Will my home owners insurance cover a defamation suit against me?

    Posted: 30 Dec 2018 06:50 PM PST

I expect to get named as a defendant in a frivolous defamation case.

I currently have citizens/hanovers platinum plus insurance, I've read over the policy and it only mentions covering personal liability such as "bodily harm" but mentions nothing about a defamation/ slander/ libel.

My agent is out of town and won't be back till next week.

Sued by other driver after insurance company ruled him at fault. What happens now?

    Posted: 30 Dec 2018 09:13 AM PST

Nothing to ruin your Sunday morning like getting served with a summons for a civil lawsuit from a driver who was ruled at fault in a claim that occurred 18 months ago. This was a fender bender that occurred on a residential street at a low speed. It took my carrier at the time less than a month to determine we were totally not at fault, and the other driver's insurance covered the costs of repairs to our car. Nevertheless, the driver fought liability tooth and nail the entire time, despite having a dash cam AND showing his footage to the officer on the scene who told him then and there that he was at fault. (Can't make this stuff up.) According to the complaint, he's suffered severe and permanent damage and blah, blah, blah. I've already contacted my carrier, but of course can't get any real answers on a Sunday. So I ask the Internet experts: how worried should I be?

What happens when you only have liability car insurance, and the other party is fully at fault but they have a shady insurance company?

    Posted: 30 Dec 2018 11:50 PM PST

Ive always had full coverage so I have gone through my insurance by filing a claim and having gotten my deductible back after my insurance got it from the at fault party, but that goes to question what if I just had liability?

My insurance wont do anything then right? Like the police report 100% confirms the other party is at fault, but since i just have liability my insurance wont do anything right? In order for my insurance to step in i need to file a claim, but since id be missing the crucial "collision" and only have liability i wouldnt be able to right?

Thankfully for what im going through ive got full coverage so my insurance is doing the brunt of the work but from what ive read of this other party's insurance company they always try to fight back and make it take months, and id imagine without your insurance company backing you up you might be up shit creek.

Auto insurance and a DUI in Montana.

    Posted: 30 Dec 2018 09:23 PM PST

I got a DUI last fall and haven't been sentenced yet. I backed into another car. The claim was paid out to the other vehicle but I never told them it was due to a DUI nor did my mother who's insurance I am a part of as she owns the vehicle. Do I need to tell them? Also when I am sentenced if I can get a hardship license so I can still get to work will I need an SR22? I haven't really found any information that I can understand what exactly an SR22 is and what it does. Thanks

(TEXAS) What kind of car insurance do I need to be able to drive the truck my STBX is hiding from me?

    Posted: 30 Dec 2018 08:43 PM PST

(First posted in legaladvice and was directed here.)

My husband and I are both on the title. We had a schedule where we traded off using the truck (he works offshore; I had it while he was working and he had it while he was home). In early December, when he left to go back to work, he refused to return the truck to me and told me he took me off the insurance (we were on the same policy together). We will be having a temporary hearing in early January when he returns and I'm hoping the court will order him to let me use it again (I have 3 jobs and take care of our daughter) but I need to be insured first.

Google isn't quite giving me the exact answer I need and I've also never bought insurance for myself before, car or otherwise (gotta love new experiences) so I'm a bit lost on how to proceed. I'm clearly on a budget but I want to make sure I have the right insurance. I dont have details on what kind of insurance we had before as he has taken most of any financial paperwork we had so for a lot of stuff I am unfortunately in the dark about that if it happens to be pertinent.

What is the difference between Alamo Extended Protection and Supplement Liability Insurance?

    Posted: 30 Dec 2018 12:40 PM PST

What is the difference between Alamo's Extended Protection (EP) and Supplement Liability Insurance (SLI)? If I already have EP, is there any reason to purchase SLI to boot?

EDIT: The answer is: THERE IS NO DIFFERENCE. I've figured it out by copying the text of the two coverage policies above into two different files, replacing all occurrences of "EP" in the first file by "SLI", and letting my computer diff the two resulting files, ignoring capitalization and whitespace. There was no difference.

Who is to blame: Accident in Washington State

    Posted: 30 Dec 2018 07:53 PM PST

Say there's a two-lane road with a double solid line. Washington has tons of hills, and one driver goes into on-coming traffic to pass a slower vehicle in-front of them. They crest a hill and didn't see me coming. There will be a 40+40mph head on collision unless I take evasive maneuvers and drive off road, I do, my vehicle flips 6 times and is totaled. The person who went against on-coming traffic didn't hit me and drove away.

Who is to blame? Will my vehicle be covered? Is there a certain type of insurance I should have to cover this situation? Would a dash-cam help at all in this scenario?

Creating a record of possessions in case of property damage - receipts necessary?

