Posted: 26 Dec 2018 07:51 AM PST I passed every Field sobriety test that was administered to me & Blew a .000 in AZ ; the Zero-Tolerance State. I was very respectful to the officers as they searched me and I even allowed them to search my entire vehicle. They did not Believe me as I continued to tell them "I Am Sober". They booked me in Jail and took my Blood. Here's my Question.... If THC metabolites stay in your blood for up to 1 month, How can that blood test prove to them I was under the influence..? Thanks in Advance for serious responses. My Court date is next month. The Test came back Positive for THC metabolites. [link] [comments] |
[Update] Wedding photogs using my parents property without permission Posted: 26 Dec 2018 09:57 AM PST Original post here- https://www.reddit.com/r/legaladvice/comments/9tew0f/wedding_photographers_are_using_ny_familys/ Well, first I wanted to thank the LA group for a lot of good advice, and the BOLA group for the lulz. My parents have now acquired an adjoining piece of land and we have several plans for it. Firstly, we are planting a large pine plantation between the wedding venue and their property. There will be no immediate effect, however, over time the trees will create a fantastic visual and sound barrier between the wedding venue and my parents' home. It will be an fantastic source of profit as the trees can eventually be cut in sections, sold, and replanted, without losing the sight and sound barrier. This will be managed by father and myself, and we plan on setting up a trust so that it can continue to be properly managed for my children/grandchildren in the future. Unfortunately, this also means that once the trees grow a bit, it will cut off the vaunted "sunset view" that has been a major selling point for the wedding venue, and also make it quite hard to trespass on my parents property, as pine plantations in their first several years can be notoriously thick and hard to navigate. Secondly, just beyond the pine plantation, we have created a private firing range. That way we can safely enjoy our (quite loud) firearms from the convenience of my parent's backyard. The volume of fire might increase during wedding events mainly because they seem to happen on the weekends, and that's when the fellas from the gun club will be coming over. We've also spoken with local law enforcement and firearms instructors about using our range free of charge for things such as firearm certification/qualifying and Concealed Carry licensing tests. Third, since we are going to be hunting the property as we have for almost 20 years now, we will be marking everything quite aggressively with "posting purple" and a bevy of No Trespassing signs, and have contacted the local game and fish department about dealing with trespassers as they seem to be a bit more independent that the local law enforcement, and just happen to be friends with most of the gun club members as well. So, all in all, patience will win the day, and there's the added bonus that, if something happens to the trees... tree law. Merry Christmas! Edit: Forgot to mention- the family lawyer has sent C&D letters to the property owners and several of the photographers that have been identified through social media posts that have trespassed on their land to take the pictures. They were mailed out right before the Christmas break so they will likely be getting those today. [link] [comments] |
My wife had her wallet stolen in Dollar Tree - Managers refused to help us/police Posted: 26 Dec 2018 07:56 AM PST EDIT: The incident occurred in Charleston, South Carolina. So just a bit of backstory here... Last week my wife was in a Dollar Tree with her mother and the child she nannies. She was trying to grab some cheap mugs and stuff for a Christmas gift her mother was making for someone. When she came into the store, an employee helped her place the child into the cart/seat/thing, and commented on how cool her wallet was (its a small, handmade wallet a friend gave her - kind of a cross between a wallet and a clutch). She then proceeded to walk around the store, and noticed an employee following her and her mother around. She finally made it to the aisle with the mugs, and the creepy employee who had been following her started staring at her, and stocking shelves near where she was standing. My wife turned around to grab one of the mugs from the shelf, turned back around, and her wallet was gone and so was the employee. We later found out the employee clocked out immediately following the incident and left, we believe, in the middle of his shift. My wife immediately called me and asked what she should do, I told her to speak with a manager and that I was leaving work to come see what was going on. I also told her to call the police, which she didn't feel comfortable doing. My wife is the most kind and caring person I've ever met, and hates confrontation, so I told her I would call them. The police arrive shortly before I do and ask her some standard questions. I arrive and speak with the officer about what our next steps should be. He informs me that the managers of the store were refusing to let him review any kind of security video, and were