I'm being sued for $200k-$1M for a car accident

    Posted: 15 Jun 2019 03:35 PM PDT

    TL;DR Version:

Got into a car accident at a 4 way intersection. I'm claiming the other driver is at fault, he is claiming vice versa. Currently there are no witnesses or any proof to show who is at fault (to my knowledge). Today I was served with a citation that I'm being sued for between $200k - $1million dollars by the other driver for his injuries.

    My insurance coverage is

Bodily Injury Liability - $30,000 each Person/$60,000 each Accident Property Damage Liability - $25,000 each Accident

Am I going to be forever in debt from this day forward?

    LONG VERSION:

I feel like I'm about to have a panic attack. . I'm hoping anyone here can help me

I'll try my best to explain this situation:

    The Accident:

A week or so ago I was involved in a car accident. This is a map of where this accident occurred, with street names edited out. The number 1 is my starting point and 2 is where the collision occurred.

My car was following the red line, the other car was following the blue line. The arrows indicate the direction of travel.

My car (red) was traveling southbound on the service road, stopped at the light [#1 on the screenshot], then turned left onto the bridge. I know that I had the green light to cross over the intersection #2, I remember seeing it change to green while driving across the bridge. And the other driver also believes he had the green light. So we have a collision at intersection #2 on the map.

I didn't claim any injury and refused ambulance, I was pretty much unharmed. The other driver declined an ambulance, and was fine enough to be standing and giving the police his report. The driver stated he would be driving himself to a hospital.

Here's where I kind of messed up - the police took down my testimony while the other driver was literally standing right next to us, about 4 feet away, so the driver was listening to me speak. The way I phrased my side is that

    . . . I was driving over the bridge. I'm pretty much positive I had the green light. . . I believe I had the green light . . . etc.

The reason I was saying it like that is because I assumed that it was going to be up to the insurance to actually determine who is at fault. The other driver was listening to me speak and I didn't want to definitively say he is at fault because I feel like it would have cause an argument. In hindsight I realize this was really stupid of me. . .

The insurance agent mentioned when she received the police report that this type of wording made things ambiguous - and also that the police wrote a note on the report of blaming me for driver inattention, which I would argue against.

Both cars were totaled, his was a ~1995 Toyota Corolla, mine an 05 Prius.

As of now, no fault has been able to proven because both drivers and insurance parties are claiming the other is at fault. No dash cams, no witnesses, no proof to my knowledge of who had a green light except our own testimonies.

    Today:

I was served with a citation that I am being sued by the other driver. Some highlights:

This is a serious injury claim arising out of a motor vehicle crash that occurred on 6/6/19. Plaintiff was driving northbound on ______ service road (blue line on map). Defendant [me] ran a red light on ________ (intersection at point 2) causing him to violently ram into the side of [other drivers] vehicle

Defendant [me] owed duties of ordinary care to Plaintiff and other motorists. Defendant's conduct, as outlined above, breached those duties through various acts and/or omissions, including the following, each of which singularly or in combination with others, constitute acts of negligence that were a direct and proximate cause of the occurrence in question and the resulting injuries to the Plaintiff.

    a. Failure to maintain a safe speed.

    b. Failure to maintain a proper lookout

    c. failure to make timely and proper application of brakes to avoid the collision

    d. failure to exhibit proper driver attention

    e. failure to take proper evasive actions to avoid the collision

As a direct and proximate result of the foregoing acts and or omissions, Plaintiff suffered severe and debilitating personal injuries and resulting damages

Another section states that the Plaintiff has sustained actual damages for medical treatment paid or incurred -

By reason of all the above and foregoing, and as a result of the damages suffered by Plaintiff, Plaintiff seeks damages in excess of the minimum jurisdictional limits of the court

    . . .

Pursuant to Texas Rule of Civil Procedure 47, Plaintiff seeks monetary relief over $200,000.00, but not more than $1,000,000.00, including damages of any kind, penalties, costs, expenses, pre-judgement, and attorney fees.

