Legal Advice I think my dads company is responsible for his death [California]

I think my dads company is responsible for his death [California]

    Posted: 07 Dec 2018 02:49 AM PST

My dad passed away last week while at work. He had a massive heart attack. He was in the bathroom while the attack happened and he tried calling 911 repeatedly. Here's the thing though, 6 months ago, his company installed some kind of signal blocking device in the bathrooms because employees were going to the toilet and browsing the internet.

The doctors say that if he'd received medical attention within 20 minutes he might've made it but they didn't find him until almost 2 hours after he'd passed. Last month, there was a nasty car wreck just outside his office and apparently ambulances were on the scene within 10 minutes so I'm sure that if he'd been able to make the call, he might've lived.

I spoke to the company and they've told me to get lost, saying it's private property and they're well within their rights to use jammers how they please. Is that true? I'm struggling with the funeral costs as it is, I can't afford a lawyer, especially if it's going to go nowhere.

Hired a housecleaner. She left without cleaning because she was afraid of pets but wants me to pay anyway (North Carolina)

    Posted: 07 Dec 2018 06:25 AM PST

I hired a cleaner for a deep cleaning service. I have two pets in my house and apparently the cleaner is terrified of animals. She didn't ask about pets before coming and I didn't think to mention it; the animals are well behaved and mostly ignore visitors.

I have security cameras and can see that the animals didn't act aggressively towards her or threaten her in any way, one was in his cage and the other was sleeping on the couch. On the video she comes into the house, starts unpacking her supplies, notices the animals, then grabs her things and runs back outside.

I obviously don't want to pay her because she didn't clean anything. She says she is entitled to payment because of her time and travel. She is threatening to take me to court for the $300 cleaning fee. Do I have to pay?

    Sexual harassment update 2

    Posted: 07 Dec 2018 09:25 AM PST

Here is the first post: https://www.reddit.com/r/legaladvice/comments/9ycfw6/is_this_sexual_harassment_will_i_also_get_in/

Hi, after my dad and me talked to the cops he was able to get a lawyer that helped us a lot more than the police. He said i can't talk about the details of the case with anybody but he said he's confident that we will win the case and that my manager should go to jail. I'm still really scared that the story will end up on the news or something and I don't know how to stop that from happening but as of right now everything is ok. Thank you to everybody who has been DMing me positive things, I really appreciate it. I have also gotten quite a few messages from people from here and best of legal advice asking me for nudes and stuff and I reported them all so hopefully they won't bother anybody else here. Thank you everybody for your help 💕

idk why i still have to add my location but i'm still in Maine

Who do I sue to try and get back my family's 1971 Corvette and what is my best remedy?

    Posted: 07 Dec 2018 09:09 AM PST

Hello! A quick summary can be found at the end of the post for those who only want the short facts!

My father, older brother, and I bought what we thought was a 1972 Corvette at an estate sale in mid to late 2013. It clearly was the decedent's project car as it was mostly just a frame with a body and boxes of pieces, parts, bolts etc stacked around and in the car.

Fast forward a few weeks of wrenching and we slowly start to realize this is more likely to be a 1971 Corvette and not a 1972 Corvette as our title claims. According to the engine block VIN it is a 1971 engine. According to some stylistic indications (such as amber reflectors rather than clear) and suspension adjustments from one year to the next we are convinced this a 1971 Corvette and not what our title says.

Why go to all of this work? Isnt there an easier way? Yes. Every Corvette in this vintage had a VIN tag in the doorjamb that ties the engine to the paint color, to the interior color, and what plant made it back in the day. Ours was non-existent. Whether it never got taken out of the garage where we purchased the car, or the owner before us never had it we are unsure; regardless it isn't anywhere to be found. This left us with 2 options to try and find the true production number of this car: there was a sticker on the gas tank that if intact would have the whole VIN; and the VIN was stamped into the frame rails of the car under the body. Since the gas tank was easily examinable we started there and it clearly wasn't attached as it was in worse shape than most things from the 70's.

