[CT] daughter is suspended from school for 2 weeks and school will only let her back if she gets unnecessary therapy update

    Posted: 04 Oct 2019 10:25 AM PDT

Hi everyone, thanks for your responses to my last post.

After I read everything, I called and emailed the superintendent describing what had happened. I got a call back almost immediately and after I explained the situation, the superintendent told me that she had to call the principal, but there was no way my daughter was suspended for 2 weeks. Got a call about an hour later letting me know that my daughter could come back to school the next day but would be placed in a different class. I received apologies from the district and from the principal himself, though I figure that's probably not a genuine apology, but whatever. Thanks for your help!

My tenant cut down trees in my yard. Including my apple tree

    Posted: 03 Oct 2019 09:36 PM PDT

    We live in BC Canada.

    So here's the story.

Renters moved in May 15. They asked that we take the house off the market, they will sign a two year lease and pay $2000 a month, $100 more than we were asking for. Immediately they were late paying rent and since then, have not paid rent on time once. Numerous messages every month with excuses as to why rent couldn't be paid on time. June 7 he asked me to pay someone to care for the yard because they couldn't afford a lawn mower. I reminded them that it was in the rental agreement that they care for the yard because we are 10 hours away and that we need a somewhat self sufficient tenant. More months of late rent and complaints about small issues which we immediately attended to by sending someone in (furnace filter needed changing, toilet ring needed replacing in both bathrooms, dryer needed to be cleaned)

July 21 he messages me about pruning the trees and cutting and getting rid of them. I clearly stated in text that he was not allowed to cut the trees down.

Sept 14 we have friends come visit and tell us our grass is about 3 feet tall so I send this message to my tenant "Hey Chris, could you please now the lawn or at least pay someone to mow it and clean it up. Just got a call from a neighbor concerned that the place isn't being cared for. Said the lawn was out of control"

He proceeds to bitch that the yard has been a disaster since he moved in in the spring and that he shouldn't have to do a dump run for the garbage in the yard. The "garbage" I explained were painted decorative tires for growing potatoes with the garden and if he wasn't going to use them he could store them in one of the 3 sheds but to not throw them out.

Today Oct 3 he sends me pictures saying he cleaned up the yard and I see that my apple tree in the front yard is missing and the choke cherry tree in the back yard is also missing. He did NOT have permission to cut them down, I explained this to him and he says "I did not touch either of the big trees anymore than I showed you a couple of months ago and you had no problem then. If you are not happy I apologize but you told me to deal with the yard so I dealt with it so that I was happy with the way the yard looked. Sorry we didn't know the tree in the front yard was to stay. We checked it and it hadn't produced anything. "

We pruned the apple tree end of last summer so of course it won't produce apples this season!!

Now he is trying to get out of his lease by telling me to evict him but I want repayment for my trees. It was stated in the least that they weren't allowed to remove any permanent fixtures pertaining to the property without written consent from us.

    What can I do????

I paid off my car 6 months ago, have full title but my car was "repossessed"/stolen last week.

    Posted: 04 Oct 2019 10:19 AM PDT

I apologize for the wrong flair probably, no idea what to put.

So 4 years ago I bought a new car, originally financed through Ford Financial Services. I came into some cash 6 months ago and decided to use it to pay off the car and a few other debts I had to lower my monthly money out. I received the title, all was good until last week.

Woke up to my car being gone, first I called my father who has a spare key to the car to see if for some reason he took the car without telling me and he didn't. I called the cops who came out and they informed me they were notified of a repossession on the car and told me which tow/recovery company called in the car.

I called them up and they tell me sorry, not their problem they have all the paperwork from the finance company (Different bank, not even Ford Financial). So I start calling the bank who was never involved with my car or the loan and they tell me I'm outstanding by over 5 months non-payment. I send them a copy of the title and tell them I paid the car off 6 months ago. They dont care.

The police won't let me file a stolen vehicle report because the tow company sent them all the repossession paperwork (paperwork that they won't provide to me).

I called Ford and they tell me they closed out the loan upon receiving my payment and sent me the title. I asked them to send me some sort of paperwork to show I paid off the loan and they said they can mail it to me. This helps me possibly but a couple days ago I received a 10 day letter notice that my car is going to auction and where to retrieve property that was left in the car.

