Posted: 27 Jun 2019 06:17 AM PDT I had a c-section a couple days ago so I had my MIL come over and help me out. She and my husband went to the grocery store last night and got into a bad accident... She had turned left on a green light after the green arrowed. She was t-boned and both my car and the other car involved was completely destroyed. She apparently had an expired licence and told no one about it... I'm very afraid right now since it was my car she was driving and I'm afraid the other person will try to sue me. I am getting a lawyer, but I want to know what to possibly expect. My location is Pennsylvania EDIT-- Sorry I'm slow on responses. I'm in the NICU with my son, so it's hard for me to reply to everyone here at the moment. Here's more information- I have progressive insurance My inlaws insurance will not cover the crash. The other driver was not injured. The only person who was injured was my husband who was in the passenger seat. My car was t-boned. The front of the other drivers car got really screwed up. My husband is visually impaired and does not have a license and is not on the policy. I'm the only person on the insurance. I did not know MIL had an expired license until after the accident. No one knew other then her. It expired maybe 2 months ago. She has no histories of duis or anything. She was at fault. The accident happened at an intersection. There is a left turn signal but the light was just green with no arrow. I spoke to my insurance earlier today. They are calling her. No update on that yet. My insurance is apparently going to cover this but my premium will go up. As far as my fear of getting sued, I'm getting a lawyer. I have no idea if there is a chance the other driver will go after me or my MIL. I don't have a ton of money but my in laws are loaded. [link] [comments] |
Charged $750 for a negative review Posted: 27 Jun 2019 11:22 AM PDT Hi all! My parents recently just took a vacation to Key West, Florida. While there, they paid to take an hour and a half jet ski tour. While on this tour, the tour guide sped through and it ended up only being a 50 minute tour. She told the tour guide about their displeasure with the tour, speeding through and not being able to see as they sped through, and the tour guide was very rude and dismissed them. My mom took to Trip Advisor, Yelp, and Google to leave a negative review about their experience with the tour company. The next day they were charged $750 by the company, my mother called, and was told by the owner that they were charged the $750 due to leaving negative reviews which was slandering their company and then proceeded to hang up. Is there anything they can do? My parents reported it to their bank as fraud, the bank said it wasn't considered fraud and that it was a dispute. The local police also were no help when called. Since this situation occurred, the company owner has used my mother's Facebook pictures and shared them all over Facebook, with messages saying she was extremely drunk, and didn't know what she was talking about. (If she was drunk why would you let someone on your jet skis? Is that not a liability? 🙄 My father then called, threatening a lawyer and the money was eventually refunded. I just wonder how much these people have made off of people leaving negative reviews about their company. Is this legal? Can you be charged for leaving a negative review? I've never heard of such a thing. Thanks in advance! [link] [comments] |
My school used my cancer for money Posted: 27 Jun 2019 10:01 AM PDT Apologies in advance as a mobile user for formatting issues. I have stage 3 Hodgkins Lymphoma which is very treatable, I believe it has a 90% success rate of treatment or so. Whatever the case, my family did not have insurance for the first few months of my treatment and let's just say chemo is a lot more expensive than I could have imagined. My older brother created a go fund me for this reason (lower middle class family) and my school administrators caught wind of our financial troubles. I should explain first that my school has a very strict uniform and that free dress days are used in order for the school (a charter school) to raise money for programs such as robotics and other extracurriculars. The last few weeks of school were advertised as being all free dress days in an effort to raise money for the guy with cancer. In our small town the entire school had heard of my health related dilemma so the turnout was excellent, even more so considering that the price for a free dress day was increased for this event. After the fundraisers and school had ended we never heard from the school. I suspect that the money had probably been used for something else already. Is this illegal? EDIT: I live in the state of Texas and it has been approximately one month since this series of fundraisers. I apologize for not having read the rules of r/legaladvice EDIT 2: On free dress days students present a teacher with their money by the entrance and receive a bracelet signifying that they are not to be punished for their attire. I apologize if this was unclear. [link] [comments] |
