Although all of my paperwork and paystubs list my residential address as Philadelphia, yesterday my payroll department informed me that I was not paying Philly city taxes and that I owe $600 for the last 7 months. They are garnering my entire paycheck for this week to pay for this, which is detrimental to my financial situation. I am wondering the legality of this as well as anything I can do to fight this. I'm finding this falls into a gray area legally because obviously my Reddit post was not copywritten. Which excludes him from breaking many laws. Dad got a text message yesterday asking for over $4K for a "security clearance certificate" and lengthy explanation about how the package is being held at customs to get out of the country etc. - exactly how the scam is documented to play out. He finally believed us and let us block all of the various text senders on his phone who were involved in this. We are locking him down financially, giving him cash only and anything he wants online he will have to buy through me. He needs a receipt for everything he buys since we still need to document medical expenses etc. If he really, really wanted to he could, but then he wouldn't be able to buy groceries. His usual assistants (family and close family friends) have been instructed that he is not permitted to go to walmart to buy gift cards for cash, etc. and I deleted the apps he was using to send cellphone minutes to his "friends". I also found and cancelled about 8 different monthly recurring subscriptions to various things like "savings club membership" or "financial coaching" that added up to about $250/month of money completely wasted. "Financial coaching" at $70/month - coaching for what? The guy doesn't have any money or investments left! "Savings club" costs $25/month, apparently in an offer at the end of some other call he made, he accepted a $3 trial that auto-renewed into a $25/mo subscription!!! So many scams preying on the elderly these days, it's really sad. Anyway, thanks again for the advice in the original thread. I'm not sure he learned anything, but he knows he is having his wrist slapped... Michigan/Florida: Landlord won't give deposit back because house is now "haunted" Posted: 02 Aug 2019 12:32 PM PDT To make a long story shorter: June 2018 I moved my mom in on hospice care do to her losing battle with breast cancer. She was at my place 23 HOURS on hospice care when she died. This was in Michigan Fast forward to today. I have moved to the Orlando area for work. I left my lease (24 months) two months early for said job and paid the final months in one payment. Today I get a letter in the mail from my landlord assuming it was the deposit back.
That isn't exact but more or less the jest of it. So I look at my lease, I only had to inform her of anyone moving into the unit if they were staying over 14 days. My mom wasn't even in the place 24 hours. Which I would have told her if my mom would have lived longer. It doesn't say anything about dying in it either. Which why would it? What can I do? I don't think that is an excuse to not give the deposit back. It can't be. EDIT: Thanks for the replies. About small claims court: I would have to file in Michigan, correct? Buyer of old house wants to replace carpets on our dime Posted: 02 Aug 2019 07:25 AM PDT Located in CO. We sold our home nearly a month ago. Prior to selling, we had replaced all the flooring in our house except in 2 bedrooms. We disclosed all stains on the carpet in those rooms. We have documentation of the fact that the carpet was damaged when we bought the house 4 years ago. As part of our closing agreements, the buyers gave us 5 days to transfer possession with a $500 security deposit to be cashed within 30 days if needed. We were able to get completely moved out and transfer possession in 3 days. The buyer had the home inspected but did not submit an inspection objection report. The buyer did a walkthrough of the home just before closing with no complaints. Days before the 30 day cut off to cash the security deposit, they are now claiming that between closing day and possession day they discovered an overwhelming cat urine smell in the only 2 rooms we had not replaced the carpets in that required them to replace the carpets. They claim the damage done was so severe that it soaked the subfloors. They are planning on cashing the security deposit to cover replacing the carpets and want our new home address (I'm assuming so they can bill us for any costs for replacement exceeding $500). We do have a cat, however he was removed from the premise within 24 hours of closing and there is simply no way he could have caused the damage they are claiming in that amount of time. There was also furniture on top of that area that he could not fit under. We had multiple people in the house between closing and possession helping us move who can attest to the cleanliness of the home. I have visual documentation spanning our 4 years in the home showing the furniture