Everything was fine before the owner moved the tees, as the house had only been struck very rarely, but now the house is being hit at least 10 times a day. There is a lot of damage (12 broken windows, 2 severely dented garage doors, 6 plus dents in our cars, 2 seriously dented gutters, a glass door that has been broken 9 times) and family members have been hit by golf balls on numerous occasions including several near misses. After having balls narrowly miss hitting young children we no longer feels safe sitting outside during the day. We can't even use the back half of our property during business hours at all. We have complained to the owner a half dozen times and he has made a lot of promises but never followed through with any of them. Other residents are very unhappy with the owner as he is very difficult and never follows through with anything he says he is going to do. All I was ever asking for was for him to find a way to prevent my house from being hit 10 or more times a day. Either put up a net to block the balls or move the tees back (or some other solution). I never even asked for any damages even though there are easily thousands of dollars worth of damage. I just want to be able to use my own home. Before I returned, she found out I was dating someone (my current wife), got mad, moved out and gutted the house before I got home. One of the things she took was the desktop computer. It had a separate profile for her and one for me. I didn't mind her taking it because I never used it. Once in her new home, she got her dad (a computer technician) to get into my profile, then somehow my iCloud (all password protected). She then transferred them from the computer to her phone (I assume by emailing them to herself), then showed them to my dad and my grandmother with the threat that my girlfriend will not be allowed to be around our children or she will use the pictures. Found "Peeping Tom" Hole in Shower Posted: 29 Mar 2020 10:39 AM PDT Im currently living with my parents to save money so I can go back to school. Yesterday in the shower I was looking through the broken piece of the shower water knob that hadn't been fixed in months. I figure since I'm home more now, I'll fix things around the house that my Dad hasn't. When I looked through the hole to see into the pipe situation, I noticed there was a lot of light coming through. I could see straight into his bedroom where his bed was, and I could tell the sheetrock on his side had been punched in what looks like on purpose. I feel sick to my stomach because the hole, although barely noticeable on the shower side, is big enough to see everything in the shower on my side. I told my mom about it and she placed a washtowel over the hole, and confirmed she could hear movement coming from his room and him moving something to cover it. I think he knows we know now. I'm in Texas and I know we have peeping Tom laws, but I'm not sure how to proceed. I'm a rape survivor and this is bringing up really bad feelings all over again. Does anyone have any advice? Posted: 28 Mar 2020 05:13 PM PDT From March 9 - 24 2020, my sister boarded her bearded dragon at a reptile shop in Southern California which We found on google and had good reviews. When my sister dropped it off on the 9th she gave careful instructions on the dragons diet and bathing schedule. She saw that the cage was much smaller than she anticipated but didn't want to worry being that it is a "specialty" shop with high reviews. During her visit in Australia, we called the reptile place to request a status update and a photo. However, we never got the photos. But we didn't let this worry us as CVOID-19 was changing a lot of things and shops were closing down. When my sister returned back to Los Angeles, she was asked to pick up her dragon the following day March 25. On the 25th when she picked up her dragon she saw that it had its eyes closed but didn't think much of it until she got home. Her dragon was showing extreme lethargy and closed eyes. I had my sister watch it overnight to see if there were any improvements. The following day, she took the dragon to the vet which they had to provide care overnight. During this period I called the boarding and I told them that the dragon under their care had to be held overnight in the hospital. When I called I said "I need to know the care you provided because my sisters dragon is being hospitalized". I tried recording the conversation but my app didn't work. During this conversation the man yelled at me and said that "the vets don't know shit", "they want money", "they don't know how I care for my animals", "I fed, bathe and we sent photos" "I gave him mill worms". I knew then that my sister told them specifically not to feed it mill worms because it didn't sit well with the dragon and then I proceeded to say "I'm not calling to argue, I need to know how you cared for it so I can tell the vet, can I also get the photos you said you sent to my sister to see the time stamp" he then said he couldn't get a hold of them and said I'll need to call back. The vet report came back and said "gravid lethargy (suspect secondary to inappropriate husbandry while boarding)." The vet also said that it had a bacterial infection