Posted: 05 Dec 2019 05:17 AM PST Backstory: For the last few years, my mom has been spiraling deeper and deeper down the "conspiracy theory" rabbit hole. At this point, it's everything from 9/11, to chemtrails, to Illuminati, to the moon landing being fake. My mom believes that within the next 2 years, the government is going to eliminate 2/3 of the US population by forcing us into concentration camps. They will start by starving us (by controlling the weather and killing off our plants/animals) and then revoking all passports. After we're "trapped," they will start rounding us up. Long story short, she is making plans to pull my sisters out of college/high school, abandon our house, and move to somewhere in Central or South America before they revoke passports. She also wants to do this ASAP because "they will crash the value of the dollar soon, so we need to buy property before then." My youngest sister Maggie is 17, and she does not want to go. The problem is that she doesn't turn 18 until August of 2020, which is after mom plans to leave. My main question is, can my mom legally force her onto a plane? My follow up question is, can Maggie get emancipated? From what I can find online, I don't think Ohio allows minors to emancipate themselves. I signed up for 8 personal training sessions on Nov 5th, 2019. I explained my employer gives me $500/yr to spend on fitness and that's all I want to spend. Which package is best for me? They recommended the 8 sessions which came to $480 + tax ($552) which I bought. I signed waivers, etc regular stuff when I signed up and I paid the $552 in full on Nov 5th on my credit card. Dec 4th (29 days after I signed up) I noticed they charged my card again for $552 on Dec 2nd (27 days after I signed up). Assuming it was a mistake I went in and told them, asked to be reimbursed as I don't plan to continue the personal training sessions, etc They said I needed the give 30 days written communication to stop the charges. 30 days written communication would have been Nov 2nd. 3 days before I signed up for the first 8 sessions. I was never given a contract, etc. Now they're saying I have one. I do not have access to it. I've emailed them for a copy and they have not provided it. I've already submitted a dispute claim on my credit card, I'm waiting for them to get back to me. I've also cancelled the card. What else can I do? I've contacted different lawyer offices but they don't seem to want to help and I'm not sure what area of law I should be targetting. Many people told me in the comments of my previous post that we should call non-emergency and see if they can put some type of note or report on our address or names that basically says that this is an ongoing problem and to take it with a grain of salt. We tried this, here's what happened. So tonight my brother called our county's sheriff department to see what could be done about the false report made by our mother. They told us there is nothing they can do, there's no way they can put in a note or report that we have a mentally ill mother that calls the police frequently over false scenarios, and that if she reports another crime they have to respond appropriately and if they come here again to not have anything in our hands, comply with orders and not talk over their orders but explain the situation when appropriate. They said however that we could choose to press criminal charges against her for making a false report. My question to the legal advice subreddit is, should we press criminal charges? Will this actually prevent these types of incidents from happening in the future, will they get her mental help ASAP, or will this just get her fined and maybe put in jail for a few days? If it's the latter, I don't think it's really worth it as it would just cause more drama, if her mental issues are exacerbated by stress (which I'm pretty sure all mental issues are) then it would just make things way worse and fix nothing. Is there another way that we can use this incident to prove that she is a danger to us immediately that my brother wasn't informed about over the phone that will get us out of harms way very quickly and prevent future swattings, or would it be a long process that would leave us hanging in that time? Would we be better off just moving somewhere else this/next week and cutting all ties? Right now our priority is keeping ourselves safe. We are quite frankly, scared shitless. My apologies if anything I write is unclear, it's 4 in the morning and I have been unable to sleep since this whole situation started. I received a court summons today from my own mother, demanding visitation rights to my grandchildren. I believe this would not be in the best interest of my children due to the fact that she neglected me to the point of causing permanent emotional damage when I was a child under her care. She has also admitted to using elicit drugs (MDMA and LSD), even repeatedly offering them to me after I made it clear I was not and would never be interested, and I have seen it firsthand being stored in her home. Furthermore, she constantly undermines my parental authority, yells at me in front of my children, and generally has no ability to maintain a healthy relationship with me despite years of repeated efforts on my