Ok, here is why I'm having a panic attack. . This is my insurance coverage:

Bodily Injury Liability - $30,000 each Person/$60,000 each Accident Property Damage Liability - $25,000 each Accident

So, let's say I'm found at fault for this and they decide $500,000 will be paid. Does that mean the insurance is only going to cover $30,000 injury and $25,000 property, and them I will be responsible for the other ~$450k?

I literally have no savings and about $27k of student loan debt (which I thought was a lot of debt before this happened). Is my life basically over now?

Travel Insurance Help: Had serious car crash in Iceland and trying to claim (Australian Travel Insurance)

    Posted: 16 Jun 2019 12:01 AM PDT

    Hi all,

As the title says - I was involved in a serious car crash while travelling in Iceland (I live in Australia). Fortunately, I bought travel insurance through Southern Cross Travel Insurance for the whole 4 weeks of my Europe holiday.

I was travelling in a camper van and a car swerved in front which caused me to roll multiple times. I'm OK, however all of my belongings in the van were completely destroyed (food/liquids went everywhere, petrol covered everything, glass destroyed everything etc). I have all police reports and relevant documents etc stating I was not at fault.

However, silly me I did not 'specify' some expensive items (laptop, DSLR camera, drone etc). This is what I'm really worried about as the grand total of items that were destroyed was probably $20k+ AUD.

I was hoping someone could please:

    1) Thoroughly investigate the policy and find out what the maximum amount I can claim under each bracket is, for things I didn't specify

    2) Confirm if I need to produce receipts or bank statements or both

The policy can be found here:

    https://www.scti.com.au/media/1038/scti-au-travelcare-pds.pdf

I'm a little confused as Page 6 seems to contradict itself - i.e. "Section Limits" states a maximum of $1,000 of cash can be claimed, but in the "Sub Limits" table it says only $500 can be claimed.

Essentially I'm hoping to claim as much as possible to cover the cost of the items I didn't specify :(

    All help is graciously appreciated!

Got a subrogation collection notice 1 year after an accident.

    Posted: 15 Jun 2019 10:01 PM PDT

I just got a subrogation collection notice in the mail a little over a year after a minor accident i was in. The accident was i hit someones car who stopped in front of me out of no where after pulling up to merge into a lane with no cars. We exchanged info and drove away. I didn't report the accident because there was no damage but the other party did report it and claim it was my fault. It was my first ever accident ever and i didn't really know what to do at the time. I know it was dumb not to report it as well now. I did give them full discription and information about what happened after and they invistigated it, took records etc.The case was resolved saying that there was not enough evidence and that it was resolved. I'm currently using a different insurance company than the one that i used a year ago where the case was opened with.

Now i got this notice saying i about 15,000 dollars from a subrogation notice. If we dismiss the fact that the case was resolve the accident itself was no way worth anyway near 15,000 in damage. My car just hit the back of there plastic bumper. It left no mark or scratches or anything. My car had the license plate bent a little and that was it. I can understand if it was like 1,000 or 2,000 dollars since my license plate was the only thing damaged and i would not be panicing but 15,000 is making really scaring me.

What are the steps to resolve this issue? I sent an email to the old insurance company i was insured at because they are closed.

Do i reply to the letter they subrogation letter with the info that they ask for or should i get a lawyer ? What steps can i take?

Hormone Panel costs 800$ and health insurance says it won't help

    Posted: 15 Jun 2019 09:52 PM PDT

Hi all. Currently panicking over an insane bill and would appreciate your help. I recently went for an annual checkup and mentioned that I had felt I was having libido issues. I said that I wanted to get a hormone panel to see if it was a testosterone issue(i'm a guy). I also said that if we were getting bloodwork done then I would also like an STD screening(the doctor asked if I wanted to and I agreed).

