/8" and explain that it does not meet Ohio building code. I give them the go ahead to replace the decking with the required 5/8" decking and all goes well. Now that the job is complete, my insurance is refusing to pay for the cost of decking replacement, claiming that it already met my local building code of 3/8". I called my insurance and spoke with a claims manager who told me "local building departments can choose whether or not to adopt state building codes". I'm skeptical that this is true. I would have thought any work has to meet both local and state building codes whichever is higher. TL;DR: Local building code requires 3/8" decking, state requries 5/8" decking. Which requirement supercedes the other? Do I have any recourse here, or am I on the hook for the cost of decking replacement? If so, how should I proceed? [link] [comments] |

Ive been planning on buying a car right after the license and I was checking quotes for a 2012 accord coupe v6. I would be financing the vehicle. So I was ready for a payment of like $250 a month or something. I knew a friend that was a brand new driver of a 2010 honda civic coupe in a different state, and his payment from state farm was like $160 a month for full coverage, so I imagined mine in NYC would be higher. But every insurer I get a quote from tells me some batshit insane price like $2200 a month? I just don't understand how a payment could possibly be that high? I understand that I'm a high risk driver cause I'm young, would be brand new at driving/having a license, but what the fuck man $2000?? Edit- I don't think anyone's actually reading the post, but i don't think $2000 A MONTH is a normal payment for anyone in America no matter where they live. I'm not raging that my price is high, i'm questioning the accuracy and legitimacy of the quotes and wondering if anyone's heard of this happening to them after putting in info wrong or something. My work is now demanding back pay for having the insurance but did not inform me at all that I would be owing per week the insurance, even though my manager was the one who told me about sick leave. Not sure weather to pursue legal advice / action, as I'm on a small EI amount and can't afford any payments. Informed my work that I wouldn't be coming back and that they didn't detail any insurance debt, they admitted not informing me but still are giving me the option of going back and paying off the insurance or make a full payment. Allstate I was careless and screwed up settlement Posted: 05 May 2020 02:30 PM PDT Hi I was rear ended in February and the driver that hit me had allstate insurance. I went to the emergency room because of slight dizziness but did not do a ct scan because I felt better after arriving. I had some pain in my left shoulder after the accident. My car, medical bill, and emergency transport bill was all paid by Allstate. For approximately 3 weeks I was taking ibuprofen, cyclobenzapine and a lidocaine roll. I visited the doctor and was prescribed cyclobenzapine (muscle relaxant). I never attained a lawyer because I thought the injury (soft tissue) was not big enough to warrant it. I have finally recovered and adjuster from allstate is offering me 1,000 dollars in personal injury and 900 dollar in lost wages. It was a soft tissue injury and I believe I was screwed over and should have attained a lawyer in the first place. What are your guy's thought on the situation. This takes place in Illinois. Would my policy provide PIP coverage to my passenger or would my passenger's auto policy provide it? Posted: 05 May 2020 02:06 PM PDT Hello, Earlier this year I had someone cut me off forcing me to choose between tboning them or basically running off the road. In the moment I chose the later and once I got out of the vehicle that was now totaled on its roof the car was no where to be found. Who knows maybe they didn't realize. The process that followed is when I learned that fault in the eyes of the insurance companies isn't necessarily whose really at fault in reality. If they have no one to come after it's your fault. Either way obviously the vehicle was replaced and it was an ordeal but in the past. My question currently is in regards to a hypothetical scenario very similar to the one I just described except when the vehicle sustains substantially less damage. Let's say something like some major front end body work may be needed. Seeing as how again in the hypothetical scenario, there isn't another human being present to potentially claim responsibility, I am technically at fault. Obviously there's no reason not to tell the truth as it happened, but is there really any difference assuming there's full coverage in terms of how the claim will be processed or how my rates may be affected between this scenario or one where the damage occurred not necessarily due to avoiding a collision ? Specifically I am looking into Spirit as there isn't a waiting period for major procedures/restorations. I don't currently have insurance, and I live in NY. I got a dental crown a couple months ago that I would like to replace for cosmetic reasons. There isn't anything wrong with it otherwise. I know that most insurance plans only cover crown replacements once every 5 years. Would I benefit from getting on an insurance plan, or would I have to pay out of pocket for the whole procedure anyway since there isn't anything actually "wrong" with the crown? Thank you. However, if you live in the same household, the price goes way up. I had been visiting with them and driving the older car as they allowed me to. Now I have moved in, the additional insurance cost for me driving is something like 800$ every 6 months on their plan. If I moved to my step families house a few miles away, would I be allowed to drive my parents older car on occasion if I were visiting, or to quickly head out and buy groceries for them? I am 29yo male, clean driving record, own no car or real estate. would this be the best way for me to be able to drive the car on occasion? They've given me a thicc Benefits Guide document along with a 20-minute video that's supposed to explain the benefits; however, I can say with utmost confidence that I have no idea what I'm looking at. So many acronyms.... :( I'm unmarried, childless, and otherwise independent (except for my cat), but my parents are kicking me off of their work-sponsored insurance at the next available opportunity, so I need to get my own. So, insured people of reddit, what factors do you consider when choosing which benefits to enroll in at work? How do I know what I need?
