I took the advice that I was given and I pled not guilty. Last week I went to court, and here's what happened: I brought copies of my cell phone's call log (showing that I called 911 before curfew) as well as the same records from my carrier. I also got a copy of the drunk driver's criminal complaint with the help of the court clerk, and I printed out a copy of the "justification" law. The hearing started with the officer saying that I was pulled over on the side of the road, that he "went to investigate" why I was there, and that I voluntarily confessed to driving past curfew. He said that that was all he needed to prove in order to prove my guilt and basically left it at that. Then it was my turn to speak. I said that while I did drive past curfew, it was because I had noticed an erratic driver and I was following him because I thought he was going to hurt someone. I felt that if I had let the man go, that he would kill somebody and that 911 had told me to keep following him. I gave my evidence to the judge and to the police officer, and I said that I would have been home on time if not for the drunk driver. I argued that I had a reasonable belief that the man was very drunk and that the police are accusing the driver of having a .12 BAC. (The judge asked the officer about the driver and he confirmed the BAC.) Finally, I brought up the justification defense. I argued that driving past curfew was a summary offense and that drunk driving was at minimum a misdemeanor and at worst a 1st degree felony if he killed someone. I said that the law clearly provided a defense to my conduct because drunk driving was clearly the greater of the two evils and because I drove in an otherwise safe manner. The judge agreed and found me not guilty! He said that I had proven my defense by a preponderance of the evidence and that I had done the right thing. I'm going to get my collateral back in the mail in a few days and my record is clean! TL;DR: Went to court. Police officer basically said "the law is the law." I presented my defense that I was preventing a greater harm under the justification law. Judge agreed; I was found not guilty! [link] [comments] |

I go to a common pharmacy chain in Ontario, Canada. Last Monday i went to collect my refill of my medication, they weren't able to fully fill the full balance so instead provided me with a weeks worth of my medication, and told me to collect the balance on the following day. On Wednesday evening i went in to collect my balance, only for the pharmacy technician to tell me she could not find my prescription. After taking my information she told me that i had already collected my remaining balance Tuesday afternoon. I denied me ever doing this, and was told she could not help me and i would need to come in Thursday morning to talk to head pharmacist to explain the situation. Thursday morning i went and talked to the head pharmacist who:
I went home and called the corporate number of the pharmacy, and explained everything to them. They agreed to open an investigation however told me this could take well over a month to get a result, they gave me a case number, and recommended that i make alternative arrangements with my doctor. On Friday i called my doctor again, and explained everything one more time, he was sympathetic however he told me he cannot re-issue my prescription unless the pharmacy admits they screwed up because it is a controlled substance. Posted: 28 Apr 2019 02:24 AM PDT I'm from Los Angeles, visiting New Orleans and have been staying at a hotel for around a month. I work remotely as a web developer, and generally work during graveyard hours. After finishing work, I walked to a local gas station at around 3:30 AM. The streets around where I'm staying are pretty empty. I saw a cop across the street as I was walking, didn't think much of it. The cop turns on his car, drives down the street and makes a u-turn, pulling up on to the sidewalk in front of me. The officer stops me. I tell the officer I'm walking to the gas station around the corner. He seems pretty aggressive, tells me to be quiet. He mentions that the hotel I'm staying at has a reputation for drug dealing and prostitution, none of which I'm aware of. He has me put my hands on the squad car and then proceeds to search me (I don't have any weapons or drugs/drug paraphernalia on me, also completely sober). Around four or five other officers pull up in two or so squad cars. He asks me for my name and date of birth, which I provide. I mention I don't have my ID on me, but I have it in my hotel room around the corner. He then asks me for my full social security number. I tell him I don't feel comfortable providing him with that information. He asks me if I want to go to jail, and states that there are potentially many people with my name. I tell him I know there are people with my name, but again reiterate that I don't feel comfortable providing my full social security number. They proceed to put me in handcuffs and book me at the local jail. I was released 14 hours later. The above incident happened incredibly quickly - probably within 5 to 10 minutes. I have no prior record and I feel that no attempt was made to identify me with the information I provided. At the station, I continued discussing the situation with the officer - in my opinion he took it as a personal slight that I wouldn't provide him with my social security number. I mentioned that I've never been asked for my social security number when being stopped by police, even if I don't have identification on me. I also mentioned that I know my driver's license number by heart, and could have provided it to him if necessary. After being released, I was charged with resisting arrest by failure to identify. The method by which I was stopped would be classified as a Terry Stop - no probable cause but I was stopped in a high crime area. My question is, how much longer is the officer able to detain me after I provide my name, date of birth, and current address without finding anything suspicious in my activities? In addition, given that I provided the officer with any