    Posted: 30 Dec 2018 07:33 PM PST

Related to recent threads regarding the aftermath of fire/property damage and dealing with providing accurate itemized lists of damaged items, I've decided to create a document of my personal property in the event that something were to happen as well as to make sure I have accurate coverage in my renters' policy. I plan to create a spreadsheet with as detailed as possible description of items, as well as the estimated price paid (if I don't know exactly) and when/where it was bought. I also plan to photograph items and include serial numbers/pictures of any important details.

After reading threads that included personal testimony and advice from adjusters, I'm still not clear about whether receipts and proof of purchase are necessary/in what cases are they necessary. I don't save receipts for anything besides large purchases, so would time-stamped photos along with an inventory log be enough for most property that isn't super valuable (ex. clothes from mid-range retailers such as American Eagle, paperback books, art supplies)? Most of what I own is clothing, with 2-3 nicer items (over $150) but most coming in between $5-$50/item, and none of it would be new enough to replace exactly. I'm planning to document them by brand, size, style, color, where/when bought and what I can price them as by going to the store's site now and finding the most similar item (or from memory if I happen to remember). Is it worth saving links to the items I reference for the price, when most big clothing retailers change out what products are online pretty often?

My only "big-ticket" possessions are a laptop, TV and an old record cabinet, all of which were given to me (TV and laptop are both several years old as well). I could find the value of these online, but since I don't have receipts, would these items be a potential issue if anything happened to them? (Record cabinet is probably a bit different since it's an antique.)

I also own about 40 concert posters. These likely wouldn't be replaceable since they are for specific concert posters, but they were between $20 and $40 each. In the case that these were damaged, how would the value be proven? The only place any would be sold currently would be on eBay/other resale sites.

Moving forward, is it advisable to keep receipts/take pictures of receipts for anything I'd possibly want to be replaced in case of property damage?

If it is relevant, I have a renters' insurance policy with State Farm and I live in TN, USA!

Did I make a mistake getting insurance before being kicked off at 26?

    Posted: 30 Dec 2018 06:55 PM PST

I am getting kicked off my mom's insurance in March, but I'm currently in graduate school. While I am graduating in May, I am not sure when I'll find a job so I decided to buy insurance off the marketplace to make sure I'm protected.

Since my new insurance starts on Jan. 1, does that mean BCBS of TX will kick me off my mom's plan on that day? Did I mess up? I was hoping to take advantage of my mom's insurance before getting kicked off, but I don't want to go to the doctor in case I did get kicked off. My new insurance plan is also BCBS of TX.

Recieved Accelerated Death Benefit but didnt die, now what?

    Posted: 30 Dec 2018 09:49 AM PST

I was given less than 6 months to live by my doctor. She misjudged my disease and gave me a wrong prognosis. I've been dealing with neuroendocrine pancreatic cancer and was not doing well. My doctor estimated my remaining time to be 6 months with not more than a year to live. This was over a year ago and obviously I'm still here.

Because of the prognosis I was given I applied and received an accelerated death benefit from my life insurance policy and used it to pay off medical bills and clean up debt so I could die without leaving all that behind for my son. My husband died of cancer 14 years ago. Note, I have since learned that the debt would not have transferred to my son, I didn't know that at the time.

My most recent tests show I have more like a couple years to live, maybe more. This leaves me with the question, what do I do about the insurance payout. There is no way I can pay that back, I have nothing.

I am in pain every day but I'm getting through. I am working full time, but I have no savings. And I have no health insurance so I can't even get further testing. I had already decided not to seek treatment so it's really just a waiting game for me.

It just makes me mad that a doctor's mistake left me in such a financial pit. Then I feel guilty that I'm not happier that I get more time. Truly there are times I wish I would just come to my end to resolve all this, the stress cannot be helping at all.

Does anyone have advice for me?

    Totaled truck in Germany

    Posted: 30 Dec 2018 07:16 AM PST

    Hey everyone,

I am currently in Germany with my personal vehicle that got totaled in a accident. My insurance company says that I am covered for collateral damages and collisions both on my vehicle and the other one. So my question is what can I expect to receive for the vehicle? It was a Toyota Tacoma 2012 with 80,000 mile good condition kbb.com rate it at around $18,000. The towing company want to offer me $500 euro for the wreck I feel like that's a huge undercut. As the engine compartment has no damages the rear of the truck took most of the damage breaking the axel and twisting the frame. Will post photos later.

2nd edit. Insurance Company is USAA. And the vehicle is completely paid off.

Should I use the preferred shop or a shop I'm comfortable with?