always having been on that spot. I know in claims of pet urine, it can be a bit of a he said she said game, but I'm wondering if I can fight this. I truly believe they are trying to take advantage of us here. Is there a reliable way to prove that we were not the responsible party for the damage claimed? Posted: 02 Aug 2019 04:59 AM PDT It's currently 4:30 AM, I can't get any sleep due to anxiety from work. I work for a manufacturing company as an electrical technician. Over the last couple of weeks I've noticed my department lead constantly looking over at me, like often enough that it got creepy. I've asked him to stop and told him it's making me uncomfortable but he continues. I didn't know why he was watching me until yesterday after lunch I got out of my seat to cut some cable and walked past his desk to see he's writing detailed notes about what I'm doing. I was standing pretty far back and he didn't notice until I, out of pure shock, said loudly "What the fuck." These notes were really detailed, he'd noted when I got to work, who I talked to, what I talked to them about, I saw one note that said I yawned... I have no clue what these notes are being used for but if I'd have known I was being watched this closely I would have never, ever taken this job. I was so shocked I could barely breathe I ran outside to catch my breath but ended up having a break down and went home. I've also been told that he's got 2 laptops set up in the electrical department set up with software that allows him to remotely view their webcams. Is any of this legal? He said that I need to be moved out within a week. I have looked online and I haven't find any law like that and it sounds pretty sketchy to me. I have a copy of the rental agreement. Assuming that I am able to at least get the normal 30 days notice to move out, I'm wondering what my options are if I want to stay per the terms of the rental agreement. One section states "Tenant agrees to at least one year occupancy" but another section states "Owners agree to rent on a month to month basis to tenant". So does that mean the tenant is legally obligated to stay in the house for a year, but the owners can choose to end the agreement whenever they want? (With 30 days notice I mean). [link] [comments] |
Guns removed in PFA case were returned illegally- cops are covering it up. Posted: 02 Aug 2019 10:30 AM PDT I was granted a protection from abuse order against my ex husband after he sat outside my house for hours and then broke in and attacked my current partner while we were intimate. He threatened to shoot him. He owns guns. The final PFA was granted, with an order to remove guns from his possession for the duration of the PFA. The local sheriff went to his house where he is living with his parents. His dad handed over three guns that he claimed belonged to my ex husband. From what I have been told by my xFIL, he was instructed, on the spot, to go to the police station and fill out some paperwork to get the guns back. My father in law is an old man that has no computer experience in any way. This is not something he figured out his own. He went in, filled out a form claiming he was the rightful owner and they gave him the guns back. There is a law in my state that prevents guns that are removed for a PFA to be given to 1. A family member, 2. Anyone that resides in the house with him. I received a letter by mail stating the guns were claimed by the same man who turned them over claiming they belong to my ex. I called the police about it and expressed my concern regarding the issue. He said there is nothing that can be done, unless I can provide receipts for the gun to prove they don't belong to my FIL. When I pointed out the glaring hipocracy that he claimed they belonged to my ex, and then to himself, they were extremely offended. I told the sheriff at that time that I would hold him personally responsible if I or anyone else is hurt because they are instructing people how to skirt the law. This week a woman was killed by her husband despite having a PFA and gun removal order. The exact same police department served the gun removal in my case. I contacted the DA and told them my experience and he looked into it further for me. I was contacted back and informed that the records for both the gun removal and for returning the guns have mysteriously vanished despite supporting documents in another precinct (the one I live in) that state which guns were collected. I live in California and about two months ago (June 10th), I went to court to try and receive my deposit from my landlords who refused to give it to me or any accounting for it. They did not show up to court, so I was awarded the damages I filed for and was given a notice of that judgement in the mail. On that notice it stated that the defendant had 30 days to appeal. They failed to file an appeal within that timeframes. However, on July 19th they filed a motion to vacate judgement, which I recieved July 30th, and I had to again