Lady hit me and won’t respond to claim :/

    Posted: 31 May 2019 04:49 PM PDT

So long story short. I was parked on the side of the road and a lady side swiped me. Luckily I was in the car to witness it. We get out, exchange info and in CA police don't come out unless the car is inoperable or there's a injury. So no police report. I called her insurance and filed a claim. Days later no response I finally hear from the claim adjuster that they're awaiting to hear from her to move forward and they haven't been able to get in contact with her.

I have photos, witnesses and a text from her sending her info. She seems to be dodging every number calling her. What can I do to make her be held accountable?

Tapped a guy's bumper while parking and he just sent me a quote of $877 to fix it. The scuffs are barely visible. What the fuck do I do?

    Posted: 31 May 2019 07:15 PM PDT

I was parallel parking and tapped the bumper of the car in front. The guy saw it somehow because all of a sudden he and this lady showed up in another car.

They got out and he told me he got the car a week ago. They weren't angry but were very serious and acted like it was a big deal. To me, it looks like nothing. I was honestly losing my shit at this point because I've been having such a bad week/year.

You can see where I hit him but it's just a few scuffs - barely visible in the photos I took and only on the bumper part which is plastic.

He sent me a quote from a mechanic that is $877 because apparently they need to remove the whole bumper. The quote is real - he sent me a business card and two page document detailing costs.

I'm going to call around to see if this quote seems reasonable but even if it is not, I can't force the guy to do anything.

Am I crazy for being very pissed that he wants to get this fixed? Is there any chance my insurance will say that the damage is not a big deal? And if my deductible is somehow more than the mechanic fee, should I even tell my insurance?

Tldr: Bumped a car while parallel parking, now being told I owe over half a month's rent for minor cosmetic damage. What do I do?

Help! I believe my insurance company has acted in bad faith.

    Posted: 01 Jun 2019 03:55 AM PDT

Some background information. About 3 years ago I was involved in an at fault car accident. My car rolled into the middle of an intersection and the other party (who had a green light) t-boned my vehicle. The accident was deemed my fault which was acknowledged by my insurance. When I spoke to my insurance several weeks after the investigation was completed, I was told that they would handle the claim and settle with the plaintiff if possible.

A few months later I was served with a lawsuit from the plaintiffs attorney and immediately contacted my insurance. They proceeded with providing me with an attorney since my case was going into litigation.

In 2018 I was deposed by the Plaintiff and during the deposition I found out (by the Plaintiffs attorney) that the Plaintiff attempted to settle the claim within my policy limits. At no time prior to my deposition was I notified by my insurance that the Plaintiff attempted to settle within my limits.

Early this year I received a letter from a new attorney (as my case had been passed to another firm which specializes in trials) informing me that the Plaintiff was seeking damages that are beyond my policy limits and that they would be representing me on behalf of my insurance and that I was welcome to seek outside counsel as this claim was beyond my policy limits. I asked for clarification and an explanation as to why this was not settled within the policy limits and was told that my insurance had recently offered my policy limits but the plaintiff was no longer accepting this offer. With this information I contacted my insurance and asked for an explanation, to which my insurance answered that they are still in settlement talks and will attempt to settle via mediation.

Ultimately it has been very frustrating and stressful being in this situation and I feel as if my insurance is just procrastinating in settling this claim. Had my insurance accepted to settle within my policy limits this would have been resolved a long time ago and I would not be in the position where I am today (where the plaintiff is seeking for damages beyond my policy limits).

The trial has been pushed back several times already and it looks like the new trial date is sometime in July. My worst fear is that this will go to trial and I will be in the hook for damages beyond my policy limits.

Anyone here have a similar experience, or any advice on what I should do? Do I have to wait until after a judgement is made before I file a bad faith claim against my insurance? What is the best way to go about filing such a claim?

Sorry for such a long post, I tried to keep thus brief.

Quote for hail damage is more than the car is worth

    Posted: 31 May 2019 06:58 PM PDT

I live in Pennsylvania and last week we had a hail storm that damaged the house and all three of our vehicles. One of the vehicles is an '04 Cavalier that I was planning on selling soon. The quote that the claim's guy was around $3600 and I figure I could sell it for $1000-$1500. What are my options going forward?