also not allowing him into the store office to speak privately about the issue. I was then told the manager somehow knew my wife's wallet was stolen (not missing or misplaced) prior to my wife even asking about it. Apparently she asked to speak with a manager, and the manager came out, rolled her eyes, and said "I know - you're wallet got stolen." My wife then informed her I called the police, and the manager scoffed, then went back into the store office. The officer ended up calling a number of area Dollar Trees to get the name of the area manager, who he then spoke with. The area manager called the store and instructed them to comply with any requests the officer made. The store manager then came out, with a huge attitude, and demanded the officer sign a bunch of paperwork because he was "unauthorized" to be in the store office. The officer was finally able to get in, and conveniently all cameras in the store were either off or not functioning except for a single camera in the stock room, so there was no evidence of the wallet being taken. The officer then asked where the employee who had been stocking shelves and following my wife around was, and they said "he left." So my question is this: do my wife and I have any legal recourse against Dollar Tree? Other questions to consider: -Is there any kind of law or anything that requires they have working security cameras or anything like that? -How would the manager have known the wallet was stolen prior to my wife speaking with her about it? -Why did the employee who was following her around leave immediately after (3:58PM)? -Why were they so averse to helping us out when it was reported as stolen? -Why did they refuse to let the office investigate the issue as he needed, by restricting his access for a period of time to security cameras? Any help would be great! TL;DR: My wife had her wallet stolen by a Dollar Tree employee. The store seemed to know about it happening before she brought it up, and then refused to help us or the police. [link] [comments] |
I’m my mother’s sole beneficiary. Dad trying to fight it in court. Posted: 26 Dec 2018 07:19 AM PST My parents got divorced in 2013 in Texas and decided to split their assets as equally. Due to poor work on their lawyers' part, this whole process got messy and eventually delayed. Then 2016 roles around my dad was geared up to transfer his assets in the form of funds when my mom unfortunately passed away, putting me down as her sole beneficiary. This means that I am entitled to her estate, much of which was supposed to come from the property settlement— the transfer form of which is now void due to her death. Suddenly, my dad is now skewing the amount of funds he's supposed to send. Even saying he only owes a third of the original agreed upon amount. Now the will Executor on my moms side of the family has gotten a lawyer and is trying to argue contract law as the basis of the original agreement. My dad has yielded somewhat but is now arguing deductions such as the tax burden he will get by taking out funds from a particular account. Are these arguments legitimate? Is there a way to speed up this process? It's been two years and it's still being argued back and forth between two considerably slow lawyers (who aren't the original two who worked on the divorce settlement) and there's a lot of speculation as to why my dads fighting so hard against it. What can I do? [link] [comments] |
How can I effectively dispute this maintenance charge from my landlord? Posted: 26 Dec 2018 05:20 AM PST Located in Ohio. So, what had happened was: The dishwasher in my apartment (which was here when I moved in) as well as the handle on the kitchen sink faucet needed repairs, so I called my landlord. I had to leave a voicemail in which I stated the basic issue and asked for a call back to provide details. Roughly a week later, two gentlemen came to my apartment and said they were here to take a look at the hot water tank. I (knowing absolutely nothing about appliances) told them that I had called about the dishwasher/faucet and not the tank; they said that they would let the landlord know and apologized for the confusion before leaving. A day or two after that (Dec 3rd) a repairman arrived and fixed the dishwasher. He kindly explained that the issue was something involving the temp setting on the hot water tank and gave me some helpful tips for making sure my dishwasher would do its job. I just received this lovely invoice from my landlord. I believe in my heart of hearts that they are quite full of crap. I have never been charged a fee for a maintenance call and they're alleging that nothing was wrong with anything which is ridiculous. I want to call and dispute this charge but thought I should do some research first. I feel like this was a mistake/miscommunication on their part. Please correct me if I'm wrong. Thank you! UPDATE: landlord told me that the contractor said I refused them entry and told them to leave. Since that's absolutely not what happened, I clarified and the charge is dismissed. Thank you for all your advice!! [link] [comments] |