appear in court on August 2nd. On that motion, they claim that they were not served. I have proof of service papers, along with texts and voicemails from the defendant proving that the claim they filed was falsified. When I went to court, they again did not show up, and the motion to vacate was dismissed. I am now worried they they will file this motion again under the names of the other two defendants to just keep toying with me and hope I dont go. This is now the second day I have had to take off work and have lost wages. I would like to know what rights they have currently. If they can keep filing paperwork to continue this, or if the court will see the previous judgments and disregard their requests. I dont have PTO to spare, and dont want to have to file another claim to compensate me for all the lost wages. What can they do? What should I do? Thank you all so much in advance! Posted: 02 Aug 2019 11:40 AM PDT I work at a not-for-profit peer agency in NY and we were notified that we have a mandatory picnic to attend in which the main office will be closed. I work at a side office and last year when events like this came up, I was given the go ahead to skip it since my side office is open 7 days a week due to us providing Crisis work, so last year I'd see my clients like normal. This year I'm being told to ignore my case load for a day to go to a picnic I have to pay $32 to enter. If I decide to skip it, even if it's just me working with my clients with the coworkers from a separate agency at the side office like I usually would, I would still not be paid for this day, and they're stating the only way out of this meeting is taking a vacation day. TL;DR: Essentially my options are A. Attend a mandatory picnic despite it costing me money B. Work with my clients as usual and not be paid C. The dealer contacted me after all the paperwork had been filed with the bank and said he didn't intend to sell the hitch and ball and wants them back. The truck was sold depicting the hitch and mount in all pictures. Nowhere in the ad was it stated they were either included nor excluded. Yesterday we had an exam with a lot of technical issues: We didn't have as many questions as we should (37 instead of 40), some of the questions could not be opened (it was on a computer) and after half an hour we got a notification that the exams had been terminated by our professor (usually we would have had an hour). We had to start the whole exam again because our answers hadn't been saved. So today some of us went to the dean's office to complain and were told that the exam could not be graded cause our answers hadn't been saved again. They told us we were allowed to take the exam again at the end of August. Problem is, I've booked a holiday almost a year ago and will not be able to take the exam again on that date. Usually this wouldn't be a problem because you have 3 trials to pass. I failed the first one last semester so this would have been my second one. The next one is next semester (in February). I could easily take the one in February but if I fail I won't have a third try because you have to pass this exam within 18 months after you started the class. So by not grading the exam from yesterday and setting a new date when I'm (and many others are) definitely not able to participate, they took away our right to have 3 trials. Moreover, some of us took the exam for the third time yesterday and won't be around at the end of August. Are they allowed to do that or can we insist they grant extended terms in this situation? He threatened to sue me for "using him". I have only stayed with him out of fear of him hurting himself and how scary he gets when I try leaving. He stalks my friends, digs up things from my past, and mentally/emotionally abuses me. I had enough of it and ceased contact with him a few days ago. Before I cut him off, he had tried contacting my friends and family to talk badly about me and send them incriminating things. He was finally getting clean, but after a relapse with drugs, he fell victim to his demons and insecurities again. After my family and friends were harassed and numerous suicide threats were made by him, I blocked him on everything. He told me he was going to kill himself and blame me on his suicide note. He promised to ruin my life. I wanted to stay to help him remain sober and make sure he doesn't do anything harmful to himself, but I couldn't handle it anymore. In turn, I got harassed on all social media and all of our mutuals are being harassed as well. He's incredibly mentally ill. I want him to get help desperately and told him that right before I blocked. I'm afraid the harassment will continue. I'm afraid for his life. I don't know what to do. We were long distance so I do not know his address nor personal information of his family. He does not know my address but knows my family's info. Roommate 2 is a subletter himself, but a legal one and is on the lease. He moved in only 3 months ago but wants to move home