    Pretty self explanatory. This is in Kansas.

    We just moved to the a new home yesterday. In the seller's disclosure, the washer and dryer were listed as "negotiable" and, since they were pretty nice, we went ahead and included them as part of our offer.

    We went back and forth a few times but no one brought up the washer and dryer and eventually our offer was accepted. Yesterday, we got to our new house and they were gone.

    We messaged our realtor, who pulled up the signed offer and confirmed the washer and dryer were supposed to be included. She asked the listing agent, who said they weren't supposed to be part of the sale, but were accidentally listed as negotiable. No one caught this or said anything and we were certain we would get them with the house.

    My realtor is checking with her broker today, but what kind of recourse could we have here? Would this hold up in small claims court? Is it even worth it to try and get the washer and dryer back, or get a credit from the sellers for a new one? We're just low on cash at this point from the move and really don't need this right now.

    I'm not sure if this should go under contracts or real estate, so please let me know if I need to change it.

    UPDATE: the listing agent sent us $500 to put towards another set. We just took it and will use it towards a new purchase. Thanks everyone for the input! I'm glad we didn't need to fight over it.

    I was sent a $3000 cheque and I’m not sure if this is a scam

    I applied for a job as an administrative assistant for a photographer. I was hired pretty much 3 days later. He then sent me a $3000 cheque and said this: use $750 for your wage, use $200 for any equipment you need for the job, and use the remaining amount to book an exhibition hall for his event. This seems really sketchy and I'm not sure if this is some sort of illegal activity. If anyone is an expert on cheque fraud, I can take a picture of the cheque and send it along.

    My web hosting company automatically signed me up for a 'free trial' of their new service then tried to charge me and told me that it had been my responsibility to opt-out of it. Is this legal?

    Yesterday I got an email from my hosting company that said my 90-day free trial for some backup service had ended and they couldn't charge my card. I had never signed up for this service, or read about it prior to this email. I know for a fact I haven't signed up for any kind of trial with them. So, I dig through my email and find:

    April 2019 they sent out an email promoting a new automatic backup feature they will be rolling out to accounts later in April 2019.

    Then nothing until Jan 2020 when I received an email saying my automatic backup was now active. Read a bit in and it says that they will start charging after 90 days and I can cancel it anytime I want. Problem is, I didn't sign up for it, didn't remotely ask for it and I didn't see this email because it was shuffled into the promotions folder, whereas the latest one about them not getting my money went to the primary.

    There wasn't another email until yesterday about the card getting declined. No reminder about the ending of the 90 day 'trial'.

    When I talked to them they said it was legal because they sent an email to my main account telling me about the trial and that I was the one repsonsible for opting-out if I didn't want it.

    I'm not out any money from this, thankfully my card on file was old and invalid. I easily could have been though, and I bet other customers are. This strikes me as extremely shady at best. Is it legal for them to sign me up for a service I never asked for, even if it starts as a 'free trial', and then convert that to a payment without my express consent?

    Sellers swapped out appliances between seeing house and closing

    So my wife and I just purchased our first house. It had brand new, high end appliances (refrigerator, stove, dishwasher, washer, and dryer) when we saw the house. The fridge still had the manual and paperwork inside, it was brand new, never used. Our offer was that all the appliances would convey to us. We just finished the closing process a few days ago and when we got back to the house everything (well, everything except the dishwasher oddly) was replaced with old, crappy, beat up appliances. It literally looks like they went craigslist and found the cheapest appliances they could find and replaced them. Things are dented, rusty, and the fridge is rattling when running. Looking at our contract, it states all the appliances convey but it doesn't specify Makes/Models, it just says "refrigerator", "washer/dryer", etc. This isn't, really, the end of the world, if they countered our offer without the appliances we would have still bought the house, but I just feel like they went out of their way to deceive us. The only proof I have is, that real estate listening is still up with pictures of all the appliances that were in the home when we saw it, I took screenshots of each image before it's taken down. How should I proceed? Talk to my real estate agent? The lawyer? A new lawyer? Any help appreciated! Thanks!

    (Ohio) The corporate office of our property management company wants us to go door to door to talk to people.

    I work for a property management company located in ohio. This company manges HUD and Section 8 properties.

    Currently my boss, the property manager and myself the assistant property manager are still working on site in the office. Along with 1 maintenance man.

    Our corporate office has been able to work from home for about 4 weeks now, but we are required to stay on site.

    This is fine, but the individuals at corporate are pushing us to go door to door and remind people to pay rent and send in their recertification packets.

    Those of us in the office are beginning to feel completely uncomfortable doing this with everything that is going on.