Posted: 26 Dec 2018 08:40 AM PST My wife and I have been married for 24 yrs. We tried to have children for 5 with no success, after all sorts of doctors and failed procedures. Gave up. After 10 years of trying to recover from the stress, she told me we had a miracle child and that we were going to finally be parents! I was over the moon happy, understandably. Our daughter was born and I completely took over the household support so that her mother could be a stay at home mom, we decided that was the best.... My daughter has been the jewel since before she was born, and I have doted on her since. Fast forward three years.....I discovered that she is the product of an affair and that the biodad has been visiting on the sly.....broke my heart and I had two failed suicide attempts-couldnt leave my little girl. I tried to make it work for months and for my sanity I moved out of the house. I am the legal father on the birth certificate and pay child support. I also am still on the mortgage on the home she lives in and pay as much of the maintenance as I can on my income with the extra apartment. I dont know my options of keeping my daughter, the biodad has made no formal paternity claim, but still after all this time is glad to have me pay for his indiscretion. I want to cut him off....... Her mother and I have discussed his involvement and she doesnt think he is a good influence lately either. [link] [comments] |
Former employer is being sued and I'm being summoned as a witness. What do I do and am I safe? Posted: 26 Dec 2018 05:25 AM PST [(Forgive me if I misuse a term/am slow to understand/give too much arbitrary info; my only experience with the judicial branch has been from tv shows.) In keeping with privacy and to minimize legal ramifications in case someone finds this I'll not name the company or people.] TL;DR-- My former employer is being sued and I have been served a summons - civil, as a witness, due to my placeholder as a manager at that time (3 months total) while they looked to hire outside of the company. I understand that I have to go, but will I run the risk of becoming a scapegoat in any capacity? Should I lawyer up? Is there anything else I should know or do? It's my first time dealing with any of this. Prefacing: I had left the company in February of 2017 due to threat of termination (they were "cleaning house" and I had already decided to leave around November 2016 when the environment had become... Disgruntled? Not toxic, but not cohesive either. Too many new faces revolving through upper management.) In Aug 2016 a resident had been tripped up by another resident in the dining room and subsequently suffered injuries they, later that week, died of while in the hospital. The daughter of the deceased is suing the facility/company. None of the wait staff are trained in any capacity to do anything medical. We were even explicitly told that due to legal ramifications we couldn't even preform the heimlich for fear of being held accountable for any damages done to their person. All we could do is call for Nurses or CNAs on a walkie-talkie that mainly stayed in the kitchen and wait while acting as a psuedo police line to prevent other residents from getting injured/seeing anything. I wrote a very detailed witness/accident report at the time, that they sent me a copy of and that's the only reason I know of said events. Otherwise I don't remember what happened as it was over a year ago; If I wrote it that's what occurred. I'm not named in any of the legal documents from what I see, where it says defendant is just my former employer. Along with the paperwork was a paper (from someone near the top of my former company) explaining that as I was a manager at the time they wanted me to contact them at my earliest convenience to discuss this. I don't have the paperwork in front of me atm but that's the gist of it. Do I need to worry about myself in any capacity? I'm not sure if I'm only a witness and nothing more, as it was the defendant that summoned me not the plaintiff. I've never been in such a situation before. [link] [comments] |
A lot happened and I’m afraid of that I may become a sex offender Posted: 25 Dec 2018 09:39 PM PST I'm a 16yo male. A girl I know (13) tried to kill herself yesterday, but survived. She immediately followed that up by sending me emails calling me "Daddy" and other really NSFW things. I told her to stop and that I wasn't sexually interested in her. She then threatened another attempt at suicide and I calmed her down, but then she started sending me nudes. I'm worried that I may get tried and charged as a sex offender because I know teens above the age of consent have been in Ohio (I live there) Update: Thank you everyone, she has been taken to the hospital and I contacted my parents attorney and he assured me that if her parents, or anyone, tried to press charges on me, he'd take care of it for me. Once again thank you all [link] [comments] |
