OBGYN will not stop calling my dad to confirm appointments, even though I'm 22 (

    Posted: 18 Jun 2019 10:20 AM PDT

(using a throwaway in case my dad reddits, would prefer him not to find my account)

    In Indiana

I'm in grad school, but still go to the same OBGYN in my home town, out of familiarity and convenience. I was planning to switch once I finished school and settled down. I have him listed as my emergency contact.

For some reason, they keep calling him to confirm my appointments, despite me telling them three times to never call that number and to please call my cell phone instead. Things came to a head yesterday when they called to confirm my appointment for an ultrasound and he cancelled it without my knowledge.

(My father and I have a tenuous relationship, but that's not related to this situation. I will also be switching docs ASAP)

This has to be a HIPAA violation, right? I can't imagine they're not doing the same thing to other women. This could get someone seriously hurt, if they were seeking birth control or anything behind the back of an abusive parent/spouse.

tl;dr obgyn keeps calling emergency contact for appointment confirmation instead of my personal number. Worried it could get someone in a more vulnerable than me hurt

[Oregon] Identity thief created a company with my identity, which is now being brought to civil claims court for 35K

    Posted: 17 Jun 2019 09:09 PM PDT

I had my identity stolen in January of this year. I've already done everything I was "supposed" to do, like freeze my credit (though he just called and unfroze them, but that's a different story), rolled my bank accounts, filed a police report with a bunch of addendums with his activities every week, I got a lawyer and disputed all the accounts and inquiries he made, locked down my house and got a security camera. That is already all done.

Then today I got an email that looked like spam, some offering legal services for a court case that has my name on it. Lo and behold when I looked it up in my state's system, there I was, a co-defendant as part of a company I've never heard of, being brought to civil claims court for ~$35K over an unpaid car loan. It was filed 4 days ago.

The other defendant seems to be the identity thief himself. His address is in the area where all the other identity theft stuff has been happening - fraudulent car loan applications, an IP from a site where he tried to order a bunch of expensive stuff in my name, etc. It has to do with cars which is what most of his other criminal activity has revolved around (he has been trying to buy cars from dealerships in the area using my credit for several months). He has a foreign name and he had bad english on the other applications he made in my name. I have a strong feeling this is the actual thief.

The case itself - apparently he bought a car with credit, and stopped paying it almost a year ago. The filing claims that a tow company, owned by My Name, towed it and is in possession of it and will not give it back to the plantiff.

I drove by this address and it's a personal residence with some cars hidden in the back, but none of them look like the car in question, though I didn't get a close enough look.

I have NO idea what to do right now. Surely I am not liable for this? What can I do? Can I call my state's state department and tell them that the business was made fraudulently, and have it closed? I called my lawyer, who told me to go get the filing and get back to him, but he is a consumer protection lawyer, dealing with credit bureaus, and I don't even know what category this falls under, or what type of lawyer handles stuff like this.

Additionally -- since this is the guy that seems to have stolen my identity (who made a company with my information) -- can I finally get him? It has his address and name and other information, and so far the police in my area have done nothing but hem and haw because they can't find the guy -- well, it looks like this is him. Can I maybe finally get him arrested? I just want all of this to stop so I can get back to my life.

    (Edit: Small edits for clarity.)

Edit2: Sorry for not being able to respond quickly, I'm at work.

Edit3: /u/napalmenator Can you please consider unlocking this thread? I don't see that many off topic comments, and a lot of the comments were very helpful and I wanted to respond and ask more questions, and I haven't had time to respond yet since I'm at work.

Can i take legal action if my college refuses to rectify their MAJOR mistake?

