Nightmare Sellers Clearly Swapped Dishwasher With Very Old One After Close Posted: 06 Jan 2020 01:41 PM PST Seller has been a pain to work with throughout the process of buying our first home. We finally got a deal reached and included a 7 day rent-back period at no charge to them for helping us with an extra $5,000 credit toward closing costs. We did the walk-through two days before closing and everything looked good (besides the fact they had nothing boxed or ready to be moved). We hit the end of the 7 day rent-back and their agent notifies ours that they need more time. We argue back and forth and they are adamant they cannot be out. They need an extra 3 days and will be out by Sunday by 3pm. We come to an agreement they have to pay $100 per day extra they stay so $300 total. Sunday rolls around and it's now 4pm, so we are going to head to the house to meet up with our agent and make sure everything looks good. He gets there first and notifies us that they obviously are not done moving out, there are still items in the house and it is very messy - trash everywhere. As we are walking through the kitchen I notice something - the nice stainless steel dishwasher that was supposed to come with the house was now replaced by an old absolutely dirty white one. Our agent immediately got on the phone and left the seller's agent a voicemail and text stating we would be contacting an attorney in the morning if things aren't remedied. We hear back from the seller's agent and he can't believe they took the dishwasher either, but that he contacted the sellers and they will be bringing it back later on in the evening and finishing up the rest of the house. This morning rolls around and my girlfriend runs over to the house to make sure all the work had been completed. Lo and behold, the dishwasher was NOT put back (they did leave the $300 rent thankfully). We notify the seller's agent AGAIN, and he sends his sellers the nastiest text message about how they are embarrassing him and that they are greedy people. Does anyone have any advice on what to do here? I've searched and it's hard to find examples of our exact situation. They were doing a rent-back from us, so they basically just straight up stole the dishwasher. We are planning on filing a police report today with the evidence from the contract that all they were allowed to take was the fridge, washer and dryer. Possible sketchy realtor tactics Posted: 07 Jan 2020 05:45 AM PST Hey guys, So I'm a first time homebuyer who's been looking at houses for about a month now. Typically throughout this process, I've found houses I liked and sent them to my realtor and we've looked at them, which is fine with me. I don't really feel like my realtor needs to be sending houses I can see on mls/Redfin myself. Yesterday night my realtor texted me to "make sure" I saw this new listing, which i had but didn't really pursue it because it only had 1 picture posted of the front yard and that was it. I looked into the details of the house on MLS and it turns out that it's being sold by some bogus llc, but the guy who actually signed the documents is a realtor that works for same company as her. So basically, it's a house being sold by a realtor from a company masked by an llc, listed by a realtor from the same company, and my realtor who also works For that company is kind of pushing me to look at it. Buyer Agency Agreement - advantages for learning about listed and unlisted properties Posted: 07 Jan 2020 05:33 AM PST I have a question about the advantages of entering a Buyer Agency Agreement and how to choose an agent for optimal advantage in the market. I understand the main reasons for signing the agreement, but one factor that I think is potentially the most important for me (entering a hot seller's market) is the exposure to new listings before they are posted to the market. If I want to maximize my pre-MLS exposure, would it be better to sign an agreement with a large firm, who might have more exposure to new listings? I have been in contact with a realtor from a small firm (she is the firm owner and only agent) as well as a large national firm (many agents). If I sign with the smaller firm, it seems that the only pre-market listings I would be offered would be ones that her firm has been contacted to sell, which, because it's a smaller firm, seems like there would be less selection for pre-market listings. A follow-up: if she has access to these pre-market listings because she was contacted to sell them, then for all of these options, I would be working with her as a dual agent -- should this be avoided at all costs? Trying to get a feel for the process here before entering an agreement that will offer the most benefits for exposure to pre-market listings. tldr: Would signing a buyer agency agreement with a larger real estate firm lead to more exposure to pre-listed properties? Posted: 07 Jan 2020 05:03 AM PST Hi folks. As the title states, I made an offer the day before Christmas Eve that was accepted, contingent on my house selling. I'm moving to a different state with my 6 month pregnant wife and toddler to get closer to family, and I'm the founder of a startup, so needless to say, house hunting has been extremely difficult. We did a contingent offer because we need to be sure our house sells first in part to make a high enough down payment to avoid PMI, and because my wife was nervous our house wouldn't sell for enough to leave us financially secure. I got my house on the market within the allotted time, priced it low for a quick sale, and lo and behold, it worked. 