[Update][MI] Received subpoena to testify for woman I don't know Posted: 02 Apr 2019 08:26 AM PDT UPDATE: I spoke with someone at the court and she was able to find the mix up. As many guessed the real victim and I share a first and last name but they had entered the wrong birthday. Thanks to everyone who offered advice or help. A few people suggested contacting the law firm on the subpoena which was what I had planned so I contacted them yesterday morning. After not hearing back yesterday I followed up today only to be told they don't get to decide who to send subpoenas to, they get the order from the court and they send it. The law firm suggested contacting the police station to get a copy of the report so I called them immediately after. Now for the big twist, after giving my name and city of residence I was informed that I am listed as the VICTIM of the case and the subpoena is to testify against this woman charged of domestic violence. I've requested a copy of the case report but I don't know where to go from there. At this point I'm fully expecting to have to go to court and tell them I have no idea who this woman is and she certainly did not attack me. Thanks for the people who commented in the original thread and offered advice. I'm not sure if there is anything else I can do at this point to avoid going to court. Orthodontist killed my front tooth Posted: 02 Apr 2019 05:21 AM PDT I had braces for two years and during that time my orthodontist let my two front teeth separate from eachother, then pulled them back together again in a cycle. They probably went through this cycle 5 or 6 times. I didn't realize then that it would be a problem. Eventually one of my front teeth started looking gray and it turned out it was dead, and x-rays showed that the roots of both front teeth were quite bent. My usual dentist was away and her stand-in told me that they see about one person per year who has this exact issue arise from that orthodontist, and suggested it was entirely the orthodontist's fault. However, when my regular dentist came back, who is likely in some sort of partnership with the orthodontist because she did recommend him to me, she told me that it wasn't his fault. When I got the braces off, about two years ago, I had to have a root canal for ~$1000, and now my tooth is gray for the rest of my life. My orthodontist dismissed the issue as I must have fallen and injured my teeth. I didn't. I probably signed all my rights away with the contract before getting the braces. Posted: 01 Apr 2019 03:22 PM PDT Edit: this is in California I just wanted to start of by saying thank you to everyone who commented and gave advice! I really appreciate all the help. Here's what I ended up doing: I called my own insurance company to find out why it was denied. I found out that, because of my dad's specific insurance plan, I was supposed to go to a specific doctor's office and lab for my yearly checkup and bloodwork that is near my parent's house because the insurance has a specific contract with them. I didn't go there because I live a few hundred miles away. However, my address is listed as my parent's address so the insurance company thought I lived nearby. They said I could appeal with an address change but the woman on the phone was very upfront and said that those never get approved. She said that, if I could get my doctor to change the billing code (just like all of you said!! You noble wonderful people) then the insurance company would review it. She also said that the old code had to be removed and a new one put in place. The new billing couldn't have both codes on it. So! I went to my doctors office and brought in my bill. The admin at the front was so sympathetic and understanding and promised to take care of it within the next few days. I told her everything hat the insurance lady told me, and she wrote it all down and clipped it to a copy of my bill. She said that the diagnostics place never even sent them my results! By that Friday, she had gotten my results and had me come in to find what they were, resubmitted he claim to insurance, and put a hold on all payments until it was figured out. Today, I got my new bill in the mail. All of the bloodwork was covered. My new bill is $0.00. I cried all over the place, you guys. I'm planning on bringing that admin a thank-you card and maybe a Starbucks card and flowers. Hopefully she's allowed to take them. Thank you all SO much for all of your advice and help. You are all the best!! You literally helped me from having to pay 10% of my yearly wages! Plus, I started saving up in preparation for having to pay this bill so now I have the beginnings of a little nest egg/emergency fund just in case something happens in the future. A company says our website is theirs. Posted: 02 Apr 2019 03:27 AM PDT I own part of a web development company in the Netherlands. We made a website for a local business. There is a competitor (big one) in our region who makes websites and print for shirts, menu's, etc. This competitor made prints for the same local business. On the website of our competitor they have a "Portfolio" where this customers company is used to show off their work. The page contains the name of the client, then "visit our website" which leads to the website my company built and then underneath that it says "Work for this client" followed by images of the