I was attacked by a passenger tonight, I drive for Uber Posted: 28 Jun 2019 02:32 AM PDT I was attacked by a drunk passenger in Ventura County, California tonight. He didnt seem that intoxicated when I picked him up but on the 101 freeway he goes berserk and pulled my steering wheel making us swerve across 3 lanes of traffic, he then proceeded to punch me in the back of the head repeatedly. I know the area well and drove straight to a nearby police station, jumped out and reported it,. They arrested him and he is being charged with battery. I have a police report and have already contacted and spoken to critical support. Passenger had a 5.0 rating and gave no strange vibes when getting in the car, completely random. Do I have any legal course to sue him in civil court for the assault and battery, you think? P.S. stay safe out there [link] [comments] |
Posted: 28 Jun 2019 05:45 AM PDT It looks like we are taking in one of our kids' friends. She's a gay kid whose parents have told her that they're moving and she's not allowed to come along. She's under 18. They don't want to hear from her after they move. I'm not looking for "they have a legal obligation until she's 18" blah blah blah. No one should have to live with parents who do not care whether you live or die. I know she needs to get her birth certificate and social security card. There is probably more that I don't know about though. I know we can't put her on our health insurance, so I'm a little concerned about that. What do we need to know/do? [link] [comments] |
Is this a "get an attorney" problem, or a "tell them to get f****d" problem? Posted: 28 Jun 2019 09:56 AM PDT INB4 I'm posting this both here and in F-HOA. So the farmland east of our home sold about a year ago. Yesterday we got a letter in the mail with some forms. Basically it said we have 7 days to sign and return agreeing to be a part of the home owners association that is going to be instituted with the homes being built. It claims that this is required and that not returning the forms signals our agreement to join the HOA. There is no way in hell we're joining a HOA. Part of why we bought this home was that it WASN'T part of a HOA. We have several other families back in our little area. They all got the same letter. Is this legal? Do we need to get a lawyer to fight this? Or can we safely tell them to go fuck themselves? We are in Wisconsin, btw. EDIT: The ultimate question is: can a HOA force someone to join, legally? Posted: 28 Jun 2019 05:01 AM PDT Sorry if the title is too long. I am hoping that someone here will have some profound legal advice and/or suggestions for how to address the issue. If it's not clear - I think that I may be paying for the electric bill of the building's interior lighting. I can't see the meters as they are behind a locked gate to which I do not have access. Is there any way I can compel discovery? I thought to hire an electrician to come and have a look at this, but I'm not sure that just because the breaker is on the box in my room that this is necessariliy linked to my meter. I realizes this is something of a technical question as much as a legal question - apologies if I've chosen the wrong subreddit to seek advice. I am still a bit new to reddit actually and couldn't find any subreddit that seemed more appropriate. [link] [comments] |
Posted: 28 Jun 2019 09:08 AM PDT Im not sure what information is necessary but I do have a lot I'm sorry I'm not entirely sure on how these sorts of posts work. After a friend of mine quit her job she made a callout post on facebook which sort of snowballed into this huge situarion where people are asking her for help and to get something done but she isn't sure what she could do if any. She has tried calling APS and contacting the police but not much has happened along those routes. The claims range from neglect and abuse to actual theft of savings and social security. I'm sorry if this is confusing she knows all the details but she's kind of exhausted with all this so I'm trying to help her out please this is urgent. I can provide any necessary info please just ask. Edit: Arizona btw Edit Edit: Thank you to everyone who has replied so far I've talked to my friend and she says she's already tried reporting the facility to numerous agencies as wellas encouraging others to file reports to no avail so far. My Lyft driver took me to a drug deal Posted: 28 Jun 2019 09:42 AM PDT This happened earlier today. I ordered a Lyft to go to the airport when it arrived and I noticed something strange. The app told me a female would be driving, however the female was in the passenger seat of the car. Red flag, but I'm in a hurry, let's go. Me: "To the airport please!" Female: "We gotta swing by the plug real quick" Me: "Excuse me, what!? I'm in a hurr-" The male driver completely disregarded me and drove to a neighborhood across the street from my apartment and they got out of the car. They took me away from my house to a drug deal IN THE MIDDLE OF A LYFT TRIP. Before things could get any worse, I escaped the vehicle and phoned Lyft- who promptly hung up the phone on me after getting a supervisor. I don't have any recourse do I? Not only am I late for my appointment at the airport