My niece was given 10x the normal dose of adrenaline for her weight in the place of a numbing agent Posted: 26 Dec 2018 08:44 AM PST My niece is an 18 year old senior in high school. Let's call her Katie. This took place a week ago outside of San Francisco, California. Her mother is in PA, but she is currently living with her Uncle. The high school she attends had a clinic which is an external vendor that operates in the school which was doing procedures for a birth control implant. She went in to the clinic for a different reason but while she was there she became aware of the procedure and was offered to have it done. After being told what the procedure entails, Katie wanted it done. The nurse told her that it was really simple and there was nothing to worry about because she would not mess it up. The only document she signed was an acknowledgment that she understood what the procedure entailed and consented to it being performed on her. After receiving three vials worth of an injection, they made a small incision in her arm which the nurse said would not hurt. She reacted to the pain, so the nurses said maybe they just had to wait a few more minutes for the numbing agent to kick in. Suddenly she started feeling extremely distraught and lost her sight. Her eyes were open but she could not see anything. She began screaming in worry and started having palpitations. She asked the nurse to call her mother (whom she put down as an emergency contact) and uncle (her current guardian). The nurse refused and instead called an ambulance. After the ambulance call, the nurse still did not contact either her mother or uncle. She was carried to the ER where she was examined and given something to help get the adrenaline out of her body. It turns out she was given 10x the normal dose of adrenaline for her weight and was basically seizing as a result. It was only after the ER called Katie's mother that anyone was contacted regarding what happened. She never signed anything telling them not to contact anyone incase of an issue. Is there a case here for medical malpractice or anything else from the procedure? Edit** Adding specifically for case [link] [comments] |
university corruption coverup MI - Title IX Posted: 25 Dec 2018 08:54 PM PST My question: did the school do anything blatantly wrong? What can I do without putting myself in harms way? (Edit) TLDR: I feel my school may be covering up Title IX complaints in order to give special treatment to a student who is from a family who donates a lot of money to the school. They handled a less severe issue with another student immediately, however this has taken 3 months. Any and all legal opinions or any opinions question welcome, I'll do my best to answer questions (description in post is vague). Here is the rundown of events: Student (called S) from wealthy family (big donors) is in professional school in MI (USA) - relevant later in post. S sexually harasses many woman. consistent asking out, ignoring rejection, demanding women speak to him in person, alone, etc. S was so angry at one point he was shaking with rage, tried to grab woman student and another male student had to step in. S has stalked and harassed at least four woman this semester alone; constant staring, walking over to conversations where he knows women are afraid of him, following woman around campus trying to force them to talk to him. S has sent numerous threatening messages to women (at least four) in the class. What we tried to do: we tried to report him to the administration. It took over a week for the woman he is romantically obsessed with to be contacted for a meeting. Rather than going through title iX, they made an agreement for both parties to not contact one another. S has consistently violated this agreement. An administrator told S everything one student confided in her and now S is threatening / stalking her. S blames her for all the trouble he is getting in (trouble being meetings with administration). professors have reported him for sexual harassment / stalking / intimidation as well. (reports on him started about 3 months ago. the title IX reps did not give options to students reporting him, rather they listened and said "its being dealt with," over and over again. my opinion: They stop wanting to help when they hear his name. They try to make it into a smaller deal, or completely ignore it. They refused to document this in emails, when I send emails regarding this matter (to admin), they respond with the "its being dealt with." However, from my other research I thought it was procedure to at least explain the process of what could and will happen, and give assurance (documentation) something was filed, am I mistaken? what he has done in retaliation (other than stalking(literally following woman for hours on campus), harassing, and threatening): two women who he has harassed are now being called into an administration meeting to scrutinize their own behavior, because he has accused them of bullying. other facts: S brags about knowing people in admin and how they will always do favors for him. None of us women (at least 20 classmates) feel safe in our own school anymore. I plan on going strait to the police when I get back to the state for personal protection. Yes we all do have documentation of every online interaction. There is more to the story, I will answer questions the best I can without giving up any personal details about any said persons / institutions. Edit: S shows tendencies toward potential self inflicted