Is It Legal To Punish Someone For Something Done Outside of School?

    Posted: 27 Feb 2019 06:32 AM PST

One of my friends got punished for cursing on his YouTube channel. The school chucked him into ISS (In School Suspension) for opening up his videos with, "Hey Fuckers!"

This is just a public school and he didn't wear anything referring to the school in his videos. They're taking him away for his classwork for a week because of this.

    Can they legally do this?

Being Falsely Accused of Honor Code Violation at my College - Professor is failing me no matter what I say

    Posted: 27 Feb 2019 09:25 AM PST

    I am located in Maryland.

I can't believe this is happening to me but I'm being accused of stealing a test in my Organic Chemistry Lab course. Yesterday morning I took the exam (everyone including the professor saw me take it). I handed it in with everyone else's. Today the professor said that the exam was not with all of the others and that she is giving me an automatic F in the course for "stealing the exam" - that there's no way it just went missing. She also says if I don't return the exam by noon today she is going to the Dean with an honors violation on top of the failing grade. My hands are completely tied and I do not know what to do. I do not have the exam, therefore I can't even return it. I don't know why she would think I would even want to steal it (after already writing the entire exam!!) as that would result in an automatic 0, anyway. I have a 100% in the course up until now.

She will absolutely not hear my side of the story and says that "facts are facts". Meaning, her side is absolutely what happened and in her entire 8 years of teaching the course there's no way an exam went missing.

I can luckily still drop the course but I have already put in a lot of work and I feel like dropping it would be admitting to guilt. I absolutely cannot get an honor code violation as I plan on going to medical school. I am graduating in May. Is there any course of action I can take or anyone I should talk to? I am completely blindsided and don't know what to do or how to defend myself against this.

UPDATE: HERE IS HER EMAIL BACK TO ME

    email from prof

I have no idea what inconsistencies she's talking about. She's so insane. I really don't know what to do.

A neighbor of mine just got a camera pointing into a childs bedroom

    Posted: 27 Feb 2019 07:43 AM PST

The neighbors are across the road from me and just got a camera that points into my little sisters bedroom. The camera is on a pole that makes it level with the window and I was wondering what I could do about it.

I'm in the UK if that helps at all.

I will provide information if needed

Edit: The neighbors in question were also allegedly flirting with a 14 or 15 year old boy which makes me more suspicious

[UPDATE #2] I think my 12yo daughter is being groomed online (WA State)

    Posted: 27 Feb 2019 01:56 PM PST

Just a brief update because I really don't know very much.

I spoke to a local detective who works only on child exploitation cases. The Canadian authorities have arrested the man who was communicating with my daughter. I just found this out last week.

Other than that, I don't know much else.

My daughter is doing quite well. She has some anger and issues with loneliness, but we are working with her therapist to address both of these. She's not been allowed online since, and only has a flip phone with the data shut off, and she's doing really well.

Neighbor hit me with his car and has been abusive and threatening.

    Posted: 27 Feb 2019 06:18 AM PST

Using a throwaway account for obvious reasons. This is in NY.

Several days ago, my neighbor was leaving his driveway and turned left onto the street that I was driving on. I was heading the opposite direction. A school bus was parked there to his right. Instead of stopping, he swerved onto the incoming lane where I was at. I quickly slammed on the brakes. He had room to steer back into his lane but didn't. He ended up scratching up my car and gashed a tire. While parked, I quickly took out my phone and took a photo clearly showing that he was in my lane and I was right up on the ditch to avoid him coming at me.

I talked to the bus driver afterwards and she thought he tried to hit me on purpose. He had enough room to steer back into his lane.

So what upsets me is that the police wrote up the report only noting the damages to his car. Nothing about the gashed tire or the dent on my car. The cop who was there also told me that he "didn't mean to do it "and he "couldn't see the road lines because of the snow". Clearly he was on my side. Now he wants to sue for damages to his car. The cop never talked to the bus driver either.

What can I do? My main concern here is that the cop did not properly do their job when filing the report. It seems very one sided here. Also did not talk to the bus driver. I told the police department about my concerns and they said there's nothing they can do about it.

