Father killed in hit and run [CT]

    Posted: 29 Jan 2019 04:58 AM PST

So this is basically my first time posting anything of relevance to Reddit, so I apologize if I'm doing this wrong in any way.

My [22 F] father [62 M] was hit and killed by a car that drove away the other day. The police are trying to investigate any cameras that are in the area, but I'm afraid there aren't many.

Also, I am technically the only person my father has. His parents passed away. He hasn't talked to his brother in 15+ years. I have to cover ALL legal stuff and I am stuck. My brother (who has a different father) has made many phone calls regarding obtaining his body, police reports, etc.

My question is, once they find this person that HIT AND KILLED my father and drove away, what legal ways do I go about it? Do I sue this person? What do I sue this person for?

In all honesty, this is just so hard to deal with. To deal with not knowing. I guess if you have any advice pertaining to this, I would much appreciate it.

Edit to add a little bit more background information/specifics:

I did not live with my father at the time and he did not own a house. He was staying with a neighbor. He also did not own a car. He was walking across an intersection when this happened, but it happened at 6:45pm and officers are saying it may be hard to see any evidence with street light cameras because it was dark at the time.

When my dad died he left me money; I’ve yet to see it

    Posted: 29 Jan 2019 07:27 AM PST

My father passed away about 13 years ago from a work accident. He got compensated plus for his life insurance. I was only 11 when that happened but I remember meeting with his lawyer and my uncle to sign papers or go over stuff.

My dad told me on his death bed that I was to use that money strictly for school. However, I haven't seen that money till this day. My uncle was in charge of it, perhaps because after my dad died he asked if I wanted to come live with him and he'd take care of school for me.

I didn't hear from him again and resumed living with my grandmother. Weirdly enough about a year later, he bought a new house, new business and took a lot of trips to our home country.

I suppose what I'm asking is there a way to find out what happened to that money? More importantly if my uncle spent it all on himself? Or is there a way to find the attorney? I wasn't given any info from my uncle after my dad died. Pretty much got kicked to the curb and shut out.

I've been searching high and low for my uncle but he seems to be hiding from me.... just breaks my heart even more because my dad specifically said on his death bed "I paid my life for this money. Use it on your education".

    Thanks in advance guys.

Bank account frozen this morning. Bank is saying they sent me a request for my immigration paperwork. I was born in the U.S. Help!?

    Posted: 29 Jan 2019 09:16 AM PST

This morning I went to get gas, and my card was declined. I know there is money in there so I called the bank. They said my account is on hold until I send them my immigration status paperwork. I told them that I was born here, and they have my social security number. They put me on hold for an hour, then came back and said that my account is showing I haven't submitted my immigration documents for six months. By then I was starting to get annoyed. So I hang up with them, get my birth certificate and social security card, and go into the closest branch. I tell them what happened, hand them my documents, and ask them to fix the problem. The manager scans and uploads the information. They reject it because it's not the immigration document they want. They tell me I will need to call the customer service number to speak with them, because they cant override the error. I ask them if I can just withdraw a few hundred in cash to pay for things, and they tell me at this time they can't access the account. I am starting to get really angry at this point, but I call customer service back with a polite attitude. I try to speak with supervisors, and no one knows why this is happening or how to fix it. They tell me I just have to go to the immigration office and ask for this document saying that I am still in legal status. Call immigration number they give me, because I have no idea where to go for this document. They tell me they can't give me that document unless I am actually an immigrant due to scams and things of that sort. The thing that is interesting is that my wife is from India, but she has been here legally for almost 15 years now. They aren't asking for information either. We tried that in case it was a glitch related to her. Anyone have any idea what I can do? I have no access to my money, and not even sure where to go.

[UPDATE] USA, AL: I’m pretty sure my parents have been evading their taxes for the past 8 years and it’s inhibiting me from completing FAFSA

    https://www.reddit.com/r/legaladvice/comments/ajcxnb/usa_al_im_pretty_sure_my_parents_have_been/?st=JRAZ3YS8&sh=bc409706

Not sure if any of you remember my OP so I'll link it above. I first want to say thanks to everyone for all of your advice about school and my parents.

This entire situation is crazy and I hate that it's my life. After a week of trying to talk to my parents and work something out they have still somehow managed to turn this around on me and blame me for not being a "responsible adult" (ironic right ha!).