which is caused by dirty conditions. The final bill was $1295! The vet recommended for us to report it to the BBB. We want to take action but not sure what to do or how to do it. Do we have something here? I don't think a google review is sufficient. TL:DR - sister's dragon nearly died. Has a long recovery. Final Walk Through of New Home and Water Damage Posted: 29 Mar 2020 08:14 AM PDT Link below to a little more in-depth info and photo. Ultimately we were set to close on a home on Friday. During the final walk through the day before, we found water damage in the basement on a wall. We luckily ran into a contractor who worked on the house (it was a flip) and he said the chimney was behind the wall and it was moisture from that. After raising this to the sellers we got a bunch of different reasons for this contrary to what the contractor said (overlooked paint job and then paint melting from heat). We said this was unacceptable and wanted the root cause found and fixed. They have a contractor coming tomorrow to look at the chimney flashing. We showed a picture to three local contractors in addition to the below post on the 'Home Improvement' forum who have overwhelmingly confirmed it is water damaged. The sellers had a contractor come back the same day we found the issue and he either replaced the dry wall or sanded and spackled the damage out so have no other proof other than the picture that was taken. This was not there during the inspection but their initial stance is that the inspector missed it (in addition to myself, significant other, and 3 family members). This is definitely not true. We talked about it this weekend and are no longer comfortable moving forward with the property because of the potential extent of the water damage and not wanting to deal with this if it isn't fixed properly (in addition to being lied to about it from the sellers). We spoke to our attorney about it (we are in NJ) and he said that we should get a contractor of ours on site to evaluate and we could be at risk of them bring this to a lawsuit if we back out now. That day has passed, the work has not yet been completed, and they are refusing to agree to the new terms of a lease. We created a list of items needing to be completed prior to handing over the home to us. The list was agreed to by both parties. They stopped using the home as a model 2 1/2 months ago. No work started on the home until a week prior to the due date. The work was simple: a new front door (not ordered), fix a broken window, clean the home, maintain HVAC system, retouch painting, etc. Since the date has come and gone, we have presented a continuation of the lease at a per day rate which is equal to the amount of the monthly lease / 30 days. The landscaping was completely ripped out, not just where the driveway was to be poured but the whole front landscaping. They agreed to put it back the way it was. We are 4 days beyond the original date, no driveway, no landscaping, nothing completed from our list, no lease agreement. What is our recourse? Do we file a BBB complaint, small claims? We aren't being unreasonable. If they started the work once they stopped using it as a model home then the virus stuff wouldn't be an issue. But now they are complaining they don't know when it will be done since they can't get any trades to confirm. Posted: 29 Mar 2020 10:09 AM PDT My parents own a second home where they spend the winter, which is where they are now and where the incident took place. They've hired a mowing company to mow and take care of the yard once a week. Last week, they were there mowing the yard, and they parked their truck and trailer in front of my parents drive. Not really blocking the road because they're able to pull into the yard enough to not block anything. My dad was in the house and looked out the window and noticed the neighbor was standing there looking at the mowing company's truck. The neighbor turned and walked onto my parents property and was visibly upset. My dad met him outside and the neighbor said he was blocked and couldn't get his truck out. My dad said that he would notify the mower and have him move it. So my dad told the mower and he said he was about finished and would move it. At some point (while my dad was talking to the mower, I think) the neighbor confronted the other guy from the mowing company and it got heated. The neighbor ripped his own shirt off and then sprayed the mowing company guy with mace. My dad called the cops. The cop came out and took everyone's story. The neighbor claimed the mowing guy kicked him in the groin. I should add, this all happened on my parents property from what I understand. The mace incident happened in front of the house near the road. In all of this, the neighbor lost his car keys and finds them in the yard (his or my parents, I'm not sure) and then leaves. My parents have a no trespassing sign in front of the house, for what it's worth. A day or two later, my dad and mom were in their car leaving to go somewhere and the neighbor goes out in the road and stopped them. The neighbor said he had a lawyer and is going to sue. He said he lost money that day from not being able to get to work. We're pretty sure the neighbor is squatting on the