Quick backstory is that I've never had a good relationship with this neighbor. He has a history of being verbally abusive and has threatened Me to the point that I had to call the cops on him. He continues to make threats. Not to my face but out in public. I live in a small town and word quickly gets around. Co workers have over heard him talking about wanting to physically hurt me. My other concern moving forward is that he'll continue to do this and his threats will only escalate and I'm afraid what he may do next. Can I get a restraining order? Should I get a lawyer to talk to the cops? Thanks.

URGENT I just found a subpoena emailed to me to appear in court tomorrow. Impossible for me to get there

    Posted: 27 Feb 2019 05:15 AM PST

So I have been served a subpoena to appear in court TOMORROW and I only just saw the subpoena now. The subpoena has been emailed to me and I have just seen it as it is an email account I rarely use. I'll try keep the details of the situation around the subpoena short.

Long story short, me and my friends were away in a different city for a weekend. During the weekend we got into an altercation with another group of people. Pretty much my friends and I were blind sided by a group of ferals and it was followed by a fight. Security guards broke up the fight and the Police arrived shortly after.

The other group ( outnumbering us at least 2-1 ) left 2 of my friends in particular in a bad way and even stole a phone. The police, having taken statements from both sides that night and investigating the CCTV footage, asked if we wanted to press charges. Initially we didn't, we just wanted the phone back. 2 of us were a little knocked about but we weren't all that phased by the incident.

The police insisted we press charges and we obliged. The two that were most injured ( bruised ribs and cuts on face and lips ) were asked specifically to come back to the station and make statements. The two that made statements ended up pressing charges ( as insisted by the officer ).

I also made a short statement at the scene of the incident giving my email and mobile if they needed to contact me. In my drunken state I gave them an email that I rarely check and that is where the subpoena showed up. It was mailed about a week ago. The court it says I must attend is too far away to get to tomorrow.

    I'm in Australia btw

    What are my options?

Entire company blacklisted from restaurant delivery

    Posted: 27 Feb 2019 09:28 AM PST

This is not a huge matter, but it has sparked a lot of conversation at work and everyone is curious at how legit this is.

About 6 months ago a pizzeria blacklisted our entire 350+ employee company from ordering from their restaurant for delivery. This was following a single new employee having an issue with the restaurant overcharging him and refusing to refund. He gave them a negative review on Yelp and the owner called him and threatened him to take it down, asking where he lived, etc. Classic hothead crazy restaurant owner stuff.

After that not a single person calling for delivery to our company receives service. The person taking the orders says the manager won't let them place an order for our location anymore. Further, if you've ever ordered to our location and you call for delivery elsewhere you are also blacklisted. In other words, when they pull your phone number up for the order, if you have our workplace address in the system you are part of the blacklist.

I know that restaurant owners have certain powers to refuse service, but this seems so arbitrary and broad that it is totally insane. I mean, the restaurant is really punishing themselves because they are losing a significant chunk of business- many of our employees order here on Fridays religiously for decades. Also, there is no recourse i would actually want to pursue, because who wants to force a restaurant to make your food. Wouldn't trust the quality.

I'm more interested in what this means and if they even have a right to do something so arbitrary. Thanks!

My brother brought a gun to school (Montana)

    Posted: 26 Feb 2019 03:11 PM PST

Like the title says, he brought a pistol to school; from what I've been told, it was on a dare, and he was showing kids after school it was in his backpack.

He's 16. He's not a violent person. Literally not a teacher or person dislikes him. I'm scared he's completely ruined his life because he's naive and was being so so so stupid. The only thing he has against him, character wise, is that he doesn't finish homework a lot, and has been getting tested for ADHD after depression therapy/meds weren't working for him.

I know this is a serious situation, and should treated as such. I'm scared, and so is my family; all I know is what my dad has texted right as I started my shift about 30 minutes ago.

    How absolutely screwed is he?

Websites stealing my picture from Reddit.. is this legal?