    Posted: 30 Dec 2018 03:04 PM PST

Any advice is appreciated here. My car was hit this weekend by a newly licensed 16-year-old driver. The damage is to the right passenger fender, lots of paint transfer, scratches and the panel is coming off. It's not a huge accident, but it's unsightly. The kid's insurance has already accepted 100% liability over the phone. In the past, I've taken my car to a shop I'm comfortable with. This shop is not one of the insurance company's preferred partner shops. I told the adjuster that I want to use my shop and he gave me a vague unclear process of having the shop send in photos and an estimate for review. I'd like this not to be dragged out any longer than it has to be, and that seems to be the direction it's going if I use the shop I like. Should I just bite the bullet and go with the insurance co's preferred shop? I'm moving out of town in a little over 2 weeks and want this to be completed before I leave if at all possible.

Thanks for any help with this!

Mom without drivers license needs to have car insured.

    Posted: 30 Dec 2018 03:00 PM PST

While speaking to my mom's car insurance company regarding creating an online account for her, I mentioned that my mom had only a state ID for verification. Also mentioned my father passed away last year. The rep told me that technically my mom should not be insured if she didn't have a valid driver's license. I asked if he was going to void the policy and was told it would be up to the underwriters.

My parent's purchased the vehicle back in 2016 and there were no problems when we notified the insurance company. Neither of my parents drove at the time (mom never drove and dad stopped driving 15 years earlier due safety reasons). They've had a auto policy with the company since the 80's. I am listed as a driver on the current policy. Mainly drive my mom to medical appointments and Costco runs. Has less that 8000 miles in 2 1/2 years.

I was told that an option would be for me to be added to the registration on the vehicle. Honda Financial is currently the lien holder, so I don't know if they would be agreeable to this.

Are there any other options? I'm in California if that matters.

    Thanks

What are some alternatives to major health insurance?

    Posted: 30 Dec 2018 01:59 PM PST

I'm 26, self employed, and in healthy condition. Being that I am self employed, I am paying the full premium (~$300 / month) for incredibly basic coverage.

I completely understand the importance of having some kind of coverage just in case something terrible happens. That being said, are there plans out there that just cover those "catastrophic" events, rather than just Dr. checkups and prescriptions?

I apologise if this is an extremely basic question, but I just don't know enough at this stage, specifically about this question, and figured you guys might be able to just give me a straight forward answer. Thanks in advance!

A Few Car Insurance related Questions

    Posted: 30 Dec 2018 09:22 AM PST

1.I've noticed when searching around for car insurance quotes and came accross the question "amount of loss" under each accident I report is this the amount that I got or what they payed out to others for damages/ injuries how do I find this number whatever it is?

    1. theoretically if my state only looks back 3 years in my driving record do I have to report tickets/accidents more then 3 years old when signing up fir a new quote

bonus points: theoretically how does my insurance company know the age I was first licenced or would that be something one could white lie on as well?

I want to buy a car but our insurance rate is too high!

    Posted: 30 Dec 2018 07:50 AM PST

Our family has 2 cars my dad drives a minivan and my older sister and brother share the sedan, my sister has been in so many fucking accidents it's unbelievable she wrecked 2 cars already and she's on her third one, my older brother drove the car and he rear ended someone and stupidly took full responsibility for the accident our insurance rates is now $2492.80 every six months. My dad doesn't even know about it either, my mom paid for the bill, and she told me not to tell my dad, it was around $1600 before the collision. I now need a car and find it unfair that I'm not allowed to get one considering he bought my sister 3 cars already and hasn't even made her pay for the insurance or the cars itself. I already have my permit and my pre licensing course certificate and I barely ever get to drive the car, but I do drive pretty well, the only problem is the insurance my dad will never buy me a car if this insurance rate remains that high, I feel like my only solution is to get a job and pay for it myself. Is it cheaper to just get my own insurance that isn't shared with my family?

Will possibly be falsely accused of a hit and run.

    Posted: 30 Dec 2018 05:03 AM PST

Occurred in Boston, MA on 12/29/2018.

Apologies in advance if this post does not make sense, I am still shaken up and have a lot of adrenaline in me still.

I was pulling out of a spot today on a street and although it was a small spot, I got out of it fine and I did not hear/see/feel any collision. The owner of the car behind me followed me down the street and was screaming at me because he was very upset that I had to back up close to his car to pull out of the spot. He said that I backed up unnecessarily close to his car on purpose, but it would've been physically impossible for me to pull out without backing up. I ignored him because I was too scared to engage since he was very abrasive and cursing at me. THEN, at a stop light, he started to say that I hit his car and then he pulled behind me to take pictures of my license plate and began to threaten me. I stupidly did not get out of the car to take pictures of damage because I was very scared as it was midnight and he was literally following us and screaming at us, saying he has video evidence of how I messed up his car badly and that he will have me put in jail or sue me for all that I have.

Once I was safe, I pulled over and inspected damage on my car, but there was no NEW damage to the car. There are small scratches on the side of the passenger door from an incident a long time ago, but it is not consistent with his story about me backing into him. There is also a small 0.5cm scratch on the bumper, but that was from before tonight.