end to make amends. There are some other more minor reasons but these are the major deciding factors that have led me to the conclusion that being around her would not be in the best interests of my children. They are only one year old and have never lived with her, thus there is no established parental bond. I provide fully for my children. I make more than enough to support them, working from home so I have 24/7 care of them. I cook them three meals a day and spend all day every day caring for them. I'm in no way unfit to parent them. I've done extensive research and would like to think I have adequate reasons to deny her request for visitation, however I am only 20 and have never been to court before. On the summons it says I have to file an answer, but there is no explanation of how to write one and despite all of my research I cannot find any examples or templates or even basic instructions. I am very concerned she will somehow win the case and I'll be forced to allow her to be around my children. I also feel I do not have much evidence to prove my claims, although people who know me can confirm I've had the same story for years, because most of our communications are in person, not in writing. Supposedly they could not access our website. We do not have a storefront or shop. We have an office in Orange County, California that is strictly available by appointment, but 99.9% of people wanting to make an appointment, we refer to other businesses. We see 1-2 clients a month in person by appointment. in the lawsuit they filed, they kept referring to our company having a storefront/shop, which is not true. The cost to defend ourselves in this lawsuit is over $100,000. If this happened in our first year of business, we would have had to close down. Posted: 05 Dec 2019 09:38 AM PST I had an email from my letting agents this morning saying that the owner of the flat I'm renting would be carrying out an inspection today and that I should contact them if I had any problem with this. My partner and I have lived happily in this property for 15 months and have never had an inspection. In our contract it states that if an inspection were to be carried out we would be given at least 24 hours notice and we can refuse entry if 24 hours notice isn't given. I did a quick Google (I know Google isn't always right, but I was desperate!) search earlier which also says 24 hours notice must be given to tenants and if it is not then I'm well within my rights to refuse entry (unless of course they suspect criminal activity etc). I contacted the letting agents as soon as the email came through and told them they will need to arrange to come either when I'm home from work or on my next day off as I hadn't been given notice of inspection and I was not happy with them coming when myself or my partner aren't there. The woman on the phone said that was fine and told the landlady while I was still on the phone. An hour later my partner drives past our home whilst working and sees the landlady and 2 other people entering our home. They were made aware of the fact that I refused entry and would be happy to comply with the inspection tomorrow in 24 hours time. Is there anything I can do such as filing a complaint or something more serious? Would I actually have a leg to stand on or am I on the wrong here? I verified with them beforehand that they'd be able to do it and they said yet (I have multiple emails confirming this) When I finally got it to them in in Florida and shipped all my stuff (including the bike it powers), they held it back and said it could only be shipped with the equipment it powers. Unfortunately, they didn't hold back the bike and shipped that. Then, they offered me a reimbursement on the battery, but in later emails said they wouldn't offer that. Is there anything I can do? If I have a new bike shipped to them or just discard the battery and buy a new one I'm down $1k. Tonight on the way home from work, my wife was pulled over by someone claiming to be a State Trooper. He was driving an older pickup truck, that had a single red "police" light and PA system. It was through the PA system that he told her to pull over. It was clearly a civilian vehicle and had no markings of an official police cruiser. He told my wife to pull over, which she did (she's a little too trusting). She got off the highway and pulled into a restaurant/casino parking lot (she chose a busy, well-lit place on purpose). The "trooper" told her that he observed her talking on her phone and that she was following too close to the car in front of her. She was on the phone, but through a hands-free bluetooth connection. He claimed she was holding the phone to her head, which she wasn't. He did not present a badge, give a name, and was not wearing any official uniform. He merely said he was an off-duty State Trooper and was "giving her a warning." He did not issue any citations. I need to know how legal of a stop this was. My understanding is that CA law enforcement must have a visible badge and must wear a body camera. I am 99% sure this was some weirdo impersonating an officer with bad intentions. My wife did not get a license plate because he parked a weird angle and it was raining and dark. she could only give me a limited description of