    Posted: 18 Jun 2019 08:39 AM PDT

    Hey Everyone,

So i have an unfortunate situation. I am currently working full time and attending SNHU online for a bachelors degree in computer science. I started in 2017, with a few transfer credits from a local community college and would be graduating in 2020. For this major, you are required to select a concentration. I chose to focus in software engineering. fast forward to the present, one of the courses i was taking in the current term was horribly structured and as a result was causing a major delay in work completion. So i started looking into what i could do to avoid this class. After speaking with an academic adviser at SNHU, she emailed me a proposed concentration change to information security that would change only 2 courses (one of which was the course i had the issue with so this was perfect). I filled out the paper work and submitted it as procedure. Well, it turns out the adviser used the catalog for 2017 (the year i started at SNHU) instead of the current 2019 catalog like she was supposed to when she sent me the proposed evaluation for the concentration change. Since this error was made, 8 of the classes i took now have no credits towards the degree, on top of that i would have to take all the courses in the updated catalog, which means i will have wasted about $8,000 on the courses that no longer apply my degree, and would have to also take the 8 new courses, another 8 grand all because the adviser provided me with misinformation that i used to make this decision (i have copies of all correspondence and documents). I am waiting to hear back from the dean in regards to this matter, and i assume this can be corrected as it was a mistake on their part, but i want to know my legal options should it come to that.

Sorry for the wall of text, i'm triggered right now. Anyways, any input would be great!

Edit: needed to provide my location. I am in Pittsburgh, PA

    Edit/Update:

The dean called me and was extremely understanding. I was assured that this would be corrected to reflect the proposal the adviser sent me given that it was what led to my decision regarding my concentration. Aside from something happening during this process, this issue seems to be resolved.

Tenant won't leave newly purchased home

    Posted: 18 Jun 2019 06:36 AM PDT

    Hello,

I have a landlord/tenant question that is little unusual.

My father recently bought a house in a small shore town in New Jersey. The house is a duplex, with an upstairs and a downstairs. While looking at the house, he found out that both the upstairs and the downstairs have a tenant, and the owner was using the house as a rental property. The upstairs neighbor has a 7 month lease, spanning from April - October. The downstairs neighbor, who has lived there for a few years now, has a month to month lease. My father bought the house with the understanding that he would terminate the downstairs lease.

The previous owners agreed to serve the tenant with the official notice on May 17, giving them 30 days to leave. (They wanted a mortgage commitment before getting rid of a tenant.) It's worth mentioning that the tenants knew they would have to leave since March 1st, when my father's offer was accepted and he told the tenants his plan for the house.

Settlement was May 31st, and the downstairs tenants would not allow an official walk through of the house. (The upstairs tenants have been extremely easy to work with, so there was a walk through of the upstairs.) We sent a letter stating where to send rent on June 1st, and the amount that would cover June 1 - June 17. June 1st came and no rent was received.

On June 14, my dad drove by the house, and saw the downstairs tenants planting flowers, which threw him into a near rage. I suggested he give a call to the tenants, letting them know he would come by to measure the master bedroom the following day, and he could get a feel for whether they were planning on leaving. (I told him to give 24 hour notice, as that is reasonable notice.) He called and the tenant hung up on him.

On June 16, she calls and leaves a voicemail, and tells him she hasn't found another place yet and would "try to be out by the 1st". She also said she sent rent to the previous owners - this was confirmed. She sent the full month's rent to them.

It's a small town, and my dad talked to a family friend who serves on the council. She advised that because of short term shore rentals, there are some lax laws to deal with renters who overstay (makes sense, as they don't want to interfere with tourism). My dad is ready to change the locks and shut off the utilities, which I've told him NOT to do, under any circumstances. My brother is ready to confront the tenant's husband/boyfriend, because he found out what bar he hangs out in and knows the owners of the bar.

Do we have any recourse here? The realtor is afraid that the tenant will try and stay until the winter - because she won't find any place in this town for the same rent she is paying ($1050/month).

I bought a gifted car from the dealership... lien included!

    Posted: 18 Jun 2019 08:52 AM PDT

I bought a car in Tennessee from a dealer on 4/25. The car was sold with no liens as is. After a month my title came in and I was told it came back from the wrong state so I was issued another temporary tag and went on my way. Then the car flooded 6/7 and was deemed a total loss. Needing the title for insurance, I started calling around trying to get it and no one had it. Not the bank I financed through, Wells Fargo auto, or the dealer. So the hunt started.

