(NC) Hit by my neighbor backing out

    Posted: 07 Apr 2020 06:47 PM PDT

    Location is NC.

I was pulling out of my drive way to go get my car registered and inspected.

No joke, almost parallel to the road (that slight turn when going from reverse to forward to get on your side of the road.

Live in a subdivision. Young idiot on the opposite side of the road nails it in reverse and send his car all the way down the side of mine. It's clear as day his fault and you can see point of impact on the side of my car.

Now. Being I wasn't in my driveway, I got a ticket for failure to register and inspect my car (as I was on my way to do so). Driver who hit me got a ticket for failure to yeild.

Officer said he sighted us both contributing to the accident. Wouldn't give a percentage.

I took many photos instantly and it very clearly shows neglect on the other drivers part for not being aware.

There is no unibody damage and just two doors that need to be replaced. I am a mechanic and it's nothing I can't do by myself.

Should I risk contacting their adjuster or talk to my neighbor and try and settle without insurance claim? I fear I may be up a creak. Being it's not registered/insured. :/

    Insurance denied wisdom teeth removal

    Posted: 07 Apr 2020 04:32 PM PDT

I got my braces removed in January and was hoping to get my wisdom teeth out as I noticed one breaking through. Went to my dentist and he told me I will need them out and referred me to the oral surgeon. Oral surgeon said they'd need approval from my insurance to do the procedure. That was more than a month ago. I was hoping to get the procedure done before I turn 21 (mid april) because that's when my state's free insurance (Tenncare) stops coverage. It's now april and I just got notified today that I've been denied because the root of my tooth is not completely formed, so it's not medically necessary. I don't know how to go about the appeal since my birthday is coming up so soon and everything with this COVID situation will probably slow the process even more. Any help is appreciated.

    Auto claim

    Posted: 07 Apr 2020 05:33 PM PDT

Tell me what you guys think. In November 2018 I got into a car accident where two people were taken to the hospital via ambulance however did not appear to be a seriously injured as I saw both people walk around and I talked to them, and they seemed fine.

A claim was filed and I was at fault. I hadn't heard from my insurance company in a while despite checking in with my claims adjuster periodically. however today I received two Letters in the mail for the same claim number both dated 04/01/2020.

One letter says that Our preliminary investigation has revealed that the total claims may exceed your coverage limit advising me to potentially get an attorney.

The second letter says that they are please to inform me that the claim has been closed because the claimant could not prove bodily injury under NYS law.

What do you think? I am going to follow up with my claims adjuster but wanted some preliminary thoughts. Thank you.

[AUS] Perpetual Roadworks and Dangerous Overtaking

    Posted: 07 Apr 2020 10:26 PM PDT

    G'day guys,

I was wondering where the law stands on perpetual road works?

For example today I passed a line marking operation, and at the start of the line marking operation there was a vehicle displaying a 40 km an hour sign, which is pretty standard for most road works.

However at the other end of the line marking operation there was a bunch of vehicles and an "end road work" sign however there was no sign allowing the speed limit back up to 100 km an hour.

Now you would normally think that we've common sense you would just go back up to 100 km an hour at an "end roadworks sign", however I did get stung a few years ago in Victoria where I did exactly that and the police warned me for doing 60 km an hour over the limit. The officer who gave me the warning had the opinion of "you follow the last sign that you saw denoting the speed limit for the road", ergo, as the last sign was 40, you do 40, even if that means you drive for 20km more at that speed.

During this, a number of people overtook, somewhat dangerously mind you, and it got me wondering, what the laws actually are? Would I be deemed to be driving dangerously? Would I be considered a contributor to the accident if one were to occur? Would any portion of the liability be levied against my insurance?

I'm now in QLD, be also interested if the rules change state by state.

    Covid-19 Car insurance boom

    Posted: 07 Apr 2020 10:09 AM PDT

My car insurance is due next week (great timing). UK, London.

I pay £460 annually, my renewal quote £980... On compare sites the quotes are in the excess of thousands.

    Wow.

I have also found that many companies are turning away new customers. A varitey of sites wont even let me make an account to get a quote.

Buying Back My Own Flood Car From Insurance/Salvage Yard?

    Posted: 07 Apr 2020 08:21 PM PDT

    Location: Indiana

    Hello all,

I have a Subaru WRX that was involved in a small flood in front of my house during all the stay at home orders. Insurance totalled the car and offered me $5000 to buy it back pending an inspection at a licensed Subaru dealer. My question to you all is if i can negotiate this price? Given the market right now the auction lot will not be able to sell the car for months and they are leaving water inside the car for that long. Is there any possibility for me to get this reserve price down since I am going to be putting a decent amount of money into this car?

Any help would be appreciated, thanks!