but I'm quite flustered from the situation. What if we had gotten pulled over? If the situation went sideways? What happens the next time they put someone else in an uncomfortable situation? Thank you for your time and consideration. Edit: I need to add that I also asked why she wasn't driving and who the guy was. The female who was supposed to be driving said that the man was there because "people had refused to get out of the car before" SKETCHY Edit 2: All events occurred in Winter Park, FL, USA. Posted: 28 Jun 2019 07:14 AM PDT My ex moved out May 22, and we've been separated since March 10. Kids would have understood that we weren't together maybe a few days before May 22. Three young girls together, 8, 4.5, 1.5... I was fine going for 50:50 until last night when my daughter told me my ex introduced new boyfriend first day they moved out. They are intimate together on an air mattress in my sister in laws basement, with my one and a half year old on the same bed as them going at it. My other two kids have seen this multiple times now as they're sleeping on air mattresses ten feet away. Daughter tells me that this boyfriend of less than 6 weeks is making them call him step daddy, and that the kids don't like it. My oldest doesn't like how she sees him looking at her at night, and how he's always there and she can smell him from her bed every day. Makes me vomit. I need help. I can't let my kids stay with her like that. That's so damaging. I mean introducing a boyfriend the day you move out is brutal enough. Then the step daddy thing that quick? And the sex in front of and ten feet away from the kids? She won't work, has a job but it's a "work whenever you want" job....so she chooses not to work. My poor kids. I need help. But how would they let a father who in the past before medication and therapy and getting sober, used to be emotionally abusive to their mother? I mean found out that my gut was right every time we fought before (rarely out loud mostly over text is how we fought so kids didn't get the worst of it really ever) and she was cheating the entire 10 year marriage and beforehand too... Anyone have any idea what I can do? Is there any hope I can get custody until my ex gets some therapy and help and understand about how messed up that is for kids? [link] [comments] |
Posted: 27 Jun 2019 07:00 PM PDT Long time lurker, first time needing to post so I made a new account. A few weeks ago, a post on the Georgia Tech subreddit stated that anyone with a .edu email could get 2 free fitbits from the fitbit website by following the given link. I, along with a very large number of other students, got our 2 free fitbits. Fast forward to today and we all receive an email stating that if we don't pay, return, or agree to subsidize the amount for the fitbits, the amount will be sent to collections. Is this an empty threat or is there actual legal precedent here to get sent to collections? I feel like since it was their fault this happened, we, the students, shouldn't be punished for it. Any advice would be appreciated. Editing post to clarify a few things. UGA is not responsible for this. USG is, which is the governing body for Georgia's University System. They don't have a campus, students, or anything like that. But they have had events promoting student activities. The email we received was from Fhs-healthplans@fitbit.com, so Fitbit themselves contacted us. I personally received this link and was told "University students get free Fitbits" I didn't know that it was only meant for employees. [link] [comments] |
Officer wouldn't let me read what i was supposed to sign Posted: 28 Jun 2019 09:27 AM PDT I was arrested and booked for a DWI 5 days ago. I complied with the officer, he took me to the station & then the hospital to get blood taken. Then to the county jail. At the county jail he told me to sign something and I said that I would need to read it first and he refused to let me. I told him 5+ times to let me read it or I couldnt sign. I didn't end up signing. Would you sign a contract without reading it? Fuck no, so why would I sign that. When I was released I got the paperwork and the document he wanted me to sign says something along the lines of "By signing this, you acknowledge that you refused a blood test". This is 100% false. Im sure they have body cameras or something that show this is 100% false right? What should I do? Talking to an attorney later today. [link] [comments] |
