She told me yesterday that when she saw my son, my brother in law, my dad and I at an Astros fathers day baseball game, I was holding a beer. She now has said she's gonna buy a breathalyzer and anytime she feels I have been drinking while hes been in my custody, then she'll hire a lawyer and pursue full custody. I'm fortunate to have been taken in by a relative, but I haven't been allowed to get many of my things. I have enough clothes for 5 days, but I don't have enough insulin to last me more than 1½ days. But she (my grandmother) has refused all contact, and I don't know if my insulin has arrived yet, or if I would be allowed to get it even if it had come. Salesman forged my signature, company agrees he did it, won't refund my money. (TX) Posted: 05 Aug 2019 05:25 PM PDT Two weeks ago a pest control salesman knocked on my door. He let me know they were servicing other houses in the area and basically gave me the rundown of what they offered. I listened because my wife had recently complained about ants and thought the current special they were running sounded like a good enough deal. He pulls out an iPad, enters in my info (phone number, email, address), we agree on a day for the company to service my yard and I give him my card number to enter. He moves to the next screen where I am supposed to sign a contract. This is where I started to become wary of the whole thing. He did not let me know that the company required me to sign a 12 month contract until I said out loud "this is for 12 months?" To which he quickly brushed off and pointed for the second time to where I should sign with my finger on the iPad. I was uncomfortable with the deal and let him know I was having second thoughts and ultimately did not want to proceed. He said it wasn't a problem, that he'd email me the contract to look over and to give him a call if I changed my mind. Fast forward to the next day, my wife and I are pulling into our street as a van for this company is leaving our house. They leave a note on the door saying that our house had been serviced. I am immediately alarmed. I tried calling the company's corporate number, the local number just passed you off to corporate, but it was outside of business hours. Because it was a Friday evening I had to wait for Monday to roll around. Once I get ahold of a human on the phone, they let me know that I had in fact signed the contract, meaning that the salesman had taken it upon himself to forge my signature. I ask for it to be cancelled and for a copy of said contract. The salesperson had never emailed it to me and when I asked for a copy, they had my email misspelled, despite me having seen it correctly typed out on his iPad. The "signature" is clearly a bunch of scribbles. It literally looks like 4 vertical lines and a circle. After calling again I make a big fuss and am passed up the call centers chain of command. The manager lets me know that the contract has been cancelled and that I would be getting a refund. He calls me back after talking to the branch manager of my area to let me know the sales person has received a written warning and his other files will be reviewed. A week goes by and I don't receive a refund so I called them back today. I am told that because services were rendered, I would not receive my money back. It does not matter to them that it was not my signature, in fact they basically told me they were doing me a favor by not charging me the cancellation fee ($200). I argue that it's unreasonable for them to keep my money and they do not budge. I have filed a fraud report with my bank. What other steps do I need to take to fix this? My room mate left across the country very quickly for mental health reasons and I told the leasing office when it happened and they said they needed her signature to get her off the lease but she was already long gone. I told them she was gone but got a "too bad" response. Now 4 months later, I'm tying to give my 60 days notice to finally get out of this place as my lease is up in September. But the lady at the leasing office won't accept my notification letter because my room mates signature needs to be on it... again she is long gone and I have no contact with her. What can I do? The workers went through my fence and sprayed my horse pasture without permision. I'm a sheet metal fabricator, in the front show room of the workshop we have a camera set up watching the counter so, when we're outback, we can see entering customers & for obvious insurance & security reasons. One of the staff complained about us being able to "watch her at the counter when shes serving customer & her not being able to see us". Even though her time at said counter is minimal at best. (& for clarity, I wouldn't want to watch her eitherway) Today she grabbed a ladder & proceeded to tape a piece of paper over the camera. So we can no longer see entering customers & if a theft was to occur we'd have no evidence. Is she allowed to do this? TL;DR. Last night she called me to discuss a request that my mom sent to her with regard to bringing my son on a family vacation (I gave up custody in the divorce; separate story). I have asked her repeatedly over the last 6 months since we finalized our divorce to only contact me via text. She refuses. When she calls me, I refuse to speak to her because we are completely incapable of maintaining a civil conversation for longer than 5 minutes. My ex always uses these opportunities to control the conversation, says demeaning/belittling