[UPDATE] [Texas] My Mom has my cat and has repeatedly sent threats all weekend claiming that she beheaded him. However, the police is still alive, and when I showed up to collect him, she refused to give him up. How can I get my cat back?

    Hello,

First off, thank you to those who commented with helpful advice. I didn't feel like advice to steal my cat back was 'legal' (thus, being in this subreddit), so I took one users advice to talk to the director of Animal Control in my mom's city.

She basically told me that the police have no idea what they're doing, especially when it comes to law regarding animals. She said that the only thing I can do to get them to understand is to report my cat as 'stolen property'. She said the police will understand what to do if a I reference my cat as 'property' and not an animal.

I went to the police station and the police threw me around again. Despite I tried to report stolen property, they got upset at me and claimed that a cat isn't 'property'. After 5 minutes of arguing, they send a cop out to the lobby and he agreed to read my mom's texts.

The cop read them and said that since she claimed that the cat is mine, and she told me to collect him, I can go to her house with a police officer and he will assist me in getting her to hand back over my 'stolen property'.

We get to my mom's house and she's not there. We look around the outside of her house and find no signs of Kitty either. I call her and ask her where she is, and told her that I was at her house with the police. She said, in quote, "I took the cat and ran off into Oklahoma and I'm not ever coming back."

The police said they can't help me since they don't have jurisdiction in Oklahoma.

I went to the courthouse to file a small claims against my mom, but the filing fee is $171.00, so I left because I can't afford it. On my way home, I contacted Adult Protective Services in one last ditch effort, but was on hold for over 3 hours. So I hung up and filed a complaint on their website.

I also called my grandparents and they were the ones who tipped my mom off, which is why she ran into Oklahoma. My mom played the 'poor me' card, so my family bought into it. And somehow, I'm now the bad guy in the situation who is trying to murder the cat... When I got home, I cut everyone out. All of my family. I separated every single tie I had to them.

I've had that cat since he was 2 days old, and if I'm being open about the situation, I was a victim of childhood abuse. That cat was the only thing who showed me love for most of my childhood and teen years, and it kills me I won't be able to get him back. I ended up hurting myself and had a nervous breakdown, and now I'm getting help for my own mental health. This situation broke me, and right now, I'm trying to recover.

    Thank you everyone for listening.

Tl;dr: My cat is gone and I'll never get him back.

Coworker gave me an edible and it took me to the emergency room FINAL UPDATE.

    Posted: 08 Nov 2018 08:42 AM PST

    He's been fired!

I came in to work today and had another meeting with my boss regarding the current edible incident. They've terminated my coworker and charges are being pressed. I asked my boss if it was possible to notify the dispensary since I personally want to do as much damage as I can to this guy. My boss took the time to call them and notify his manager. Did it have to go that far? No, but he sure as hell made sure it did.

I don't know if he's going to continue to be employed with them, but i'm glad this whole thing is over now. I've gotten no legal threats or text messages since yesterday and things seem fine.

That being said, thanks for all of your advice and responses!

I'm gonna go get a joint now to celebrate 😁

[Update] My landlord thinks I have a dog named Steve

    Posted: 07 Nov 2018 04:59 PM PST

Sorry - forgot to link my last post: https://www.reddit.com/r/legaladvice/comments/9spqbh/ny_im_being_evicted_for_violating_my_apartments

So - first off I wasn't totally honest about my relationship with my landlord. This was probably pretty obvious the more I commented but we're actually really close friends. Like I spend holidays with his family. So yeah, that's how I knew he wasn't just fucking me over to get more money.

Anyway, I met with a lawyer. I like him. He basically said the same thing as everyone here - NYC is really tenant friendly, and if this makes it to court (unlikely, you'll see why) it won't be hard to fight. I don't think I'd want to fight though. I probably have nothing to worry about but I would just peacefully move if it does happen.

The rest of this update isn't very legal. Sorry if that's against the rules.