work they did. This company has nothing to do with the website and we have not used any of their work on the website but it still says our. My question is: Are they violating any laws or my company's author's rights by saying "Visit our website" while it is not theirs? The email address the seller provided in their answer is different than the one my father corresponded with, though the mailing address is the same that he sent the money order to. Seller also provided a discontinued telephone number in their answer. They are both pro se, simply because the contended amount was somewhere around $2,000 and attorneys fees probably would be steep in comparison. I guess my question is, if worst comes to worse and this individual is telling the truth or convinces the judge they are telling the truth, how would you proceed with recovery if this woman had indeed gotten her identity stolen? I have access to Westlaw and a few other research tools, is there anything I can look for that would help his case against the seller? My manager said they are changing how my position operates and they want someone with a different skill set. He said I would get ample time to find new work and would be allowed time off to schedule interviews, but he did not give me a set end date. The next day, he emailed me asking me to sign a resignation letter. I responded by saying I wasn't resigning, I was being terminated, and I was concerned this would affect my ability to collect unemployment. He said "there must be some confusion with HR," and said he would take care of it. Since then, HR has taken over all communication about this situation, and they've been very shady. First, they refuse to do anything in writing. I've sent them several emails asking for details about my separation from the company, but all those emails have been met with phone calls in response. In one of those calls, I directly asked what my end date was. The HR rep said "We hope you will determine your end date. We've given you ample time to find other work, and when you do you can turn in a resignation." I responded that it might not be possible to find another job that quickly, so I needed to know my set end date. She again dodged and focused on how "accommodating" they were being by giving me time to find other work. She brought up a resignation letter again, to which I said, "I'm concerned that would prevent me from receiving unemployment." She said "Oh, we won't contest your unemployment. We just don't want you to have a black mark on your record due to a termination." I asked to get that in writing, and she said she couldn't do that, but "You have my assurances we will not prevent you from receiving unemployment." The next time HR got in touch, they finally gave me a set end date (May 3) and again acted like they were being very accommodating because that will allow me to receive my company health insurance for the entire month of May. However, this time they also said I was being fired "for cause" because I had been caught applying for other work on company time, a direct violation of company rules. When I said that's not the reason my manager told me I was being let go, she said "Well it's here in your file." This whole thing seems like a concerted effort on the company's part to intimidate me into signing a resignation letter instead of accepting a termination, thus freeing them from paying unemployment. I will need unemployment to support myself after I'm let go, so that's not something I can afford to do. However, I'm now concerned that a "termination for cause" on my record will adversely affect my chances to gain employment elsewhere. And this HR department has shown they're not above thinly veiled intimidation, so I have no doubt they'll try to tank my future opportunities if given the chance. This company seems to be conducting themselves in a highly unethical manner, and they have turned what should have been a relatively straightforward separation into a very stressful situation. My child is about to turn 4 and I raised her with the mother until she was 3 and we separated, they haven't let me see my child in 3 months. I'm not legitimized. I have a consultation with an attorney later in the week, I'm scared because I can't really afford an attorney. What are my chances in court? Landlord charging $10 a night for having guests over Posted: 02 Apr 2019 04:01 AM PDT So I'm really stuck with this situation and want to find a solution that doesn't result in everyone in my house paying for every guests but also doesn't get me evicted. So what happened was my girlfriend was making toast and there was mess that wasn't her's on the bench top where she was making her toast, then my roommate who I don't know very well sees her making toast and the mess and assumes it's her's. What does he do? Ask her? Nope. Ask me? No again. Go directly to the landlord to tell on her? Yep. So he tells my landlord "she's always here" "she always makes a mess" "she never cleans up" which is untrue. My girlfriend usually stays here two to three times a week and my roommate has told my landlord that she has been living here for 7 months straight which is false. He pays the bills so he's wanting me to pay for all the "time" she's been here. I convinced him not to charge me but he wants 10 bucks a night for her to stay here. As a tenant I think I should have the right to have