    Posted: 27 Feb 2019 07:37 AM PST

Awhile back I posted this picture of my grandparents on r/OldSchoolCool. Since then, I have seen the picture used on several different sites, such as Chive. I truly do not plan on taking any action simply because I don't really care that it was used, but some people have told me I should do something about it. I recently had a person from a small company message me to ask if they could use the picture on their business' instagram, and it made me think about all the others that never asked. I am genuinely just curious to know, is it legal for them to use my picture without permission/giving credit? Or is it allowed because I posted it on a public forum??

[NE] What are my rights if someone wants to adopt me?

    Posted: 27 Feb 2019 06:31 AM PST

I have technically been in foster care since I was six due to deaths in my family and my father's parental rights being terminated. I used to want some random family to adopt me, but now I don't want to leave my older sister who has taken me in to live with her. She's the only family I have left. Am I allowed to just say no if anyone inquires about adopting me from foster care?

By the way, I have said that to a social worker and she just said it's in my best interest to be adopted because my sister is an atheist and a lesbian.

Former Landlord Tried to Cash a Check 7 Months Later (MA)

    Posted: 27 Feb 2019 06:23 AM PST

Hi, I am 90 percent sure I am in the right on an issue regarding renting and check fraud in Massachusetts but any input would help.

I had a work opportunity in the summer of 2018 and ending up staying in MA for 4 months. It was an older building and management company only took checks but it was very close to my work and fairly affordable.

At move in I paid for my first and last and a security deposit via check and kept receipts. I paid regularly and in full for all other months. They were rarely in their office so I used a dropbox for my payments. In July they told me they had not received the check I had dropped off. They were under renovations so I wrote a new check and everything went through like normal.

I should have canceled the check I know, I honestly forgot. I moved into a new place September and I thought everything had been paid for and settled. They were upset that a rug had been slightly damaged but it fell under reasonable wear and tear and I received my security deposit back after they did not provide me with an itemized list of issues that were not reasonable wear and tear in timely fashion.

Then this morning I checked my bank account and I had been charged $700 via check. The check had been cashed on 2/26/19 and on the back they had written on the back that it was for a security deposit. The check itself was my "lost" check that had been made out on 7/24/18 and I had written out that it was for rent.

I called my bank and between the discrepancy as to what it was for, the date it had been written, and the oddness of the situation they expedited the issue and I should have the money back in my account within 2 days. Now my question is, am I good? Do I have any I's to dot or T's to cross? I would rather not talk to the people who tried to steal from me and I don't think I am in the wrong. I also don't want to spend time in court if I can avoid it, I am no longer living close by and it would likely not be worth it.

TLDR: Old Landlord tried to cash a check 7 months later and after all accounts had been settled. Do I need to do anything else if the money is going back into my account?

Downstairs neighbors have been upset as us for excessive noise, called the police last night over using the dryer late at night. Can we get evicted or sued over our behavior ?

    Posted: 27 Feb 2019 01:16 AM PST

I'm going to try to lay things out as objectively as possible, without bias. Here is what has happened since we moved in to our second floor apartment in a 3 story multi-family home that is almost 100 years old (state of MA).

    1. My roomate was contacted via text message in September about excessive noise. We had friends staying over that night, and we came home late. We opened up our futon which created noise that disturbed them. We have since then made sure to refrain from making excessive noise when opening up the futon or when having friends over.
    2. My roomate wrote a letter in October over being disturbed at late hours (2-4AM) from neighbor and significant other for having loud sex. They have since then made efforts to reduce the noise, problem resolved. (EDIT: Please note this was a complaint from our apartment to theirs).
    3. This past weekend a letter was written to our household about excessive noise from vacuuming at 8:30 AM and walking too loudly - "stomping" to use their verbiage. There was an overall tone of anger in this letter - it states that we are negatively impacting their health - and they contacted the landlord about us. The letter was typed up and then signed by pen. They made no efforts to contact us in any way first before going to the landlord (not via text, calling us, ringing the doorbell, and no written letters) about walking too loudly at hours that disturbed them (8am, pm, and 1am). We were not aware there were any ongoing issues until angry letter was posted on our door.
    4. Last night they called the police for use of the dryer close to midnight. they did not try to ring our doorbell or text anyone in our household about it. They went straight to the police who then rang the doorbell and asked us to turn the dryer off. Additionally they posted the city noise ordinance laws on the dryer for us to find when we went back to the laundry room to shut the dryer off.

