It's a long story but at the end of the day, I got some scratches on the hood and front bumper of my 2018 Volvo. I filed a claim with the car wash company and their insurance company contacted me. They basically said that there was no question about liability and all they want to know is how much it will cost to repair. I went to the bodyshop at my local Volvo dealer and they gave me a quote (~$2000) which I forwarded to the insurance company. The agent proceeded to tell me to proceed with the repairs and they will get in touch with the bodyshop to figure out invoicing. A few things I wanted to know.

Posted: 05 Mar 2020 03:05 AM PST My vehicle was recently hit while parked on the street in front of my house while I was out of town, my neighbor came forward and admitted to reversing into my car. He has only given me his first name, his number and is refusing to give me any insurance information. Not sure where to go from here but he is not willing to pay my deductible and is only giving me the option of letting him fix it himself or its not getting fixed. Very frustrated as this is my first accident, any advice would be greatly appreciated. He also doesn't seem to have money so not sure is small claims would be worth the time and money. I have already filed a claim with my Insurance but they haven't been able to find anything on him with the license plate number. Also have audio recordings and texts showing he's at fault. Car title was changed to salvaged even though it was deemed as repairable [California] Posted: 04 Mar 2020 09:38 PM PST Posting here because I'm totally confused and I think I'm being screwed by someone's mistake. After an accident (not my fault) USAA deemed my vehicle as a total loss. I objected and persuaded them to re-evaluate the case. They agreed, re-evaluated and changed the car status to repairable. I proceeded with car repairs and everything went well unit I received a letter from Copart (I assume USAA contracts them to deal with title procurement) with a paper from the DMV indicating that my car status was changed to salvaged. I called USAA asking to clarify the situation, - their representative indicated that there might have been a mistake and Copart might have sent out paperwork to the DMV before they changed their decision to deem the vehicle as repairable. I called Copart explaining the situation and asking them to re-adjust my vehicle title back to normal, but they replied that even though the vehicle was deemed repairable they still must file for a salvaged title because it's the California law and they won't re-adjust my vehicle title anymore. This doesn't make sense to me. Can someone clarify if Copart is right in this situation? If no, what can I do in this case? I have an official letter from USAA stating that my vehicle was deemed repairable. [link] [comments] |

I'm a university student and my insurance just went back to normal after being rear ended on the highway.. I'm probably more upset than I should be. But I don't want to mess it up for my parents again bc I feel guilty that they pay my insurance for me while I'm in school. Would it be his insurance or mine bc it's my car? He's mad at me for being mad at him but I refuse to pay for something he did, he sneezed and that's how he managed this (this will be funny someday) How much will it cost to fix this out of pocket? Help a travel newbie with insurance! Posted: 05 Mar 2020 12:10 AM PST This is my very first international trip so I'm new to all of this and need guidance! Basically, I'm (currently at least) leaving for Japan on March 20th. I bought a one way ticket from Houston back in Sept of last year. I didn't buy any type of insurance for the flight. I plan to be in Japan for at least a month and then from there visit other countries in SEA. It's all very fluid but I suspect I will be traveling for about 3-4 months. I don't carry any kind of health insurance currently. I knew I wanted to get coverage for this trip and was looking into just health insurance vs travelers insurance. This was prior to the whole Coronavirus situation. I still have not bought anything but have been reading that at this point, "cancel for any reason" insurance is advised. I've tried looking into insurance quotes but I get tripped up on certain questions like: -When is your return date? -What is the total cost of the trip? I'll be buying flights and booking accommodations as I go so I honestly have no idea. Any recommendations on certain companies or plans that would fit my particular situation? My biggest concern is health coverage, especially now with the Coronavirus. My airline (EVA Air) hasn't cancelled my flight so far and I haven't been able to get a hold of them yet. Would any insurance plans cover the cost of my flight in case I decide to cancel the trip myself? I'm assuming not but again, I'm clueless with this kind of thing. I was management during the time and recently was demoted due to a restructuring and now am back at a union position. I had $3000 on the card intially and used about $1000. When I was demoted I asked about card and was told I no longer have access to it since I'm no longer mgmt and that the funds on the card are now forfeited. Can they do this? [link] [comments] |