harm and / or others (I.e. almost physically grabbing female student because she didn't want to talk with him, at that point he was yelling at her, male student had to physically place himself between S and female student to prevent further altercation. Later that day he "shook with rage" as he told a backwards account of the altercation to another classmate) Edit #2: my question is this; from a legal standpoint are there any facts that stand out to you? Posted: 26 Dec 2018 11:57 AM PST I'm in Oregon. My significant other and I have been searching for a place to move in together before my current lease is up. After weeks of looking, we've finally found a great place that checks of all of our boxes: in my son's school district, relatively affordable, right amount of bedrooms, great layout, etc. We've gone through the application process, paid the fee, and the landlords (a private couple, not a company) let us know they'd love to rent to us. There's just one problem. We're going to go see the inside of the place this weekend, and I asked for the lease in advance so we could be ready to sign on Saturday. However, the lease has a few clauses that are illegal under Oregon's landlord/tenant laws. Some examples: –The landlords can enter the premises for inspection without notice. Oregon law requires a 24-hr notice. –A late fee will be charged if rent is late by one day, weekends and holidays are no excuse. Oregon law states late fees can only be charged if rent is not received within four days. – They're charging a $300 non-refundable pet deposit. In Oregon, all deposits are refundable, and pet fees are no longer allowed. –They're charging a $200 non-refundable cleaning deposit. (See above regarding deposits.) They're are a few more, but you get the gist. My question is, now that we've been accepted in writing, are they obligated to correct these clauses when we point them out? Or can they refuse? Or can they decide they no long would like to rent to us? What's the best way to approach this? We really love the place, and we're getting down to the wire. [link] [comments] |
Consequences from flying a drone over the Russian border Posted: 26 Dec 2018 01:54 AM PST My friend recently bought a really nice drone that's technically capable of doing long range fpv flights. Since he lives in Finland he's really intrigued by the idea of flying over the border to Russia. He knows this isn't very legal but what sanctions would he face if he were to get caught? edit: asking for a friend update: he's gonna draw a big russian flag to the drone to avoid unwanted attention [link] [comments] |
Bank foreclosed on my house in 2012. I had a VA loan, and I think they had been charging me for PMI. Posted: 26 Dec 2018 07:46 AM PST I do not have proof that I know how to access for any of this, I was younger and ignorant at the time. I bought a home in 2007 with a 30year fixed interest VA loan that Country Wide financed for a year or two. I remember the mortgage payment being just over $1500. Then the loan got switched to BOA, and my payment went up to about $1750. I remember calling when that happened and they told me I had not been putting enough in escrow. At the time I just accepted that, until I ran into financial problems. I called BOA several times asking if there was any way they could work with me to reduce the payment which they refused to do. I tried to do a short sell, got an offer for the amount owed that they refused, and chose to foreclose. Now I do not have any VA benefits left, do not qualify for a conventional loan for another 1.5years, and looking back I believe it was because BOA had started charging me for PMI. I have no idea if there is anything I can do about this. A lot of paperwork and assets have been lost over the years in all the moves. Any help on my options at this point would be very appreciated. Posted: 26 Dec 2018 10:50 AM PST I have what I believe to be a straightforward set of divorce papers which I received today Merry Christmas. There are no kids involved and the house and car are solely in my ex wife's name. The only stipulation is I still have material possessions like a tv and books nothing major she agreed to let me get but aren't mentioned in the papers. I have literally 0 assets or money to my name and so I know I can't afford a lawyer to check it out. Again I am not planning on contesting anything just signing and getting it over with. What can I do? I resides in Michigan but am now with family in Virginia. Apparently there was some confusion in my wording I have 0$ not any amount of cash or retirement or 401k or stocks or anything I can sell. Literally $0 period. I can't even afford to pay for the hospitalization I went through. I would love to pay someone but again I have absolutely nothing for which to pay for their services with. [link] [comments] |