property. The landlord lives out of state and we're not sure if he even knows they're staying there. There are never any lights on so we don't even know if they're using any electric. Code enforcement has been by the property multiple times but we don't know why. The place is uninhabitable. My parents aren't sure what they should do. They would like to call the landlord but they don't want to put a target on them because if angry neighbor hears that a neighbor complained he'll know it was probably my parents. Family member caught stealing from the company- what now(California) Posted: 29 Mar 2020 09:19 AM PDT We recently discovered that my mother in law stole from the company business that we have 40% of and in January took over to try to save when she (then the president) told us she was having health issues and could not manage. (health issues turned out to not really be the case). So we took over and found that no one had been keeping up the books or filing takes for years. We hired accountants to clean up everything and catch up tax filings and in doing do discovered that over years she took almost a million dollars for personal expenses- basically ran anything and everything through the company finances, had a secret bank account in the company name and credit cards but she used those for herself. She has 40% equity in the company. She was the president and CEO but we had her step down when we discovered it. The bank account was set up by her as well. She did a lot of other terrible things- the money she was taking she wasn't reported as income, we found out she had 2 people who she was paying under the table but from the company's money who were dealing prescription pain medicine to her which she admitted to us. She is obviously mentally ill, an opioid addict apparently and also a gambling addict but it's more than that she is just thoroughly dishonest and unethical. She believed and maybe still believes she had a right to all the company money even though she didn't fund it. She even took a merchant loan out at 40% interest and took the money for plastic surgery. Meanwhile, she was stiffing vendors, letting product registrations lapse, necessary tax filings were not done, she defaulted on loans in the company name…the company was funded by her mother, my husband's grandma who is in a very vulnerable position as she has Alzheimer's and elderly and his mom made herself trustee of the grandma who has another 20% which further complicates the situation and has us worried we may be powerless to stop her. We want to know can we demand she make restitution to the company by forfeiting her equity? Does she automatically forfeit her equity? Who are we legally required to report her embezzlement to or are we? We don't want to get in trouble for not reporting it. We honestly are disgusted. Can someone lay out the steps we should take? When we had her step down as president we did a board meeting and signed a resolution that only officers can access and manage the bank account but she has three times accessed it and made unauthorized transfers to herself. Our merchant account was tied to it and it takes time to switch to a new account so we are worried she will again and drain the account and we won't make payroll or be able to pay bills. We need to get control of the company and get it out of the hands of this person. The lAndlord called the cops on me. Tried to tell me I was trespassing and it's not even the last day of the month. The cops showed up, Informed me the lock down and state of emergency doesn't matter, I have to move out, but since I was unofficially evicted he had to hand me a paper saying i had 10 days to move out. Now he wrote on the paper April 1 I have to be out which is only 4 days. Not only that the very next day these same assholes that tried to kick me out on the street busted in my house ( with the keys they have) and pretty much told me that they were gonna continue moving their stuff in. I'm not ok with this. I'm uncomfortable having these people just bust in what's still my residence, and they are being very hostile with me and I don't know what to do. I have found out recently that occasionally her abuser will try and find ways to contact her through different social media even though she has them blocked. I found out as well that she tried to legally get them to stop some time back but it was unsuccessful. She thinks that her abuser uses their position in trafficking ministries to give them a reputation as a protector in case they were every accused of trafficking. Called him a few names which I shouldn't have but they were probably warranted (read my in depth story below). He tells me to call the cops if him being on my property bothers him so of course I say I will. He proceeds to get and stay off my property but then after the fact he sends a text to me stating if the fence builders even step on his property he'll be calling the cops. Should this worry me in any way? I'm worried the fencers won't even be able to get the job done. What should I do about the situation? Long story if you wanna read how much of a manipulative piece of work this dude is: We move in and get a survey to build a fence eventually. Come to find out a bunch of