Posted: 06 Feb 2019 08:11 AM PST Right now my brother is threatening to "sue" me for my son taking a figure from his collection and get the police involved. Here is the story. Last week my brother invited me and my family over for diner. While we were there my son asked to see my brothers collection of toys and figures. My brother has spent a good deal of money on his collection and from what I know it's one of his biggest hobbies. Well, after diner we left and everything seemed normal Well, until yesterday. My brother called me up furiously and told me my "little shit" stole something from his collection and I needed to return it immediately. I honestly was upset at this, but if my son had taken something that was wrong, especially if it was from my own brother. Well, it turns out that my son slipped away during dinner and took a Boba Fett figure from his collection. He confirmed it because he has footage from his porch camera of him taking it out to our car. I was furious and took it from him. Here is the problem though, after I confirmed with my brother it was his I found out that my son had removed it from it's packaging. Apparently the figure is worth almost 2000$ in it's package and almost nothing out of it. So my brother broke down over the phone and refused to take it back before hanging up. Well, he just called me again today and said he wanted me to pay for a replacement immediately or he will get the police involved and sue me. I told him I would help pay for one but not fully to which he said "not good enough" and hung up. Honestly, what are my options here? I can't afford to pay him back right now. If he does go the police will my son get arrested? He's only 15. It was very wrong of him to do but I think my brother is over reacting. What can I expect if he does take me to court or call the police? [link] [comments] |
Posted: 06 Feb 2019 11:04 AM PST Mostly what's in the title. Condo was vacant for roughly 60 days between closing and our attempt to move in. Upon getting there with our belongings, we discovered a new deadbolt on the door - the unit was vacant and had no deadbolt when we did our final walkthrough the day before closing. Tried knocking on the door. got no answer, reached out to our realtor, who contacted the seller's agent and asked that he get in touch with his client to find out what the hell is going on, but at this point we assumed squatters. About an hour later, a young man showed up and produced a 36 month lease which had been paid in advance. All $1 of it. He told us it's between us and his uncle, and headed into the apartment. Our realtor is flabbergasted; he's encountered squatters and tenants who had to be evicted after refusing to leave at the end of the lease, but never anything like this. The police won't touch this either, which makes perfect sense given the context - dude has a lease that predates our contract (albeit by one day) so as far as they're concerned it's a civil matter. The condo association is incredibly hands-off about owners leasing their properties (which is part of why this place was appealing, as I plan to rent it out myself when we are ready to buy a house), so they want nothing to do with the situation. To me it seems like the lease should be completely void given that it was executed in ridiculously bad faith, but I am nowhere near a lawyer. To that end, the attorney who handled the transaction for us is out of town till next week - my understanding is that he's camping or hiking or hunting or something along those lines and is basically incommunicado for the time being, but I am waiting to hear back from his admin to get details (he's a one man firm so there are no associates that can help me in the interim). I have no idea what to do here. Luckily the truck we were using to move is owned by a friend's business, and they have graciously offered to let us store our belongings in it while we get this sorted. Unluckily, my wife and I turned in the keys to our old apartment this morning, and as such we have nowhere to go. I'd be willing to do a cash for keys thing to get this guy out of our apartment but he won't speak to us. Beyond that, do I have grounds to evict him? If so, how do I recoup the expenses associated with this whole clusterfuck, sue the seller? Does the tenant have any sort of liability here? If I do pull of a successful cash for keys arrangement, can I sue the seller for that as well? What about the friend who is letting us keep all of our stuff in one of his trucks, does he have any grounds to sue or does the fact he is voluntarily letting us use the truck take that out of the equation? Is there anything else that I am not thinking of? I am shaking with anger right now so I apologize for this being a bit of a a rambling novel, and thanks in advance for any advice you can offer. Edit: Location is New York, specifically Putnam County. Update (4:45PM): I just got a call from my attorney's admin. He's apparently close enough to civilization to have an internet connection in his cabin and should be checking in with her shortly, at which point she'll have him reach out to me. Apparently he was a civil litigator before he "retired" to real estate law, and she thinks he'll welcome an excuse to step into his old shoes and tear these people apart. Needless to say I am looking forward to hearing from him. Update 2 (5:25PM): Just heard from both my realtor and my attorney. The evening seems to have found a way to get even more interesting, but the truck owning friend is about five minutes out with my car. We're going to meet my realtor for dinner, my closing documents and some badly needed drinks (said the guy who doesn't really drink). I'll update tomorrow morning if not tonight, but till then... THANK YOU THANK YOU THANK YOU for the advice and reassurance. Wish me luck! [link] [comments] |
