I work in payroll in Ohio. They are not giving me any sort of severance pay and are not paying out my vacation time. Is there anything I can do about not getting at least my vacation paid out? There were a group of 13 year old boys standing by the side of the road and when I was coming by one of them decided to cross the street and stepped out right in front of me. I didn't have time to stop and hit him and he suffered minor injuries. I stopped and called 911 and when the cops got there I showed them the video on the tiny preview screen that I was not driving fast or dangerously and the boy was not in the crosswalk. And I said if you connected my dash cam to the computer the GPS data would show my speed was at the speed limit. So the cops took my dash cam as evidence to review the GPS data and gave me a receipt and allowed me to leave the scene (I wasn't arrested or anything). Two or three weeks went by and I didn't hear anything so I called the police non-emergency line and after some phone tag I got connected to the officer investigating the case who said I wouldn't be charged because the GPS data had shown I was "within the speed limit". I asked when I could get my dash cam back (it was $500) and he said he had paperwork to finish and in a week or so he'd return my property to me. So since then about two and a half months have passed and I still don't have my dash cam back. I've repeatedly called the police department who said they're still working on it. And the last time I called he said they were still analyzing it. I said why, I was originally told charges wouldn't be filed. And the cop (different guy than who I talked to I was told the original cop left for another agency) said that their IT staff was still retrieving data from the dash cam. The ex-wife was an alcoholic, and tried to drive with him drunk in the car so her family asked my husband to take full custody. None of this was done through the courts, which is what I assume will highly complicate things. Prior to her series of relapses/stint in rehab, they split time equally...again, still agreed on by both parties but not taken through court. The past few years have been bumpy, but the whole goal was to get both parties splitting custody again. She is stable, has a job, and as far as anyone knows isn't drinking. My stepson loves his mom very much. She has spoiled him with gifts, endless video games, and everything a 16 year old boy could ask for. We have been the ones who have taught him life skills, tried to get him to take on responsibility, limited his phone time, and dealt with a lot while basically she gets to do all the 'fun' stuff. Needless to say, he would rather live with his mom. For the past year, she has been given partial custody (wed-sun every other week). This week was our week to have him, and she texted on Monday saying it was her father's birthday on wednesday (last night), and that she would like the son to go to his birthday party from 4-8. He is sick with cancer and his last scans weren't great, so of course we agreed. We seemed to have a decent relationship with her parents, her mom is always very sweet, and again when she kept relapsing they asked us to take full custody of him. We were not worried. So around 4 p.m. when she comes to pick him up, he says goodbye like everything is normal. My husband leaves our room a few minutes later and finds a note talking about how he will never be back, that we're terrible people, and a bunch of other things. Obviously we are hurt and unsure of how to proceed. Any attempt to contact anyone (including her parents) has been met with silence. He is 16 years old and we are in North Carolina. I graduated high school and am turning 20 at the end of July. I honestly just plan on disappearing on day. I have $3000 saved up and a apartment lined up. The owners are a nice couple who know about my situation. My plan: They've agreed to wave the security deposit and references cause of my situation. All I have to do is put in the application and pay the fee and they said they'll approve me as soon as my application is in. I've also been lying to my parents about where I work so they can't find be there. Is there anything I should tell or ask of my boss about so this? Everything I really care about is in 3 bags in the back of my closet, ready to go. Basically, I want to just walk out the door and not come back. I plan or doing just going straight from my parents house to my new apt and not saying anything. Some time ago he was stopped for a routine control and the police officer confiscated his (perfectly valid) license because he thought it was false. The lady at the DMV office told me that officers in the EU are able to check if the license is valid directly from their computers, but the officer who stopped my dad didn't bother to do so. So now my dad has to bring them some sort of certificate to prove that the license is valid. He asked me to do it since it can only be requested from an italian DMV office. I brought them the documents and they can make a validity certificate, but that it'll take around 10 days, which is way too much. He has thousands of songs posted under various "artist" personas. However, he doesn't get real listeners. He's written a code to basically have bots listen to his songs over and over on multiple accounts on multiple computers. He told me he's made hundreds or even a thousand dollars per day doing this. The judge granted a 3 week order and an order to retrieve the child from the husband. They are going to stop by the police station with the paperwork and hope to get him back soon. Next hearing in 3 weeks. She also located a good attorney in the area. The husband and his family were hoping to just humiliate and get back to business as normal, but her actions and those of the other parts of the family shocked them. Many of them will be going to a camp week event in MD at the end of June. My bosses have been asking for volunteers to go to MD with these