    We are a couple in our 60's with several properties about half of which have mortgages. We both have FICO scores over 850 and have never, ever, missed a mortgage payment in over 30 years.

    We wanted to refinance a vacation property which also rents through a vacation rental organization.

    Our experience with Quicken Rocket Mortgage has been a nightmare. We provided them the key forms of our taxes and they came back with questions like, prove you are a U.S. citizen, prove that you own this or that property. We had provided them our property tax statements, certificates of insurance, etc. AND, these were not even the properties that we were trying to refinance. The amount of foolish make work has been unbelievable. They ask for absolutely irrelevant documentation that has no bearing on our ability to pay for mortgage. Once we provide them the information, they come back and ask for something else.

    Do yourself a favor. DON'T EVER USE QUICKEN LOANS ROCKET MORTGAGE. Save yourself aggravation and time and go with another lender that knows what they are doing.

    Encroachment lawsuit immediately after closing. Needing advise.

    My husband and I are at a loss on what to do in our situation. We live in Oklahoma and closed on our first home a couple weeks ago. The night we moved in, a 24 year old neighbor came over and stated that our entire fence and part of our garage was encroaching on the property next to our and he will be tearing down the fence and our 2 car detached garage very soon. We immediately contacted our realtor who spoke with the title company and they told us not to worry. They said it is in fact our property according to the survey that was done prior and they forwarded that survey.

    We didn't hear anything from the 24 year old for almost two weeks then suddenly we came home and our entire fence was gone alongside of the property. The man told us that we needed to do something with our garage because it would be gone soon. Our realtor told us to file a police report and the police said that it is a civil suit and nothing can be done with them.

    We spoke with an attorney and after compiling information, this 24 year old is a 4 time convicted violent felon who is apparently paying cash under the table to the actual property owner of the house next to us. The attorney is recommending we quiet the title of the home so nothing more can be done and we sue the 24 year old for destruction of property and sue the land owner for the land. Apparently the land was encroaching on his property many years ago, and no one did anything about it so it is now considered our property due to 'adverse possession.' There is a public record showing that date the garage was built 16 years ago and there was a garage in the same place prior to that.

    Does anyone know if we might be able to get out of the home purchase? We have been told because we didn't get a more thorough survey done (besides the one the title company provided) that all our rights were waved and we are stuck with the home.

    We plan on selling the house as soon as the suit is over. We've also been instructed not to talk to the young neighbor because he has a violent past. We are also looking at a lawsuit costing us up to 30k. The house is 100 years old. I am looking for advise from anyone willing to give it. Thank you.

    TL:DR The night we bought a house we were told it is encroaching and we are now looking at a legal battle.

    Suggestions on "unofficial" dog park behind my property

    I live next to a housing development, that has a "common" area with boat slips/docks that backs up to my backyard. The area is fenced in, except for the water frontage. They have signs that all dogs shall be on leashes.

    However, this is not what is practiced. Dogs are allowed/encouraged to run free while in this area. The owners are often at one end of the area while the dogs are loose. The area is about 600x80'.

    I have a dog, and understand the need for them to run and have no problem with them out there during the day. However, these people are not able to self-regulate and they only give us 7 hours of undisturbed sleep at night. They are out there at 10/11:00 at night and at 5 to 6:00 in the morning. I've tried talking to some dog owners individually, but they continue to do their own thing.

    Do you have any suggestions on how to address this? I'm going to start by sending a letter to the HOA president and ask they they enforce their rules. I've never found this to actually be effective, but I have to give it a try.

    My next step is to involve the local animal control, as they are breaking the county rules by allowing dogs to run free on other people's property (each home owner owns a strip of the land). I'm not sure where the line is drawn though since the area is mostly fenced in.

    I'm just looking for other suggestions on how to amicably deal with this.

    PMI removal

    We are getting close to the end point of our PMI, from what I've heard/read. We've been on-time with all our payments, have good credit, etc. etc. The loan was not under FHA, VA, or anything else that we know of. Of course, our loan has changed hands at least 3 times since we bought, and this is our first mortgage so all the details are a bit dizzying.

    Anyway, I just called my lender and they gave us a LTV number of 77.2%. When I brought up the 1998 HOPA, he said it was amended to it being mandatory at 75% and subject to request at 78% (from the original 78% and 80%). I couldn't find anything on the internet to back this up.

    Is this true? Or am I missing something?

    My mortgage was sold before I could make the first payment. What do I need to know?

    I am manly afraid that they'll screw up something with taxes or insurance and I'll get some huge penalty. Or maybe there's new fees, or that the loan terms might not be exactly as they were prior. I was not expecting the loan to be bought so fast. What do I need to know?

    Which Realtor Board Should I Join?

    I recently got my license in Colorado and my office requires me to join a board.