We would think that it would be reasonable for them to contact us first before contacting the landlord or the police over excessive noise. There is no way for us to reduce the noise if we aren't made aware of the noise to begin with.

They seem to be collecting written & documented evidence (signed note, police report) about our noise. There's one of several possibilities for doing this: (key word in note was that we are "negatively impacting their health".

    1. They want to sue us
    2. They want to get us evicted or make us ineligible to resign our lease
    3. They want to be able to break their lease so they can move out

What should I do? If there's a better subreddit for this please let me know!

EDIT; Spoke with landlord, and had a very productive conversation. They mentioned that while they were on the property to do work last week, the neighbor mentioned they were getting upset with increased noise from our foot traffic. Landlord kindly suggested they "lightly" and "kindly" ask us to reduce noise especially since there has been no prior communication about the loud walking or general loss of sleep from our day to day behavior. Landlord was not thrilled to hear that neighbor took the angry letter route. Furthermore was not thrilled to hear they called the police on us . Landlord stated that they have never had issues with noise complaints in the past over walking too loudly or with the laundry- and that they don't expect us to refrain from using laundry at restrained hours given that it's in the basement and does not shake or make unreasonable noise. Overall landlord felt as if neighbors have been unreasonable, especially since requests from neighbors to landlord about maintenance issues have been aggressive/rude/unreasonable in expectation. Landlord said I have nothing to worry about and that moving forward we will try to find common ground to make the neighbor happy but also not make us feel like we have to change our behavior too dramatically.

Will keep everyone updated if any further trouble arises from neighbors.

    Chase ATM didn't dispense money

    Posted: 27 Feb 2019 10:16 AM PST

I am in New Jersey. We tried to withdrawal money, which we do every month, from a Chase ATM. The ATM didn't dispense it and spit out a message saying "We aren't able to give cash right now" gave a phone number and error code 90002 which states online it is an ATM issues. Our bank overseas said they successfully sent the money and to contact the bank of the atm you withdrew from. The receipt also says it was successfully withdrawn. Chase said there is nothing they can do and hung up on me 3 times advising me to call our home institution. What to do?

Stalker believes I belong to him, and is threatening to kill my family. His arrest only made him more aggressive. Please help us.

    Posted: 27 Feb 2019 02:08 PM PST

It's hard to make this coherent and safe for me, but I'll try my best. I am in desperate need of advice and guidance, so I really hope people can offer some insights. I have to be really careful not to tip this person off, so please just ask questions if I come across as too vague. This is the United States, PNW.

I am a stalking victim of a very mentally sick person. I met them 18 years ago, in a sort of teaching situation, and had minimal contact with them within the program. They were not sick at that time, just a regular student. I was close in age to the students, so I was very adamant about boundaries, to maintain professionalism. Thus, I didn't hear from them for 13 years.

Then, five years ago, the student reached out, but in an alarming way. I tried to be polite, but they frightened me, so I asked them not to contact me again. I wasn't ever close to this student, so I didn't know why they were even reaching out.

For three years, this person became increasingly aggressive, threatening, and stalkerish. Declared me as his property, that he was going to rescue me, and that I had to return to him. If I didn't, he would kill me. I reported him, but the Police were not very helpful with my reports.

He couldn't find me in person, so he reached out over various electronic and phone methods, always finding different ways to contact me. I stopped using social media, I stopped going out as much, stopped answering my phone, and yet it kept escalating. Eventually, I had enough, and petitioned my rights with the law. I had mountains of evidence, to the point where multiple judges stated outright shock and alarm. He was arrested, charged, jailed for several months, and an official protective order was issued. He refused mental health evaluation and help. He was arrested a couple times again for minor violations of the order, but nothing serious enough for jail time.