things to attempt to get a rise out of me, etc. I've gotten a lot better at not letting my emotions get to me when she makes ad hominem attacks, but it's just not a pleasant experience and I can only imagine that my son is in the background knowing mom and dad are talking and mom is raising her voice at dad. I would heavily prefer that he not witness his parents having heated discussions about his care, so, I straight up don't want to talk to her on the phone unless she consents to the calls being recorded because quite frankly her behavior is out of control. I'd like to document all of our conversations for posterity's sake -- I fully intend to request a modification to the custody agreement when I'm more financially stable and no longer living in downtown Baltimore. Three questions: 1) Legally speaking, am I in the wrong with any of this? 2) What's my best course of action to get a court order in place to state that our communication can only be via text? 3) If I pursue a text-only court order, would that affect my ability to FaceTime with my son? For the last 5 weeks, we have attempted to reach his assigned public defender. We have left multiple messages and dropped by the office multiple times, leaving messages each time. We have probably attempted to contact him 20+ times, either in person or over the phone, and received no calls back. He is always "in court" or "unavailable", and we have yet to hear from him at all, other than an "I'm your assigned lawyer, get in touch with me ASAP" letter. We are located in Virginia. Any advice on how to either get him to acknowledge us and return a call, or escalate the situation without pissing him off to the point we've made an enemy out of someone we need to be an ally? FWIW, I won't go into detail about what he did, but it was a non-violent petty crime related to an acute mental health crisis (a "cry for help", if you will). Q: Is there a right to view in Virginia or Fairfax County such that a neighbor has standing to force a new shed to be moved or removed because shed is visible from neighbor's property and interferes with their view of my trees and the squirrels running around in them? [Note: I did not make up the squirrels - that is really the complaint - and I had no idea they ate dinner where they had a view and that squirrel watching was their dinner pastime. I used to shoot and eat the little suckers, not a fan.] Suspected answer: No. Likely with a "You have to be xxxxxing me" attached. Narrative: Middling to ritzy neighborhood. Arranged for conforming, but unpermitted (permit not required for this size and height), built-in-place shed (can be moved a little, but not relocated elsewhere on property). Shed is 1.5 feet from fence. Shed has gabled roof with gable on one end extending 37" above the top of the fence. After construction, neighbor complained that shed blocked her family's view of the squirrels running around my trees and asked - pretty close to demanded - that I move the shed somewhere else. Guys coming today to relocate shed 90 degrees and slightly downslope, to have gables point up and down the fence and to lower the shed about 10" (because of slope, this is feasible). Neighbor walked off from discussions before and did not return. Important phone call pretext. Today, when crew is coming, I informed her of my decision. I informed her that this was a reasonable compromise and dismissed her vague suggestions as unworkable. I was given a diversion program and upon completion of the program, all the charges would be dropped and I would not be given a conviction. The diversion program was completed in May of this year. I wanted to know that if I leave the country to go to Europe or any other place for vacation, will I be denied re-entry into the US? I called the police and they asked if he was ok to stay with me while they tried to track her down because I am the only family he has. My sister is a drug addict. Her phone has been turned off and none of her junkie friends will tell the cops or me anything. In the note she says she's leaving for another state with her junkie boyfriend. The police contacted CPS and I spoke with a social worker this morning. Basically, they say that as long as I agree to it that my nephew can stay with me rather than be taken custody of the state and that I will be granted emergency guardianship of him. I had to miss work today. I make minimum wage and have no idea how I'm going to take care of him but I don't want him to go to foster care. What are my legal options regarding custody? What resources are there to help me out? I'm just a single guy in a studio apartment. I have no idea where to go from here. She was told that she needed extensive treatment which we knew, and that she needed work on both sides of her mouth done. Multiple root canals, crowns, fillings, an abcess needed to be drained, lots of work which has caused her pain for months. Last month, when we went in to get it scheduled, she sat down with the accountant. Or whoever it was, and she laid out a treatment plan with a list of work. The total was $12,265, after insurance it was $7,235 out of pocket. During that visit, when we paid in advance for the work, my wife asked "is this everything. All the work that needs to be done?", to which the accountant said "yes, this I closes everything". And we paid the 7 grand. We were not told that what was presented to us was only half of the total plan. Now, weeks later and the day after her first day of treatment, we