information he asked for outside of my social security number, is it reasonable to expect that I can get the charge dropped or will be found not guilty? I don't have money to hire a lawyer and am concerned that if I plead not guilty I could be facing up to 6 months in jail. On the flip side I'm also concerned about the long term ramifications of accepting a guilty plea (having to disclose the arrest to employers, travel restrictions, etc...). Thanks for any assistance or guidance. I'm not trying to demonize the officers involved, but I feel like they could have handled the situation a little better, and spending 14 hours in jail sucks. Bank wrongfully repossessed wife’s car and are dragging their feet giving it back Posted: 28 Apr 2019 09:43 AM PDT We checked the app again and this time it says we are paid in full from January up to a payment that went through on April 2nd, two days before the repossession. So technically we are two months ahead on our payments because we even paid during our grace period. Told the bank about the problem and they had us send them bank statements with everything but our payments to them redacted. We sent that to them on April 8th. Since then we have called everyday asking for an update on the situation. For two weeks now we have been told we'd be getting a call later that day when the car is released. Here we are three weeks after repossession and still nothing. Whenever we call asking what's taking so long, we are told the "higher-ups" have to release the car given the circumstances. We don't know what else to do at this point. We are going to Atlanta this upcoming weekend for a music festival and need that car to get there (mine needs too much work to get to Atlanta). (Wisconsin)Neighbor cut down tree on my property. Posted: 28 Apr 2019 09:04 AM PDT Woke up this morning to discover my tree had been cut down... I know this sub enjoys these situations, I wanted to ask some questions. The tree in question was an evergreen, only about 8-10 feet tall. Trunk was maybe a foot around, we are not talking a huge tree. It had been leaning over the property line since last winter, a large snow storm had bent it over. I was hoping to try to straighten it this summer. Failing that I likely would have cut it down myself. I approached my neighbor who didn't deny cutting it down. He seemingly found it funny. I know these things can be expensive but between the existing damage and smallness I'm not sure if it's worth pursuing or not. Does this sort of thing require a police report? Will I need a lawyer? Cannot get a HELOC to invest in real-estate projects, nor can we travel as a family because I have to save up to pay off the BIL... Finally, I don't have proof, but I am certainly being discriminated against because I am not religious, from a different culture that the family/cult members and for simply being the educated, resourceful and empathic man that I am. After several years of much needed respite and avoidance I'm back and want to fight - How can I unfuck this situation... for several reasons... but to show a good example to my brave children about boundaries and how to be tough in every way. Scammer jumped in front of car and got "injured" , tried to get details but we drove off (UK) Posted: 28 Apr 2019 05:16 AM PDT Was with my father in law driving back home yesterday evening and rounded a corner when some idiot (who I had seen from the passenger side) literally runs alongside us then dives out from behind a park car and into the front of our vehicle, bearing in mind I had shouted at my FIL to brake at this point and we had stopped but this guy still jumped into us. Obviously we stop just to see what's going on in case the guy was mentally ill/on drugs or something and he's making some exaggerated noises, groaning in pain and he's got a bloody nose even though there wasn't any on our car so I'm thinking he intentionally bashed it on the ground. He's also complaining "I think my leg is broken" even though it wasn't even near the car when he touched us. Literally out of the woodwork comes another fellow with his phone camera pointing at us saying "bro you just fookin smacked into him" and starts making out we were going too fast and to call an ambulance, but I quickly pointed out we saw this guy jump out and sensed it was some insurance scam. My FIL has some anger management issues and in the heat of the moment he lost his temper, practically hauled this guy up to his feet and said "it's not that broken is it?" when he miraculously found himself standing on it. Meanwhile camera bloke is shouting at us saying to call an ambulance and provide our details or he'll report us to the police, got up close to me and I swatted fhe camera out of his hand and told him to fuck off. Got back in car, FIL went to get bsck in until the "injured man" tried to block him so he pushed him out of the way. Had half a mind to call the police ourselves but they're understaffed round here and we didn't have time to waste dealing with idiots. I have 2 kids with my ex, and I have full custody and he has visitation. Yesterday was a day with him, and he didn't bring them back after his visitation. I called him and he said he wasn't going to be bringing them back, that they'll be living with him on the reservation, and that they are his kids. Immediately I went to the police and told them he took my kids and isn't going to be bring them back. I told them he is keeping them at his home on the reservation, and that he was supposed to return them because we have a parenting plan. The police told me that they can't do anything because it's tribal land. I literally don't know where else to turn. What steps should I take? I just want my kids back... Just if she feels like she deserved more or if the customer was rude or something. . I've never seen her do this, but it did spark the question "what if it happens to me?" . If I order something and I leave a $5 tip for example, what is stopping her from just adding an extra 0 onto the tip to make it $50. . Or even just changing it to a different smaller amount like $5 > $7. . Am I supposed