I have spoken with a financial advisor at my school and she is working on possibly getting me a dependency override since I have a special circumstance. I should be hearing from her later this week and am preparing to start school this summer!

With that said I think I've decided to follow some of your advice and I'm going to go ahead an report my parents for tax evasion. Do any of you know how to go about doing this and what the process will be like?

Teacher got me kicked out of a school when volunteering because I supposedly “threatened to kill her” even though I didn’t, can I sue for slander?

    Posted: 29 Jan 2019 06:36 AM PST

I had went to this School before HS and I had left because this teacher would constantly kick me out of the class and send me to the office over the most minute things. I went back today to volunteer with another teacher for hours since it's exams right now and the other teacher saw me and she started yelling at me saying how she is going to get me kicked out for "threatening to kill her" which I never did. I had said things previously like "I don't care for her" and "I have the most minimal respect for her" but I never threatened her. She then got the Principal to get me removed and canceled my volunteering. Is there anything I can do like sue for slander? Location : Ontario, Canada

Jury duty turned into a felony...

    Posted: 29 Jan 2019 08:27 AM PST

Okay guys, so I'm an 18 y/o (M) college student and I moved out of my parents house, whom I don't speak to anymore. I live in FL. I was assigned jury duty once which I wasn't ever informed of. Then the reschedule was set for the day after I came back from vacation. I thought I could make it, but I was too jet lagged and slept through the second hearing.

Then I was given a form by a deputy to appear in court. So I'm thinking alright it's time to clutch. So I go to court on the day I was summoned for my "trial" or hearing or whatever. I get there and wait for about 30 minutes until I realize something isn't right. I ask around multiple desks on multiple floors of the building and I learn that my court date was cancelled. (No I didn't get it in written confirmation, I'm an idiot). The assistant then tells me to reschedule upstairs in the magistrates office. I go and the door is locked. I knock and wait. I buzz the ringer on the door and wait. No one comes so I just leave. My assumption was that they would mail me a date to reschedule once the judge came back.

Boy was I wrong. I got a letter telling me because I didn't show up I'm now a felon, have a $140 fee and I have 30 days jail time. I feel like it's all bullshit.

    What do I do?

[Maritime Law, American Flagged] Is it illegal for me to quit my job before my rotation is up?

    Posted: 29 Jan 2019 08:41 AM PST

I am working on an ship as an engineer with two other engineers and a chief. One of the engineer hurt himself and is getting off the ship. The company has no replacement for him as of now and might make the rest of us work more hours to cover. I make a flat daily rate that with my current schedule comes out minimum wage an hour for where I live. If I have to regularly work longer shifts I will be making less than minimum, and if I am not offered more pay to compensate I plan to walk off the ship. However I have been informed that under maritime law / the Jones Act that doing that could be illegal. So to put it flatly, is it illegal for me to quit my job as a ship engineer before my rotation is up and/or without a replacement?

The ship is US flagged and is a US company. I live in Seattle WA. I do not recall signing any binding contracts keeping me on the boat, just the regular employment tax forms.

[PA] Why would a home seller want to keep oil and mineral rights to the property?

    Posted: 29 Jan 2019 07:55 AM PST

So my husband and I are looking to buy our first house. We found one we really liked that was well within our price range and came with all appliances.

It's for sale by owner and we're working with a realtor, but we called and confirmed that he'd be willing to work with us all.

Meeting with our realtor last night to write up the papers to make the offer, he told us that the guy selling the house want to keep the oil and mineral rights to it. This isn't a big property - it's a two-story suburban house that takes less than 20 seconds to walk down one walkway and up the one to your neighbor.

When we own a house, we want to own everything. Not just all of it EXCEPT for X, Y, or Z. He hasn't told us WHY he wants to keep them and we're worried that there might be something going on that we don't know about.

Also, if we let him keep these, does that mean if 20 years down the line we find oil or something on our property, am I correct in assuming he would own that and not us?

We're obviously looking into this through other routes as well, but I wanted to post here and get your opinion. Please let me know if there's anything I need to add as we're both kinda new to house buying.

    Thanks, everyone!

(TX) I inherited a house, now it's being foreclosed.

    Posted: 29 Jan 2019 09:04 AM PST

Basically, what the title says, I inherited a house from my maternal Grandfather. The thing is, it was also left to my brother, sister, and a step-uncle. The taxes are due, a few grand, but I'm in No position to pay (college student). I don't even live in the same county as the house. I'm worried about My credit-score and what this means when I'm ready to buy a house of My own.