Today I was told the story on the car. The car had a lien placed on it out of state. Was gifted to an individual who did not update the registration before trading in the car. The dealership took the car. Then sold it to me. Now I have no car, no title, and money for a new car up in the air.

I'm not sure what to do or where to go from here can anyone offer any suggestions?

[New York(Upstate)] I prepaid the last month's rent on my apartment three years ago. Landlord wants me to pay the difference between what I prepaid (750) and current rent (825)

    Posted: 18 Jun 2019 05:50 AM PDT

Is this allowed? I'm moving out this month. The rental agreement did not state that the last month's rent would be adjusted to reflect future rental rates.

Can anybody provide authoritative literature that covers this topic?

Note that this is in Western New York.

    Thanks for any help!!!

    Apartment maintenance broke and entered...

    Posted: 18 Jun 2019 07:00 AM PDT

    Good morning everyone,

I'm here to seek an advice. My apartment had a breaking and entering two month ago and I lost about $700 in cash so I installed a camera in the living room. Last Friday, I saw the alarm and I recorded a maintenance guy entered my apartment and searched for 10mins (he wears apartment shirt). I checked the office at the same time and they said no1 should be in your room. I called police and went home. I didn't find anything lost but police said it's a crime and that individual will be charged. The apartment is asking me for an amount of compensation but I have no idea. They fired that individual already. The current rent is about 2k/month. Should I hire an attorney for this case? If not, how much should I ask for the compensation?

    Thanks in advance

Update: I took the advice and asked for $700 compensation to cover my cash loss. Also checked with them to see if they can waive the last month rent (I have lived their for 3 years and plan to move out next month). The manager said will update to me by Friday. It's a key fob so I don't worry much after he was fired and arrested. Thank you all!

[VA] My husband destroyed our separation agreements

    Posted: 18 Jun 2019 11:53 AM PDT

This is so outlandish and beyond my comprehension that after scouring the internet for hours I've found nothing. I'll try and make this brief...

In January my husband and I physically separated and signed a separation agreement with his father as the witness. We both had signed copies of this. This was a mutual decision, although one he was unhappy with, but we put our differences aside to move forward. We have no children or marital assets so after being separated for 6 months we would be able to get a non contested divorce.

Fast forward to yesterday. With the 6 month mark approaching I wanted to have all my ducks in a row so I go into my file box to pull out our agreement - and it's gone. The literal tab says "separation" and the slot is empty. I immediately know something is up.

I call him and tell him I need the separation agreement for (unrelated reasons) and he proceeds to say, "I'm sorry, what are you talking about?"

    Now I know for sure.

I respond, "the agreement we signed back in January. You have a copy, I have a copy. I just can't seem to find it at the moment."

Again he says, "I know we've discussed such terms but we haven't signed anything. Lets meet up and talk about it. I don't want to discuss this on the phone."

I'm livid. This asshole went into my home, took my legal documents and is now pretending like it never happened.

I've agreed to meet with him at the end of this week, simply to humor him and see where his head is at. My family knows when he moved out. They are aware we are separated. What his end game here is, I do not know.

I need to know what my options are. I've been so blindsided by this. If this is something I can redo and backdate, that's great news. If not, I'll have to start this 6 month wait all over again.

I cannot afford a lawyer, and quite frankly have nothing to lose in this divorce besides my peace of mind. He makes more money than me, he's the one who moved out, etc. My concern only lies in how to go about fixing this and moving forward.

    Thank you so much, reddit.

