[Megathread] Yes the Lawyer for the National Enquirer possibly committed extortion in his threats against Jeff Bezos.

    Posted: 07 Feb 2019 07:11 PM PST

...but it's only an allegation based on limited information at this point.

No doubt some of you have read Jeff Bezos' piece published in Medium. In it he documents what may be the attempts by agents of the National Enquirer and its parent company AMI to engage in some light extortion. The emails show that Enquirer/AMI wanted Bezos to cease investigations into the political and lobbying activities of AMI and its president, David Pecker. Keep in mind that the emails presented in the story tell only part of one side of the story.

Allegedly the National Enquirer has compromising photos of Jeff Bezos. They were threatening to publish them if Bezos did not agree to say that investigations of AMI/Pecker/National Enquirer revealed no political bias.

Bezos chose instead to air the correspondence in the above article. We have not seen the responses sent by Jeff Bezos' attorneys nor do we know how many other emails were sent by AMI. Nevertheless, many people are asking "does that constitute blackmail/extortion" - the answer appears to be that yes, there is a colorable argument based on the very limited information available.

Since Mr. Bezos lives in Washington here is the relevant Washington Statute and the relevant jury instructions:

"To convict the defendant of the crime of extortion in the second degree, each of the following three elements of the crime must be proved beyond a reasonable doubt:

    (1) That the defendant knowingly obtained or attempted to obtain property or services of another by a wrongful threat;

In this case the argument would be that the 'service' would be agreeing to state that there was no political basis for the Enquirer's actions. The threat would be publishing the photographs.

    (2) That such threat communicated, directly or indirectly, an intent... (b) to expose a secret or publicize an asserted fact, whether true or false, tending to subject any person to hatred, contempt or ridicule or (c) to reveal any information sought to be concealed by the person threatened or....

Publishing the photos would probably satisfy this element.

    (3) That any of these acts occurred in the State of Washington.

Bezos lives in Washington. There is an argument that this element is satisfied because he resides here and presumably the threats were communicated to him here.

The relevant Florida statute (Where Pecker/AMI/National Enquirer are headquartered) is essentially the same. As is the relevant federal law 18 U.S. Code § 875(d).

Now does this mean anyone will actually be prosecuted? As discussed above this is only part of one side of the story, and based on that limited information such a charge would be possible. There is no way to say with any certainty, however.

Update, my son took the Boba Fett figure.

    Posted: 08 Feb 2019 08:33 AM PST

So, I never honestly expected the post I made to get where it did. I also never expected the barrage of support and hate. I will say these past 48 hours have been a ride and that post has not helped in any way.

So, why am I back? Well, because I feel like I need to be. I'm not here to give some apology to a bunch of internet strangers for how I acted or seek validation. I'm here because I feel that for myself I need to admit my own wrongs and move on to a better place.

So, I want to talk about something first before I get into the update. Many people who responded talked about how me or my brother in a bad light, and with how I reacted in the comments it didn't help the situation. I was also hit pretty hard for how I was not taking my brother into consideration when talking about the issue. To give some context for this, me and my brother have never had a good relationship. We have never seen eye to eye and after our fathers death he cut contact with me for a good amount of time. We're just to different in some senses. He's a single nerdy guy who has no aspiration for family while i'm the exact opposite. In these past few years we've tried to fix this. Work as adults to bring what little family we have back together. During our time apart he began collecting old nerdy things, and I wont lie I never understood the appeal. It is his life though and he can do what he wants.

So, when my son stole and damaged his property I didn't see how it was valuable to him and discounted it. So when he asked for 2,000 to fix it I really didn't feel like it was worth it. Was this wrong of me? Maybe. I don't feel bad about defending my son, I only feel bad that I discounted my brother in the process.

Sorry about that. Like I said, I don't want sympathy. I only wrote that out to allow myself to be true about the situation. back to the update.

So, after all was said and done, my family had pretty much been thrown into chaos. I had no idea what I was going to do and after talking with my wife, we decided we would take many of your advice and have my son pay him back. We collected all the non-essentials he had and planned to sell them to raise funds. During this time I got back into contact with my brother and wanted to talk this out to make sure this did not end badly. I offered to pay in full.

(Also, some people in the comments said that the figure was worth less so I asked him. He had it professionally valued a few months ago when he bought it and it's was worth a total of 2,200$.)

My brother said he plans to not sue us. His renters insurance apparently is willing to pay him the value he has listed, but he would need to file a police report to get it. At first we agreed not to go that route and simply pay him the value of it or one for a replacement if he could get it cheaper. This was the plan until last night.