    They ended up being mad at us because they have wanted us to go out everyday to remind people daily. And the head CEO or company owner (not sure which he is) said he doesn't feel like we are doing enough to try and collect rent.

    We feel this is putting us at risk. We have to handle people's papers and still interact with them.

    My boss has been trying to find a way to report this, but has been unable to find the proper avenue to go through .

    Does anyone have any suggestions? Would they be able to retaliate against us for reporting them?

    We have emails that clearly shows them being aggressive about giving out notices, late fees, knocking on doors, and how people should definitely be able to pay because of the possibility of stimulus checks.

    Please help, I'm 16, my mom just called the cops on my dad saying he abuses me but he didn't do anything wrong, they're going to come back and I don't know what to do.

    I asked a question here yesterday and thakns for the help received but now the situation has changed (for the worse) my mom has called the cops on my dad because I'm not visiting and I'm freaking out and I dont know what to do. She's sending 100s of texts every day and in some she said she would call the police and CPS on my dad but I didn't believe her, but she did it for real. I was home alone because my dad had left for work, I was just out of bed and there was a knock on the door and it was the police. They said they have a report that my dad is abusing me and locking me up inside the house so I can't visit my mom. It's not true at all she's the one who's harassing me and there's a good reason why I don't want to visit it's because her boyfriend wants me to watch porn with him and I don't want to. I told them many times it was my idea not to go but I'm not sure they believed me. My mom said she has started telling everyone she knows that I'm a liar so I'm sure she told them too. They asked if it's true that my dad doesn't want me to visit her and I said yes but that's because I asked him, usually he makes me go but now we're going to go to court to change the custody agreement. Anyway I've been told that I'm old enough (16) to decide if I want to visit or not. They wanted to talk to my dad but it's not like he can just leave work in the middle of the day. I showed them the texts she sent where she threatened to call them. They left but they will be back to talk to my dad now I'm freaking out, I don't want him arrested he's done nothing wrong. My mother was always difficult but she was not that bad but now she's going crazy and she wants to hurt us, first the texts and destroying and selling my property now this. I called my dad at work but he can't come back now they are short staffed already. I'm so terrified now I don't know what to do I'm sure she's going to lie and my dad is going to be in trouble but he's done nothing wrong. What should I do if the police come back?

    (MI) Neighbor's Kids Took and Destroyed a DIY Project Off My Backyard. What Can I Do?

    Yesterday while doing ourdoor projects we noticed the neighbor's kids were running around, being kids. Occasionally they came onto our backyard, but didn't seem like they were doing any harm, and didn't stay for long. Their mother was sitting in a running car with a assumed friend watching them (and possibly smoking weed based on the smell, not the first time).

    We went inside for food and refreshments, and by the time we came back out the kids and the car were gone. After a bit of more yardwork, we noticed one of our DIY projects, a chair we picked up off the side of the road that we were in the process of repairing, was torn apart and hanging in their tree.

    While this chair didn't cost us anything, we've already put several hours into stripping the old paint and we were about halfway finished with it. My wife is really distraught as she had grown really attached to the chair. Short of just walking over and telling them to please watch their kids closer, what is something we can do?

    $2,600 from my checking, and $1,200 from my savings have been stolen

    Hey all, so this is my first time posting on legal advice. I am seeking advice from y'all and making sure I am taking the correct steps for my situation. I was trying to find more information online on my specific situation, but I am having trouble with that. I am living in Los Angeles county

    I called my Wells Fargo Bank 2 days after all my money had been withdrawn . I only realized because I had a hold on my student portal in order to register for classes next semester, after trying to pay my student fees that my card was declined. And that's when I found out.

    With my bank, I closed both my checking and savings account and opened a new one. I was told to wait 10 business days to find out if they'll resolve my claim. They also replaced my card.

    Shortly after, I went to my police department to file a police report about the fraud.

    Is there anything else I can do instead of waiting? This is the most stressful situation I've been in, in my entire life.

    If it helps, the name of the withdrawal title was "cash ewithdrawal in branch/store 'city name'"

    Followed with "cash ewithdrawal in branch/store 'another city 25 minutes away'"

    Checking withdrawals were split as 1,200 1,400

    Both of the locations were at Wells Fargo Banks

    I do not know if it was withdrawn from inside the actual bank or the Bank ATM.