guests over and not have to pay for that but I do see he's point of view. I never signed any contract nor was I told of any restrictions on having guests staying over until now and I honestly cannot afford it, but I don't wanna get kicked out. Posted: 02 Apr 2019 08:44 AM PDT State: Missouri My father is 65 years old. He knocked up a 23 year old hooker. Long story short she is now out of the picture and he was granted custody. A few months ago the baby (1 year old now) was discovered home alone. The cops were called and the baby was removed from the household. The house was in an extremely bad neighborhood and not in good condition. There were saws, hammers, nails, and all kinds of other tools and equipment just laying around. In a court hearing when questioned about this he told the judge that the baby was a "construction baby" and she knew not to go toward those items. (WTF) The state put the baby in foster care temporarily, but my dad is fighting to get her back. (He's getting $1,100 per month in state money for having her). To give you some background on my dad - he's never had a real job. Always been a bum his entire life. Fathered 5 children and never took care of any of them. Left them with their mother and abandoned them. He was diagnosed in 2003 with a disease that caused inflammation in the body, so he told everyone he had cancer. Still to this day tells everyone he has cancer. He's got no job, no car, no house, no 401k, nothing to show for his time on this planet. Not to mention he has abused meth his entire life. The baby is in foster care and when she first arrived she was severely malnourished. After every visit he has with the child he is supposed to bring her something to eat, and that is usually candy and soda. The problem is - the court system here in MO. It is an absolute joke. The court system is catering to the parent. He shows up to these hearings with his public defender and they are actually making progress on getting the child back. We have provided evidence to the court that he is an awful father and it would be dangerous for him to be granted custody, yet the courts seem to be moving in the direction of giving custody back to him. Post office withholding mail for my apt building Posted: 02 Apr 2019 04:21 AM PDT Apparently the Allentown, PA post office won't deliver mail to our apartment building anymore until the building is "compliant" in putting a key box in the foyer specifically for the USPS. There's a key that UPS and FedEx use and they refuse to use it. Another resident called and they were told that they're not even allowed to come in an pick it up because they want the residents to be angry enough to get the building to install the stupid box. (FTR, the building was notified some time ago about it.) I can let it go that they won't deliver to the building, but I don't believe it's legal for them to withhold it even if we try to pick it up from where we were told they're holding it. Many have packages that are about to be returned to sender and 1 man I spoke to is out of his meds and was waiting for them to be delivered. For one of our classes, we are making things for the collections. The issue is, I am in a separate branch of the program, and I am not part of any collection. So I am making things for others. Why does this matter? Well, at the beginning of the semester, we were asked to pay a large fee in order to pay for the materials. It's my last semester and I just cannot pay anymore. The tuition is high (private college), and I already paid for my own materials as well. Recently, the prof has said she will not grade our papers unless we pay this fee. Is there anything I can do about this to fight it? It seems a bit dodgy to me to threaten this, and I won't get my diploma unless I pass this class. [link] [comments] |

Posted: 02 Apr 2019 09:03 AM PDT Hey Reddit, my wife and I are facing a bit of a strange quandary, and we would love any feedback you may have regarding an issue with our HOA. We are located in northern Utah. To put it simply, we received a notice of our HOA filing a lien against us and our house for overdue payments - threatening to foreclose on our home if we don't pay them 2.5 years' worth of backpay from when we first bought our place. The thing is, we've been paying the HOA monthly since we moved here. They've sent us a bill for $96 every month, and we are always prompt with our payments. Then out of nowhere we got this notice yesterday saying we owe them an additional $600 plus $350 for legal fees. I called the legal team they're using, and found out that apparently we're supposed to be paying TWO HOA's. The one we've been paying regularly is the smaller, more local HOA, and there's a larger, "master" HOA that also expects payment from us - roughly $19-20 per month. Except we've never heard of this parent company. They've never contacted us once, let alone to send us a bill of any kind. All HOA contact we have ever had was with the "smaller, local" company that we are familiar with. So this lien / legal notice is literally the first we have ever heard of these people or any financial responsibility we have to them. As far as we've been aware, for the last 2+ years we were completely square on our homeowner fees. We were worried it might be a scam, so we checked with our neighbors and they confirmed it - there is definitely a second HOA. Not