to jersey to save money. The whole sublease is illegal and not approved by the landlord. Furnished apartment. They seemed nice and are in the same industry as my boyfriend. The rent for the 2 bedroom apartment is $2,275 Roommate 1 had been paying $1100 and roommate 2 paying $1175 and splitting utilities 50/50. They said utilities average $100 month. Roommate 1 says because we are a couple, he wants us to pay an additional $300/month to make his share $800 and ours $1475. I countered by offering we pay an additional $100 and take on all the utility costs ( as we had been told they averaged $100/month). He agreed. We moved in. Roommate 2 said he wanted to switch out the bed that is in the apartment but he would bring us one he has at home. Okay, no problem. Shortly after moving in, we realized the apartment was infested with cockroaches and mice (boyfriend had to kill 7 mice in the first two weeks) .We also started getting bites, so my boyfriend asked Roommate 1 (who never actually sleeps in the apartment and due to work spends less than 10 days a month there) if there were ever any bed bugs. Roommate 1 says " oh yeah the apartment was infested 6 months before you moved in but we treated it".We continue to deal with the mice and roaches, buying traps and sprays and we asked roommate 1 to please contact the exterminator about these pests and bed bugs. Per our sublease, we are not supposed to directly contact the management company. The exterminator comes and says there are large openings behind the oven and sink and there are trappings/signs of significant pests, but this means a contractor has to come in, he says he cannot resolve it himself. We see several people move out of their units at this time, it is mid month, which is strange but hey its NYC. We wait weeks and the contractor never comes. Roommate 1 tells us he is moving out 2 months early, but will find a sublet for his room. My uncle dies and I go out of town for a week, when we come back, there are signs all over the elevators from a concerned neighbor who says their apartment is infested with bed bugs and keeps getting re-infested after professional treatments. They have reported it to management several times, and says management is responsible for telling other tenants but they have not released any memos. I fear I have brought bedbugs into my mom's apartment, as if she does not have enough to deal with recovering from a stroke and her brother passing. The sublet roommate 1 found moves in. He did not tell us her name or when she would be coming, he told us the day she arrived and that we needed to be home to give her her keys. She purchases an air conditioner, and our utility bill goes up to $178 for the month (should we be responsible for the surcharge in utility price?) Sublet moves out after 3 weeks. We call an exterminator. He says we need to have the apartment sprayed twice, one week apart. He also says we need to:
The exterminator also told me our roommate had lied to us about the timeline and nature of the infestation. He said 3 treatments were scheduled for our apartment unit January and February. He said the last treatment was February 25th. We moved in April 3rd... less than 60 days from the last treatment. He also said the roommate 2 had taken the treated mattress, the one he sprayed, and replaced it with an untreated mattress. Roommate 1 had a mattress protector on his mattress, ours did not. The exterminator let me take photos of the dates of services and their signatures, He says the entire apartment building is severely infested. Roommate 1 has at this point disappeared, leaving us to deal with preparing the apartment, his room and all of the communal furniture and decorations for the exterminator. He denies any roaches in the apartment, and says he has only ever seen 1 mouse. We are supposed to move out in 30 days. My boyfriend says he will have to take out the beds, bookshelves and couches bc we are the only tenants of the apartment. I think that is crazy, it is not our furniture and not our apartment, and these roommates just left us to deal with their mess! He has no health insurance, and the chemicals the inspector sprays really cause his asthma to act up and he hasn't been feeling well. We have no security deposit and it's their responsibility. He got pissed off I didn't want to talk to him, drove to his house, grabbed a Nespresso machine I forgot there when I was packing up my stuff (only thing he's aware of that I left), grabbed a shotgun, came back to his mom's place, shot the machine in the backyard, hid it in the trunk of my car, came inside and told me, "I brought some of your things back from my house, they're in your car," screamed at me a bit, and drove off. He spent the rest of the night texting one of his friends (who communicated it to me, in a very limited capacity) that he was driving down/going to drive down to my house to give me a piece of his mind. Sounds like an r/relationship_advice post. But I'm including these details because I'm wondering