I feel like I'm in the twilight zone because some random bank never associated with my loan has effectively stolen my car legally and is going to auction it.

What do I do here? I can't file a stolen vehicle report because of the repossession paperwork, can I just show up to the auction with the title and take my car with the keys I have since its effectively my car because I have the title or will that cause an issue?

I live in Texas, the auto auction yard is literally like 2 miles from me and I've gone and seen my car sitting out back. If I go take it is it going to cause me potential legal issues? I don't see how because it's my car

I (European) got arrested in Arizona and didn't show up for the court date. Now what?

    Posted: 04 Oct 2019 06:25 AM PDT

    (Throwaway account)

About ten years ago my SO and I, both from Europe, were travelling with backpack in USA. At one stage we decided to travel from the west coast to the east coast, and ended up sneaking onto a cargo train going eastward from San Bernardino, California (It was an adventure after all..). We hid on the train for about a day, and in the evening we went to sleep in our sleeping bags. But, during the night we were abruptly waken by a police officer with a flashlight. The train had stopped in some small desert town in Arizona, and judging by the way the police offer was handling it, it was not a uncommon thing for him to find european kids in sleeping bags on cargo trains.

He cuffed us and brought us in to the police station, where he registered our personal details, took our mugshots and told us that we had to show up in court about a month later. All in all he was really nice about it, we politely answered all his questions, and he let us go as soon as he had filled out the paperwork.

The thing was though, that we had return tickets to Europe about two weeks later, and it was not possible for us to change the return date or buy new tickets to stay a month in a small town in Arizona waiting to go to court. So in the end we decided to just leave the country and return to Europe and not show up in court.

Recently I became aware that I have a warrant in Arizona, with the following registrations:
    1 CRIM TRESP 3RD DEG
2 VIOLATION OF PROMISE TO APPEAR

How do I go about getting this sorted out? It is not possible for me to go to the US to appear in court, is there some other way I can get in touch with the court and get any fines paid?

[MN] Unable to access 12 year old daughters health account online. I call and they tell me I cannot because now that she's 12 she needs to consent and allow me to access her medical records.

    Posted: 04 Oct 2019 07:06 AM PDT

I've been trying to reschedule a vaccine and couldn't online. I called today and some lady answered and said pretty much what my title said. Apparently, in MN, once a child is 12 they need to sign and give consent to the parents to do anything medically related to them. I questioned this as it sounds moronic, and the lady simply said "maybe you should try googling emancipation laws in MN".

After the phone call I did I all I can see is that if a child is emancipated they have certain rights. But she's not emancipated - she's in 7th grade ffs.

    Does this make sense?

My father passed away in August and not one of his four children have been notified.

    Posted: 04 Oct 2019 12:05 PM PDT

Hi! I apologize ahead of time for formatting I'm on mobile. I have not been in contact with my father for several years. He was living in Puerto Rico until the hurricane and I was able to confirm with extended family that he and my Aunt moved to Florida. He left property he owned in Puerto Rico. I am one of 4 siblings and none of us have met but me and my brother Sam are in contact now. Sam heard about his death from a neighbor of our fathers after he had already had a viewing and burial. My aunt has made no attempt to contact us and ignores all of our attempts to reach out to her. I can not find any obituary, property tax records in Puerto Rico or any evidence he existed or died. I'm not sure what my options are moving forward. Florida Vital records says I need to be there in person with ID ( I live in Maine) or use vital statistics online but we dont have a date of death even for me to request the death certificate. I spoke with someone at the Supreme Court in Puerto Rico but she said they need a death certificate before they can tell us anything. Can anyone suggest what I do next?

University Wrongly Keeps Saying I'm Out of School and Won't Change It, Loans Want Repayment (MD)

    Posted: 04 Oct 2019 05:38 AM PDT

Hi everyone, I live in Maryland.

I am currently in graduate school in Maryland (in-state), and I have federal loans from undergrad (also in-state) as well as grad school. I have two subsidized loans from undergrad, and 4 unsubsidized loans from both undergrad and grad school. The total amount of money I owe from my federal loans is about $43,000, so you can see why I need to wait until I graduate to pay. I owe about $8000 in private loans, but my private loans surprisingly have been easier to deal with resolving my issue, as explained below.

