I (23F) genuinely think that there’s someone living in my attic. Posted: 21 Apr 2019 11:24 PM PDT I'm not sure this is the right place to post but it made the most sense to me. I have reasonable suspicion that someone is squatting in my attic or accessing it on a regular basis. To note. The house hadn't been lived in for about 4 months prior. And is in an OKAY area of Cleveland, OH. I've been moved in for about a month and a half - I've heard whats sounded like footsteps at first more than a handful of times but then I've just chucked it up to being new house sounds. I'll be honest and say I've been too scared to see if anything's up there since I've moved in so I've never even seen the attic. Today my sister and her boyfriend were staying over for the holidays so I asked him to check it out. He popped up with a flashlight and there's a tent set up. He came down and told me. My sister and I came outside and he locked the back door and came out the front. The back door is directly in front of where the attic opens. We called the cops and waited about ten minutes. Once the cops arrived the back door was unlocked and no one was in the tent. Cops didn't do anything and didn't even go up to check. They were neato. So I put my head up to check while they were there. It's a tent. There's playing cards. They took my name and left. Sooo I nailed the attic shut and blocked all entries to my home. I was thinking first thing I should do is get new locks and window monitors in the morning. Other than that - Do I hire someone to check the house? Do I call the cops again another day? UPDATE: My other sisters boyfriend came over today and the two of them went up there and scooped it out. It looks like a weird grow op. Can't can't if anyone was there. To me it doesn't look like it. But it's strange regardless update Thank you to everyone whose been so kind. You've made me feel safe even if it's been nothing. It's hard to tell. I can try to get back on my messages. But we're changing the locks today and I'll be looking into all the options for surveillance cameras. [link] [comments] |
Posted: 22 Apr 2019 09:04 AM PDT A few weeks ago around 3am my neighbor's kid was screaming in the middle of the street that someone needed to call 911 because "he was going to kill mom". I called 911, and it turned out to be the husband was trying to kill his wife because he thought she cheated on him. He was arrested and I figured it was done with. However, he recently came home and while there's no proof it was me, he definitely suspects it was me. I've had issues with this neighbor before so I have security cameras everywhere. The outdoor cameras were all shot. I have cameras inside the window that aren't clear enough to show his face, but the video shows a man with his build walking from their side to mine to shoot out the cameras. Every morning when I leave for work, he's sitting on his porch watching me with a gun across his lap. This morning he pointed it at me and pretended to shoot me. Last time I went to get my mail, he came out and told me he was going to break through our shared wall with a hatchet and he was going to come in and kill me with said hatchet. Over the weekend he would get in his car and follow me wherever I went. He only stopped when I pulled into the police station. I talked to the police who told me that unless he actually tries to kill me there's nothing that can be done. They wouldn't take a report or anything. Are they just being lazy or is there really nothing that can be done about this? I can't get a video of his behavior since his unit is attached to the side of mine, and I don't want to use my phone to video it because I worry if I provoke him he'll actually shoot me. I'm scared to leave my home, but I'm also scared to be in my home. I'm already planning on moving out, but in the mean time I'd like to live. [link] [comments] |
Posted: 22 Apr 2019 08:06 AM PDT Upstate, NY. So my neighbor got cut off by someone who then came to a complete stop in the middle of a traffic circle. My neighbor flipped them off, and when they still didn't move, she went up on the curb to get around them. That's definitely a traffic violation. This person, so incensed, followed my neighbor TO OUR HOUSE and parked in our driveway. They then moved to directly across the street. I'm at work, but my boyfriend says they are just sitting in the car staring daggers at our house. My neighbor, who is struggling a bit financially, is worried that if the cops come she'll get a ticket. I told her it's possible for sure. Her car is legal and her license is valid. I assume that if this person has some sort of camera footage or evidence that my neighbor committed a traffic violation, my neighbor will get a ticket - but can we also charge this person with harassment for basically stalking us? What advice can you give to me / my neighbor for dealing with this kind of bizarre situation? UPDATE: The cops are at my house. This is ridiculous. UPDATE 2: Nothing happened. My boyfriend watched out the window as the cops showed up, sirens blazing, rushed out of the car to go to the stalker lady. After a few seconds the cop's body language started looking more and more annoyed. About a minute later they left and stalker lady just drove off. EDIT: Glad it's over, post still seems to be getting attention. Posted: 22 Apr 2019 11:35 AM PDT My HOA sent me a letter saying that I'm in violation due to the following: "Architectural change without approval- A fence structure built on top of your deck without approval." I bought the house like this 4 years ago. Per their governing documents as cited in the letter, "All exterior changes require prior, written board