EDIT: The property is being foreclosed upon by the county for taxes. There is also a $39,000 child support lien because of Uncle

Wife is being denied a license bc I have felony convictions

    Posted: 29 Jan 2019 06:20 AM PST

This is NY. I honestly am in a bit of shock. I have multiple felonies that happened years before I even met her. One was from 20 years the other 14. She was trying to open a cafe with a liquor license and they requested information on me even though i have 0 to do with the business. I'm extremely crushed for her and so upset that my fuck ups in the past are affecting her now. It just doesn't seem fair or right at all. I didn't even know she existed when I had these convictions. What are her options? She has invested so much financially & emotionally to get this place ready to open and all that was holding it back from officially opening was the license.

Broke my clavicle bone on Sunday and don't have insurance. I need surgery. Hospital wants $9000 upfront to use their facilities (does not cover the surgeon fees, literally just to use the room). Am I fucked? (NY)

    Posted: 29 Jan 2019 12:42 PM PST

I definitely don't have 9 grand on me and they won't do a payment plan. They won't even get me in for a pre op (which is supposed to be tomorrow) unless I give them the money up front. My clavicle is broken into at least 3 pieces and I absolutely need surgery. I already paid $300 to get xrays when it happened and then $500 today for a doctor to walk in, take one look at the xrays and say "yup, you need surgery," so I don't have any extra money. The doctor I got x rays from told me there was something in Medicaid that allows you to call in for "one time emergency help" but I haven't been able to find any information about it online and he hasn't returned my call. Has anyone else gone through this?

Handicapped Neighbor, can I brush off their car?

    Posted: 28 Jan 2019 09:09 PM PST

Hey all! MN resident, and we had a bad snowstorm this past week and it may only get worse. I have a handicapped neighbor that I have never spoken to. I noticed today that their car wasn't brushed off and snowed in. I've seen her around and know she has some physical disabilities.

Tonight I was wondering if I can legally brush off her car and grab a shovel and make a path through the plow pileup so she can leave if she wants. I don't believe she would be physically capable to do this herself. This is her first winter here at this location (I think).

It would be a random act of kindness kind of a thing, she lives a few buildings over, but the handicap spot is right in view of where I occasionally have a cigarette so I just noticed it. I haven't seen her since the fall (I can only imagine the ice and everything doesn't help, plus I think she is over working age) but I would love to be the random neighbor to help her out!

Can my boss take my side business?

    Posted: 29 Jan 2019 05:27 AM PST

Hello, I'm hoping someone can help me. I'm starting my business on the side of my everyday job in the UK. However my boss is a bit of a psychopath and my contract said anything I create belongs to him while I work here and I can't work for any companies now or for my next job that are similar - non compete clause. I know he'd be the kind of person to take my business if he found out about it.

I work in fashion ecommerce and for my business I want to sell jewellery - so they are similar fields but not the same.

I'm wondering if I registered my mother as the sole trader for my business (which she has agreed to) if this is legal and would prevent me losing my business?

How far from a restroom can you work?

    Posted: 29 Jan 2019 09:04 AM PST

I do construction and the nearest bathroom is 9 floors away and the only way up is a single freight elevator used by EVERYONE. Sometimes it takes 10 minutes before the elevator reaches my floor, then i have to wait for it to drop people off on the way up! Ive almost had an incident more than once. How far can the nearest restroom even be? Can i demand to use the restroom on my floor?

Pregnant Ex-Girlfriend refuses to tell me if im the father. Giving baby up for adoption. Indiana

    Posted: 28 Jan 2019 09:26 PM PST

    Hello,

After breaking up for a few months me and my girlfriend got back together. Soon after this I realized she was pregnant. However, she refuses to tell me if I'm the father or even her due date. She has simply told me that she's putting the baby up for adoption and it doesn't matter who the father is. Obviously, this put a strain on our already shaky relationship and we aren't together anymore.

I had hoped the situation would resolve it's self and she would eventually tell me if I was the father but she continues to neither confirm or deny and I have to assume her due date is approaching.

It's very important for me to know if I'm a father. But I don't disagree that adoption may be the best option. What options do I have?

Thank you for your time and consideration

Edit:. Thanks everyone for your advise and opinion. I registered with the Putative Father Registry today. From here I plan on working with the adoption agency to facilitate a smooth transfer of rights to the adoptive parents pending a paternity test.