    Is this legal? Georgia

    Posted: 18 Jun 2019 06:35 AM PDT

I work at a small company that has 9 employees and 2 owners. The owners are married. The owners do not want you to be buddies with other co-workers. One co-worker called me this morning because she had a flat tire. I went and picked her up drove us to work and drove her home this afternoon. On our way home I got a call from one of the owners asking why we were riding together. I explained she had a flat tire so I helped her out. The owners then wanted to talk to my co- worker so I gave her my cellphone. The owner proceeded to curse at her and told her to take off the rest of this week with no pay. They also want to have a meeting with me in the morning.

Is there any legal recourse for them making her take a week off without pay?

Do I have to listen to them yell and curse at me?

Apartment Complex falsely submitted an application on my behalf and is now asking for $$$

    Posted: 18 Jun 2019 09:12 AM PDT

A few months ago I was doing some apartment hunting, as my lease was expiring and my apartment manager was trying to increase my rent by too much. I came across one complex(let's call them "SR") that fit my basic requirements and went in for a tour. The unit that I toured was incredibly small and looked nothing like the photos and floorplans posted on SR's website. Despite this, I was still interested in the apartment because the price/location was good for my current situation. The application process for these apartments are done online, so when I made it back to a computer after the tour I attempted to complete one.

However, there were issues with the website and I couldn't even get past the portion of the application where you provide personal information and rental history. To completely submit the application, you would have to complete an E-signature and pay an admin fee, which was $160. I tried and failed a couple more times before emailing my contact with SR. She had me try a couple more times to no avail. The application was never submitted at this time.

The next day I met with my apartment manager, and he actually agreed to not increase my rent if I was to renew for another year. I took his offer, as the apartment hunting process had gotten nowhere and I didn't really want to downgrade into a smaller unit in the first place. Any interest I had in SR was gone.

Later that day I spoke with my contact at SR on the phone and explained that I was renewing my current lease. I don't know if she just didn't understand or just didn't care, but she emailed me a few times after that asking me to provide my last 3 paystubs, and to submit the application again. I never responded to any of these requests, not even once.

However, I received an email later that day from what seemed to be SR's automated business email. It was a generic message that said my application was submitted and approved. Like the emails before, I ignored it, though I thought it was strange. A month later I received a 'Move out statement' email from SR that said I had an outstanding balance of $160. I ignored this because it seemed like the dumbest sh*t ever considering I never submitted the application, never moved in, never paid a deposit, and never even spoke to anyone from SR after losing interest and renewing my lease.

Last week I get a call from a debt collection agency, who is trying to get the $160 for the SR application fees. I explain to them how I never submitted the application, and they claim that my e-signature was on the application and that since I had ATTEMPTED to complete an application, that it is perceived that I requested SR to push the application through due to the complications with the website. This is false. I never made an e-signature OR asked for them to just push the application through. I did cut off contact and stop responding to their emails about the application, but you would think that would alert them that I was no longer interested instead of wanting them to push the application through. I guess I should've been more adamant?

It's only $160, but I refuse to pay for something that I didn't sign off on or personally submit. I also do not want this to be reflected on my credit report. Lastly, I'm furious at the fact the apartment submitted a false e-signature.

What are my options with getting this thrown out? Can the debt purchaser report this to the credit bureaus? Can I go after the complex for submitting a false e-signature, and would it even be worth it? This occurred in Georgia if that is important.

Doctor didn’t do job, now I need reconstructive surgery. (TMI WARNING)

    Posted: 17 Jun 2019 08:14 PM PDT

So backstory: I live in California by the way. I had my daughter this last February(2nd child).. the labor itself was a mess (anesthesiologist took 11 tries to place epidural, causing a spinal fluid leak which needed a blood patch to fix... and then the epidural medicine ran out 3 hours before I had her and they apparently had "none left in stock"... but that's a whole other fiasco)

Anyway, she came flying out and I tore pretty bad... and as I was waiting for her to stitch me up, she looks around the area and goes "eh.. it'll be fine" and just leaves the room.

    It was not fine.