Well, he's been out for a couple years, and, over the past few months, has begun obsessing over me again. While he isn't contacting me directly, he is posting about me over numerous social media and online platforms. My name, my picture, lots of defaming lies about our 'relationship'. However, the most concerning thing is, his death threats have become much more pronounced, violent, and frequent. He's stated that he is going to kill everyone around me, talks about killing my siblings, about killing my neighbors. How he's going to kill members of the church I use to attend. Anyone who talks to me. He despises me and wants me to suffer, and then return to him.

Here's the rub: I've called various resources for advice on what to do, and, to them, it's pretty cut and dry: his current behavior violates the protective order and he'll be arrested. But then what? So he is out again in a few months, even more angry at me and agitated? He 100% blames me for his original arrest/jailing. He sees no connection between his behavior and death threats and why he was jailed. He is very mentally sick, and he even testified that I bribed the judge and police and have them under my control. So, if I have him charged for violating the order on me, I am fairly confident he will try to kill me upon release. Or my family.

I have been considering approaching the situation on the side of the mass death threats, and less with the focus of me. For one, he thinks I am a part of a specific religion, so I am worried he will try to harm its members (he was written that he will). From what I've seen on 'true threat' legal doctrine, his writings warrant that label. He is convinced my family is part of this religion too, so he's described my family members from that point, and part of the reason for why they deserve to die.

With those aspects, could this be a sort of case that the FBI could handle? Is there any way to approach this general threat to multiple people, without making me the face of the case? I desperately wish to avoid returning to court, as I am certain that it would only reinforce his behavior--i.e., threaten to kill people, get to see me.

What can I do? How can I make this about his threats, and less about my protection order? Please help me, I am scared for myself and for my family.

Ex wife wants to move with my son about 200 miles away

    Posted: 27 Feb 2019 07:06 AM PST

As the title says my ex just informed me she wants to move with my son back to her hometown which is about 3 hours away from me currently, in the same state (PA).

The backstory here, we got divorced in 2015, in the divorce we were really amicable and laid out a very vague custody agreement, but this agreement did have me as the primary parent. We then proceeded to move back in together for a little bit, she left again, we continued to share custody about 50/50 and lived in the same town until this past fall when he started kindergarten.

I have moved on, am engaged to a different woman, we have a very stable life, she has a son that is 4, my son is 5, and I now live about 30 miles away from my ex, but my son attends school where my ex lives, so she has him Monday evening through Friday morning, I have him for the entire weekend, and sometimes I keep him on a weeknight here and there. This is not in writing legally at all, we just work everything out between us and it has gone really well.

Move to now, she is finishing grad school and looking for work and has told me she wants to move back to where her family is from which takes my son almost 200 miles across the state. I am not ok with this. The area is really rural, the schools are bad, she is single, doesn't know how long she will live there, and I know my relationship with my son will be drastically altered because I just will not be able to see him as much, and I know as he gets older and gets friends he won't want to come to my house as much. Her arguments are that he will have her family near by to help, she will be on a teachers schedule so a little better for time with him, and she'll give me weekends, holidays, summers.

If he is with me, I'm not moving anywhere so he won't be changing schools frequently, I'm in a more urban area with better schools and opportunities, we have a nice home with a real family life that he will live with, its familiar to him. My work schedule is a little more rigorous than hers but I will make it work. She has no recorded income for years, where we have good stable jobs and can provide whatever he needs.

So what do I do? What legal options do I have to prevent him from moving that far even though it isn't across state lines? Does the fact that he's been with her for this school year really screw my chances?

[OR] My mom is looking for an adoptive family for my brother. Is this legal?

    Posted: 27 Feb 2019 12:54 PM PST

I'm 19M. My father is deceased. I have three siblings (7M, 8F, 11M) who live at home with my mom. I do not live with them. I have my own apartment & income and live ~15 min away. I don't have any say in what goes on there.

My mom doesn't like my 11 year old brother at all, and she has made a lot of threats and gestures to either give him up for adoption or trade him for a sweet girl. Our mom is very prone to tantrums where she screams obscenities and just says whatever hateful things come to her mind. I called CPS on her six times when I was in high school, and they didn't do anything about what was clearly abuse by an insane freak.