3 offers, small bidding war, house under agreement, all within 8 days of posting. Mind you this is all happening over the holidays. Yesterday, on the same day my house went under agreement, I got an email from the seller's attorney that they disapprove of the contract and to consider it cancelled. We were able to get their agent to tell us they got a higher offer without contingency the night before. However, this was after the attorney approval period of 7 business days. The only thing I did "wrong" was that I asked for an extension on the inspection date at the advice of my attorney, who suggested we wait until after attorney approval or until our house was under agreement, especially considering the holidays and the fact that I needed to be home to be selling my house. It was only a 3 day extension from 1/4 to 1/7. My question is: what can I do, here? I have already sent a counter offer at asking price with the contingency removed, since I now know how much my house will sell for and when. My parents have a $800k home in Canada and they do not want to sell it - they want to put 50% of the home into my name and 50% into my sisters name. I am wondering what the tax implications are since I plan on staying in the US. My questions: 1) Do I pay US taxes on this now after the home is put into my name? 2) Do I only pay US taxes if we decide to sell the house? 3) If they bought it for $800k and my sister and I sell it for $1M, how do taxes work on that 200k of profit..? 4) For my own understanding, are any of the above answers different if I am a green card holder or a citizen? Posted: 07 Jan 2020 12:06 AM PST 1) How does one go about figuring out what kind of access there is to land you might be interested in? 2) Would the realtor have that kind of info or is that up to the buyer to figure out? 3) Does a realtor usually have access to a map of the property lines or do they have only what can already be found on like Realtor.com? 4) Lets say you narrow your choices down to 5 options and they're all through different agents/realtors, can you work with one realtor who can help with any of those properties or are they restricted to only what they have listed? I'm a finicky person by nature and know that it has to be in PA, 50+ acres, electric (of course), natural gas, public water (no wells), Comcast Cable and a bonus would be the ability to hunt on the property. And almost forgot... the lowest possible property tax! Preference to a property that is mostly on the flat side with no lakes but a couple ponds or maybe a stream would be nice because if hunting is allowed it would help to have a natural water source. A big thing for me is the property has to be as squared as possible and not all over the place with the property lines. A lot of trees is a sure preference as it gives many options on home placement and driveway design. Seen too many existing homes with horrible placement, whereas I would go almost dead center. I live in GA where land and housing is relatively cheap. I'm a single person making 60k, though hopefully that goes up this year! I currently rent an apartment. What I'm looking to do is buy some land (3-5 acres) and build a small home (not the whole 'Tiny Home' thing, but something designed for a single person) that would hopefully run me less than the average 200k~, 2 bed 2 bath house that most of the market comprises of around here. If I could build something small but nice for 100k or less (not including whatever land I buy) then I'd be absolutely thrilled. To clarify what I mean by small (and I'm no architect), something like a 700-800 squarefoot, open ground floor with a kitchen and living room, with something like a loft up top with space for a bed. That's it (well I guess a bathroom in there somewhere, ha). In GA, does anyone have any clue as to how much something like that would cost to draft up and build, or point me somewhere to figure that out? [AU] Question on NBN Connection Posted: 06 Jan 2020 10:33 PM PST Just wondering with the mix of technology available, I'm looking at buying/building a house and we've been writing off FTTN and FW suburbs, mainly for speed and latency issues. Only been looking at FTTP/FTTC suburbs, now my understanding is that if I'm in an FTTC suburb I can pay to have the lead in made to FTTP if building, now would the cost be similar for FTTP/FTTC if I'm building if I chose an FTTP connection in an FTTC suburb versus a FTTP connection in an FTTP suburb? As really it's the difference of running copper or fibre to the connection on the footpath? Or is it a whole new fibre run from the exchange even if there's already fibre in the pit? A few more people are saying if I live in an FTTC suburb, I'll be benefiting my neighbours if I run FTTP, which I'm not sure exactly how they'd benefit from that down the like, as I'm not building any infrastructure to them, just me. Lastly, I've been told it would not increase the property value one iota going FTTP over FTTC, is this true? It's been a big thing on our tickbox when househunting the ADSL/FW/FTTN/FTTC/FTTP curve of suburbs we have looked at. A couple of homeowners have been amazed that we'd walk out on a FW or ADSL property because of the connection. Am I being touchy? Or a Millennial? Or is this a silly concern? I love the house, it's in my dream location, and it's our forever home. The only odd thing about it is that it has a very small lot compared to the rest of the neighbors. Each house backs up to an alley, except the land right behind my house belongs to my next door neighbor. There