So - I ended up calling 311 instead of Adult Protective Services since Google gave me a few different numbers. I must have described the situation really badly because they transferred me to Animal Care and Control twice and then I was distracted by a fire at work (that's not jargon - we were evacuated because of a fire on another floor. The story is they were making s'mores in a conference room).

This wasn't a call I wanted to make surrounded by all of my coworkers while we stood around outside so I texted his sister instead and we made plans to talk later. Long story short, she'd gotten some weird messages from him lately (like him congratulating her on a promotion then getting angry when she had no idea what he was talking about). Once she heard about Steve and the eviction, she made plans to fly out to us the next day.

This is getting long (sorry), so jumping a bit - she told him some story and convinced him to fly back to CA with her. Before he left he apologized for blowing up at me and said that we could talk about the dog when he got back and try to work it out but that it was shitty that I did it behind his back especially when it was against the lease and he couldn't rent to someone he couldn't trust.

I asked his sister about the eviction (just in case) and she said of course I wasn't evicted and to just hold down the fort.

Anyway - so he's at a place near his family being treated now. I don't know what for and I don't really care as long as he's getting better. That's his business and he'll tell me if he wants to. I just want him to be okay and it looks like he will be.

(I do know it's nothing environmental because I've had the whole place tested for everything. Also I've been staying there and I'm still fine.)

His family is awesome and reaching out to me almost daily. I haven't been able to talk to him since he left, but hopefully soon. I'm also going there for Thanksgiving so I'll most likely even get to see him.

And when he's back we can maybe start looking for our new dog Steve.

Thanks again for all the help. Not trying to sound dramatic but I'm not sure if I would have done the right thing if I hadn't posted here.

Boss took my Cell Phone and won’t give it back

    Posted: 08 Nov 2018 02:46 AM PST

Hi, I work at an Olive Garden in Maryland as a busser and I'm only 17 and don't have my license. so when I get off work, I have to call my parents for a ride. Last Saturday when I was off work and finished closing around 1 am I called my parents for a ride. While I was still on the phone my manager snatched it out of my hand and told me "no phones on the job" and wouldn't give it back, eventually I got tiresome of begging for it back and just left when my parents got there as I was really tired. It's now Thursday and I've been back to work 4 straight says since and he literally won't give it back and is saying things like "well you broke company policy, and it's olive gardens property now". When I brought my parents in and had them try talking to him as I felt maybe he wasn't respecting my opinion due to my age, he told them the same things and basically said "it belongs to me now, take it to court". It's an iPhone 7 and I really don't want to lose my phone over something this dumb. I don't want to say my parents are dumb but they aren't very helpful with This at all. I contacted the police, but they don't find this to be a cause for concern at all. They showed up and now my manager is denying taking the phone at all, and when my parents tried calling the phone, we found out the phone is off/dead. So what can we do about this if police won't help and this guy is being a complete dick?

    Edit: update:

Sorry for delay, I was at school. We contacted Olive Garden, and they were very helpful and wanted to have someone higher up meet me at the Olive Garden location and take care of this.

Thank you for recommending to contact my phone provider also. Verizon immediately contacted on our behalf the police for us and they took this way more seriously. I'm about to head over to the Olive Garden now once my dad gets off work.

MIL picked up children from school, refuses to return them

    Posted: 08 Nov 2018 11:50 AM PST

[OREGON] My MIL has repeatedly throughout the past month claimed that I am an unfit mother and that she would be looking to obtain custody of my children after my daughter killed herself.

We've had it worked out that my eldest daughter's girlfriend was to drive her and my middle child home. We completely forgot to tell school not to let MIL pick up our children. Girlfriend however goes to different school because of zoning (even though she lives 3 minutes down the road) and MIL went to school and picked up both children stating I had sent her.

Now MIL is refusing to release my children to me.

How do I proceed? Is there a way to stop MIL from being allowed on the campus in the future?