My brother isn't even that bad. He has a gross sense of humor with things like poop and genitals, but don't we all sometimes? When I'm babysitting, he's never a problem for me. When we were younger, our mom got mad at him for being a kid, doing things like trying to play her piano and paint, and she let her emotions get out of control. My other siblings don't like to explore and try new things is my non professional diagnosis of why she prefers them. They'll just be angels and do exactly what she says.

My mom has been asking on Facebook and online boards for infant adoption if anyone wants an 11 year old or will trade a girl of similar age for him. I'm not seeing anything in her posts like "lol" that implies she's joking. She just complains about him in the comments but doesn't retract her statement. Her friends who give parenting advice are ignored. Some of her friends encourage her trading him for a girl, also without saying "jk" or anything of the sort.

I don't think CPS will care. She's said and done way worse. She told me a bunch of times she would put me for adoption when I was young and never did. But I at least want assurance that she can't legally throw him out on the street. Legally, is there any way I can help my brother? I really can't help but side with him 100% after seeing both sides of the story.

[FLORIDA] Servers working untipped hours for $5

    Posted: 27 Feb 2019 05:29 AM PST

I work a serving job at a small 4-location chain Chinese place. The system for tracking hours only ever records $5.20 an hour for servers, which is the untipped minimum wage. However, the management calls us in for many mandatory meetings outside of shift and operation hours, many of which are on days we do not work and thus could not possibly receive any tips. (It's routine to have to come in for a meeting from 10:30PM-midnight, despite working no other hours that day). Furthermore, we will occassionally be held for 1-2 hours after restaurant closing to unload large shipments from trucks. Obviously no tips are possible here; it's obvious to us that management is taking advantage of the cheapest labor force they have.

Management has never paid out to the full untipped minimum wage for any of these hours; servers always make $5.20 regardless of the tips we could or could not have made. I'm dead certain if I complained directly I'd be fired, and I know I need a new job, but I really want to secure the few hundred dollars in back pay that this place owes a lot of young people.

Thank you! Any help is appreciated.

    Worried about my landlord

    Posted: 27 Feb 2019 10:09 AM PST

So about a year and a half I moved with my step-sister into your standard, shoddy first apartment in IL. It is a hundred year old building with four units. A couple months after we moved in, the only other occupied unit in the building became unoccupied.

We were fully aware and open to not a not 100% comfortable living situation, but our landlord didn't really do anything at all. A while back the pipe in the unit above ours burst, causing a bad leak. Our bathroom wall became water damaged, and our landlord said he would send someone to fix it. He never did.

After a while the wall became so bad there was mold, which is a health concern not only for us, but for our animals. We happened to have an opportunity to rent a townhome at a great price, so we sent our landlord our intent to move out within a couple months. This was the beginning of January.

For two weeks I attempted to get ahold of him in several different ways to no avail, and finally got him to respond after contacting the property management company. He told us we would have to continue paying rent until someone else moved in, or our lease was up. I told him I would understand that under normal circumstances, but this wasn't normal. The three other units in the building had been open for a year without moving in, no one would move into ours, especially with the damage, and we could not afford to pay two sets of rent. So he said we could give a 30 day notice and forfeit our security deposit, to which I agreed. He also said he would send someone in a week or two to fix the wall.

Well, no one ever did come to fix the wall, and we began move out prep. I contacted our landlord again and asked if he needed any other written confirmation from us regarding our moving out. He didn't respond again. Finally, I reached out one last time and said that if I received no communication I would assume he had everything he needed, and I cancelled our utilities. We cleaned the place up and got settled in our new one.

Despite no communication from our landlord, our property management site still states we have a payment in March. We do not intend to pay it as we payed January and February and gave up our deposit. Despite lack of communication from our landlord, I am nervous that he is going to find a way to come after us. Maybe because we are two young girls he thinks we won't be difficult to get money from, I don't know, but we can't afford it and we did everything we could. I just want to know if, considering the circumstances, there is anyway we could still get into legal trouble. The place was a health hazard, and we did our best with our landlord, but I want to make sure that he has no way that he can go after us. Thank you so much in advance! This has been a long one, I know.

Job refused to allow me to go seek medical attention until I signed a negative performance review.