to hold onto every tipping receipt I use incase they do change the tip amount? How to get criminal charges pressed for sexual abuse in Utah Posted: 28 Apr 2019 08:15 AM PDT Hello Everyone, In 2001 the county prosecutor dropped charges against my abuser due to not wanting to "traumatize" myself and my witness any further by testifying on the witness stand. Recently Utah has changed the statute of limitation for first degree felonies in sexual abuse cases. The charges would fall under Utah code § 76-5-404.1. I would like to see my abuser held accountable for his actions. I was not his only victim, I am sure I was not his last. I have considered pursing a civil lawsuit against him since I thought the criminal charges would be past the statute of limitations. If I pursue a civil lawsuit, I have 3 years to file due to the statute of limitations being changed. I would rather see him face jail time and having to register as a sex offender than just get money out of him. The prosecutor that dropped the charges against my abuser went to the same LDS ward as him. That prosecutor is still working for the county. I believe it caused my anxiety to be worse. About 9 days ago I was at my wits end and i went to my doctor to discuss it. I have been prescribed SSRIs in the pass and the side effect were really bad. I experienced tremors, muscle spasms, rapid heart rate, night terrors, many things. I was off of them for months. I have bever been able to take anything for more than 2 weeks . Well 9 days ago I had this conversation with my doctor. He prescribed me Paxil. Im 31 with no children but currently trying for a baby. I asked him if he could discuss the side effects with me and he stated " Im not going to do that because it will scare you away from taking the medication trust me I deal with alot of anxiety patients stay off the internet" I listened and 7 days later I ended up in a psych ward suicidal and manic do I have a case? I'm being charged with receiving stolen property, despite the fact that I repeatedly offered to return the stray dog to his legal, responsible owner - from the detail cop whom I asked to call in the 'found dog' report, to the sergeant who filed the complaint. Officials have made several statements that put the dog's ownership in question. Multiple stories have been told about different parties claiming ownership of this non-neutered mutt. In one case Animal Control claimed he was microchipped but they repeatedly refused to scan him at my home, insisting instead that they must take the dog into custody/puppy prison, despite the fact that his ownership is in question, and the fact that he's safe and secure with me. Officials have consistently refused to put me in touch with the parties claiming ownership. At every turn I have made it clear I would be happy to return the dog to his legal responsible owner, yet town officials apparently withheld my contact info until after filing a clerk magistrate hearing request for the crime of receiving stolen property. After filing this complaint request, officials apparently released my contact info to one or more of the parties claiming ownership. I have been mildly harassed through several channels, and yet the dog's supposed owner has still not presented him or herself at my home. Is it legal for town officials to release such information after filing charges against me? Is it legal for the complaintant to contact me prior to the hearing? Thanks for any insightful comments. Neighbor cut down tree fell on my garage. Posted: 28 Apr 2019 01:26 PM PDT State is VA. Moble so excuse format errors As stated in the title neighbor cut down a tree that was on his property but it fell and hit my garage. Put a roughly 3 foot long by 2 foot wide hole in the roof and damaged the wall. We had a tree feller out to look at the tree last month,Who refused to do a single cut for fear of hitting either my garage or my neighbors house. We then had a conversation about splitting the cost 60/40 to have it taken down in pieces so it caused no property damage. Well I went out of town for a family emergency and came back to antarp on my garage roof and a hole in the wall. Turns out he let his buddy who "Can totally cut it down no problems!" cut the tree and it hit my garage. He is submitting it to his insurance and getting bids for the roof and wall. My Boss Has Stopped Me Multiple Times From Disciplining Employees That Happen to Be a Minority Posted: 28 Apr 2019 02:40 AM PDT Multiple times over the last year, I have had two employees break company policy: fighting, insubordination and clocking out hours before the end of shift without permission. I have issued them both verbal warnings, but every time I proceed to the write-up stage, my employer stops me because he does not want any discrimination claims. When they both committed another infraction within days of each other, I was told to document and counsel. Because both had committed their infractions multiple times, I placed them on probation. In the middle of the night, my employer sent me an email asking if I was treating all the other employees the same. I was floored. Just that month, I had written up two others and let one go. He was aware of the situation and never once questioned my actions until I went to discipline these two. I am at a complete loss. Should the rules not apply to everyone? Other employees have gotten disgruntled about the situation because these two have gotten away with quite a bit. What can I do to resolve this? I feel as if my hands are tied. I wanted to see if there's anything I could do about my situation. I live in Alabama by the way. So I work for Jimmy John's here in Tuscaloosa and was fired apparently because I refused to do any work during my shift and left early. The video cameras were never consulted and I was never given a chance to give my side of the story. What really happened. I came in my normal time around 9:55pm for my 10-cl shift, the schedule says cl which for inshop workers is either 2 or 3:10 am, and as soon as I walked in I noticed a pile of sliced cheese on the table, not the correct way to handle