    Here are my options:

    1: SMDRA: South Metro Denver Realtor Association

    www.smdra.com

    2: AAR: Aurora Association of Realtors

    www.auroraassociationofrealtors.com

    3: DMAR: Denver Metro Association of Realtors

    www.dmarealtors.com

    I've looked at each website and the first is $590, the second one doesn't have anything on their website regarding pricing, and the third is $835 in November and progressively gets cheaper every month until October.

    My question is what's the difference and why the difference in prices? Should I just go with the cheapest?

    Seller's agent demanding to see military orders?

    Since I don't know enough about real estate and/or law to effectively Google for this, I figured I'd ask this community. Here's my situation:

    Upon separating from the military, my wife and I tried to buy a house in the Hampton Roads, VA area using the VA loan. Everything was going well until the lender checked income, and due to my wife only having a seasonal job any income she has from her current full-time position won't count because she hasn't had full-time for a year or part-time for two. The income from my job wasn't nearly enough to qualify on my own, so we had to back out of the contract.

    Even though it was written into the contract that if I had to back out for any reason my EMD would be refunded, and both agents were provided the denial letter from the lender, the seller's agent refuses to release my deposit and is demanding to see my separation orders.

    My agent is telling me that even though it's a violation of Privacy Act Laws and she has no reason to need them, she isn't letting the issue go.

    What should my next steps be?

    Does a title deed have the address of the owner, or just the address of the property?

    If the owner wanted to change that address in those records, how would they go about it?

    [Question] Looking for a small real estate management software for 5-7 commercial Units/Residential

    Hi Guys,

    I'm looking for a small real estate management software that can keep track of leases, rent increases, has payment portal for tenants and easy to use. I've looked into Appfolio but they said the minimum units they will do is 50, which is way above the amount I'm managing.

    Do any of you real estate managers have a background that can speak to a smaller property manager? Please let me know thanks!

    Licensure and criminal history

    I decided I wanted to get my real estate license as I have friends that have been successful and offered to help me. I have a DWI from 2011, and I have a felony theft of a firearm, it is not a conviction because of Deferred Ajudication, technically the case was dismissed but it still pops up in a background check.

    Before I spend all this money on the courses and exams, how will I know if I'm eligible?

    We’re having a realtor over on Thursday to discuss selling our house. What are red flags that I should look for?

    Hi all! So we did decide that we're going to go through with moving, and my husband called a realtor he worked with in his former career. She's coming by on Thursday to talk, and I want to know what red flags I should be wary of. I know my husband knows the woman, but we didn't have a stellar experience with our realtor when we built our house. Thankfully the builder paid her.

    What fees would be exorbitant/superfluous?

    What should I expect to pay a listing agent? Is it 6%? 3%? More or less than that? 6% is over $20,000 so that's a little tough to swallow! I know that a good realtor is worth every penny, but since this is the first house we've ever owned, I don't want to get ripped off. :)

    What should a good realtor do to get our house sold? I'm afraid that it'll get thrown on the MLS and we'll be forgotten about.

    Thank you for all your help. I'm new to this. At this stage of my life, I feel so should know, but I just don't.

    Buying a home (1982) that had shingle roof replaced with tile by prior owner. No documentation, warranty, engineering review, etc.

    My home inspector suggested I talk to the prior owner about the roof because not all roofs are build to support the additional weight but the current owners know nothing about it. Ive talked to some engineers and they want to do a full analysis of the entire truss system to be sure it can hold the weight and that costs over a grand and takes 4 weeks.

    There is no permit either. I found one permit for the home and that was to install a big workshop in the backyard. The home also has a large addition that "should" have a permit but that was also built before the current owner. My city permit search only seems to go back to 2004 and after talking to a neighbor the addition was done in the 90's. I dont fear the addition too much because the square footage IS included in the tax accessor's info on the plot.

    So that leaves the roof. I know that it was installed at least before 2012 and hasn't collapsed so far haha. Should I pay for the engineering work and try to extend the inspection period another month/try to add some contingency that the sale depends on the results? Should I try to get the owner to get an engineer to sign off on it/repair as needed? Should I just chill out and buy the house?

    Can you add an extra bed/bath to a listing if the basement is finished?

    I'm thinking about finishing a basement. Are there any rules that prevent me from adding a finished basement bedroom/bathroom to a MLS or zillow listing?

    E.g. i have a 3 bed 3 bath house. if i finish the basement with an egress window and a full bath, can i then list the house as a 4 bed 4 bath?

    Rental Agreement Questions

    Hello! I have a questions regarding my "rental agreement" with my landlord. At the end of July 2018, I signed a rental agreement to move in to my apartment that Labor day weekend. On the agreement he wrote what date he requested the security deposit by, that this amendment A would be made legal part of the document and some notes about the pet policy. There were also who is responsible for utilities and such but that is not super important for my question.