My current issue: I am in a dual degree program, where I earn a Masters after 1 year of classes (30 credits) and then a Certificate of Advanced Study after 2 more years of class (36 credits). This is my first semester of the CAS and I have two more years before I actually separate from my university. To obtain our Masters and "move into" the CAS program, we had to apply for graduation of our Masters. This has always been the case for my program, and they have never had this issue until THIS year. Even though I am enrolled full-time (and have always been enrolled full-time!!!) and even work for the school as a Graduate Assistant, my university keeps sending out to a third-party company (Clearinghouse) that I am not a student anymore. Clearinghouse continues to notify my federal and private loans that I am no longer in school. I have filled out 4 Enrollment Verification forms in the last two months; my private loans accept this. But my federal loan distributor (MOHELA) does not accept these forms and will only accept Clearinghouse's report, which is wrong. **I am not the only person in my cohort having this problem, everyone with federal loans is facing the same issue.**

I have called MOHELA about this, and they questioned why my university is not fixing this issue. I have called my university 4 times and they have not fixed the issue. My program director has spoken to them and they have not fixed this issue. I have filled out an In School Deferment form for my university to fill out and send to MOHELA; it still has not been processed despite this being weeks ago. My last resort is to fill out paperwork with MOHELA proving that I am in "hardship" and do not have enough income to pay my loans, thus making my monthly bill $0. First, I don't think I should do this since I am literally IN SCHOOL. Second, I don't want to do this because my subsidized loans are going to start accruing interest because it "looks" like I'm not in school when I am; therefore, I will be required to pay back interest that I was promised would not accrue while enrolled.

I have to start paying back this February. I'm extremely stressed. My subsidized loans are about to start accruing interest that I'm not supposed to be paying. I literally don't know what to do. If someone can please direct me on the right path of what to do, I would appreciate it. Please let me know if you require more information to help. I want to know if there anything legally that I can do to stop this.

Update: I sent a lengthy factual email to all Maryland's delegates and senators and one of the delegates immediately responded asking if she can forward my email to her contact at my university to ask if they will fix it. While it's not resolved, I just wanted to say I appreciate all of the advice!

HOA past dues from before HOA exisited

    Posted: 04 Oct 2019 07:01 AM PDT

For the first few years in my subdivision the builder collected dues made out to his company. We all find out a few years he never registered a HOA with the county. Now the trustees have sent me a bill for past dues missed and saying if I dont pay they will take legal action. Can I owe money to an HOA that didn't exist? In Jefferson County, Missouri.

Our daughter (1.5 F) was hurt while throwing a massive tantrum at daycare. We suspect something more happened. [AZ]

    Posted: 04 Oct 2019 11:49 AM PDT

This might be a little long, but I am so lost and have no idea what to do.

I started a new job 2 weeks ago, and Nora started daycare. All has been well. She had a couple days where she was fussy, but she adjusted well.

    Until yesterday.

I got a call at work around 2 pm. The daycare employee sounded absolutely terrified. She said, "She's okay. But she woke up from a dead sleep screaming and thrashing and throwing herself on the ground. She's scratching herself, pulling her own hair and ears and lips. I've never seen anything like this and it's not normal. She's been doing this for about 30 minutes and we can't get her to calm down. We think she might be in pain or something, but we can't tell." After a minute or 2 of talking with her she said Our daughter is now fine and calmed down in the director's lap.

So of course I leave work early and rush to the daycare as fast as I can. My husband meets me there. She is absolutely fine and is playing with toys at this point. But the teachers looked off. Like they looked worried when they saw us. We go see our daughter and her whole side of her cheek is raw (we think rug burn) and she has a bruise underneath her eye, as well as some obviously self inflicted scratches.

So from the daycare we leave and go straight to the pediatrician who didn't see a thing wrong with her. We made sure to take pictures of any marks she had too.

