3 car rear end collision. Who is at fault?

    Posted: 25 Feb 2020 01:12 PM PST

    Hello,

I am the middle car. Car in front of me stopped, I stopped (didn't hit the car and braked), and the car behind me didn't stop in time (either wasn't paying attention or idk) and ran into me pretty hard to where it forced my car into the car in front.

The lead car after we got out told me he saw me stop. Lead car has the least amount of damageS (a few scratches), I got the most impact from the car behind me. Rear car's front end is all messed up and had to be towed.

The cop did come but the police report hasn't been filed yet. Based off this information, the end car would be at fault for everyone's vehicle right?

Progressive insurance refusing to pay for the single doctor appointment after an auto accident totalling my car, among just about every other possibke way of misleading me. Can anyone read a summary of what has happened and tell me if I am being treated fairly?

    Posted: 25 Feb 2020 08:39 PM PST

Progressive has absolutely tried every single trick in the book trying to not pay anything. Basically my car was totaled. Other driver's fault. They had full coverage though Progressive.

First, I have contradictary converstations with them where they either straight up lied to me or witheld information because I am a young person with no idea what I am doing and no support system, unless they do this to everyone. I was in the middle of moving across states when my SO was involved in an accident (other driver was found liable immediately) totaled my car.

Immediately they called him mintues after the accident asking about his medical plans. He said he isn't sure but probably won't go to the doctors. He ended up going becuase of back pain about 7 days later. I confirmed on the phone he had the option to do so after I was informed (I was in the other state).

This was 5 weeks ago. They wouldn't talk to me about it but kept calling him despite the vehicle belonging to me. They are now refusing to pay the bill as well as ignoring my requests to not contact him and do all communications through email. (I stopped conversing over the phone so I could more easily keep track of what the fuck they are doing). They agreed to that, in writing, and now are not honoring that.

My loan for the car was still just over $6k. First they bullied me trying to withold info and get me to sign to have the car repaired without any inspections despite me having a recorded phone converstion layi ng out how the steps of evaluating the damage was. That would constitute a rebuild title rather than a total, and leave me still owing more than the car is worth and depreciating the value of the vehicle further as it had not ever been wrecked before. (NADA/KBB valued it around 3k).

I got them to do the inspection and in fact it was totaled. They never mentioned a loss of use claim to me until I asked them about it from reading online/speaking to my mother.

For the settlement, an inspector evaluated my vehicle. They said I had over 400$ of interior damage.

They refused to give me parameters that they use to judge the interior of my vehicle because it is the property of Progressive. I requested that a second inspection be done after I clean the vehicle.

I took good care of my car and they described the interior as having "significant and permanent damage". After I cleaned some crumbs out of the seat and used some seat cleaner on the car at the salvage yard, I requested a second inspection. They reduced the damage charge to 200$. But still refuse to give me any metric of what they are judging my car against aside from the inspectors' words of "significant and permanent damage".

I'm caught between states now car-less, unable to work or move the rest of my belongings. I was using my car for work and transporting my equipment between the states and cannot finish now. I had to purchase a bike with promptly got stolen. I purchased a second bike and locks etc. (All thrifted and secondhand because I currently have no income).

They told me the only loss of use I am awarded is between the 11 days between the accident and the 1st settlement offer. They say that my bus tickets receipts and miles traveled back and forth between between states to handle everything in a borrowed car do not matter despite me giving them receipts. They said they will award me 220$ for the loss of use, which would have been the cost of a rental vehicle for 11 days had I accepted a rental.

However I was also told in the beginning that I can only have a rental for 72 hours, and IF i signed to have the car repaired at their chosen mechanic (instead of just totalling the car which saves them thousands).

So among several other hiccups, the summary is now that if I accept the vehicle settlement and loss of use claim settlement, I will get a surplus of maybe 300$ from the auto loan payoff taken from the settlement, and $220 for loss of use.

I'm out of a job, I am out of a car, and now they are refusing to pay for my S/Os doctor appointment.

Part of an agreement I had with my new roommate in my new location is that i would essentially be his private uber service to and from work, saving him money on transportation costs as well as garunteeing me a monthly income of $300, as we arranged. I obviously cannot do that now.