Posted: 06 Feb 2019 04:51 AM PST Hello all and thanks for reading. As the title states, my front lawn is being used against our will as a communal bus stop for the local Public Middle School. There's about 2-3 kids of teenage age who come up to the house every morning and scream, jump, and run all over the front lawn and front porch of my property. We have gone outside to tell the kids they have to move as they are trespassing, and at first they would move, but they refuse to even look at or acknowledge us now. We've called the school, and the bus company, and they completely understood my concern for the kids safety and the property. They said that they'd "talk to the kids but can't force them to do anything" and that they couldn't move the pickup stop, so now it was a police matter. So I called the police non-emergency line and they also verbally agreed that what the kids were doing wasn't safe, and said they'd send out a squad car in the mornings to talk to them. I have yet to see a police cruiser drive by, but maybe they've had more important calls in the mornings so far. I have no way of knowing where these kids are from, seeing as I live in a neighborhood where you can't really see your neighbors and these kids are definitely not from any of the immediately surrounding homes. I don't want to start a neighborhood war, I just want these kids to not break their leg on my property, or jump off the rock ledge and into the road and get hit by a passing car, as visibility is low due to a blind corner in front of the property. Are there any other avenues that we should be taking to try to protect these kids from potential injuries and ourselves from potential lawsuits if one of them gets injured? We're at our wits end with these kids and while everyone agrees it's an issue, no one seems to care enough to make any changes. Located in Rhode Island. Posted: 05 Feb 2019 03:07 PM PST Original post: https://www.reddit.com/r/legaladvice/comments/9z5mms/i_do_reviews_i_reveiced_a_cease_and_desist_after/?utm_source=reddit-android So it's been an interesting two months, after my post I started contacting a few attorneys locally and eventually had to call the state bar for a referral because of the type of possible laws not a lot of people handle that like a normal lawyer does that's usually family/criminal. I finally found an attorney that understood what I was talking about and wanted a link to the Reddit post and agreed with the majority of the top advice I received. He accepted a small retainer of $250 to respond to the cease and desist I received and a few possible future letters/calls. He responded asking them exactly what statements I made that were false and requested exact times in the video that the statements were made. Since I previously privated the video we had to give them a different link. He also outlined what will happen should they continue stating that during discovery he will be requesting all communication between QA, play testing, developers, and management to see if they were aware of any of these bugs/issues that may compromise a customer's experience while playing etc. It also included a paragraph basically calling them out for reaching out to me and lying about "swag and wanting feedback" to get my information to send a cease and desist instead of going through the proper legal channels to obtain this and the fact that I still have yet to receive any "swag" that this is clearly the case. Also included that they need to preserve all the emails they sent to other reviewers because it's of interest in the possible upcoming legal action. He also requested they preserve all sorts or other communication between QA, developers etc. So after he had confirmed receipt of the letter we waited and waited. Nothing for about a month but then I received 3 large boxes containing games, posters, statues, a custom PS4 limited edition console, bobble heads, Funko pops, just every piece of swag I think they have for 3-4 of their games and a letter saying "Sorry it took so long for us to get this swag out to you!" My attorney then sent out another letter asking about the status and their position on the cease and desist and we received a letter back with only a few sentences basically saying they made a mistake and we can expect no further correspondence on the matter and that the video can be reinstated if we so wish. He sent out another asking about the lost ad revenue due to me having to private the video since they admitted it was a mistake. They sent out a check for $500 and some papers I needed to sign basically saying the issue is over and I won't sue them. Thank you LA, I didn't get sued and after it all I came out ahead. I'm still not going to link my channel or the video or name the company in question but thanks for all your help! [link] [comments] |