Drunk falls into my friend on an airline, breaks my friend's knee Posted: 27 Jun 2019 10:49 AM PDT So my friend is flying home. Someone who was extremely intoxicated fell over onto her as they were getting on the plane. As they fell, my friend landed on a suitcase and snapped her knee the wrong way. This injury is pretty bad and now she has trouble going up stairs, getting in and out of the car, etc. There's a long wait to see a doc here (california), so we won't know the extend of the damage for another month. Not being the type to sue, she just says her insurance will cover it when they get the medical bills. Not sure what information she collected at the time. Any thoughts as to what she should do? I tend to think the airline might be liable, particularly if the person was drinking on a plane before hand. She might be entitled to more than insurance paying for an MRI. [link] [comments] |
Posted: 27 Jun 2019 07:06 AM PDT Alright, guys. This is long. Hang in there. I was born in Russia in 1998, where I was properly given over to the state by my birth parents to be adopted. Neither my birth parents, nor any of my biological family, had contact with me for the state-mandated full year to keep me eligible for adoption. In 1999, two US citizens (born in VA and WI, respectively) came over to visit my baby house, where they picked me. They initiated and finalized the full adoption in Russia, and I believe they forwarded this information back to the US via their adoption agency. In December of 1999, I was legally granted access to enter the US on an IR3 visa, at the age of 22 months old. Fast forward to when I was seventeen, and for some reason my parents decide I need a green card? So, that's what happened. I went and got a green card. Only.....I don't think I should have gotten one. Under the Child Citizenship Act (CCA), any adopted child who entered the United States on an IR3 visa would have automatically acquired citizenship on the date all of the following requirements were met:
USCIS goes on to say that children who meet these criteria would have been mailed a Certificate of Citizenship in 2004. I called USCIS to ask about this, and thye have no record of sending that document to me or either of my parents. I just don't know what to do! I have this green card, but I believe this was a failure of the immigration officer handling my case to have not pried more about my circumstances (as I was only 17 at the time and didn't *know*), but by the looks of it I should be a full fledged US citizen. Also, I worry about getting stopped by Border Patrol or ICE and not being able to articulate these facts, and just having to act like a green card holder. What should I do? Thanks, guys. [update] My country won't renew my passport and it is putting my immigration status at risk Posted: 27 Jun 2019 01:00 PM PDT I wanted to do a quick update to thank everyone. Back when I submitted my question, I was wondering if I should wait out to get a passport renewal and pursue an OPT extension or to apply for a greencard. You guys told me to apply for a greencard as soon as possible, and that if I waited for the Venezuelan goverment to get their act together I was going to fail and you were right. We applied for the greencard and I got an expedited work authorization with the help of one of our California congresspeople. I was able to continue to work without any interruptions and I'm now waiting for our greencard interview. It will still be many months before I receive a greencard but for now I have a work authorization and travel permit. I do not have a new passport however, the Venezuelan goverment is still on fire. We now have competing presidents and an US embassador with no power to issue new passports. The US did agree to accept expired Venezuelan passports for 5 years (although I don't think I will be traveling anywhere and putting that decision to the test, and leave my right to re-enter the US in the hands of a CBP agent). If I had waited to get a new passport I would have been screwed out of luck and you guys gave me the courage to choose the more lengthly but ultimately much safer option. [link] [comments] |

Posted: 27 Jun 2019 10:51 AM PDT This is in semi-rural Oregon. I have 15 acres of mixed pasture and forest, with a house, power, a well for irrigation, and domestic water via district watershed line direct to house. One of the properties that borders mine (on two sides) is about 50 acres of forest, and is entirely undeveloped utility-wise (no power, no water, no easements for either, no house). This is the property at issue, which the owner (we'll call Fred) bought in the early 90s, and is now trying, rather desperately, to sell. All properties involved are zoned exclusive farm-forest use (EFU; one residence p/80 acres) My property is almost a perfect square, with almost perfect North, South, East, and West sides. Fred's property is shaped like Oklahoma (upside down) and it surrounds mine on two sides, so my entire South and East property boundaries I share with Fred (with the panhandle on my South, and bulk of his property to my East). Fred and I have basic "ingress & egress easements" along a private road owned by the property owner to my West (who is not involved in this, but we'll call Jed, he's got about 50 acres). I only mention that access easement / private road because running a power line along that road is not an option. Jed is very firm on that, as his road (which we have access easements along) is densely forested with near old-growth 120-150 year old trees with significant stumpage value. So, the power line currently runs above-ground through Jed's land to my West, and ends at a post in the pasture between my house and Jed's property, at which point the power line then runs underground the 100m or so to my house/shop/garage. This is by far the closest existing power source to Fred's property, the next