UPDATE: Planet Fitness lied... Posted: 06 May 2020 08:27 AM PDT Just wanted to post an update for the fraud Planet Fitness committed, you can see the original post here So after I received that letter with the very old photo of me with the doctored date and time and the fake check in date and time of March 06, 2020 12:30pm, I called my bank like you all directed me to do. I did really want to contact Planet Fitness directly and tell them they committed fraud and my hair hasn't looked like that for at least a year AND I haven't even been in that state since November. I decided not to because I figured it might give them time to come up with an excuse/rebuttal. The dispute analyst at my bank initially told me I was out of luck because the dispute was put in as fraud initially, which was technically incorrect because I signed a contract with them and gave them my bank info. He didn't realize that the photos and check in times were fake and that they lied, so after I explained all of that with proof he said it was then a fraudulent case. Also since I made it very clear I wanted to cancel, that should've been enough to stop debiting my accounts moving forward. I sent over a letter from myself, a letter from my boyfriend who lives with me and can attest that I hadn't been to that state since November, a bank statement with charges in a different state that same day and a letter from my boss with clock in times showing I was at work that day and time. Needless to say they will not be returning the money to Planet Fitness and closed the case. The bank analyst told me that they can move forward with repercussions, since they are committing fraud against the bank technically, but I have already prepared a letter for the AG. Hopefully this post alone causes some people to be weary of the MANY fraudulent things this gym does. I have received so many messages and comments proving that this isn't an isolated event and pretty common amongst other shady things. Watch who you give your money to! Update to post about landlords locking me out for not following unreasonable rules Posted: 06 May 2020 08:44 AM PDT I called the police again, said again I was being illegally evicted and cited the law they were breaking, this time someone took me seriously. I had to wait a few hours but a policewoman finally showed up at my landlords house and made them give me the key to the new lock so I was able to spend the night in my room. They were angry and scared but there was nothing they could do. It's sad becase they're not bad people but fear will make some people go crazy I guess. I'm looking for a new place to stay hoping to find something quickly and that the current landlords make no drama with my security deposit and all. Thanks for your help [link] [comments] |
Posted: 05 May 2020 04:49 PM PDT I posted a month ago about our brand new neighbors wanting our permission to put up a fence exactly between our houses. We ended up telling them that they really need to get a property survey done first since we don't know exactly where the property lines are. It was a little difficult to communicate this well since there's a language barrier, but eventually they understood and agreed to wait. Since they didn't know how to proceed and we were planning to do a property survey ourselves soon, we offered to research and get quotes and schedule surveys for both of our properties to be done at the same time. WELL. It's a good thing we did push for the property survey, because we discovered - after living here for almost 13 years - that there's actually a separate 10-foot wide lot BETWEEN our houses that's owned by someone else entirely. The surveyor said as far as he can tell, when Habitat bought the then-abandoned house next to us, they either declined to buy the adjacent 10-foot lot that was tied to it or somehow they weren't aware of it. In any case, that 10-foot lot then went up in a tax sale (that we were never notified of) and was bought by some guy for about $500. So now we have to go through the process of contacting this guy and seeing what he's going to ask for this inconvenient gap between our houses. [link] [comments] |
Neighbor is holding parked cars for ransom Posted: 06 May 2020 06:53 AM PDT Someone on my block owns two really old pickup trucks, and he's been parking both of them within an inch or two of other parked cars on the street and leaving a note that says he'll move them for $200. This has happened to two of my neighbors I've talked to so far and they've said they just had to pay him so they could go to work. Is there anything we can do about this? Is this against the law? From reading online, cars have to be parked for 30 days to be abandoned in my area, so we can't call the cops until then. Location is US, New Jersey state. [link] [comments] |
Posted: 06 May 2020 06:22 AM PDT I (17M) got into a disagreement with my mom's current boyfriend (40?M) around an hour ago. During the argument, Boyfriend came into my room and destroyed my personal laptop that I had recently bought (my own money) and smashed it to the ground multiple times, then stomped on it. It is very thoroughly destroyed. He also toppled over my desk, scattering everything I had on it and breaking multiple smaller things. While on his rampage, he grabbed my barbell from my weightlifting set and attempted to throw it, leaving a noticeable size hole in my bedroom wall. The whole time this is going on, he is yelling threats at me, « I'm going to snap your neck » or « I'm going to bust your nose/break your fingers. » My younger brother and sister both saw/ heard everything going on. What can I do? My laptop is essential to my schooling at the moment with the virus, and I don't have the money to afford another. This is also not the first time he has threatened me and it goes back quite a while. So, what can I do?? Some things have happened since I originally posted so I figured I would post an update. Shortly after posting I found a lawyer through the MA bar referral site who recommended we send them a demand letter. I agreed and paid him his fee. Hours later, (this is now four days after posting here