During the process of taking his things away, my wife found a conversation he had with a friend he has over the internet. It turns out my son stole the figure to sell. He had googled it while we were at my brothers house and found out how much it was worth and bragged to a friend that he was going to sell it at a pawn shop. He didn't realize that taking it out of the package would ruin it so he ripped it out to hid in the car better.

Suffice to say, I am not happy about this. I won't elaborate on this very much more but me and my wife have decided that what is best for all of us is that we let him face the consequences of this. My brother is going to file a police report and collect money from insurance. Some may say this is a bit harsh, but honestly I think this might be for the best in the end. The way my son actively stole from family to make a profit worries me and I believe the only option that I can live with myself making is this. I will stand by my son till the need, but he needs to learn now before he is an adult.

So, thank you all for the advice. The support and hate are what I needed as a true wake up call. Like I said, I don't need pity. I'm doing this so that I can be true to myself, and maybe become a better parent in the end.

My sister (NE) had security deposit given back to her. She did not cash the check quickly, and the landlord put a stop payment on it. The landlord is threatening to pursue 2k+ in damages if my sister attempts to get her deposit.

    Posted: 08 Feb 2019 05:12 AM PST

I've just been informed of this and I have copies of the correspondence between my sister and her previous landlord.

Some dates, early July my sister moved out because of her landlord requesting she leave so a new tenant could move in. She did not get a refund for the rent she had paid for July. She received a check for her security deposit in full, but forgot to cash it. The first attempt to cash it was last month, and was met with a stop payment.

The landlord was sent a letter of demand, and the landlord replied with a letter in kind accusing my sister of damages. This letter was dated approximately 200 days after the writing of the check. The check cashing was attempted within 180 days of its writing.

The damages listed (most are laughable, in my not a lawyer eyes, but give me some insight please).

    1. Plumber Charges for a leaky faucet/toilet tank. (Is this not the landlords responsibility to repair anyways?)
    2. Excessive water use due to the leaking toilet seal. (Landlord paid utilities, but again, it's the landlords responsibility to maintain the unit, correct?)
    3. Rent and utilities for unauthorized person. (My sister had guests over, they did not live there, but were there often.)
    4. Plumbing charges for main sewer line. (Claiming my sister flushed sanitary products causing damage. However, in the attached letter her statement is "I believe this is your fault", and does not assert any proof. There are multiple units and anyone could have done this. I've lived with my sister before and she does not do this.)

So my issues are mostly that:

    1. Can the landlord fail to inform the previous tenant of "damages" to the property over 200 days after the tenant has moved?
    2. Aren't the seals/utilities the landlords responsibility anyways if that's how it is outlined in the lease agreement?
    3. Can she charge my sister for having "unauthorized guests"?

Sister is in Nebraska, thanks in advance guys!

My neighbor called the cops on me for shots fired. But there's more. . . .

    Posted: 08 Feb 2019 09:51 AM PST

I have been hearing a pounding sound in my apartment for about a month. I can't tell where it's coming from but it wakes me up from a dead sleep. I haven't had a full night sleep since the beginning of the year because of this. I searched the neighborhood thinking it might be a construction site, made a formal complaint to the city, and left a note for my landlord. No one could help me. It's like I was hearing things.

One night I was going to bed and the sound reemerged. Losing my sanity I banged as hard as I could on the wall and floor and shouted, "what is that fucking sound!?" About 3 minutes later I was being held at gun point by the police in my boxers completely in shock. Turns out my neighbor called shots fired on me. Once they searched my house and realized I had not weapons and couldn't possibly fire a gun that didn't exist, they asked me what was going on. I told them what I told you and they took me, in handcuffs, to the psych ward for evaluation. After about 7 hours of giving blood, urine and convincing a psychologist that I am not a threat to society they released me.

When I got home the sound was in full force. Now that I am thinking I am crazy and hearing things I decide to gather as much evidence as possible before making accusations. Last night the noise was so loud that I could tell it was coming from the neighbor who called the cops on me. Now I think she might have done it on purpose to retaliate against me.

My question, am I overreacting or do I have a legit grievance that needs to be addressed? What are my options?

    Edit: Denver, CO

Edit2: The responses so far have basically reaffirmed what I was dreading. I am going to have my sister come over and listen for the sound. If she tells me she can't hear it while I can, I'm going in for counseling. Here's hoping she hears it!

Edit3: Thanks to everyone who is helping me figure this out! Pretty much everyone is on the same boat right now so I won't be responding much. This weekend my sister and my best buddy are going to stay with me and see if they hear it. I'll let you guys know how it goes. Sorry r/legaladvice! This turned into more of a psychological thing but I hope to return with an update on if anything comes of this legally for sure. I secretly am hoping that my neighbor is running a meth ring and my super hearing saved the day but we shall see.