approval. Additionally, fence structures are not permitted on decks. Decks do not have walls." It's privacy in suburbia where our houses are 12' apart. They want me to remove by May 18, or they'll fine me $50/day or come remove it at my expense. Their threat of coming onto my property and removing the structure themselves seems quite illegal, in itself. I called the HOA today and she said that she guarantees there is no paperwork on the wall because "no board member would have ever approved this" and that I am not grandfathered in, that it's now my responsibility to adhere to the rules. What leg do I have to stand on here? Violation letter: https://i.imgur.com/bT4oNG5.jpg from the front: https://i.imgur.com/Pbh3fUZ.jpg here's the wall of the deck: https://i.imgur.com/HkdEDVr.jpg here's my neighbor's wall, which he removed because he was selling and didn't care to battle: https://i.imgur.com/7BsUa6X.jpg links to HOA rules: https://www.greentreehoa.com/documents-newsletters-forms/ What should I do? I don't want to comply because a) I really like the wall and b) I'm petty as fuck. EDIT: rulebook states that a deck railing can not exceed 42" if this is pertinent info... [link] [comments] |
My (21) sisters friend stole a lot of money from me Posted: 22 Apr 2019 06:53 AM PDT Hello guys, to keep the story short; I had some in my room and then my sisters friend came over one day. The next day, when I wanted to count the money again, 2300€ disappeared. That's a lot of money for me, that I saved up over the years. Now I had it in the same hiding place for years and nothing happened before this particular friend came and I asked everyone else and I'm fairly certain it was her. Just before the money went missing this particular friend also went prom dress shopping with my sister and complained that the most beautiful ones are too expensive so she couldn't buy them (which is fair) but the day after my money went missing she magically bought herself the prom dress, a new pair of shoes etc. y Now this happened a while back, but the story just makes sense now, since money has been missing again and her friend is suspected again. i don't have any proof of anything but logically I'm pretty damn sure. I talked to my sister and she believes it, but isn't sure if she wants to confront her cause the friend will probably just deny it anyway. Do you guys have any advice on what to do? I feel like I'm out of luck since I don't have any hard evidence :( Location: Germany [link] [comments] |
Posted: 22 Apr 2019 11:20 AM PDT First and foremost sorry if the format is messed up I'm on mobile. I'm posting this on a throwaway for obvious reasons, but I need help. I don't know if I even have any grounds for a lawsuit, or if any criminal action can be taken against this person and I'm too embarrassed to call the local PD if nothing can be done so I would really appreciate some advice here. I'm currently 26 weeks pregnant, and my boyfriend and I aren't living together at the moment. Lately things have been a bit strained between us and communication hadn't been very strong. Apparently a few days ago his phone was glitching out so he contacted someone he knew through a friend who fixed electronics for a fair price and brought him the phone to repair. I did not know this because he hadn't called me yet to tell me, as I said things have been rocky and we haven't been communicating well. Anyways, last night I texted him to say happy easter a little while later he replied very kindly and started a conversation. I was really just happy to be talking to him and having a good conversation since we hadn't in awhile. When I asked why he hadn't talked to me in a couple days and why things had been different lately he apologized and told me he'd been feeling down, and was really sorry but that he missed me and apologized for how things had been going lately. He was typing different, and it didn't really seem like the way he usually texted. There was slight spelling errors and abbreviations/slang he didn't usually use. I brought this up and he said he wasn't sure what I was talking about and laughed it off, I asked if he could send me a picture and he did so I let it go and figured I was being crazy, he must've taken one of the selfies off my boyfriends phone to send. The conversation went on and was really good and eventually he asked for a naked picture. Being pregnant I've been self conscious lately and my boyfriend knows that, so when I replied "I feel pregnant and huge i don't feel sexy" he responded with tons of flattery telling me how me being pregnant was the most beautiful thing to him and made him feel close to me and the baby. Totally manipulating me. I sent the picture. This morning my boyfriend called me to let me know his phone was being repaired, and that it had been with this guy for a couple days now. I felt sick. I told my boyfriend what happened and he called this guy and demanded his phone back, the basically laughed and told him he'd already sent the pictures to himself and had copies anyways. He then hung up and now the phone is off and we can't get ahold of him. I'm completely distraught. I feel violated and disgusting and I just don't know what to do. I'm sorry this post got so long but ultimately is there anything I can do legally to get him to delete the pictures? Can he be charged with anything if I file a police report, since I did send them on my own even though he was impersonating my boyfriend? Edit: forgot to add that I'm in California. Edit 2: sorry for the title gore. I made it when I was really emotional and didn't double check. [link] [comments] |
