Yesterday the cop that pulled my wife over a few months ago pulled her over again yesterday. We have paid all of the tickets that were given to her and got her license squared away. The problem I have is that my wife wasn't speeding, was wearing her seatbelt, was driving her sister's car and the officer pulled her over again. When he got to the window he called my wife by her last name and asked, "Did you get your tickets and license taken care of?" and then proceeded to run her information. Since everything was good to go he let her go. I have a couple of concerns about this and you guys were so helpful last time. We are in Austin, TX (Williamson County)

I was not injured whatsoever and refused all medical services. They forced me into the back of an ambulance to sign a paper stating how I refuse all services etc... Today I received a bill from the county EMS for $150 for "REFUSAL". How can I be charged if I •Never called them in the first place •Refused services •Even told them I was refusing services to avoid fees Since I am not at fault in the crash I'm assuming the other persons insurance will cover this but for example, if it was my fault, why would I have to pay for absolutely nothing? Someone also asked in the comments if our father was claiming my brother and I as dependents, and since he was paying child support on us, it's likely that he was. This is a long, LONG complicated story, and I don't completely understand everything since I was a minor when much of this was taking place. Thanks in advance for reading this and feel free to comment if you need clarifications. When I was 3 (in 1998), my father placed me in a Family Limited Partnership formed by my paternal grandparents. My interest in this partnership has grown to about $400K. It should also be noted that my mom was pregnant with my younger brother when this partnership was formed, and instead of waiting for him to be born and giving him his own share, they gave me a double share. Therefore, I have twice the interest in this partnership as any of the other limited partners. It is an irrevocable trust, and my father was my custodian, and was supposed to file and pay my taxes (the funds for which were provided by the partnership). In 2007, following years of physical abuse, the police removed my father from our home and subsequently my mother, brother and I were given an emergency protective order against him. I was 12 and my brother was 8 at this point. When I was 17, I found out that my father had failed to file or pay taxes on my behalf since my parents separated, and I was notified that I had been in arrears with the IRS since I was 12. He has been sent my share of the money every year, and it is my understanding that he has pocketed it. Furthermore, the trust has made payments to him in the amount of the taxes which he is supposed to have paid in my name and he has pocketed these as well. I have not seen a cent of it, nor have I been provided with the documents necessary to file these taxes, even after repeatedly requesting them. I'm now 23, and have been attempting to remedy this issue for a few years without getting very far. I was able to hire a lawyer for a short time to attempt to remedy this; however, he did very little to help and I don't have the money to continue to pay a lawyer. I am desperate for some concrete next steps that I can take to remedy this, and would appreciate any and all advice from someone with more legal know-how than I. I would love to 1) Get these taxes paid, and make sure I am not in any trouble financially or with the IRS, and 2) Get this money for my brother and I. It is in my name, was promised to us, and was supposed to be put towards our college fund and other expenses. I feel that we have been conned out of it by our father. Posted: 04 Jan 2019 08:11 AM PST He first arrived around 9:30am knocking on my door and neighbors at the same time. I opened the door and asked if he could come back at 2pm and that I only had $400. (I needed to go to the bank and withdraw the money).He said that was fine and I shut the door. He came back at around 12:45pm. He knocked and I opened the door. He asked if I was ready and I told him that I was. He went to grab his receipt book. I paid half the rent and told him I'd have the other half on Wednesday. He then touched my breast and "down there." My body froze and felt like I couldn't move because of the shock. When I did realize what was happening, I told him to stop and to never do that again. He apologized and I repeated for him to never do it again and to get out! He apologized once again and was backing away. I pushed him out the door and slammed it. Ran upstairs crying and called the police immediately after. They came over and did the report. They said it was Gross Sexual Imposition and it was a very serious thing. They told me to go downtown to figure out my options. I did and they said I could try to get a restraining order or press charges. I want to press charges, but want to know the likelyhood of him being charged. I went ahead and filled out the background check paperwork there. I did not have time to stay for the police interview because I was already late for work and couldn't miss anymore days, otherwise