Yesterday, my cat was taken to the vet for dental surgery, my mother paid $413 and did not receive a receipt or even post-operation information. A few hours after taking him home, he had passed away from what is looking like a morphine overdose. Do we have grounds to sue? (Nova Scotia)

    Posted: 08 Feb 2019 05:27 AM PST

    Summary:

    • Cat was taken to the vet for dental surgery to prevent future cases of his stomatitis as recommended by the vet, was not an emergency visit and was planned well in advance.

    • Cat was completely healthy and fine the day before the surgery. Only 8 years old.

    • Cat gets the surgery, Mother pays about $413 and was given no receipt or any post-op information

    • Cat was very drowzy and dopey when he got home, health rapidly declined and he died within a couple hours.

    • A separate emergency vet, while not completely sure, is thinking it may have been a morphine overdose.

    • If we want a full autopsy we need to go back to the previous vet since he's their "patient", and I'm worried they won't give a straight answer.

With what we have now, would we have any grounds to sue them?

UPDATE: My mother ended up contacting the original vet and telling them the situation, and the result was that they offered to give my cat a private cremation with no expense to her as accommodation. I'm not the happiest with the result, but I do believe it's what my mother is happiest with. That's why I'm choosing not to push the issue further as of now. Thank you for the legal advice, personal experiences, and general kind words. I can't express how much I appreciate it.

My dog was killed by poisoned pet food listed in a recent recall. Legal recourse?

    Posted: 08 Feb 2019 06:29 AM PST

I have no idea the steps to take here but I am devastated and angry beyond words, and I am feeling very lost. I never in a million years thought something like this would happen to me. I am hoping someone can point me in the right direction. You have no idea how much that would mean to me.

In October, my dog got inexplicably ill. She was diagnosed with acute kidney failure, and I spent thousands in medical bills, took time off of work and school, and ended up losing my dog in early December. My vet was stumped. I just found out the food she had been eating was recalled for containing toxic levels of vitamin D. She was eating Hills prescription wet food, and many other people are coming forward with the same story. Acute kidney failure, then death. The timeline fits, the symptoms fit, and I want Hill's to take responsibility for this. I have gone over her blood results both with my veterinarian and a registered dietitian with a doctorate degree and they both agree that vitamin D toxicity fits. I understand the blood results and interactions well myself as I have a degree in nutrition.

I reached out to Hill's multiple times via social media and phone. I have left my contact information for them and have still heard nothing. Should I tell them my story? Someone close to me advised me not to share anything with them, as they could use information against me down the road. I don't know where to go from here, but I am not letting this go. She suffered greatly over this. Please help me.

Edit: I'm not sure if it matters, but I live in Colorado. I also did not save the cans of food, but I have proof of purchase.

Uber Driver has faked an image claiming I threw up in the vehicle

    Posted: 08 Feb 2019 03:32 AM PST

I recently took an Uber ride back the other night (early morning). It was all fine and the 3 people I was with all got out fine and nothing else was said.

When I checked my account in the morning, there was an additional £110 charge to the fare. I contacted Uber support and they have claimed that our party made a mess in the vehicle. The driver had sent photos of what looked like sick in one of the passenger seats. No one we were with was sick nor would we have gotten into a vehicle which had such a mess. Uber support forwarded the concern to 'their specialised unit' but they have given me a blanket statement saying it had been investigated and they still believe we were the ones responsible.

I don't know what to do now and how to continue as they have literally just stolen £110 off of me. Any advice would be appreciated.

    Location: London, UK.

The couple raising my biological son is threatening legal action if I don't give them hundreds of dollars

    Posted: 07 Feb 2019 05:48 PM PST

A little over 2 years ago I had a one night stand with a girl that resulted in her getting pregnant. Far before anyone found that out, she revealed to me the morning after that she had slept with me to make her boyfriend jealous. Apparently they smoothed things out by the time she got a pregnancy test because they decided (after discussing with me) to raise the child as their own. We decided that I would have no personal or financial relation to the couple or the child. We also decided to not tell anyone that the child was not the father's biological son. As I had no interest in being involved in the child's life, I had no objections to this agreement.

Fast forward to last night. The girl that I had hardly spoken to since we decided that I was not going to be involved in the child's life messaged me. She demanded that I transfer her several hundred dollars to cover daycare fees or that I had "better clear my schedule to watch [the child] every weekday". I reminded her of our agreement that I would not be a part of their lives. She replied with: "Well I guess we'll see what a judge has to say".

The couple and I have no legal agreement as to our situation and (as far as I'm aware) no one knows that the child is my son. Do they have any legal grounds to demand money from me?

    This is in Canada btw.