closest is almost 1/2 mile away. Fred wants an easement through my property, so he can run that power line from where it ends in my pasture, above-ground in a general Southeast direction until it hits his property line. Based on preliminary conversations with the utility, running that above-ground line will require at least three big posts to be sunk in my property, and the power line will cross my driveway, then cross my creek, and go up the hill to Fred's property. In sum, it will avoid my forested areas (thus, will only require cutting 2-3 trees down) but will be incredibly visible from virtually every room in my house, and every location on my property. It will dramatically change the character of the property. Currently, you can only slightly see where the above-ground line ends in my West pasture and goes underground (if you're looking for it), other then that, it's all natural pasture and forest except for my little cluster of house/garage/sheds/gardens. Fred's a reasonable and relatively sweet (albeit naive) guy, but he really wants to sell this land-locked property he can't afford to develop himself, and he has dropped the price $90k in the last 12 months simply because virtually no one will finance the property without power. So, because he finally found a buyer willing to deal with the easement / power headache, he's putting a shit load of pressure on me to agree to the power line / easement. He's also repeatedly said "the buyer won't agree to anything more than $5k, so if your number is higher I'm pretty much just fucked / can't sell this place and will have to look into other options of how to get power there that might not involve you." Which is (a) quite emotional, (b) not fair to me, and (c) not really my problem. All that said, his repeated claim that "if your easement value is too expensive I'm gonna explore other options that might not involve you" got me thinking, and a bit worried. As such, I thought I would explain the situation here and ask a few questions: [as a preface, I am ready and able to meet with a local land use attorney if/when necessity arises, rest assured, I would not kid myself and pretend I can handle this shit myself if it gets litigious, I've just always appreciated the general guidance and brainstorming I've seen on this sub and want to ask some questions before I go down that path] (1) How do people value easements like this? I've heard 10 different calculations. Diminution of value to my property; difference in their property value before & after power; value of my participation in the development of the benefited property; price of the engineering + diminution of value to my property; etc. What is a reasonable calculus here? Is there any easement valuation/appraisal method attorneys use regularly? (2) What if I just say no? I've obviously considered this, but at the same time, I'd like to help old Fred if I can, I mean "there's a price for everything," I'm a relatively young guy, it's likely I'm not going to own this property forever. That said, what if I just said "no, I won't sell this easement, I won't have power lines ruining the vibe of my land"? (maybe just see questions 4-5 below) (3) If I say yes, are there serious restrictions on land use that come with power easements? Does it mean the power company can drive a vehicle under the whole length of it and cut down any trees they think could interfere with it? What if I want to move my irrigation waterline from my well to an area within their easement / under the power line, do I need the power company's permission? Can the guy who buy's Fred's property have access along the easement / under the power lines? (you don't need to answer those individually, just some of my concerns). (4) Is there a way for the power company to condemn my property to run the power line? I know power companies can condemn property for transmission, but would/can they for a single un-built residence on EFU land? (5) is there such thing as a "way of necessity" action for power lines? I know you can file a "way of necessity" claim for access to landlocked property in Oregon, but can you for power? Thanks in advance for your time. It's much appreciated. Sorry it was so long, but I figured as much detail as possible was helpful for considering land use issues like this. [link] [comments] |
Bullies put laxatives in my cousins drink Posted: 27 Jun 2019 12:20 PM PDT [MD] This happened in the beginning of last month. These group of bullies slipped a laxative of some sort into my cousins drink. Then they locked him in a changing room. Where he had to poop on the floor. The boys were severely punished by the school. The punishment extended to the next school year and they had to apologize to my cousin. The issue is one of the boys got a picture of the poop on the floor. They've been sharing it on Snapchat and basically making memes about him, the whole school knows about it. My cousin didn't want to go back to the school and completed the rest of the school year from home. Now that the school year is over, my cousin doesn't even want to return to the school, ever. My uncle/aunt understand but they're furious about the situation. The school that my cousins went to is a really good but very expensive private school. My cousin is smart and was there on a partial scholarship. He would have to switch to the terrible public school in his parents school zone. I think my cousin could have a case against the parents of the bullies. Although there was no medical treatment needed for my cousin. I just think the public humiliation my cousin suffered is enough. But IANAL and would appreciate any advice offered. [link] [comments] |