I would've done it. Before I go to the interview, should I hire a lawyer? Is it worth it to press charges? What proof do I need? I have the signed receipt with the date. So my ex and I have been divorced since 2011 and we have a ten year old son. I'm listed as the primary parent in our parenting plan. This morning my ex calls and says there's a dental appt for the kiddo at 3, and asked if they could bring him back tomorrow, I said fine. She also told me that the court will see things thier way because I'm neglectful (I'm not. My son is my. Entire. Universe.) they said my house Is disgusting, I live in a bad neighborhood (to them any neighborhood with anyone not Wasp is a bad neighborhood) and that I'm teaching him bad habits like not brushing his teeth and hair... My son has a strict routine. Showers every night at 730, teeth brushing multiple times a day. Other info that might be relevant but I'm notnsure: I have a letter from my son from when he was with his dad over the summer that states his dad told him he "had enough money to make sure you ever see me again" and he owes roughly 22k in child support because he doesn't "feel" he should have to pay it for the times our son was with him.... At this point there's multiple police reports, but Arkansas apparently doesn't count this as parental kidnapping, and aren't doing anything but making a report. I have no clue where my child is. Posted: 04 Jan 2019 05:05 AM PST Long story short I went in for an oil change and twelve days later I was stranded on the side of the road traveling home for Christmas. Has anyone experienced this with Walmart? My vehicle (2017 Impreza) was taken to the nearest dealership for a diagnosis and the result was my transmission was drained and filled with gear differential fluid, and my oil was double filled. Walmart is telling me they're likely not going to pay for a new transmission because I traveled 370miles since the maintenance (all very short drives between). I paid $3000 (a reasonable and current price for the vehicle) in CASH for the car and got the title and had it put into my name. Yesterday I was leaving work around 4 pm, and I couldn't find my car. I park in the same spot every single day but my car is just MISSING. I call the police, we make sure i didn't just "misplace" it and file a report. The car is entered into the stolen car database. Today the police call and tell me my car was towed to a Repossession Lot and it has been taken out of the stolen database. I am 100% it wasn't towed because of debts i have (I have literally zero debt) so it MUST have been the lady I bought it from. She was living with her fiance at the time. 10 days before she died, they held a ceremony for a wedding in hospice but never actually got married bc he didnt want to inherit her dept, only her wealth (which was only $15,000). When it came to the funeral, he used her money in her bank to pay for it all and put his last name on her grave. He wouldn't let me take any of my moms things from his house, as he couldnt part with any of it, but was able to start a new relationship with a new woman 3 months after her passing (my mother and him were together 8 yrs). All of her things are in his house i.e. pictures from when we were babies, furnature shes had since we were children, baking machines I bought her, books I bought her, jewerly she made, all of her clothes, he has access to all her passwords, emails, social media accounts with lots of her writings in them. I am 27, they dated for 7 yrs, I want what is rightfully mine. They were never legally married, and there was no will on her end. Can I bring him to small claims court for what was left in his house? Neighbor's Radio Transmissions are Causing Interference With My Electronics Posted: 04 Jan 2019 11:15 AM PST I've got a neighbor a few houses down and around the corner from me, and over the past year I've been picking up what I assume are his radio transmissions over my computer speakers. He's got a 60 foot antenna sticking out of the top of his house, and several large ones on his vehicles, so I'm fairly certain this is my guy. Several times a day I can hear his side of a conversation to what sound like long haul truckers. It's almost causing a lamp to cycle through the various power settings rapidly, creating an alarming light show. There are dozens of other houses around, so I can't imagine I'm the only one experiencing this. I've recorded several videos of it happening, and I contacted the FCC about it, as I've been told they take this very seriously. A few days after my first email to them, broadcasts became much louder and more frequent, with the individual referencing his right to broadcast several times, so I assume someone contacted him and he was retaliating. I emailed them again, and he went mostly silent for a few days. Unfortunately back to the same daily interference now. My question is, who do I contact? I'm fairly certain the FCC regulates broadcast strength, and takes violations seriously. Clearly this guy is using too much power for what he's doing, if it's turning my lights on and off. I don't care in the slightest about what he's doing, but it's absurd for me to get woken up all the time by his conversations