After a month of waiting for a sign that I was healing, I was worried because it was more or less just as bad as the day I had her... so went to see my regular OBGYN who took one look and said "why does it look like you weren't stitched up?" I told him the story and he was pissed. He sent me on my way with some birth control (a nuvaring, that's important later) and a "come back in a month and we'll see how it is"

Well I try the nuvaring... won't stay. I thought I had done it wrong.

My first period came. Tampon won't say.

Was healed enough to be intimate, NO FEELING.

So I go back to my OBGYN and he's sorry to inform me that there's nothing he can do besides surgery... we schedule it and I'm going on tomorrow.

My question is; what can I do, if anything? Shouldn't she have known better? I had a tiny tear with my first and they stitch it up. It's caused me so much grief... but I'm dead poor and on government benefits and I'm not sure I can sue or anything. I just feel like I was completely screwed over...

(California) Feral peacock attacked and damaged guests car on my property. Am I liable?

    Posted: 17 Jun 2019 04:07 PM PDT

A guest parked their car on my property. A feral peacock came by and attacked the vehicle while parked in my driveway (they occasionally attack their reflections). The guest now wants compensation for the (minor) damage done to their vehicle.

The peacocks are not pets and they range all over the neighborhood. They have been in the neighborhood for decades and were here prior to us moving in. They freely travel across numerous (40+) properties in the area and are owned by nobody. The neighborhood council also frowns on anyone harming them. They occasionally attack vehicles, even those parked on the street. We sometimes feed them, but they are not reliant on our care to survive.

Am I responsible for the damage done to this persons vehicle? Are they entitled to file a claim through my homeowners insurance? The damage done is very minor. I can't imagine it would exceed $200 in body work.

    Next steps against extortion

    Posted: 18 Jun 2019 10:03 AM PDT

Hi, I'm new on reddit but I really needed advice. I'm a 22 year old college student.

Last winter I was home in a different city, and matched on a dating app (I can't remember if it was Bumble or Hinge) with this 22 year old girl from the city of my college. We talked for about two weeks, and when I returned back to the college, we went out for a drink. Afterwards she invited me back to her apartment, and we drank a beer and then proceeded to hook up.

In the next few days, we hung out at my place a couple of times, both of which involved sexual activity (hooking up). One weekend night, I got drunk and I invited her over to my place, to which she responded that she did not just wanna have sex. I replied that that was okay and we came back to my place and cuddled.

Later in the early morning, we started talking and conversation led to sex. She was as much involved as I was because at times she was on top of me. Then she proceeded to leave.

Later that day, I texted her "Hey last night was fun" to which she responded in the terms of "you're just wasting my time, I don't want people who waste my time, I didn't really wanna have sex but we still did, so lose my number". I can't remember if I responded with an apology or just went radio silent, but I deleted her from messages and blocked her on all social media. No communication for months.

Fast forward to early April, I drunkenly texted her at 11pm on a Friday night saying "Hi! how have you been". We both have iPhones, so the next day she sent a 'haha' reaction to that message. No further communication.

Today, I received a message from her saying "I sent you something on Venmo so I would just complete the request to avoid any conflict about things☺️"

When I checked my Venmo, she had requested me for $250 and this is what it said "You know what you did and to avoid any conflict or trouble I would just complete this request so that we can pretend nothing ever happened :-) very simple. Declining this request will just make it all more complicated 🙃 I want by the end of this month. Thanks!" And then she had sent a friend request on Venmo.

I am dead sure nothing wrong ever happened between us, and that this is just poaching me for money, but I don't know how to approach this situation.

Any advice will help!!! Please and thank you!!!

Neighbors allowing transients to live in driveway, effecting my safety (CA)

    Posted: 17 Jun 2019 09:43 PM PDT

Los Angeles homeowner. Next door neighbor is elderly and is allowing 2 transients to live in a vehicle in their driveway. They have lived there off and on for the better part of nearly 3 years (mostly on) and I have been under the impression that there is nothing I can do about this, as it is private property. However, last week these unwanted guests have endangered my safety and I am asking for assistance.

