Got laid off due to Corona. Boss called me back a week later to tell me he wants me part time, for way less money, and he'll contest my unemployment if I say no.

    Posted: 30 Mar 2020 08:50 PM PDT

This is happening in the great state of Tennessee.

So a couple of weeks ago my boss laid me off. I was a salaried estimator/project manager/IT specialist for a concrete company. I got the unemployment paperwork into the state and approved, and got the notification that they were sending it to my boss as per usual. Less than a week later, my boss called me back to let me know that he needed me back to do a little bit of project management work for him here and there (<10 hours a week spread out over several days), and he was going to have me do estimates on a commission basis in the meantime (previously part of my salaried work). Now, because I have to drive anywhere between 45 minutes to 4 hours to get to a job or estimate site, and my drive time is unpaid, this means that I will be spending almost all of my time working for almost nothing, and half the job I was previously paid for will now only pay if I make a sale.

I told him that his offer was bullshit, I never signed any paperwork changing my job duties and he'd literally just laid me off, and he told me that he had work for me, and hadn't done the unemployment paperwork, and "He wasn't going to let me just sit back and collect unemployment and not work." He mentioned it would be easy to contest it as there was no official paperwork made up yet (I didn't know this as he'd laid me off over the phone, assumed any necessary paperwork would reach me by mail or would already be done), and he was considering doing so because there was some kind of small business loan they're offering now for people who DON'T lay off their staff and he wanted to apply for that.

If I agree to this I'm basically going to be working a 40-50 hour week for $200, where I was previously making $1300, which is still incredibly small for a project management position, and in all honesty I feel like I'm way better off spending that 40 hours revamping my resume, brushing up on some skills or taking a class, and applying for better jobs, even if I probably won't be getting one until all this Covid-19 stuff blows over.

Personally, I feel like I've been somehow blackmailed into slave labor, but there's no way I'm going to be able to find another job right now, and if he contests my unemployment I am royally screwed.

Is this legal? Like, what the hell kind of recourse do I have here?

Edit: thread is locked so I can't reply, but thank you for all of the advice. I'll get in contact with a UI lawyer immediately.

My aunt passed away and left me everything. My dad is the executor of her will, but my mom is telling him to keep me in the dark about it.

    Posted: 31 Mar 2020 04:54 AM PDT

This is in Minnesota, for what it's worth.

This is a bit of an odd situation. My aunt passed away a few months ago and left me everything. This was a complete surprise to me since she wasn't actually related to me (she's my aunt by marriage to my uncle who died years ago) and I just assumed she'd leave her estate to someone else. But I'm guessing she did this because she and my uncle were also my godparents. The only way I even know any of this was because my brother gave me a heads up when he overheard my parents talking about it, and my mom was telling my dad not to tell me that I was the beneficiary of the will until she "figures out what to do." I don't even know what that means, I just know my mom has always been controlling and petty. What can I do about this?

Owner is docking $50 from everyones paycheck because beer and liquor costs are too high.

    Posted: 31 Mar 2020 08:43 AM PDT

I work for a small pizza place in Indianapolis Indiana. Our owner sent out a letter to all employees that he will be deducting $50 from all paycheck this week and a $100 after that because liquor and beer costs are higher than normal and he believe people are stealing beer. Is this legal and do i have any recourse?

My Broker (Questrade) wants me to delete all my reddit posts speaking negatively about them ("or risk legal action") after I ranted about losing $50000 due to outages[CANADA]

    Posted: 30 Mar 2020 06:02 PM PDT

So long story short I feel like I got shafted by my broker where I invested close to $50000 CAD in a high risk vehicle and was unable to access the position due to outages by them

I posted about my displeasure on reddit and they reached out to me to "make things right".

I was offered $1200 USD and asked to sign an NDA.

I decided ultimately to not take this offer.

Before I was given the offer I was politely requested to delete my comments on the /r/Questrade (the broker's) subreddit

In order to be cooperative while getting an offer I complied.

After I decided to ultimately not take their offer I started posting again on investing subreddits about my experience to warn people about what happened.

I got this email in response:

I have just been notified that you have posted information from our private discussions on Reddit. These discussions were confidential and constituted good faith attempt to resolve your complaint. Your Reddit posts are inaccurate, misleading and contain defamatory content. As we discussed, you incurred a loss as a result of trading in high risk options, which you failed to mention in your posts.