Something weird happening next door - harassed by neighbors Posted: 06 Feb 2019 08:15 AM PST Hi. I am desperate for some guidance - I'm going to make this as short as possible. I (36 F) purchased my home in December of 2017 (Florida), I have lived there alone since around February of 2018. Its a very quiet nice neighborhood close to a downtown area with a lot of young professionals and also the neighborhood is old so there are quite a few elderly neighbors who have lived in their homes since the 50's or 60's. During this time, the neighbors directly next to me (we share a fence) have not been the same. Every couple of months new people are in the home, never any moving trucks or anything like that, just new people and new cars. So, I assumed it was an air bnb deal. I have had a couple of run-ins with the most recent neighbors who are 2 middle aged men who have made me feel very uncomfortable. One morning my dog got out of the yard, I had just gotten out of the shower so I threw on a pair of running shorts and a tank top to try and find him, luckily he didn't get far. But while I was searching both of my neighbors were whistling and shouting things about my body. I had an alarm system installed after this incident because I felt unsafe. About two weeks after this they saw me in my back yard and walked up to the fence and asked me if one of them could come over later and pick from my tree. When I said no I don't feel comfortable with that they became very hostile telling me that I am not very neighborly and that they know I live alone and I can't use all the oranges for myself. One of them flicked his cigarette toward me and it landed about 2 feet in front of me in my yard. I was calling for my dog to come inside and they were doing that thing that assholes do where they talk about you like you aren't there saying things like "Oh look now she's running away, oh she's getting her dog" So now I avoid even going back there. A couple of days later 4 girls appeared, sometimes in the back yard and could be seen coming home, I never saw them leave but I am at work all day so that's not uncommon. I assumed the middle aged men had moved out and I was so relieved. This morning (about 2 hours ago) I saw a young looking girl, maybe in her early 20's leave the house and get into a car that was parked in front of my house. She wasn't wearing any shoes and didn't have a purse or anything with her. I looked in the car and it was one of my neighbors driving. I looked at the other cars (3 of them) in the driveway and on the street and they all have temporary tags. Something weird is going on. So what do I do? Do I call the police? The city? If I do can it be done anonymously? Can I call someone to find out who is supposed to be living there? The owner of the home lives out of state and I have not been able to find her contact information. I want to ensure my safety because I already am sketched out about these people. Something just seems really off about the situation. Any advice appreciated. [link] [comments] |
(TEXAS) Mom died, entitled brats arguing over all the things. Best way to keep peace? Posted: 06 Feb 2019 04:56 AM PST Mom's last will, from 2006, leaves her estate, 50/50, to me and my brother. I'm the responsible kid (and executrix) who works 12-hour shifts and never asked her for a dime, for anything. My brother has lived on her place for 20 years, never paid lot rent, quit his job a few years ago, and she's paid all his bills ever since, including cigarettes. He claims he was "helping out," but all I heard was complaints that he wouldn't help, had to be prodded or insulted to do simple tasks, and she just wished he would move so she could move into an assisted-living apartment. She started having serious health issues in 2016. The past two years, she has been in and out of hospitals. Six months ago, she took up smoking again (my brother smokes). She also went off all her meds, including very important blood thinner and BP medicine. In an effort to motivate my brother to help her, I offered him her land and home if he would just take better care of her. I explained that my shifts wouldn't allow for much help from me (and, besides, he had free room and board). My brother did not step up to the plate. My niece lives 100 miles away and works, so she couldn't do much. I live 30 miles away and work 12-hour shifts, so I couldn't, either. My brother, unemployed, dependent upon mom for everything (including cigarettes) dropped the ball, badly. Worse, in an effort to keep me out of the loop and from understanding just how bad things had gotten, I was gaslit for months, by both of them. (Cigarettes were the biggest issue: They wanted to smoke, I didn't want mom to smoke.) I was repeatedly told, "Everything's fine," to the end. Then she died. My brother and niece believe he deserves $75,000 estate. After paying all expenses, there might be $20,000 cash left, including three CDs worth $5,000 each. They insist that mom meant for each of us to have $5,000. (I think mom may have mentioned three CDs last year, one for each of us, and honestly thought she meant brother, her, myself.) All three of us got upset and probably said things we shouldn't have. I loved mom, but she was a redheaded PITA, and had harsh words for everybody -- behind our backs. (When they told me mom said "ABC" about me, I just had to let them know she also said "EFG" and "XYZ" about them). After much arguing and namecalling, my brother will settle for $75,000 property, but I haven't been, and won't be allowed, to take inventory, take anything, find out what happened to her