Old boss trying to track my work across state lines (RI and CT) Posted: 27 Jun 2019 05:00 AM PDT I recently left a job as a project manager on what I believed were good terms about 3 months ago. I'm a relatively seasoned professional in my field, which involves tracking progress on large projects which have state oversight, and writing completion reports on these projects, which are often submitted to the state. For background, I'm in the environmental remediation business. The question comes from that I recently received a letter from my former boss, who owns the small (8 people total) firm I worked at, saying that he believes I violated my previous contract by bringing my old work with me, which the contract states belongs to the company. His evidence of this was that he had people go to the Connecticut Environmental file room and pull files under the Freedom of Information Act, pay to make copies of work I prepared at my new job, and compared writing style and content. He said to expect to hear from his lawyers regarding this issue. I did not bring my previous work with me, and signed a document saying I did not make copies of any work I prepared at my previous job. I'm wondering if he has a legal leg to stand on in this matter, and if I should be worried about this. I know he does NOT keep a lawyer in house for the business, so he would have had to retain someone. [link] [comments] |
Posted: 26 Jun 2019 09:26 PM PDT Hi! obligatory long time reader, first time poster etc etc! i'm 17 years old living in LA, California and on the 27th of June this year i was scheduled for open heart surgery to fix a hole in my heart. We have known about this hole since around January, and only a couple of weeks ago my father decided that he would no longer agree to sign the doctors' agreement to operate on me. his signature is 100% needed as my parents have 50/50 custody, even though i have not been living with him for ~4 months. recently, my doctors called and said that it would be very, very ill advised to postpone my surgery as i was supposed to have it within 6 months of my original diagnosis. this makes it a "you wont die tomorrow if we dont fix it, but you are in grave danger" situation. i worry that putting off my surgery could lead to major health consequences and even death, and i have been told that i should contact CPS or a social worker of some sort to help get me the surgery without my dad's permission. however, the case would likely take months to get a solution to and even then.. i worry it will make my relationship w my dad irreparable :/ can anybody help? Thank you so much for anyone who took the time to read and maybe help out!! :) TLDR: Im 17 in CA and in June i was supposed to have semi-urgent open heart surgery until my dad who has 50/50 custody of me refused to sign the doctors' agreement. what are my options here? Posted: 27 Jun 2019 09:48 AM PDT Hello reddit. First time poster and somewhat of a new user. Have you all heard of the low income help? Where the government goes and gives free services like free water efficient toilets or water heater or similar things like that. Well recently a group claiming to represent the Maravilla Foundation (the group that helps low income households) came to us and offered to fix our "faulty" heater that was installed by the same foundation. Someone came in with one of those electric pads to get our signature so they could get started. Seeing as how we had this foundation help us out before we said ok. The signature couldn't go through but they started anyways. We allow them to do it then when they finish they let us know our roof has a bit of damage and offer to fix it for free. They removed our solar panels, finished the roof and left without reinstalling the panels. Few weeks pass and we begin to call up seeing who's going to re install our solar panels. Well when the roof was being installed a few friends and neighbors came and asked about it. We told them who they where and it was free, we gave them their contact info and they had work done on their house too. Word of mouth spread to 2 more people and 4 houses were worked on. We come to find out from one of the houses that had work done... That they had a lían placed on their house without their knowledge or approval . So we begin to do our own research and sure enough we have the same thing totalling to 111k. We manage to get the details and it had a completely different phone number and e mail we're not associated with. Not only that but the "signatures" and initials signed on the contract don't belong to our handwriting. That's not all! The people who forged the signature signed the wrong last name. (old style family names in Latin American countries are a bit different, when the woman takes the last name of the male they add "de" which means "of" followed by the last name. Well they signed my fathers name with "de"and initialed MD which is wrong. Now there's 4 household with forged signatures and we don't know what to do. I think our household got lucky that the pad wasn't working so they had to guess and forged it wrong. So umm yeah... What do we do? Tl;Dr 4 households involved in fraud and forged signatures. What do? Edit: Everyone involved is floating ideas out now we're thinking of calling the news channel. It seems big enough for them to get involved. Should we avoid them and just go to the DA or courthouse as was suggested? Right now I'm heading to the police station to get their opinion. [link] [comments] |