He hit me, then denied any contact was made. Advice needed

    Posted: 31 May 2019 08:27 PM PDT

So this evening, I was hit by another driver while I was parked. I was sitting in my driver's seat while parked at the train station waiting to pick a friend up. Here's the details:

    • I'm backed into a spot. The driver who was previously parked to my right was over the line a bit, so I parked accordingly. I was right on the line.

    • I see the guy beginning to back into the spot on my left. He's VERY close so I think twice. He stops, then continues to back up, scraping the side of my car. I feel the contact inside my car.

    • I'm looking at him at this point with a "wtf" look on my face and my hands raised in the air. He rolls down the window and says "you're over the line. What do you want"?

I say "I may be over the line, but you adjust. You don't just back into my car." He says he did not hit my car. I tell him I felt him hit my car. (Perhaps a little too colorful with my language) At this point the two cars were too close for me to get out and look.

My friend arrives, gets in the car and I now pull up. I get out and look. Sure enough there are matching scrapes on both cars. He still denies it. Claims his scrape is from his garage door and tells me that my 1 year old car must have had the scrape (and his matching paint) on it before today. At this point I tell him I'm calling the police.

Cop arrives, looks at the cars, takes our accounts down, tells me that in her report she was noting what each of us said and writing that their appears to have been contact between the two cars as I had said.

I never took his information, but she did. She gave me the information for her report.

My question is what do I do...

Do I contact MY insurance to get his insurance to cover? Could that result in my rates going up despite the fact that i was sitting there in park when this happened? Do i get a quote for repairs first? Is the fact that he denied ANYTHING happened going to hurt my cause? The cop's report clearly seems to favor me but is that going to be an issue?

I doubt it's going to be a significant cost, but the guy was SUCH a jerk that I'd like to get him to cover it if possible. At the same time I dont want to risk the insurance companies determining that their was no fault, and my rates going up for repairs that I could have covered out of pocket. Does contacting my insurance at all potentially cause problems for me? It's a year old car and I take pride in keeping it nice so I'd prefer not to just drive around with the scrapes.

    Any thoughts on this?

Car declared total loss, insurance let me keep it but never gave me a salvage title. Is it clean?

    Posted: 31 May 2019 08:24 PM PDT

    Hi there,

A year or two ago I had a minor sideswipe by somebody. Reported the claim and the insurance declared the car a loss and wanted to possess it. After negotiating, they took a couple hundred off the claim and let me keep the car. I never was advised to report it as salvage and never received a salvage title in mail. I've been driving it since, have renewed registration twice, changed insurers and passed emissions testing without issue. I live in Illinois FWIW.

Fast forward to now and I'm trying to sell the car. The Carfax lists it as a total loss but a clean title. Is the next owner going to have issues registering the car?

I've been browsing through Illinois title law and came across this:

Sec. 5/3-117.1. When junking certificates or salvage cer- tificates must be obtained. (b) An application for a salvage cer- tificate shall be submitted to the Secretary of State in any of the following situations:

    (1) When an insurance company makes a payment of damages on a total loss claim for a vehicle, the insurance company shall be deemed to be the owner of such vehicle and the vehicle shall be considered to be salvage except that ownership of a vehicle 9 model years of age or older may, by agreement between the registered owner and the insurance company be retained by the registered owner of such vehicle. The insurance company shall promptly deliver or mail within 20 days the certificate of title along with proper applica- tion and fee to the Secretary of State, and a salvage certificate shall be issued in the name of the insurance company. An insurer making payment of damages on a total loss claim for the theft of a vehicle may exchange the salvage certificate for a certificate of title if the vehicle is recovered without damage. In such a situation, the insurer shall fill out and sign a form prescribed by the Secretary of State which contains an affirmation under penalty of perjury that the vehicle was recovered without damage and the Secretary of State may, by rule or regulation, require photographs to be submitted.

    https://www.cyberdriveillinois.com/publications/pdf_publications/vsd224.pdf

"In an effort to minimize automobile "chop shop" crime, the Illinois Vehicle Code does not permit you the right to retain the salvage once the insurance company has deemed your automobile a total loss. There are only two instances that you may be able to retain your vehicle: 1) if the vehicle has incurred only hail damage that does not affect the operational safety of the vehicle, or 2) if the vehicle is nine (9) model years of age or older."

    https://insurance.illinois.gov/AutoInsurance/total_loss_auto.pdf

I have been unable to find anything regarding my responsibility to report a car as salvage once it is deemed a loss.

My car definitely is older than 9 model years, so does that mean I don't have to report it and can just sell it as a clean title?