jewelry, none of it. That leaves me with only the $20,000 cash. Also, my brother (now 62, his SSI starts in April, but is only $1,200 monthly) has already expressed doubts he can keep up with the insurance and taxes. I hate to see property that my parents worked so hard on for 50 years be junked up (he's a hoarder) and ultimately sold at wholesale because mom spoiled him so badly for so many years. But realistically, legally and ethically, what is the best course of action? The two of them are still livid that they won't get "their" CDs. My brother has already verbally threatened me. I'm just sick of it all, and want to finish probate ASAP. Owning the property 50/50 is not an option. When my niece said, very condescendingly, "surely you realize cash is worth more than property," I offered to trade them the $20,000 remaining cash/CDs for the $75,000 house and land, but my niece replied, "No, because he will still need a place to live." Any advice, compromises, and legal insight is appreciated. [link] [comments] |
Terminated while serving for Jury Duty Posted: 06 Feb 2019 10:24 AM PST Location: Colorado Background: I work for a company that does contract-to-hire. I was assigned to a fairly large organization that does a lot of work for the federal government, stuff like aerospace and defense. During my course of working for this company I was assigned to jury duty, and was selected for jury duty for a criminal case. I notified my boss well in advance of my appearance date, that I had been summoned for jury duty; I'm still serving on the jury, and on the first day I notified my boss that I was selected for jury duty and about how long the case should last. The Judge in this trial said the trial would probably last for at least for days. Early this morning I get an email from my point of contact from the contract-to-hire company that my contract with the large organization is being terminated for performance reasons. This contract was supposed to last until at least June. I have called ( my now ex) boss to hear from him, but have heard nothing back. What options do I have? What is the best way to handle this? Alerted landlord to black mold - now being evicted Posted: 06 Feb 2019 06:33 AM PST Hello, I posted about a month ago regarding my situation but I don't know how to link the old post. Long story short, we're month to month tenants in a rental home in clay county, Florida. My boyfriend had a year lease with the old management company and they never required him to renew it. A new management company took over (we contributed to be month to month) so we alerted them to mold growing in the cabinets and a severe roof leak because I thought they would maybe do something about it unlike the prior company. This new company sent out a contractor 2 weeks ago and he said that it was black mold and the roof needed to be replaced. He said he would alert the company. The company then reported it on my boyfriend's file that it was "discoloration" in the cabinets. My boyfriend got along with the contractor so he called him and asked how he reported it. The contractor said he told them it was black mold and that the roof leak is extremely bad and needs to be fixed. The company sent another contractor out after my boyfriend called them a few times and that contractor again confirmed the mold and put tar on the roof but said it needs to be replaced. One week later (this morning) we got a paper on the door that they are ending our month to month tenancy and we have 15 days to get out. We paid the rent on the 1st. I wanted to withhold the rent due to the black mold but I was told that since we gave them notice they have time to fix it before we can withhold rent. They are clearly doing this because we alerted them to the black mold and the roof leak and they don't want to deal with it. Is there anything we can do? I feel like this is a retaliatory eviction but I am unsure about that area of the law. Any advice would be appreciated. My boyfriend called them and they said they would call him back but I'm sure they aren't going to say the real reason why they are ending our "lease" I understand they have the right to end month to month tenancies but the timing is extremely suspicious. After 2 of their own contractors tell us it's black mold and the roof needs to be replaced they have decided to remove us from the home instead of doing the repair. Thank you in advance. Posted: 06 Feb 2019 07:22 AM PST Okay so when I was a kid, I was sexually abused by my dad. After I finally told someone at like 15/16, a lot of things happened with DCFS and the police. I know my dad was taken to court. However, I did not go to court to say what happened, I was too afraid and scared. I know he ended up being convicted as a sex offender, but I am not sure the details of anything else. I think he was not allowed to contact me or be around me, but I don't know if that was only while I was underaged, or if that was forever. Is it possible to ask the police for records of the case? Would something like this normally be where he can't contact me at all, ever again? If I do go to the police, what do I say/ask? Also, he has attempted to contact me. It mostly been through Facebook, but it's also been through my mom (like him giving me money mostly for birthdays, Ect.) Should I mention that to the police? Thank you in advance for helping me. Today is another day I woke up from a nightmare about him being around me. I need to know he can't do anything to me anymore. (Illinois, US) UPDATE: I called the police department. They of course couldn't give any info over the phone, which was expected. However the lady I talked to said I just needed to come down there and she can give me the information there. So I'll be doing that this weekend when I'm home from college. [link] [comments] |