I am being sued by my girlfriend's father [Tennessee] Posted: 27 Jun 2019 09:29 AM PDT Hello all, I (H) am being sued by my girlfriend's father (D). The claim is as follows. I had a black truck valued around $1500USD. D had a red truck valued approximately the same. I wished to sell my black truck, D wished to buy it. I allowed D to keep and use my truck for no charge while he attempted to sell his red truck, at which point he would buy my truck. Several months pass and he has not sold his truck, he asks me if I have any ideas. I have a friend (T) who is a backyard mechanic and buys/sells all the time. I mention taking the truck to T and seeing if he can sell it. D drives the truck to T, I follow and give D a ride home. T starts to show the truck to a potential buyer and it will not run correctly. T claims he did nothing to it because why would he. Several months pass, D and his wife separate, he falls on hard times. He leaves his home and my truck, so I retrieve my truck and it is back in my posession, which brings me to today. He texts me, says he wants the truck fixed and back in his possession, or the agreed upon sale price or he will see me in court. I tell D that if he wants the truck back we can make arrangements for him to come get it to which he replies "I will see yall in court." Also worth noting that D's name is not on the title for the red truck. It is in his wife's name. This has me shaken somewhat as I have never even been in a court room. I'm at work not able to focus and I'm trying to get my options together here. Any help at all is much appreciated. [link] [comments] |
Flooding likely caused by distinguished, unincorporated community building around our neighborhood. Posted: 27 Jun 2019 05:52 AM PDT [TX] Our neighborhood was built in the late 80s along with our HOA. There are around 100 homes. Someone mentioned that one of the homes/properties is in a 100 year flood plane - this property is on around 10 acres. I don't know if this is true or not. A unincorporated development (CDP) starting building to our north in 2001. Over the years they have grown to 1500 homes all around us. About 18 months ago they started building to our south, first neighborhood to our south, which is on decently higher ground. They put in a retaining pond. As more of these homes went in, the flooding in our neighborhood has gotten significantly worse. Last spring water started seeping into our home. Luckily we were there and able to prevent damage. Whenever there is significant rain our pool floods (could be due to grading issues in our own yard) but water covers our yard and in several locations the water can be over a foot. It is really like a running stream through our yard every time it rains. It comes from the south and through our yard and into our front yard before finding the culverts. The problem is the culverts are not designed to get this much water. They overflow and little ponds are created in our front yard. We are not alone in this and has been the talk of many home around us including our neighbors to each side who have similar, significant issues. My direct neighbor has a ditch on the opposite side of his house which is overgrown and always holds water. I imagine if this ditch was cleared out it may help. Is the CDP responsible at all for creating flooding issues? Would this have been researched before homes were built with proper notification sent to the homeowners it could effect? Our community and the CDP share a zip code and school district, but we are part of a different town - even though the CDP surround us to the north, west, and now south. [link] [comments] |
[US-CA] New job offer rescinded after current employer filled out Employee Verification Posted: 27 Jun 2019 01:05 PM PDT Hey Legal Advice, Hopefully, this doesn't come off the wrong way as I am a bit annoyed at the situation. I am currently employed as a "Junior Infrastructure and Systems Administrator" at least that's my job title listed on my employee offer letter and employment contract at my current employer and what the job duties have entailed "Managing Corporate Cloud and Network Infrastructure" etc. I've been here for 4 years and have been shopping around for a new job in my area more attuned to DevOps/Senior Infra Engineering or Sys Admin etc with the duties that match it in addition to moving with my wife to a rental home. A week ago I got an offer letter from a company in the area with a pretty big substantial pay increase to what I am making now and other benefits and was beginning to make my preparations to leave my current job and take that job. However, today I got a call and an email informing me that the offer has been rescinded because the information I provided did not match up with what they found. Naturally, I was dumbfounded so I asked the HR person specifically what this meant and he spot on told me that I had lied on my application and resume about my current role at my current employer. More specifically, their employer history verification came back with the Director of HR at my current company stating my Job and Role was "Help Desk" which did not match up with the "Junior Infrastructure and Systems Administrator" I had listed and that it was a pretty big jump to put that on my resume. He was kind enough to send me a copy of my current companies letter of verification and sure enough, it