TLDR: Can I negotiate the $5000 totalled car buy back from insurance/salvage lot or is the price set in stone?

    Question

    Posted: 07 Apr 2020 01:15 PM PDT

I own a unit in four unit condo association. There was a roof leak that was occurring for years and didn't notice until finally piece of ceiling collapsed. I made a claim with insurance for the shared condo insurance for mold remediation. They determined that they can't reimburse as it was a maintenance issue. About six months to a year later the owner of unit below me discovered leak where I guess water had gone down side of my unit to his when initial leak was found. State Farm reimbursed him 7k for mold remediation which i just found out about. I am now roughly a year and a half removed from my initial claim. Anyway I can attempt to contact State Farm for reimbursement or is it a lost cause at this point? I would think if they processed his claim why wouldn't they mine? I am not hopeful at all considering the amount of time that has passed.

We have since updated by laws to ensure shared area costs are split but we did not have anything written at the time of the leak.

    Posted: 07 Apr 2020 11:58 AM PDT

She doesn't have a car, she's not allowed to drive her grandparents car, and she is a tenant to them paying rent each month. Why is she paying car insurance when she's not driving any cars? her grandparents drive her to and from work. is this a law? Please help us understand the law, she's going to get kicked out of her grandparents house if she doesn't pay it, which she can't. Thank you.

    Health insurance for hysterectomy

    Posted: 07 Apr 2020 10:32 AM PDT

I have been seeking a hysterectomy for quite some time now and am now talking with a therapist to get letters written. Two letters are required for me to get the hysto and insurance cover it. I am on my parents insurance and they do not approve. My biggest fear is they will be send a 20,000 bill after this and not everything will be covered. They already don't approve and I am terrified of big expenses not being covered and them being billed. We have blue cross and blue shield of Alabama

    Insuring my boyfriend [WA, USA]

    Posted: 07 Apr 2020 03:09 PM PDT

Hi! I'm buying insurance for a car I plan on road tripping in, and am wondering if I should add my boyfriend as a driver to my policy. I plan on having him split driving with me and want to make sure insurance is valid and adequate, not to mention he drives my daily car occasionally. Himself and his personal car are already insured under his family's USAA policy. Are there any benefits or drawbacks to adding him as a driver? As he is older than me and had a nearly spotless driving record he actually brings the rate down a bit.

My main concern is it affecting him and his insurance in some way.

    Health insurance for students 26+

    Posted: 07 Apr 2020 02:01 PM PDT

I'm a Grad student in DE entering into my final year of Grad school. I'm currently 25 and on my dads plan, but come January I will turn 26 and have to get off of his plan. I have to have proof of insurance to attend my school. Wish I just turned 26 a few months later but can't really do anything about that. I do not work as school takes up all of my time. I'm living off of student loans. I have the option to sign up for my schools student health insurance policy, but it's pretty crappy and expensive. Plus it would start next month and I don't need it until January. So what are my options?

    Young first time home owner

    Posted: 07 Apr 2020 01:04 PM PDT

Hello everyone, recently graduated college. Got a great job in my field, have been saving to buy/invest in a home long time.

24 y/o and under contract, trying to pick home insurance for my needs. I've been learning a lot in this sub and some others on what to look out for. I have a few different quotes, all have some differences in premiums and certain coverage expenses but they're all based on $1000 deductibles.

I know I can always change down the line, but being the detail oriented person I am want to make the right first choice.

Current competing quotes (I did have 2 different brokers) - from lowest to highest premium: Stillwater - Allstate - Openly - Travelers - SafeCo

The home is from the 1970s, but I did see as a rule of thumb you don't want to use insurance for anything such as A/C - roof etc and it's better to have a savings account for it.

I will be DIY renovating, living in it and renting one side of the house like a studio. I do have a pool, no pets so far and living in Arizona.

Current auto insurer: Progressive (from different state, just moved)

Help would be appreciated, all the different coverage costs are getting a bit overwhelming :)

Massachusetts, USA - "Fully approved" ABA claim later denied

    Posted: 07 Apr 2020 12:28 PM PDT

We live in Massachusetts and we have a son who has been diagnosed with ASD. Last year we had a reputable local ABA provider assess our son and recommend various services. Prior to this assessment (and after submitting a plethora of paperwork) we received an email from the ABA provider that included the following...

"Thank you for your patience as we awaited confirmation/authorization from the insurance company. We are fully approved and ready to begin services!"

Our insurance (Blue Benefit Administrators of Massachusetts) then went on to assign us a nice case worker to oversee everything and ensure we got what we wanted from the provider.

Ultimately, we decided not to engage their services. It just wasn't a good fit for us and our boy was doing very well in school.

Some time later we got hit with the full $1,100 bill for the initial assessment. I spoke to my insurance and while the services had apparently been "pre-certified", a supervisor later deemed that they weren't covered under my company's plan.