No Plumbing for the Holidays... xpost from r/indianapolis Posted: 26 Dec 2018 07:30 AM PST My plumbing has been out (mainline is clogged) since Christmas Eve. I called the maintenance line and got a recording saying if it was an emergency, they would call back within 30 min. Wouldn't you know, they never called. Call again this morning so I can actually get someone on the phone, I get a new recording stating that they are closed for the holidays and if it's an emergency they will call back within 60 min... I'm not holding my breath. So I drive to the office to find a notice on their locked door saying their offices are closed 12/21 through 1/2. So I guess I have no plumbing for the next week? Is this legal? What should I do? Edit: for clarification, I am renting this house. [link] [comments] |
Got my kids a Nintendo Switch from Gamestop for Christmas...but no Switch was inside Posted: 26 Dec 2018 12:25 PM PST In New York, USA. We ordered from Gamestop.com a Nintendo Switch for our children as a Christmas gift. It was shipped end of November and arrived in the first week of December, via UPS. We kept it in the shipping box in the closet until Christmas Eve, where we took the Switch box out, and wrapped it and put it under the tree. At no point did we open the Switch box itself. Christmas morning, my kids unwrap it, and it's all happiness and fun. Until we open the Switch box and find that there is a dock, cables, and a controller holster. It is absent the joy-cons (controller) that comes with it, and without the console itself. Immediate disappointment from my poor kids. I immediately fired off an email to Gamestop, explaining what had happened and asking how we proceed getting replacement/compensation/refund or whatnot. No response yesterday, and no response today. Was hoping I would so I could run into a Gamestop and get a replacement and my kids could at least play today as they're on school vacation. I called them this afternoon, and eventually got through. The assistant on the phone apologized and said they would have to conduct an "investigation" with UPS. I was told I would hear from UPS tomorrow, and then Gamestop would get back to me after about 10 business days to let me know the result of the investigation! So now I'm a little concerned and very annoyed. I was expecting a wave of apologies, refund/replacement and some compensation like a free game or something. Instead I'm in limbo, and have a feeling Gamestop are going to try and pass the buck and keep my refund/replacement on hold as they back-and-forth with UPS. My questions for legal advice are two-fold. The first is, at what point should I be calling my credit card company and looking at getting the charge pulled? Am I safer waiting until they conduct the investigation and see what they do? Or should I already be on the phone to the credit card company, informing them of what happened? They have not delivered anything close to the product described, having sent over basically a box of cables and minor accessories. The second is, am I entitled to a refund or can they try and just replace it after they finish their investigation? The reason I ask is because I want to get my kids a new Switch ASAP (especially as they are both disappointed from yesterday and off from school) and so want to order from from Amazon or Best Buy instead of waiting however many weeks it will be until Gamestop (possibly) decide to offer a replacement, when the kids are back at school. But I also don't want to buy a new one and then have Gamestop say "oh we'll replace but won't refund." So am I on solid ground to demand a full refund? Their returns policy (https://www.gamestop.com/gs/help/Returns.aspx) says this: "We reserve the right to limit returns to unopened or defective products. Defective product(s) will be replaced with a like item, upon return." So is this a "defective" item? Although they didn't even deliver it in the first place? Thanks in advance. [link] [comments] |
Posted: 26 Dec 2018 09:45 AM PST First of all, I would like to say I cannot possibly comprehend how is it possible. The level of incompetence it takes to do something like this is truly unsettling. I moved to NYC only two months ago from another state and I finally decided to get the state's driving license. I did everything right: set an appointment, gathered all the documents, etc. On the set day, which was this Friday, I come in and they serve me right away. I submit all the documents to the worker and she approves that everything is good. That's when the fun part begins. Here I need to say I am a permanent resident. They gave all my docs, old driver license, social security and took my green card saying a supervisor needs to verify it. I take a sit close by to wait, and I wait and wait... From the start, I didn't like the whole thing. It should take them a second to take a copy of the card and give it back to me. Instead, the woman who worked on my file placed on the supervisor's desk like it was nothing serious and asked me to sit down. While I waited I started to notice commotion going around. It looked like they were searching for something in the office. From that very moment, I knew what happened. After an hour and a half of me waiting, the supervisor called me to the desk and informed me that they lost my most valuable document in this country. Furthermore, they think they gave it to a complete stranger who was in line after me. I kind of freaked out although I think I should've been more dramatic and vocal to get things done. They assured me