We ask that you remove these posts immediately and you cease to use social media to post defamatory and misleading statements about Questrade in an attempt to extort funds from the company. If you do not remove these posts, you are put on notice that this will become a legal matter. Our legal department are already investigating two prior posts you made where you stated that you were ready to "burn down the building" as well as making the following statement: " if I can't get my money back I'll be sure they lose an equal amount in whatever way I can.''

If we do not receive your confirmation by 12pm on March 31, 2020, that you will discontinue posting defamatory content on social media, you will leave us no choice than to commence legal action.

To keep things in perspective, the world is reeling from a tragic situation. Thousands of people have lost their lives. Our staff have been working around the clock to help our clients get through this unprecedented crisis. In response to our genuine attempts to find an amicable solution, you have threatened and insulted our staff. I urge you to think about your actions.

    I replied with :

I think in all my post I mentioned that I was trading 0DTE options. If you would like I can clarify in the posts that these were high risk but I think that saying they were 0 DTE inherently means that they were high risk. I will go through them after this email just to make sure that I did in fact clarify I was trading a high risk vehicle.

Like I stated before, I am not expecting anything from Questrade in terms of compensation. I don't appreciate the insinuation that I am trying to extort Questrade in anyway.

I think in the context of the posts you are referring to I stated that I meant by costing you guys potential commission from people switching brokers or not opening accounts with Questrade.

All my previous comments were however deleted as per your own request but I am sure your legal department should have screenshots with context.

Everything I am posting is true. There is nothing slanderous about it. I promise that I will not post anything defamatory and to be honest I believe I haven't posted anything defamatory so far anyway.

Regardless I'll go through all my posts and comments just to double check that I have not said any lies about Questrade. If I have said anything untrue I will be sure to edit it immediately.

You can look through my submitted posts to see what is happening but this is the main one where I go more into detail about my situation

    https://www.reddit.com/r/wallstreetbets/comments/frz0fp/my_broker_questrade_wants_me_to_sign_an_nda/

I also made a guide on how others can formally submit a complaint in order to potentially get compensation from them:

    https://www.reddit.com/r/PersonalFinanceCanada/comments/fryrfs/heres_a_guide_on_how_to_formally_submit_a/

Edit: Sorry, if it's not clear I want to know if I am actually required at all to delete any of these posts since I am simply stating the truth. Should I be worried at all from the last email they sent me?

[California] My employer notified me that I would be receiving 40-50% of my owed pay on my next paycheck for hours already worked, but promised to pay it back double at an unspecified later time. Should I file a wage claim now or wait to see if they honor their promise?

    Posted: 31 Mar 2020 01:26 PM PDT

My employer posted a written notice in our store that all employees would be receiving 40-50% of their owed amount on the next check due to COVID-19 financial struggles. They "promised" to pay it back double when they are able to get a loan, possibly sometime in the next 2-4 weeks, although they couldn't say for sure. Just got my check today and it was actually 29% of what I was owed. Should I file a wage claim now or wait to see if they pay me back double like promised?

I will note that I have reasons to distrust this employer due to them trying to retroactively change my hours in the past and also have a history of delaying rent and tax payments as long as possible. They just recently paid their property taxes after having seizure threatened upon them. This is not some small business, it is one of the largest individual franchises of a well known corporate food chain (don't want to give names on here).

Moving co lied (about a lot), failed to come when promised, now charging $800 despite providing no service

    Posted: 31 Mar 2020 07:09 AM PDT

State is NH. Company is based in Miami, FL.

I electronically signed a binding estimate with a moving company. The way I was told the agreement worked is that there's a 3 day window you initially agree to, and then the day before your supposed window begins, you would get a call telling you the specific day and window.

I was supposed to receive a call on Friday to confirm it. The salesperson told me they would be there on Saturday, and that his office would call Later that day with the window. Nobody ever called. When I called, I got a message it was after business hours.

Saturday came. I could not reach their customer service (tried all day). Contacted the salesperson who told me there were people in the office and someone will call. Nobody ever called and nobody ever came. By the end of day I researched the company and found some very unsettling info. Basically all their positive reviews are fake, and there were a lot of people whose stuff had been stolen or held hostage.

At that point I decided to cancel. No movers had come at that point, no moving had taken place, period. The estimate I agreed to had this in it:

Estimates may be canceled and deposits are fully refundable up to 5 days prior to the start of the moving services. An estimate/order may not be canceled and deposits are not refundable, and a cancellation fee of up to 50% of the total cost of the moving estimate may be incurred after the mover has begun the physical moving services, including but not limited to packing, loading, storage, transportation to and from the pick-up or delivery address, etc. Moving services may not begin until the contract for service (Bill of Lading) is signed by the customer authorizing the mover to begin services.