Neighbors want to shut off my parent’s driveway Posted: 22 Apr 2019 06:59 AM PDT My parents bought a home two years ago in North Carolina. They had a falling out with their neighbors who found that they own a portion of my parents driveway. The driveway is in the shape of the letter "U" which connects to the main road. The neighbors found that they own about a foot onto the one side of their driveway and want to shut down that part of the driveway to plant trees. We've talked to various people but no one can really help us. One possible defense that we've found is that the driveway has been there for 20 years, which may be protectable under North Carolina law. Another possible defense may be that emergency vehicles cannot get down the other half of the driveway due to trees and because it's a narrow path. Would greatly appreciate any advise or possible defenses. It's been terrible trying to find a lawyer because they live in a small area. Thanks! Edit: My parents have not had their own survey performed. The neighbors have already planted trees and stuck a no trespassing sign in the middle of their driveway. [link] [comments] |
Posted: 22 Apr 2019 06:36 AM PDT There's gotta be something to prove they're real so I'm not just giving anyone my card information over the phone right? Like beyond the fact that I believe those companies shouldn't exist by nature they have to have some kind of certification or information about me that isn't public that can prove I owe right? Also like I need to know how this is going to affect me if it turns out to be true. Does this affect my credit score? (They say it's medical debt) How long does this hold on to my account until the statute of limitations goes up? How do I avoid renewing the statute of limitations? It's not a lot of money and I could totally pay it but the sheer fact that the woman on the other end got offended at me asking how to tell they aren't scamming me makes me SUPER suspicious. and I want to know if I falsely assume they ARE scamming me that it won't come back to bite me in the ass. There is like a state agency that registers these people or something right? [link] [comments] |
Constant unnecessary hospitalizations Posted: 22 Apr 2019 07:49 AM PDT NY - Over the past couple of years my dad has constantly sent me to psychiatric units were he would lie to get me admitted as a form of punishment. What can I do to prevent this? I thought this would have stopped since I'm over 18. Can I sue him in any way? Those visits have messed up my work/school situation numerous times and have had a negative impact on my mental health. I'm afraid to go to the hospital because my dad takes advantage of the situation and tries to get me mental health treatment. I have a great career and I'm about to finish college and move on to medical school. I am not schizo or bipolar or anything like that I do have anxiety and have dealt with depression in the past. They keep locking the bathrooms Posted: 22 Apr 2019 09:39 AM PDT (WA, public school) For the past two months, our school has been under siege by repeated attacks of vandalism in our bathrooms. When such vandalism is noticed, the school administration locks the bathrooms to prevent any further usage. Additionally, the school has removed all of the soap dispensers from all of the bathrooms, since most of the vandalism is flooding toilets with the parts of the soap dispensers. However, many students struggle without being able to use the restrooms and it affects learning environment. Is there anything we can do to stop the administration from shutting down all of the bathrooms in the surrounding area, and forcing students to walk a farther distance and spend more time out of class? Please note that we have only 4 minute passing periods, and being late for class will affect our transcript as well as it being very unhygienic for everyone. Any advice helps, thanks! Edit: all of the girls bathrooms are in far better condition and are provided lotion and are cleaned significantly more. They are also scented, while encouraging messages are written on the mirrors. Car dealership overvalued my trade it. Now they are coming after me. Posted: 22 Apr 2019 09:44 AM PDT Long story short, I did a cash deal for a new car. The trade in was brought in. They independently inspected it and appraised it. They made the offer for it which was definitely high but who is going to refuse it? What they did was copied the odometer wrong by a long shot which was the source of their error. I see now that on the paperwork that it was in fact copied wrong. Additionally, I wasn't even present for the deal, I only signed the final paperwork. It said sign here, here and here, one section of which had the odometer reading which specifically states "to the best of my knowledge the odometer reading is correct". I Only know this now because of the dispute. Here is another variable as if this didn't make it more complicated, my wife's name is on the bill of sale which she signed and paid in full for the vehicle the day before I picked it up. Now her copy does not have the odometer reading at all on it. So it is a done deal, I see the error they are referring to, so what do I do? Note: This happened in Alberta, Canada. [link] [comments] |
Can my parents go to jail for abuse and neglect? Posted: 21 Apr 2019 07:34 PM PDT I'm a 16 year old from Missouri. My parents physically abused me and my siblings (we even have audio of them beating my 9 year old brother). They kicked me out of the house, and because of all this, I suffer from severe depression, anxiety, and PTSD. Yes, I have been diagnosed with PTSD, meaning my parents did something wrong. Can the law get involved with this? EDIT: After hearing about a comment, I'd just like to say that it is NOT okay to be abused. It doesn't build character at all. It destroys the very fabric of relationships forever. [link] [comments] |
