I paid the full months rent on the first, but found a new tenant that signed a lease and moved in on the 7th. She never returned the security deposit (or sent an itemized list of deductions) and kept the full amount of rent. I am taking her to small claims court and am under the impression that it is unlawful to charge two separate entities rent for the same location, but can't find the statute where that is defined. I've been in country now for almost 5 months. I gave my parents power of attorney since I've been here to handle my bills and other responsibilities since being gone (there are times where I have no internet or means of communication). On March 31st if this year, I (legally) withdrew early from my lease due to a last minute military activation/deployment. I moved out of my apartment and left it in good condition. The landlord walked around and actually helped me move out. I gave her some furniture and belongings to reward her for helping me. She mentioned the paint had some blemishes that weren't there before I moved in, but she verbally agreed that she would just keep my deposit of $250 and call it good. No mention of anything else. Flash forward to a few days ago (August 22nd), almost 5 months after I moved out. My parents told me that I got a letter in the mail from a collection company. The landlord sent a $1,000 bill to collections claiming there was damage to the paint. She never sent me an itemized bill and never tried contacting my parents to inform me of the damage. It went straight to collections. She knew I would not be able to be contacted due to my deployment. Can she do this? Will this affect my credit? How can I fight it? My parents sent a certified letter to the collection company stating that they would like to dispute the charge due to the circumstances. She never sent me or my parents a bill or anything. Posted: 27 Aug 2019 11:36 AM PDT This is a follow up to my previous post where I suspected my Cold Stone manager was getting tips from the tip pool. Circumstances have changed, and I need new advice! To recap my original post, I was told by a shift lead, and eventually by later employees that the manager took a greater percentage of tips than anyone else from the tip pool. Tips are counted by shift leads or the manager, and are then added to our paychecks by the owner. Basic, "crew member" employees aren't allowed to count or handle tips. I was told by friends, as well as those in the comments of my previous post, that the manager taking from the tip pool was certainly illegal. I was then told on Friday by the "assistant" manager that the owners had a tip withholding system, where an unspecified portion of tips earned during that pay period would be withheld from your paycheck and stored in a pool over your head until you worked at the store for six months and were "adequately trained." He said that if you quit, or were fired, before the six months was up, you wouldn't be getting that portion of your tip money. That last part there really sent me over the edge. That night, I mistakenly lost my temper and spoke pretty frankly about my feelings towards the owners tip policies with my co workers. They seemed very much in agreement that the policies were bullshit, and unfair. But they argued that they were still legal because the manager was serving costumer so she could get tips from the pool like anyone else. I argued with them that it was not legal and against the law, and I showed them the regulations from the Department of Labor and Industry. They were unimpressed, and insisted that it must be legal or it wouldn't be happening. That night I wrote to the Cold Stone district manager explaining the situation to her in detail and asking her what I should do. She wrote me back that she would look into it, and that I should speak to the owners directly about it. I wasn't sure I agreed, but I took her advice and called and texted the owner asking to speak to her. She still has not replied. Flash forward to earlier today at work. I arrive at work to find the owners husband there. He was passing out Tip-Pool agreement policy papers to my co-workers, and asking them to sign them. When he sees me, he asks me to step outside so we can talk. He shows up with a Tip-Policy agreement form in writing, asking us all to read and sign. The policy openly admits what I suspected. According to the policy, basic crew members like me get paid the lowest rate of tips, while shift leads get paid 1.5 as much, and the managers get paid 2 times as much. He tells me that I either have to sign and agree to those terms, or I can opt out and not make any tip money. He didn't push or pressure me into signing, but I went ahead and signed anyways, because obviously some tip money is better than no money. When I questioned him on the legality of the policies, he insisted that he has been to the local Department of Labor and Industries Office and talked it over with them, and that they assured him everything in the policy was legal. I asked him directly how my manager could take tips when the law seems to prohibit it. He replied that, because my manager served costumers and was paid on an hourly basis, she is eligible for the tip pool. He insisted this is what the Department told him as well. I am very skeptical, because the RCW he's citing in his agreement form says absolutely nothing about managers being able to take tips if they work hourly or serve costumers sometimes. Turns out he knows everything. He claims that my co-workers were "deeply disturbed" by the things I was saying, and heavily criticized me for showing them the Administrative Policies from the Department of Labor and Industry. He said I was disrupting the flow of the store and turning co-workers against each other, and he said that his wife has continuously gotten phone calls and texts from disturbed co-workers. While I suspect this is largely exaggerated, it is obvious my co-workers ratted me and my plans out. He knew that I had contacted corporate, and