I just got the bill for the bloodwork and it was 800$, all of which I am expected to pay because apparently "Benefits are not provided for treatment of sexual dysfunction or impotency." Of course this was not communicated at all until the bill came. One important thing to note is that only about 180$ of this was for a testosterone screening, the rest seem to be STD test + a standard metabolic panel. Here is what I am wondering:

    1. Can I dispute any non-hormonal tests here as not being part of my libido concerns? Like I said, this was just supposed to be for a checkup.
    2. Assuming I can dispute everything else, is there anything I can do to try justifying the hormone panel to insurance? Honestly I wasn't that worried about the libido issues, I mainly was curious as to what my test levels were at. I guess I am going to pay a hefty price for that mistake, but I really didn't think it would be this expensive to get a hormone panel. Any insight here would be greatly appreciated.

    New Home owner- Insurance.

    Posted: 15 Jun 2019 11:01 PM PDT

Looking for home insurance on a home we're buying (hopefully). The thing I'm worried about the most is the inspection. I know the roof is going to need replaced. Probably in a year or two. Which by then, we will have the money. Though I've read stories where home insurance has tried to cancel policies, 14 days after starting, for this reason. So my question is:

If I choose 'Actual Cash Value' instead of 'Replacement Cost', do you all think they would try this with me?

    Uninsured/Underinsured Motorist

    Posted: 15 Jun 2019 08:50 AM PDT

How necessary is it to have this insurance. I am currently in the process of getting a job which requires me to have both because I need to use my car to get from job sites. On average, how much will this add to my payments and is it something I should have had this whole time?

Car Owner vs. Owner of Insurance Speaking w. Claims Adjuster!

    Posted: 15 Jun 2019 09:22 PM PDT

My aunt pays for insurance on my car. I totaled my car on Thursday and the claims adjuster is supposed to be informing us of the payout for the car they will give us. My question is: Can I, being the owner of the totaled car (name on title) speak with the adjuster to negotiate the payout if need be? My aunt sucks at that shit.

    Thanks!

    Not medically necessary?

    Posted: 15 Jun 2019 09:13 PM PDT

A relative recently had emergency spinal surgery followed be a stay in the neuro intensive care unit. Afterward, he was transferred back to a regular hospital room and then sent by ambulance to a rehab center/nursing home to recover. Medicare and the supplemental insurance denied the ambulance bill as "not medically necessary." Can't call them until Monday, but what are the odds this could be successfully appealed?

[CANADA, ALBERTA] I want to buy a van to convert to a camper, but am having some trouble.

    Posted: 15 Jun 2019 08:45 AM PDT

I want to buy a GMC savana (think electrician's work van) and convert it into a camper.

I've asked a few insurance companies if they'll insure it as an RV and they have told me no.

What is stopping me from buying the van and insuring it as a regular van, and then building out the inside?

If I did that and got in an accident, could they decline coverage or something?

    Accident in girlfriends car

    Posted: 15 Jun 2019 04:48 PM PDT

    This happened in Ohio.

I was driving my girlfriends car. I have full coverage for my car but my girlfriend has only liability on her car.

I got into an accident and I was at fault, failure to yield for left turn.

My girlfriend and I are worrying that her insurance is going to skyrocket for my mistake. I called my insurance to see if we could do a claim only through mine instead of hers and no one could really give me a straight answer. I was told that my insurance might cover it because Ohio might carry insurance for the driver, and not just the vehicle.

I do not want my girlfriends car insurance to go up for my mistake. I would rather take the higher insurance because of my mistake. Could someone explain how auto insurance for Ohio would work for this? I have Progressive and my girlfriend has Geico.

Please advise - How expensive is a lapse in coverage?

    Posted: 15 Jun 2019 12:34 PM PDT

I'm in the process of selling my car and will be without a vehicle for the first time in years. My current job is located right off the subway and I don't have much need for a car for at least the next few months. How concerned should I be about having a lapse in coverage when I do eventually get another car? (in likely 3-6 months from now)

Progressive offered me a liability only plan for $55/ month. worth it? I don't plan on borrowing or renting a vehicle during this time , so the only benefit would be to avoid a lapse in coverage and potential higher rates down the road. This is in California.

Not sure what car insurance to get

    Posted: 15 Jun 2019 10:21 AM PDT

    Hello!