We decide to pursue option 2 and check the frame rails under the body to see if the frame is in fact a 1971 VIN. After removing the body we find a clearly hand-stamped frame rail that denotes this car was under repair (based on the welding reinforcements) and reinforces our idea that the engine and frame are in fact a 1971 Corvette as whoever did the repair said it was and tried to stamp the correct VIN back into the rail after doing some serious repair. As a result of trusting the hand-made VIN on the frame combined with our knowledge of the body's cues of being a '71 and our engine VIN being similar we believed we had enough evidence to say this was a 1971.

We then spend the next 4 years fixing up, making adjustments, and spicing up our once turd of a car. It has $70,000+ worth of expenses put into it (honestly it could be over 75k if we count labor or do a more in depth review of our expenses).

Now we want to try and get this car road-ready by registering it under the correct title which we don't own. The Secretary of State(DMV) says we need an officer to come out to check the car and make sure the VIN is verified and is road-legal (i.e. seatbelts and mirrors etc.). The Chief is convinced we have the correct car and signs off on the VIN verification form. He also does a quick search via his database and has no issues with the VIN. My father than goes back to the Secretary of State to correct his title to say what we want/need it to say for it to be a '71. Then the unthinkable happens.

After receiving the title from the Secretary of State in the mail the Michigan State Police show up at my parent's home where the Corvette is kept. Unbeknownst to us (and apparently the local chief) the car VIN we registered for was reported stolen in 1999. It was then taken by the insurance company claiming to be the owners of such a vehicle. For the last month it has been kept away from us at the Police impound lot where the local officers reassure us it will be garage kept as they know how much it means to our family.

The insurance adjuster who got our car/case (whatever its called in their world!) explains that the 'loss' for the vehicle has already been eaten as its rarely the case that a 20 year old stolen vehicle resurfaces. He also said he is unsure of the process going forward. As of today's date of posting they have moved the car from the police impound garage to their own garage and have said to have taken title to the car. They continue to tell us it won't be sold and that we may keep in contact with them as they resolve this issue. Regardless, me, my brother, and father believe the worst is imminent. Who should we sue to get it back?

    Quick Summary:
-My Dad, brother, and I bought a 1972 Corvette at an estate sale.

-Learned it is likely a 1971 and get it re-titled through the Secretary of State.

-Police arrive after our title comes in the mail and claim vehicle was stolen in 1999.

-Insurance company who 'owns' the vehicle impounds it and puts title in their name,

-How can I get it back? Who should I go after?

sudden eviction notice? emergency help (Maine)

    Posted: 07 Dec 2018 08:53 AM PST

I was just served an eviction notice with a court date by the sheriff this morning. The notice says I received a notice of termination in november and refused to leave the premises- this is the first time I am hearing about this. I never got this letter or a phone call and my landlord never mentioned anything when I have dropped off rent these last few months.

the reason listed is a default of rent for 1 month- which was paid. I do not have receipts from the landlord directly but I do always pay with a bank check (like, printed out at the bank and handed in directly). I havent even ever been late paying rent.

We are on section 8, I have a disability (ptsd-SSDI/SSI im not all that sure which one I have) and have 2 small children. 1 year old and a 5 year old...... my 5 year old has non verbal autism and we are currently in the middle of negotiations with the school district because of some IEP problems. Literally the only thing that I can see him getting upset with is our security deposit..... he moved us in without the security deposit paid in full and we've been paying a little bit extra here and there as we can. Landlord never expressed a concern with this and nothing was ever put in the lease for a payment plan for that.

I have called the section 8 offices (waiting for a call back) and my daughters case worker (gave verbal permission to talk to landlord on our behalf to get some information). I haven't spoken to the landlord yet and unsure if I should. Will be calling for a lawyer on monday hopefully.

if we have to move my daughter loses all of her support system (school district and in home support) let alone the fact that we don't have any family and its in the 20s outside. I am at a complete loss right now and I am panicked.