he censured me heavily for that, saying that corporate hates it when employees contact them directly. When I told him that I was afraid to contact the owners directly because the other employees said not to talk about the tip situation with them as we weren't supposed to know, he called me a liar, saying that the employees never would have given me doubts about talking to them. When I asked him about what the assistant manager said about tip withholding. He acted confused for a moment, and then insisted that had been an old store policy that they had "done away with a LONG time ago." He didn't sound convincing, and when I pushed him on why the assistant manager would have told me about an axed policy from a long time ago, he insisted that the manager simply must have made a mistake. (Frankly, I'm skeptical that withholding tips over employees heads for six months and keeping the money if they quit before that could EVER have been legal policy in Washington, but that's what he claims). The whole discussion was awkward and very passive aggressive. I told him that I wanted to talk to the Department of Labor and Industries so that we could all be on the same page, and he laughed and said, "We're already on the same page. But go right ahead!" He insisted they would back up the legality of his policies. Although when I reaffirmed my intention to talk to them, he added, "unless they tell you something different than they told me. In which case you should call my wife right away to let her know, and we'll get it all squared away together." He seemed very unconvincing for large portions of our discussion. I'm also frankly, a little skeptical that he somehow could have made an appointment with the Department and talked it over with them the exact same day, before writing up an agreement and getting back in time to be there when I was beginning my shift, but I guess it's possible. I have no idea what to do. I feel like I've done nothing but make a huge fool of myself. None of my co-workers will talk to me. They avoid me like the plague, even the one's who seemed so friendly at first. The owners are obviously very pissed at me. The district manager hasn't gotten back to me, but perhaps she's already talked to the owners and taken their side. I don't know how to go about finding out if this is legal or not. I really don't think it is. Do I need to hire a law consultant or something to find out? Or would the Department be able to tell me? I need to get out of this job. It's going to be humiliating to cause such a ruckus and then walk away. But the tip policy, even if it is legal, (and I still don't think it is) is so ridiculously unfair, I can't be apart of that. I could work any other place with a tip pool and make far more in tips without a manager and shift leads getting up to double my tip rate. How can I get out of this job in a mature way? TL;DR My owner insists that it's legal for him to give tips from the tip pool to the manager, because she works hourly, and serves costumers. I still believe that it is illegal under RCW 49.46 WAC 296-128. There seems to be no provision for managers to take tips if they work hourly or serve customers. My manger is still a bonna fide administrator, she runs the operations of the store, she can hire, or fire, and make executive decisions, even if the owners ultimately seem to have the final say in everything. When do child support payments stop? [MI] Posted: 27 Aug 2019 07:28 AM PDT I've been divorced for 14 years and paying child support to my ex for my kids. We have "50/50" custody, but I pay support because under the custody agreement, the kids spend 183 nights at her house and 182 at mine. The payments are taken directly from my paycheck and distributed through the Friend of the Court. I don't mind paying what I am obligated to pay, but I also don't want to just give my ex more money than I have to. I did enough of that while we were married. My oldest turned 18 in April and graduated high school soon after. He's starting college now. The amount being taken out of my paycheck has not changed. My understanding is that in Michigan, support for a child that turns 18 while in high school continues until graduation, which in this case has come and gone. I'd rather just put the money into a savings account to pay for his college expenses. I've searched through the divorce decree and there's nothing in there about continuing support payments after age 18. The section on child support really just says that the state's formula will be used to establish the amount of support. Any insight into what's going on or what I should do to figure it out? Landlord refuses to fix moldy ceiling due to leaky roof, now entire family is sick. (Rhode Island) Posted: 27 Aug 2019 11:45 AM PDT We have had a number of issues with our landlord, some that effect our health, some that just are a nuisance. This ones major and I'm at a loss on what to do since we move out on September 1, and I'm afraid anything I may do will put me at risk for having to fight for my security deposit back. We told the landlord about mold in one of the bedrooms in June. The mold is in the ceiling and we had a friend look at it who has said it is caused by a leak in the roof that soaked through to the insulation to the ceiling. It is now almost August and we have decided to move because of his failure to remedy the situation. He claims he never knew there was mold (we texted on multiple occasions with photos). Things the last few weeks have gotten progressively worse. Last week, I took my dog to the vet because he was coughing, only at night. We couldn't figure out why, and I couldn't figure out why when my husband and I were on our honeymoon and he was staying with my parents it wasn't happening. The vet put him on a steroid and told me just to be safe I should have him stay at my moms for the remainder of our lease. The last few days, I've had a nasty cough, with no other symptoms. I've had a horrible time breathing, and just can't seem to catch my breath. I went to the doctors and was diagnosed with a lower respiratory tract infection, and put on an antihistamine, a zpack, an inhaler, and a cough suppressant. The doctor said it's likely due to exposure to mold but couldn't guarantee it so did not put it in writing (I tried). My husband has been sniffling and coughing for at least a few months. I remember saying to him right after our wedding in May, what since we are married now you are just never going to blow your nose again? We only have a few days left in the house, but we have a few issues. 