him (white male, no facial hair). I told her if this ever happens again to not pull over, and call 911 explaining the situation. any other advice is greatly appreciated. thank you UPDATE: first, thank you for all of your comments. We called the non emergency number for CHP last night. The person who answered said that any law enforcement officer can act in accordance with their job duties 24/7 so an "off duty" officer can still pull someone over. She said it could have been an undercover highway patrolman, but also acknowledged it could have been someone posing as an officer. I thought it was weird that an undercover law enforcement officer would waste their time issuing citations, but she assured me it could happen. She said that if a situation like this were to occur again and my wife did not feel safe being pulled over my an unmarked car, that she is to call 911 and not stop until a marked car arrives. As long as she stays on the phone with the 911 operator, not stopping would not be held against her if it were in fact a real officer. The non-emergency person did say the "officer" should have identified himself as law enforcement and presented a badge. I asked her about the body camera thing and she said it was not a requirement. This has led to water ingress into the plywood core of the panel and has voided the warranty of the panel as it was installed incorrectly. He has acknowledged that there is damage and is now trying to avoid responsibility and trying to install some sort of post installation patch on the wood even though it is already permanently ruined as explained by the manufacturer of the panel. Earlier this week, we all (myself, other roommate, herself and our landlord) all signed an amendment to the lease, removing her from the lease. She just notified me (after having to ask and dig for information) that she intends to come back with movers and get the rest of her things while myself and my other roommates are at work tomorrow. Is she allowed to come into the house without our permission while we aren't home? She's did already pay December rent before moving out in the first place. The amendment does not specify a date that it becomes effective, and I assume it is effective immediately. I wouldn't even attempt to have these recordings monetised, and at the moment I'm thinking of a book of children's tales, which has been out of print for a while (1983). It seems to had been printed in 1983 in Poland only for a few months, but copyrighted in 1968, and was a school literature book (it has a stamp indicating it on the inside cover.) The author (or rather the person who selected the various stories by various authors in various books quoted at the back) passed away in the 80s, and the publisher seems to have put out a new edition in 2012 - strangely, still using the same 'author' name on the front cover, but consists of some different, some same stories. When we signed he told us that a family member would be moving into the third room. As far as i know we each have individual leases. Up until November the third room was unoccupied until the third tenant who i am going to call Cindy moved in. I don't know very much about Cindy , but she is related to our landlord somehow and she was apparently a single mom. At the end of November Cindy and the landlord told us that her 4 kids are going to be living with her in the apartment as well, and laid out a bunch of "new rules" such as:
I told her that if it isn't in the lease it doesn't mean anything, and both me and my roommate has since been telling her off. Right now i will say that both me and my roommate have been passively aggressively standing our ground. She does minor petty things like yell at us, and plead with us to respect her rules and we don't which leads to petty stuff like her turning the stove off when we turn it on after 7 pm to make dinner. However living here since the 4 kids showed up has been absolute hell. Her oldest is like 10 years old, and the youngest is constantly crying cause it is a baby. I complain to her or the landlord and i get the same shitty pity speech about she is a single mom and how hard it is. We both have asked to be let out of our leases and our landlord refused, and told us unless we can find a replacement he won't (who would move into this hell). Purple frog day it was because they were waiting for a part but their own guidelines say that issues like this will be fixed within 5 days. They have also accepted responsibility and recognised that it was not acceptable we wait so long but are only willing to offer £50 in compensation. Is this fair? I initiated a refund through eBay. The seller paid for fedex to pick up the package to be returned which it was I have confirmation and proof. The seller goes dark trying to abuse ebays return policy so that I couldn't receive a refund. He wouldn't respond to anything. So I go to my credit card to file a dispute. The seller gets angry tells me to drop the dispute. I go to eBay to get an official refund but the dispute on my card is blocking it. So I recall eBay they tell me to drop the dispute so my refund can be processed. Huge mistake. PayPal ends up taking over for eBay and fighting an already dropped dispute with my credit card for over 75 days. Every rep I