(Western Australia) Hospital provided incorrect and concerning information to my psychiatrist.

    Posted: 07 Dec 2018 03:26 AM PST

Hi all, I was a voluntary psychiatric patient at a public hospital in WA, I came in of my own free will with suicidal ideation. I've since transferred to a private clinic to finish up with some therapy - on admission to the clinic, My private psychiatrist said that the hospital had emailed him directly that I was a violent and agitated patient, and had walked onto the nurse's station with a rope threatening suicide. None of that was true. You can't get rope onto the ward, and the nurse's station is a locked fishbowl style of station - patients cannot walk in. There was another patient with a similar name, and he may very well have done so in the past, but he is a low IQ and barely functioning person. The nurses would often get us confused, and the night before I left, they burst into my room claiming that I was about to hang myself with a belt. I never even brought a belt onto the ward, and would have told them if I wasn't feeling so great. I'm extremely lucky that my psychiatrist didn't believe them, I would have been looking at being made an involuntary patient about now if I'd stayed there.

I would like to make a formal complaint to the hospital, and any relevant licensing bodies. Do you have any idea where I should begin?

    Boudoir Photos as an Ad

    Posted: 07 Dec 2018 12:01 PM PST

Not sure if this goes here but I'm looking for the best advise. I am located in Arizona!

I took some boudoir photos last year and paid for them, so they weren't free photos. When the photographer wanted to post a sneak peak, they specifically asked for my permission to post that one picture in a private group which I agreed to.

She is now using a DIFFERENT photo that I DID NOT approve or give permission on for an AD on her Facebook page for boudoir shoot. Does she have the rights to do this, even without my permission?

These photos were taken for my husband and I did not want everyone to see. I only gave her permission for one specific photo... but can she really use any of them?? HELP PLEASE

Former employer is planning to close all locations, still selling 6-12 month packages. Is there an agency I can report them to?

    Posted: 07 Dec 2018 10:46 AM PST

Throwaway account because my main has personal info. I just recently left a job at a salon in town that has 5 locations total. At our last management meeting before I left we were told the stores would likely be closing in January/February, but definitely by March/April. Their sales have been declining for years and they also closed three other locations this past year.

We sell packages there, some of which are prepaid 6-12 month packages. They are still selling these 12 month packages knowing they will be closing within 5 months. This seems extremely unethical to me. So my question is just, is there an agency or something I can report them to? They've been in talks with their landlords about ending their leases, so I know they are serious about closing down. People are spending up to $700 on a 12 month package that they will only be able to use for a few months. I don't know if this would be illegal, but it does at least seem unethical and wrong.

Mother wants to bar me from school

    Posted: 07 Dec 2018 07:19 AM PST

This is in NY, United States.

I have been really lacking in school. I have been missing my work because there is too much on my plate. My parents were called to parent teacher conference to deal with the issue. A punishment was dished out, and if I miss any more work, my electronics will be taken away, so on so forth, though most my homework is based around electronic work, but whatever.

I live with both my mother and my father. High school is living hell. My mother was especially angry as to my work being missed (though she sets an impossible curfew for me to meet with all the work I have to do). She yells at me constantly for the littlest reasons.

A few days ago, she threatened to bar me from school and force me to stay home and do chores for the rest of my life. She threatened to go to the principal and sign me out of school permanently and stop me from entering 11th grade and graduate from high school.

Can someone tell me if this is possible? I want to stay in school and work to a college degree in research, but I'm afraid that she might crush those dreams. I think that without my consent she cannot do anything, but I'm not sure.

Note: I'm doing fine in terms of tests. I'm passing with good grades. It's just homework that I can't complete in time because of the strict curfew.

EDIT: since people are confused, I'll elaborate.