Asbestos removal company didn’t remove all asbestos from my basement (NJ) Posted: 22 Apr 2019 06:45 AM PDT I purchased a house last summer and the basement had asbestos pipe wrap insulation on the steam heating pipes in the basement. As part of the conditions of the sale, the sellers would have a licensed company remove all of the asbestos. The company did remove almost all of the asbestos pipe insulation but I noticed when I was accessing a water shut off in my basement, above the ceiling drop tiles , there is a section of asbestos pipe insulation still there, about 3 ft away from a section of pipe which the company removed asbestos. The size of the piece left there is around 2ft and is exposed at both ends and potentially friable if disturbed. I called the company who performed the work as I have the receipt for the job (total over $5k) and was basically told that I was quoted for what was removed in linear ft. The woman I spoke to was extremely rude basically saying it was my fault for lifting my ceiling drop tiles and exposing it even though I was under the impression it was all removed. I was told by my home inspector that these asbestos removal companies are supposed to remove all the asbestos in the house after evaluation. It seems extremely negligent to me to leave a potentially dangerous section of exposed asbestos insulation in my basement. The company won't reason with me after several calls and emails and I want to know what my legal options are? Can I report this company to any authority in NJ? They are state licensed and have a license number on their receipt. Any help into this matter would be greatly appreciated. [link] [comments] |
IOWA - Sister has not been receiving medical care in prison Posted: 22 Apr 2019 08:33 AM PDT Preface: My youngest sister starting using opioids and benzos during late middle school, early high school after starting to hang out with the wrong crowd. She became addicted, and my parents tried everything they could to help her get clean, including multiple trips to rehab, drug counseling, and, I believe, even psychiatric help. Eventually, they had a small falling out and I offered to let my sister stay at my house under things blew over. It wasn't long, however - maybe a week - before I found out that she was stealing from me in order to fuel her addiction. I noticed she had taken some of my anti-anxiety medication and had also stolen a check from my checkbook, for $40.00, signed the check under my name and cashed it at a local bank. I discussed this situation with my parents and we decided, as a family, that I should have charges pressed against her for forging the check. We had tried everything else, and maybe the state would know what is now best for her. She was given a suspended sentence and was placed on probation, which she almost immediately violated, and was sent to prison. This was three years ago, and since then she is still in prison, which had a lot to do with escaping early on in her prison stint when she was on some kind of work release style program. Over the last year or so, though, she seems to have been making a lot of progress. Issue: Six months ago, my sister started to bleed from one of her breasts. She reported this issue to the authorities within the prison, but after a couple weeks nothing was done. My mother was worried and called the prison to lodge a complaint. As soon as my mother had complained, my sister's telephone PIN number was deactivated, she was fired from the job she had in the prison, and she still was unable to get medical attention. Last week, and 6 months after her initial complaint, they woke my sister up at 3AM to take her to a doctor. She now has multiple solid lumps under both breasts, the size of the smallest knuckle on her pinky finger. The doctors are From what I can tell, the prison had no intention of sending her off for the immediate help she needed and then punished her when my mother complained - which is now causing my parents to have deep regret about ever trusting the state with this issue. I asked my parents if they thought about hiring an attorney to look into this issue but they have two excuses for not doing so: 1.) They do not know if they can even afford an attorney to look into the issue. 2.) They feel like there will be no legal recourse because they would be up against a state run facility, so they would lose the case no matter what. My question: Is there any legal recourse for this issue? My parents have much more information about this situation than I do. As the victim of her crime, I have limited ability to contact her, so any questions about this issue may take me some time to answer as I have to go through my parents. Thank you, in advance. Another dog bit my dog while on a walk [GA] Posted: 22 Apr 2019 08:11 AM PDT Earlier this morning I took my two dogs on a walk since it's been such pretty weather and I had a day off. As I'm walking, two ladies with two dogs, one lady of which I've seen often in this neighborhood, are walking as well. One of their dogs was unleashed and walking beside the lady i did recognize, albeit I didnt know her name until today. I walked the other direction because my dogs (leashed and harnessed) are ones to get nervous and bark. I doubled back once I saw that the lady with the unleashed dog had gone up a side street. As I walked past the intersection of the street my dogs and I were walking on and that said side street, the unleashed dog bolted from its owner and jumped immediately at my dogs. I immediately started yelling and trying