Advice - Business Partner had Son on Payroll. Son does not work for us.

    Posted: 28 Apr 2019 10:52 AM PDT

Throwaway, since I'm not sure if I have any liability here...

I'm a 25% partner in an S-Corp (USA) with one other partner (75%). I became a partner about 4 years ago, and I'm about 20 years younger than the other partner (my former boss). For years, he's handled payroll and finances with little involvement from myself. Things have been good so I had no reason to be suspicious, but I recently decided to review some payroll files and discovered that his son has been getting ~50K per year for the last three years as a subcontractor (1099). Every 2 weeks, our payroll company issues the son a check just like all the other employees. The son occasionally comes in in the summers, but doesn't do much of anything and is in college out-of-state for most of the year.

It's obviously illegal since the son doesn't actually work for us, though maybe not that uncommon from what I'm hearing. That said, the money is coming out of our profits that I'm entitled to 25% of. I'm also concerned that he's opened me up to some tax liability as well given my ownership stake. Any advice on how to move forward, protect myself, and address this with my partner is appreciated!

Advice- Fiancé wants to become part owner with a succession business loan?

    Posted: 28 Apr 2019 05:17 AM PDT

Guess I'm looking for a little piece of mind..? My fiancé (27) works for an adult foster care provider. His boss (60?) was planning on buying the company from the owner but was told since he's getting to retirement age the lender would prefer a succession business loan? Fiancé would go in with a currently unspecified amount of money towards the loan and become part owner, eventually taking the loan on and becoming the sole owner once his boss retires. Not sure if I got that right, this is all a little confusing to me.

My fiancé is excited about the opportunity, he's talked about wanting to buy the company before but I'm nervous. He has a meeting with the bank next week and I'm assuming all our wedding/honeymoon savings would be going towards this.

The business is successful and he kicks ass at his job but I've never been good with bid decisions.

Advice - Registering for VAT for short period of time

    Posted: 29 Apr 2019 03:08 AM PDT

I have recently started a new business that deals with a supplier in Italy, I plan on making one or two orders a year from this supplier, approx 5k each order.

The Italian supplier has said that I need to be VAT registered to make the order.

I deal mainly with the public, so becoming VAT registered will increase the price of my products, which isn't ideal.

Is it possible to become VAT registered, pay for the goods, and then de-register?

    Thank for your help!

Seeking input on a new Landscape Design business

    Posted: 28 Apr 2019 09:51 PM PDT

Hi everyone, just wanted to share my new landscape design business and see what other small businesses think! Looking for constructive criticism. My goal is to make it clear what I am selling, and to answer any unanswered questions.

My name is Wayne Baldwin, and I created Landmarks Design as a way to make professional-quality landscape design accessible and affordable to anyone. All a client has to do is log in and choose one of the design packages we offer. From there, they will consult with us, fill out a Site Quiz to give us more specific information about their site and their unique preferences, and upload, email us, or allow us access to images (photos of project, design ideas) and other documents (such as plats, surveys, house site plans, etc). Our website also offers free information that will be supplemental to their design plan, such as general construction details and information on planting, site prep, and maintenance.

The website is www.landmarksdesign.com - Id love to hear your input!

    Advice on collecting on invoices

    Posted: 28 Apr 2019 12:10 PM PDT

Not an owner here but a college student who works in accounting/administration of a small business. I don't own the company so I'm going to keep it vague. Ok?

So the company I work for is a manufacturer for an expensive consumer product. We manufacture and sell to dealers who then sell to customers. We have a 5 year manufacturer's warranty. When things break (and they will because stuff happens) we send out a part with a term net 15 invoice. The idea is that the dealer replaces the broken part and sends back the broken part in about 15 days. When we receive the broken part we cancel out the part invoice with a corresponding credit invoice. When we confirm the part is in fact broken we credit their account for warranty labor.

The problem. We get dealers who don't return the broken part. They don't because they are busy, or they forget, or they didn't pay attention when we told them. The reason doesn't really matter. However, without the broken part we cannot confirm that they are not in fact using our warranty program to stock themselves for billable work. So we cannot credit the part invoice back without the part. Also, we cannot credit their warranty work without the broken part. This can cause anger and confusion.

So I have been tasked with a plan to get these dealers to get the parts back to us. I need to have it be automated enough that it won't cause a huge strain on man hours. It also needs to be polite as we like our dealers and frankly we need them. It also needs to be flexible to deal with mom and pop operations as well as corporate entities.