So I'm not sure as to who's at fault here. Did my insurance mislead the provider? Did the provider mislead me? Did I ignorantly misinterpret the phrase "fully approved"? Was I stupid to trust the provider?

And lastly, do I have any recourse at this point?

Thank you for any advise that you are able to provide.

    Using a “mechanical breakdown” plan?

    Posted: 07 Apr 2020 10:29 AM PDT

This is mainly for my mom. She has an older bmw. It slams into gear on cold mornings and the transmission slips (auto). Sometimes gives a very hard jerk into 2nd and 3rd. While she still drives it daily, the transmission obviously won't last. It's been getting especially bad the past few months.

She can get breakdown insurance through a company called "healthcar" with her job. She spoke to an agent and explicitly said that the car has issues, and they said that's fine and expected for old cars so it's priced in.

The total cost is $48/month. Anyone have any experience with something like this?

How much to pay back for subrogation claim?

    Posted: 07 Apr 2020 10:22 AM PDT

I was in a car accident in California where the other party was at fault. I completed my medical treatment which was paid by my own car insurance medpay. I made the claim against the other party and the offer came back rather low. I want to try to reduce the amount I need to pay back to medpay so I'm reading here: https://codes.findlaw.com/ca/civil-code/civ-sect-3040.html that

    (d) If the enrollee or insured did not engage an attorney, then the lien subject to subdivision (a) may not exceed the lesser of the following amounts:

    (1) The maximum amount determined pursuant to subdivision (a) or (b), whichever is applicable.

    (2) One-half of the moneys due to the enrollee or insured under any final judgment, compromise, or settlement agreement.

If my offer from the other party was 4000 and my medical bills were 3000. Based on the above text, does that mean I only have to pay back 2000. I don't have an attorney. Another reference is here: https://www.henshawhenry.com/california-subrogation-laws/

Is the 2000 amount correct? My subrogation representative disputes it saying theres no such thing.

How long will vehicle violations made as minor affect my insurance rates? (NH)

    Posted: 07 Apr 2020 09:34 AM PDT

I'll be the first to admit I was a reckless driver in my early years of getting my license. I had 4 moving violations within my first 1.5 years of driving, the last of which was three years ago. My last job moving violation (misuse of plates) was 2 years ago. I am turning 21 soon and will be getting my adult license. I took a defensive driving course to remove some points and have been driving safley for the past two years (have lost thousands as a result of my stupid youthful actions). How long will this affect my insurance rates? I've heard that in my state moving violations last for 5 years but have also heard that once you get your adult license that this can help as well. I'm asking because I had to sell my $1000 car because the insurance was too high on it and am scared to get a newer car because of how much more it will be for me to insure. Thanks for any insight!

    Unemployment Stimulus

    Posted: 07 Apr 2020 01:19 PM PDT

Hello: as you know, President Trump signed into act a stimulus package that adds an extra $600/week to everyones unemployment during COVID-19. My parents are near the top of their bracket with Marketplace Insurance, and if they make much more than they already do, they no longer qualify for their healthcare assistance through the Marketplace. My question is: does this extra $600 (that is state and federally taxable) count towards Marketplace income? It will basically double their income and will wreak havoc on their insurance plan if it does! They just met their deductibles and are very worried.

I would imagine this stimulus will mess up many people's insurance plans! Does anyone know if the Marketplace is doing anything to remedy this?

We bought a home and got a pit bull after, now what?

    Posted: 07 Apr 2020 10:58 AM PDT

So without thinking we adopted a pitbull lab mix from the humane society here in Utah. We didn't think to review our home owner's insurance policy to make sure she wasn't a non-covered breed, which she isn't, because we hadn't owned a home in many years and we were just ignorant. I'm not sure if my lingo is right but we're wondering what to do to get her covered. Can we get an umbrella policy or a stand alone policy?

She has been spayed and this is the we really screwed up part, she escaped from our six foot fence by jumping off a boulder and fatally wounded a chicken almost a year ago. The chicken owners are people we've known for years and we apologized profusely and they did not call animal control. We added specialized protective fencing to keep her in. She is two. She is great with kids and other dogs. She's been very gentle. She is always on a leash and we have installed a baby gate so she can not go down the stairs to the front door. We never thought about our insurance policy until someone mentioned they ouldn't get a pitbull because their insurance didn't cover it. And I thought why did we not think of this. I want to be honest with our insurance company and let them know, but as of now I don't have a job so increased costs are a big concern. I could try to get a job but I have health issues. We just want to do what's right whatever that takes. Does anyone have suggestions on how to best handle this? Should we get a stand alone dog liability insurance, inform our insurance, and then ask if we can get an umbrella policy?