[UPDATE] Purchased a condo, seller "rented" it to his nephew the day before contracts were signed. Now what? [NY, Putnam County]

    Posted: 08 Feb 2019 01:32 PM PST

I am gonna make up some names this time around because referring to people as "the female seller" or "the tenant" is cumbersome as hell.

After the mess on Wednesday, I met my realtor for dinner and to grab my closing docs. The seller's agent actually wound up stopping by as well (he arranged this with my guy) . He apologized profusely, told us he knows the family and he's confident we'll be able to get things sorted quickly. I didn't get my hopes up but he picked up our tab and bought a round of drinks while he was there, so hey, when life gives you lemons, make a superhuman amount of whiskey? I don't think that's accurate but it was my approach and I stand by it.

Anyway, I wound up speaking with the seller, Anne, yesterday morning, and got the rundown on the situation. It turns out the unwelcome tenant (Bill) is actually her nephew, not her ex's (Charlie). She was absolutely livid with Bill, and promised me the apartment would be vacant ASAP even if she had to physically drag him out herself and pay for movers to take all of his stuff. She also gave me assurances that she'd cover whatever this ordeal has cost. From there, she said she was going to check in with her sister (Diane) who was dealing with Bill as we spoke, and get back to me as soon as she knows something, but again promised that the absolute worst case scenario would be Bill starting to move out by early afternoon.

Maybe half an hour later she calls back and tells me that Diane had rented a truck and Bill was in the process of packing his stuff up. Turns out Bill had recently experienced something pretty fucking awful, and as a result had sort of become preoccupied with seeking approval from adult males. Charlie was at the top of this list; apparently his midlife crisis consisted of buying a Harley and trying to carry himself like a badass, and Bill bought the act hook, like and sinker. And a lot of you guys assumed correctly - Bill cooked up the scheme to basically extort me for a cash for keys deal. From what I was told, Charlie figured a doctor from NYC would just pay out right away to be done with it. For what it's worth, I am not an MD, nor am I from NYC... but you do you, Chuck. Anyway, at this point, Anne threw me a curveball. She and Diane were both at peace with the fact that I was going to pursue this with the police, but asked if I could meet Bill so he could look me in the eye to apologize because she wanted him get an understanding of the fact that his actions hurt a real, live human being. I agreed to it - I was hoping to see if I could get in to check the condition of the place anyway.

So yesterday evening I went up to the apartment and met "my tenant" as he was loading up the truck with his stuff. We wound up speaking for a while and... well, I am gonna disappoint some of you here. He seems like a genuinely good kid who got taken advantage of by a legitimate piece of garbage... there were a lot of tears, and innumerable apologies, and I 100% believe that these were based on genuine remorse for what he did, not regret about getting caught. I'll just say it here because I don't think I was being as slick as I'd hoped in dancing around it anyway, but the kid recently lost his father, and I don't see any reason to fuck up his life with a criminal record over a (ridiculously, incredibly) stupid mistake that he was to a great extent manipulated into making anyway. For whatever it's worth, if getting involved in a stupid scam like this was the worst thing that I did at nineteen... yeah let's just say that I was a remarkably stupid and reckless kid. I lucked out and never wound up getting caught in a situation that could have had significant legal consequences, but if I had and I hadn't been given a second chance, I'd be living a very different life right now.

As far as the money goes, Anne and I are going to figure out what's what, and I don't want to explain how because it involves details about her personal life, but the money will technically be coming out of Charlie's pocket anyway. She started by hiring some movers to unload my truck, which is taking place as I type this. Bill left the apartment in shockingly good condition, but I am basing that on what sort of damage nineteen year old me would have passively done to an apartment, so this may be a touch skewed haha. Either way, no damage has been done aside from some very minor cosmetic stuff (a couple of light scuffs from moving furniture and things like that), all of which would become immaterial when I redo the apartment in anticipation of renting it out, so I am not going to concern myself with any of that stuff.

As far as Charlie goes... well, I mentioned in a few comments that My Attorney (who is too majestically vicious for fake names so he just becomes capital-M-My capital-A-Attorney) is a super intense older guy and later found out is a "retired" civil litigator who can't sit still long enough to actually retire. Yeah he's out for fucking blood. Turns out Charlie does have himself some assets, and My Attorney is pretty confident that they will become my assets soon enough. I had a brief chat with one of the officers who came by on Wednesday (he's a friend of Diane's, apparently - this everyone knows everyone thing is still very foreign to me), and will be going by the station to issue a statement/file a report/whatever it is you do in this situation. Some of you expressed concerns that he may have fled the country, but the concept of Charlie leaving the county, let alone United States, is very funny to Anne, Diane and Officer Friend-of-Diane. Seems like Charlie is just a dumbshit who thought he could pull a fast one, and will be easy enough to find at one of the local watering holes when it's time for him to be picked up. I absolutely do not believe in throwing around assumptive diagnoses for fun, but I've made an exception in this case and decided that Charlie has full bore antisocial personality disorder because it makes me feel better about things for some reason.