Upon cancelling, the manager claimed that they did send a guy (lie). He claimed that I was told it would happen Sunday, not Saturday (lie). He also claimed that it could have happened any time within the three day window which contradicts what I was told (verbally) by the salesman.

For all this, doing absolutely no work, they charged $800. He was very nasty with my HR person and told her he was going to block her phone number.

Is there any way to fight this charge?

TLDR: signed a moving estimate under false pretenses, company goes silent on me/does not deliver on promise, I cancel. I was still within this three day window and they're claiming they could've come at any point during the window, and they're charging $800 even though they never actually did any work.

We were set to close on a house on April 2nd. I was laid off 10 days ago due to covid-19 with a pledge to be rehired when restrictions are lifted. We asked for an extension on closing. The sellers refused and now want to walk away taking the earnest money. Do we have any recourse? (Texas)

    Posted: 31 Mar 2020 09:37 AM PDT

Our realtor has sent us a "release of earnest money" form for us to sign. What if I refuse to sign it? Do we go to court? I have a letter of denial from our lender. Would that help our case at all? The earnest money is 3.5k

Just really disappointed that people are like this. We have a family of 4, now with one full income (I have filed for unemployment) and there couldn't be a worse time for us to throw away 3.5k

Some company is using my photos without my permission

    Posted: 31 Mar 2020 08:36 AM PDT

    I'm in Ontario.

Some random company is using my photos to advertise for their totally bogus "hair growth and thickening serum."

The photos are from a professional portrait session of me that they stole from my Instagram and the photos are all over their website and social media. My face is clearly visible. There's even a fake testimonial from me talking about how I grew my hair long using this product.

I have no idea where the company is located. I sent them an email and DM a few days ago with no reply.

I contacted the photographer and he had nothing to do with this either. He's sending them an email as well.

I hate that my image is being used in this way. Realistically, what are my options here? What can I do?

Someone cashed my Federal Tax Return check for the 2018 year

    Posted: 31 Mar 2020 06:34 AM PDT

    Hello everyone

I'd just like some general advice and tips as I'm trying to take care of this

2018 was a crazy year for me; I got out of an abusive relationship and moved into a new place with roommates. I did my taxes while I was still "with" my abusive ex and living with him and his family. I originally put my direct deposit information for my tax return, and after a few weeks I officially left my ex and his family's place, and still didn't see my direct deposit hit. I called the IRS and was told the info entered was wrong, but they're sending me a check. But I had recently moved and they didn't have the correct address. The man I spoke with said he could send me a new check with the updated address on it since the old one at the time he claimed wasn't cashed. I agreed and after a week or so I got the new check, endorsed it, and cashed it. Later I found out my bank account gave me the wrong routing information.

No to the fun part. In December of 2019, I got a letter from the IRS stating I owed money. I called and explained the situation with the direct deposit and second check. They told me to write a letter to the IRS bc on her end it didn't look like I owed anything. I did and sent it. A month later I get another letter, stating I cashed two checks. Every few days I was calling to see what happened, since I only received and cashed one. I was told a different thing every time. Some people told me I definitely cashed two checks. Some people say there's no balance on my account. Other times they tell me it's bc the direct deposit is still showing up. I finally got someone who was able to handle my situation and they opened up a case to investigate. I filled out a 3911 form, sent it to the IRS with another letter. The next day, I got a call from the investigator/case worker stating that the department of fiscal services (?) took over, so they could not help me. The department of fiscal services sent me a 1133 form which I got today. It has a copied photo of the first check that I never got, with a signature that is not mine, with a VERY old address on it. I'm planning on filling it out today and sending it back.

Any advice on how to speed up the process and make sure it's all done correctly? The 1133 is very confusing to me and I don't want to mess it up. They told me this process could take up to a year or more. I'm located in New York City if that makes a difference. I'm also afraid bc of the pandemic I was told I will not receive this years refund money bc it's like I'm paying back the money I owe, and I really need the money as I'm not working very much. Also, can I sue the people who cashed it at the old address or do anything ?

Thank you so much to anyone who can help me.

My job is keeping me on the schedule so they don’t have to give me unemployment. calling me off the day prior for all of my shifts.