only that, they went through a nearly identical situation (minus the lien) a few months back, and implied that several others in our neighborhood have had to deal with this very thing. My question is, do we have any legal basis to push back on this? Obviously we are happy to pay any bills moving forward, provided they ever actually send us a bill for once… but we are in no position to suddenly cough up $600 backpay for a fee that we didn't even know existed two days ago. At the very least, even if they force us to pay the $600, I would hope we can convince them to cover their own legal fees. After all, if they had ever sent us correspondence of any kind - a letter, an email, a phone call, ANYTHING to let us know they existed and expected payment - they never would have needed to get a lawyer involved in the first place. Anyway, I appreciate the wisdom I've seen while lurking on this sub and thought I would see if anyone had any thoughts or warnings… I'm in the process of creating a written statement contesting the fees, and don't want to be so bold that I shoot myself in the foot. But the whole thing seems genuinely preposterous to me. I would've come here sooner but I just explained what happened in a new job interview and he said I had a case. I told him I didnt have money for it, and he said I didnt need any. But then he said he couldn't say any more in the work building. So here I am. With that unnecessary bit said. Here's what happened. I worked in a furniture warehouse. It was February 21st I hurt my back pulling a mattress. They were stacked against each other and I had to get a co worker to hold them up so I could pull it out. Decided it'll pass, continued to work. Carried the mattress out so I can inspect it, that was my job. Back locked up, I fell backwards onto the mattress; that's important. Finished my job. Went on break. Came back. My back hurt so damn bad at points it dropped me to my knees. I filed the workers injury report. Went to the hospital. They said take the night off. Due to the next day being a Friday, when I called for a follow up they said that department was closed. Wasnt allowed to go to work the next night because I wasnt cleared. Asked my boss if I could use vacation time for those two days and he told me to wait and see if I'll be out longer, which I knew I wouldnt. Monday comes, I'm cleared for light duty. Get all the paperwork to hand in to work. I walk in in the building, "Hey warehouse manager, how are you doing?" Hand him the paperwork, and he says he wants to talk to me. I ask if I can clock in and he said no. "Let me go get your boss." I don't think anything of it. We go into an office and what it boils down to was, "You're fired. You carried a king mat by yourself and you need two people to move that (something I never heard or read, they didnt give us an employee handbook or anything. And it's only one person per order picker, they have to get that by themselves all the time). You fell on that mattress and hurt your back. You were horse playing. You were even smiling." Now I probably did smile because a coworker made a joke like, yeah real busy laying on your ass or something. It was funny. But that's not how I hurt it. When I tried to file for unemployment they said that I didn't hand in any paperwork, and that a screwdriver fell out of my pocket and I landed on it, and that's how I hurt my back. University charging me for unauthorized use of parking permit when I have receipt of purchase Posted: 02 Apr 2019 08:35 AM PDT Duluth, MN US For the Spring 2019 semester, I purchased a parking permit from my University so that I don't have to worry about my transportation to school. Everything goes fine for the first 2 months where I've been parking in the designated parking lots with the permit, no tickets or anything. Then when Spring Break is just around the corner and I suddenly receive a parking ticket stating "unauthorized parking $100". I immediately went in to talk to their front desk about the ticket. The guy at the front desk said the name under the title of the car is not the same name as mine (of course, I'm an undergraduate student with no money to buy or own a car). The car is under my friend's brother's name whom we both share the car, and the car is the only car registered under that permit. Even when I was looking to buy the permit I asked if it was okay that my friend and I share the permit as long as it's the only car under the permit and they said it was fine. The guy dismissed my reasons and simply told me to write an appeal. I wrote an appeal and chose not to appear in person for their board appeal meeting because it's almost Spring Break and midterms are coming up. The appeal went through their board and they denied it without giving me an explanation. Now I went back and reviewed all their policies regarding the parking permit and NOWHERE does it mention anything about a vehicle's title. All it mentions is that the vehicle must be registered under their system, and as mentioned earlier this car is the only car registered under that permit. So I really don't understand where the confusion is coming from. It's the middle of the semester, I'm stressed with projects and exams. What can I do from here? TLDR: University charging me for unauthorized parking permit use. The vehicle in question is the only car registered under the permit. Front desk