Posted: 28 Jun 2019 04:59 AM PDT I recently bought a house in Minnesota. Having a third stall on the side of my garage was a priority and continues to be one. I spoke with my neighbors one day who told me they gave the previous homeowners verbal permission to have the third stall put in on their property, as city code required a certain width for paved spots on the side of garages. I would estimate it goes 6 inches into their property. My concern is while me current neighbors are great, if they move and the new buyers do a survey, could they make me tear up my driveway? I'm worried then that I would be out of code on that third stall. Is there a way to have the neighbors sign an agreement or even buy that land? It is certainly less than 10 square feet. [TX] Someone copyrighted my artwork. Posted: 28 Jun 2019 10:22 AM PDT About three years ago, a friend of mine came to me and asked if I would do the illustrations for a children's book she was making. She offered to pay, and I accepted (no written contract). I made the illustrations and purchased Adobe products to do them, which she also offered to pay for. She was very pushy and rude the whole time, and it's clear she was not pleased with the final product, but due to some time-crunch on her end, she accepted them. After that, she disappeared for a bit. I gave her the bill for the Adobe products and never heard from her again (It was somewhere between $200-$300). I forgot all about it afterward as I became very busy with other things. Well, yesterday I was on Amazon and low and behold, the book came up as suggested. It has my illustrations used in it, and it's been published, and it even has copyright markings on it. I was never consulted on this and never agreed to have her copyright my work. I've also still never been paid for my services or the cost of the Adobe products. I know it was stupid not to do any written agreement, but hindsight is 20/20. Is there anything I can recover? Can she copyright my artwork without my permission? [link] [comments] |
Posted: 28 Jun 2019 12:44 PM PDT My friend is wheelchair bound indefinitely. When getting a contractor to come and make some accessibility modifications to their home the homeowners association is blocking these modifications from happening. Like a simple wooden ramp with rails to enter their house through the front door. Obviously this is morally f*cked up. Are they legally allowed to prevent a disabled person from making modifications for increasing accessibility to their own home? Huntsville, Alabama [link] [comments] |
Mom passed away, disabled brother lives with her, landlord wants house empty in a week. Help please! Posted: 28 Jun 2019 01:10 PM PDT I will try to be brief. My mother and brother were living in a house that they have been renting for about 10 years. Only my mother was on the lease. My brother has a disability and my mother was his primary caregiver. my mother passed away last week, I called the landlord And she wants us out the first week of July. Rent is current up until now, it is due July 1st and I don't have the money to pay it. My brother is currently in the hospital for a surgery to his leg. The house is full of both of their possessions. I live in Florida, what are my legal rights as far as removing all the personal property from the house before were evicted? As a side note, I called landlord yesterday to tell her that my mother had passed awayAnd the neighbors told me that she was showing the house, full of all the possessions last night. I know this description may require some additional answers, please ask if you have questions. I am desperate to figure this situation out. [link] [comments] |
Posted: 28 Jun 2019 09:07 AM PDT I hauled my RV to be repaired in Indiana. Unbeknownst to me, the mechanic stored the RV at a storage unit type place while waiting on parts. The RV was stolen from storage facility this past week. The RV is worth approx. $5,000, but I still owe $11,000. Is there any liability on the part of the mechanic or storage facility? I only had it insured for the $5,000. I live in Tennessee. Mechanic and storage facility is in Indiana. [link] [comments] |
Discovered someone using stolen ID, what to do? Posted: 28 Jun 2019 05:48 AM PDT So I help perform background checks for the company that I work for. An applicant uploaded a driving license and European National ID card as proof of right to work. However, the photo on the driving license and the ID don't match. After a bit of research stalking LinkedIn and Facebook, I found the original owner of the ID, so I've discovered that this is identity fraud. As far as I'm aware, my company is doing nothing to tackle this, and in order to confirm that the id belongs to the original owner, I reached out and asked if it belongs to him; which it did. Due to GDPR rules, I haven't shared any information about the fraudster to the original owner, but I want to help him. Should I contact the police and let them know about the person using said fake ID or would sharing such information also breach GDPR? I want to help the original owner reobtain his ID but don't want to break any laws or lose my job in the process. Any ideas? [link] [comments] |
Let my roommate borrow my car and he performed a hit and run. Bystanders have photos of my plates. Posted: 28 Jun 2019 11:17 AM PDT Salt Lake City, Utah. This is a true story. I let my roommate borrow my car last week and he ended backing into a parked car (little to no damage) and drove away without leaving any info. Shortly afterwards, some bystanders in the parking lot confronted him about it to which he gave them false info, but they took pictures of my plates. He's an idiot, I know. I don't really know what to do and he totally screwed me. I know there's a chance that I don't hear anything about it, but wondering if there was a way to preemptively protect myself from getting in trouble for his mess up. [link] [comments] |