So a settlement of an amount about 300$ greater than my loan will be awarded to me/my bank. My bank of course will take that and pay off the loan and I get the excess.

Getting $500 or so total between the two claims is not enough to use for a down payment nor enough to feel compensated "to my pre loss condition".

On top of that they have ignored requests and insulted me through emails.

One quote says "I apologize for any inconvenience stemming from your inability to reference this information while making your decisions," after requesting all communication be delivered by email because of the conflicting information I continue to get.

Any advice? Does this sound normal? Should I consult a lawyer? I am 25 and can't really drag this out much longer. I'm getting desperate for transportation and because my small business is still in infant stages (I moved for better opportunity in the market, it's my first big step).

    All help and eyes appreciated.

Accident occured in Oklahoma and I now reside in Texas. They want me to handle things at the Dallas office now though.

Allstate created a "Sucker List" to charge gullible customer even more.

    Posted: 25 Feb 2020 01:31 PM PST

Customers who were already paying the highest premiums, of about $1,900 or more every six months, and were due an increase would have borne price hikes of up to 20 percent. But drivers with cheaper policies, who deserved price jumps that were just as big, would be charged a maximum increase of only 5 percent. Customers in the 20 percent group were more likely to be middle-aged.

We also found Allstate's algorithm would have denied meaningful decreases to thousands of Allstate customers who the company's new risk profile showed were paying too much. That 36-year-old from Prince George's County would not have saved $3,772 on his policy as he deserved, documents show, but rather gotten a measly discount of $26. Discounts were capped at a half percent across the board.

About to turn 26 and Job does not offer enough hours for coverage. (Need recommendations for MA Private Insurance)

    Posted: 25 Feb 2020 07:41 AM PST

I am currently in school and about to turn 26 in March. I have tried dipping my toes into the world of Private insurance, but it seems very difficult to navigate these waters. Any recommendations for what to look for in a policy/what company I should reach out to. I tried a quote finder, and all it got me was hundreds of phone calls and emails from the bigger insurance corporations.

    Parking lot fender bender question

    Posted: 25 Feb 2020 09:56 PM PST

I was involved in a parking lot fender bender where I scratched against another unoccupied parked car. Other car received some scratches on the rear door near the tire and rear fender bent near the door (all within around 4in x 8in area). I left a note and the other person contacted me after a week. Now after few weeks, he has a repair estimate of about $2500+. He wants to settle outside saying both our insurances will go up. But $2500 seems too high for such a small dent and paint job. (The car is 8 yrs old and Kelly blue book price is around $4k now, so it seems ridiculous to fix it at more than half it's price). I will also be checking with another body shop if this is really the cost. My car has barely visible scratches.

My question is: should I go for settlement or involve both our insurances? Excluding deductible ($500), my extra cost would be 2000, which is equivalent to 80% insurance increase for 3 years over current rate. Also, will it come under my car's record and my license? No police report was filed.

Determining fault and best course of action?

    Posted: 25 Feb 2020 09:28 PM PST

I wanted to know wether or not an accident would be determined as driver A's fault or driver B's fault in an insurance claim.

Assume there is a parking deck with a ramp going to an upper level floor. It's shaped like a T.

Driver A is driving straight up the ramp.

Driver B makes a right turn coming out of the left side of the T. Driver B is texting and driving while also speeding. He comes too far out in his turn and turns into driver A's lane.

Driver A sees this, hits the breaks, then honks. After driver A honks, driver B looks up from their phone and breaks. The cars are within 2 inches of each other.

Driver A then freezes because of how close the cars are and releases the break then rolls forward and makes contact with driver B's car.

Driver B reverses their car and flees the scene because they were texting and driving.

Who would be at fault in this scenario?

Medical Insurance Coverage for Living Donor Evaluation

    Posted: 25 Feb 2020 07:50 PM PST

Hi all, I am on a waiting list for a kidney transplant in Southern California. My twin sister is (very generously!) being worked up as a potential living donor. My donor coordinator informed me today that my insurance carrier, a major carrier in Massachusetts, will only cover testing to determine whether a potential living donor is a match, but not the battery of additional tests required to determine whether the donor is healthy enough to be a donor. I called Member Services today, and they confirmed that they will not cover additional testing for a potential living donor, meaning my sister either has to try to go through her insurance or pay out of pocket.