    I have been here now for little over a year and the third family on the other side of this house will be moving out with in the next week or so. This is a house that he attempted to make in to a two unit apartment, but the walls are so thin. The first family complained about my dog barking during the day while I was at work. I was told get out or get rid of the dog. So unfortunately at the time getting rid of the dog was the best choice. He did go back to where we moved out of, so he was really familiar with the place. Then they moved out and the second family was a bunch of druggies. They didn't last long and now this family has only been here for 3 months and were supposed to be out yesterday due to "health" issues.

    Well I have had enough of the thin walls and decided I want to move out. I have been miserable ever since I had to let my pupper go. I talked to my land lord and he informed me that there is a "winter clause" in my "lease". Ok fine, whatever, he insisted he would put it up and try to find someone before December 1st. So I could move out.

    Now finally to my question. The rental agreement that I mentioned at the beginning DOES NOT have a beginning or ending date. All it has is a 12, my guess indicating that it was supposed to be when we signed. But when September rolled around this year, I never got a renewal or anything. And I sure did expect to get one! Well he still hasn't put the apartment up for rent. But I am super curious as to why no beginning or ending date. Is this still a legit legal agreement?

    Any help would be great!! Thanks soooo much ahead of time and apologize for my ramblings! I'm a bit stressed about all this at the moment

    hoa and selling q

    Hi I'm wondering if there is a very difficult hoa and it takes forever to get things done, would that ever prevent someone from being able to sell in a desirable neighborhood? or are most hoa's difficult / have one person who never agrees to stuff etc?

    Any stories or experience from such a thing?

    What happens when nothing happened on closing date?

    Friend is selling a house in PA. Personally we feel agents on both sides perhaps were too eager to make a deal, because:

    1. Agent talked my friend into increasing the list price (relevant later), and then increased seller assist from 5% to 6% without first discussing it with her. She let it go in the interest of not derailing the deal.
    2. Inspection found detached garage to be unsafe, but her agent brushed it under saying buyer "found a way to take care of it without payment from anyone."
    3. Talked her into letting buyer pay for some mold removal, way before closing. No separate contract on that.
    4. Told her nothing about result of the lender appraisal, which we later learned came about 2-3K under due to garage, around the same as the increase in #1.
    5. Literally night before originally scheduled closing agent told my friend closing company is missing some appraisal documents. She then agreed to a postponement.
    6. Few days before new closing date, structural engineer was sent to look at the garage, and confirmed it had to be torn down. Agent then wanted my friend to lower the list price, and threw in some fee reductions to try to convince her, but claimed that she would be "legally responsible" if she didn't "let the sale go through." I couldn't find anything that suggests this in the pretty standard contract (example). Seller is not obligated to reduce the price both party had already signed on. Garage issue is also preexisting, so they can't claim it failed per the maintenance and risk of loss clause, and even if so, she is not obligated to repair it or give credit to buyer. Far's I can see it's entirely up to the buyer on whether he wants to back out or not, if my friend refuses to change the terms of the existing contract.

    After all that, my question is, given that the closing date is today, and no postponement has been proposed, is the contract now void?

    Update: Friend signed agreement to terminate under mortgage contingency releasing the hand money to the buyer. Thanks for all the comments.

    Need help with changes to a house's deed!

    When my wife and I were buying a house, my credit wasn't the best. My in-laws helped us get approved and father in law's name is on the deed. Father in law now wants his name off of deed and credit. What kind of company or lawyer do we use to remove his name from the deed and against his credit and get it switched to my name and credit. Is this possible without refinancing? Thanks for any help!

    Putting a house in my name that isn't "mine."

    I am a carpenter by trade, and as such I have been presented with a business opportunity to partially own a home where my investment would be sweat equity and theirs would be the upfront capital for the purchase and repairs. The house is to be purchased outright in cash, so there will not be a mortgage payment with money owed to the bank. My partner is requesting that the house be put in my name. What are some potential risks here? Why would he request this? Is this cause for concern?

    Can I get my Ernest money after option period due to finding asbestos?

    Exclusive rental agreement

    I am a NY realtor and in discussion with a landlord for a potential exclusive unit to rent.

    My firm s agreement states a few things but including a sales clause which states :

    "If the Premises is sold during the Term of this Agreement, or if a tenant procured by Broker, or such tenant's affiliate, enters into a sales contract to purchase the Premises within 6 months after the expiration of the lease term or extension thereof you agree to pay Broker a commission of 6% of the sales price, payable in full at closing of title. If you retain a purchase deposit, you agree to pay Broker a commission of 6% of the amount retained. The provision shall survive termination of this Agreement."

    This has the landlord started questioning about the credibility of my brokerage and asking why Sales clause is in a rental agreement.

    Is this term normal?