I am worried that he will bring this as evidence to the police and use a video of me backing out to corroborate with his story. I honestly did not commit a hit and run and I am not sure what to do as I don't have much money nor do I have experience with dealing with the cops; I've had my license for 7+ years and have never gotten a ticket let alone a parking ticket.

If this is actually not a big deal, sorry for being dramatic!!! I have been a nervous wreck and have been shaking nonstop from anxiety ever since.

Thank you in advance for any and all advice that you can offer!

Edit: I'm not sure if it helps my case, but my friend was also in the car with me and also agrees that she did not feel/hear/see or experience anything remotely close to a collision

Vehicle owner giving option to pay him directly or file claim? New situation for me. Help!! :D

    Posted: 29 Dec 2018 10:26 PM PST

First of all thank you for reading this. I will try to keep this short and to the point but it is a little bit long. The past 2 months have been pretty busy in the 'life' department. I purchased my first home on 11/2/18, I've bundled that home with home owners insurance, 2 autos - Liability only, and an umbrella policy. I got married last Friday. 12/21/18.

Here's the situation:My wife, fiance at time, works for Amazon at their warehouse. My new insurance policy, which included her car, started on 11/2/18 to coincide with home purchase. On 12/5/18 she was backing out of her space at work to head home and she hit a parked delivery van which damaged the van's bumper.

The parked delivery van was a rental van that Amazon rented from a 3rd party to make deliveries, so it was not the Amazon's actual van. She reported all the information to supervisor and provided insurance cards, etc.

We haven't heard anything since then until tonight. She received a phone call at 9:15 PM tonight (Saturday) from an unknown number, so she didn't answer it. A little bit later she received an email from the owner of the company that owns the van (Email included number that had called earlier). In the email, this is what he writes (formalities and identifying info removed):

    " Hi Person,

My name is Owner and I am the owner of Rental Vans. I own the van that you backed your vehicle into on 12/5/2018 in the Amazon parking lot at Name of Parking Lot in Omaha, NE. The damage to the rear step requires that it be replaced.

There are two options that we can do:

    1. I can file a claim with your insurance, whereas it is highly likely that your insurance will increase over the year due to being at fault, or:
    2. You can compensate our company for the just the cost of the rear step ($251.24) and no claim will be filed. I will also change it myself so no labor charges would be included as there would be if a claim was filed. I have attached a photo of the replacement step with the total cost for your review.

Please let me know which option you would like to pursue seeing how I need to fix the van immediately. If you would like to just pay for the replacement part (I'm going to assume that this would be the quickest and cheapest option), please provide me with a money order or cashier's check made out to Rental Vans for $251.24. You can give it to us at blah blah blah.

I can be contacted through the number or email listed below. Thanks for your time Person. I look forward to hearing from you.

    Very Respectfully,Owner"

Couple things here... I checked the cost and that's relatively how much the bumper is so no qualms there. I do find it odd to call a person at 9:15 PM on a Saturday nearly a month after the incident and then send an email and say that "he needs to fix the van immediately".

I am not contesting that he is due his money. She hit his van and we need to pay him what is owed.

This is where I am needing help. I'm not sure how to navigate this. I believe the obvious, correct way is through the insurance company, if not just for the assurance that he can't come back later and file a claim for more or something, etc. I don't know the person and like to give everyone the benefit of the doubt, of course. I'm sure he's probably an honest person given that his price for the bumper is reasonable and I think he is only mentioning that if he files a claim that he will charge the labor is because that would need to be provided to the insurance company to prove the repair costs and that it took place? (Just guessing here... I don't like to think it's an attempted strong arm or something especially since he is asking for less than what he would get through a claim, presumably)

I think he does have a point on the claim though and that's why I'm not positive what action is best.

I'm not sure what my deductible is (I've been trying to locate the dang thing on Farmers but can't find it. I would think it's probably much higher than $250. So, I could end up paying more than that (depending on whatever labor charges come out to be - hell, the dang thing is like 2 bolts, here is the actual part https://tinyurl.com/ybelz9ea ). Then after paying towards the deductible I would have to deal with a raise in rates. (I really don't know how much raise we are talking about here.)

I did see this when googling where to find my deductible: *There is usually a deductible for a comprehensive or collision policy, but a basic auto liability policy does not come with a deductible.* Since we just have liability on our vehicles, maybe that's why I cannot find a deductible... in which case what happens?

If everything is on the up and up then I'd rather just pay him directly but am I setting myself up with a risk? Can he come for more if he is unscrupulous, even if I keep his request and all my documentation and correspondence that states I've made restitution to him for what he asked for in damages?

I want to thank everyone in advance for taking the time to read this and offer your input. I very much feel like the clear answer is to just go through claims but I don't know if I'm just being overly cautious to the point of costing myself money needlessly and having a claim on my record..

My wife fells really terrible... :(

Edited a lot: Been a while since on Reddit.