lists me as "Help Desk". Now like I said my wife and I are also moving to a rental home. We filled out the applications and these also ask for employee and income verification, because I filled it out or rather started the application first, I have considered the "Head of Household" for the application and while my wife makes 1.5x my income she was considered a co-applicant. Naturally, like the job applications, I filled out the Job history/title and income stuff to what I thought it was. We got a call about two days later letting us know that some parts of our rental application specifically about my occupation and job history for me did not verify correctly and that it came back differently, but that it was a non-issue if they swapped me with my Wife as "Head of Household" since they were really just looking for the income to be x3, otherwise we would have been denied. Now with two things about my job history being off, I decided to reach out to my leasing company about my application from earlier in the month, despite the fact we ultimately did get approved and sure enough, the part that didn't match up was my employee verification. The software they used had flagged it because my current employer again returned that my "Job title" was Help Desk and the income they replied with was hourly based not my total salary. Do I have any legs to stand on to get the HR Director to stop inadequately filling out the forms? We aren't a tiny company (150 Employees in the US, 950 Globally) and she knows me very well and I interact with her occasionally. I reached out to my Boss who casually reached out to our HR Director under the guise of changing my title to something more "Senior" after he got a reply from her, he also informed me that according to our HR Director my job title is "Help Desk" despite my duties not really being Help desk if at all making this less of an accidental mistake. It's a bit frustrating that this would've cost me housing, if not for my wife and has already cost me a job. TL:DR My employee contract has me listed with the job title of "Junior Infrastructure and Systems Administrator" replied back to prospective housing rental landlord and possible new employer with the title of "Help Desk" - Had job rescinded and house rental almost denied because that did not match up with I put on my application. Don't really care about the title at the end of the day, but the mismatch and very junior/entry level title of Help Desk is leading to issues, but can my employer change my job title at will despite it being set in my employee contract? All my salary increase have required changes that require me to agree to amendments to my contract. [link] [comments] |

I accidentally bumped my girlfriend's previously injured hand and nowshe wants to sue me. Posted: 27 Jun 2019 09:52 AM PDT My SO and I live in CT and were recently rear ended, resulting with the both of us getting hurt. It's been made clear that the accident was no fault of my own (we were in my car). This morning I accidentally bumped her thumb that was injured in the crash. She now wants to sue me because she believes I broke it when I bumped it. Does she have a case against me for the reinjury? On a related note should I break up with her for suing me over this? She would be doing it to get money. Not to cover the expenses of the injury and that feels like a scummy thing to do to a SO. [link] [comments] |
Accused of Carnal Knowledge in Prison I work at Posted: 26 Jun 2019 05:39 PM PDT My main question here is do I need a lawyer. I work at a female state prison (I wont say which state because that will easily identify who I am) as a male officer. Today I was mirandized and questioned by our special investigations unit (sworn law enforcement who work for the department, kinda like internal affairs). An inmate has accused me of having a relationship with her and having sex multiple times. The only evidence they have is her statements. No camera footage or anything like that to back up her claims. When i was being questioned i was told it was a criminal investigation at this point. I began to answer what they were asking but they kept repeating the same questions over and over like "have you ever kissed her" "have you ever had sex with her" etc. Half way through the questioning one of the agents interrupted and said "look we dont ask questions we dont already know the answers to, now when was the last time you had sex with her?" which implied that I was already guilty. At this point I stated I did not want to speak anymore without a lawyer present. They asked if i would take a polygraph which i said i would if my lawyer advised me to. They then asked for me to write a statement which i said i wouldn't unless my lawyer advised me to. I was then placed on administrative suspension with pay pending the investigation. I dont really have much money but i feel like at this point i have no choice to get a lawyer. Any advice would be appreciated. USA [link] [comments] |
Making Amends For Stealing Firearm. Posted: 27 Jun 2019 01:21 PM PDT Ten years ago, as a juvenile, I burglarized someone's truck and stole their hand gun. Today, I am working the 12 steps and a part of doing so is admitting my wrongs and doing whatever I can to make it right, granted doing so does not harm anyone else. I am not fearful of being held accountable, but I believe for me to sit any jail time and be away from my family will be harmful to them. I have sought advice from both sponsors and attorneys in the program, but no one has had any experience. The best I've received is "Don't lead with the chin.". Crime occured in Montana. I plan on making direct amends to the victim. Is there a statue of limitations for this crime both state and Federal? Can I be held liable if the gun turned up somewhere and was used in a violent crime? Is there anything I may be overlooking? [link] [comments] |
