I asked them for a copy of our insurance policy and saw that my car was not listed. My parents claimed that I have liability insurance, but the policy does not list my current car. My name is on there, as is my old car (now sold), but I was wondering if (in the state of TN) you can be have liability without your current car being listed on the policy. Also, if anyone knows, is 100$ a month for liability insurance on a 2000 mercury villager a reasonable price? [link] [comments] |

Rear-end auto accident- At fault? Posted: 22 Mar 2019 12:54 AM PDT Hello, I was involved in a rear-end auto collision with another vehicle yesterday where my vehicle rear-ended another. I am in California, and I understand that generally, rear-end cases are usually at fault of the rear vehicle. This situation is a bit different. There were a total of 3 cars involved. We were all driving along the highway at the speed of traffic when the front vehicle brakes, causing the second vehicle to slam his brakes and ultimately him rear-ending the first vehicle. I reacted as quickly as I could but due to the rate of speed (60 mph in a 65 mph highway) and due to the the second car's collision with the first vehicle dramatically stopping the car in it's tracks, my car did not have enough time to avoid the rear-end. I was driving at a safe speed and had ample distance (2 and a half cars) between the vehicles. This is all noted in the police report. After speaking with insurance, it seems like they are already assuming that I am going to be determined at fault. Do I have a case to dispute the fault? My car was likely total loss as the bumper slipped under the vehicle causing extensive damage to the engine and 2 airbags going off. [link] [comments] |

I talked to him and the damage to his truck was negligible so he didn't care. However the damage to my car was a little more significant. The car still drives fine, just a fender bender. Rental Car Accident - Who pays? Posted: 22 Mar 2019 12:08 AM PDT Hi! This is my first time posting on reddit and wasn't sure how to so sorry if I mess up the format (or posted in the wrong sub reddit) but I just got into an accident with someone who was in a rental car. He was coming out of a parking lot and I guess as soon as he turned, I merged into his lane which resulted in a minor collision (just scratches on both our cars). I am also in California but I'm not sure where he's from; I think he's also from California and so I'm not sure if a rental car means he's rented it out as if he's on a trip or if he rented it out but "keeping it as his own" if that makes any sense? I'm not really sure who's fault it is (I don't think I'm at fault as I checked my blind spot before merging into the lane but I guess he turned out of the parking lot as soon as I merged which resulted in a scratch) but I looked it up and read that the person that owns the rental car is usually the one that pays for everything as it is their responsibility to keep the car in the condition it was rented out. ACA Market Place Plans vs Employers Plan Posted: 21 Mar 2019 10:40 PM PDT I was looking at the Market Place plans and comparing them to my employer's plan and I noticed even before my Employee's contribution the Market Place plans are significantly more expensive and offer less coverage. The Platinum HMO plans from the same companies like Kaiser and Blue Shield have high premium than what is offered to my Employer and have much lower benefits. I currently have a policy on a 4th vehicle that currently is not being used at all. Its policy was mostly liability so i never figured it was too important to switch. At fault driver here - better to pay out-of-pocket or through insurance? Posted: 21 Mar 2019 10:04 PM PDT Total insurance illiterate so I'm sorry in advance. Before this I had an accident where I was not at fault 3 years ago but otherwise clean record. This is in California btw. I got into a minor fender bender where my foot slipped from the brake pedal and I bumped into the car in front of me at ~5 mph. I fully owned up to my mistake and the other driver was kind enough to let me pay out-of-pocket. There was no damage to my car, and her car (White 2017 Toyota Camry) had a tiny paint scratch on her rear bumper, although I'm not sure how deep. She got an estimate from a body shop and it turns out that the estimate is a little over $1000. According to the estimator her car color is considered more pricey to paint, and her plastic lower cover would need to be replaced. Frankly I'm shocked but after doing some google-fu I found it it isn't unheard of. The lady is going to get another estimate tomorrow because she also finds the price a bit high and I appreciate her for doing this. However, I want to know if it's more worth it to pay out-of-pocket for her repair or go through my insurance because I'm afraid the premium increase will be