The issue is when my husband went back to the daycare to speak with them about what happened, not one employee could tell us how exactly she hurt her cheek or anything. They admitted that there was a 20 minute lapse in where they didn't know what she was doing. She was just tantruming alone on the floor with no supervision to make sure she wouldn't hurt herself. She's been known to have breath holding spells so when she gets really worked up, she'll hold her breath for so long she'll lose consciousness for a few seconds and then will come back. My theory is that this is what happened, and they didn't want to call 911 since she had come to and seemed fine.

She's a toddler, so I expect to see bumps and bruises and scraped knees. But her entire cheek and next to her eye are raw, as well as the bruise underneath of her eye, and no one can tell me what happened for an entire 20 minutes. They just ignored her and let her tantrum while hurting herself, and that seems incredibly alarming to me.

There are cameras in each room, but they are on a controlled circuit and apparently only corporate has access to them. We intend to go speak with them tonight about seeing the footage, and if they do not allow us then we plan on at least speaking with a lawyer.

My question is, would this be worthy of getting a lawyer, or am I being an over concerned parent? What would our next steps be if we decided to get a lawyer?

Pulled over and ticketed for non possess of insurance card on rental car

    Posted: 04 Oct 2019 09:31 AM PDT

So earlier this week wife was driving a rental on a New Jersey freeway and was pulled over due to a report of similar car model involved in a hit-and-run. Everything went very well until the police officer asked for rental car document and found an expired insurance document, dated 3 months ago.

Wife offered our own insurance card, which is current and with full coverage, the officer declined to read. Wife also offered our paid credit card premium rental insurance record, which is a primary rental car coverage prior than our own insurance, the officer declined to read. The officer issued a ticket for non possess of insurance card and summon her to court or we can plead guilty and pay the fine.

The rental car company is one of the largest rental company in US, and they just forgot to put the new insurance card in. Wife took the new card from rental company the next day and submitted to the court office.

I suspect the officer did it wrong, and I'm looking for a dismiss from the judge. What do we need to do to make that happen? What are the things that we need to prepare to win the case? We never had a ticket or went to court, any help is appreciated.

Court served me with paperwork that didnt notify me of my next court date and I missed a hearing.

    Posted: 04 Oct 2019 08:58 AM PDT

So I was served with a summons last week and I read it through. It stated that the date was "to be set in future entry." I called the clerks office and didnt get an answer so I left a message. I never recieved a call back and I went into the courthouse (which was located out of town) two days later and got everything straightened out. Turns out I missed a hearing that was scheduled on October 1st to establish is visitations(its a custody battle) which I missed by two days. I was never notified of that hearing and was unaware of it. They granted him weekly visitations because I didnt show to show my evidence.

How do I go about disputing this? I feel like it was a mistake on the courts clerk. I'm located in Ohio, USA.

I have text messages on my "dumb phone" that are pivotal to my small claims case and I can't get them off. Can I just type them by hand onto a word document and bring the phone to court as well? (small claims, California)

    Posted: 04 Oct 2019 08:21 AM PDT

I have to sue a guy who stole a lot of valuble cards from me. My text messages contain all of this info and confirm it 100%; however, I can't screen shot these as they are on an old flip phone. Can I copy them onto a word document and also bring the phone to court as proof as well? Would I need to notorize the copy I make? I've never sued anyone before and quite illiterate in this whole process.

[Las Vegas, NV] I have legal guardianship of my brother. His new HS Football Coach is demanding details about why he isn't with his mother.

    Posted: 04 Oct 2019 10:43 AM PDT

I (30m) recently won full legal and physical guardianship of my little brother (14m) through family courts. Without going into too much detail, our mother is one of the worst people alive and the judge agreed.

This year is his first year with me and his first year in his current HS. He signed up for the football team and the coach; after seeing that he lived with me, demanded that my brother write him a paper explaining why he isn't living with his mother and the nature of his relationship with me.

I don't know what this has to do with being on a football team. Nor do I feel like it's anyone's business but ours what happened in court and why it happened. If my brother is happy under my roof and I have all the proper paperwork signed by a judge saying that I am the legal guardian, that is the end of the story. Is this even legal? What if the coach retaliates and doesn't allow my brother to play?

    Advice?