I [17F] went out drinking, got stripped and videos of my private parts are being spread.

    Posted: 29 Jan 2019 12:25 PM PST

So this happened... I[17F] was out drinking with a couple of friends and had way too much to drink. Some people that I'm not friends with joined us and when i was not in any condition to defend myself they started filming, beat me and stripped me naked. Also, when i woke up all of my money had been stolen (20-30€). Some of them have spread the videos through snapchat and I'm currently being bullied because of it. I have proof (screenshots) of one of the culprits sending the videos to my friend. What should i do?

My country won't renew my passport and my immigration status is at risk

    Posted: 29 Jan 2019 10:00 AM PST

    Hi all,

    Location: Bay area, CA.

As it says in the title my country (Venezuela) won't renew my passport. More precisely it won't extend my passport. The country is currently in a major crisis and passport renewals have been notoriously hard to get. Waittimes were 7-8 months before the currently presidential crisis. I applied for a passport extension that could have taken 1-2 months before the crisis but now my consular office in San Francisco is closed and my case has had no progress since early December (when I paid for the passport extension application).

Without a valid passport I will immediately be out of immigration status (OPT). My passport expires in a couple of months and I need the extension before March 3rd to apply for the STEM OPT extension. I will be let go of my job in the UC system (or put of leave without pay) and as the main breadwinner in my family we will be screwed.

I have the option to apply for a green card by marriage. My wife has been job searching for several months but we moved to Bay Area recently and getting a career track job (MS level) takes a while. We have no guarantee she will get a job before my passport expires, also a minimum wage job won't cover our rent (Bay Area). The green card process will take months and I will have to stop working when my passport expires and wait to get a new EAD through the green card process (which could take 3-5 month since the application date, and won't happen before June). We can't afford 3+ months without my salary (plus the green card fees) and it is also unlikely we could get a green card if I'm unemployed and our income requirements are not met.

Trying to keep my OPT and getting a STEM extension is by far the best choice but without a valid passport I'm lost. I wanted to ask the legal advice group to see if there was someone with a better grasp on immigration law that could come up with another solution, a way ask for some sort of special work authorization or to fast-tracked my green card work permit or anything of the sort. I feel stuck and I'm really scared.

The United States has acknowledge the opposition government in Venezuela but that has only made my access to a passport extension more difficult. The US has not come up with solutions for Venezuelans with expired identity documents. It has happened through no fault of our own, just a consequence of being citizens of a failed state.

[CA] Neighbor wants to put entire fence on our side of the property line

    Posted: 28 Jan 2019 11:16 PM PST

    California

A few weeks ago, my neighbor told us that they wanted to replace our current wooden fence with a 6in cement block fence. We said it was fine as long as it was right at the middle of the property line. Last week, a surveyor came and marked the line. The contractor has repeatedly moved the line closer to our side and we have disputes over this. The neighbors also want to put the entirety of the 6 inch thick block fence on our side of the property line. I believe this to be illegal, unjust and unfair. I am sure they will wiggle in more on our side of the property as well.

Every time I try to talk to them in a civil manner about this issue but they just get angry, complain that it will only take up 6 inches, yell racial slurs at me, threaten that one day my "shed might just disappear" and that they will call their lawyers. They told me their lawyers were coming today but no one has showed up, only the construction crew. Currently they have the trench built so that it on our side of the water line and it seems that they are going to insert pipes underneath the fence. Why are there pipes underneath the fence and what can I do? I have talked to a lawyer but we may not seek to fight since an extension of our house may not have been built with a permit. I'm not trying to be petty but my neighbors always try to intimidate and bully us and I am tired of it. I like to mind my own business and expect them to do the same, but it is hard to have a conversation when they do not use logic. Do you have a similar experience? How did you resolve it? What would be the best route for me? Should I be recording all our conversations from now on? If I do, should I inform them they are being recorded or just record silently (I know they will probably not like being recorded).