worse for me. Thank you all so much! Sump Pump Failed, Flooded Basement! Claim Denied! Minnesota Posted: 21 Mar 2019 04:51 PM PDT I am in a tough spot. Last Wednesday 3/13 the Minneapolis area went from frozen to 50 and rain overnight. The roof melted 2 feet of snow and the ground melted about 1 foot. Needless to say the whole area is a little soggy. My house has a finished basement with 2 windows in the rear. The floor is about 4 feet below ground level. It sits in an area very flat and very susceptible to poor drainage issues. I have replaced the sump pump 5 years ago when the original one failed. Home was built in 1997. The sump expels water to the very rear of the yard, 40 feet from the house. The drain pipe is buried behind a 3ft retaining wall the entire length. I have not had any worries with the sump pump since I replaced it, it does an amazing job. Until last Wednesday. A portion of the drain pipe must have had water in it that froze, or a plug of some sort. The 2 inch white PVC pipe that exits the house broke at a joint before it enters the ground. Right next to the house. I was at work when this happened and when I got home the sump pump was running non stop in emergency mode. Both the main pump and battery backup pump running. So much water! The water flowed against the house for 15 feet, then turned the corner to the back of the house and flooded the entire back wall. Both window wells under water completely. It washed out the retaining wall, and the mud sand mixture collected against the house. The water was held against the house because of the snow in the yard. It had nowhere to go but in. When I got home it seemed to be pumped out only to come right back in through the windows and walls. I went into damage control mode. I ripped off some gutter downspout long enough to divert the water far enough away from the house. It took 2 hours for the pumps to turn off for more than a minute. Then I called my insurance to make a claim. The next morning a claims person called and asked for pictures of the outside. Then an hour later I get a call from them asking if it was ok to record the conversation. I knew immediately this was bad but I had nothing to hide that the adjuster wouldn't see. Then another call shortly after telling me the claim is denied because the water came in the windows from outside and is labeled as flood damage. No reasonable person would pay for flood insurance because of the costs. I do however have a sump pump amendment. How is this damage not covered by the amendment if the sump system failed and created the problem? What can I say to the insurance to change their mind? Auto: How many estimates should I get when other party accepted liability? Posted: 21 Mar 2019 12:34 PM PDT I got one official estimate so far from an other insurance companies approved auto-body shop. They did a photo estimate. They approved it and are willing to send me a check. The amount is about the average of what I was quoted off-the-record by a few other body shops. Should I just take it or get more estimates? My concern is that if I get another estimate and the amount is lower that they will take retract the first estimate? Please advise. [link] [comments] |
What do you know about Association Health Plans? Posted: 21 Mar 2019 06:06 PM PDT I'm losing cobra coverage. I'm self employed, only employee is my mom, but she's part time. I am not eligible for a Group Plan because she's Family and part time. I do have a Qualifying Life Event, but the plans in my individual marketplace suck. There are very few choices. There are some great group plan options... but again I don't qualify for a group plan. I've heard there are Association Health Plans out there, but I can't find very much on the google machine and hoping someone more knowledgeable can shed some light. Believe it or not I am an insurance broker, however this isn't my area of expertise. Unfortunately all of the colleagues I've talked to thus far are not informed on the topic either. Medical insurance: Preventative colonoscopy or not? Posted: 21 Mar 2019 05:52 PM PDT Hi r/Insurance, I hope this is the right place to ask this. I'm a 34 year old male. I have a chronic gastrointestinal condition, Crohn's disease. Typically the specialists I've seen have recommended a colonoscopy every couple of years, but as my last one showed some adenomatous polyps (the kind that can theoretically become cancerous), the last specialist I saw recommended doing another one in a year to keep tabs on things. I just got a new job, and moved across the country. I need to decide between a HDHP with an HSA and a more traditional one. To budget for this, I'm trying to determine if a colonoscopy would be considered preventative or not--my understanding is that under the ACA, if its preventative its totally covered, but typically that is only after 50+ years old. Do any