    • After midnight on a weeknight a person attempted to climb over the shared fence and into my property. Police were called, person was not caught. Transients pretended to be asleep when cops came questioning, despite video showing they were "entertaining" in the driveway less than 5 min prior to the break in attempt.
    • There are frequently people stopping by late at night for less than 5 minutes while they chat in the driveway
    • One to two people live in the vehicle (one comes and goes as the relationship sours)
    • Word-of-mouth from another neighbor indicates that they are likely (almost certainly) selling drugs
    • When police inspected the property next door they indicated that they have excess refuse in their yard and that one of the transients had "stab wounds in her face"
    • They are frequently heard scuttling around the property at all hours of the night, directly outside my bedroom window - off my property, but only by a few feet, and frequently, and audibly enough that I am woken up throughout the evening, even with the TV on. Some of these incidents are them "repairing" their vehicle with the aid of bright lights and tools.
    • Neighbor is both elderly and in poor health and is never seen outside of the home

Due to the break in attempt and the disclosure of evidence of violence by the attending officers I no longer feel safe on my property. What, if any, steps can I take to have these people leave quickly and peacefully. As I cannot access the homeowner without also engaging with these people, and I only have circumstantial evidence (indirect video of the late night drug sales) and hearsay from the other neighbors, I am at a loss.

[UK] School lost a sentimental, religious item, what can I do?

    Posted: 18 Jun 2019 08:19 AM PDT

Not me, it's a friend but the doesn't have Reddit.

PE Teacher = Bob Friend = Jeff

Basically, Bob told Jeff that he had to give Bob his chain, made of metal and has a cross on the end, that came from his mum's friends deceased grandma (They were close), because they were doing Physical Education. Bob said that he would give Jeff the chain at the end of the lesson, but Bob said that he lost it by the end of the lesson. Jeff would rather have the chain back, but Jeff's parents are willing to report it to whoever they have to to get it back.

TL;DR: Teacher lost students chain that he had to take off for PE. It has great sentimental value and parents are willing to take action.

Is there some kind of law against this? And is the school liable for this? It's technically religious wear, since it has a cross on it, and it has great value to Jeff and his family. Also, should the school not do anything about it, who is the next best person to report it missing to?

My Roommate got my car impounded

    Posted: 18 Jun 2019 11:55 AM PDT

Hey, so I have a pretty annoying situation going on. My roommate borrowed my car (me not knowing his license was suspended). My car got impounded by Phx PD and my leaseholder repossessed it from the Police Impound lot. After calling my leaseholder how I can get my car back, They are telling me there is a 30-day hold on the car and I can not pick it up until next month. Since I was not the person driving with the suspended license. Can they legally hold my car for 30-days while I'm still making monthly payments?

Wife (probably) lied about paternity. Divorce pending. What steps should I take to protect myself?

    Posted: 18 Jun 2019 07:24 AM PDT

Hi everyone. A little background: My wife and I have been married for nearly 10 years. About two years ago we separated (she left me for a coworker who ended up dumping her shortly after) We have a 5 year old son together who up to that point whose paternity I never questioned even during the separation. I took her back and we bought a house together, but since then I've had some nagging doubts as to whether I'm his bio father. He doesn't look a lot like me, looks way more like his mom. His hair is also quite a bit lighter in color than mine. This is a nightmare for me as I love him more than I've ever loved anything. He and I are super tight, and at this point even if he's not mine biologically I don't want a life without him in it.

Fast forward to the current day. Wife just had another baby. When she was born the docs said she was several weeks more developed than she should have been if the conception date my wife gave was accurate. This would mean that the dates don't line up conception-wise. She's not a good liar and having known her for so long I feel like I can tell when she's lying. To me it seems like she's being dishonest. This baby also has light blonde hair. I have black hair. I know that it's still possible for her to be mine but the doubts, as well as the prior infidelity were reason enough in my mind to ask for a paternity test.