are being told that the 7 grand we paid only covers the right side of her mouth! We are going to be on the hook for another, presumably, 7 grand and change for the left side. This was not represented to us when we paid, or when they went over the treatment plan. They gave us a sheet listing tooth numbers, issues, etc., which we are now told are all on the right. My wife told the woman that she didn't understand the dentist jargon, and simply asked if everything she needed done was covered, and was answered yes. Now, her mouth is almost half done, the other side still hurts, I'm unemployed and her dental insurance barely covered 1,800 of the cost. We already put the 7 grand on our credit card and we cant afford to do it again. I don't even know if there's a case to be had. We were given the plan as executed in writing, but told verbally that we had paid for the whole thong, not just half. If we had known just how much this would cost, we could at least have talked to another dentist to get a second quote. I'm sorry if this rambles a bit. Or if it's hard to follow. The house includes a basement that I informed the tenant should be used for storage. A few weeks ago the city visited that home and found that the tenant's son, his wife, and their daughter all live in the basement. I received a violation for: 1) Renting out the basement 2) The washer & dryer in the basement because they required permits to install the electric and gas lines but I bought the house with this already done. 3) Having a room/walls built in the basement which were already up when I purchased the house. 4) Basement bathroom (shower, sink & toilet) installed water and waste lines without a permit (again this was already done before I purchased the home). 5) Installed electric wiring for light switches and outlets installed without a permit (installed prior to me owning the house) At the time of purchase I had a lawyer & an inspector and neither one informed me of these violations. I also looked up the building at the time of purchase and the building had no prior violations. we have not gotten any extra rent money from her son and his family in the basement, nor did we know they were there. A few questions what is the best way to deal with this: 1) Can I somehow force the tenants out (their lease has expired already)? If so, How long would that process take? 2) How can I fight these charges? I am not economically in a great place so I need tenants to pay the mortgage? In her custody agreement she is wanting me to pay for past expenses that she willingly paid. If it matters, the first 18 months of his life I watched him during the day so we could avoid daycare costs. He has been in daycare since April when my schedule changed. Is there any merit to this? I'm willing to pay for things now and in the future but it feels very vengeful of her to go after this money. I never thought I would have to go through this and I feel completely lost. However recently there has been a pattern of people stating the animal they are bringing a service animal, and one of my friends told me that it is illegal to ask for paperwork. I ask this because my parents are getting older and it's an insane amount of work scrubbing the rooms clean of pet hair, and I wanted to learn more about the subject/law. Over the past couple months, all the men in the company have slowly been having their hours cut back and decreased. Including this past week when a veteran of the company was let go by the owner because, "We're going back to an all female staff." This is what he relayed to me that the owner told him over the phone. And as the last guy who still has his original shifts, I'm starting to get a little nervous. Is there any legal recourse I can take to keep my job, or do if they decide to oust me for similar reasons? A couple things to note. 1) The men generally have comparable sales to the women. I sell more than the women I work with, and I know the veteran did as well. So it doesn't seem to be a sales issue. 2) Men have never had their pick of the shifts at these bars, and are either allocated to the slower bars, or worse shifts. 3) Any advice on the situation is greatly appreciated! Then out of no where on every few episodes commercials for cbs shows started playing. I thought it was an error so I sent an email to customer support to find out. After a week and a half I have heard nothing. So today I called them. In this conversation I was informed that though I pay for commercial free viewing these arent commercials, they are Ads which is completely different. Well after the call i did some digging. Ive found that channels account for the cost of these "ads" in the budget for each show because they charge the show for the time used. After the digging a few things popped into my head.