blasting over my speakers and affecting lights in my home. She's going through workman's comp to get it fixed. Currently she's waiting to see a specialist. She's been placed on weight restrictions. Basically zero lifting or carrying with the injured arm and only 5lbs with the non injured arm. At first they placed her in jobs she could do but her co workers started getting pissy because she cant help out with other details and complaining to HR. So they moved her around to different positions. In these positions she's either been and inconvenience to the other CNAs or it's been jobs she cant fully do because of her shoulder. Last week after being placed in a job requiring her to organize closets doing stuff that requires 2 hands and lifting more than 5lbs, which she couldn't do it due to the injury, they told her they would have to talk with the director and that she needed to be more accommodating. They haven't let her come in to work the last 3 days and she has the meeting this afternoon. What are her rights here? To me it sounds like they've created a hostile work environment around her injury. Edit: we are both afraid they are going to try and leverage the complaints as a way to let her go. We lived together in an apartment for 2 years, my name is the only one the lease but he has been paying me half of the rent via check since we moved in. The day after the breakup, I asked over text if he would write me a check for his half of the remaining lease (4050 USD). The lease isn't up until September, and it is a loft style apartment with no separated bedroom so it would be very difficult to find a roommate to move in and take up his slack. He agreed to pay that amount over text, and told me I could write and sign a check for him for that amount (his checkbook and almost all of his belongings are still in the apartment). I even took a picture of the filled out check and asked him again to confirm if I could deposit it. He said, "If you want". This conversation happened while I was at home and he was at work, so there's no reasonable way I would have access to his phone to fake these messages. Now he is threatening to get me in legal trouble for forgery if any of his belongings are damaged when he comes to get them in a few days. I have not messed with his stuff, I'm better than that, but I am concerned that he may try to lie or he will intentionally break something himself and claim I did it so he can get me arrested or sue me. At the time I was handed over to her, she was living with my aunt because her husband has a record, and she worried it would interfere with the CPS investigation process. She lives with him now, and he has physically and emotionally harassed me. A couple years back I was sexually assaulted and I don't really like talking about it, my grandma wants to force me to tell her husband and if I don't he's threatening to kick me out or make me move with my mother, who is NOT supposed to be able to take care of me under the court. Basically, he got billed for his next year and decided he didn't want to continue the membership, so he called their office and the secretary told him that he would be refunded and his membership would be canceled. A week or so later, he calls again when he sees the charge has not been removed, and is told by the same secretary that they can't refund him or cancel his membership because he never submitted the request in writing. Very large church in, east of Dallas and West of Shreveport, Texas built a new facility. I was contracted to furnish 300 PC systems, set up a domain, establish security procedures and protocols, move the exchange server, and set up every church employee/volunteer with email. Train permanent tech on procedures for terminating and activating new accounts and maintaining systems. On no less than 7 occasions did they ask me to donate my work, donate equipment, pay a tithe to the church, or simply do it out of the kindness of my heart. My response to each of these requests was. "Did the contracting companies, the plumbers, HVAC techs, and electricians tithe, donate work, or simply work out of the kindness of their hearts?" Answer was always no or "I will have to check but I think so." This required 5 people and 2 weeks to accomplish the preliminary work. All equipment was procured by my company and reimbursed by the church in full. Another week to train up their guy. However when it came time for paying the employees it goes like this. Church pays me, I pay the employees. When labor costs were calculated and submitted I received a check for the full amount minus 10 percent as a tithe. Obviously I have to pay the other five people what I promised them. I have done this, but I am now out a little under 2k what I am owed. Since this is contract work this is 2k I am being taxed on that I am not seeing. Suing this church is out of the question as many of my regular customers are members of this church. This would be shooting myself in the foot basically. To give you an idea, I periodically show up to this church because these customers only deal with like religioned individuals. My question would be if anyone knows the relevant laws regarding this kind of thing. I never agreed to the tithe and