are no structures on it, and their kids occasionally play back there, but mostly use their rather large lot. Ideally, I'd like to buy the parcel that sits behind my house so that my property extends directly back to the alley behind my house (also we plan on putting in an addition and a two car garage in the years ahead and would like to have more backyard space to accommodate this). The internet has yielded very little in regards to this scenario and I wonder if anyone had any experience with this and what I might expect to encounter. At the time the cabinets were slightly pulling away from the wall, the stairs were slightly sloped, bowed wall, etc. Anyways all of these issues have gotten worse over the last 3 years. Is there any recourse I could take against the seller? I asked the home inspector about the cabinets and he brushed it off like he didn't know or no big deal. I also asked him about a crack in the foundation and asked him specifically if there is anything I need to worry about. He said the house has settled over time. I k ow this guy flipped the house to me cause he saw the problems coming. He probably hired a civil engineer to give home a report. Anything I can do? Thanks [link] [comments] |

How to be effective in between investments Posted: 06 Jan 2020 02:48 PM PST I'm a 25 YO first time Investor. I currently live in a 3/3 condo I'm house hacking and it is going great. PITI/HOA + maintenance & vacancy is 1630/mo and I gross 1640/month. I live there for the cost of utilities (about 150/month). I procured this property with a 3.75% note with a 5% down payment on a 300k purchase price. No PMI. When I move out, I should cash flow 500-600/mo conservatively. I want to keep doing this, buying SFRs year after year at 5% down leaving a cash flowing rentals in my wake until I have between 5-10 SFRs. I bought the house in June 2019 and will have liquid savings enough for a second property in Q4 2020 (I'm prioritizing maxing out 401k and rebuilding my E-fund I dug into to buy the first place; won't do that again!!). The issue I am having is I'm feeling antsy and have this urge to make more and faster progress. Is there anything in the meantime I could do to better prepare myself to scale in the future? Our property value dropped by 10% from last year. We bought it in 2016 and since then the assessed value has dropped by ~14%. We will most likely be selling our home this summer due to a work related move. I know we will be losing money on the house due to the housing market here. Posted: 06 Jan 2020 07:33 PM PST How normal are credits from sellers for a home that needs some work? I am in escrow on a property that was overpriced (20k) when we offered on it. After some back and forth - we got it to the price we thought was fair. After appraisal, it came it right on the number that was accepted. Our home inspection came back with some things that you would expect from a 15 year old house. The HVAC is on life support. Its leaking, its rusted, its 15 years old. There are 3 windows that have broken seals and there is a water heater that was installed 3 years ago that has the pressure hose installed incorrectly, (twisted downward). Cracked roof tiles. Some GCFI issues with the electrical that came up too. THere is a large storage shed in the back that we dont have keys to that we cant inspect. There were also a long list of cosmetic things - broken/missing closet doors. cracked vanities and a shower tub that has some damage at the drain. We sent over some requests to the seller to have fixed/replaced/credits applied. We didnt even mention the cosmetic things. just the stuff that was not safe or was going to fail in the immediate future. It took them 8 days to come back, to say they arent doing anything other than change the smoke detector batteries. also, they will leave the storage shed keys in the house at closing, not before. i was conditionally cleared to close today, and am 10 days from my date - and now i am feeling really discouraged. This house sat on the market for 85 days with no other offers on the table. Is this something that is normal? i wasn't asking for a full replace of things - just some assistance to getting it into working/safe order. Am i being unreasonable that I am considering walking away? I am a first time home buyer, so i apologize if i'm in the wrong -- Part of me thinks that because i am putting down a large down payment, they believe i dont need any credits from them and its eating at me. but just looking for some experience and advice from those who have bought and sold before. I have contacted the processor, officer, their boss etc. I have maintained contact and gotten all of my paperwork in within hours and they are taking days to respond each time. They've been ignoring my calls and I'm now almost 14 days beyond my initial closing date and I'm being charged $100/day for every day I go beyond that date. I initially backed out of an offer before and escrow was included which allocated home owners insurance and property taxes. I just noticed with the new disclosures i signed it did not allocate home owners insurance and property taxes. Is there a way to include escrow after signing disclosures? I reached out to my mortgage lender and have not heard back. Initial Disclosure - include 397/month for property taxes and home owners insurance, as well as $900 for insurance and property taxes for 8 months. Now it does not have escrow which estimates 420/month for property taxes and home owners, and no initial money at closing for escrow either. [link] [comments] |