My employee's contract for Severance states that Company shall pay me accrued but unused vacation when I leave the company for any reason. When I started, the company tracked PTO. I had about accrued over 100+ hours of PTO when the company decided to switch the PTO policy to unlimited PTO. They did not providing any details as to what will happen to the accrued PTO from the older policy -- there was no written forfeit policy as I understand. The Company is now saying that they do not have to pay me because they have an unlimited PTO policy. What are my options, if any, to understand if I am in my rights to get my accrued but unused vacation paid out? What are some useful questions/ways to approach the Company about getting the facts? About one year ago, my psychiatrist prescribed me a medication called Viibryd, manufactured by Forrest Labs, which is classified as a "serotonin modulator." Before getting the drug, my doctor had to submit rationalization for coverage called a "prior authorization," which is additional paperwork needed to rationalize why a certain med should be covered (in my case, I had tried dozens of other meds like traditional SSRIs and SNRIs, all which failed). Soon after starting the medication, which was eventually covered by New York State Medicaid, my depression started to improve drastically. I finally had control over my depression and anxiety. Fast forward 8 months later. I'm down to my last few pills, and I call Walgreens to submit a refill request, as there are two remaining refills on the prescription bottle. A day later, I check with Walgreens: "Delayed, insurance issue." I call them and they explain that the previous "prior authorization (PA)" had expired. I never received any notice it had expired, otherwise I would have contacted my doctor to get the ball rolling so I would have no lapse in medication. I contacted my doctor, and she faxed over a new prescription with another PA. After waiting for Walgreens to process it, they inform me today that my refill has been denied once again. The pharmacist tells me at this point, I need to call my insurance (Excellus Blue Cross/Blue Shield) and find out the reason for the denial. I tried to call today but they're already closed. At this point, I have been without the medication for almost 10 days. I had titrated up to a dose of 20 mg, and have de facto "quit" cold turkey because of the insurance delay issues. According to the manufacturer, there can be serious complications and a withdrawal syndrome if the dose is rapidly decreased. Sure enough, this whole past week I have experienced terrible insomnia, anxiety, panic attacks, and severe fatigue. My suicidal ideation has returned at full force, and it's difficult to get out of bed. It's hard for me, in this state, to do the things I need to do to take charge of my health. IANAL, but it seems to me that it is very injurious to cut off someone of a prescribed drug without any warning whatsoever. If they just had the decency to inform me of the change in coverage I could have titrated down my dose in concert with my doctor's assistance. Posted: 06 Aug 2019 02:13 PM PDT My grandmother Bea Developed Necrosis of the intestinal tract due to radiation damage from the late 80's due to treatment for cervical cancer. the necrosis was discovered 2 years ago and she was given a couple procedures to remove the necrotic tissue. the end result was to have permanently placed Urostomy and colostomy bag's. this required 2 surgeon specialists to do the procedure the same day. Dr. C for the intestines and the colostomy, Dr. B for the Urostomy. 2 months ago Bea got another long term hospital stay this time with a kidney infection requiring a Nephrostomy bag and another doctor. My Grandmother showed up at her appointment with my mother to get the Nephrostomy removed from the doctor who put it in. when the face to face happened he refused to take it out claiming that, "Due to the complexity of the situation he can't handle the removal of the Nephrostomy." and then specifically told Bea to go to Dr. B, the surgeon who is a Urostomy specialist to get it handled. after speaking to Dr. B's office they refused and told her to handle the situation by going to Dr. C. we had an appointment with her the next day by luck and when we did a follow up i mentioned the situation and Dr. C said " i am not able to do anything about it i am just your surgeon for the colostomy. The Dr. that put the Nephrostomy in is supposed to be the one who takes it out. After this i Knew that Dr. C is definitely not the one who even would be responsible and i was ready to get this handled and over with however we have been met with resistance by both Dr's. Dr. B and the Dr. who originally put the Nephrostomy in. The Back and forth is getting absurd. and my biggest concern is that since this was supposed to be a Short term temporary Bag. Which now is no longer the case. there is no care being given in the aspect that, the first two ostomy bags are to be replaced every other day she has had the same Nephrostomy bag in for about a month now and the longer she doesn't get any maintenance on the Nephrostomy aspect she could get infection, or other complications. Law enforcement agent with the Department of Justice calling regarding a previous employer Posted: 06 Aug 2019 12:43 PM PDT A previous company I worked at of about 8 months ago is being investigated by the DOJ, and about 4 months ago I received a call from an agent that was wanting to confirm my employment with them. I had no idea up to that point that they were being investigated. He said he would be calling back at another time to ask some questions regarding the company and what my role was/what I did for the company. Since last Thursday he has called me 4 or 5 times leaving VM's that I have to call him back. To the best of my knowledge nothing I did was illegal, but I dont really want to speak with this guy if im not required to. Am I required by law to speak with him and give him information? When I left the company i dont think there was any investigation under way, so I feel like im not required to do so but im not too sure. Any advise would be helpful! [link] [comments] |