So I asked. The test will happen in 2 weeks. And the wife has gone ballistic. Messaging with her family on Facebook, slandering me with lies to cast me in a negative light. Silent treatment. False accusations. Every dirty trick she can think of. To me it seems like she knows that the paternity results will show that she cheated and she's trying to get in front of it and garner as much sympathy from others as possible.
Me, I've remained reasonable and am trying to be as emotionally detached as I can be. There are also 2 older kids from her previous marriage. They're 11 and 12 and I've raised them as their step father. They so-far have no idea about any of this.

Financially, for most of the marriage she was the primary breadwinner, earning about 65k vs. my 40k. Recently though she lost her professional license due to a criminal conviction and is currently unemployed with little prospect of ever resuming her career. House is in her name ( I'm fine with her keeping it, the kids need their home and I don't want them to suffer)

With her reaction to me asking for the test it's going to be difficult if not impossible to repair the relationship. I can't foresee a way that this doesn't end at least with a seraration. What steps should I take to prepare for the likely divorce? With her current unemployed status am I going to be on the hook for alimony? How is that calculated? I have no idea how to proceed. Any help is appreciated. Thanks.

[Texas] I’m back after taking some advice here and reporting my stolen Roof of my Wrangler to insurance. They have been no help, when is it time to go to small claims court?

    Posted: 18 Jun 2019 10:37 AM PDT

So 3 months ago I bought a car, few weeks in my roof was stolen while my car was wrongfully towed. They gave me pictures of my car before it was towed and those pictures show my two front panels of my Wrangler on my car. When I picked up my car those panels were gone.

Gieco told me 1 month ago "you'll pay the $500 deposit for the new roof but we'll reimburse you after we get our legal team to assess your claim. I call Gieco yesterday for an update and they told me "what is it you want us to follow up with "towing company name" about?" Unmmm what? You said you'd call me with updates and your telling me you haven't done anything?

So now they tell me again "we'll bring this to legal and liability and see if they'll take action" but warned me they might now if the towing company has "not responsible for theft on lot" at their tow lot.... duh hell?! I didn't even want to put through a claim if they weren't going to Make this towing company pay. I work for Oracle and they offer a free legal team to their employees, and Gieco told me they'd happy go after then when I was filling the claim

Wife's employer wants to recoup paid wages (NY)

    Posted: 18 Jun 2019 08:31 AM PDT

My wife is in the medical field. Her pay is calculated as a percentage of incoming insurance payments made to the practice. Recently an insurance provider made a decision that they've calculated around $17,000 was overpaid to the practice. Employer/owner of the practice states that my wife is therefore responsible to pay the practice back her percentage received of those payments. My wife strictly provides care and is not involved with billing and insurance.

I'll try and clarify any muddled details and appreciate any insight anyone can provide.

    Thanks!

[NY] Father has unbelievably loud motorcycle. What are the laws regarding this?

    Posted: 18 Jun 2019 09:12 AM PDT

Background: My father has the mind of a reckless 19 year old in the body of a 41 year old man. He has recently gotten a motorcycle and has started modifying it.

It's insanely loud, which I'd normally write off as being just a nuisance and leave it at that, except he works night shifts so when he comes home at 5/6am on his motorcycle it's enough to wake me up out of a deep sleep even with my windows are closed. I imagine it's also enough to wake up anyone close by too (live right across from a trailer park and I'm fairly sure they're being woken up in the mornings by it too.)

I'm not completely sure what the laws are regarding motorcycles but I know you can get in trouble for having loud music playing in your car, so surely you're not allowed to have a motorcycle that's disturbing the peace this much either? If he's actually breaking the law (which I hope he is because I'm sure the entire neighborhood doesn't want to deal with his midlife crisis every morning) I'd like to report him to the non-emergency line anonymously if I can. Just wanna make sure I know what I need to know beforehand.

Apartment Complex lied to me about about unit’s availability in order to try and make me rent a more expensive unit.