(New York) Estranged wife completely discharged husband's girlfriend's asthma inhaler Posted: 06 Feb 2019 05:17 AM PST Not me, posting from a throwaway, trying to convince a friend that this was a crime and they need to go to the police. Estranged wife who lives in another location far away traveled to NY and entered her husband's home unannounced when he and his girlfriend were out. She rifled through the girlfriend's things, among them was an asthma inhaler. The next time the girlfriend needed to use her inhaler, it was completely empty. The inhaler had a cap on the trigger, so it was impossible to accidentally discharge, and it has a counter on it so she knew the amount of doses left from the last time she used it (more than 100). Seeing as it is common knowledge that a person can die from an asthma attack, does this constitute attempted murder, or other crimes such as assault? At the very least it seems to meet the criteria for tampering in the 3rd degree, but that merely extends to "causing substantial inconvenience" and I feel like this goes way beyond that. Posted: 05 Feb 2019 06:12 PM PST Thank you everyone for your advice over the weekend. It gave me the courage to continue forward. I'm in California. I had someone willing to represent me legally, but she said even pre-litigation could take 3-6 months and it'd likely end at that point. I've been in the middle of a lawsuit before and it's time consuming and exhausting. I'd rather not focus on that right now, instead I want to focus on my son and his needs, as well as my family while I search for a better fit. This entire ordeal has already taken up too much of my time and created too much emotional distress. I went to HR on Monday representing myself with the implication I had a lawyer prepared to litigate for me. HR was in no way informed about anything that was happening. They were never informed I was fired on the spot in the manner I was and sent home. When I took out all my documentation I've been preparing for weeks now (notebook illustrating times, interactions, what I did during the day) and all the e-mails of his that documented his systematic approach to getting me to a place where my performance was in question (being a dick isn't illegal though). They did disclose he was in the process of firing me (as I knew he was), but the company's strategy was looking to place me with another manager. Since this man is the Director, I said that would not work out as he would impact everything I did as a chemist in their company. When I disclosed what he said about my son, and him pressuring me to not take my sick time, they were sincerely shocked. I initially requested 3-6 months severance (I had only worked their 11 weeks, that seemed like a large demand but I still made it) and said I was losing health coverage for my kids since we use their health benefits (we will be able to switch to my spouse's employers plan). They took a day to do their own fact checking and have various internal meetings. I had a follow-up phone call with HR today and was initially proposed their company (and really my industry's) standard of 2-4 weeks severance. They offered me 4 weeks plus an agreed upon stipend to pay the COBRA coverage to remain on their healthcare plan an additional month. I negotiated back that I didn't think that was sufficient for everything I encountered. I got them to give me 6 weeks severance with an agreement they would not deny me unemployment. I ended up with $11,000 from the company. Had I not stood my ground, documented, and prepared myself I likely could have been fired within 30 days (there is no way he would have allowed me to do well in a 'Performance Improvement Plan' since he couldn't even have been bothered to follow company procedure). As I originally discussed with HR, I made it very clear I wanted repercussions for his actions. I knew he wouldn't be fired. However, they made it clear that they spoke with his boss (he's only one step below the VP) and the company will make sure he receives additional training and they will be monitoring how he on boards new hires in the future. They said they took all my feedback very seriously and appreciated me coming forward. I'm glad to be out of there and I'm glad that I received some sort of compensation. I'm also glad that they were clear that they took my feedback seriously and will monitor his behavior. I think that is more than I ever expected. [link] [comments] |