[MICHIGAN] Is it illegal to discriminate against employees based on looks?

    Posted: 08 Nov 2018 06:42 AM PST

I know it's illegal to discriminate based on sex, religion, age etc... but I love my job but I'm having a very hard time here right now. I'm the GM of a golf facility in a more "conservative" part of town. I hired in a girl and she has a small septum piercing and very short hair and this is what started a rage against my bosses and I. One boss said "let's have her grow her hair out and look more like a chick before she starts on the floor. Also, she needs to take out that God awful nose ring." The nose ring I can do something about but not her hair - this girl is also a very hard worker and is killer with customer service, the type of employees I'm looking for. One boss then said he wanted pictures of girls before I hired them in so I showed him a picture of a girl I basically already hired and he said "no, absolutely not her hair is too red" … Girls natural hair color is red. This girl was recommended to me from another employee and she has a great work history and is very personable and seems like she could have a wonderful relationship with our customers. I called my boss this morning and told him the things he said to me left a bad taste in my mouth working for them. He says since it's a conservative area he doesn't want people "looking like they came from a Green Day concert" which I can understand but it's not like I'm hiring people with face tattoos and piercings all over their body.. I hired a girl with short fucking hair. In this business, since we are a sports bar/golf facility, I want employees that know how to create a relationship with customers and keep them coming back while working their ass off. Not a bunch of "hot chicks" that stand in a corner and don't lift a finger.

Girlfriend’s ex is a cop. He gave my car a ticket for overnight parking even though my car was called in.

    Posted: 08 Nov 2018 07:46 AM PST

So my girlfriend's ex is a police officer in her town. From what I heard they had a toxic relationship. Never met the guy. Whatever.

Anyway her town requires all cars parked on the street overnight be called in to the station. Give the address and license plate.

Last night we did that exact thing. Like we usually do. No problem.

Well, this morning I woke up to a ticket on my dashboard from (guess who) her ex boyfriend. We called the station number to tell them that we called it in last night. We gave them the time of the call.

What steps should I take from here? I refuse to pay this bullshit ticket. My concern is that this is only the start. My girlfriend tells me that he was psychotic and abusive so I stand to believe this is only the beginning.

Edit: location is United States. NJ

    Any advice?

Mom has hidden 3,000,000 dollars in my name to evade taxes and make my dad pay her child support. I have no access to the account. Is there anything I can do to see at least some of that money comes my way?

    Posted: 08 Nov 2018 09:12 AM PST

I am currently 17, and live with my dad. I don't currently talk to my mom because the two of us have a very strained relationship. Roughly two years ago, when I was still living with my mother, I opened a piece of mail that was sent to her house addressed to me. The mail was a balance for an investment account containing over 3 mil in my name. My mom doesn't work, so I knew she was fairly well off financially, but never had realized the extent of this. The mail also stated that there was an additional 8 mil in my mother's name, and another account with 3 mil in my brother's name. Given that this money is in my name, and I am fairly confident that it is an inheritance from some relative on her side, is this money that I am entitled to when I turn 18? If it is, how can I assure that she doesn't attempt to hold on to it? If this is not guaranteed to be money that I am inherently entitled to, is there anything about her actions that would be considered a clear violation of the law, meaning that I could potentially sue?

Edit: I live in the northern suburbs of Chicago Illinois

My tenant has been urinating on the floor, can I do anything?

    Posted: 08 Nov 2018 02:32 AM PST

I own a rental property on a college campus in Philadelphia. The student I am renting to just signed the lease in August and I have repeated complaints about him urinating on the bathroom floors (plenty of pictures) when he comes home drunk, which I hear is practically every night. I spoke to him about yesterday (used pics as an example) and 2am today his roommate texts me saying he's came back drunk and sent me pictures of the urine on the floor not even 24 hours later.

He told me he wouldn't do it again and went ahead and did it. I messaged him saying I will be speaking to a lawyer about terminating his contract and he should start seeking elsewhere to live.