clients. However, many employees are simply not able to due to the fact that this trip requires the employees to stay at MD the entire time, many employees with children are simply not able to do so. There have been questions (same as below) by other employees via emails that have gone unanswered by all the managers and admins. Employees that are going are not allowed to bring their personal vehicle, they have to join company vehicle with clients to go to MD at the start of the week (June 30, I believe) and can't leave till the end of the trip on July 5th. Here's another thing that worries me, they are saying that there will be NO overtime paid that week at all? We are essentially non-salaried residential advisors so it's not like we qualify for exemption from overtime according to what I could find online. And from what I can see, all employees that have to go to MD are considered on duty the entire time under the labor law, meaning they have to be paid for all that time, even if they are not actively involved with clients all that time? I am not able to go myself due to the simple fact that I'm on a limited diet (necessary for health and medical reasons) and from what I've found out, it would be very difficult to stay on this diet at the camp. Now, here's my main concern, I am contracted to work 37.5+ hours each week. If I refuse to go to MD, am I still entitled to my hours even though there's no clients on sites to monitor? I've been getting in the red with my finances lately and really cannot afford to lose these hours (I'm currently seeking other job but still depends on the current one for now). The MD trip is considered way above and beyond my listed job duties. They may use 'and any other duties as assigned by managers' to get around this though... They have not been exactly clear about all this and have not communicated very well. So I am hoping to get some info that I can use to force some clearer dialogue between the managers and us employees on this matter. She's a new, 'Full time Substitute - Per Diem Teacher's assistant' She pays union dues for a retirement account, I don't know much about it. Long story short this kid is a major problem. She's the 3rd TA this kid has had this year. He is a known violent kid and she's been hurt by him before, and I suspect the school did nothing about it the first time. But enough is enough. This kid also assaulted the teacher and put her in a walking boot for a month due to the fact he kept kicking her. What is the process that she should be following? If the school doesn't follow up and apply discipline(i.e. suspend the kid) what recourse does she have available to her? No one should have to be exposed to this kid much less assaulted by him. So our landlord has been struggling to pay the mortgage for several months in a row now. He's asked us for extra money several times. He has informed us that yesterday he missed his mortgage payment in court and there will likely be eviction notices posted on our door today. He told us that today we should go file a right to possession and said we may all get locked out within the week if we don't. It's frustrating that we've made all of our rent payments to our landlord and the mortgage wasn't paid. My wife and I do not know what action to take if the eviction is posted but I'm trying to prepare for that moment so we can take quick action. Is there anything we can do now to prepare for this? It's worth noting that we probably can't afford a good tenant attorney's services. From what I've gathered it can get expensive. I tried calling "Just Cause" two days ago anticipating this and they did not return me or my wife's calls. Any and all help would be a blessing. Thank you. UPDATE 10:13 am: We are on our way to the Hayward hall of justice self help center. It's a long shot that we'll be seen today but we are trying to address the fact that we are probably not known in the case currently open regarding our home and the landlord. The court is not aware of tenants in the home. UPDATE: 11:47 am: We are about to be called in at the Alameda County Superior Court Self Help Center. We intend on checking to see if there is an eviction notice and we will tell them we are tenants of the landlord whom we have learned he did not disclose that in the case that's ongoing. UPDATE 12:50pm: This situation just got real. My wife and I are really surprised after leaving the Hayward hall of justice. We were told by self help that in order for us to exercise our tenant rights we may be entering his ongoing civil lawsuit which is expansive. We could be on the hook for his house problems if we try to stand our ground. And the people coming after our landlord could then come after us. I can't really break down details of the suit here but we're pretty nervous. We were told there will be a sheriff posting an eviction any moment now and we may have 1 or 2 weeks until we are forcefully removed. I was referred to 4 organizations in the Bay Area and left them all voicemails. I'm really looking for any and all legal help. Posted: 13 Jun 2019 10:15 AM PDT My friend is disabled and needs help with her activities of daily living. She can't support herself. She might be unable to live alone. She is in an abusive marriage. We are afraid to make a report to Adult Protective Service because we've talked to people who worry they might let her fall through the cracks. The concern is that they will successfully remove her from the abusive situation and place her in an emergency shelter, but afterwards will not find her a safe, permanent living arrangement that fits her medical and financial needs. We are worried she will ultimately wind up homeless. What is APS legally obligated to provide? Is it legal for them to not find her a permanent living situation where all her health needs are addressed? How about finding a lawyer who deals with APS so I can send a preemptive letter that there will be legal action if they mishandle her case? Or even just a lawyer who can