    Posted: 17 Jun 2019 06:49 PM PDT

Edit: As a fair amount of people seem to think this is just an issue of slow system updates or miscommunication, I have added more details of the story which I believe support my suspicions she was intentionally deceiving me.

(Ohio) Recently I have been looking for a place to move. I had decided on an apartment complex but was trying to pick between two different units. One unit was a prime location, but expensive. The other unit was not as great a location, but was being offered with a substantial discounted rate and one month of free rent as well. The price difference between the two would have been $4000 for the year.

I was back and forth for a couple of days, but eventually decided to rent the cheaper unit. On the final day of the promotion I went to the management office to put in my application for the cheaper unit. When I got there, I was told that unfortunately someone had put in an application for it the night before and it was no longer available. I found this strange because as I was pulling into the complex that morning I saw her showing that very unit to a couple. Yet 10 minutes later she was saying it was unavailable. (No the couple didn't take it). Regardless, I asked her to let me know if by any chance it fell through. Later that day she emailed me and confirmed that the unit had been "secured".

Because of this I was left with no choice but to rent the more expensive unit. She knew I was on a very tight time frame and didn't have many alternatives.

Over the next few days I noticed that the cheaper unit was never removed from their web site and is still being shown as available to this day. I know from my conversations with the management that anytime an application is submitted for a unit it is automatically removed from the system. The one I applied was removed the same day, and I haven't even been approved yet. Yet the one that was applied for and "secured" is still listed as "available"

I began to suspect they lied to me about the cheaper unit being rented so my only option would be to rent the more expensive unit. She knew I really wanted the nicer unit, but was having trouble justifying paying so much more. Since then I have confirmed my suspicions in various ways. Beyond the fact that it's still available on the website, I have called both their regional leasing center and the corporate headquarters who both confirmed that unit was available. I have also had friends call and email the very woman Who told me it was rented to check on apartment availability. Sure enough they were told it was available.

I know this is extremely sleazy, but is it Illegal? I have documented/recorded various conversations and emails to show proof that they lied to me. But do I have any recourse? As much as I'd like to just walk, I am very short on time to find somewhere else to live. The best outcome in my mind would be if they gave me a significantly better deal to keep me quiet. However I don't know how realistic that is.

    Any help would be appreciated.

Utah - Car Stolen, Someone else bought it, cops say they own it now?

    Posted: 17 Jun 2019 10:22 PM PDT

I switched the insurance off of Car A to briefly cover a Car B I had purchased while I drove it home from from out of state. While heading home I'm informed by family that Car A has been stolen. I had my title in my glove box because I'm an idiot and didn't know better. I file a police report and don't hear anything for several months.

Later, I call the officer handling my case and I'm informed the car has been found - A small dealership in Salt Lake City has purchased the car and subsequently sold it to another person.

The police are telling me this person now legally owns the vehicle even though I never authorized the sale of it, never claimed insurance on it, and have filled out handwriting tests and whatever else to prove I did not sell my car.

Do I attempt to take the new owner to court? The dealership? I read an article where this same thing happened in another state and the police returned the vehicle to the original owner.

    Thank you in advance.

I paid $5500 for work on a food truck that was never completed. I have not been paid back yet even after reaching payment plan agreement. Should I file in small claims?

    Posted: 18 Jun 2019 07:22 AM PDT

    Hi,

    Thank you for reading.

I own multiple food trucks and have had them all built by the same person who we will call "guy". I wrote him a check for $5500 probably around 15 months ago for a food truck build.

The work that I paid for was never completed and the money was all REFUNDABLE.

In January, 2019 I reached a agreement to offer a payment plan to "guy". The payment plan was for 8 months with 10% interest.

He made the first two payment and has not made a payment since. I am ready to file in small claims court since he has missed this many payments.

What am I entitled to? Can I ask for additional interest and the fees for court?

If I include a amount on the paperwork to file, can that amount be changed to add more interest if it takes day 6 months to get through the court date?

Is small claims court the correct place? I live in Texas and it is allowed up-to $10,000.00