I have heard that the recipient's insurance almost always covers evaluation of potential living donors, and my coordinator says that--in nearly two decades at a major research university--he has never heard of a recipient's insurer denying coverage for living donor evaluation.

Can anybody offer insight on how uncommon denying coverage for living donor testing is or offer any advice on what my next steps should be? Thank you very much for any help you can offer!

    Car Insurance Question

    Posted: 25 Feb 2020 03:58 PM PST

So I got into a car accident along with a traffic ticket (Rear ended someone;failure to reduce speed) 2 years ago with my friend's car but I didn't carry insurance at the time. His insurance covered the damage but I paid for the deductible for the repair. I'm buying my first car soon and for the insurance, do I need to declare the accident even though I had no insurance at the time? Thanks in advance

    Noob car insurance/repair question

    Posted: 25 Feb 2020 05:49 PM PST

TL;DR: Was involved in a collision, did not hear from other party and began repairs out of pocket, later heard from party wanting insurance to be involved, will insurance cover the repairs already being made or want to investigate first?

More details, happy to provide additional details as needed:

I recently was involved in a t-bone collision at a four way traffic stop on a unlit and dark country road. I collided with a truck that was passing through the intersection that I did not see, despite checking both ways.

After reviewing the damage on our vehicles, the other driver (who claimed the vehicle was insured under his uncle but could not provide insurance information at the scene) said he would talk with his uncle and call me, so we exchanged contact information. I never admitted fault but felt I was at fault, so after two days of not hearing anything I had my car inspected and begun having repairs made (have not paid anything, but told the repair shop I would be making payments out of pocket).

Three days later, I've already begun repairs to my car and he called me wanting to get insurance involved - would insurance cover the repairs I've already begun or would the insurance company want to have an estimate on their own?

    Thanks in advance

Rate hike after discovering 30+ year old injury

    Posted: 25 Feb 2020 04:38 PM PST

My husband has been in the process of applying for health insurance through Farm Bureau. Thirty two years ago, he sustained a very serious injury in an auto accident. He has fully recovered and never had any further issues from it. There are no existing medical records from the incident because it was so long ago. The only reason that his primary care physician even has it in his records is because my husband mentioned it. He has never been treated for any residual issues. We answered all questions on the application honestly as he has not been treated for any health issues in the past 10 years and takes no medication for any reason.

To clarify, he had Farm Bureau last year but cancelled it at the end of the year because he thought he'd found comparable coverage for a better price. When we discovered he had not chosen a good plan, he reapplied to Farm Bureau for the same policy that he'd had before. Medical records were requested again and it was then that his previous injury was discovered.

When he received the invoice, the rates as compared to last year had increased 50% per month. He called to question it and was told that it was because of the 30+ year old injury. How can an insurance company justify raising the rates over such an old injury that has not caused any residual medical issues? Is there any way appeal?

    Auto injury while at work

    Auto injury while at work

I was rear ended while on company time. Me and two members of my crew in a dump truck. We were completely stopped and the lady who rear ended us was not paying attention and hit us going about 35-40- didn't even attempt to brake. Her insurance company (geico) has assumed full fault. We all went to hospital with return appointments, xrays, etc. geico has contacted me directly offering to pay everything- my boss says that worker's company will pay for everything except for "personal injury" money. And that they will go after geico later to get reimbursement? Geico is saying they will pay my hospital bills and pain and suffering and lost wages. I am so lost I don't know what to do. If I accept geicos payments will worker's company accuse me of "double dipping"? Just FYI if either of these matter: This is North Carolina .Also since this has happened I am no longer working with this employer.

    Broken Into Renters Insurance Question

    Posted: 25 Feb 2020 04:10 PM PST

Hello Insurance, I am asking this question because i am freaking out and cant wait a month to see if we get any money back for what was stolen.