Children consistently left unattended in apartment fitness center

    Posted: 29 Jan 2019 01:50 PM PST

I live in an apartment complex near Baltimore MD and I've seen 4 children between the ages of 6 and 10 left unattended within the apartment's fitness center twice in the past 3 days. I've seen the children playing with various pieces of equipment, obviously dangerously, including a treadmill, stair stepper, bicycle, cable machine, and several free weights, while also getting in the way of myself and other residents during their workouts. The leasing agents must be aware of their existence due to their requesting access to the nearby restrooms. I have expressed how unacceptable it is for the children to be left unattended in the fitness center but they seem to be disinterested in my complaints or they let me know they've contacted the mother, both of which result in no action. Residents possess an electronic key fob in order to gain access to certain facilities within the complex, I am unsure if the mother gives them her fob or if the leasing agents allow them inside.

If/when the children become injured while playing with the equipment, can I or any other adults present be held liable? Is there anything I can do from my end to ensure they are not left within the facility? Is this a CPS level complaint if it becomes increasingly prevalent?

Thank you for any and all advice, I'm just trying to ensure the children aren't allowed to seriously injure themselves and/or innocent bystanders are held liable for their injury.

Tollbooth bill for place I’ve never been, and for a car I don’t own.

    Posted: 29 Jan 2019 07:19 AM PST

I received a bill in the mail from FDOT. There is a picture of the car, and the license plate. The letter says 'this car was either leased by you, owned by you or rented by you' and for me to pay the tollbooth bill from the Miami Dade expressway tollbooth.

It's not my car. Not my license plate. I've never owned, rented or leased that car. In fact the car I have now is the only car I've ever had. On top of that I've never been to Miami. The only thing I can think of is I went to Orlando on October 20th for a concert but I didn't go through any tollbooths, and the bill they sent me is dated for September 1st, so a month before I even went to Orlando.

Why would my name be on something I do not and have never owned, leased or rented? Is it going to be difficult to dispute this?

    $235 public transit ticket

    Posted: 29 Jan 2019 11:22 AM PST

I'm a student in Toronto, Canada. I have had no tickets prior, and I have a long history of paying for the public transit. Recently however, I received a ticket for not paying, and I regret not putting in more time to verify my payment.

I tapped my Presto on the public transit, and received a confirmation that my payment went through. Upon the proof of payment check, I learned that I did not pay. This surprised me, and the officer insisted that I did not tap. Given the options of paying the fees in full, talking to a prosecutor and going to court, I chose to talk to the prosecutor. I am still awaiting the letter from the prosecutor. I've sent Presto an email requesting support, and recently, I received photo proof from the public transit showing that I did tap to pay. I also have electronic records showing that I have a history of paying.

This would be my first time dealing with such a situation. What should I do? What can I expect?

Should I report a sexual assault that happened seven years ago

    Posted: 29 Jan 2019 10:17 AM PST

I was sexually assault seven years ago by a teacher at the middle school I attended but I never told anyone. Legally, is it worth reporting him? I don't have any proof but I feel guilty that there could be other victims, as I've seen before most of these cases justice isn't served so what are my options legally? Ideally I'd like to anonymously report him. Could I just report him to the school?

Future soldier waiting to be ship to Basic Combat Training but has potential law suit coming up. Help...

    Posted: 29 Jan 2019 01:34 PM PST

Hi, I am an Army future soldier who is scheduled to ship on at the end of Feb.

    My location is Maryland

    Here is my timeline.

    - I signed the contract and swore in as green card holder on Oct 13, 2017 and got ship date on Nov, 2017

    - Due to DoD policy released on same day (Oct 13, 2017) I could not ship.

    - I established Single member LLC and signed a commercial lease with my name and the corporation's name on Nov, 2018 with 5 year contract. I did not have plans of joining the Army at that time.

    - On Dec 4, 2018 the policy got suspended by Pentagon and all green card holders could ship

    - The shop I opened did not run well and I decided to join the Army

    - Army Reno took place on Jan, 2019 (re-signed the contract) and I informed the landlord with a written notice & my BCT order 30 days prior to my ship date.

    - The landlord hired a lawyer and they want to settle this matter with retained security deposit and $4,000 of penalty on top of it. If I do not settle, they said they will sue my corporation with $30,000 of remaining rent balance.

    - However, the single member LLC has no assets what so ever. No inventory at shop.

    - My accountant told me once my corporation is sued, I can just bankrupt it and dissolve later.

I have posted this thread on r/army and people advised me to post this on here to get help.

Should I hire a lawyer to take it to court battle? or should I just accept or negotiate the settlement and then go to BCT?

I would really really do appreciated any kind of advice or opinion. I need every kind of help to solve this problem

Thank you a ton in advance