No, my mom doesn't want to pull me out to be homeschooled. She wants to pull me out permanently so I can't go to school and there is no chance for me to receive my 11th and 12th grade education. It's a threat, but I think she might be able to carry it out without my consent.

In her own words: "You haven't been doing your work. You don't deserve to go to school. I'm gonna go to your principal and pull you out of school, whether or not you like it. You're gonna stay home and do chores while I go out and work. Do you know how many people are dying for an education?" And so on and so forth.

So the question is: is she legally allowed to pull me out of school without my consent saying "yes, I want to drop out of school."

TL;DR- my mom is threatening to pull me out of school because I haven't been getting time to do all my homework. My question is- is she allowed to pull me out of school without my permission?

Landlord sold house to another management company. Is charging me a full month for not giving 30 day notice.

    Posted: 07 Dec 2018 05:25 AM PST

So as a good tenet and as I like to stay on top of my bills, I pay a month forward. So on Nov 1st I payed for the full month of Dec. On the December 5th I received an e-mail from my landlord saying that they have sold my property to another management company and I'm to see to them for all future payments. My lease is up Dec 9, and I payed the full rent of Dec with intentions to stay. When I heard they sold to another company, I figured my lease with them would be terminated on the 9th and I would have a new one with the new company. So I contacted my old leasing company to have them send back the prorated amount that I had over given them, to which they told me I failed to give them 30 day notice of leave. They have left me in the dark. I have all email and every letter they have sent me. All indicate that I'm to rent from this new company. I live in Indiana. Is there any laws or anything that could help me? It just doesn't make sense to me that they can charge me 30 days when they are no longer the company that owns the property.

About a waitress changing the tip amount on receipt

    Posted: 07 Dec 2018 09:43 AM PST

[Virginia] A waitress wrote in a higher tip on the customer copy receipt and forged my signature. The merchant copy that I had signed is nowhere to be found (she probably discarded it).
My question is: how can I press charges? I know it's extra to do that, but I'm not asking about if I should be nice. I'm wondering what I can technically do to make sure she's charged with a crime (what crime is it)?
The only proof I have is a photo of the customer copy receipt she forged.. restaurants shouldn't be cashing customer copies, right?

[USA - PA] My GF's mom is about to be incapacitated. Her other children have robbed her few assets. She wants my GF to become her lgal power of attorney.

    Posted: 07 Dec 2018 07:17 AM PST

USA - PA, my girlfriend's mother has asked us to take power of attorney over her. Her other children regularly take advantage of her. one of them put a car in her name, had her get the insurance and title and now her other car got repossessed. Obviously she requires the new car to get groceries and have a standard of living. The son will not turn the car back over, claims it's his. Title, registration and insurance are in her name. She has a valid license.

I found the following forms below, we will take her to the notary sit down and read each aloud and make sure she and my girlfriend both understand their powers and duties.I will have 2 impartial witnesses(just whoever is there at the notary) and we are already prepared to have a bank account set up that will be solely for her mother.

Can someone tell me if i'm doing this right? Will this stand up in court/hospital/police station? Trust me when i say these other siblings are going to haul us into court over this and it is what her mother wants.

She has a lawyer but he charges her an arm and a leg. The attorney also took more than 50% or so of her settlement she got for bodily injury at a nail salon. But were not sure since we have no access to her records and can't call and find out.

She is slipping into dementia, it is not bad enough yet she is incapacitated but she will be within a few years. My Gf's mom has a lot of debt, will that debt be transferred to us if we assume POA? Can we look into bankruptcy proceedings on her behalf?

Also, my girlfriend does not have a license so it may be that i am the one who does vehicle power of attorney.

    Vehicle Power of Attorney

    Durable Power of Attorney

    Healthcare Power of Attorney

    Thanks,

I was fired from work because I chose not to accept an apology.