and the letter hadn't been sent yet) I got a call from someone claiming to be with the venue who said they needed my address to mail me a check for the full refund of the $10,000 we were owed. Keep in mind this was the first and only contact we've received from the venue since this all started. I was skeptical at first, but provided my address and decided to wait. The woman on the phone also told me the venue would be reopening after the COVID situation calmed down. We waited about a month without receiving anything in the mail before I started trying to get in touch with her for an update. I called several days in a row and left 3-4 voicemails without receiving a call back. Turns out the venue filed chapter 11 bankruptcy 2 days ago according to my lawyer. Now I'm not sure if I was was lied to in some sort of stall tactic or if they were hoping to take advantage of the government assistance and that fell through or what. I'm more inclined to think this is just incompetence and poor management. It's a mess and we're pretty devastated, but are not surprised that this is the outcome. The lawyer I've been speaking with is looking into the details of it now and we'll probably file a claim as a creditor, but we are unlikely to receive any money at the end of this because their debts significantly outweigh their assets. Study abroad cancelled and students are still expected to pay $5000 Posted: 06 May 2020 03:02 PM PDT Hi, so I go to a southern state school and was supposed to study abroad this summer. For the first 6 weeks of the program we would travel around Europe and the second 7 weeks we would take classes at Mansfield College in England. Due to the circumstances, the school cancelled the trip. However, despite there being no mention of a financial responsibility if the school cancelled the trip in the contracts we signed, the school is still making us pay close to $5000 for a trip they cancelled. This is due to Mansfield College as well as vendors not giving refunds or full refunds for the cancelled trip. They told us in early March that if we expected a full refund, then we should get travelers insurance, but it was only one line in the middle of a very very long email. Is it legal for them to still charge us for this? I was only studying abroad to save money because I'm out of state and get in state rate when studying abroad, but now I'm out of cheaper classes and $5000 that I was planning to save to do this same program next summer. Help! My baby mama is accusing me of sexually assaulting my daughters. Posted: 06 May 2020 04:54 AM PDT Let me start off by saying that my baby mama is a crazy bitch. I live in Texas around the Austin area. This all started when the mother of my first daughter found out that I was getting married. I accidentally told her. Anyway, soon after I told her I was getting married I got called by CPS. The CPS investigator told me that a sexual assault case was open against me for sexual assault against my step daughter (13) and my younger daughter (7). CPS interviewed both of my daughters and they came to the conclusion that I didn't sexually assault my step daughter. But they came to the conclusion that it was "unknown" if I did any thing to my youngest. So CPS passed the case off to local police. Monday I received a call from a detective. He wants to interview me and hear my side of the story. He told me that I would not be arrested and he just wants to talk. He told me that he has my 7 year old daughter on tape saying that I touched her inappropriately. What should I do? Should I meet with the detective? My gut is telling me not to do it. Some background: My sister is a pothead who dropped out of college twice and now visits just to steal from me and my parents don't do anything about it So my sister has stolen from me my whole life growing up and my parents wouldn't do anything about it. It was annoying but she never stole anything important but now I have to pay for college by myself and my sister within the last month has stolen around $300 from me. She has also stolen around 6 pairs of expensive pants around $75 each and my news shoes that are around $80. I have tried to tell my parents but they say "they can't do anything about it". She has blown all her money and has nothing to her name after dropping out of college twice. I have threatened to call the cops before but she did stop at all. I was thinking of buy a cheap recording device and catching her stealing from my room for evidence when I actually call the police. I don't know if i can legally do it because I don't turn 18 until May 19, I don't want to bump into any legal issues. I looked into it and come to find out that the money was diverted to a local community college through the tax intercept program. I found out that they are claiming that I was a student there and owe the money for tuition. Specifically they claim i registered for two senior level classes 3 years ago but never completed the classes. This is impossible since i was in high school in another state at the time and have only moved to MA last year for college (at another school). I had never even heard of this community college prior to them stealing my money. I tried to look into a way to reach the tax intercept program but have not had any luck. Everything i find lists it as a way to collect child support and other types of debt like that owed to the state but there are no appeal processes listed on any of the sites for it. I reached out to the community college directly and was told that the only way to appeal the intercept is through them. I asked for a copy of all the information they have showing that this debt is valid and they told me they do not provide people with access to their file. They said all they can do is send me the bill which i can appeal to them. I appealed with proof that i was a senior in high school across the country when they claimed i registered and they denied my appeal. I am at a loss right now. I really needed my full tax refund. Landlord withdrew rent via ACH without permission and then cashed rent check Posted: 06 May 2020 11:52 AM PDT Location: Minneapolis, Minnesota I've lived in my current apartment for about 5 years now. When I moved in I asked about paying rent online, and was told they only accepted checks. Fine - no problem, I've written checks every month for the past 5 years, never a day late. About a year ago the business manager started asking people to give them ACH details so they could withdraw rent on the first of the month. I resisted because pay days were sporadic and I could never budget to have the money for rent on exactly the first of the month, so I didn't want to set up a withdrawal on the same day every month (rent can be paid up until the 5th of the month with no late fees). I also don't like the idea of someone being able to pull that much money out of my account at any time. At the beginning of April, I received multiple phone calls asking me to set up ACH - I explained my reasons for not wanting to again, and they said that was the end of it. On April 3rd, I received an email from the business manager again asking me to set up ACH and sent me a screenshot of her having set up an ACH withdrawal using the information from my check, saying that she could set it for any day I wanted. I wrote back explicitly telling her that I did not authorize them to withdraw money from my checking account. I went further to say if they required that as a method of payment, I would set up another checking account exclusively for rent, but that it would take time. Her response was that I can continue to pay via check if I'd like. I had also asked multiple times about paying rent online, but that is not an option. Fast forward to this month. I paid rent on May 1st. On May 4th, I see they've debited the amount via ACH. Then on May 5th, I see that the check was also cashed, throwing my account into overdraft. Luckily, my bank charges no overdraft fees and is connected to a savings account so it just transferred money to cover any overdrafts, so I'm not technically out anything other than my time chasing this down. The business manager said I should have a refund check tomorrow. My question is if there's anything legal to pursue here. Are there laws that govern what is required to initiate an ACH payment? Do I have any recourse should this happen again? I don't really have any damages because we took steps to prepare for just this situation after the April email but I can't imagine it's perfectly legal to just debit an account without authorization. Incredibly loud downstairs neighbors are now intentionally disrupting us throughout the day Posted: 06 May 2020 06:46 AM PDT My boyfriend and I live on the top floor of our building which only has two apartments (we're above a store front). Just to preface, we understand that our building is a bit old and this isn't my first apartment, I know there will inevitably be things we hear from our neighbors and in general, I'm completely unbothered by the occasional noises. People argue, doors slam, commercials have loud music, I GET IT. But those things should not be constant, all day every day noises. We work from home at this point due to COVID, and co-workers on my calls have acknowledged the amount of background noise. I've had to just apologize because it's out of my control. I can tell you what TV shows they watch at each point throughout the day and if I give it enough of my attention I could tell you what season of The Office they're on and how caught up they are with Westworld. When it first became a disturbance, we knocked on their door and politely asked to turn it down because we still have to work 8 - 5 and it's interrupting our work. It was turned down for maybe an hour before back on full blast. Asked a second time, stood on the landing knocking on the door for 10 minutes before they heard us. They laughed at us, shut the door, and no change. So we contacted the landlord. 4 times in the past month, we've reached out to her. The first time, he yelled "Fuckin rat snitch" at us in the hallway. Our lease has a clause that 2 noise complaints equate to eviction, but with COVID, no evictions are currently legal. Now, they yell all day, sometimes directed at us specifically, and stomp around so hard that drinks on our tables shake. Our pet also gets stress-induced ulcers in his eyes, and these noises are so disruptive that we've also spent $400 on medication for him this month, which likely could've been avoided if some mutual respect existed. Called the cops as a last resort and they basically shrugged at us. Honestly, at this point the guidelines in our lease are not being upheld and the fact that he has the power to control our day to this level is absurd. He is a sheriff in a small town in northern Wisconsin. So he knows all the judges personally. He is taking her to court because while she was on vacation to Florida with the kids, the pandemic started, and when they got back she held them in quarantine for 2 weeks. (She lives in Milwaukee) and apparently he was furious about it, so now he's taking her for contempt of court? Or something....but that's why he's taking her because she held the kids in quarantine. I asked her if she could request a different county for a different judge (due to conflict of interest) she says she has tried for years but it doesn't happen. My question is, who could she contact to see about a new hearing with a judge that doesn't work in the same county? maybe the next county over? Contact a lawyer? Thanks for your help!! Originally the contractor responded to emails about coming to take a look and fix, but they dropped off. These back and forth emails went on for 24 months, while the defect got worse. Simple question is, should I inform one last time that of I don't hear back I'll be retaining an attorney, or should I just go ahead and retain one now, and let them start sending correspondence? I spent a couple of hours in jail before bonding out. This was my first and only arrest ever. It was a complete lie on his end, and the charges were completely dropped by the DA before we even made it to court. All is well after, I completely move on this past year I've even won complete legal and physical custody of our