Also, pertinent info: I do know NH is a mandatory arrest state for any DV cases regardless of whether I want to press charges; he's not a US citizen (green card); there are no prior incidents of him escalating like this though I've seen him throw things at walls and destroy some household objects (idk if that impacts a restraining order, or if it impacts whether or not this is considered DV); ~20 guns between mom's property/ex's house and guns technically belonged to his deceased father though ex has a handful of them at his own home and I don't know who technically took ownership when dad died. Green is a lane cutting through three separate properties. Orange is a nice guy. My dad is red. Gray is an asshole. Gray has been at war over this green lane and insisting that my dad has no right to use the road to access his (my dad's) property. Gray has plans of closing off the road right at the point where gray meets red. Gray claims that because gray's property lies first on the road (???), he can open and shut it if he pleases. Gray acquired an attorney and sent my dad a letter stating that my dad is to stop using the green lane immediately because he has no right to it. Every deed my dad can find going back to ~1850 says that the red land has a right to use the lane to access the property. Gray cannot present any actual paperwork stating that he owns and controls access to the green lane at any point. For all intents and purposes, every deed says that all three properties have equal access to the green lane. Orange is just as accessible and close to the blue road as Gray is, but Orange has told my dad that the green lane is open to all three of them and he has no intentions of ever closing it or contesting it (because what grounds would he have, anyway?). My dad has talked to two surveyors. Both of them have looked at the deeds and said that my dad has uninterruptible access to the green lane to access his property. My dad spoke to Gray's attorney and inquired about what actual proof Gray presented saying that he can control the green lane at whim -- a deed, a contract, some ancient hieroglyphics carved into a tree? The attorney did not have a clear answer and my dad seems to think that he caught him off guard with that question. I wasn't listening to the conversation so I'm not sure. Furthermore, my dad has been trying to get power turned back on at the Red property (he does not live there and there has been no electricity on the property for ~2 years, but he had hoped to have it turned back on and possibly move there before this lane fiasco started). He spoke to a representative for PP&L (our state power company) on the phone and mentioned the green lane nonsense. The utility worker said that, right of way or not, Gray cannot just block a road at whim because the utility company needs uninterrupted access to all properties where there's power. So even the power company is saying that Gray has no right to just block a lane, whether it touches his property or not. My question is really just this: does my dad really have to go to court and contest what appears to be an open-and-shut case? And if so, and when he wins the case, can he sue this guy for harassment? Or at least attorney's fees? Gray, according to at least 3 parties, has absolutely no ground to stand on. Even if my dad had no deeds proving the open use of the green lane, PP&L's need for unmitigated access to the road should be enough to prove that Gray has no case, right? Unauthorized Tire Replacement at Dealership (Michigan) Posted: 02 Aug 2019 05:05 AM PDT Background: Fiancé went to car dealership to check out a clicking noise that occurs at high speeds and after high speeds. She dropped her car off and they notified her they could provide her with a courtesy vehicle the next day. We went in to get the courtesy vehicle and they explained the noise was coming from her tires. We explained that the noise occurred also while the car was not moving so it could not be coming from the tires as my fiancé initially told them when she brought the car in. The mechanic and the service advisor acknowledged what we said and they said Jason would drive it to his house a town away via the highway to see if he could duplicate the problem. This was also communicated over text with the service advisor. This clearly did not occur as the Mileage in and out was the same (107178). They called us Tuesday and said that the problem was fixed. Upon picking up the car after hours the paperwork said they replaced the tires and ball joint. We never advised this repair to occur. Upon driving the car the next day the noise was still present and the problem was clearly not fixed, but we were left with a $1100 bill to pay for new tires and a ball joint which supposedly "fixed the problem. All which were never authorized by us the owner and the problem was not fixed. So we were instead sold a "package" essentially. Do we have a legitimate claim for small claims court?
