An (update) I hoped I'd never have to post--my daughters mother has passed.

I got a call this morning telling me that my daughter's mother had passed away; no other details at this time, most likely an overdose.

I've recognized it as an inevitability, but I also hoped for a miracle for our girl's sake if not her own. You always cheer for people you loved at one point and especially so in this case.

It's mixed relief and deep sadness. Legally there are going to be some things down the line here that will fall to me to deal with on behalf of our kid and I'm sure it'll come with questions I'll rely on you for.

Our girl doesn't know yet; I let her sleep in this morning and she's still asleep. I don't know how I'm going to tell her and that's the part that gets me. She's going through some stuff of her own right now and this was the last thing I wanted for her.

My parents just shaved my sister's head bald for dying it without permisission

    Posted: 01 Apr 2020 08:05 PM PDT

    North Carolina

My (15 y.o) little sister (13 y.o) recently decided to use Hydrogen Peroxide to die her hair light brown. When my Mom learned about it she flipped shit, and after her and my Dad screamed at her for a bit, they completely shaved her head... All hair. Gone. They've always been emotionally abusive and treated me and my siblings like shit... but this is the final straw. I'm hesitant to really try and do something about it and make my parents mad at me, because obviously they could make my life really miserable... but I want to check all my options at this point... thoughts?

My father has a tenant whose lease ended on the 31st but they won't leave. Now there is an emergency maintenance issue and they want him to pay for their accommodations.

    Posted: 02 Apr 2020 09:39 AM PDT

    State of Iowa

My father owns a rental property. It was previously his home, but after an injury two years ago he moved into a retirement complex and rented it out. He has recovered from his injury and has had major improvements in his overall health (it turns out a health concern was previously misdiagnosed, and now that it is correctly diagnosed and properly treated, his quality of life is hugely improved, which is super cool). He misses his home, doesn't like the retirement complex, decided to move back into it.

He gave the current tenant notice in November 2019 that he would not be able to renew their lease because he is moving back into the home. He wanted to give them adequate notice that they would need to find a new place. They understood and used him as a reference on some applications which he received calls about.

They did not pay March rent, but with everything going on with COVID he tried to be lenient. Since he had gotten calls for references for other rental applications he was confident they were moving and he didn't want to put up a huge fight over a month's rent with everything going on.

On the 31st he arrived for their move out inspection and to get their keys and found that first of all they have not moved out. They say they cannot afford to move because of COVID. He proceeded with an inspection.

Apparently there has been a leak in the basement for some time. The tenant has not reported any problems to my father, but when he asked they said they noticed it a few weeks ago, but they don't go into the basement and their lease was ending anyway, so they didn't worry about it. She says she hadn't been at the house for several weeks because she has been spending all her time with her boyfriend, but she came back to the house to meet my father to tell him she couldn't move out. So she didn't notice the chaos going on.

Meanwhile, the basement does have two sump pumps but they are both unplugged. The tenant admitted to unplugging them a while back and never plugged them back in. The battery backups only last so long, they are meant for a power outage, so they have not been running.

There has been major water damage. My dad brought in an emergency cleanup crew to remove standing water. Gas, water and power were temporarily turned off to the property. They now have a multi-stage process ahead involving removing everything that is wet or damaged, ensuring everything is safe to turn utilities back on, and then replacing things like the furnace and water heater etc.

At this time the house is effectively condemned pending these repairs and cannot be lived in by the tenant. Now in normal circumstances for a tenant who has a current lease, my father would be paying for a hotel or whatever for her - but in this case, her lease was over several days ago and she was supposed to have moved out. She has not paid rent since February. My father is not opposed to paying for a hotel for her for SOME amount of time but the problem is - when does it end? Normally he would have to evict her, but evictions are on hold because of COVID, and how do you evict someone from a hotel arrangement when their lease is already over?

The tenant is demanding that he prepay for at least a full month at a hotel "to start" as well as prepay for 3 months at a storage facility for her belongings.

He has called several lawyers, no one can talk to him until next week, and we don't know what to do.

My state has issued rules about maintaining 6 foot distance from coworkers while working. My job is forcing hundreds of people to work in close proximity.

    Posted: 02 Apr 2020 02:55 AM PDT

I work at a chicken processing plant in maintenance. With the current covid 19 epidemic, my state of delaware has issued rules for all essential businesses still operating that 6 feet of space must be kept between employees. The company I work for is completely ignoring this and making employees work shoulder to shoulder on all the lines in the plant. Literally hundreds of employees crammed close together. Last week a supervisor tested positive for the virus and I fear it's a matter of time before I get it. I have an elderly father that lives with me that's recovering from stage 4 cancer and I fear if he gets the virus, it could be life threatening. I've only been with the company for about a month so I'm not sure how to proceed without losing my job.