Hopefully this is the right place.

    Thanks!

Applying to Claims Adjuster Trainee position, looking for advice (NY)

    Posted: 31 May 2019 11:18 PM PDT

Hi! I don't have any insurance experience, but it is something that's interested me for a while. I have ~6 years experience as a supervisor in retail while I am currently working FOH in a very busy restaurant. I'm 24 years old. I am just three credits shy of a bachelors degree in an unrelated field. Is that an adequate background to get my foot in the door?

I'm considering applying to a claims adjuster trainee position for a large company, as I don't foresee myself in the food industry forever. Should I pursue any licensing beforehand? I am located in NY, but do not yet have a permanent address here, so I believe I'm considered a non-resident.

Thank you for any and all help!

Sister was involved in a hit and run pile up accident

    Posted: 31 May 2019 04:50 PM PDT

Hello, My little sister was involved in a hit and run situation on the freeway. Basically a car hit the car behind her, causing that car to lunge forward and hit my sisters car, causing her car to lunge forward and hit another person. The car that initiated the pileup drove away, fleeing the scene. My sisters car does have some damage on both ends, but still drives. They exchanged information. We are unsure if we need to file a claim on our own policy, if we are responsible for a deductible, need to get an lawyer, or if we need to do all of the above?

I thank y'all in advance for any advice.

To sum up the event: V1 hit V2, V2 hit V3(sisters car), V3 hit V4.

    Car Insurance goes up 16%

    Posted: 31 May 2019 10:42 PM PDT

I live in California and have Farmers Insurance. Been with them for a long long time. Mostly out of apathy. My policy covers my 2005 4Runner and my wife's 2013 Civic. No accidents, no tickets. My insurance jumped 16% from last period. Why does my insurance keep going up? The money I would get from insurance keeps going down each year but my insurance goes up. Who does reddit recommend for car insurance?

Was overpaid on a medical claim from a year ago. Insurance company now wants me to refund the incorrect payment.

    Posted: 31 May 2019 08:20 AM PDT

I was living in Asia and had international health insurance. Went to see a doctor there and submitted the claim to my insurance. They paid me more than what I should've been paid. I noticed this and contacted the insurance company to tell them they overpaid me and they said don't worry about it and there's a chance they won't notice it. Now they are asking me to refund the money. I am no longer a member of that insurance company. They are saying if I don't pay them then they will deduct money from future benefits payments. But I likely will never have those benefits again. Should I just not pay them? Can they do anything if I don't pay?

    I think Allstate committed fraud

    Posted: 31 May 2019 08:09 PM PDT

Okay, so a little back story. I am currently pregnant and my fiancé has a C6 corvette we need to trade in for a family car. We go to a dealership that offers 4K above what KBB suggests as a trade-in. When we are at the dealership the salesman runs a carfax report on his VIN. He says he can not accept the vehicle as a trade-in because the car was reported a total loss. My fiancé says that while he was in an accident 2 years ago that isn't possible because he was never notified of this. He DID buy the car from a "buy here, pay here" car lot, and not an actual dealership. The salesman informs us that those types of car lots aren't held to as high of a standard as dealerships are, so it is possible that my fiancé bought the car with that blemish on the car fax, but his version of the report couldn't tell us the exact date that was put on the report.

So with that information we paid for a car fax of our own. He was in the accident in February of 2017, sitting at a red light while it was pouring rain out, and a woman slid into his driver front end somehow- I don't know the specifics because we hadn't met yet but the woman's insurance claimed fault. When an Allstate inspector came out he told my fiancé that he doesn't recommend he drive the car, and tells him he will have it towed to the repair shop Allstate has chosen. My fiancé wanted to take it to a Chevy dealership and have a certified corvette mechanic do the work, but the guy there doesn't do auto body repairs on them.

So he gets his car back, Allstate and the repair shop say everything is fine, car is operable and fixed. For whatever reason my fiancé still tried to get a diminished value claim from Allstate, and they denied him saying the vehicle was fine.

Then, in June or July 2017 is when Allstate reported the vehicle a total loss to car fax, after the claim was closed.

So he called the claims department and was asking about diminished value, the girl tried to help the best she could but was also reluctant to give out any answers. She said she would have someone from the diminished value sector contact him. When they did they denied any responsibility for paying anything out, and that it was the woman's insurance that would need to be contacted. We are supposed to get her insurance info through certified mail any day now.