Posted: 06 Feb 2019 07:29 AM PST My 13yo sister got molested by a family friend (who also lives in Toronto) while they were in Ohio with my parents settling in my cousin. She got the courage to report him when she returned to Toronto but because it happened in Ohio, their police had to take over. I have no clue how dealing with an American case works as a Canadian citizen but our major problem is legal fees. From what I understand, my parents were contacted by a lawyer and/or the police in Ohio and they mentioned it would be $150k in legal fees. Now I don't know if that's just my parents lying in order to avoid taking it to court or the actual legal fees we'll be facing but either way, it is weighing on my sister a lot. It is an understatement to say we have a complicated and tumultuous relationship with our parents, so some objective information or sense of direction would be greatly appreciated! EDIT: We are NOT trying to implicate or charge our parents...not about to end up on the streets here friends. All we want is for this dude to get charged for the crime he did and let my sister live in relative peace. Some of you need to understand the cultural relationship between the police in other countries vs. the west. In no way am I defending my parents' actions but from their perspective, there's no trust between the law and the people. [link] [comments] |
Druggie ex bf left cocaine hidden in my apt Posted: 06 Feb 2019 08:01 AM PST Hi Floridians, I recently found out that my boyfriend of 4y was using cocaine when he overdosed, and was found at a hotel then taken to a nearby hospital. To make matters worse, he also took a ton of Viagra since it's difficult to get an erection while drinking and doing tons of drugs, and he had condoms in his pockets despite him and I not using condoms with each other... Needless to say, once he was discharged from the hospital we had a long talk, and decided to end the relationship. He relapsed, and now blames our breakup for his bad decisions. I am afraid that he will have the police search my apt for his hidden drugs in retaliation for ending the relationship. Will I be charged for drug possession of they do find any illegal substances? I got rid of all of his marijuana paraphernalia, and anything even remotely related to this guy. My address is listed on his driver's license even though his name is not documented on the property title. And I have his medical records, including toxicology screen showing that he was positive for cocaine, benzos, marijuana, and other substances. What are my options? I don't know where to look for the drugs? I wouldn't even know what they looked like! I threw out anything of his that has pockets, I raided the guest bathroom which is where I assume he does Coke based on how much time he spends in there, but everything seemed normal. Thanks in advance! [link] [comments] |
Victim to Hit and Run; I received Citations for Speeding and Reckless Driving Posted: 06 Feb 2019 09:18 AM PST I was involved and a victim too a hit and run on 12/28 and received citations for a few different things; I am currently on my work computer so I will update what the citations are as soon as I get home. The accident took place in Pennsylvania on Route 33 near Stroudsburg. I am a NJ resident and I was bound for central NY to see the in-laws-to-be for new years. My fiance was in her car right behind me and was a witness to the incident. The citations are based on my statement, as i was rattled, anxious, and hopped up on adrenaline, that I "chased" the person who hit me. Now there is no proof, no sworn statement, that i was doing exactly 100+ mph, it is something that was merely just written on the speeding ticket. And since I was "allegedly" going at those speeds I received reckless driving and a few other citations along with it. Personally, I was merely trying to follow the guy to get his license plate number, I was able to get enough of it, first 4-5 letters/numbers along with make, model, and rough year of the vehicle. As soon as I decided alright, this is enough, i began to lay off the throttle and try to follow his tail lights in the distance and before i knew it his tail lights swerved left, then right, then left again, and then they disappeared into somebody's porch. My uncle, a NY State Trooper, told me I should fight it, they have no grounds or evidence, no radar receipt and are going off of my statement, which in the heat of the moment, is not accurate and not realistic. My father-in-law-to-be is a lawyer in NY state, he also believes that I should fight it and should not have to worry about representation and go there to defend myself since they have no grounds or evidence as well. My concern is the traffic cameras. Now I am a car guy, I have a fairly clean record, and I understand and adhere to the rules of the road fairly strictly. I am uncertain about the use of the traffic cameras being used against me in the court of law. This article here outlines that traffic cameras or non-enforcement cameras, different from red light or speeding cameras, do not store video back up and are very rarely used as evidence at all let alone for accidents or speeding violations. I have gone back to the scene and have only found traffic cameras such as these. Is it safe to say that if I fight this, the state of PA/Town of Stroudsburg cannot bring up video evidence proving me wrong? TL;DR: I got some tickets I want to fight on the grounds that they are hear-say with no evidence. Do I have a chance? P.S. As far as I know to this day, 30+ days later, there has been no toxicology report completed and I know for a fact that there was no field sobriety test completed on site of the incident prior to the arrival of EMTs. This has nothing to do with my tickets, but something that alarms me. EDIT #1: Field sobriety test is with regards to the gentleman who hit me. I was not in need of one, I didn't hit and run someone on the highway at 60 mph, I didn't run away, and I didn't total my car into the front of someone's house. [link] [comments] |