to get the unleashed dog off of my two dogs who were freaking out. I did kick at the dog to get it to back away, but I was unsuccessful. The lady did eventually get her dog back and started saying "she (the unleashed dog) doesn't normally do this and I normally have her on a leash." I, in the heat of the moment, just yelled that that didnt matter; that they were dogs and didnt know any better. I also yelled there was a leash law for a reason. My female dog had only a very slight cut on her front right leg, my male dog didnt seem to have any kind of injury other than the fact he flinched away when I tried to touch his back left leg. I ran my hand over his leg and no blood unlike my female dog. I got my female dog in my car and drove down the side street where the lady with the unleashed dog was. I found the lady and got her name and asked for her to drop the dogs shot records in my mailbox. This lady tried to convince me not to go to the veterinarian because, "she didnt want me to have to spend any money." She told me to just call the veterinarian. She also showed where her dog (the dog that was unleashed) had received a cut as well, most likely from my male dog who was trying to defend my female dog. I took my female dog to the vet and got her checked over. She was fine other than needing an antibacterial swabb, normal check over stuff. They gave me an oral antibiotic for her to take and took some blood tests which will be back by tomorrow. Overall, it was only 176 something dollars; as well though, I had to use my care credit card though and that requires a 200 minimum, so that was what was charged. I got home and had seen that the owner had been to the same veterinarian I just went to (that vet is down the street from where I live) and provided a reciept from less than a year ago that the unleashed dog had had the rabies vaccine. The owner of the unleashed dog has asked for my dogs shot records. I have not yet responded. My male dog has the rabies vaccine from a few months ago, but I was unaware my female dogs rabies vaccine had expired last year. I thought dog rabies vaccines were good for 3 years, and since she had had one in 2017 that she would be fine, but the paperwork from 2017 says it's only for a year. I want to know what my next steps should be because I was following the leash law and I always have. I most certainly dont want to have to pay the 200 I owe since my dogs didnt start the altercation. I don't want to be in any trouble either obviously since I made a mistake of not getting my female dogs rabies vaccine done in the last year. I dont want this unleashed dog to be affected negatively either because its not the dogs fault the owner didnt have a leash. What do I do? [link] [comments] |
I was electrocuted at work and then fired from my Job 2 months later [WA] Posted: 22 Apr 2019 09:43 AM PDT I am an engineer and I was electrocuted at work while running an electrical test. Over the following days and weeks I started experiencing various neurological issues, most of them were not immediate but rather delayed on-set which from what my neurologist told me is normal in electrical injury. The symptoms began as weakness in my hands and limbs and gradually turned into muscle twitching, numbness and tingling in my extremities, muscle tremors, difficulty sleeping, fatigue, nerve pain throughout my body, difficulty concentrating and short term memory problems. Despite this I never took any time off from work due to the injury because A) the sheer amount of work that I had to do and the fast approaching deadlines that I had to meet as part of my responsibilities and the program I was working on meant that I could not afford to do this as I was already completely overwhelmed at work (to give you an idea, I regularly worked 70hrs a week) and 2) Despite the fact that I reported this injury at work, the environmental health and safety guy at my job told me that I was not injured and rather this was a "close call" due to the fact I did not have any burns from the electrocution, therefore my injury was not an OSHA record-able and he said I would have to bring proof to him that I was injured. Basically he said even though I suffered a high voltage shock, he said there was nothing visible to prove to him that I was actually hurt. This meant that I got questionable looks when I told my boss that I did not feel right and he basically rolled his eyes at me when I told him about my symptoms since my symptoms did not begin showing up till the following days and weeks after the injury. I work as an engineer so the physical symptoms were very frustrating but I powered through them, the nerve pain, weakness in my limbs and muscle twitching, fatigue etc and kept on working, however the cognitive symptoms were a lot harder to deal with as my job is very mentally demanding and I usually work 12+ hrs a day. The cognitive symptoms were subtle at first since initially I just thought that I was just overworked and stressed and that's why I was forgetting things but as time went on I realized how bad my memory had gotten, my boss constantly reminded me that I had forgotten to send him updates, upload results etc. Furthermore he wanted me to continue doing more electrical testing which I really did not want to do anymore because of my accident (I really did not want to be anywhere near live electrical wires, I still get recurring nightmares of getting electrocuted). He kept asking for more electrical tests and it got to the point where I told him I could not do this anymore and I requested to be transferred back to the department where I interned with which did not involve any electrical testing and I was more familiar with the job responsibilities (I am a mechanical engineer and this position was primarily electrical), he said okay and then basically sent me an email with HR CC'd that basically said the following: Hi /u/mythrowaway4legal do you agree to the following,