What is the best course of action here? Get a lawyer? We can't even trade in this car for a vehicle that can carry two car seats, and if the car fax is correct and there IS structural/frame damage to the car, and we are in an accident and become seriously injured from it is Allstate at fault?

TDLR, Honestly we feel like Allstate has committed fraud because they made him go to their own choice of repair shop(which is legal, I know), told my fiancé his vehicle was repaired to satisfactory condition on the other party's insurance's dime, and then filed a total loss on the vehicle without informing my husband.

    What can I do?

    Posted: 31 May 2019 07:45 PM PDT

Was involved in an accident where the other party was 100% at-fault (as stated in the police report). I don't have collision coverage, though. I called his insurance to file a third party claim (his insurance also has no collision coverage) and they told me that they were having issues since the driver that hit me used the car without permission (his father owns the car). I know I'm entitled up to $1K but in this situation, can I sue in a small claims court or possibly have my car repaired? And no, neither of us was injured but the damage to my vehicle costs about $2.5K to $3.5K. (MI)

Red Shield Extended Auto Warranty- Anyone have experience with this company?

    Posted: 31 May 2019 09:17 AM PDT

I financed a 2011 Jeep Grand Cherokee last year from a dealership. It had 90k miles when I bought it but was in good condition. I ended up buying the extended warranty from the dealer bc it had a good amount of miles and it covers most big issues. My ac went out and my car is in the middle of being inspected by the adjuster. Looks like it's an evaporator and condenser leak. I've read up on this company and I see a lot of "beware" reviews because they will deny claims because of technicalities. Anyone have any experience with this company? I now know that most of them are scams to begin with so I'm not hopeful, but then again it's not a 15k claim, but only a 2-3k claim.

Can I get insurance on a tourist attraction that also doubles as a private residence?

    Posted: 31 May 2019 09:16 AM PDT

Ok! So this is the deal, Friend owns a small piece of property in California that has a rickety old house built in 1930's. On the same property is a bunch of old antiques that have somehow become a large tourist draw. The property has all sorts of fun, sharp, jagged stuff an unwatched kid or drunken adult could hurt themselves on. With so many strangers going in and out of the property, I'm worried about someone getting hurt and suing. Is there a way I could get the property insured against that sort of thing? I'm not worried about the house as it's in pretty bad shape, just the strangers milling about the yard.

Need advice on how to file a claim for an at fault accident

    Posted: 31 May 2019 05:57 PM PDT

So a couple days ago, I was parking at a local supermarket in Colorado and I scraped the side of another car while parking, resulting in some damage to the car. I gave the owner my name and phone number, I didn't give her my insurance information since I'm just a teenager and I didn't know where my mom has it in our car. I just got a call from the local auto shop that the owner of the car went to for the repair, and they gave me an estimate of for the repair costs to the car. I'm just looking for advice on what I do from here, I've never been in this situation before and I don't know how to go about filing a claim and how any of that works.

[Georgia] Involved in a multi-car accident when I'm not at fault. At fault driver only has state minimum liability. Will filing a claim on my own insurance raise my premiums?

    Posted: 31 May 2019 02:08 PM PDT

Myself and 4 others cars were involved in an accident, including the at-fault driver. Myself and the driver behind me were completely stationary when the at fault driver started a chain reaction. Her insurance and police report both say she is the sole at fault party.

My car is the only one that is repairable, rear bumper probably needs replaced (per the body shop), in addition to whatever structure or electronics were impacted. The estimate just has the bumper getting reworked, so the estimate is probably short already. The two cars behind me were totalled, one of them being a pretty new loaded SUV.

Right now, there is still a waiting period from the at-fault drivers insurance claims rep because they don't have all the info to officially say the driver is underinsured. If I go ahead and file a claim on my own insurance, to try and speed up the process (and be less of a headache for me if the cost for repair does significantly go up once the car is torn apart), will this affect my premiums at all? Does GA Code 33-9-40 apply for a claim that I would file on my own insurance if I'm not at fault, or does it only apply to claims from the at-fault party? Thanks for the help.