help me understand her legal rights and protections in the APS system? I've tried to find a lawyer to talk to through the State Bar Association for Texas and the Texas Attorney Line and been unsuccessful. I don't even know what kind of lawyer to search for. Vet billed me $110 to tell me that their equipment was contaminated. Posted: 13 Jun 2019 11:12 AM PDT Last week I took my dog (9 YO Coker Spaniel mix) in for a checkup for ongoing medical issues. I am located in centeral Texas, Copperas Cove to be exact. The vet conducted a urinalysis on him to make sure he was over a UTI that he was diagnosed with a few weeks ago. The sample came back positive for bacteria but of a different type than he had previously had. The vet then took another sample and sent it away to an external lab for analysis, charging me $110 for the test and $60 for antibiotics to start treatment with. My wife just got a call from the vet. Testing from the lab showed that the vet's equipment was contaminated, and my dog has no issues. I was charged $170 for the vet to be told they need to sanitize their equpment better. Do I have a leg to stand on for any action against the vet? Is it worth my time? I don't need the money, its more about the principle, and in my area there are plenty of people who do need the money that may be in the same situation. Thanks! [link] [comments] |

Stolen iPhone turned life threat Posted: 13 Jun 2019 09:46 AM PDT Long post, bear with me. It gets more exciting at the end I promise. Last Friday night my iPhone X was stolen out of my back pocket while out at a bar with a few friends. About 15 minutes later I noticed my phone was gone, and immediately retraced my steps and logged into Find My iPhone via a friends phone. Of course, the person who stole it immediately turned it off, so my location was not updated and said it was still at the bar. I left my information with the bar and crossed my fingers I dropped it on accident and someone would turn it in. At this time my phone was in Lost Mode and displayed the phone number of my work phone (important later). I'm a backup to computer type of girl (dumb I know) and hadn't done it in about a year. Needless to say, I want my iPhone back. The next morning I woke up to a location update. It pinged to an apartment complex street across from a graveyard about .5 miles from my apartment. The phone was turned off (assumingely) after that, and would ring but couldn't receive text messages. Location was not updating for 24 hours, and it went to "offline" mode. At this point I figured it was gone, but held out hope and continued using my work phone if needed. Fast forward to yesterday. I get about 10 text messages clearly phishing for me to log into my iCloud. It seems legit, but I immediately call Apple to get the scoop and they confirmed my theory of it being a scam. I also notice the cellular on my Apple Watch is no longer working (last connection to my personal phone). I call my carrier and they tell me it has been deactivated because the SIM card was put into an iPhone XS Max. (Sweet, wasn't me!) About 20 minutes after the first phishing text message, I get a iMessage (from an email address) on my work phone by a guy claiming he bought the phone off someone and my stuff keeps syncing with it. He plays the card he has no idea it was stolen and wants me to immediately wipe it so he can use the phone. (Yeah, let me wipe my stolen phone so you can enjoy it!) Now I'm aware that with Find My iPhone and Lost Mode, your iPhone is basically a paperweight. Unless I log in that thing isn't useable by anyone. At first I responded, hoping this guy was a good person and would give it back (wishful thinking, I know). He starts to get really upset about my iCloud being connected still and sends me a picture of the Find My iPhone app and a screenshot of Find My iPhone with a red circle around the "Remove" button. I quickly notice this screenshot is time stamped a few hours in the future. This guy claims he's on the East Coast, putting him an hour in front of me time wise. I call him out and he said it was an old screenshot from before (convenient?). THIS IS WHERE IT GETS GOOD! He gets so upset I refuse to wipe it and let him win, that he sends me a video of him with all sorts of guns, claiming he has taken lives before for far less than an iPhone. Says he has my address and will kill me if I don't remove the phone. Ok, so I'm freaked out. Tear up a little not going to lie. After all, I'm a female in her mid 20s just looking for her phone back. I head to the police station and all I get is a hug and a lost property form. The officer told me to turn it into a specific HQ location and talk to them about harassment. A few hours later, I start sending screenshots of these texts to friends to see what they think I should do. One friend wanted to watch the video, so I saved it on my phone. I then notice the picture of "remove" button on Find My iPhone was time stamped to August 2018. I also notice the video he sent me was time stamped to January 2018 and upon swiping up on the video, I get a direct address of this guy in NYC. My question now is, as I wait at the DMV to get my license renewed planning on heading to the police HQ after, is can the police do anything at all about this? I know they typically don't care at all about stolen phones but this guy multiple times claimed he was ready to take "my stupid life" for an iPhone and has a massive arsenal ready to use on me. At this point I have a hard feeling this is the guy who stole my phone, considering he isn't remorseful and has no details at all about who he bought it from and for how much. His aggression tells all. Not sure if that video was taken at a friends or what, after all the video was dated 6 months ago about 1200 miles from my apartment. How it got from TX to potentially NY from Friday to Wednesday is strange. TL;DR: My iPhone got stolen last Friday and the guy is threatening to kill me if I don't remove it from my account.