A few questions about a swerve into the curb accident. Posted: 04 Mar 2020 10:07 PM PST I live in Hawaii, and someone turned left in front of me and I swerved to avoid her and hit a curb. One tire is blown and the other tire's tread on the same axle is worn so that it could be dangerous to have different length treads on the same axle. I'm wondering if I could make a claim to get both tires replaced by her insurance since I can't have just one tire replaced? Or will I need to replace the other tire with my own money? There could also be a bent control arm or strut on my car too that should be replaced because of alignment and other things. What should I do to get a statement and quote on damages that happened? Someone pulled out in front of me and I hit her (she/her insurance is accepting 100% liability) and the repairs are probably going to cost more than the car is worth. I live in a state where you cannot drive on a salvage title, it must be rebuilt. My car is still drivable, though. I love my car. I don't want to get rid of it and I want to run it into the ground/I can't really afford to get a new one, AND i have put in a lot of money to make sure it stays running smoothly and will last me a long time. It's at 213,000 miles and I expect to make it to at least 300,000. The closest replacement I can find is in Chicago and there is one other one is California. That's literally all I can find. I live in Atlanta. I don't mind flying out to Chicago to get it but that will cost a couple hundred extra dollars (gas, flight, Uber, hotel) AND a few days of work which is also incredibly valuable to me. Is there anything I can do to make sure I get whatever I can from the insurance company? Any chance they would cover the cost of the vehicle that is comparable to my current one? [link] [comments] |

Few years ago FM Was in stop and go traffic on a snowy road when a truck coming the opposite way hit my FM, no major injuries both trucks drove away after exchanging information. Couple witnesses gave info, all good, let's go to insurance cause hey shit happens right? When adjuster gets back to FM they say the other driver is claiming FM actually hit him! They had some super weak ass evidence so we weren't really concerned cause the true evidence was concrete. Obviously it's ruled in FM favour and adjuster says it is a criminal fraud case but can't give any other information, understandably. Condo ceiling damage claim denied due to 'negligence' language in by laws Posted: 04 Mar 2020 04:31 PM PST Hi, We had water damage that occured to ceiling on first floor condo. Went upstairs and the renters reported they had a leak in their fishtank. We filed claim against their insurance carrier and provided details of damage plus copy of by laws. The adjuster has spoken to the unit owner and has confirmed that there was indeed a fish tank leak and is not disputing the fact damage resulted from this leak. However, the insurance adjuster is denying our claim to cover damage stating our Condo by laws lanaguage, "If due to willfull misconduct or negligent act or omission of a unit owner, or of a member of his famiy or household pet or of a guest or other authorized occupant or visitor of such Unit Owner, damage shall be caused to the Common Elements or to a Unit ownerd by others, or maintenance, repairs or replacements shall be required which would otherwise be charged as a Common Expense, then such Unit owner shall pay for such damage and such maintenance, repairs and replacements as may be determined by the board." The adjuster is stating that it was an 'accident' that the renters were not 'negligent' in the act leading to the leakage and they tried to fix it as soon as possible. I have called and tried to argue with the adjuster twice but he keeps stating that because the by laws state negligence and in this case they're ruling it as an accident they won't cover for the damage! Any resources or how to tackle this? I've combed through but this is the only section that talks about damage and repairs obligations related to unit owners). Any and all help would be appreciated, as the damage is ~ $1500 and our deductible is $1000. We've had 3 previous leaks from upstairs unit in different areas that were paid out without running into this issue. However, none of those indicated any specific by lawys for their coverage. We waited for a police officer but even though I asked he said I just need to file with her insurance and explain and they'd determine fault. Apparently she is saying I hit her which is ridiculous because she merged into my lane and ended up in front of me. We were at an intersection and there were a bunch of people but unfortunately no one stopped and her insurance is saying since it's her word vs my word they're not accepting fault and we're responsible for our own damages. Luckily it's not too bad but I just cannot believe this happened. I called my insurance but I'm pretty sure the cost would be less than the deductible. I am not sure what other options there may be. I was sitting in the car (legal parking space) and the car behind me hit my bumper while parking. Not a huge deal, but scratched and dented my car nonetheless. We exchanged insurance, driver's license, and contact info. I contacted their insurance company (AAA) to file the claim and everything. AAA responds and at first, denies me because their insured would not respond to the requests of AAA. After complaining to the claim adjuster's supervisor, they call me back and say "yes, we accept liability based on the evidence you have provided." No less than 2 hours later, the supervisor calls me back and says "my boss says we can't accept liability because the evidence you provided only proves the insured was at the scene, and not that they're at fault. And because we could not contact the insured, we cannot accept liability." How is it my fault that AAA can't contact their own insured?! From my experience, if the insurance company can't contact their own insured, they still payout, because their insured was not cooperative. Is it normal for AAA (or any other insurance co) to deny the