Defendant in small claim threatening to move case to district court

    Posted: 04 Oct 2019 09:51 AM PDT

    Ill keep this short.

The defendant was visiting Michigan from California, and damaged my car while here. At the time they agreed to pay but are no longer willing after hearing the cost to repair is $1500.

I successfully served via certified mail.

The defendant then said they would settle for $500 and threatened to move the case to district court if I don't agree to the amount, and that "we would both need to hire lawyers".

Can he move the case to a district court?

Would the district court be in the same state as the small claim court?

    Would I need a lawyer?

    Thanks!

May have created something that a company is now using, what are my options?

    Posted: 04 Oct 2019 01:18 AM PDT

    I'm located in California, USA.

So, many years ago, I produced a piece of fan-created content for a series of products which I posted on the web, and subsequently blew up outside of my purview. It had a specific title which was simple but effective, and I still enjoy searching Google from time to time to see where my content ended up. Dozens and dozens of hits, to this day, with new ones every time I look. None of them link back to me, of course, and the account I posted the content to the web with has since been deactivated.

Flash forward, and a very large company is putting out a new product for the same series. Their tagline, slogan, whatever is the title of my fan-created content, and is almost (though not quite) the tagline I used within the content itself. I have since reviewed my own records, and found emails with WIP versions of the content as well as the finished product dating back to when I originally created it to prove that I was the original creator.

Do I have any options here?

    UPDATE: Neighbor removing Mezuzah.

    Posted: 04 Oct 2019 02:45 PM PDT

NYC. First, I would like to thank everyone for the good advice (except for the person who messaged me telling me I wasn't a Jew since I'm a lesbian. You stink).

What happened was not very exciting. I again emailed my landlord, telling him that the Mezuzah has been destroyed and that my girlfriend and I were considering filing a police report if this occurred again. I also went over to my neighbor directly, told him exactly what a Mezuzah was, what him destroying it meant and that if it happened again the police would be involved. I don't know if that did the trick or the landlord talked to him again but it's been up for a week with no issue, and he said "sorry" when my girlfriend saw him in the laundry room. Don't know if that was directly related to this but I'll take it.

Thanks again for the advice. Just a quick aside, after the post was locked I got MANY personal messages telling me to contact the Shomrim. I have been spit on by Shomrim in Williamsburg because I wasn't dressed frum or holding hands with my girlfriend and they have a troubling history regarding cases in which they have beaten black men. I doubt they'd help me, and I think people should evaluate if they're truly the best course of action.

(GA) Landlord trying to void lease due to a favorable addendum to tenant.

    Posted: 04 Oct 2019 05:15 AM PDT

City in Question is Atlanta if that matters. About a month ago a resigned a new lease at my current apartment complex that I had been residing at for over a year. When I originally moved in a year ago, the apartment agency was offering a special for $500 off October Rent because I was a new tenant (but the language of the terms simply said "Special: $500 Off October Rent. This Addendum only applies during the initial term of the Lease unless specifically extended by agreement under any renewal or extension of the Lease).

Well when it came for me to resign a new lease, in addition to adding my girlfriend to the lease, the apartment complex kept the language of the $500 Off October Rent. Since it was a new lease, I assumed they were offering me the same special that they did originally, and signed the new lease along with my girlfriend for the upcoming year (Oct 2019 - Oct 2020). The Property Manager signed this lease as well a few days later. And we were all sent a final copy to download with the addendum still in place (with the exact same language above, only difference were the dates were made current from last year).

A month passes and when I went to pay my rent yesterday, I noticed that $500 was not subtracted from my rent, I emailed in inquiry about it, and physically went into the office before the end of the day because they never got around to responding to me. I spoke to my leasing agent about the issue, and showed her the relevant language in the lease agreement. She got her superior who said that they would not be honoring that language in the contract, and that they would need to void my contract and I would need to sign a new one. I stated that it wouldn't make much sense to me to sign a new contract because the slip up seems to be our their end. The Supervisor said that we would have to talk to the Community Manager (CM) in charge of the property to see if she would allow it, but doubted that she would.