Anyway I have been typing this piecemeal throughout the afternoon which has essentially been a test of my wife's patience. I'm not dumb enough to incur the wrath of a tiny Puerto Rican woman who has spent the last couple of days stressed out of her mind, so I'm gonna call this a post. Thanks again to everyone on this sub for all of the advice given and sympathies expressed, I'm lucky as hell to have had this end the way it did.

PS: If a mod could let me know how to report some accounts that PMed me to advertise their law firms, that would be wonderful. Pro-tip to lawyers: advertising via Reddit PM does not inspire confidence in your legal acumen.

Got in trouble for indirectly giving someone a panic attack because a schoolmate of mine showed her gory images.

    Posted: 08 Feb 2019 05:27 AM PST

This was a while ago back when I didn't know r/legaladvice was a thing. I'm just looking for some advice just in case it pops up again.

I'm 15, 16 in a few months and still in highschool. I currently reside in Scotland, UK.

A while back, say 1 to 2 months ago, I started to get active in Reddit after 8 months of having it. Out of all the subreddits I discovered one that really caught my attention called r/enoughinternet, at the time I didn't think much of it although the pictures being disturbing and extremely gory I thought it was fine because 1. It's Reddit 2. It could be accessed by anyone easily 3. I didn't save any pictures on my own device.

So during one of my lunches which I had outside of school property with a few classmates I decided to show one of my classmates a few gory imgaes after I asked for his consent he too found in interesting and decided to get into it. Fastforward a day he had his phone suddenly confiscated from him by our school's "child protection officer" without any information then was called to his office a few hours later, I didn't think much of it.

Then at the end of the day as the final bell rang I got called by him to go to his office for a talk with my guidance teacher and him. After being told to put my phone on the table he vaguely told me what happened earlier on today. (I found out later on that my classmate had shown a "goth" girl the images from that subreddit in school and she apparently had a panic attack and reported it to a teacher, my classmate then panicked during the interview and used my name.)

So then he asked if I've been looking at this images such as, autopsys, decapitations and other stuff and I answered truthfully. He then went on to saying that I'm lucky when they called the police the one from "that" location picked up because he said it was a mistake and to leave it. And not from "this" location did otherwise he would've arrested me.

What I want to know is, is this true? Did I do anything wrong? The girl who had the panic attack is known to throws bricks at people and talk about suicide, killing her parents, and cutting herself. Did my classmate do anything wrong aswell?

TL;DR - Showed pictures of gore to a classmate outside of school grounds after consent and then he showed them to a girl within school grounds which led to her getting panic attack. He then panicked used my name. Is it illegal to be looking at this pictures even though they're so easily accesible? Could I actually be arreseted for this?

[SC] Lady on Facebook was offering résumé services for $25. She asked for the payment by Zelle, I sent it and she blocked me on Facebook and won’t answer any emails or calls. I have her name and phone number, is there anything I can do?

    Posted: 08 Feb 2019 07:25 AM PST

I know it's only $25 and I'm stupid for falling for this scam but I honestly think she needs to be held accountable for her actions so she can stop scamming others. What (if anything) can I do?

Zelle offers no fraud protection apparently. I'm going to call my bank and explain the situation and see if they are able to help me at all. Thanks!

Fire department broke down my door when I wasn’t home.

    Posted: 08 Feb 2019 05:51 AM PST

So last night, I went to a bar and dinner after work. During this time my phone died. I'd say it was dead for about 1.5 - 2 hours. After dinner I head home only to arrive to a bunch of fire fighters and police outside my door. Apparently my smoke detector was going off and my neighbor called my management company and the police.

My neighbor told me the management company showed up first but didn't bring the master key so they couldn't get in then left. After that the fire department came and broke down the door. Now the management company wants me to pay for the door. This was in Pittsburgh btw and any advice will be appreciated.

My irresponsible dad put me $33,000 in debt

    Posted: 07 Feb 2019 07:57 PM PST

Sorry if the formatting is weird. I'm on mobile. My dad has always been a selfish deadbeat who only thinks of himself but this takes the cake. My dad has, apparently, opened multiple credit card in my name and has run up a tab of $33,110. He's had them in my name for a little over a year, I'm currently 17 and have no idea what to do. My mom isn't much help and doesn't think it's that big of a deal but I'm so scared. I found out because I recieved a letter regarding my credit. I found out he lied about my age and has filed for multiple credit cards. I was planning on going to college, but I'm not sure if I'll be able to file for students loans so I might not be able to futher my education and get the hell out of here. I will go the my local police station and file a report on the next couple of days I have off (12/13). If there is any way to fix this without my dad going to jail, please let me know. I've tried researching it myself but all I've found are horror stories about parents ruining their kids credit. Please, any help would much appreciated.