    Posted: 07 Dec 2018 11:33 AM PST

Here in Phoenix, AZ, I got into a bit of conflict with one of the Team Leaders here at this retail store that I work with. With our store, Team Leaders aren't legitimate bosses or managers and they certainly don't have the power to fire anyone or make big moves like that, but they still hold some power and authority over regular team members like myself.

One of the Team Leads came up to me while I was on break and he instantly accused me of not doing something that he asked me to do. He had asked me to set up an endcap of Christmas themed beauty products and he started telling me to set it up. I had clearly set it up the day before and I told him to go check again since he was probably looking at the wrong spot. But he said "I don't make mistakes, you fucking idiot." He then started yelling at me and telling me that I don't know what I was talking about and he just walked off fuming and clearly letting his anger get the best of him. Later in the day, he found me and he admitted that he overlooked the endcap that I set up and that he was indeed looking in the wrong spot. He apologized to me and held out his hand for me to shake, but I told him that I don't accept his apology and that he needs to control his anger and just do a better job as a Team Leader in general. He gave me a really dirty look and walked off.

Near the end of my shift, I was called into my actual bosses office and he fired me for "creating conflict" with my Team Leader. My boss told me that I should've accepted his apology, but I retorted that he shouldn't have made false accusations against me and called me a fucking idiot. My boss said that he doesn't care about what happened and he was talking as if I was the one started the whole incident. He big me goodbye and that was that.

I mean, come on. Can I really be fired over this? My Team Leader was clearly the instigator in this whole episode and I don't see why I'm the one who "created conflict". Sure, I didn't accept his apology, but is that really a bad move on my part? I would think that my Team Lead did far worse in all of this. Can I fight this in any way?

[AUS] Can I sue my parents for sending my nudes to my entire family?

    Posted: 07 Dec 2018 01:25 PM PST

So back when I was 16 my stepdad molested me, I pressed charges but had to drop them because my mother accessed my personal conversations with my [now ex] girlfriend and used photos I sent my ex as a leverage.

I'm now in my twenties and during a short conversation with my aunt she mentioned that she had seen those photos ( my stepdad mentioned in the past that he printed my entire Facebook inbox. )

Is there anything I can do?

[California] Out of state hold preventing me from renewing driver's license. Police from out of state seem to not want to help me, still no resolution after 5 months!

    Posted: 07 Dec 2018 07:02 AM PST

Where to begin? So i go into the DMV to try and renew my license because it was expired but the DMV tells me that it's not possible because an out of state hold (from Phoenix, AZ) is preventing me from doing that. I get a hold of the Phoenix DMV and they point me to Phoenix police because apparently the hold was put in place due to a traffic violation. I get a report# and get in touch with a receptionist in the Vehicular Homicide Unit. I tell her I've never been to Arizona and have no idea why they put a hold on my driver's license so she tells me she'll send me a False Information packet so i can provide things like my fingerprints (so they can compare them to the suspect's prints that were taken at the scene of the crime), a copy of my driver's license, a current photo of myself, a statement saying I've never been to Arizona and lastly a notorized copy of my signature. After gathering all this stuff and sending it out to them i follow up to find out a detective has been assigned to my case and try to contact him but never hear back from him. I leave multiple voicemails and months later still nothing so i contact his supervisor via email and CC the detective assigned to my case and let them know I've been trying to get a hold of them for months but to no avail. Still nothing. Five months later and not a single word from anyone at Phoenix PD.

So last week i get the Lieutenant on the phone and explain my situation to him but he sounds completely annoyed and inconvenienced by my phone call; he may have said the phrase " and what would you like me to do about it sir?" maybe three or four times. Finally, he assures me that the detective will give me a call this week but it is now Friday and i fear i am just getting the run around. After i post this i plan on calling the chief of the department and will also file a complaint.

Is this enough action on my part? Should i get a lawyer? As I'm waiting for this to be resolved i drive around with an expired license and my fear is I'll be pulled over and arrested. Oh yeah, local law enforcement has been super unhelpful as well and basically want me to deal with Phoenix.