Sure enough, the Community Manager told me that this was a mistake in the contract that they would not honor. The CM then said because the lease had "gone into effect yet" they would be able to void it and make me sign a new one (because the technical dates from my old lease were from 10/9/2018 - 10/8/2019, with the new dates being 10/9/2019 - 10/8/2020. However, the general provisions of the lease state "The lease is legally effective on the date it is signed, regardless of whether it was signed before or after the Resident moves into the apartment").

After pointing this out the CM said that it did not matter, that they would not be honoring the addendum in the lease, and that we could go back and forth as much as I wanted, but ultimately I would need to sign a new contract for new terms of lease. I replied that I did not want to sign a new lease, and made up an excuse for needing to leave to review the lease myself. I read the wiki and know that this sub doesn't help with contract interpretation, but really I just want to know if they would have any right to cancel my lease to attempt to make me sign a new one because of a mistake on their part, and would I have any ability to recoup this $500 later down the line? I probably don't want to ruffle any feathers because I'm currently living here and would prefer not to move, but I wouldn't mind going to course over this later when I plan on moving out.

Appreciate any help on the matter, I just kind of rambled on about the parts of this I thought were important, and can provide any extra details to clarify anything.

My grieving mother was verbally assaulted by a loss prevention employee and now the management is denying that anything malicious occurred. What can my family do?

    Posted: 04 Oct 2019 09:17 AM PDT

My father passed away less than a week ago, and we as a family were unprepared for a funeral and needed to shop for clothes. In the course of shopping my mother went outside -- without her purse -- to grab her store savings card from the car. A loss prevention employee and what we assume was a witness proceeded to verbally berate my mother and threaten her with police intervention. She insisted that my mother had stolen a pair of earrings, citing video evidence. My mother was bought back inside where she was aggressively forced (not physically) to empty her pockets and purse. She begged the employee to stop yelling, and repeatedly explained that she had just lost a loved one, but the employee maintained that she was lying. At this point my mother is on the floor crying, and the employee is still yelling at her. A family friend, who was shopping with my mother, eventually found the earrings in their shopping cart, which by the way, she had been holding in line at the register. The employee let off my mom, but never apologized. We asked to see the recording of my mom supposedly stealing, but the employee argued that she herself had to go into the room alone with the employee to see it. Given what she had just been through, she obviously did not want to be alone with this woman, so she ended up letting it go. A cashier who had seen what happened did write down the employee's name for us though.

The next day we went back to the store and asked to speak to a manager. The manager directly denied that anything like what we described had occurred on the part of their employee. The witness, who had stayed silent through the whole ordeal before, also sided with the employee and lied about what happened. Again we asked to see the video footage of the situation and the manager said that they couldn't allow us to watch it unless my mother went into the room alone with an employee. We asked for a written note of our complaint and a guarantee that the video wouldn't be deleted, which the manager refused to provide.

I've never personally experienced a customer being treated this way, and I want to know what we can do in this situation. I would like an apology, hopefully public, and if possible I really feel as though that employee deserves remedial training at the least.

By the way, the earrings were only $10 dollars, this was not a high stakes situation.

Edit: Just read the location requirement: We are in Tennessee

Wife bringing boyfriend on to my property

    Posted: 04 Oct 2019 08:55 AM PDT

I have asked my soon to be ex wife several times not to bring her new live in lover on to my property several times she is insistent on doing so. The property in question was our mutual house whose deed is currently in both of our names. She moved out to be with the person in question and when the divorce is finalized per agreement I will be keeping the house. What legal recourse if any do I have to keep him off of the property? She is insistent that since her name is on the deed she can bring whoever she wants onto the property till the divorce is final.

Daughter abruptly moved across country and left us with her 2 year old

    Posted: 04 Oct 2019 09:37 AM PDT

In SW Washington State, US. I[ll spare the details, but long and short, my step daughter packed a bag, and despite our pleading and offers and efforts already being put in place to help, left for Virginia to be with her girlfriend and left her 2 year old daughter in our care. Fortunately, my stepdaughter had an apartment very close to our place and my granddaughter has spent a lot of time here with us and my school aged children. The adjustment hasn't been too traumatic in that sense, however its had its impact in our work schedules, and of course having to plan child care, diapers, and all of the other things a toddler requires.