[Florida, USA] My employer has just fired me for "no call no show" after I'd informed them I would be gone due to my son's birth.

    Posted: 01 Apr 2020 04:58 PM PDT

So for months we've known we were having a child. After being diagnosed with preeclampsia our doctor scheduled an induction Monday March 30th. I've been communicating with my HR and Supervisor about the entire plan and had informed them several times of my intention to use a week of my PDO to cover this week for the birth, recovery, and transition. When I notified HR the week of the 19th (when I found out the induction date) she informed me that I may have to take FMLA, but it shouldn't be necessary if I had the correct amount of time to cover it with PDO unless I needed to take more. I was also instructed that filing the pdo was not necessary as I had spoken with her about it. She gave my supervisor the papers for FMLA to give me the next week and I have them but they have not yet been filled out yet. We are currently in the hospital and corporate HR called me and informed me I was terminated for being no call no show for two days. My son was 27hrs old. The termination letter was dated yesterday March 31st with my benefits ending same day, however I was not informed until today April 1st. I guess my questions are do I have any recourse? In giving me the FMLA paperwork can I file it as a violation for firing me? I don't even want to go back there to be honest but i cant be unemployed and uninsured with a newborn. Any advice helps.

Ex wife can’t pay child support

    Posted: 02 Apr 2020 06:58 AM PDT

    Hi,

I've had full custody of my children for almost 2 years. My ex abused the children and put us through the ringer in court. She refused to settle in any way shape or form. After a long battle I was able to win custody but through draining every money I had and she also received a huge amount from my retirement.

Recently I received a phone call from courts for remediation. They want to remediate because she lost her job and can't pay CS due to the virus. I agreed to the remediation session but want to know what are my options before I go to remediation. The money is not much at all as she pays minimum BUT it is very helpful when it comes to groceries and activities for the kids.

Should I say I can only delay for few months? How do I explain how much I need this money for the children.

I'm new to reddit so sorry about my bad etiquette in posting.

[NYC] Harassment via smart TV cast requests?

    Posted: 02 Apr 2020 12:30 PM PDT

I live in a small building (<10 units). In unit "X", there is an elderly couple.

I live in a different unit, and have a smart TV. I keep getting requests to cast to my smart TV, and the device requesting to cast has the name "Apt X die already you old bitch."

I believe I know which apartment is doing this. Obviously, they are mistaken if they think my TV belongs to the elderly couple in apartment X.

If the culprit is who I think it is, then they've been causing other issues with the landlord as well. However, I know there's a stay on evictions in NYC until June so I'm not sure what he could do about it.

Is there anything I can or should do about this, given that the harassment is not actually directed at me?

Hit and run by a drunk driver, should I give his insurance the dash cam video?

    Posted: 02 Apr 2020 11:10 AM PDT

    Hi Reddit,

Using a throwaway account due to the legal implications of this case. Hoping to get some advice from this amazing community. Short version of what happened: I was driving on the highway, the cars ahead of me started slowing down and I did the same. I was rear ended from behind pretty hard because the driver didn't stop in time. The other driver then changed lanes and took the next exit, fleeing the scene.

I called 911, the highway patrol responded and took my statement. I agreed to email over the dash cam footage to the officer. I went to the ER and by sheer luck, the police officer located the vehicle that hit me. Apparently the other driver had driven ~10 miles from the scene and his car broke down - forcing him to call a tow truck. The officer confirmed the plate using my video and pulled over the tow truck. This was less an hour after the accident and the owner of the other vehicle was drunk, and IN the tow truck. The officer arrested him for drunk driving and took his statement (in which he admits to being in the accident involving my car but claims I fled the scene). Using the police report, I was able to get the other drivers insurance information and start a claim with them.

Now for the tricky part: The other driver is dodging the calls from his insurance company. His insurance company is saying they won't cover my bodily injury claim because "they can't confirm the driver in the accident." I provided the police report to my insurance AND his insurance - and in the police report he ADMITS to being in the accident. They are also pressuring me into providing them the dash cam footage without any real justification as to why. I even asked if providing it would provide what they need to cover my claim and they said no, they just want to have it on file.