the church office is trying to smile it all away as not a big deal. Nearly two thousand dollars is a big frickin deal considering this is the biggest job I had all year last year. What laws are they violating by making unauthorized deductions. I plan on going to them and stating that my "management company," IE my wife, is demanding the extra money owed. I already have a litany of bible verses that have made the deacon in charge of payment laugh at me. Now I just want to come back with something a little less threatening than "I will sue you." I contacted one of our mutual friends about sending the laptop (to the friend) because I didn't want to contact my ex for her address. This happened in early December. Cut to now, and my ex and some of her friends are attending an event near me. I contacted her friends telling them I still had the laptop and would like to give it to one of them so she can get it back. The mutual friend showed me group messages that she had said "sucks for him, I'm going to be in the [hotel] room the whole time so he can't come by", and her friends saying they were going to make excuses to avoid me IME, it doesn't sound like she wants the laptop that badly, since she's trying to make it difficult to get it to her friends (note: I never asked to go to their hotel room) So basically, I'm not about to waste my time trying to track these people down if they're going to ignore me, but I also don't want to get a knock on my door from the police asking where the laptop is. My ex faked a pregnancy after we split, so it's not unlike her to pull cheap tricks. So what's my responsibility, here? Significant problems found after buying house. Posted: 04 Jan 2019 08:35 AM PST Hello, My wife and I recently purchased our first home in Everett, Wa. We had an inspection that found some problems consistent with a 1900s house, but nothing critical. After taking possession I was in the crawlspace figuring out how I was going to address some of the problems found in the inspection and found a couple huge problems. First, the drain for the washing machine was not tied to the sewer and was draining straight into the crawlspace. This seems to have eroded an approximate 2'x2'x2' hole directly beneath the pipe which extends laterally maybe 20' about a food down, like a giant sinkhole. This caused the pier closest to the hole to sink away from the beam and so is not supporting it. I also think it is causing some of the other foundation piers to sink aswell (it's a pier and beam house). I have no clue how to approach this from a legal standpoint. Do I have a case? Against who? Is What Instacart Does Legal Regarding Tips? Posted: 04 Jan 2019 11:14 AM PST So recently Instacart changed the way they pay their independent contractors. It's very nebulous, how they calculate what our "batch" (which is a shopping trip) payment is. However, one thing that has come to light is that what they offer us on their side (from the company itself) as a "guaranteed batch incentive" is calculated using the tip applied pre-order by the customer. For example: If a customer leaves a $3 tip, Instacart itself will pay a $7 "batch incentive" for a total of $10. If a customer leaves a $7 tip, Instacart itself will pay a $3 batch incentive for a total of $10. This itself sucks, but it doesn't seem that questionable. We're offered $10 for a shop and we can take it or leave it. It seems like a basic contract (per shop) to me in this way. HOWEVER ... Instacart allows customers to adjust or remove tips for up to 3 days after delivery. So that batch you shopped that had a guaranteed $3 batch delivery with a $7 tip could (and often does) become a $3 payout if the customer gets stingy and just zeros out their tips. The work you thought you were doing for $10 becomes $3 in an instant. My question is: Is there any question of legality in that they calculate our batch incentive based on the amount of tip that is left. The tip is used as a tool to come to an "appropriate pay," and then if that tool is removed (the customer zeros out the tip), who is at fault for "breaking contract" in this situation? Does it not matter? Or because this is a metric by which Instacart calculates incentive, they should be bound to cover that incentive up to the amount that the tool was considered relevant to payment? A high profile magazine hasn't paid us for event photography shot and published in May Posted: 04 Jan 2019 01:17 PM PST Location: Los Angeles, CA Hi my first post on this sub, but I run a small digital marketing agency and we shot photos for a high profile magazine conglomerate in May of 2018 for an event they hosted. We were asked on because the event planner referred us. Since it was a last minute hire she insisted we didn't need a contract (a mistake we'll never make again). Over the summer, the company ignored our calls and emails. Finally, we were set up through their online payment portal in July. Since then, our invoice has been "pending" and they've continued to ignore our calls and emails. Later I found out that our contact at the magazine and the events company have both resigned from their positions. I've spoken with the CFO of the magazine on the phone in November, he insisted we'd get everything