I am in search for auto insurance. I have a perfect driving record for 8 years. I have been driving for 8 years. I am a white female and in my 20's. What is recommended for insurance? I want the collision and comprehensive so if injured or if someone hits me their company will pay for my insurance. I will add the uninsured motorist to my package too because many are uninsured and I am covering my ass. What is the best plan coverage wise?

Question about filing a claim in a car accident

    Posted: 15 Jun 2019 01:45 PM PDT

My girlfriend recently got into a car accident, rear ending a Prius at a stop light. She was going less than 5–10mph at the time. My girlfriend's SUV is hardly damaged but it blends in from previous mishaps, unsure if it is worth of filing a claim on its own. The Prius will likely have $2k-3k of damage by my initial estimate (new rear number cover and work to repair the upper trunk lid).

They have the same insurance, I am curious about the logistics of filing a claim:

    1. Does my girlfriend (who is at fault) need to file or should she wait until the Prius driver makes a claim? They documented the necessary information, simply curious who should or needs to act first?
    2. If Prius driver makes a claim, does my GF have to pay her deductible or will they "only" reassess her monthly premium?

Ultimately she will be calling to file a claim, the situation just got me wondering about the logistical order and if there was a way to mitigate financial impact in this situation?

Does health insurance not cover minor kitchen accidents in your own home?

    Posted: 15 Jun 2019 01:14 PM PDT

Using a throwaway account for privacy.

I am so confused about this - I cut myself at my own kitchen with a knife, nothing major, but I went to the doctor to get a tetanus shot after. My health insurance sent me a form asking if it was an accident, where it happened, etc. which I answered saying it was at home. Now I'm getting a notice that the $100 bill for a doctor's visit will not be covered. Is this not covered by my health insurance??? What can I do about this?

Increased rates despite not at fault accident, repairs paid out of pocket?

    Posted: 15 Jun 2019 11:45 AM PDT

I live in Michigan and have Progressive auto insurance. In January of this year I was rear ended by another driver. There was very minor damage to my rear bumper and their front and no injuries.

The local police Dept and they said they typically don't respond to minor situations like this. (Damage less than $1000 and no injuries). So we exchanged info, took pictures, and went on our way.

The cost to repair my bumper was less than my deductible so I paid out of pocket. I never notified my insurance. I have no idea what the other person did.

This week I got the renewal offer for my insurance and it was suspiciously high. I did a manual quote for myself with my same VIN on progressive.com and it was almost $200 less per 6 months than the renewal. I asked progressive about the discrepancy and they cited a report of "damage" to my car.

Since I was not at fault here, progressive didn't pay a claim (I paid out of pocket), and frankly didn't even notify them, can they raise my rates? How did the "damage" even make it into the record if no police report was made and no claim was filed? Is there something I can do to correct this situation? It seems quite unfair that my rates would jump ~30% for being the victim of a minor fender bender and paying out of pocket.

    Insurance score

    Posted: 15 Jun 2019 09:58 AM PDT

Last week we got our yearly documents for car and home owners insurance. We pay in full for the year and the premium for two cars 05 sienna and 17 Camry was $1174.

Today I get a letter that says amended declaration and reason for amendment: updated insurance score. The new yearly premium went down to $890 (homeowners also went down from $935 to $750)

My question how is your insurance score calculated? What changes it? Nothing has changed for us recently. We did have a total loss but were not at fault and the other insurance took care of it all. Before that no accidents/tickets anything else in years. What could make it go up? I'm assuming our score improved since our rates went down.

Was this a HIPPA Violation? Medical information given over the phone.

    Posted: 15 Jun 2019 09:15 AM PDT

This happen a few years ago, I need a CT scan, and someone from my provider in charged of authorizing coverage called me informing me he needs more information before they will authorize the scan and coverage. He has been unable to get into contact with the Doctor office, and so reached out to me instead to get some information about my symptoms and any blood work. He ended up approving my CT scan.

Now I am thinking, was this a HIPPA violation? He did ask some verifying information such as Address and DOB, but still this was done over the phone, which isn't 100% secure.