Posted: 27 Jun 2019 07:48 PM PDT [GA] So, as part of an initiative a university ran a promotion where employees who had a health insurance plan with the university could receive a free health tracking device, by following a link, creating an account, and placing an order. Unfortunately for the university, this link was leaked and all students with the link were able to access the account creation page, which simply had the initiative's logo and the text "Create an account with your company email and receive your free device", which appears to me to be just generic text. There was no direct mention of being an employee of the university, and no mention at all of the requirement to rign up for a health plan. So naturally, hundreds of students filled the form out, and recieved the free devices. Recently, the university has sent emails to those involved demanding they either 1) Pay for the devices. 2) Mail them in with a free provided shipping label. 3) Deduct them from their paycheck, if applicable. Or face collections in one week's time. While I recognize that the smart move for students is probably to just accept the free return, no questions asked solution, I'm curious as to how enforceable their threats could be, given that at no point were students with the link required to acknowledge or agree to any conditions, other than by seeing the generic text at the start. Posted: 28 Jun 2019 10:11 AM PDT I decided I need to reach the top legal minds of reddit. I'm not entirely sure how to handle the situation I'm in. TL;DR: Apartment maintenance was in my apartment yesterday for quarterly preventative maintenance. When I got home, my TV and mount had fallen off the wall with some strange circumstances surrounding it. I'm not sure what to do here. The story (and backstory): I live in North Carolina. I recently moved to an apartment complex at the end of March. I love my complex, and have never had any issues. I've never had a maintenance call, complaint, or a negative situation with them. Shortly after moving in, I purchased a larger TV, as the one I moved with appeared tiny above my fireplace. I purchased a Samsung 55 inch 4k TV, and the highest rated wall mount I could find on Amazon, rated to hold my television weight up. My brothers and I mounted it above the fireplace in the first week of April, and it has remained securely mounted on the wall...until yesterday. I had a notice on my door Monday, June 24th saying that apartment maintenance would be stopping by some time on Thursday, June 27th for quarterly preventative maintenance. It would involve changing my AC filter, and doing moisture checks around my apartment by the washer/dryer, water tank, sinks, toilets, etc. This is the first time they've entered my apartment without me being there (that I'm aware of.) When I came home last night, I found my TV laying on it's back in front of my fireplace, with the mount off of the wall. Some of the pictures and decor I had on my mantel had fallen off and broken as well. The power cable was still connected, stretched over the TV, and the HDMI cable to the Xbox was out of the HDMI port, but laying over by my gaming systems to the side. There was also a note in my kitchen sink showing that maintenance had been there, with yesterday's date and initials of the technician. It does appear the TV and mount pulled out of the wall, but there are too many strange circumstances with how the TV appeared when I found it. I had the TV mounted slightly leaning forward, as it is high up on the wall above the fireplace. Imagine approximately a 10-degree angle. When I found the TV, it was lying perfectly on its backside, centered in front of the fireplace. There are no visible marks on the hearth where it would have fallen, and it appears to be under the lip of the mantel, almost as though it had been pushed back there. When turning the TV on, the screen is cracked and appears to have a few impact points on the front that do not line up with where the mount screws are. I called the complex office, but it was after hours, so I left a message. I called the 24 hour emergency line, and left a voicemail. They called me back and I explained the situation. It did not qualify as an emergency situation, so they were unable to send anyone out. I called the non-emergency police line in an attempt to get a report. They sent an officer, but there was no evidence of a crime being committed, and he informed me it would be an issue with my renter's insurance or a civil case with my complex. The apartment complex office called me back this morning and informed me that they spoke with the maintenance technician and property manager that were there, and there was nothing broken or out of place with my TV when they were there. They told me it would be a renter's insurance claim. I called my renter's insurance, and am currently waiting to hear back. I just find the situation odd with the circumstances above. I understand this is my word versus theirs, but I don't know how to handle this. The TV was completely fine until yesterday, the day they were there, after three months of being fine. They were the last ones there when I found the TV in this situation. Is this just a terrible coincidence? Would they still be responsible, even if it was? What is the appropriate next course of action? See attached pictures to hopefully paint a better picture of the situation, and I have still not moved the TV or damage around it. Any and all advice would help. Thanks in advance for all of your help. Pictures: https://imgur.com/a/nVRVwUZ [link] [comments] |