Things I'm trying to figure out:

    1. Do they have any actual grounds for denying my claim? How it is possible that their insured driver hits me, flees the scene, and I'm stuck with $15,000+ of bills from the car repair and my medical bills??
    2. Do I need to hire a lawyer?
    3. Should I give them the dash cam video? Is there any incentive to do so? I don't have anything to hide but I'm worried they'll somehow try to use it to claim that my injuries aren't justified or something.

Edit to include my location: Bay Area, CA.

Any advice you can provide would be greatly appreciated. Thank you!!

My landlord has been stealing my oil for almost 2 years

    Posted: 01 Apr 2020 03:17 PM PDT

I live in MA. I rent an in-law style apartment where my landlord lives in the main big house (by herself) and I live in the (only connected by a breezeway, but all under the same roof technically) in-law side (also by myself). My lease states that all utilities for the in-law apartment are to be paid by the tenant and that the apartment has its own separate meters & oil tank. I verified before moving in that it is in fact a legal apartment with separate meters and 2 separate oil tanks (or so I thought).

The oil tanks are in my landlords basement, which I do not have personal access to. I've requested before to see them (for unrelated issues - mainly to be able to check the oil level), but there is always an excuse as to why I can't.

Anyway, I've lived here for almost 2 years and at first, I didn't really notice if I was going through oil fast or not (never had it before, so wasn't sure what the norm was). But recently, I've been noticing that I've been going through 100 gallons every month for the past 3-4 months (I'm on automatic delivery and the company can tell when it gets low I guess and they automatically show up and then bill me).

I finally called to try and figure out why I'm going through it so much, and they didn't really know what to tell me.

Today was how I found out.

I woke up to no heat and no hot water (they both run off of my oil). I was confused but it was too early to call the oil company (they weren't open yet) so I waited it out. My phone rang and my landlord asked me if I had run out of oil, because HER WATER WAS COLD. It didn't even dawn on me what she was saying when she said it.

However, I called the oil company, they came out, and had to prime my tank and gave me another 100 gallons.

I asked the tech if it was normal for my landlord to not have hot water when MY tank ran out of oil, seeing as how we have separate tanks and I didn't understand why my tank had anything to do with her water. The tech confirmed that my tank shouldn't have anything to do with her water as were completely separate. I advised my landlord that it seems as though the oil I pay for is going towards her hot water (and most likely heat as well), and she immediately got defensive and said "well I guess that's just how the house was built" and closed the door on me.

I can't imagine this is legal, especially with a lease, and it being rented as completely separate utilities. I've clearly been paying for her heat and hot water for almost 2 years and now I'm pissed at her response when I tried to ask her about it.

Do I have any legal grounds?

    Thank you

[NE] Landlord took my car to his own private property, whats me to pay an impound fee.

    Posted: 02 Apr 2020 08:53 AM PDT

I'll be straight up, I didn't pay a month of utilities when I signed the least. I also left trash on the property which I'm sure will cost me.

My car was on his property, with a dead battery, so I couldn't move it, I was not able to get to it for a week, I assume he had it moved, which I was able to check his other property I paid rent and my car is sitting there fenced in. I have the keys and title.

Anyway, he is telling me to pay $6,000 impound fee (it's been ~3 months).

This place isn't an official impound yard, do I have to legally pay this impound fee? Is this what they are doing illegal?

Paws stole my mom's dog (Aberdeen, WA)

    Posted: 02 Apr 2020 02:40 PM PDT

My mom took her dog to Paws for a behavioral training class since he's getting rowdy. They took the dog on a walk and apparently it supposedly bit the guy walking it and ran off. This dog has never bitten anyone, he's just big and rowdy and was getting rough with the smaller dogs. He's a 9 month old pup. So the dog was lost, my mom has been sick over it, and after a few days they 'found' the dog today. They are telling my mom they refuse to give him back and have tried to convince her they have the right to keep him. She's heart broken. I feel like there's no way this is legal though. Paws is a rescue, but not any sort of law enforcement. We need to know what we can do. My mom is older, retired, and they don't have a ton of money to dump on lawyers or anything.

(CA) Got notice of a modification of child support for my children because of a change in custody circumstance. Plot twist: my ex has neither paid any child support OR seen the kids in almost a full year.

    Posted: 01 Apr 2020 04:01 PM PDT

I have two kids with my ex boyfriend, 13 months old and a newborn baby. I found out I was pregnant with the newborn a few days after we split.

The child support and custody order was put in place a couple months after he left, and then modified slightly when the second baby was born.