talked to at PayPal in that time period assured me my money was going to be refunded. It ended up going back to the seller over thanksgiving. Now no one at PayPal or eBay say they can help me. My card holder won't refile a dispute either. eBay recommended I take legal action and get in contact with either of our local polices. We had been treated like absolute dogshit by the landlord (extremely slow repairs, no central heating until January, multiple thefts) and we had zero faith that our security deposit, so as a final "fuck you" we didn't bother cleaning before moving out. Aside from an outstanding balance thing we had to sort out a few weeks later, I was happy to just forget about that place and the year I'd spent there, even if it meant that the landlord was just gonna eat my security deposit. On Monday of this week, my roommate received a letter from a collections agency informing them that we owed the company about $1,500. I went to the online portal we had used to pay our rent, took a look at the ledger, and found out that on August 22, nearly five months after the date of us moving out, our landlord had added about $2,600 worth of charges (the difference between that number and the number the collections agency gave us being the security deposit). There were no receipts or anything for these charges, just entries in the ledger for things such as "$300 - Cleaning - Trash out of apartment" and "$1,500 - Repairs Labor - REPAIR & PAINT UNIT". I recognize and accept some of these charges - like I said, we left the place a mess, so the cleaning ones make sense. There were absolutely zero attempts to contact us by the landlord. I even went and checked my barely-used email that was linked to my tenant profile and didn't see any e-mails from the portal from after the day we moved out. No calls, no letters, no e-mails, just these charges added to the account out of nowhere. As far as I've been able to find, NY (until July of this year) has a policy that says security deposits must be returned to the tenants within a "reasonable amount of time" which is commonly accepted as 1-2 months after the move-out. However, since the collections agency is now involved, our timetable is really short until it starts tearing into our credit rating, and I have no idea where to go from here. I've tried reaching out to the local housing authority and housing council - the former was no help, and while the latter was able to give me a bit of information, I was only able to talk to a hotline operator for a few minutes. HOA management company messed up and we are now unable to sell our condo Posted: 05 Dec 2019 09:16 AM PST Will try and just state the facts. My wife and I own a condo in Colorado. Building has 17 units. I am one of 3 on our HOA. 3 years ago we hired a management company to basically handle all aspects of the building, we 3 are basically just there for voting purposes. We have a rule in our by-laws stating we are not allowed to cross 50% rentals (people like to rent their units out) as that seriously affects our valuations as we can no longer offer FHA and VA loans. About once a year we would get an email from the management company saying a unit is interested in renting and that we are currently at 7 rentals so there is room for one more. It wasn't until recently that we realized all their emails always would say we are at 7. Last month they said the same thing and we realized this and did a head count and learned that we are at 10 of 17 rentals, over the allowed 8. We have scheduled a meeting with the management company after the holidays to discuss this and what can be done. To add insult to injury the last 2 units to rent are the other 2 HOA members and there is no way they will go along with a vote requiring them to move back into their units. My wife and I are certainly not happy about this. We were actually planning on selling in the spring but now are likely not able to afford a new home as we needed the money from selling the condo. He said ok, but that he needed to see about filling that spot. I never heard back from him about it though. Over the 5 months I've lived here I've met with him plenty of times and spoken with him even more. I've paid my rent to him in cash twice now and none of those times has he asked for the additional $80 that parking cost. But this morning he texted me that I owe him $400 for parking the last 5 months and that he has tried to reach out to me but "the emails must have ended up in spam" I have plenty of email from him about all kinds of things but absolutely nothing from him about my rent being $80 short each month and nothing about parking in general. So my mom passed away when i was 9 and I have been recieving social security my whole life due to illness. My grandparents held that money in an account for me up until the point where I was forced to move with my dad and he took control of these accounts. Not once in my 9 years have I seen a single bank statement until today. I should have upwards off $100,000 if not more and currently there is just over $500 in the account. Reviewing the statement I saw $620 being withdrawaled by my step mother. As I have never seen a statement or check it's obvious they've been kept from me as well ass the $100,000. Please help me!!