insurance experts know where I would fall? Like, if my doctor says, "No, with his preexisting health condition this is preventative" is that what decides, or would this still be something that I would need to pay OOP until my OOP max? They are rating some new business as being near a fire hydrant even though they are in the country...which makes a big difference in rates. This seems unethical, but is this normal practice for them? They will rate a country home as being close to a fire hydrant in order to lower the rate. I don’t know how to write this request letter Posted: 21 Mar 2019 09:28 AM PDT My late sister died 5 years ago, she left a monthly insurance for her disabled daughter, now she's 21 (I am her legal guardian now) the insurance company doesn't know about her condition. So now, they are asking for a letter request fo re-adjudication for tagging an incapacitated child so that they will continue to give her the monthly pension. I don't know much about writing request letters to a insurance company. And can anyone explain what re-adjudication actually means? I googled it and I am in all honesty confused. He has full coverage but also has some friends who work on cars. He told me he's willing to either go through insurance or pay for parts needed and have his buddy work on the car. Not at fault - Other driver's insurance saying some damages not caused by accident Posted: 21 Mar 2019 02:21 PM PDT Hello all, We were rear ended while at a dead stop in traffic and the other driver hit us at about 50mph. They admitted fault, saying they were not watching where they were going. We wanted to go through their insurance to avoid paying the deductible but their insurance is only wanting to pay for the body damage to the car. The accident caused our sun visors to break, there is now something wrong with the passenger side window (the side they hit us on) and the window will roll down but not back up, and we have a cracked motor mount. The accident also caused damage to a lot of our personal property as we were moving at the time of the accident and had the car packed full. My laptop was damaged, it will not boot or recognize the hard drive. Both of our glasses came off and broke, and we had two guitars in there as well. There is no physical damage to the guitars but they just don't sound right anymore and won't stay in tune. So their insurance doesn't want to pay for anything but the body damage They're claiming everything else was not caused by the accident. We are not sure what to do as we've never been in an accident before and aren't sure how it all works. Our lawyer said it would be best to call our insurance company and go through them and let them handle it? Do you think there will be problems getting these other parts of the car reimbursed? Would they also be reimbursing the items that were damaged in the accident? Also, how does the deductible work? Is it billed or we pay it before the car goes in the shop? Auto-Insurance company refusing to pay for full rental car cost - Minneapolis, MN Posted: 21 Mar 2019 01:46 PM PDT **I originally posted this in r/legaladvice and it was suggested that I come here for possible answers/help** I was rear-ended about three weeks ago on my way home from work. The other driver admitted fault and everything was done through their insurance company. Their insurance set up a rental car for me to use while my car was being fixed. I dropped my car off with the repair shop at the dealership where I purchased it. The insurance company gave an initial estimate for repair cost and time based off of photos from the time of the accident. Their initial estimate was that it should only take 2 days for the repairs. I dropped my car off for repairs (and picked up the rental car) on 3/5/19. My entire bumper needed to be replaced and so the repair shop had to order it and have it delivered. Because of the bad weather in my area, there were several delays in having the bumper delivered. The insurance company approved 2 extensions for the time it took and the additional labor that the repair shop requested. I received my car back from the repair shop on 3/15/19 and returned the rental car same day. I got a call from the insurance company yesterday saying that I was only approved for the rental car for 2 days and they extended it out to 3/11/19 as a courtesy but that I now had to pay the cost of the rental car from 3/12/19-3/15/19. I told them that was unacceptable and I would not be doing that. The person I spoke with kept repeating the same line over and over that the repair was only approved for 2 days and they weren't responsible for the extra time it took. I asked to speak with a manager and he initially refused before offering to transfer me to a voicemail. The number he transferred me to said I had to enter an extension to leave a voicemail for a specific person, so I ultimately