sorted out. After another 2 months of no response and still a "pending" invoice in their system, we're wondering if we have a case. They owe us is $500, but is it true you can also calculate the cost of unpaid invoices? What do you guys think the right move is here, do we have a case? My company threatened to fire me if I talk to the police. Can they do that? Posted: 03 Jan 2019 03:13 PM PST I am in Nevada. I don't want to give too many details in case someone identifies me, but to make a long story short, a woman I work with accused a man I share an office with of sexually assaulting her. I was in the office when this incident supposedly happened, and I know that the accusation is totally false. Anyway, she reported it to HR, which reported it to the police. HR called me in to talk about it and I told them what I observed, and then told me that if I talk to the police, they will consider it to be interfering with the investigation and I will be fired. Is that legal for them to do? Can I tell the police what I know, without my company finding out? I know this may seem silly, but I really don't think it's fair for someone to face charges for something they didn't do. [link] [comments] |
How can I get off the mortgage with an ex-boyfriend? Posted: 04 Jan 2019 08:14 AM PST Issue: I own a house with my ex-boyfriend. I've been out of the house for 5 years. He refuses to sell. He refuses to refinance or buy me out. He is living in the finished basement and renting 2 upstairs bedrooms. He doesn't claim his rental income. He doesn't carry the correct rental insurance. It's a disaster waiting to happen. I'm not getting any money from the tenants. I've also not paid towards the mortgage since I moved out. I use to do all the upkeep and landscaping when I lived there, and now it looks like it's falling apart. The stairs are broken, the fence is falling down. History: - 15 year relationship - Started dating when I was 15. He was older. - We bought a house together when I was 21, in college - The mortgage and deed are in both of our names - He used his 401k for the down payment (30k) - We were taxed 12k that year. I got a loan and eventually paid it off. - I paid 900 a month for 6 years. - He had previously claimed bankruptcy but at this point, he is ok to get a loan When I text him every 4 months, saying that we need to sell or refinance to get my name off the mortgage, he just stalls, says that he can't or doesn't answer. Also, I'm not the type to ask for money but am I owed a portion of the house? I don't think it should be 50/50. I had previously said I would be fine with 10k because I paid to have the wood floors put in and paid to finish the basement. Police Department Lost My iPhone (TX) Posted: 04 Jan 2019 08:19 AM PST In June of 2018 I was jumped while walking home from work late one evening. I was able to get the individual off of me, but in the struggle the person destroyed my iPhone. The screen was shattered and the back was scuffed but it was not in more than 2 pieces. Once the police arrived on scene, they asked for my iPhone as evidence. A detective reached out to me later that week and said that I would be able to pick up my phone from the evidence locker and gave me a location. I went to the evidence locker and they said they did not have my phone. I called the detective back and he stated something along the lines that it was a rookie officer who was at the scene and he improperly entered the phone into evidence and he would follow up with me. 6 months later and I have not heard a thing from this detective. Truthfully I forgot about the phone when I replaced it and just moved along with life. Is there anything I can do to reconcile this situation financially or otherwise? [link] [comments] |
Incorrect birth date given to father Posted: 04 Jan 2019 03:44 AM PST [Texas] Hello /r/legaladvice , Long time lurker here and I have no clue how I should go along with this. My father came to the United States in 1982 they had made a mistake on his birth date, he was originally born in 1953 but they had written 1959 which is a difference of 6 years and as you can imagine that's really difficult for him to sign up for his retirement as he is physically not able to do much anymore. He has proof of his birth being in 1953 from his origin country I was wondering where would he need to go in order to fix this and how he should correct this? Update 12:23 CST: currently at the Social security offices in line with my father will let you know how it goes so far it's hell. Update 3:20 CST: just got done and we got it fixed thank you so much for answering my question and finally getting my father to fix it he's relieved on how easy it was to fix besides the long wait at the SSA. My father wanted to inform people with the same issue that if you have your original birth certificate or something similar that verifies your age that you should go ahead and fill out a SS-5 (we didn't have to but you might have to) and go to your local SSA to have it corrected. You will still need to fix your passport and driver licenses to reflect the updated birth date which is another trip to the DMV but in the end it's worth it especially if you're looking to sign up for retirement.