guy claims that it's because title of car doesn't match my name when nothing of that note is under their policies nor was it mentioned when I purchased the permit. Posted: 02 Apr 2019 03:41 AM PDT Unfortunately not a first time poster... even about this current apartment. On March 1, my building was sold to new owners. They moved in on the first floor, and we have established good communication with them. As of this morning, I have woken up to low temperatures in our (partner and three kids under 10) apartment. The thermostat says 55 degrees, but I believe even that to be inaccurately high. We do not have hot water either. I immediately texted the landlord and apologized for disturbing them so early, but then explained the issues. Both heat and hot water are included in the lease. Maine also has a warrant of habitability law requiring 68 degrees indoors. I'd like to give the landlord the benefit of the doubt, but with no response being forthcoming, how long do I HAVE to do that before I can proceed to the next step in the process? According to a local legal aid website, the next steps are calling code enforcement and/or possibly getting the heat turned back on myself either through repair and deduct or calling the city. Can debt collector touch social security ? Posted: 02 Apr 2019 03:30 AM PDT My grandfather and grandmother purchased a new car in 2017. In December 2018, my grandmother (85 years old) passed away. My grandfather is 76 years old. Their only income was/is social security and with my grandmother gone, my grandfather only has his social security income now. We contacted the car company in December and they told us to fax a letter and death certificate and they would collect the car. Finally, 3 months later a tow company came during the night and repossessed the car. My grandfather had no idea until the next morning when he woke up, even though we contacted them several times to get the car as he could no longer afford it. Yesterday he received a letter from them that it will be sold at auction, and the funds applied towards the outstanding loan balance. They will then go after him for the unpaid amount. I (think) I impregnated a girl I messed with a while ago. I didn't know the entire pregnancy. She contacted me the day she gave birth and insisted I was the father. We did a cheek swab (one of those tests you can buy from CVS) and she told me I was the father. I never in fact saw the paperwork. She lives with another man who does in fact look like the child. However she asks me to buy clothes etc. for him. I've asked to get a paternity test done in a lab and pay for it myself, but she's constantly finding excuses not to come. Is there a law that protects me from my employer forcing me to come in on a day that im off? Posted: 02 Apr 2019 12:18 PM PDT (Pardon my ignorance as for what flair to use, but...) EDIT: US, KY! i work at a convenience store. I work about 4-5 days a week. This week, i have yesterday, today, and tomorrow off. My boss is telling me that i have to come in today, no questions asked, no arguments. And it has been this way since i started working there. However, when i worked at another location for this chain, when i was asked to come in, they would politely ask, and if i couldnt, they understood. Is there a law that protects me from being forced by my employer to come in on my days off? And does it protect me from discrimination if i refuse to come in? [link] [comments] |

I live in a building where different smaller apartments gets rented out. Found out someone who is amazing, awesome and relatable has cirrhosis of the liver that's terminal. She has a court fine, that has turned into a warrant that will give her 8 months in Jail. Her two daughters are in Michigan where she can't go to, can't live there, can't get a job there or anything. Regardless she doesn't deserve to not see her daughters for not paying a fine. Is there a defense or anyway to drop charges? Does this- commonly happen? Nothing violent was the original charge. False criminal accusation posted online Posted: 02 Apr 2019 02:27 AM PDT Oregon, female 19 A girl who I've been dealing with for a while, especially if you seen my last posts, after months of dodging her accusation, and defending myself to other people. She has gone as far as publicly posting online that I am a bipolar stalker who has been stalking her and taking pictures while following her around, about how she's scared, and that I know her work schedule and come In to stalk her. It was lengthy along with jabs to me personally but those were opinion based..but those were the main points. Her family has threatened to sue me regarding "Defamation of Character" for something again I did not do, and they know that, that was two months ago. I haven't done anything since then, I cut off all ties with anyone that's connected to her. But she won't stop telling people I've physically assaulted her, or now today publicly online declaring I'm a stalker. Is there anything legally I can do for her false accusations online? I mean posting I'm a stalker and she's scared for her life, When I've had no contact with her is excessive and she won't stop there I'm not one to typically jump to legal options, but I'm not sure what else to do. I'd like to file a police report for cyber bullying but I'm not quite sure this fits... any suggestions? [link] [comments] |