His child support amount was calculated based on his involvement with the children which is 0. He was offered 50/50 custody and I agreed to no child support being paid if he took 50/50 custody.

He declined. Literally said he'd rather pay child support than have even partial custody.

His current amount in arrears isnt huge, and this isn't really about the money at all, but he never paid child support even once and hasn't seen either child once. He signed the birth certificate for child 2 and saw her then, but I'm not counting that.

I got notice that he had filed with updated information stating he was now seeing them 50% of the time (the asshole went as far as to list days of the week) and that there would be a modification of child support to reflect this.

I don't really have a lot of concrete evidence that he ISNT seeing them, I have the evidence that he hasn't paid CS but he's claiming he's been doing 50/50 for a few months now, but I was never in the habit of keeping receipts for things I bought for them or anything. I keep the custody stuff off social media too.

My question is how difficult is this going to be to fight? Is there something criminal in what he's doing or just really freaking annoying?

[Arizona] Tenant with a 3 month notice may not leave property

    Posted: 02 Apr 2020 12:46 PM PDT

    Hello r/legaladvice

We purchased a condo last year and it came with a tenant that has been there since 2013. This person has always paid rent on time and never gave us or the previous owner any issues whatsoever. We decided that once his lease is up (May 1, 2020) we were not going to renew him for another year as we need the condo for a family member. On February 1st 2020, we called him to let him know as well as sent him an email about it. He acknowledged receipt.

When we inquired about a move out inspection, he told us that he has been affected by the coronavirus and has not been able to find an apartment in the last 2 months. We believe he might not actually vacate the property on time. Is there anything we should do (legally) to prepare for this event? What are our options if this individual does not leave?

    Thank you!

Employers of 3 years repeatedly screwed me, then fire me without notice

    Posted: 02 Apr 2020 08:20 AM PDT

Hi Reddit, I hope you wonderful people can help me out a bit here today. Throwaway account because ex-employer seems vindictive. For some background, I have been working for a security company in Nova Scotia, Canada, for the past 3 years. I have a few medical issues (sciatic nerve, IBS) which the company has known about since the day they hired me.

Everything started to go down hill last year, when some time around June I broke my hand on shift. I work overnights, so after contacting my supervisor, finishing out my shift, and getting a few hours sleep at home, I went into the ER. It was discovered it was broken, I'd be off work for 2-3 weeks, and the doc sent off the relevant forms to Workers Compensation. My employer did not. I had to hound them for weeks to send in the paperwork, because living paycheck to paycheck and then having it dry up is not a good thing. My boss told me that until he got a letter from Workers Comp about it, he wasn't sending in the paperwork, even after I emailed him the WCB website and the appropriate rule about sending in paperwork no more than 5 days after the incident.

After this, my hours started to drop. And the more I pushed them after my return to work, the more they dropped. I used to get 3-5 12-hour shifts a week, which quickly decreased to 1-3 12-hour shifts, then 0-2 12-hour shifts, until finally I'm told the second week in March there are just no hours available. I figure fine, not the first time, there'll be some hours next week and I can scrape by for two more weeks. Next week comes, told there's no hours. And the next week.

That brings us to this week! Yesterday (April 1st) I received an email from a new boss at the company stating that due to the current lack of hours and accommodating sites, they have processed my ROE. I know for a fact there is a lot wrong with everything regarding this email. First, he tried to get a hold of me over phone so there would be no written record. Second, there is no lack of hours, a fact that can be proven by them currently hiring 4 guard positions and them already doing more hiring before I was let go. Third, the only accommodation I ever asked for permanently for sites I'm at is some form of washroom (toilet, port-a-john, whatever) because I have IBS, and don't feel like having a place to poop during a 12 hour shift is some form of luxury. I never asked for permanent accommodations for my nerve issues, and successfully guarded buildings up to 20 stories high. Fourth, he said they already processed my ROE, which from my understanding must be done no more than 5 days after the last worked shift, which for me was March 3rd. That would mean either they lied when submitting my ROE, lied about already processing it, or knew for a month they had let me go and strung me along. Fifth, I received no notice, written or otherwise, regarding my termination.

Sorry for the long post, I just need some advice on what to do. Do I have any sort of legal leg to stand on?