Submitted timesheet late, pay docked to minimum wage (PA) Posted: 06 Feb 2019 09:25 AM PST I work for a traffic flagging company and I get paid between $14 and $37 an hour depending on the job site. This past week I submitted my timesheet a day late. When I got my pay stub I realize that I was paid minimum wage. When I asked about it I was told that since it was late my pay got docked. I was not told of this policy when I was hired on. Is this legal? [link] [comments] |
Denied entrance to the USA, what now? Posted: 06 Feb 2019 02:16 AM PST Daughter of my wife was 18 when she was invited through a website by an older gentleman to travel with him in the USA. He paid for her flight. She was travelling with a valid visa. When she arrived in LA the customs asked her what was her business. She explained that she was visiting a friend. The custom asked her to call this friend but the gentleman did not pick up his phone and could not be located. They then confiscated her phone, threatened her with jail so she would give the password and found the conversation with the gentleman. They said she was visiting for prostitution (which was not the case, just an irresponsible action by a young girl that wants to travel) and denied her entrance. They put her on the flight back home. She was told that she cannot enter the USA the next 10 years because of this. The girl has grown up a bit and is now working as an air hostess on European flights. Because of this immature error she cannot work for international airlines since they deny her entrance in the USA. She recently visited the US embassy in Spain and was told that she is in the system with the remark prostitution and cannot enter the US. She is Spanish and has a Spanish passport. Can anybody advice on the best way to proceed? Can this be changed so she can enter the USA again? Can a lawyer do any good in this case? Any advice and comments are greatly appreciated! Edwin EDIT: I asked her some extra details: As far as she knows there was no legal procedure and no judge or alike involved. She spent little more then a day waiting in the airport for the flight home. She was not given any paperwork while leaving. She did not resist her deportation. On the recent Visa application form from the US embassy in Madrid she is refused entry and the box 'Other: 2D1' is ticked. [link] [comments] |
Posted: 06 Feb 2019 11:31 AM PST Hello! Thanks in advance and I'll be incredibly grateful for any assistance that can be offered. Some background: I'm in Roanoke, VA and my son is a third grader at a Roanoke City Public School. He's always had spotty attendance (missing between 10-20 days per year) due to a chronic condition called EBV and a very low pneumococcal titer count. He gets a booster shot every five years to help manage the latter, but there's unfortunately no known treatment for EBV. The EBV causes him to come down with a fever, get swollen lymph nodes, get very lethargic and feel generally terrible for few days or sometimes up to a week. It's essentially like a mini-mono outbreak that occurs randomly, and averages out to roughly one outbreak every few weeks. Now, on to the problem: As I said before, neither his condition(s) nor his attendance are new phenomena for either my family or the school. But, for whatever reason, they're doggedly pursuing us regarding his attendance this year. We started receiving letters in the mail from his school letting us know of the time he's missed, which was normal and appreciated. But then we started getting letters from the school board, threatening us with truancy officer investigation if the alleged truancy issue continues. At that point, I reached out to both the principal of his school and the school board member that is in charge of truancy cases. In my correspondence with them I explained why my son was missing so much time, and I even attached FMLA paperwork (which was completed by our pediatrician and which was approved by my employer, in December 2018) as evidence to support my case. It was a week or so before I heard back from his school (I never heard back from the school board). His principal suggested that I apply for intermittent homebound, and that this program may be a solution to our problem. I told her I'd be happy to try it if that'll help us out. She sent the application home with my son the following day and I looked it over. While reviewing the application, I noticed that there was a section that needed to be completed by my doctor, which will cost approximately $30.00. So, in effect, Roanoke City Public Schools has put any discretion in the application of their compulsory attendance policy for kids with chronic conditions behind a pay-wall. I want to take a principled stand on this, as I know for a fact that there are MANY poor families that attend my son's school who, if they had a child with a chronic condition, would have a hard time coming up with $30.00 to keep themselves from being investigated for truancy and/or being charged/convicted of a class III misdemeanor. What are my options here? Would the school stand a chance of having us prosecuted for the class III misdemeanor of truancy if our son's absences are due to a chronic condition and we can prove it? Is paying to have the intermittent homebound application completed the only way to keep this from escalating any further, or might I have some recourse under the law? Again, thank you in advance for any help you can offer. [link] [comments] |