My landlord rang me he may kick me out because one of my roommates doesn’t like me. What are my options?

    Posted: 08 Feb 2019 06:48 AM PST

Lived in a flat in London for a few months, I just moved here and all my family live in my home country. Since I lived here I have gotten on fairly well with everyone except one guy. Let's call him Simon. For context, the flat has no rules about behavior or noise other to be respectful and polite to other tenants. I pay rent cash in hand and my rental agreement is just something my landlord typed up and printed.

I work late and Simon works early (generally). Any time I come in from work or have a friend over he'll kick off, become threatening and send constant aggressive messages. I don't have house parties or make a lot of noise, but even if I'm just walking around my room or watching Netflix he'll knock my wall with a broom And send me angry messages. At first I tried to be accommodating and I wouldn't even talk on the phone to my mom quietly in my room after work, because he would get so aggressive and stressed out. After a while I got sick of it and stopped caring. I told him if he's willing to respectful I will be willing to comprise but that's not good enough,

Got a call from my landlord saying he's sick of dealing with complaints so one of us will have to go, and since he's been here longer I'd be the one to get kicked out. But that he's going to "Investigate" the situation and get back to me by Monday.

I'm 22 and hAve very little money. Moving into this flat cost me a lot and being kicked out will cause me a lot of issues. I don't know what I can do considering how flimsy my rental agreement is as a document. I've been crying all morning and have no idea what to do or who to go to for advice. I know nothing about rental laws.

Is there anything I can do here? Any advice would be appreciated.

I was suspended from my school due to a joke resumé I turned in for an assignment, and now have “terroristic threats towards the school” on my record

    Posted: 08 Feb 2019 09:30 AM PST

Yesterday I had an assignment to have a fake interview with one of my teachers, and part of that assignment was to turn in a fake resumé. On this resumé under the volunteer work area, I thought it would be funny to add a few things that I never actually did, such as:

-Assassinating the Leader of Communist occupied Russia -Blow up the Death Star -Purge lower class vermin -Save Wakanda from a new evil Reign

I turned this in and when I did, the teacher (actually it was the vice principal) acted completely normal, it wasn't until after the interview was over that they called me back in acting concerned. If also like to add that I turned this resumé in to my teacher about a month ago, and never got any slack for it then.

I understand that the words assassinate and purge were could be considered, but I do not think I should've got the reaction I did.

This took place after lunch yesterday, and I had to wait in the lobby for the rest of the day with exception for every time they called me into the office. I was patted down, my bag was searched, and now an officer will be keeping an eye on me from now on once I go back to school on Monday.

I originally thought their actions were justified, but in another post I made (check my r/TIFU post in my history) someone commented saying my rights were violated. Now I'm not very educated on this sort of thing, so I don't know what rights were violated nor am I now confident that my consequences are justified.

What should I do? Were any of my rights violated? And if so, who do I contact?

    I live in Tennessee btw

Edit: My school is also considered a choice school. You need to have an interview to get in, but is technically a public school as it gets funding from the county. I don't know how much of a difference that makes

Pennsylvania, I have a seizure disorder and a medical bracelet that says I do not need an ambulance for a seizure. Despite this, I was taken to the emergency room after a seizure an I am being charged.

    Posted: 08 Feb 2019 11:21 AM PST

The bracelet mentions my seizure disorder and says "no 911 unless injured". I had a seizure and was taken to the emergency room after my roommates called campus security who called an ambulance. I was taken to the hospital and charged for various things. The hospital told me to call the ambulance service about the dispute, but the hospital is charging me. They keep telling me that they are legally obligated to provide care for a person who is brought in unconscious. I was wondering if I can legally dispute the charges.

Edit 1: thank you all for your help. I suppose there is nothing to do about the charges but negotiate with the hospital. I called to try ask what I can put on my bracelet so that I will not be taken to the hospital. They said that if I am unconscious and an ambulance is called then they must take me no matter what. I suppose there is nothing else I can do but reiterate to my roommates that I do not need an ambulance. Thanks again

Fired after having a stroke (Erie,Pennsylvania)

    Posted: 08 Feb 2019 08:34 AM PST

Hey all, so my significant others brother in-law recently had a pretty serious stoke at home. He has been recovering and attending rehab to regain his motor-function. He has been doing better and should regain all function. However he was recently fired before he was able to return to work. The time between the stroke and being fired was around 50 days. Does he have any recourse for being fired while recovering from a stroke, or is the firing legal. Thanks for any help, and the location again is Erie,Pennsylvania.