    Employer Forcing Employees to take Negative Vacation Time (PA)

    I was asked to reduce my hours to 32 hour weeks due to lack of work relating to COVID-19. Initially I planned to take the 8 hour cut as unpaid time, but apparently we have to use vacation time. However, even once we hit 0 vacation hours, we're still being asked to use vacation hours until we're at -40 hours. This then has to be re-accrued before we leave the company or we owe the company money for the hours. Is it legal to give the employees no option but to go negative? And then also dock their last pay check for the negative hours?

    I bought a Samsung Galaxy phone and it was shipped through FedEx. It was to be delivered after signature but I got a text that it was delivered and signed for. I looked everywhere but couldn't find the package. I called FedEx and they opened a ticket for this. I received a call later from them and was informed that the driver left the package at the door and signed for it himself due to the virus issue. I am pretty sure that either he didn't deliver or delivered it at a wrong address. I called Samsung and they told me to wait for FedEx to finish their investigation and then file a police report.

    Does any one knows what happens after the police report? Are my $1000 gone for good? I asked Samsung to block the IMEI number of that phone but they won't do it (yet).

    Friends work wants everyone to work Saturdays with no pay

    I hired someone on Fiverr to create a 3D product for commercial use, and have now received a cease and desist(NY)

    A year ago, I hired someone on Fiverr to create a 3D design. Before we completed the transaction, we spoke on the fiverr platform about my requirements. I told him that I fully intended to 3D print and sell the model he will design, so I required ownership of the rights to the 3D design. He responded and said that I will have full rights to anything I order from him. After I completed the transaction, I asked if he had any sort of paperwork that he can send over with a signature saying that I own the design, but he refused to sign anything and said that our chat history will be the agreement. When he sent the 3D design over to me and I accepted it, he sent a message saying "You fully own the 3D printable design I made for you on this gig"

    Fast forward about 8 months, I have been selling the 3D print with no issue, and have been working with a manufacturer to mass produce the 3D design via injection molding. As soon as I started selling the mass produced version, the Fiverr designer sent me a cease and desist on both my 3D printed listing and mass produced listing, claiming that the design was not meant for commercial use and that he will be coming after me for the profits I made on the design for the past year.

    Am I totally screwed here? Should I have gotten a signed document from him that I own the commercial rights to the design? What are my options here?

    Fired from company, now they "can't find" my personal belongings to return to me

    I work in Connecticut and was let go due to the virus.

    I was hired as a contractor by a recruiting agency based out of state (my paychecks come from Virginia) to work at a company in Connecticut.

    I received a call from this recruiting company one late Friday night in March that I was being let go and to not return to the job site that Monday. They said they would ship me back my personal belongings.

    I relayed to them exactly where my 2 items were - my earbuds and my prescription safety glasses. They were both on my desk the day I left on my last day of work. They told me they were able to find my earbuds (which they shipped back to me) but could not locate my prescription glasses.

    It has been over a week now and I haven't received any updates. These glasses are valued at approx. $500. I do not have a receipt for the glasses but the store I purchased them at last year still might. Is there anything I can do?

    My mother recently kicked me out and I live with my dad. She likes to micromanage me even though she said she was done with me and didn't care. She didn't give me all of my stuff, even still has my boyfriends 3DS and all the games he let me borrow. But she won't give it back. But most importantly I don't have access to my birth certificate or my social security card. I don't even have the insurance card to go to the doctor (I am currently paying for my birth control completely out of pocket) because she won't give them to me. I'm still a minor and won't be 18 for 6 months. I live in Iowa in the states and I want to know what I can do about this.

    Any advice?

    Hello from Texas

    About 15 years ago after a nasty divorce I had to sell the house I was in due to black mold. I moved in with my older sister along with my son. My credit was in bad shape so my sister helped me get into a small condo; fixer upper type as it was all I could manage. I paid the down payment and all payments for the past 15 years but the condo was in my sister name because she had a better credit score at the time.

    I worked on my credit score and was looking into getting it transferred into my name when my sister was struck ill. In less than three months with all this going on she died three weeks ago.

    One of her daughters got a video of her last wishes on video and rush to get a will done and signed by her while she was in the hospital.

    There was no mention of my condo in her video or said will.

    What do I do?

    Sorry this is kinda long Throw away account for obvious reasons.