claim because of their non-cooperation? I already filed my claim with my own insurance to fix the damages and subrogate with AAA, so I'm not worried about it. She sees me and says dryly, "sorry" before walking away. I jump out to examine the damage and see a huge dent and chip on the side of my car. I call her back over to exchange information and she seems annoyed at ME! The next day I had an estimate for the damage.... $1700 to fix due to it being on the ridge of the side and due to the proximity to the front door, etc, etc.... I am going through her insurance (under her parents names) but I am just wondering if this will affect her parents rates at all. If she was remorseful a tiny bit I wouldn't care as much, but this teenager was a little snot for something she did and I would love to think she is getting an earful from her parents because their rates have risen. PVC failure at point of cast iron under slab foundation in TX Posted: 04 Mar 2020 05:43 PM PST Just finished sobbing so if this post is scattered it's because I am. Could be a 15-20k expense out of pocket. I've searched the homeowners insurance flair and can't seem to find what I am looking for so if this question has been answered I apologize in advance. Both my toilets backed up in my 1965 home and poop was coming out the shower drain. We called a local plumber who did all the tests + camera and determined that the PVC main line (added in 2010) connecting kitchen & two baths had failed at the T joint where the PVC meets the cast iron of the master toilet and shower and 2nd bath toilet and shower. I pulled permits and showed plumber the work that had been done to replace main line and he thinks that the mechanism used to fasten pipe to slab has failed and all the shit is rolling back downhill and now leaching into the soil under the foundation. I have progressive home insurance. Many people in the area have had similar pipe failures with no luck getting insurance to cover it. Some people in the area have had success with All State covering excavation. What do I say when I call my insurance to make sure I don't fuck this up? If you have any advice I would love to hear it. We have been noticing changes with blue shield of California in the new year, we had been aware that covered California now carved out our specialty to a third-party management company (American Specialty Health) but even plans not through Covered California were being handled by this third party management company, which greatly affects us as we chose to not be in-network with American Specialty Health. When asking our billers as to why this is happening with some Blue Shield but not all of them they said that it is due to these plans being "off-exchange" and when I asked what that meant she said she had no idea. So I went to google the differences between the two I just really didn't understand the differences and how that would affect the patient's coverage as supposedly it should not affect the patients' quality of care but I believe that this does affect them. We need to rent a portable organ for an upcoming concert in May and have signed a rental contract with the organ owner that states that we are liable for damage or theft of the organ while it's under our control for those few days. I asked our broker if we are covered under our current policy and got "Your current CGL policy does not cover damage or theft of rental equipment. We would need to add coverage for Leased/Rented Equipment? These policies start out at $500.00." But our policy states: "...Who is an Insured is amended to include as an insured any person or organization whom you have agreed to add as an additional insured in a written contract, written agreement or permit.... ...only with respect to liability..... caused in whole or in part by: c. The maintenance, operation or use by you of equipment rented or leased to you by such person or organization..." (I hopefully didn't leave out pertinent text) This seems like it would in fact cover us? I am unclear as to whether the organ owner would need to literally be named in the policy as an Additional Insured, or whether it is implied by virtual of the rental contract we signed with him. Posted: 04 Mar 2020 02:21 PM PST A neighbor who lives 8 houses down from me hit-and-ran my parked car at night 2 weeks ago. Luckily, a different neighbor who was walking her dog saw it happen, rang my doorbell the next morning, and identified the truck. I sprinted to his house and confronted the guy -- who was fixing the damage to his truck (he had no clue there were any witnesses). At first, he made a million excuses but then eventually admitted to having hit my car and gave me his insurance and DL. As a nice guy (perhaps too nice), I declined to go to the police station to file a hit-and-run report. I contacted my insurance to report the incident, but he has not contacted his insurance company (surprise, surprise). Both mine and his insurance tried getting a hold of him but to no avail. He's not picking up any phone calls. My insurance told me that they can recoup money directly from the man responsible, but that's going to take a while. I'm kinda in limbo right now, driving a car that needs to be fixed. Question 1: What's the fastest way to resolve this? Should I knock on his door and demand he contacts his insurance to admit fault? Or is this too dangerous? There's something a little "off" about this guy, so I don't know if he's dangerous. Question 2: Should I file a hit-and-run report against him? Or has too much time passed? If he goes to jail, I also run the risk of him getting "payback" - something me and my dad are scared of. Question 3: Should I lawyer up?