Banned from all Activities outside of work (NY)

    Posted: 02 Apr 2020 04:14 AM PDT

My boss has instituted a new rule that all employees may only drive from their house to work, and then back from work to their house. Nothing else can be done, if employees will not abide by these rules they will be removed from the schedule. He expects the signing of a contract stating that employees will abide by these rules. There were no provisions given for essential activities, or activities sanctioned by the govt such as going hiking, or getting takeout at a drive through etc. Only driving to and from work. There is also no fixed end date, just "when this is over"

    1. Can he enforce such a rule. This isn't about international travel to hot spots, it's about ANY activity other than work
    2. If I refuse to sign the paperwork and have my hours cut/am layed off would my boss have any potential ability to cause trouble with unemployment benefits.
    3. Would signing such a document potentially set me up for not being able to claim unemployment if he later lays us off with potential evidence we broke the rule?

The customs took my all my face masks and medical supplies

    Posted: 02 Apr 2020 10:55 AM PDT

I'm not sure if here is the right place for this but here is what happened. My mon sent me some masks and gloves oversea through DHL and it didn't take long for the package to arrive (I'm in Canada). As I teared down the plastic wrap I noticed immediately that the tape outside the box was cut.

I can only assume that the customs had taken my items, it doesn't make sense if DHL would do something like this. I heard that the customs can just take what they want especially during time like this. I'm honestly fine with my supplies going over to hospital staffs, they obviously need them more than me. But do I just accept this and do nothing? My mom paid for the package to be sent. I'm not trying to be selfish but she went through all the trouble and she's worrying.

I've already contact DHL's customer support and I'm waiting for a response. Any advice would be appreciated.

Edit: I want to thanks for those of you who replied. I apologized for accusing the customers without any evidence. I'm just really frustrated, this has never happened to me before. And yes, my supplies are indeed gone.

Apartment building manager won't let me move out

    Posted: 02 Apr 2020 02:24 PM PDT

    Location: Pennsylvania

My lease is up. I signed an agreement with my landlord that I would be gone from the apartment by May 1st. The move-in date for my new place is April 21st. I need to reserve the freight elevator and asked for permission from the building manager (different from the landlord) to move out on April 21st. She states that due to the pandemic, move-ins and move-outs are suspended until after April at the earliest. I didn't know that apartment buildings could prohibit that? The landlord I was renting from said there's nothing he can do about it.

My mom fell for one of those “diet pill” scams. What actions can I take?

    Posted: 02 Apr 2020 02:06 PM PDT

Summer of 2019, my mom signed up for one of those diet pill ads where you just pay the $4.99 shipping and get a free 30-day supply. She canceled shortly after being charged $49.99 for the next month and thought it was all over with.

She got her February bank statement in the mail, and saw that she was charged 8 different times totaling just shy of $350. March she was also charged numerous times for just under $350. So total she is out about $700. Her bank won't refund her since she had previously authorized the free trial, so we've tried contacting the company and they claim that she never canceled and that her card was being declined so that's why the charges just came through in February and March.

I went back through her emails and she has a cancellation confirmation from August 2019, and when I told them this they claimed that was just for the free trial, not any further purchases. How is this possible? The email explicitly states it cancels all subscriptions. She also only received her initial free trial, and no other supplements (they're claiming she's received 8 shipments). So she never actually received the product she was charged for.

I'm very frustrated. She does stuff like this frequently, but typically it's $10 or $20 here and there, not $700!!

I did some googling and see that the company is based out of Florida, and that they have numerous negative complaints on the BBB site. Can I contact the FL attorney general about this, or should I contact my state's attorney general? Any help is greatly appreciated!

Is there any way to force my employer to lay me off when wages are being cut? (US-MD)

    Posted: 02 Apr 2020 01:39 PM PDT

I work in the IT department of an "essential" business. Since we are in a retail industry, the stay at home order has vastly reduced revenue. Instead of laying off extra workers, management has significantly reduced wages and banned overtime, with no definite end date. I imagine that cutting wages is cheaper than laying off an employee. Currently I would be making about $200 more per week on unemployment. This, combined with the safety of not being at work, seems like a win-win situation. Is there any way I could force my employer to lay me off? Is there some sort of partial unemployment claim for lost wages?

Owner wants to kick us out for 5 days to fix kitchen then raise the rent after

hello friends, the owner of the apartment I currently am leasing wants me and my family to leave our house for 5 days to fix our kitchen (therefore kicking us on the street for 5 days), and then after the kitchen is fixed, she wants to raise our rent by 400 dollars. We have a signed yearly leasing contract. Can she do this? We have lived in the unit for 10 years. The raise in price is what bothers me. (State is Virginia)