I filmed a video at work and it went viral. Now they think they can claim all of the revenue. Is this true?

    Posted: 08 Feb 2019 11:15 AM PST

    I'm in NY.

I looked over the employee handbook and I didn't see anything about filming. I decided to film a cute little day in the life of me at work, and it went viral. My job saw the video and fired me. Now, I understand, I'm at will, they can fire me for anything, yada yada. But they also said since it was filmed on their property, they own the video and all revenue I make off of it.

Clearly this is BS, right? Can I file unemployment as well?

Fired for looking for other jobs? And for...facebook posts?

    Posted: 08 Feb 2019 09:59 AM PST

I'm in Montana. I doubt I have any grounds but it's worth asking.

I worked at this restaurant for a year and a half, past 6 months as manager. The restaurant sold and the new owners took over beginning in January.

Long story short, they slashed my hours, then my SO's hours, and gave us halfass excuses. It all came down to me sucking for a while because I had the flu, which we apologized and had a "fresh start", and then a series of ridiculous excuses and non-issues. We easily picked up shifts from fellow employees that actually really liked us (unlike the owners). There was nothing wrong with our work ethic or competence on the job, we had lots of experience coordinating the team in that restaurant and it shows in how we worked.

I felt like they were playing games with my schedule, and since I'm an adult with bills to pay and no time for games, I began searching for other jobs. Either a second or another full-time, whichever happened. In any case, a reference call was made on Thursday of last week to the restaurant for my current new job I'll be starting this coming Monday.

I head into work this past Monday and don't make it a foot into the back hallway before the new owner stops me. And this is what he said. "Before you get too comfortable, I have yours and SO's tip envelopes and.....thats it. I wish you luck in life" and then he turned and walked away. Literally didn't even want a response. It took me a bit to realize what even happened as I opened my tip envelope and saw that it was...empty? It was 7am and I was cold and tired. I actually laughed and walked back to my car 3 blocks away through a wicked winter storm.

Yesterday I learned of two claimed reasons from someone that still works there. I was getting "calls" from other "places" looking for references, however there was only the one call. Also, something about Facebook posts that his friends showed him? Something negative we posted on Facebook? Neither of us had posted anything related to that restaurant on Facebook, like, ever.

The unfortunate truth is that this is very common when restaurants sell.

What complicates things is the new owners had us old employees sign new probationary period paperwork. So even though I worked there for a long time and was fired for illegitimate reasons, does the new probationary period screw that up? How unlawful was our termination?

Caught one of my employees stealing from my business. He has agreed to pay it back all in payments. I want to have him sign a contract saying he will pay it or else I will press charges. Would this be enforceable?

    Posted: 08 Feb 2019 10:17 AM PST

I have a car servicing business where clients leave their cars with me while they are on vacation and I get them serviced at a local business I have contracted. I send my employees to pick up these cars and they get charged to the company account. I recently found out that one of my employees has been taking his car there as well as the cars of his family and friends and he has been getting them serviced for years (thousands of dollars). I confronted him and he is very apologetic and has agreed to pay me back in payments. I want to give him the chance to do this, but I want to have something in writing in case he decides to not pay. Would a contract that threatens to press charges be enforceable? What specific crime did he commit (i'm in TX). What sorts of elements should I include in the contract and is there any sort of specific language I should include to make sure that this is enforceable? Thank you.

Leased Car Got Totaled, Insurance sent check a week ago but leasing credit company is still saying I need to pay next monthly payment

    Posted: 08 Feb 2019 10:25 AM PST

    Location: NH

A couple weeks back I got rear ended by another car which totaled my leased car. My insurance is covering the car and my lease has gap insurance to cover the difference between the cars value and what I would owe. Therefore, I should be out of the lease with no further payments due.

My insurance mailed their check to the leasing credit company 5 days ago. However, I called today and they say they still have not recieved the check and my payment is due this upcoming Monday. I was told if I do not make a payment Monday the payment they recieve from my insurance will be considered a late payment which I'm worried would ruin my credit but I also do not want to make a payment on a car I no longer have.

I have evidence that my insurance mailed the check last Monday and the check will be dated for before my lease payment is due. Can I avoid making this payment if the leasing credit company says they have not recieved it when I call again Monday?

Do I have the right to use a bathroom, privacy, phone access, and prescribe meds during a 5150? (Northern California)

    Posted: 08 Feb 2019 11:10 AM PST

    Throwaway because pretty personal.