what we thought was the neighbors land is actually ours. He disagrees so we respectfully agree to go with him to the courthouse to look at the deeds even though our surveyor has confirmed and told him that he's wrong we do so just to keep everything cool. After going through 100 years of paperwork he agrees he was wrong and the land is ours. Days later we notice someone surveying his land. He texts us saying he went ahead and got a survey to get a second opinion. This is after him giving us the okay to build the fence. We wait a week for him to say again that our surveyor was right and the land is ours. A few days go by and he's still using the land like it's his having work vehicles and friends park on our property. We tell him it's fine but we need everything off the property by February. He says no problem. End of February comes and everything is off. A week goes by and things are back to normal because "we haven't built the fence yet". He asks us "are we still planning to" as if we weren't that means he can use it. We tell him we are but other things have popped up. A week goes by and he asks if we want to use the property as a "community garden" that we can pick through if he farms and also so he can park his trailer there. We say no. Next day he's digging on our property and has a truck and trailer parked on our land as well. Plus the last few days I've witnessed his friends parking on our land too. I go outside and politely as I can why the fuck he's on our property and he claims my gf told him it was okay he was building a community garden. My girlfriend said no such thing. I'm stressed to no end because he's tried everything even asked us to buy the land and just can't take the fucking hint and now wants to make our lives harder after we did everything we could to show him the land is ours. I read the CO lemon law and it says within 1 year of delivery or during the warranty term, which ever comes first. I didn't really like this, but it seemed like it was part of their standard agreement and wasn't optional, so I complied. Recently, I've been made very uncomfortable by the fact they don't tell me when they are coming, and they always enter on their own after knocking a few times (I usually don't have enough time to even get to the door). I never get anything in advance to indicate when/if they come. Everytime they've come, it was a legit reason, such as a maintenance request that I put in or a neighbor who had a bug issue and they are checking units. Is this legal? This is Baltimore County, Maryland. We never received a lease. Building: 2 family home buildings on one lot. One building has 3 units, second building has 3 units plus unit in the basement (they moved out recently). 7 units total on this lot. Oldest building records I could find were from mortgage in 1969. Couldn't find when it was built. Owner in 1998 was different, these owners took over building in 2004 and kept rent amount the same, at $650. Been paying $650 since July 1998 till Dec 2018. Jan 2019 started getting month to month lease, at $750. This was raised in Jan 2020 to $810. We still have rent receipts from 1998 through 2020. Jan 2019 the owner wanted to sell the building and all the tenants signed a month to month lease, and they began increasing rent. My sister is disabled and receives SSI and lives with my mother, her primary caregiver. My mom is low income and can not afford any more rent increases, or a new apartment at these rates. Should her apartment be rent control or stabilized? Are they legally allowed to increase rent? TLDR: lived in apartment since July 1998, paying $650 rent for 3 bedroom apartment in NYC. My friend’s house was stolen by her bankruptcy lawyer. Posted: 29 Mar 2020 12:13 AM PDT (Texas) Hello everyone. I was hoping someone could help me or point me in the right direction. A friend of mine was in bankruptcy about 2 years ago. She had been for awhile. Every so often, she, or at least her lawyer, was supposed to go to court to be sure things were going well, ask for changes, etc. When her lawyer was promoted, she was assigned a different lawyer. When she would call to speak with him & see what was going on with her case, he would yell at & berate her, accusing her of not trusting him to do his job. That was such a serious red flag to me, but she was in such a severe depression, among other road blocks, she wasn't able to get another lawyer. After a few tries to talk with him , her court date came up, & she was expecting him to renew her bankruptcy, or something like that. Instead, he blew off court, knowing full & well it would cancel her bankruptcy & she would lose everything. She didn't know any of this, since he wouldn't talk to her, until people started coming by to look at her house. Within 3 months, he sold her house, essentially stealing it from a disabled senior (early 60's) citizen. Once all this was started, she had no recourse that she knew of, & once it sold, she had an extremely short window to move. She has no family in the area, & just a few friends, none of whom were able to help her. With the short notice, she was forced to move into an apartment complex that is supposed to be tax credit, low income (definitely can't have an income over a