    Posted: 31 Mar 2020 01:00 PM PDT

When the Quarantine in New York became official we let 2/3 of our staff go and we kept on a skeleton crew of our most "essential" employees. Problem is business isn't exactly booming so we end up not needing most of our staff. I'm starting to feel a little bit taken advantage of though because I haven't worked the last two weeks. Every time I talk to my bosses they keep telling me how important I am and how they absolutely need me on the schedule. I think one of two possibilities is most likely the reason for this, either one they don't want to have to contribute to unemployment pay and they're trying to keep as many employees off of unemployment as possible. Or two they just really want on call employees in case someone wants a day off or there's a call in. Is there a certain period where if I don't work I can apply for unemployment? I'm getting kind of desperate after two weeks of not having an income and could really use some advice.

Car got towed despite being registered for a parking space

    Posted: 31 Mar 2020 11:15 AM PDT

I need some serious help. I live in an apartment complex with its own gated parking lot. Residents can pay to have a designated parking spot, which is what I did. The car I registered is not mine, but my parents, who live 400 miles away. My apartment complex has all the information like make, model, and license plate number. They also gave me a parking permit to hang on my windshield mirror, which I did. I know for a fact that permit is still in the car since I've never removed it.

This morning when I tried to leave for work, I realized the car was gone. I was going to call the police for a stolen vehicle, but I realized that I should first check with the leasing office to see if it was accidentally towed. Keep in mind they HAVE my license plate number and everything in their system.

Unfortunately, there was no one at the leasing office except for a girl that was just covering someone's shift. However, she did give me the towing company's number. When I called the towing company they said that they towed my car for lack of a parking permit! I told them I know my parking permit is in the car cause I never EVER removed it for any reason. He said that they took pictures of the car before towing and that there was definitely not permit visible through the windshield.

I think the permit must have fallen off or something, but I KNOW that permit is somewhere in the car. I didn't use my car yesterday, which is when they must have towed it. He said that normally the registered owner would have to come pick it up, but since they were obviously 400 miles away that they would make an exception. The cost to release the car is $380. My mother says that the apartment complex should be liable for the fee since it's because of situations like this that I gave them the license plate number for. Is there anything I can do?

Can I record the inside of my own home if neighbors are audible?

    Posted: 31 Mar 2020 02:41 AM PDT

Im in California. It seems like we have pretty strict laws here about recording.

Everything I have read says we have an all party consent system - meaning that everyone in the recording has to give consent. But does that mean that you can't record your own house?

I am actually wondering because I have some obnoxiously loud upstairs neighbors - to the point where it's affecting my girlfriends and my sleep. We have a private security line to call from the apartment, but due to the Coronavirus they won't do anything other than have someone stand outside the door and listen to confirm the noise. But the noise is coming from the opposite end of the unit (directly above our bedroom). So the security often don't confirm the source of the noise. I was hoping to record from inside my bedroom to give a clearcut example of exactly how aggressively loud they are.

Was given an approved raise, signed by HR and supervisor - it never appeared on paychecks, and company is nonresponsive after sudden layoff

    Posted: 31 Mar 2020 12:33 PM PDT

Hi guys! Before I get started, I want to say that I definitely did fuck up by not checking to be sure that my raise went into effect earlier.

I was a behavior therapist for a somewhat large (over 500 employees, not quite 1000) company in Texas that deals with developmental and intellectual disabilities. We shut down a few weeks ago due to COVID-19, and my company continued to pay us until March 27, making vague promises and plans to have us start up telehealth this week. Late in the evening (7:30 our time) on Sunday, most of the company was unceremoniously laid off via e-mail. We also had our credentials to the e-mail system revoked in the very early morning, resulting in most employees finding out through Facebook that they had lost their jobs.

Our paycheck history is stored through a different system, so I took a look at my paychecks, and realized that a raise that I earned in my yearly review in May 2019, was approved by HR and my supervisor, and that I signed a document agreeing that would be my new pay rate had never been applied. I started working overtime frequently during that time, due to being a therapy group leader, so I didn't notice the difference until now. Believe me that this is an expensive lesson learned. My old pay rate (I'm going to call PAY1) is $1.50 less per hour than what I signed up for. I e-mailed HR to let them know about the situation, and the dates, supervisors, and rates that were affected. The total that they would owe me, before tax, is over $2k.

Late in the evening yesterday (5:30 our time), HR emailed our personal e-mail accounts to let us know that our health benefits were to be cancelled at midnight tonight, personal belongings would be mailed out if you left anything at the centers, and to mail anything that was company property back at our expense. I e-mailed HR, letting them know that I had personal belongings at the center, and that I hadn't received a response about the large amount of money in backpay I had asked about. I also asked about healthcare continuation, explaining that I had researched what to do if laid off, and that (although they gave us a few weeks of extra pay) many companies were providing severance packages - and that most of us would not be able to afford the expense of COBRA without our main income, which is dire in a pandemic.