Fired after going to Urgent Care for carpal tunnel Posted: 28 Jun 2019 11:14 AM PDT I hope I used the right flair, I've never used this sub before. I'm in the MN united states. I was hired by a furniture store and started on 5/28. I was hired alongside another new hire, and we began the 6 week training process. Everything seemed to be going well, I was picking up on the information and systems quickly. I was complimented for my sales technique at corporate training and during the 3 weeks of in store office training I only made 2 mistakes that I needed help correcting. The other trainee however needed constant reminders and help, and reached a point where I'd be submitting 5 orders in the time it took her to do 1, while helping her with hers. I was always early, never complained and only took my lunch break when the store was empty. She was frequently late despite living 5 minutes away from the store (I live 30 min away), took multiple smoke breaks and would take extra long lunches. Sunday 6/23 I worked 12-5, and around 3 started having extreme pain and tingling in my left hand. On my drive home it got so bad I couldn't operate my turn signal. I went to Urgent Care and was diagnosed with carpal tunnel syndrome, given a brace and a note asking my employer to put me on a task where typing is not required for the next four days, only two of which I was scheduled to work. I arrived at work Monday morning before the owners and went to work fluffing pillows, fixing displays (yes, 1 handed), and waited for my boss to arrive. When she got there I showed her the note and she sent me home. Today I arrived at work (1st day back) and was called into the office. I was told I was being let go because they decided to only keep one of us. The timing and seems very suspicious, and they had never mentioned before that they were hiring the two of us on trial and only keeping one. Do I have a case for wrongful termination? Can i request reasonable accommodations for being Dyslexic? Posted: 28 Jun 2019 10:42 AM PDT Hello I have been working for a company for 3 years. this month they introduced a new change to the way our work is reviewed for accuracy that i feel is unfair to someone who struggles with dyslexia like myself. We have to enter our memos on a central database system. There is no spellcheck or other tools avalible for this system. Effective immediately spelling or grammatical errors will result in that work being scored a 0 out of 100 points. before this would simply be marked 2 points off and be scored a 98 out of 100. I have got documentation from my physcian showing i struggle with dyslexia and have given it to our HR department. I asked to be provided with either additional time to review my work or a spellcheck and grammer check tool to ensure these errors are not made both requests have been denied. I was told Dyslexia is not a protected disability. State is Delaware [link] [comments] |
Emotional support dog barks constantly in my condo complex in Massachusetts Posted: 28 Jun 2019 01:19 PM PDT I live in Massachusetts and own a condo where it is against the rules to have a dog. A new owner has moved in recently and they have an emotional support dog, not a service dog. The dog is left home alone all day and barks constantly and even though the windows and doors are closed in my place and in theirs, I can still hear it. I work from home most days and also cannot keep my slider open as I hear the dog all day. I have complained to the board and the property manager every time. Can the board have the owner remove the dog as it is not a service animal and is causing a nuisance? [link] [comments] |
Posted: 27 Jun 2019 09:27 PM PDT Long-time lurker, first time poster. On mobile, I hope the formatting is okay. Wasn't too sure on the flair, but we'll go with this. My friend has lived in a small apartment complex since I think 2017, around 6-8 units max. He went away out of town this past weekend and came home to check his mailbox, and found a hand-written letter from (likely) another tenant, basically calling him out for listening to her being abused, and "never once as my neighbor asked if I was okay". He told me he overheard one argument one time, but it didn't seem to escalate to any reportable level. I do trust his judgement on this absolutely. The letter then claims he got her "thrown out on the street" instead of coming to her "like an adult". The last line is: "If you record me again, I will be contacting the police as that is a felony in Tennessee." I don't know if TN is a one- or two-party consent state, buthe has never recorded anything involving another tenant in the complex. He has contacted the landlord, who states they can't discuss it for tenant privacy, but this situation seems strange to me, and I'd like some insight. Should he bring the letter to the police? It's not signed in any way to signify who placed it there. How should he approach this? Thank you in advance. [link] [comments] |