    Posted: 26 Feb 2019 07:07 PM PST

Have to be a bit vague. A few months ago I was being targeted by some co-workers, who were spreading rumours. I was not part of the "cool kids group". They did things such as booking the Christmas party in a non-accessible building and not telling me until I arrived there. I'm in a wheelchair.

One day I was accidentally injured on the job by a young client. Someone without my disability would have been knocked to the floor. I ended up with an injured neck and shoulder. When admin was told of my injury, their response was "We have cameras in the hall. We'll go check."

I told them my ride had arrived and I needed to go seek medical attention. They said I had to sign 2 performance reviews before I was allowed to leave. I said I really didn't feel well enough and needed to go. They insisted it had to be done right then. I have only the vaguest recollection what was on them, other than the fact I felt it was very unfair, and very much a case of trying to make me look bad. I ended up signing it because I was in severe pain. I did not receive a copy.

I went to the Dr and have documentation from them of being diagnosed with a severe neck and shoulder sprain.

These performance reviews were sent to the professional accreditation board, and I am having trouble finding another job. They fired me "without cause" a week later. I can't argue the dismissal (and don't want to), they did follow the letter of my contract.

I am in Alberta, but I was working on a First Nations reserve so the rules may be different. I am white. I want to know if I have anyway to force them to retract them, considering I would not have signed them if they hadn't been refusing to let me leave for medical care.

[TX] Sued friend in small claims court, no response. How to get default judgement?

    Posted: 27 Feb 2019 09:53 AM PST

I sued an ex friend in small claims court for $3500 plus filing fees. She was served in person on January 31, 2019. She did not submit a response to the suit. It is my understanding that if she does not contest the suit in two weeks then I write a letter to the court to request a default judgement. Is this correct? This is in Bexar county JP1.

[NJ] Gym is closing and won’t let me cancel my membership

    Posted: 27 Feb 2019 12:47 PM PST

I found out a week or two ago that the gym I just joined is closing at the end of the month. I signed up for a 1 year membership in November. The gym is less than 5 minutes from my house and is open 24 hours which made it very appealing to me. They posted a sign around the gym saying that effective March 1st all memberships will be transferred to a gym in a town over 30 minutes away from that location.

I spoke to someone there about wanting to cancel my membership because the other gym is not convenient for me. They told me my options are to either buyout my contract or keep paying monthly and have my membership transfer to this other gym location. Can they do this? I would have never committed to a 1 year contract if I knew they would be shutting down and shipping my membership elsewhere. Do I have any recourse here?

Got a bill from a hotel that said I stayed there but I didnt. Its too late to dispute. What can I do?

    Posted: 27 Feb 2019 01:14 PM PST

Hey guys, long story here but I appreciate any help.

So first off, I am in the Army Reserves in Arkansas and in mid October 2018, the Army sent me to a week long class. My unit has full time administrators(UA) and they are the people that arrange my orders, how I will get to class, and where I will stay. Also, I have my own Government Travel Card through Citi and I charge my expenses to that and send my receipts to the Army and they in turn pay back Citi.

At first, one UA, lets say Edgar, had a reservation for me at a Holiday Inn Express. He decided to change that and send me to a different hotel that was closer to my class. However, Edgar didnt cancel my reservation at Holiday Inn and he gave them my Citi card info so they charged me for that stay and for the reservation fee(~$400+$100). Since then Edgar has retired so he is out of the picture.

The Army knows I didnt stay at the Holiday Inn so they wont pay the bill and Citi wont do a dispute because it has been longer then 60 days, thats the law. Now where this gets fishy is that Holiday Inn has a sign sheet saying that I signed in and stayed there in October, but I didnt even know about Holiday Inn until February, when I got the bill from Citi. Because someone stayed there under my name Holiday Inn wont throw away the charges.

What can I do? I have a >$500 bill for a place that I didnt stay at. The fact that Holiday Inn said that someone stayed there and signed for my room but didnt show ID is so weird. I am lawfully illiterate, please help.

Also, I understand that I should have kept an eye out for my Citi charges and my DTS shit but thats 20/20 hindsight. I didnt receive the bill from Citi until February so it was already too late to dispute the charges.