Last year I was placed on a 5150 hold under the description "Gravely Disabled" and just so you guys know I was in a depressive state and my family thought that I might hurt myself, which I wasn't, and they overreacted and had me placed. One of the reasons they believed I might be trying to hurt myself was because I wasn't eating which was due to my religious beliefs (family not religious) and which was also documented by the police a day prior (I have the report). I was also on antidepressants (Zoloft 20mg) at the time. But I'm not here to challenge the 5150 hold because I understand that they we're just worried, but rather to know what are my rights are while under the hold. I received some pretty horrible treatment under the hold and wondering if maybe I should take legal actions. This all occurred mid last year in Northern California.

The hold began on a Monday night where the police came in, handcuffed me, placed me in an ambulance where I was taken to the ER. Starting Monday night I began reciting the following to EVERY employee at the ER I came across to state my position:

    1. I have no intention of harming myself or others.
    2. I am fasting for my religious beliefs.
    3. I do not consent any medical treatment whatsoever. (giving blood, urine, tests, etc)
    4. I wish to speak to my lawyer over the phone.
    5. I will peacefully show my non consent and resistance through immobility.
    6. I'll exercise my right to remain silent.

On that first Monday night they requested a urine sample to me which I replied, "I don't consent." and at first it was let go and no other issue was made. Shortly later I needed to go to the bathroom and so I asked the security guard to let me go. Since arrival I was under 24 hour watch by security. They let me go and I locked the door behind me. While mid "business" the door is unlocked the the security guard bursts in insisting on a urine sample. I felt completely violated and took the empty cup just to get him to leave. I did not give them a urine sample and returned the empty cup after I left and returned to my room startled from the experience. Later in the week I'm also walked in on while I'm in the bathroom but I'll save those details for later.

Is that considered a breach of privacy?

Later in the middle of the night (Tuesday am), I needed to use the bathroom again. I got up to ask the security guard if I could use the bathroom again to which a nurse standing next to him made it clear that my use of the bathroom was contingent on me giving up a urine sample. I said that I don't consent and I returned to my room unrelieved and sleep try my best to sleep.

Can they not allow bathroom usage based on submission of a urine sample?

Tuesday comes and goes and with blood tests and more request for urine sample to which I reply my usually statements including "I wish to speak to my lawyer over the phone". At no point does any employee give me access to outside contact or inform me of where and how to use the phone. I'm being watched 24/7 by security so I'm not really free to roam around. One employee even states, "Those rights don't apply here, this isn't that place." More medical treatment continues without my consent including a catheter. At all times I stayed respectful and tried to stay calm but all staff seemed very hostile and aggressive towards me leaving me feeling completely helpless and alone.

Do I have the right to deny treatment?

By Wednesday morning I'm extremely terrified and shaken because no one will listen to me or help me and still haven't been able to use the phone. A new nurse comes in and I literally beg to her sobbing that I need help, I haven't been able to use the phone, and no one will help or listen to me. She must've spoke to someone because afterwards my treatment changes dramatically. A lady comes in that's obviously not medical staff (HR maybe?) and tries to explain that not consenting to medical treatment isn't helping my situation and I respectfully reply that I'm not here of my free will and I don't have to consent to anything. I bring up the issue of the phone and she replies, "Oh, you haven't used the phone? It's right there." (pointing at the counter outside my room). I don't know if she was trying to make it seemed like I had access to it the whole time but I had NO knowledge that the phone was there or that I could use it. With security watching me 24/7 I couldn't step outside the room without them stopping me let alone complete a full phone call.

Do I have the right to outside contact and/or usage of a phone during the first two days?

Now during this time I had been prescribed 20mg Zoloft, ironically from the exact facility that I was staying at and I NEVER received my medication while staying there and didn't receive it until I was transferred to a mental hospital.

Are they liability for not giving me my medication while I'm being held there against my will?

Needless to say all this has been extremely traumatizing and have been in isolation for the past 6 months. I'm just not sure what to do or what my rights are? I have the names, times, dates, and more details of all of these encounters but I don't know if anyone will believe me or take my word over it in a legal proceeding as that's about all the proof that I have. Is this hopeless or should I try taking legal action? What is the statute of limitations for something like this? Any input would be much appreciated. Thanks.

    Bait and switch

    Posted: 08 Feb 2019 09:32 AM PST

Last week I signed a contract with a non-compete clause.

This week, they let me know that they are no longer going to move forward with a program that was going to be a huge focus of my work over the next few months, and a major reason that I signed that contract in the first place.

I have been working for this company for over a year, but we didn't put an official contract in place until last Friday. I feel like this was a bait and switch, because now that the program is not on the table, I no longer want to work with them, and now I have a non-compete clause that I didn't have a week ago.

I would like to ask them to void the contract entirely, because this is pretty messed up IMO. Can I do that? And what can I do if they say no?