    Back in January my wife's friend (we will call her Abby) was in an abusive relationship with a boyfriend she had been living with who was not the father of the three kids she has (ages 8-12) and the biological father is not around. Being in a bad situation she had no where to go, my wife took it upon herself to have them move in with us to escape the abuse and be able to get her life back together in a safe environment. When she moved in my wife did not have any kind of agreement or terms and conditions of her staying so I wrote up a small living agreement that outlined that she has three months to prove that she is making efforts towards getting a job, getting a car, and saving to secure her own place to live. If she could show ample improvement I would allow her more time to stay but if not she could no longer live in my house. A few rules I included: No drinking alcohol in the house No drinking alcohol or doing any drugs outside the house that would inhibit her ability to perform her obligations to her children or myself No dating/seeing anyone No guests are allowed over

    Now, I know it may seem a bit rude or outside of my place to tell her, let alone put it on this living agreement, that she cannot see anyone while living in the house but my wife had just driven half way across the country to rescue Abby and her kids and to allow them to live in my house, in which we also have three kids of our own. I didn't need her going out and getting in another relationship and start bringing a stranger around my family in house that is already full. Besides if she is working and not having to pay any bills whatsoever then she should be able to move within the three months and then she could date whoever she likes. I dunno if that's something that would hold up legally but I am just trying to protect myself and my family.

    Shortly after getting a job and a car, Abby started staying out later and for longer periods of times going to the bar and ended up getting herself a boyfriend who did not have his own place to live. They thought it would be just fine if they were to stay outside my house living in the car. Even tho I considered this as having a guest over I was being lenient considering my wife saying her boyfriend was a good guy and she deserves to have a break after all she's been through. I gave it some time to see how things would play out but as time went on Abby was spending less and less time in the house with her kids and started spending almost 24/7 outside with her boyfriend when she wasn't at work. I finally told her that she is breaking our living agreement by having him over and that he needs to leave. So when he left she left with him. She has stayed away for almost three full weeks now only stopping by ever once and a while to grab something and then leave. During the weeks I gave her many chances to return and to be with her kids but she says that it would mean she couldn't spend time with her boyfriend and that's not something she is willing to do. She no longer is here to care for her children or provide for them in anyway except to give my wife her food stamp card to buy them food. Her phone has been shut off and I have no way of contacting her except through my wife who is still in contact with her through Facebook. She is going from place to place living with her boyfriend out of her car. I have told my wife that she cannot do this and that she is neglecting her kids and if we don't do or say anything about it to the authorities we would also be complicit in her actions and risk our own kids being taken away. My wife loves these kids and cares for them deeply and doesn't want them to leave but I feel that we can't continue to care for them while their mother refuses to return unless we have some sort of authority to do so.

    I want what is best everyone so I am asking for your help and guidance as to how to handle this situation. My wife doesn't want to lose her friend but she won't listen when I tell her this can be considered a crime for all parties involved. She feels that if we were to file for emergency custody we would be taking her kids away from Abby and that would destroy her friendship. (Too bad so sad in my opinion)

    I do not believe that Abby would return to stay with her kids even if the law was involved or that she would just take the kids somewhere else and that somewhere else would be much worse than them staying at our house.

    I do not want Abby to live at our house anymore seeing that she has taken an act of charity and goodwill and used it to abandon her children in pursuit of a new found lover and moved out anyway. The agreement she has broken on many occasions ends on the 18th of April.

    Please show my wife that something needs to be done now and sooner not later.

    Would I, a 13 year old, be able to legally go behind my parents backs and get vaccinated?

    I'm from Minnesota. My parents are antivaxxers and have been my whole life. I've never been vaccinated. Though, I have siblings who might bring me to get vaccinated, if they were up for it. And hopefully, at some point there will be a coronavirus vaccine.

    I'm not sure if my parents would get the vaccine though. And I'm worried. So, would I be able to be vaccinated without parental consent with an older sibling?

    My car was stolen out of my repair shops parking lot

    My car was stolen out of the parking lot over the weekend. The shop says they are not liable for anything being stolen out of the lot if they still have the keys. When I asked about their insurance they responded angrily and said I am not going to ding their insurance when they did nothing wrong. Do they hold any liability or is it my responsibility?     Air Conditioning broken in My Apartment

    I live in Texas.

    Yesterday and many days before it was 88 degrees in my apartment, while it was 88 degrees outside. I had my AC set to 72 all day.

    I've VERBALLY contacted maintenance several times to assist, they come over, change a filter, and/or add Freon. It's temporary and I feel like it's a leak or somethings blocking my intake.

    But per the lease contract it states

    "31. Our Responsibilities. 31.1 Generally. We'll act with customary diligence to:... (b) Maintain fixtures, hot water, heating, and air-conditioning equipment;"

    If they do not fix this by the end of the month may I withhold rent? I'm contacting them in writing right now to help my case but I just don't know what options I have to get them to fix this other than asking over and over.

    Again I live in Texas, normally I believe our laws don't require AC as a necessity (even though we should) but the lease seems to state that my particular apartment is responsible for the air conditioning and it's functionality.