I replied yes to this email because I thought he was using it as a justification to transfer me back to the department where I originally interned (I had done a great job in my internship and got an excellent performance review) and was way more familiar with the job responsibilities. However the next week I was called into an office and let go. Since losing my Job I continued going to physical therapy, occupational therapy and began going to speech therapy (for memory problems) as a result of the electrocution. However I feel like the damage to my body is permanent as this happened over 6 months ago and I'm still dealing with all these symptoms and from what my neurologist tells me, I can expect more symptoms later in life. This has caused me to go into depression as I feel like my mental abilities are nowhere near to what they were before (my memory, concentration and cognitive abilities have suffered significantly) as well as all the physical symptoms that I feel in my body (the nerve pain, weakness and tingling in my extremities and muscle twitching) really just make me want to end my life, there is not a minute that goes by that a muscle in my body is not twitching or spazzing out. However a friend of mine thinks that what my employer did was a violation of labor laws because I was injured and he thinks I should take legal action. All my medical therapies have been covered by workers comp except for mental health therapy since I was using my private insurance for that (I started seeing a LMFT because of the toll the electrical injury had on my mental health while working there - no prior history of seeing a therapist), however since I lost my job 4 months ago I have not been able to afford to see my LMF therapist anymore, she has been very concerned for my mental health and has had the police do a wellness check on me but I can't afford to see her anymore however she is completely aware of the effect the electrical injury has had on my mental health. I haven't even bothered to sign up for unemployment because I honestly did not even expect to make it this far but here I am. Here is a link to some information on the long term effects of electrical injury as I have found that most people are not aware of how many symptoms it can cause and the toll it can have on your body. Please let me know what I should do, do I have a case here even though I was an at will employee? My understanding of the labor laws in the US is that you cannot sue your employer because of an on the job injury since you are receiving care through worker's compensation? How should I proceed? Thank you in advance r/legaladvice [link] [comments] |
[Non-US] I was sent an order that should have been cancelled. Posted: 22 Apr 2019 04:56 AM PDT \* TL;DR: Seller decided to ship an order that was going to be refunded, in an effort to scam me. Am I allowed to keep the package if I get my refund before it arrives?* Recently, I bought a product online. While ordering, I had the ability to choose from 3 different warehouses where the product would be dispatched from. I chose the German one since it was the only one inside the EU (to avoid customs). A day later, I found out (through DHL and not the seller himself) that the seller decided to send it from China, without notifying me (both the order, invoice and email stated it would be sent from Germany). After some back and forth between the seller and myself through email (and them denying to help in any way), I requested the cancellation and refund of the order. They denied the cancellation at first, and forwarded me to their Terms of Use (stating that they are not responsible for any custom fees). However, after I pointed them that " (7.1) It is Seller's responsibility to notify stock statuses to the buyers prior to shipment (taken from their Terms)", they backed off and we agreed on the cancellation and refund. Fast forward a few days, and I got sent an email from DHL (again, not from the seller), that the order had been dispatched from Germany this time. Confused, I emailed the seller again seeking for an explanation. They told me that they decided to send the order, despite the fact that we had agreed on the cancellation - again, without notifying me. Bear in mind, that the reason why the order was not dispatched from Germany in the first place was because, as they told me, "Germany warehouse stocks can only be ship to only some EU countries. We do not ship to Greece from Germany warehouses due to customs issues." which turned out to be a lie, since they were able to send the order in the end. Frustrated, I requested that the shipment would be cancelled, considering that the order should have been invalidated as agreed. They completely denied it this time and told me that "Only way to cancel the order now is you have to refuse the package and you have to wait for refund until it reaches back to seller's warehouse." something that will take too long. They also advised me that "We highly recommend to you to accept the order to avoid the delay in refund." (how thoughtful of them). In the end, I decided to bring the matter directly to PayPal in order to get my refund, since they offer a really helpful buyer protection program. They have a history of refunding relatives, so I am not worried that they will do so on this occasion. So, essentially, my question is: In the event that I do get my refund from PayPal before the package arrives (could be