1. We had to move to a more expensive house because nothing else was available. 2. We are facing a $260 early termination fee from our cable provider. 3. Every time I am in there trying to pack, I have an asthma attack. 4. My dog has had $70 in medical bills. I have had at least $75 in medical bills, and god only knows with my husband because he started getting allergy shots months ago, when we didn't know about the mold. The allergy shots are not covered by his insurance. My fear, is that a family will rent this house - which on a side note is not up to code (lacks access to heat in the bathroom). If a family moves in, they will be exposed to what we have been exposed to, and it would be much more dangerous for certain individuals to be exposed to that. I know he does cover up jobs, so paints over mold so it can't be seen, and other things like that. So I called a group here that inspects these types of things. Unfortunately they said that unless I pay to get it tested, there's nothing they can do. We genuinely cannot afford to do that at this point, and like I have said, I'm afraid whatever we do he will find a way to withhold our security deposit. We have only lived in the house for 8 months, we had a 6 month lease, and the house is exactly is it was when we moved in, with the exception of the mold. Tldr, landlord doesn't fix mold. Posted: 26 Aug 2019 06:40 PM PDT This will be a long one- This is all taking place in Maryland (United States) In August 2018, my SO, a friend of ours and myself had all signed onto a 12 month lease for a rental property (a condo). About a month after we had moved in, we received notice that our property was going into foreclosure and would soon be on the market for auction. We were reassured that our lease would still hold true and since we were paying rent through a rental management company, nothing would change and that our checks would just be sent to the new owner. We double checked Maryland law on this and tenants are protected during foreclosure so that all checked out. However, almost immediately after the new owner had purchased the property at auction, he had reached out to my SO and explained he intended to flip and sell the property for quick profit, he stated that he did not want tenants in the property and basically that he wanted us out asap. He also claimed that he believed our lease was "invalid" and advised that we stop paying rent to our management company (which we of course didn't believe, we continued paying our rent) he kept claiming we were being "scammed". We spoke with our management company immediately after, they said he should not be reaching out to us at all, especially until after the sale was finalized (which it had not been until January 2019). They said they would send us verification at that point just to let us know where our rent checks, security deposit and keys would be going. From that point on, the new property owner would not back off. He constantly harassed my SO asking if he could inspect the property or if he could bring people to look at it. He even sent people to us to talk to us about other rentals in the area. He also mailed us some "eviction" notices himself stating that he was the new owner and planned to remove us from the property. My SO had spoken with him and even said we would be willing to terminate our lease early if done legally and correctly, but that we would need to wait until the sale was officially transferred to work out some sort of "buyout" for the remainder or to be given a month or so to save for a security deposit elsewhere. We took the advice from our management company and ignored his requests during this time. As soon as the sale had transferred and we received notification, the new landlord asked if he could come inspect the property. My SO tried to work with him so that we could be present during the time of the inspection, as we feared he would be performing a self-help eviction and throwing our stuff out on the street. All in all, we asked if he could change his time from 10:00 am to 10:30 so that he could be present and that I would not be alone. The new owner disregarded that and said he would be entering our property with or without our permission and that he would have our keys, a locksmith and "the sheriff" with him. I had contacted the police department and they advised me to call 911 if he showed up at the property at all, which he did. The deputy that arrived when I called 911 told the new owner he needs to evict through the court and cannot just enter our property. He advised us after the new owner left to go to the courthouse and file a peace order against him. We did, but the judge dismissed the issue as a landlord/tenant issue and asked for us to speak outside of the courtroom to see if we could reach an agreement. During that time, the new owner and one of his buddies he had with him were very aggressive with my SO and I. They made jokes about "getting their guns back", garnishing our wages, throwing us out on the street and even threatened violence against my SO. Weeks later, we attempted to pay our rent and they filed a "wrongful detainer" suit against us, claiming that our lease was "invalid" and that we were squatting. We had to hire an attorney to defend ourselves, the judge decided this was not the correct filing on their part and dismissed the charges against us. Our attorney tried to reason with them and their attorney, still