certain amount to live there), or something like that, that takes 90% of her income for rent. She has health problems, & has been sick, a lot of it due to the stress all of this has taken on her, since before this happened. Her house is now on the market again. My question is, does she have ANY recourse to reclaim her house? And are there any legal malpractice lawyers she could talk to about going after the lawyer that stole her house to begin with? I live in ID and my family is practicing self isolation as best as we can because my son and father-in-law are both at risk for getting Covid-19. The rental we've been living in has very recently been put up for sale. A real estate agent wants to bring people into our house to view it. He told me that real estate is an essential business based on the order that our Govenor, Brad Little, signed. When I looked at the order, I only saw a reference to commercial real estate, but I thought our home is residential real estate.... Does this give him the right to bring people over to view the house when we're trying to protect our family????? Please help!!!! [link] [comments] |
Posted: 29 Mar 2020 01:54 PM PDT Hi Legal Advice, The title really says it all, but I'm basically wondering if I have any legal right to push back against my landlord. When my spouse and I were looking for a place to rent, we put an ad out describing ourselves and saying we were looking for a place that was okay with dogs. We were contacted by our landlords and subsequently signed the lease, including the pet deposit. We did have to describe our dog the pet addendum. (Breed/size). This was 11 months ago. Our dog passed away suddenly about 2 weeks before we moved in last May. We told the landlords when we picked up the keys, they offered to give back the deposit, we asked for them to keep it because we would probably be getting another pet. They verbally agreed and said to just let them know when we do. Well last week we contacted them to say we were looking to adopt, and in keeping with our agreement, we were looking for dogs the same size as our last one. They finally emailed back today and said they'd rather we have no pets and that they would send our money back. Do I have any legal legs to stand on? Can I push back? TL;DR:. Landlords have had my pet deposit for 11 months with a verbal agreement that I would get a new pet, after our last died before move-in date. The pet agreement is in our lease with size/breed of original pet. Now that I tell them I am finally get a new pet, they say no and are "sending the money back". Can I fight this at all? Neighbor dog constantly barking, making sure my own dog won't get in trouble. Posted: 29 Mar 2020 01:40 PM PDT WV here. Backstory time. So my elderly neighbor has one of those dogs that just barks at everything. All hours of the day and night, can hear the dog no matter if she's inside or outside...but shes outside about %75 of the day. I know the pain of having a loud dog who doesn't listen to you, took me about a year to get mine to quiet down. Difference being I'm always outside with mine and reminding him to keep it down. None of us have ever heard her even try to stop the noise. Multiple neighbors have mentioned it to her nicely, she replies "dogs bark, get over it". Then people have started calling the cops/animal control. Their reply was basically the same, pointing out that we all have dogs and they most likely bark also. In response, one neighbor looked through his cameras for a week and noted every bark. It was ridiculous, %90 of the barks came from that one dog. The other %10 was split evenly between the 5 other dogs in the area, my own included. So camera neighbor took that info to elderly neighbor, as a final "hey we have proof yours is the worse, please just try to quiet her down". She (according to camera neighbor who has always been great to me) turned it around and said if we don't stop she'll start reporting our dogs. Her dog is the tiny yappy type, the other 4 are medium to small, mine is big and his bark can seem more aggressive then the others. Camera neighbor texted me to ask me how I felt, since my dog will probably be the one they look at most. Is there actually a chance this could cause me legal issues? He's never done anything wrong, bark is worse then his non existent bite type of dog. But he is intimidating, and I can see elderly lady saying she's afraid of him to the officers. The other neighbors offered to uh....give my dog like a good boy reference? Which I'm hoping will help since that would make it 4 neighbors against 1 if she does start anything. And I've offered the same for them, but the other dogs are obviously not an issue (the biggest of them is old and needs a doggy wheelchair). I just wanted to check here to be sure before we went forward with anything. Each visit by the cops or animal control has been documented, always for the same reason. Also, if my dog is safe and we move forward with all this, is there actually anything they can do to make her at least try to quiet the dog down? It has disrupted everyone's life multiple times by this point, don't think I've slept longer than 4 hours at a time with the noise even after getting earplugs and leaving the tv on.