    Please help!

Edit: sorry about the huge wall of text, i hope everything makes sense

Edit 2: i lost my driver's license years ago and didn't report it, only ordered a new one. My guess is someone picked it up and provided that when they got in the accident in Phoenix

Previous employer using my old email and pretending to be me

    Posted: 07 Dec 2018 01:11 AM PST

I used to work for my Dad, and during this time I was aware that he would send emails from past employees emails pretending to be them, I would call him out on it and he would continue anyway.

I was on as a director, and in August I had enough of working for him, we had a falling out and I left. Before I left I deleted my email address, as I knew he would still try to use this. I have now found out he has created a new email address for the company using my name and continues to use this.

I am unsure who he currently contacts with it, what can I do about this? He is a compulsive liar and if I call him out on this he will either say it doesn't exist, or say he has deleted the email and continue anyway.

EDIT: I am in the UK, for reference.

My job didn't pay us today, and it's pay day. What should I do?

    Posted: 07 Dec 2018 09:33 AM PST

I was supposed to get paid this morning and I received no direct deposit. I waited a little later in the day and still nothing so I contacted my bank and they said there was no activity. No checks were deposited, or anything. I proceeded to call my work and ask what was up, both of my managers weren't available to talk to. Front desk answered and said they were out. Whoever was working front desk also told me he did not receive any pay either. So I proceeded to call corporate, and literally was sent straight to voicemail. I'm so furious. I have tried contacting them several times, my managers and HR but they are not responding. I need my money, I have bills to pay off and I would like to know what to do from here. Can anyone help me out on this? I have no idea how to proceed.

EDIT: I live in the US. Illinois to be more specific.

AND this is the second time this month they have given us late checks. Ridiculous.

I'm getting scammed by the US postal service and wondering if there's any accountability with a government agency like that.

    Posted: 07 Dec 2018 09:58 AM PST

Apologies if this isn't the correct sub but don't know any others where I can ask this.

I ship a lot of things via the postal service for my business. Everything had been great with them for 6 years. Recently this past few months, I've been getting bills from them for "overweight fees" and they claim I'm putting the incorrect weight on my packages. The fees are ridiculous, one package was a $6 extra fee for only being 2 ounces overweight! That's almost the full price to ship another whole package.

I thought maybe my scales were off, so I tested them with weights, but they were accurate. So I bought new scales just in case the weights weren't right. Tested those too.

A few days ago I weighed a package for 1lbs 8 oz. For shits and giggles, I put the package as 2lbs on the label (much higher than it really was) AND THEY STILL CHARGED ME AND CLAIMED THE PACKAGE WAS 2LBS 6OZ.

So I'm convinced at this point that either they are trying to scam me, or that THEIR SCALES are wrong.

Problem is I don't even know where in the process they are weighing things and charging me. I asked my mailman (he picks everything up from my business) and he said he wasn't sure and that it gets weighed for accuracy somewhere in a facility.

I tried calling my local post office and they were clueless and said they do weigh it there when they get it in but they said they don't remember having anything overweight from my address so it must be happening further along in the shipping process.

I called their 800 number in DC I think and the lady on the phone basically told me their scales are always accurate and accused ME of trying to scam them for lower shipping rates.

So at this point im just wondering if anyone has any advice. I don't know who else I can call to get ahold of a decision maker of some sort that can investigate this issue.

So far in the last 3 months I've been charged almost $500 in overage fees. I'm not sure if small claims court is even an option here when dealing witha government agency. And I'm not sure I have really any realistic way of proving anything.

Edit to add: I know a lot of people are going to say use FedEx or UPS but that's not realistic for what I'm shipping, most of my customers request postal service

MN - Can I be required to pay for the birth of my son if my girlfriend is on state healthcare?

Alright, so my girlfriend is entering her 3rd trimester of pregnancy. She is unemployed right now and has state health insurance. I work full time and have insurance through my company, however she is not on my plan as we are not married nor do I think she would qualify as a domestic partner as we haven't been living together for 6 months.