My stepdaughter prior to leaving had indicated to us that she didn't think she could be a good mother to her daughter as well as lied to us outright about the reason for going to Virginia. She was gone within 12 hours of telling us she was leaving and hasnt given any indication of a return date. Her girlfriend told us she would be staying with her and her family for a short time before moving in with a friend in the area while she looked for a job. I don't expect a return any time soon honestly.

The shock is wearing off and we are settling into our new normal. We have support from other friends and family, and are giving priority to her needs. Now we need to get our ducks in a row so we can make sure we're doing what we can to take care of her. We can't afford a lawyer, but not exactly sure what we need to do to get legal guardianship/custody so we can get her under my health insurance and to make decisions for her. We have an address to send my stepdaughter paperwork, but part of me feels she'll flake on signing them and we'll be stuck. The baby's birth certificate doesn't list a father (long story there and she won't cop to who the real father is), so that could be a complication. We have an idea of one possibility, but no way to get in touch with him.

Looking for an suggestions or advice to approach this so we can do what is in the best interest of our granddaughter. Thanks Redditors!

Unnamed Individual kept my tax refund that I accidentally deposited into their account.

    Posted: 04 Oct 2019 10:43 AM PDT

(I live in CT, I don't know where John Doe lives) I entered the wrong account information to the IRS last spring. I noticed the error within days, I spoke to BofA and they said it wasn't on them because I incorrectly entered the account number. I spoke to the IRS and they put a trace on the deposit, but after 90 days they were unable to do anything because there were insufficient funds in the account to pull the money back. I've filed a police report in the town I live in, per a previous post's suggestion, but they were not helpful at all. I've reached out to a few different lawyers, but no one will touch it because it's 'only' $2000 and the fees would be more than the amount I'd recover. Obviously, BofA won't give me the name tied to the account. The IRS will not provide me with that information either. I've sent an email to the CT AG's office, no response.

How do I proceed from here? I have no idea what steps I need to take, please help! Thanks in advance : )

Wondering if I get a restraining order for a kind of death threat-Oregon

    Posted: 04 Oct 2019 01:18 PM PDT

Background on this is that my Schizophrenic cousin recently sent me emails that had a kind of death threat. The reason I say this is a kind of death threat is that he believes he will rule the world one day because of reasons I will not go into. Anyways the exact quote is something along the lines of one day I will legally execute your family. And I know that he means this because he very obviously believes I have betrayed him or something of the like. I have some pictures of this that I can link if needed to show the gravity of it. But since he's schizophrenic and I'm pretty sure he's going to be kicked out of his parents household soon since they are retiring soon and I believe he may be crazy enough to come after me so I'm wondering if this is reasonable enough to be considered harassment or intimidation. Another thing though is that he currently lives in the state of washington so how would that effect it.

I earned a bonus I applied for before starting maternity leave. HR will not pay me the bonus until I return to work. Is this legal?

    Posted: 04 Oct 2019 11:50 AM PDT

I'm currently on short-term disability and state family/medical leave and have received 2 paychecks containing STD funds thus far. I applied for a merit-based bonus during my pregnancy when I was working in my regular capacity. Upon submitting the application, I asked my superior if maternity leave would impact the receipt of my bonus and was verbally told it would not be a problem. My eligibility for the bonus was determined by a third-party panel, which did not award the bonus until I was 3.5 weeks into my leave.

When the bonus did not post on my most recent paycheck, I contacted the same supervisor who said "no problem" to discover why. The supervisor did not have an answer, so they escalated the issue to my institution's HR payroll liaison. The payroll liaison informed my supervisor and I that I will not receive my bonus until I return from leave because "when [an employee] is on leave, the system will only pay leave." I responded with the information I have provided here, indicating that this contradicted what I was told by my supervisor. I asked either my supervisor or the payroll liaison to provide me with this policy in writing, as there is no mention of it in the institution's HR policies I can access online. My supervisor apologized and said they were unaware of any such policies and referred the matter to the payroll liaison, from whom I am still awaiting a response.

tl;dr Is it legal for an employer to withhold a employee's bonus that was applied for and technically earned prior to taking STD and/or FMLA until the employee returns to work?