couldn't leave a message. I intend to call back today but I want to know if they are allowed to do this, or if I have any ground to stand on since they approved the extended time for the repairs and I was never given an option to return the rental car sooner to avoid the cost. State Farm - Technically a Hit and Run. Posted: 21 Mar 2019 01:45 PM PDT Background: I'm a 25 year old male living in Virginia under my father's insurance. So a few months ago, I was in a 7-11 parking lot when a Hispanic woman backs up quickly and hits the back-left door of my car. We get out of the car and she starts getting aggressive. I can't quite understand her perfectly because of her accent - it's clear she's not a native of this country. So I repeatedly ask her for her license and insurance information, and she refuses to give it to it, claiming my light wasn't on and therefore it was my fault (the incident took place early morning as the sun was coming up). She keeps yelling at me and tells me to call the cops. I do, and as I am, the cop asks me a few questions, one was the exact location, which I was too tired to identify. I look at the scratch/dent, decide it's not that bad and won't affect my finances anyway (my car already needs a paint job, so what's one more spot? - was what I was thinking). So I hung up the phone and just let her go. Anyway, I got home, napped, and woke up maybe 4 hours later. Upon further inspection, I realized the damage was worse than I initially thought. The next day, I called the local police to assist me in getting footage at the 7-11 and they retrieved a picture of the person, but not of the car. I called State Farm to report the accident in the same manner as I did above, and the representative said the deductible would be 200 rather than 500 because it was a hit-and-run. I called again a few months later, and the new representative told me it would be 500, claiming that because they driver had stopped, it does not constitute a hit-and-run and therefore I have to pay the full 500, adding in that I did not write down their license plate number (which is accurate - I was fatigued and not thinking clearly). However, according to Virginia State Hit-And-Run Law, "The driver is legally responsible to report their name, driver's license number, address, vehicle registration number to the law-enforcement officers or to the State Police of Virginia, or to that driver who was struck. " So because they failed to do this, it constitutes a hit-and-run and therefore I my deductible should be 200 rather than 500. Do you guys think I have a case? I talked to a State Farm Representative about this and they said because the driver stopped and I didn't get any information, I have to pay the 500 deductible. [link] [comments] |
Car Accident in US - Insured in Canada Posted: 21 Mar 2019 01:20 PM PDT Looking for some legal advice for the following scenario. Joe = Canadian Citizen, insured in Ontario w/coverage for USA. Joe was driving in a parking lot in Florida (5km/h) and a pedestrian popped up with shopping cart, and the car hit the shopping cart which made the pedestrian fall on his/her butt. They were totally fine, called the cops/ambulance. Car had barely any damage, and police were contacted, a police report was completed. There is also surveillance footage of the accident from the store's cameras. The accident was not reported to the insurance company (may have been foolish) because Joe figured if there is no claim to the insurance, there is no need for reporting. Fast forward 5 weeks later, the pedestrian's lawyer has notified Joe's insurance company that they will proceed to seek injury damages (so far no amount, just a notification). The insurance company called Joe, and he complied, gave all the details of the accident, along with police report. Insurance is now trying to find a way out it seems, saying Joe "MAY" have breached the policy terms by not reporting the accident, but they have to look into it.
Joe will now obviously consult with an insurance lawyer but can the insurance company deny the claim? Let me know if I left out any important info. [link] [comments] |
How long will “at fault” driver’s insurance pay for my rental car after an accident? Posted: 21 Mar 2019 09:32 AM PDT I was recently in an accident where I was not at fault and the side panels were damaged. It is still drivable... just ugly. The person who hit me is insured through State Farm and they told me they will cover the cost of the rental car and repairs. Most reputable body shops I've called aren't able to take my car in for repairs for at least two weeks. State Farm has already sent info to the rental car agency. If I were to pick up the car today, with a repair appointment set for two weeks from now, will State Farm cover the rental until my car is repaired even though it won't go into the shop for at least two weeks?