Yesterday a friend of mine mentioned that I should check into this as he seems to think it's possible that because I'm employed that if I sign the birth certificate the state will come after me to pay the costs of the child's birth.

I contacted another friend of mine who went through this exact situation with his gf and he showed me a horrifying bill. But said that neither he, nor she were asked to pay a dime of it, and that the state covered it completely. Now he also mentioned that he wasn't making much money at all during that time.

I have no idea how this works, or who to even ask about this. I very much want to be the legal guardian of this child and plan to be a part of my child's life indefinitely, I'm a bit nervous right now however that by signing the paper that legally makes me the father I'm opting into a massive bill that I cannot afford for the birth of the child.

I don't need to hear about how signing opts me into child support in the event we split up...I'm not worried about that and understand that. I'm only curious about the birthing bill.

    Thanks!

TL;DR: Girlfriend (legally single) is pregnant, unemployed, and on state healthcare. I (legally single) am employed and on my company's insurance. If I sign the birth certificate can her insurance company come after me to pay the bill for our child's birth?

Neighbor with Mental Illness is letting homeless people live in the shed in her backyard and they are harassing me and my family when we go in our backyard.

    Posted: 07 Dec 2018 12:50 PM PST

This is a complicated situation so I'll give the back story.

I purchased my first home 6 months ago in a recently gentrified neighborhood in Downtown Phoenix, Arizona. Within the first 2 weeks of moving into my home I discovered that my neighbor is a bipolar schizophrenic with over 8 assault charges and multiple trespassing charges over the past 2 years (All of which were dropped because she was deemed incompetent during court ordered mental examinations). She is an elderly woman who primarily speaks Cantonese and is very hard to understand. She wanders the neighborhood and attempts to walk into any opening she can find (unlocked doors, open gates to backyards, etc...). The only intelligible english she speaks is verbal harassment to me and my girlfriend (calling us a fing son of a b* when we walk our dog or go out to our cars).

After about a month of living in the home she started knocking on our door and then banging on our windows in the middle of the night when we wouldn't answer the door. For two weeks we were calling the police every other night because she would continue this behavior. She would turn our door handle and try and let herself in and then get angry and start screaming while banging on windows/doors/etc. For every incident we would first call the police, then call her ACT Team's on call number and finally call her daughter who the police put us in touch with since she was her legal guardian. Finally after 2 weeks of incidents and no sleep she was taken to Involuntary Psychiatric Care. Then things went quiet for a few months and we stopped seeing her and she left us alone.

Fast-forward to two weeks ago. She recently started letting multiple homeless people live with her (at least 1 inside of her home, and at least 2 in the dilapidated shed in her backyard). We are unsure what she has told them but for multiple nights the past few weeks these people have aggressively harassed me and my girlfriend over the fence whenever we take our dog out or do anything in our backyard. They tell us to "keep our eyes to ourselves" and that "we better not be going over there because their dog is vicious and they can't stop him" and that she's told them about us "and that they don't like the way we treat her" all in a very aggressive and confrontational manner. The shed entrance is literally right on our fence so they hear us every time we open the door and immediately come out and start watch us/ make comments.

    To clarify a few things:

    • I know for fact they are homeless because her daughter told us and they have started collecting trash, food, blankets, clothing and more in the alleyway behind our homes.
    • Her daughter has been trying to get her state provided inpatient care for years but keeps getting denied because her mom has not threatened her own life or that of others (somehow the multiple assault charges don't apply here?)
    • The daughter and I believe the homeless people are clearly taking advantage of a mentally ill woman and they are very aggressive because me calling the police and reporting her behavior threatens their free place to live.
    • I do not have a restraining order against her. The police recommended this but since she was taken to IPC we have not had another issue with her directly. It's as if she's having other's harass us for her.
    • I have called the police every time the homeless people in the backyard have harassed myself or my girlfriend. They show up and say there's not much they can do but go talk to them which does us no good. This is the same thing the police would do when she was banging on our windows, doors, etc. The police seem very tired of dealing with her and many officers who respond tell us they have been dealing with her for years and that she generates multiple 911 calls a week (from other's in the neighborhood).
    • I am certainly not the only one she has harassed, but I get it worse than anyone since she is my direct neighbor.
    • I have invested over $5000 in large shrubs and trees to try and create natural privacy in our yards, but the homeless living with her still hear us and find a hole to start harassing us.
    • I have multiple video cameras recording audio/video 24/7 so I have full evidence of every incident that has occurred since we moved in.
    • She is not the homeowner. According to her daughter the homeowners are her Aunt and Uncle but they want "nothing to do with the situation and are only letting her live their so she isn't in the streets".

It's become so bad that my Girlfriend is afraid to stay at our home alone and afraid to take our dog out. I went and purchased a firearm and got my CCW license just because I feel so unsafe going outside in my yard or in the alley (We have an alley facing garage). Her daughter sympathizes but says there is nothing she can do and blames the state/her mother's ACT team. The ACT team blames the state. and the Police seem to suggest that the daughter is protecting her. I feel so powerless and so uncomfortable knowing I am living next to someone so unstable who is also encouraging threatening characters to harass me and my girlfriend. Do I have any legal action I can take to help rectify this situation or am I screwed until something much worse happens?

Thank you so much for taking the time to read provide any insight!

[Maryland] Piercing ears without proper license

    Posted: 07 Dec 2018 07:07 AM PST

I live in the dorms at a college in Baltimore, Maryland, and a few days ago my friends and I were bored and some of them decided they wanted their ears pierced. We got the needles and proper sanitizing agents, and did the deed. We pierced 3 peoples ears in the dorm room and they all turned out well and are uninfected. All of those who got their ears pierced are 18+. We heard talk of an RA reporting us to the campus police for "illegally piercing ears". I've never thought of this to be against the law. Is there anything they can charge us with?

Edit: Looked over the rights and responsibilities guide for the residence halls at our school. It includes nothing about piercing ears.

Is step-parent adoption still required for a married lesbian couple?

    Posted: 07 Dec 2018 12:41 PM PST

Most of the advice I've been able to find from local advocacy groups was written before Obergefell v. Hodges.

I live in Virginia. My wife and I (gay women) want to start our family. Since 2015, my state has permitted married same-sex parents to both put their names on the birth certificate. I'll carry both kids, but one will be biologically related to her and one won't be. (Or that's the plan!) We are planning to work with a fertility clinic.

Isn't that enough/do we really need to ALSO hire a lawyer? I keep reading all of these guides saying that we need to proceed with second-parent adoption, that my partner would not be ~really legally truly~ a parent to our kids, and that she will need to adopt our kids in order to be OFFICIALLY REALLY FOR TRUTH their parent. But if we're married, and her name is on the birth certificate, and we went through a fertility clinic, and one of the kids is biologically related to her anyway...in what capacity is she not a parent? I'm worried about:

    • medical decision-making
    • our custody rights in case of death, given that her family is problematically homophobic
    • our custody/child support rights/responsibility in case of divorce
    • her ability to travel internationally with our kids

I know the advice here is almost always "consult a lawyer", but...do we really need to pay to consult a lawyer if we do everything else "the right way"? We're trying to figure out how to budget for this.

Am I allowed to record a conversation with my former boss(es) in person? I have not received any pay stubs, boss is ignoring phone calls. [QC]

    Posted: 07 Dec 2018 10:35 AM PST

The first two weeks of working I excused because there was an issue with my online account and the person who manages the pay stubs was on vacation. I was layed off a few weeks later and got no update after having reminded him two more times in person. This is frustrating.

And obviously, must they be informed? What other things should I do here?