that they are doing everything to retrieve it; said that they are trying to call the guy who they think accidentally took it but he doesn't pick up the phone. Now, this part of the story I don't completely believe. Why would they look around the office for it if they know the guy has it? Anyhow, I said fine and that I would wait for the call on Monday. I was worried about it all weekend I received a call confirming all my fears. Once again they said they had no luck contacting the guy who accidentally took it. At this point, I lost all hope to get it back this way. The worst part is that the timing of it couldn't be worse. I am planning to go back to college and in order to get in-state tuition, I have to get NYC driving license to prove my state residence one year before classes begin. Guess what? No more registering for spring 2020 classes or getting in-state tuition if I don't retrieve it before January 15th. I am going back there today to take the names of supervisors and women whom I was dealing with. I feel it shouldn't be my problem in the first place and the people responsible need to face consequences. How state institution can take my federally issued document and lose it? I know they messed up big time and I can get them at least fired. The question is can I actually sue? What else can I do? Sorry for grammar and punctuation in advance. English is not my first language. [link] [comments] |
Posted: 26 Dec 2018 09:40 AM PST I live in Lafayette, IN. I rented a carport in my apartment. However, the apartment was sold to another management company, and the new company said they "did not receive any documentation regarding future carport reservations." They sent out a letter to all tenants on 11/26, saying we should contact them if we wish to park in the carport, and then posted a sign on our car on 12/5. However, I was out of town during that period, and they towed our car from the carport on 12/7. I did mention my absence to the previous company, but not the current one. I have contacted them several times but they have refused to refund the towing fee, as well as the carport fee for December. I am not sure but I believe the towing is illegal as they need a 30-day notice to change the lease, and it is stated in the lease that I am renting a carport. If I take them to the small-claim court, will I have a case? Will I be able to also ask for court/attorney fees? What are some possible ways to proceed? I cannot find a rental board or similar for Indiana, but maybe I simply missed it. Are there other non-profit organization or government department that will deal with this? Also, is it a good idea to take legal actions now or should I wait until my current lease is up and I have moved out? [link] [comments] |
Unwanted touching from Coworker's Husband Posted: 26 Dec 2018 04:00 AM PST Since before my time at this company, my coworker's husband drops and picks her up from work. Roughly an hour before her shift is over though, he'd come into the office to say hi to EVERYONE, distracting them, sometimes even telling them how he could do their job better (he does not have a job). He makes it a point to hug every girl, including me. I and the other girls would have earbuds in, be on the phone, just focused on work but that doesn't stop him. It got uncomfortable (seriously, at your wife's place of work you have to hug every chick?), so one day I told him that he can't come to my desk to interrupt me just for a hug anymore. Call me a prick, prude, stick up my ass, whatever. He said alright, sorry for bothering. Few weeks passed; no hugs, no interruptions. Awesome! Until one day, with my back turned and earbuds in, he comes into the office and strokes the middle of my back from base of my back... and I turned around right when he got to my mid back. I told him to never touch me again. Next day I complained to my boss and he told the creep to never come inside the office again (he also advised the coworker). A year later, the creep is back in the office, giving other girls hugs while completely avoiding me. It came to a point where I refuse to attend group outings and events where he'd show up. He's gross, disgusting, and just a jerk for continuing to be a creep in front of his wife. It is sexual harassment, right!?!? Not sure if it is quite workplace harassment but I think the boss should be more proactive to keep that douche outside of the office and events. Can I tell the coworker that her husband is not allowed to come to the events? She'll defend him though... what is the legality here? It's just wrong that I (who actually works for these people) is too uncomfortable around him but it's totally okay with them that he comes around. Edit: should I warn the other girls? Idk if they are feeling creeped out as well. Edit: I'm in California working for a government entity. [link] [comments] |