I still have not had a response to anything I e-mailed about today. Worse, I realized that my state is very far behind on processing unemployment claims, and I can't put in a claim until I have an answer to this, because my state needs to know what rate of pay I made at termination. If I put in PAY1 and it is raised, or PAY2 and they refuse it, I can have my claim denied.

I have documentation of the following:

    - my paycheck history

    - the dates and hours I worked for the company

    - the date I signed the form agreeing to my raise

    - an email from the company president saying we would be paid until the 27th

    - the email from HR letting us know about insurance cancellation, etc.

Unfortunately, the company would not give me a copy of the form okaying my raise in May 2019. What recourse do I have, and are there any state agencies that can help me put pressure if they continue to be unresponsive? Am I totally screwed?

My neighbor sold their house, and I had some property on their land. May I go retrieve it?

    Posted: 31 Mar 2020 06:54 AM PDT

Oregon, USA. My neighbor sold their house (closed on it) and has moved away. The new owners have yet to move in (no idea when)

Years ago, I built two raised planters at a cost of $250, and with the neighbor's agreement, placed them on their land. I raised vegetables in them for years. If it matters, I did give vegetables to the neighbor occasionally.

With the crisis, I just missed the fact they were selling their house. I only came to know of it a few days ago, and the sale has since closed.

May I legally go retrieve those planters? Do I even legally own them?

Not at fault accident on my driving record?

    Posted: 31 Mar 2020 11:18 AM PDT

25F from Chicago. I was recently t-boned while driving to work and was immediately deemed not at fault. However, when purchasing insurance my rate skyrocketed because there's now an accident attached my drivers license number even though I did nothing wrong. Other than this happening, I have a perfect driving record-I've never had a ticket, been pulled over, never even had a red light ticket ever in my life.

My question is, how can I get this removed? It wasn't even my fault, and I don't like the idea of this tarnishing my record and raising my rates for 5 years.

    Thank you in advance!

Fired from employer and and backdated information sent to unemployment (Florida)

    Posted: 31 Mar 2020 02:21 PM PDT

My mom's husband was let go from his job at an irrigation company in Florida on Friday morning. He received a txt message in his work phone the evening of Thursday 3/26 asking him to meet the owner at the office with his company truck at 6:45am Friday morning. He was then let go and given a ride back to his house.

Upon filing his unemployment he discovered that his employer set the date of his termination as 3/22. He worked Monday through Thursday of that week, putting in 32 hours and completing several sales, including a significant $2,000 sale on His last day before being let go.

At minimum this appears to be wage theft and I'm not sure of any other types of violations may been committed by sending a false date of termination to the state unemployment office. The office is now not returning any of his phone calls. He needs a letter to send to his mortgage company to get them to agree to put a hold on the payments while we finds another job. Is the right call to the US Department of Labor or the Florida of AWI? Or both?

Hi all, I'm not aware of a more appropriate subreddit, so I am happy to be directed towards one.

We moved into our place in 2018 and it was pretty gross. Not swept, open food & crumbs in the pantry, dirty unpainted walls, disgusting oven, etc. We cleaned a lot of this out ourselves, but now he wants to charge us a cleaning fee upon our exit.

Is there anything that protects me from this? My feeling is that if the house wasn't cleaned when we moved in, he shouldn't be able to charge us for cleaning when we move out.

I am also slightly concerned about the condition of the appliances. When we moved in, pieces were taped together. My specific concern is on the refrigerator where a faceplate was taped on, the tape came off and the faceplate broke (about a year ago). I informed him and he said "ok" but never fixed it. It's a 15 year old refrigerator so that part cant be replaced. Am I liable for the fridge?

I have photos of the dirtiness we inherited and the broken appliances from our move in date.

My goal is to not be responsible for these fees (IF I rightfully should not be) and to not drag this out so as to get my security deposit back in months if this gets to the point of going to court or similar.

Thanks in advance for any help.

My neighbors land is flooding my property and its pooling around my foundation. I'm in Oklahoma and they just built there house 6 months ago. They literately built it within 5 feet of my house and now all the water rushes to my side because they built theirs on a higher grade. Do I have a case and if i do what do i do next? I cant really afford a lawyer right now. Could i just take them to civil court? They are rude I have tried to discuss it with them to no avail.

I have multiple witnesses that saw a man beat my kitten to death with a baseball bat. The cops won't do anything but I want justice. If there's anyone who can help, please...