    In law family drama, wanting advice on how to help

    Tl;dr Cousin in laws mom has poa over her because she is lightly mentally handicapped. Cousin (32F) is wanting to leave her abusive mother and marry her now 5th fiance but (crazy) mother is holding poa and threatening to put her in a mental home if she doesnt follow her every command. Is there anything she can do

    Cousin in law who is lightly mentally handicapped (32F), is wanting to get married to her now 5th fiance but her VERY controlling mother is not letting her leave or get a place with her fiance. Her mother is threatening to put her in a home or ward if she gets married to him or moves in with him until they've been engaged for at least 2 years (was 5 changes monthly it seems).

    Now she does have some mental handicap issues. I'm not exactly sure what but she could hold down a job and drive a car ( if her mother would let her) and you couldn't much tell by talking to her either.

    Her mother is very controlling and has been since I've known her since we were neighbors like 10 years ago, shes also the type of person to steal $600 out of your car then turn around and proceed to tell you about how important family is. She also threatened to sue my wife and I when we didnt invite her to our wedding. Just setting the tone here.

    Now the cousin also has a severely mentally handicapped brother (22m and ~6'3") who has a problem with throwing things and hitting. I'm not going to argue with anyone if he does it on purpose or not but the cousin says most of the time he does things like this on purpose. Now I've seen him throw things when he feels like no ones paying attention to him but when people including his own dad get on to him the mother jumps in and starts yelling at everyone and defending the brother so the cousin says her brother does it and knows he can get away with it.

    Her brother has been throwing things more often and harder as of late at the cousin. Most recently he threw his phone at her back hard enough to leave a golf ball sized bruise according to her. But she cant do anything because her mother has poa and control over all her money she receives from disability. Also she can't move in with her fiance due to her mother and because her brother is soo handicapped she feels like she cant go to the police for help and due to her and her fiance not having enough money for an attorney she feels absolutely stuck.

    Also their home is very gross, trash, roaches, fleas, 4 dogs who poop in the home just deplorable conditions. On top of that her mother also controls when/what days shes allowed to shower and for how long.

    Is there anything she or the fiance could possibly do to Spring her from her abusive home?

    My job laid me off but called me back in to work for a few days, can they change my salary to hourly without discussing it?

    Our pay week is Sunday-Saturday and received an hourly paycheck without discussing a change in pay structure.

    Early lease termination

    First time asking anything here. To start I am in ohio, and I signed a lease to end in October of this year. In this lease there is no statement showing the process of early termination of the lease. Now they are presenting me with papers that state i need to pay 3 months worth of rent following a 30 day notice.

    Is this usual circumstances?

    Nonconforming use structure on property

    I'm hoping to gain some insight into my current situation involving the city I live in. It is regarding two 20' shipping containers I placed on a vacant lot. It is not my home property. They were placed in August 2019 on an existing 20'x24' concrete pad. Before doing so I went to the city office and checked all the zoning/building ordinances. I did not find anything prohibiting steel storage containers. In fact, any storage building under 200sqft does not need a building permit. Each container is around 160sqft. I had them delivered and nothing seemed to be an issue

    In November I read the city minutes of last meeting. Someone was upset by my containers and wanted the city to check in legality of them. The next meeting the council discussed and stated there was nothing wrong with my structures according to current zoning/ordinances.

    Fast forward to now. New city council. One member has created a proposed storage shed ordinance. The person stated 'sheds should be made from wood" and "what ever you say doesn't matter, we'll pass this anyways". Council had the first reading of ordinance. (due to covid-19 everyone participated via phone call. What a mess). I obtained a copy of proposed ordinance. It basically goes through what a storage shed should be like in the city. Has small drawings of a good shed and drawings of shipping containers that are prohibited. It shouldn't be steel. It can't be a standard shipping cargo container of any kind. States its is needed for public safety and general looking of town. All in all I don't have a problem or the ability to stop such an ordinance from passing. My issue is one bullet point in the ordinance. It states:

    "Existing storage structures defined and described as disallowed by the regulation, shall be made to comply with a municipal codes and/or shall be removed from all properties by July 1st 2020."

    It seems by that I am being told they will force me to remove my structures.

    I have been searching terms like 'grandfathered in', nonconforming use, and non compliance. IANAL and feel helpless. It seems that I was within current zoning laws when I placed the structures. Now someone has a problem with me and appears to have crafted this ordinance directly to me.

    My question is: does the city have the ability to fine me and force the removal of my storage sheds? In ordinance it states that failure to comply with be a simple misdemeanor.