Does anyone have any ideas? I am new at this company and I don't have enough experience to come up with anything more than a nicely worded e-mail. I think the owners have already had that idea. Thanks.

New Business Plan: How To Get People on Board?

    Posted: 28 Apr 2019 07:46 PM PDT

    Hey Reddit!

So I posted last week about legal forms and procedures. This week I am wondering how to get people on board with a new business plan that revolves around ESports and Daily Fantasy Sports? Basically to help build a website, maintain, designs, stat trackers, etc.

I know there are developers who can be hired for jobs or third party sites that allow you to.purchase such plugins. But I would honestly love to have a team that is solely focused on what can be created and maintain it as a team. Obviously everyone gets a piece of the pie hypothetically (if it works) with the major risk of if it doesn't.

Would you suggest reaching out to people in the surrounding areas on job boards, sites like reddit, social media?

Any tips, suggestions, happy or bad thoughts welcomed.

I hope everyone has a great week and appreciate you taking the time to read and respond! Thank you, Shaun

[MO] Fired GM for stealing, who can I hire to look into payroll and business bank account fraud/theft?

    Posted: 28 Apr 2019 07:08 PM PDT

I had to appoint a new GM for bar/restaurant, they had been working for about a year.

Installed some video surveillance and happened to be watching. Noticed them just going wild on the clock, eating food, drinking, doing multiple rounds of shots with friends and looked a little further into it.

Long story short, GM was taking tips from bar/servers, creating fake comps, voids, stealing part of money drops, food and alcohol daily. (thats just what I could roughly find, over $3k in comps in a quarter)

What the best way to go about investigating this. Theres only so much I can do and would much rather have a professional step in and help. I have payroll and POS systems, business checks and bank cards the GM had access to.

I'd like to find out about everything they did and tally up collateral damage here so I can prosecute them for stealing, etc...

Advice- Is It Worth Me Creating A Sole Proprietorship?

    Posted: 28 Apr 2019 04:10 PM PDT

I am an Electrical Apprentice in Michigan which requires me to take classes for 4 years and have 8000 hours of on-site training. (Info if you are more interested Here) I'm currently about 7 months into the apprenticeship. I really enjoy my work and at $13 dollars an hour it's decent pay in the summer/early fall time, but isn't much come winter and early spring.

I have recently been doing side work for my mother's friend who is paying me cash to do things to get his newly bought home into living-condition; as well as some other misc. things such as driving vehicles, etc. Should I register as a Sole Proprietor or something along those lines? I'm only 19 so I have absolutely no experience in this and would love to hear your opinions. Perhaps Pros and Cons to this. I'm mostly trying to protect myself from the government swooping in and making me pay taxes if I am, indeed, supposed to be.

Edit: Feel free to ask more questions in the comments or a DM

    Creating proper IT contract details

    Posted: 28 Apr 2019 04:05 PM PDT

I have a potential 6-12 month IT contract coming up. My plan is to ask for $90/hr at 20hrs/week for the project, which should last somewhere between 6-12 months. I plan to hire a dev from upwork with the appropriate experience for the techs to be used and pay them $40-45/hr, with their role being the main dev doing the bulk of the work. Then, I will be paid the remaining $45/hr to manage the project, and assist with development.

Ok those are the meat and potatoes of the plan. Is it a good idea? What can be done better? What am I missing? I'm looking for any kind of comments/suggestions.

    TIA for comments and suggestions!

    Determining daily income

    Posted: 28 Apr 2019 12:39 PM PDT

I'm really trying to parse out my daily expenses and not sure if I'm going about it properly.

Let's say I'm open 5 days a week so I take all those days and hours and it comes up to approximately 22 days per month and about 51-55 hours per week.

If I take all my expenses and divide that down that should equal X/day, obviously. But some days I don't come close to that so I have to make up for it on other days. How do I represent that or do I just keep it even? Like, if I want to communicate to my employees that we need to reach x/day, I don't want them to think we're making our goals if we made more than that on some days since we didn't come close on other days.

Hiring own employee as a contractor

    Posted: 28 Apr 2019 10:31 AM PDT

Hi there, I am new to this sub-reddit and I was wondering if someone could help me with a question that I had.

I have an employee and this employee has a company of his own. His company does construction work (which I need). But, is it possible to have his company do contract work for the company at which he is hired at?

Furthermore, I am aware of this and I have no issues with this. I just want to know if this is fine on paper and legal (in Canada).

    Thank you!