offering that we were willing to terminate if offered a buyout or rent-free months agreement, but they wouldn't hear it. Our attorney advised us to hold our rent checks since they were still claiming we did not have a valid lease and to put that money aside. Soon after, they filed another suit against us for damages, attaching it the original foreclosure case on the property, still questioning the validity of the lease. The judge ruled that our lease was 100% valid and dismissed anything else they had filed against us. Our attorney had filed a counter-claim for harassment, but the judge said he did not want to hear it on the foreclosure case, he did however leave it "without prejudice" so that it can be reopened at anytime. After this, we spoke with our attorney about our options. We were exhausted, felt unsafe and really didn't want to deal with them or this situation any longer. We had also been informed (by our neighbors and the HOA) that there was a black mold infestation on all the lower level units of our residence, all of the other residents had to be put up elsewhere for 3 weeks while the mold was being removed/cleaned. I reached out to the HOA to get more information and they said they've been trying to get into our unit, but the owner of our unit wouldn't respond to them. So on top of everything else, were concerned for our health. We asked if it would be reasonable to ask if we could keep that back rent and leave within one week. We had been looking at other places on our own in between court dates and had one lined up we could sign the lease at anytime. We offered to even let them keep our security deposit. Our attorney spoke with theirs and they surprisingly agreed. We signed a lease for a new rental property the next day and moved immediately. Unfortunately, our attorney called the next day and said they completely went back on the initial agreement. They said they wanted all of our back rent and were going to press charges against us for a bunch of other things on top of that. At this point, we were already out. Our attorney told them that we were leaving and confirmed our move-out date (end of May). I hadn't heard anything from them since then...up until recently. I had been watching the property on Zillow (it was up for sale almost immediately after we had moved out). The price had been dropping almost everyday throughout the summer. I noticed last week that the property was off the market. Of course, after seeing that, I checked the online case search to see if anything was there. Lo and behold, they're pressing charges against us yet again, this time in large claims, for around $20,000 (back rent and attorney fees as far as I can tell). Upon further investigation, I noticed the HOA of the condominium complex had officially filed a foreclosure suit against them on the 12th this month and noticed they filed against us only a few days after that...I can't help but think the foreclosure suit inspired them to lash out yet again since they couldn't make their profit. I'm at a loss here. I'm tired of court, tired of this situation, tired of being harassed, we are absolutely drained. I contacted our attorney again and he said he could work up another counter claim against that and we could see how things might play out. He also advised that we reach out to the HOA again so they can be aware of our situation as well, which we plan on doing tomorrow. However, we would have to of course pay him again.. We are drained of our money at this point, I don't know if we could afford it. I am an elementary school teacher, and since we had a moment of peace this summer, we used up any extra funds we had to help me with grad school so that I can finally start the process of renewing my certification at the end of this school year. I have no interest in getting money from them, getting revenge or any sort of satisfaction from pressing any charges/counter filing against them. More than anything, I want peace and quiet in our lives that we haven't had for this entire past year. Is there any way of dealing with this otherwise? My first thought was writing a letter to the court/ judges prior since they're familiar with the cases, situation and parties involved explaining just that, maybe asking if these charges can be dismissed and make it clear that we just want to be left alone. Is there anything we (the defendants) or the court themselves can do about people like this that abuse the court system, wasting time and money filing frivolous suits over and over again? I believe that's what's happening here. I don't know enough about law to know if this is something that can be brought up in someway before it even gets into a courtroom. I know we could also attempt to go in without an attorney and represent ourselves. I'm sure this wouldn't be advised. I've looked at a few of the forms on the maryland courts website (such as motion to dismiss) which we could just file ourselves, but I'm not sure about any of that either. I feel as though these people will never stop. I feel like they will continue to attempt to press charges and waste our money and time over and over again until it's put to a stop. I'm at a loss here. No one I've spoken to has ever heard of a situation like this. Tragically, one of their friends committed suicide at the home recently. He was found by one of the roommates, but all were there and witness to the passing of their good friend. The boys are all extremely distraught and have since moved out. None of them could stand to be in the home after the tragic incident. I am wondering how best to handle this situation. The driver did not have her signal on and there was no turn lane. She stopped short while the light was green with no warning. The road she turned onto is a frontage road with only a few houses. When the police got there she claimed to have been turning left (not making a u-turn) to go visit friends, when the police asked what house her friends were at she changed her story to say she was pulling