How to properly cancel auto insurance? (CA, USA)

    Posted: 31 May 2019 05:09 PM PDT

    Hello /r/insurance

I have a vehicle registered in the state of California (my license/residence is New York but I'm stationed in Cali) and my friend who has power of attorney (I'm currently in Asia for work) transferred ownership (with my consent) of the vehicle to a company that towed the vehicle. The vehicle is pretty old and non functional so we decided to just get this headache of a vehicle out of my life and sign it over to the company. That's already done. I called my insurance company (USAA) about cancelling my policy since I'm no longer operating this vehicle and don't own it and the representative I spoke to informed me that upon cancellation, it will automatically inform the state that the registered vehicle is no longer insured.

I no longer own this vehicle and it's no longer being operated on the road. What's the best way to take care of it so the state knows that I have nothing to do with this car so I can cancel my insurance policy and stop paying for this vehicle?

Is there any reason to NOT use an independent insurance agent for Condo [HO-6] insurance? Looking for a critical path to the best price on the right coverage.

    Posted: 31 May 2019 03:29 PM PDT

The online quotes leave much to be desired in terms of clarity and usefulness. Important details such as exclusions for specific types of loss (theft vs. damage, e.g.), replacement cost vs. actual value, and even the amount of coverage (Hartford, loss of use), are simply missing from the quotes. I have read my HOA's declaration and bylaws, understand (I think) what coverage I need, and have shopped quotes from several of the big names (Amica, GEICO, Hrtford, etc.) and am having a damn difficult time understanding what is actually covered. For example, Hartford offers "extra" coverage for specific valuables (jewelry, china, etc.). When I inquired as to under what circumstances I might need this, I was advised that the personal property coverage excluded losses over $1500 for theft for a bunch of different property categories. When I asked to read the details, which seems like the prudent course of action, I was told that I could only read the policy details after I purchase the policy.

What's the right way to get this done right?

    Car Insurance rates dropped significantly..

    Posted: 31 May 2019 10:51 AM PDT

Im a 17 Y/O male with progressive in California.

My normal rate is 570 every 6 months for liability on my car. Works out to $1xx every month. My renewal came this month, so I opted to renew and all was well.

I went to check my payment schedule and I see my rate was practically cut in half. Now 275. What on earth? https://imgur.com/a/e3kdHpB

I called progressive and the lady was confused as to why I was pushing it, but I know for a damn fact they arent going to insure a 17 Year old male for 45 dollars a month.. she claims everything is fine though. (This is my own policy)

Any reason why this could have happened?

Involved in fender bender in Boston. Next steps / tips on filing accident claim with insurance.

    Posted: 31 May 2019 01:24 PM PDT

Hello, I'm a Massachusetts driver that was involved in my first auto accident.

Thankfully, it was a relatively minor accident- some dents but no air bags deployed, no injuries on either driver.

I'd like some tips on filing an accident claim (or whether it's better not to file one at all?) - particularly, some questions they might have in the filing process.

Mostly, I expect the rate to go up (I guess it depends on the type of insurance and the company you have, and I know some companies like Geico have first time accident forgiveness) and the other driver to contact my insurance company, but I have a couple of other questions :

    1. I saw some posts regarding not filing a claim at all for an at-fault accident- in what cases is it better to do so?
    2. If a driver were to report no injury, is it hard to claim anything if he/she were to require short-term physical therapy later on?
    3. How much should I expect the insurance rate to go up, and for how long?
    4. What exactly happens from the time I file an accident claim? What should I expect from the other driver / the insurance company on their side?
    5. At which point do I need to go to my dealership to get any repairs done for my vehicle?

At fault insurance maxed out limit; should I sign property damage release?

    Posted: 31 May 2019 11:10 AM PDT

    [WA, car accident]

    Hi guys,

I was rear ended in a multi-car accident, and the at fault insurance is maxing out their property damage limit.

They said they will send me a property damage release letter, and I need to sign it and mail it back.

I have underinsured coverage under my own insurance, and they said I can use it once the at fault insurance release their limit info to them.

    Questions:

    1) Should I sign the letter? Are there any negatives to that?

    2) At fault insurance company said their max includes $200 for loss of use. My insurance company said if I use my UM, I won't get loss of use $, because UM doesn't include loss of use. Is there a way I can get my insurance UM to fix my car, and also get some $ for loss of use?

    Thank you guys!

Medical Payments - Universal Property: $1,000 TypTap: $2,000

Universal sounds like the way to go but I see their ratings are kinda terrible. Would hate to deal with a terrible company while going through a stressful situation (hurricane damage or whatever). But I've never heard of TypTap so kind of reluctant ...

Anyone here currently with either of these? Or any thoughts or advice in general??

    Thanks!!