children from him, and he is only legally allowed to have a once a month supervised visit with them. I've gotten back in school and and was accepted in a mortuary science program in December that is very hard to get into. I am very much afraid this can effect my Mortuary liscense. All is well until today, when I received legal documents from the state of California, a notice of Exclusion,stating they are trying to make it where I can never work at a daycare again, or ever be a foster parent. I worked at this daycare two years ago, only as a housekeeper, never as a child care worker. They did make me do a background check/liscene to work there. This has really taken me by surprise that they are doing this, and I am so confused with this. The charges were completely dropped and happened a year ago. I have nothing on my record. Why am I just know getting sent this, and what does this mean? Do I need a lawyer to prove these charges were dropped? Older woman with dementia is pleading us to save her from her husband (TLDR at bottom) Posted: 06 May 2020 01:35 PM PDT (This takes place in upstate New York) Two weeks ago my mom got a knock on the door at 4AM. There was a naked old woman outside of our house begging for help. My mom told me that she started crying and saying that her husband was going to kill her. I know her husband and he's insane. We called the police and they said that they couldn't do anything. After that my parents brought her back to her house and told her husband about what happened. Nothing else happened for about two weeks. Today, she came back doing the same thing. She said she escaped from the back door and that her husband wants to shoot her. I know she has dementia, but is there a chance this could be real? Her story has been coherent and she seems genuinely scared of that man. I'm 15 so I don't think I can do anything about this, but do you have any advice? Employees clocking in/out but not actually going to work Posted: 06 May 2020 12:59 PM PDT My company (in PA) uses a mobile app for timekeeping as our employees work at different locations based on their schedule. We have discovered that two employees have been clocking in and out from home and not going to work. One has been doing it consistently for weeks. Because this wasn't noticed there were several pay periods where the employee "worked" and was paid for multiple shifts she did not show up for. Is there any way to press charges against people who do this to recoup money lost for work not done? Or do we just cut our losses? [link] [comments] |

I did not see the damage but I did take a picture of the downed limb and sent it to my landlord, and I gave the neighbor my landlord's number. I don't know who is responsible and I would prefer to stay out of it, but the landlord lives across town and I rarely see him so I thought I should tell him. Negative police interaction while doing yard work. Posted: 06 May 2020 03:41 PM PDT I own a home on the corner of a residential street and a small city street in Augusta, GA. My roommate was cleaning up the dirt and grass growing off the sidewalk into the city street. This left a fair amount of debris he was going to clean up. While weed eating on the other side of the fence in the backyard, an officer parked his car in front of my house, entered my yard and told my roommate he needed to talk to him. The cop basically told him to make sure he removed all the debris or he could get cited by a marshall. My roommate told him he was waiting for the blower to charge and he ran out of yard waste bags, but was going to do what he could once he could use the blower. The cop said, "well that's not going to work, do you have any trash bags, you need to do something now." My roommate ensured him he would take care of it, and the cop said, "i can't cite you because its not my job, but just know you can be fined" He then asked for my roommates first and last name and left. Since then he has driven by my house at least 6 times. Of course we cleaned the dirt the best we could, but we found it odd he chose to interact with us, who are making our yard look good, when the opposite end of our street has apartment yards littered with trash. The original court date was April 9th but the pandemic delayed it and I don't have a new date yet. Still, his lawyer wants a copy of my outdated subpoena and had my ex contact me to for a copy of it. I told him he should be able to get that through the court (I assume), or his lawyer could contact me directly. I also accused him of lying, so he then sent the screenshots of his lawyer asking for him to get the copies from me. It honestly feels like my hands are tied in the matter, the cats are constantly using my property as a bathroom, making my property smell like a zoo as I was pregnant and unable to clean up their mess myself for the better part of last year. Now it seems as though my 10 year old has developed a cat allergy, I have contacted my local animal control about it, but since my neighbor has registered himself as a colony caretaker, they've stated there's nothing they can do. Do I have any legal recourse I can now take against my neighbor, given that his cats are constantly on my property? I feel the need to add that I have a dog who is for the most part able to chase them out of my yard when they are back there, but there seems to be one cat in particular that has learned that my dog is actually harmless and I'm now also afraid that this cat will eventually attack my dog. Neighbor playing Mosquito Noise Posted: 06 May 2020 03:38 PM PDT I have a neighbor who installed a mosquito noise generator on the outside of their house.... they have it set to play for 5 minute intervals every 30-45 minutes it seems. Its preventing me(m28) and my spouse (f27) from working and giving us serious migraines. I can't tell which neighbor has it yet because its a little faint and I can't find the source before it shuts off. Is what they're doing illegal? A lot of my neighbors work from home as well/have children. Its a nice day and none of them are playing outside (especially after the noise starts), so its affecting them too.