Ex refusing to consent to autism evaluation Posted: 06 Feb 2019 10:17 AM PST Hi everyone, I was recently diagnosed with high-functioning autism. Living undiagnosed was utterly miserable and I got no support or understanding. I am seeing a great many number of symptoms in my 5-year-old daughter and am confident that she is on the spectrum as well. I want her to have access to support and resources. Plus, studies show that there is more stigma attached to being socially incompetent with no explanation than there is with having an autism label. However, my ex husband says he refuses to consent to an evaluation. I can only guess as to why, but I think it's because he's embarrassed to have been married to someone autistic and doesn't want the world to know his child is autistic. I feel this is active neglect, especially since autistic people have astronomical rates of mental health issues if they go unsupported. Our life expectancy is only 54 years because the rates of suicide are so high. But early intervention works to reduce these risks. He says I "will give her a complex if I keep pushing this mental illness on her." Autism is not a mental illness, it is a neurological condition, and I'm not pushing anything on her. I simply want a professional to talk to her and see what's going on; she'll have no idea that it's anything more than a learning skills evaluation. Does he have any legal recourse if I get her evaluated, or alternatively, do I have any legal recourse or protections to ensure he doesn't interfere? I am a broke grad student who just wants her child to be safe and supported. Edit: custody/divorce was filed in Alaska, I am in PA. Edit: There is nothing in our divorce filings about medical decisions, only who will cover her with insurance. We have shared legal custody. [link] [comments] |
[OH] Landlord towed my car without any notice for expired tags Posted: 06 Feb 2019 05:39 AM PST So I came out to the parking lot this morning and my car was gone. I spoke with a police officer and he helped me track it to an impound. They told us my apartment complex had the car towed last night because the tags were expired. I have the new tags. They are in my glove compartment. The old ones expired on the 25th and I was waiting to apply the new ones on a day when it wasn't raining or snowing. The police officer said he does not think the apartment can or should be able to tow my car without any notice. He told me he would talk to someone back at the office to see if anything can be done. I checked my lease and it says nothing about towing vehicles for any reason. I just started a new job and I don't get paid until Friday. I live alone in a city with no family and few friends. I have no money to get my car out of impound or for any other form of transportation. I only had enough gas in the car to get me to and from work until payday. My job requires 100% attendance during the probationary period. I don't know what to do or what my options are. Edit: My friend's dad wired me money to get my car. I spoke with the complex and they said they have an agreement with the towing company. They can drive through the parking lots and tow any car they deem fit. They are claiming that this is disclosed in my lease and it is not. They are refusing to reimburse me. [link] [comments] |

[TX] My friend applied for a job position I wanted despite not being old enough and lied. Posted: 06 Feb 2019 10:02 AM PST My friend is 15 and so am I. I made it clear to him that I want to work at a specific pharmacy near my house, but his house is also close by so he wants the job as well. The minimum age for the position is 16. I turn 16 before him so I figured I would get the job, but he lied about his age and will have an interview for the job in a few days. I want to call the pharmacy and let them know he lied about his age, but I need to know if it violates any laws regarding privacy or something similar. Additionally, I want to know what would happen as a result and if my friend would get into legal trouble for lying about his age. Thanks in advance, I apologize if this doesn't fit here. Posted: 06 Feb 2019 10:13 AM PST I own and live in a home in a neighborhood in Alabama. The neighboring property to my home is essentially abandoned, no one resides on the property, the house is run down and I've been told by the owner that it has "structural damage". The owner does a very poor job with up keep on the property doing nothing but cutting the grass ~4 times a year. Anyone who lives in the south knows that your yard can get out of control in a week during the summer time. I often times end up cutting the front and adjacent side to me to keep snakes and rats from my property (the lot is ~1.5 acres and I cut about half of that). The neighborhood does not have an HOA (which I sought out a home in neighborhood without an HOA for many reasons) and the neighborhood is outside of the city limits. Obviously this abandoned property is not helping my property value but more concerning is the structural integrity of the home. There are many young kids in the neighborhood always outside and exploring, it may only be a matter of time before they end up in this house and hurt. What options do I have to get this property cleaned up? Should I simply report it to the county and hope it gets condemned? [link] [comments] |