To put it very short- My roommate has been leaving a spare key under our door mat to our rented out townhouse for a while unknowingly to me. Our townhouse was broken into with the key(99.99% sure bc no forced entry and the key is gone) while we were both away on a weekend night. Called the cops immediately after we started noticing stuff was missing the next morning and told them everything. We are sure it was one of our neighbors who is v sketchy but that's irrelevant. Our renters insurance is with state farm but our case is being transferred to a specialist and i dont think they believe us. I got around 3k stolen mostly electronics.

Thanks in advance for any insight

    Advice about 50/50 Liability

    Posted: 25 Feb 2020 03:46 PM PST

    I am after some advice / opinions on an accident I was involved in today. The insurance company have come back claiming it's a 50-50 liability outcome, and won't budge. I have a witness who is 100% backing me. I will use his statement as an account of exactly what happened;

    "Accident 25th Feb 2020 approx 8.20 am

    Road conditions clear, sunny

I was driving south on the A563 and had come to rest at the traffic lights with Grove Park to the right and Sainsburys to the left. I was 3rd car back at the lights. The lights had just changed to green for me when a car, PLATE OF OTHER DRIVER, came at excessive speed from the right, Grove Park, and must have jumped a red light. At the same time a car, MY PLATE, came from my left, filter lane not light controlled, from Sainsburys. The two cars collided in the left hand lane of the A563. The two cars in front of me at the lights overtook the collision and carried on their way. I stopped behind MY PLATE and asked if they would like a witness. At the point that I asked the question, the driver of PLATE OF OTHER DRIVER was remonstrating that he was only doing 30 miles an hour and that it was the other drivers fault. I explained that I knew neither driver but, the way I saw it, was that PLATE OF OTHER DRIVER had come into the junction at excessive speed. I left both drivers with my business card and left."

The 50/50 liability outcome was decided within 10 minutes over the phone. The above statement was not given to the insurer until 4 hours after this, as I contacted the witness to find out if he had talked to the insurance company due to being suspicious of the outcome. The insurance company are not budging on that I should have given way, however my argument is that you have no reason to give way to a red light, and it seems that it is suddenly legal to both potentially, although not provable, break the speed limit and run a red light. I have a satellite image here, showing lights on green at the top, lights on red at the left, and his path on the left from the red lights meeting myself from the give way.

    Renters insurance claim

    Posted: 25 Feb 2020 09:28 AM PST

Hi all, around 2am last night I started to hear a drip come into my apartment from the ceiling. I immediately called emergency maintenance who didn't call me back for an hour. Within an hour it got progressively worse so I called the fire department after about 20 minutes. At this point it's dripping in about 10 locations in my living room. Got my couch, bike, dining room table, tv stand and potentially TV wet (not much, but wet albeit). Firefighters came and broke into apartment above me to find a cat, and an overflowing sink with a stopper in the drain...

Anyway, maintenance came at 3:30am last night and vacuumed the ceiling. They put in fans and dehumidifiers and called it a night. Now, they woke me up at 8am to let me know they're going to get started on "work", most likely entailing pulling out large portions of the wall and ceiling.

I live in an apartment owned by a complex. I have renters insurance around 100k if I recall. I had to take the day off work to tend to everyone in my apartment.

I'm wondering how this will all go down when I get insurance/my complex involved. Will they pay for relocation/displacement, can I even ask for relocation, time missed from work, all things that got wet even if they didn't get badly damaged, my time, lack of sleep, etc?

Also when they plan to remove parts of the wall, dust will fly literally everywhere (known from experience), so I am worried that by doing that more things will get ruined, even if stored away in other rooms/cabinets, although it wasn't due to the original cause. How do I go about filing for this instance?

I'm pretty much a nube to the apartment disaster/renters insurance game so any insight would be so helpful. Thank you!!

How long does a car deductible refund take?

    Posted: 25 Feb 2020 03:09 PM PST

In Washington state, a FedEx truck hit our parked car, left a note. Caught on home cameras.

Our own insurance took care of things and had us pay our deductible even though we were not at fault. 1000$ deductible , 1800 in damage.

They sent Fedex's insurance a legal subrogation letter to refund the deductible. Its been 3 months.

What is normal in this situation and how long does it take?