Landlord's Dog keeps attacking / being aggressive to my service dog Posted: 26 Dec 2018 08:37 AM PST Hey y'all, I moved to Arkansas in June and my service dog has been attacked by my landlord's dog several times. I live in the garage apartment just feet away from his main residence. He allows his dog to be outside and roam wherever he wants. He will come up to the second floor of my apartment and bark and growl at my dog. They have been in multiple fights and his dog is still very aggressive to my dog with no provocation. I am fearful for my dog's safety and my dog has not been acting normal, stays on the second level of the garage apartment, and is very cautious when he goes outside to use the restroom. I have had to physically pull the dogs apart when his dog attacks my dog - and he has even left a scar on his ear/face. I am very non confrontational and I have contacted the Fair Housing Commission in Arkansas and they said they would get back to me in a few weeks whether or not they can start an investigation. I told them that I would like to get out of my lease because Arkansas laws are not friendly to tenants. I am not sure what the outcome of this is. After talking to FHC, I called my landlord and told him I wanted to get out of my lease due to the safety of my service dog. He definitely down played that attacks his dog has committed but agreed to let me out of the lease (through texts) and said he wanted in writing my 30 days notice and a written statement that we both mutually agree to dissolve the lease. This has been over a week, and he has not signed the statement of dissolving the lease but now has my written statement of me giving my 30 days notice. It's $1600 to move out of my lease early - something I cannot afford. Is it possible to take this man to court about the safety over the property and his dog and dissolve the lease this way? I am sure, at this point, has tricked me into giving my 30 Days notice without signing the appropriate paper to dissolve my lease. PS. During July, I had some coworkers over and his dog was attacking aggressive to my coworker's toddlers and he had to kick them off. [link] [comments] |
Is this considered stalking in NC Posted: 26 Dec 2018 06:17 AM PST So me and my wife have been together for almost 5 years. She has 4 children from her previous marriage and we have one together. Since me and my wife have been together he has been a very adamant on knowing exactly where we live. He used to call the police to our last address for no reason and sometimes would park across the street and just watched our house. We decided we didn't want him knowing where he lived anymore so we moved about an hour away from where we stayed last. It's been about 5 months but over that time he has constantly harassed the children and my wife through emails to try and get our address. Last night we picked up the children from the police station as we have them every other week per the custody agreement. We found out last week that he had installed a gps locator on our oldest daughters phone. So last night before I got back home with them, about 10 minutes away, I got her phone and deleted the app and cut off her location. Around 20 minutes later, without me or my wife's knowledge he called our daughter and asked her if the app had been deleted. She said yes. Then he sent her a satellite google image of the neighborhood that we live in and asked her if that neighborhood was where we lived and she told him yes. Then he told her to delete the picture. She did. Then she sent him 4 separate messages saying that she hopes he isn't being creepy and stuff like that. He never responded. Now at this point we have moved 2 times in about 3 years with the attempt of getting away from him. He doesn't know exactly what our address is but he is obviously doing everything in his power to find out. He's involving our children in this scheme and my wife is getting terrified. He's acting very unpredictable and he's being scary towards the children as well to get this address. I had our daughter screenshot the text conversation of him asking if this was our neighborhood and then asking her to delete the picture. I'm wondering if that is enough to be considered stalking and if there's anything we can do about this behavior of his. [link] [comments] |
My ex brother-in-law got a ticket in my car and he refuses to pay the $400 ticket. Posted: 26 Dec 2018 12:29 PM PST Is there anything I can do at this point or will I be forced to pay it myself? I dont currently have a job, although I am looking, what should I do? Edit: I live in California, USA. We are both above the age of 21. Edit 2: It is two parking tickets that kept adding up due to never getting paid. [link] [comments] |
Didn’t get the motorcycle I paid for. Posted: 26 Dec 2018 07:25 AM PST Basically I went to a dealership to buy a motorcycle and bought what they displayed as a 2017 Sv650 with ABS. That is the model (sv650Al7) that shows up on their bill of sale on receipts. The issue is the motorcycle they gave me is the non-ABS version that comes with a different model number (sv650l7). That is the model I have on my financing contract also. To make things worse the bill of sale reported to the state has another completely different model (sfv650). The only thing that does make sense is that the VIN is the same on each form. The transaction date was 11/17 and I didn't figure it all out till now. What can I actually do about this? Edit: This all happened in Las Vegas, Nevada [link] [comments] |