unlikely - but I need to be sure), am I allowed to keep the package? The initial order was cancelled, meaning that the package they sent me is not part of an order. I do realize that this may not be the most ethical thing to do, but considering the unacceptably unprofessional way that they treated the matter, I do not know if I want to just remain passive on this. My (26F) neighbors (50??M) says he has a right to play loud music at all hours of the night and day Posted: 22 Apr 2019 03:23 AM PDT (NC) So basically exactly what it sounds like. My neighbor is unemployed with an unemployed roommate and they insist on blasting music through a speaker pretty much any time they are awake. Which, because they're unemployed, is basically all hours of the night. At least a dozen times we have texted them or called or even gone over at 3 am and tried to be reasonable and ask them to turn it down. They have usually apologized and done so, but yesterday it turned ugly and he basically told me that he could do whatever he wants on his property and to get over it. Now my question is, where do his rights to enjoyment of loud music end and my right to a quiet sleep begin? I'm scared to call the cops because of retaliation from this guy and I'm also scared the cops are going to say that it's not loud enough for them to do anything about. He claims he bought a smaller speaker and faces it away from my house so I shouldn't be able to hear it and he's wrong. I still hear bass thumping through the walls all night long and it keeps me awake. I just don't know if it's bad enough for the cops to take seriously, and I don't know what else I can do here. [Ontario Canada] Does a Living Will supercede a PoA in the case of funeral services? Posted: 22 Apr 2019 11:30 AM PDT My friend's younger sibling, a transgirl, recently died in result of a car crash, and is going to be cremated and buried in the family plot. The problem comes from the fact that their parents are refusing to have the sibling buried under their legally changed female name, instead wanting for her birth name to be on the plot (a clearly male name). She was very sickly, and so had specified she wanted her chosen name to be on the plot anyway in case her cancer returned. Does her will, signed and notarized, take precedence over the wishes of the parents? She didn't die quickly and was comatose for a week, and the parents had PoA, does this change things? [link] [comments] |
Posted: 22 Apr 2019 05:35 AM PDT I've been thinking about this for about a year, and I'm just stunned I didn't process it properly for so long. This happened over a decade ago so I can't remember a lot of details but I'll try my best here. Not going to name any names, obviously. I realize now that a lot of this information might seem off-topic as you read it, but to me everything here is relevant to what happened and how it played out, in past and present. When I was a little kid in California, my parents were much better off than they were now, and their business was really taking off, so my dad would take us on lots of international trips. He was a die-hard surfer to the core, so we would usually go to places with good breaks, either in Central America or in Indonesia. When I was 8, he planned for us to take a trip to Nicaragua. I don't remember how, but somehow we invited my grandmother (my mother's mother) and her daughter (my mother's half-sister) to come with us. Now, I have since learned that this grandmother is kind of a horrible person. She abused and tormented my mother growing up, would take her into bars as a teenager to help hook up with guys, addicted to pain pills, the whole 9 yards. Not sure if that's important but I feel like it explained some of the behavior on that trip. She must have been in her 50s when she came with us on this trip, and she brought her 13 year old daughter with her. I'll call grandmother G, and her daughter (my aunt, technically) A. I don't know a lot about A. This was the first time I'd ever met her and I've only ever seen her once since, at a wedding. I've heard a lot of things from my mother though, that she OD'd on cocaine when she was 17, that G was paying for her plastic surgery, etc. My dad's sister happened to be a secretary for the plastic surgeon so I'd hear stuff from her from time to time. A and G lived in Ventura, California, where most of my family is from, and never left. My parents are very "hippie" and I grew up in a town that could have been a hippie commune in the Northern California mountains, so I had a very casual and latchkey childhood. I would often go "explore" with siblings and friends for hours or days, bathe naked with my siblings, swim naked with my friends in the river with my friends, etc. So I was very comfortable with my body, even at a young age. Anyways, the event. I don't remember exactly when it happened, but I think we were coming back from the beach, and my brother and I were hanging out with A. G told us we needed to shower and rinse off the salt and sand, so all three of us ended up in the shower together. A started making sexual jokes, which neither my brother nor I understood in the slightest, as we were both extremely innocent at the time. She ended up making me and my brother try to perform oral sex on each other, both in the shower and on her bed afterwards. My memory is fuzzy here, I assume in part because I didn't want to remember it. But I can't tell you if there was physical force or threats involved, and I don't know if she partook as well or just watched. I do remember she had to convince us, because we didn't really want to. I remember she would ask us what it tasted like, and if it was "fun". I didn't understand