Posted: 27 Jun 2019 01:28 PM PDT This is in California. My cousin flew out from Colorado. She comes out about once a year for 2-3 days to see my grandmother, who lives in a retirement community here. I live a few miles away. I got a call from my grandmother's visiting nurse saying she couldn't find some of my grandmother's medication. My grandmother has a habit of hiding medication for some reason, so I said I'd come by and help look for it. By the time I arrived, the nurse had left and my cousin was waiting there. I looked for the medication, and while doing so my cousin ambushed me and claimed that I or my father were stealing the medication. She repeated the accusation several times, and while I was denying them my grandmother found the medication. My cousin then accused me of planting the medication for her to find now that I'd been "caught." I then left the house, not having a reliable witness on site and knowing my cousin's past history I no longer felt safe there alone. My sister called my grandmother, and could hear my cousin in the background telling my grandmother that she was recording the call and that she has permission to talk. The last time she was out she had gone to my grandmother's neighbors and tried to get them to give her statements that I was abusing my grandmother. They refused and told me that she had tried to get them to do that. She had also attempted to get my grandmother to sing a PoA at that time. This time, I know she spent several hours with one neighbor in particular who does not like me as I told her to stop talking to my grandmother because all she does is tell my grandma she should die and go meet Jesus. I'm not abusing my grandmother, in any capacity. What should I be doing to protect myself and my grandmother? My grandmother has diminished mental faculties and is very easily manipulated. For all I know, she may have already signed a new power of attorney with my cousin. [link] [comments] |
Drug rape ending up in pregnancy Posted: 27 Jun 2019 03:50 AM PDT Need to be vague here for several reasons, but issue is in Brunei. My parents live-in helper was drugged and was raped without her knowledge 2 months ago. She only found out yesterday when she was constantly vomiting, and she was tested positive for pregnancy. She was a virgin before this and she adamant that she did not have any sexual relations with anyone. She then recalled a time when she had felt sleepy and fell asleep at a friend's place after a party, but did not recall anything, The next day she felt sore and had some bleeding but had put it down as Her having her period. I assume as she never had intercourse before she did not know what to expect. My parents feel that it is too late to report the rape as there is no proof and that it is her word against,.. who knows as she doesn't know who did this to her. Her friend is not answering her messages. I am fuming that they are not reporting the rape. But I don't know what to do. Are they correct in what they say? That it is hard to prove now? My job is asking me to pay back a sign on bonus when I was told I would not have to. Posted: 27 Jun 2019 07:59 AM PDT I got a good job with a very large, well-known hospital in December that offered a sign-on bonus in addition to competitive wages. I accepted the job, worked for a few months before my health started failing and I was not able to meet the requirements that the job entailed. I was reassigned to a MUCH lower paying position (a six-dollar-per-hour pay cut) for fewer hours per my doctor's recommendation, but was told that as long as I stayed within the hospital network, I would not need to pay back the first installment of the bonus. I have been struggling very much with the decreased pay as well as my health and the consequent medical bills. Today, I mistakenly received the other half of the bonus, so I called HR to ask what I should do. Not only do they want me to give back the second half (which is their right), they are requiring that I pay back the first half of the bonus after being explicitly told that I did not have to if I stayed at the hospital. Paying that money back would financially cripple me completely and I have no idea what to do. They want to abide strictly by the contract that stated that I was to stay at a 1.0 FTE in my old position, regardless of the circumstances or the incorrect information I was told. I have a string of emails containing said information. What should I do? 23, F, WI [link] [comments] |
Posted: 27 Jun 2019 08:15 AM PDT Massachusetts small claims. Being sued for unpaid hospital bills, around 4k. The plaintiff's lawyer had me on a payment plan 2 months prior to court date but said they were still suing and I had to show up. The date comes around and I show up, they don't. Case is dismissed and court says I don't owe the money. I have the notice of dismissal. The lawyer continued to collect payment from me this month despite dismissal. I called today to have them cancel the plan and they said they will but they have another court date to vacate the dismissal. Any help here is much appreciated! [link] [comments] |