down the road to turn around and go to a bar on the opposite side of the street to meet them. The police separated us and took our statements. I was not ticketed or found at fault on the scene, we had insurance on the car and I had insurance separately for my own car. Her insurance attempted to collect payment for damages from my fiancé's insurance, they said they would not pay as I was not ticketed or found at fault. Her insurance took me to court last August (2018). My insurance sent a lawyer to represent me, standard procedure. In court, the judge openly admitted that the woman I hit was all 3 of her sons English teacher in grade school but said as she was not deciding fault, a jury was, it was not a conflict of interest. The lawyers and judge discussed what we could and could not say on the stand, we were told of the rules, and the jury was selected. I could not say that I wasn't ticketed, I could not say that I had insurance, I could not say that the police found me not at fault. The responding officer did not show to court because he had "tactical training". The jury found me responsible for the damages. My lawyer said this happens all the time but the insurance company wanted a court ruling before paying. The insurance would take care of it. The judge did not instruct me to enter a payment plan to repay the judgement, I was only told the insurance companies would handle it from there. I did not hear anything else about it until Friday (8/2019) when I was pulled over because I forgot to put my new registration sticker on my car. I was told my license was suspended because of a "judgement" in October (2018). I received no notification from the court or Secretary of State that I was suspended, there was no hearing or paper work. I did some digging and found out that it was suspended because my insurance never paid the judgement. When I looked up Illinois laws on suspended license, it says it can only be suspended for a judgement when I had no insurance or it was a DUI case, but I had insurance, no DUI, and I'm still suspended. The landlord told us this and told us how to avoid being discovered (pretty much don't bring attention to the house and avoid the police). We are all poor college kids who barely make rent/utilities let alone have access to a lawyer. There are five people who signed the lease as well as another tenant who did not sign the lease that the landlord was aware of. So the landlord knew of six non-family members living here and five of us signed the lease back in May 2019. It expires May 2020. Due to unforeseen circumstances we are now looking at ways to break the lease with the fewest consequences, both legally and financially. Posted: 26 Aug 2019 11:29 PM PDT Long story short, my friend wanted phones for her family, I signed a contract for her to get them. The contract and phones were and are in my name and her family uses them. I keep my credit card on the account and have her pay me as I realized soon after signing the contract that she couldn't ever keep her account with money and the payment wouldn't go through and I didn't want to screw up my credit. SO. now she repeatedly is late paying me or doesn't even try to reach out. I'll ask her for it. She'll say "ok tomorrow at noon I'll bring it by" and doesn't. And repeatedly we do this every month. I have to nag for days after the bill is due to get her to pay it. I'm tired of this and I'm currently going on a stretch of 2 weeks overdue of her paying her bill to me. Guy claims I sold him fake shoes? Posted: 27 Aug 2019 05:59 AM PDT Back in April I sold someone some Yeezys on the Facebook marketplace in Maryland. Along with them I included all the paperwork from stockx saying they are legit shoes. Last week he messages me telling me he wants his money back because they are "fake." Him and 5 different friends have sent me messages to the extent of 'we have friends in law enforcement and at the administration of your school (university). If you don't give the money back we are going to get you kicked out of school and put in jail.' What should I do in this situation? I would have just given his money back and not stressed if it wasn't so long ago. When I originally sold them to him we agreed on a price and we were going to meet. 5 minutes before he said that he only had money for $50 less and tried to get me to sell them for much lower because I had already driven 20minutes to meet him at that point. My fear of refunding him now is it seems fishy to me and like he is trying to make a quick buck on something. Landlord is asking me to find a new tenant? Posted: 27 Aug 2019 02:06 AM PDT Hi all, It's my last month by contract in the property that I'm in, and I've let my landlord know I've found somewhere else and won't be resigning. He then asked that I be the one to find a replacement tenant for myself, hold viewings and communicate wit them through spare room, etc, as it's my responsibility. Is this correct given that my year long contract is up? He's been useless the entire time I have lived there and we have a broken dishwasher, shower and other appliances that he asks me to fix or get a repair man in for and then deduct from the rent or send him the invoice. He also frequently drops by without warning, as will his mum, and she once made me send my car keys in an Uber so she could check on the flat as hers 'weren't working'. My deposit has also never been registered and protected, and I've never received an email about it this - nor does he pay income tax on the rental money. Divorced now for 3 yrs and she wants more child support and change our parenting plan. Hearing is set next month and we live in WV. Mainly trying to draw hentai and the sorts. The thing is, I want to draw things that arent anime/manga related and move on to drawing real life people in "various" situations. Such as drawing celebrities and putting them into a hentai plot. My question is, will I get in trouble for it??? Can they sue me if I start drawing them in a obscene manner?