what was happening, and my brother was 4 so he was also clueless. Afterwards she told us not to tell anyone what happened, that it was our little secret. Naturally, that night my little brother mentioned it to our parents, who were horrified and demanded that G and A have a serious meeting with them. My brother and I were not present for this. I've gathered from bits and pieces that G defended A's behavior and called my mother childish for being upset. I remember hearing my dad raising his voice, a lot. After we all went home, my parents never talked to A again. My mother talks to G occasionally, but they resent each other so much that whatever conversations they have are strictly hostile and brief. I never even thought about it until very recently. When I was in university two years ago I came out as bisexual and had my first serious partner for a year. He would often want to try oral, but I would have panic attacks that I couldn't identify the cause of and just found no joy in it, so he stopped asking/offering and everything seemed fine. But I couldn't figure out why I didn't enjoy it. Whenever I mentioned it to a male friend, he would say that he didn't understand how I wouldn't like it. Around this time I also started to struggle with depression and serious anxiety issues in everyday life. I never felt like I could afford a therapist in California and just bottled it for a long time. I've been putting these pieces together from memory for 10 months, and at this point I don't know if there's anything further I can uncover without getting someone else involved. I've never told anyone about this except one of my best friends, and he didn't have any advice. I have never talked about it with my brother, though he and I are great friends right now and I have often wondered how that conversation would play out. If he really has forgotten, I don't want to make him remember. My parents almost surely remember, but they have blocked G and A from our family's lives completely and I'm not sure if they would have any new information. My dad's sister who works at the plastic surgery place is the only family member I love and trust who might have information on A, but it wouldn't be much and it might not be trustworthy. All of my family still live in California, but I have moved to Kuala Lumpur for a new office job and don't plan to return until autumn. My question is in two parts. One: how do I define what happened to us? Was this assault? Rape? I don't know where the line is drawn. Two: what can I do about it? Is there any legal action I can or should take here? Should I get any specific people involved? TL,DR: My aunt forced me and my brother to perform oral sex on each other while she watched. My parents know but no one in my family has ever spoken about it in front of me. I want to know if this was assault, and if I can do anything about it. Thank you for reading, and have a wonderful day. [link] [comments] |
[TX] Tree on my property is causing damages to neighbors’ driveway, who is responsible for this? Posted: 22 Apr 2019 11:55 AM PDT The roots of a tree on my property has grown into my neighbors yard and started to push up the brick that lines their driveway. He is renewing his driveway (including the brick that lines it) and wants me to pay for the brick and the work to redo it (it's like $1100). I get that the tree is on my property and therefore belongs to me, does that mean I basically HAVE to pay for it? Technically the driveway is by all means usable the brick is just kind of pushed up and they're only doing this because they're planning to sell the house soon. [link] [comments] |
Posted: 22 Apr 2019 12:32 PM PDT Hi, 17M here from Louisiana. During a recent trip to our local Walmart, one of the bikes on display (for those not familiar with Walmart, bikes are on display on a rack both floor-level and higher up) came lose and hit me. I was knocked out, had a concussion, and had my skull fractured. I know there is not much recourse I can do as a minor but is there any legal action my parents can take? Edit: There was no action by me or anyone associated with me that caused the bike to fall. I didn't even touch the rack, I was just standing there. [link] [comments] |
Service Animals in the Work Place Posted: 22 Apr 2019 08:53 AM PDT Hello, I finished getting my dog trained as a service animal over a month ago and sent HR and the GM an email with a letter written by the trainer detailing what tasks and why I need my service dog, as well as his vaccinations. I live and work in Florida Finally at the end of the month after zero communication they asked me for: -the trainers license (I was told there is no such thing) -Certification number (there is no such thing per ADA FAQ) I asked the HR lady where she's getting the information that there must be a license or certification and all she said was that the CEO told her. She can't even tell me the name of the certification she's requesting. Theres no registration or certification that is covered by the ADA, just voluntary registries. I plan on giving them the general Canine Good Citizen certificate from general obedience school and asking my trainer to come up with a bs certificate of completion along with FAQ from the ADA. There's no one in the office who is allergic I work in the very back by a door I have a cubicle and there really isn't any reason except for the fact they don't want to work with me. It's clear they haven't done any sort of research on the subject because they refused to speak to the trainer and told me that all of the information HAD to come from me directly. If they keep denying me to bring my service animal what can I do? [link] [comments] |