    Negotiating Insurance Claim

    Posted: 25 Feb 2020 02:20 PM PST

I nicked someone's car in the city, I left a note. There were three small breaks in the paint, all less than the size of a thumbnail.

We decided to go outside of insurance, if possible.

The initial estimate was $1200. He got a second estimate for $580, and he wanted $750 total for the inconvenience. I got an estimate for $420, and he still wants $750 total.

    What should I do?

Double coverage on home systems question.

    Posted: 25 Feb 2020 12:32 PM PST

So, i have a policy with my gas company (NICOR gas) to cover my water hear in case repair or replacement is needed. I pay ~$6 a month for that. They will cover up to $400 towards repair and replacement. I also have a coverage add-on to my home owners policy for home systems such as hot water heater, furnace, AC etc.

NICOR gas requires i use a recommended plumber, and I did. The plumber replaced my heater and related plumbing for a total of $1250. Take away $400 from NICOR gas coverage and my payment to the plumber was $850.

Now i also opened a claim with my insurance carrier (state farm) who then passes the claim on to Hartford steam and boiler. I have a $500 deductible with this policy. They are stating that they are only liable for the amount that i actually paid. Regardless of what NICOR paid.

My point in having double coverage, was to reduce my liability. I was figuring that state farm/ Hartford would pay out, less the deductible on the total amount ($1250). Instead, it seems that Hartford is only going to pay out on the $850 less the deductible, which would give me $350.

Does anyone have any insight to this? Thanks

Does an LLC owned vehicle require a commercial type of insurance?

    Posted: 25 Feb 2020 11:59 AM PST

Sorry if this is a stupid question. I'm not an American citizen so I can't own a car in my name yet (must be resident and have a state license before). I'd like to buy a car under an LLC that I own there though. Would that require a commercial type of insurance (which appears to be way more expensive) or can I have a personal/non-commercial insurance? The car won't be used for business. Not in the near future at least. Thanks in advance for your help, I know next to nothing about American insurances!

Insurance rate doubled up after car was T-bone (not at fault)

    Posted: 25 Feb 2020 11:50 AM PST

Hi all- My insurance premium today has doubled up by Geico to $288.40 per month after I filed for collision coverage after I was T-boned.

Police and Geico has already declared me to be not at-fault last month. The other part is uninsured and we have been trying to go through UM coverage but the process is really slow. Hence, last week I decided to file with my own collision coverage first.

Is it normal? Obviously I am going to ditch Geico now but I am worried this will impact my quote with other insurance company. Thank you!

Not at fault accident. My car is definitely totaled. Have some questions about insurance determining worth of car.

    Posted: 25 Feb 2020 11:04 AM PST

Hello all, unfortunately I was involved in a car accident just yesterday. The car at fault turned out of a college parking lot to make a left and didn't see me and I didn't have enough time to react. My car is completely done for, front end smashed in, airbag deployed, hopped the curb, oil pan busted and the bottom is completely toast.

My question comes from how insurance will determine the value of my car, as it was fairly modified with aftermarket performance parts (turbo, intake, clutch, etc), custom wheels, tires, suspension parts. I owe about 9,000 on the vehicle and was just talking about paying the car completely a week ago, but never decided to do it. The car was bought how it was when it was wrecked, I personally didn't do any modifications to the vehicle.

Do the claim reps take all aftermarket things into consideration? The parts on the car are worth at least 3-5k dollars, and it was in great condition with low mileage for the year.

Last question, should I cancel my upcoming payment to the financing agency on the 1st of the month until the claim rep contacts me, should I pay the balance in order to get a straight check from the insurance and not have them pay the lienholder directly, or should I just continue to make the payments on the vehicle until everything is settled?

    Thanks all

I am in the UK. I have theft/loss insurance for my iPhone. I lost it 2 days ago. If Apple replaced my iPhone like-for-like last year when they broke my old one during a repair - will I still be insured?

    Posted: 25 Feb 2020 10:18 AM PST

The IMEI is different as Apple replaced my insured iPhone7 with a new one (because they broke it during a repair) and I didn't think to tell my insurer.

I have proof of purchase for the old phone and proof of Apple swapping the phone with a new one (the document contains the old IMEI and the new one).

    What are my chances?