our cheese, the meats either completely out or low, and no cucumbers or tomatoes. which was a problem because our most popular sandwhiches have cucumbers on them and I had to slice some cucumbers the unorthodox way along with some tomatoes.The shift manager would frequently step out to his car so he could smoke weed, I know it was weed because he's offered me some. At no point did I refuse to work infact I was the one taking and making the orders even when I was the only employee in the store because our drivers were out on deliveries and the manager was off smoking.The manager finished slicing the rest of the cheese around midnight but never cleaned the slicer. This is important because the store was desperately in need of meats and I couldn't slice the meats I needed until the slicer was cleaned. When 2 rolled around my manager told me to stock up the chips and clean the tea/soda machines then everything else he could handle, which I did and when I was done he again was out in his car smoking so I went over the headset to let him know I was getting ready to leave. This was close to 2:10 and he told me to wait until someone cane back from their delivery so he could smoke a little longer without the store being left empty. I did and not long after the last delivery driver came back and I said goodbye to everyone and left without any objections. I get the termination call from my GM the next morning and he said I was being fired because I refused to work, left early, and because of me the store was left unclean. Is there anything I can do to either get my job back or get compensated for being wrongfully fired. Tldr: pothead manager doesn't have his veggies/meats sliced I'm forced to slice veggies but am unable to slice meats because he had cheese on the slicer and when finished didn't clean it. I'm forced to take and maker orders by myself because drivers are gone and manager is off smoking.I leave at 2 am after doing everything I was told to and waiting for our driver to get back from a delivery so the manager can smoke without leaving the store empty. I feel the need to give a brief rundown on the back story. We have been divorced since 2012, have 1 child together (M11) he is legally blind, only a little light perception. Since divorce ex had been in and out of sons life, paying child support only he has a job bc state takes it from his check. He owes roughly 13k in back support. He also had a drug addiction. After divorce ex was bad off in all ways, I didn't hear from him again until 2015 when I filed for full custody of our son. He decided to clean up and be a dad. I ended up with sole custody and him a visitation schedule that was phased from supervised to non supervised over a period of time and completion of parenting classes. Things went well for a while, he was sober, saw son for a while regularly unless he had to work a weekend. Things went well child support was somewhat regular and that was fine. He was trying to get on his feet financially so I didn't mind. He bought a property with a barn and converted the top of the barn into a loft style home. It was perfect for a single man with a child over on occasion. However son would come home with small injuries from bad decisions on a regular basis. He began a relationship with a woman in 2016, she had 2 children one older and one younger than our son, both boys. Son continued to visit. Son would come home saying she was cruel and yelled a lot I brushed it off as stress of having 3 boys running around. Girlfriend ends up pregnant and they marry after 4 months of dating. Fathers day 2016 son comes home and is dropped off with a black eye and a bruised cheek. Nothing is mentioned about this, he rings doorbell and drives off as I answer the door. Son claims new wife's boys punched him repeatedly because he made a comment that he loved his life. I contact ex and ask what happened his reply is "boys will be boys" Ex contacts me 2 weeks later and asks to see son. I reply he may but son may not come to his house or be around wife's children. I would be more than happy to meet or drop son at ex parents house for a visit. He replies he will take me to court. I say fine. Nothing comes of it. Here we are today 2019, I never heard from ex again. Child support comes and stops frequently. Recently ex wife whom he has had 3 children with in 3 years is arrested while pregnant with baby 3 for possession of methamphetamine, Marijuana, obstruction, and tampering with evidence, and in jail on a federal probation hold. I want to get my child a passport, son wants to change his name, I want to be able to make decisions without consulting ex, I don't want son to be a part of that mess that his dad is living in. I am not sure what to do. Can I file for custody again? Will the court give ex visitation back? Edit: extra info I forgot : he, wife, and 5 children now live in this barn loft. Opened a Pottery Barn credit card to get benefit - now PB saying i don't qualify Posted: 28 Apr 2019 10:10 AM PDT In California. Went to Pottery Barn to buy new furniture for a new house. Was told about a promotion - open a PB credit card, get 20 percent in rewards on purchases made that day. We spent thousands on new furniture, got a receipt saying that much with furniture to be delivered later. Of course it took FOUR MONTHS for all our furniture to arrive (never using PB again alone for that). But when got credit card statement - we only got 20 percent rewards on $40 worth of purchases and were told that because of when the charges went through and the delays on our furniture, the charges were past the deadline for the rewards. Credit card helpline says we're SOL and PB manager at the store says it's the credit card company's issue. I was sent an e-receipt for the day we were in the store and bought everything - but the credit card isn't count it as the date. I wouldn't have opened a credit card if this was the case and feel as though i was sold a scam. We're getting nowhere with PB. I don't want to turn this public or on social media - do i have legal recourse? If so how do i do this? [link] [comments] |