Is there anything I can do to terminate his contract before I actually go to a lawyer? The legal process is going to be a headache. Do I even have grounds for this?

Ps. I don't know if he receives mail or not

(Texas) Grandma died in 2012. Family member lied about value of land to buy land from rest of family. Did not include mineral rights. Land has been producing oil since 2011. Checks still being made out to grandma and are being cashed. Options?

    Posted: 08 Nov 2018 09:50 AM PST

Alright, well this one is a bit convoluted. I am a lawyer, but not in Texas, and I am just trying to steer my friend in the right direction. Any help is greatly appreciated.

My friend's dad died when she was young. When her paternal grandmother died, she and her siblings inherited his 1/8 of the will, with the other 7/8 going to his 7 surviving siblings. One paternal sibling took grandma in towards the end of her life. On her passing, he told the other paternal siblings (and my friend who was the named beneficiary) that he would handle everything because he had real estate experience. Among the assets listed were a couple of parcels of land and the mineral rights associated with them. These were listed separately from each other. He created a settlement offer where he paid everyone off for their rights to the land (but not the mineral rights which were listed as assets in the court paperwork). It was not disclosed to the selling parties that there was any value to the land beyond it existing. I believe my friend received about $8k, but I am not sure if that was 1/4 of her 1/8 share or the full 1/8 share.

Fast forward to 3 or 4 months ago, and my friend contacted me. She was upset because he showed up at her door (after trying to track her down via social media for a few months) and very aggressively tried to get her to sign paperwork. He said that she had already signed it years before, and if she didn't sign it again, she would have to sign another document where she was agreeing to pay him back the $8k. She did not sign anything, kept the paperwork, and sent it to me. It took me about 30 minutes to figure out that he was probably trying to correct the mineral rights discrepancy between the court's listing of assets and the settlement agreement which he drafted (humble brag, this isn't my area of law). I told her not to sign anything, and that she should contact a mutual friend in the oil industry to see if there was any value to the mineral rights to the land.

Fast forward to this morning- there have been oil producing wells on that land since 2011, before grandma died. Likely about $8k a month. Checks are still being made out to grandma, and are being cashed by the relative. What rights does my friend have, and what steps can she take to prevent any further loss? It is unknown if the relative had power of attorney at any point, but he might have.

*Addendum- I reviewed all of the communications regarding the original will/settlement signing and the most recent interaction. The relative tries very hard to convince the others to just rely on his expertise and that he was making the settlement fair for everyone involved because he was a good guy who just loved grandma so much. In the most recent interaction, his employee who is a notary also let my friend know that she could just sign the paperwork and email it to him and he would notarize it, which is against Texas law.

Sold someones property a week ago that we had stored at our business for over 2 years, after being continually ignored when we would try to contact them. Today they called to say they are ready to pick it up.

    Posted: 08 Nov 2018 09:50 AM PST

A little bit of backstory: I work at a small custom frame shop, which has been open for about 7 years. We regularly have customers leave finished, unpaid (or unpaid in full) for months past it being ready to be picked up, and sometimes even years. My boss bought the business from his former employer, and even inherited some left behind finshed work. My boss has been under the impression that there is nothing he can do about this leftover work if the customer wont pick it up; basically that he would need to keep it forever just in case, despite our invoices stating that we are no longer responsible for work left over 120 days (which we never hold people to.)

We try to contact these former customers about every 2 months, to remind them it is done and ready to be picked up. Recently, we decided that enough is enough, and anyone that we couldnt contact for over 12 months, we were gonna put it up front for sale to try and recoup the remaining balances on their bills (and get back some storage space).

One woman in particular, whose piece had been done for about 2 years, was continually rude to us on the phone when we would actually get her on the line, generally saying 'busy, can't talk' and hanging up on us as soon as we say who we are, as if we are a bill collector. So we concluded that if she wouldn't even let us explain why we were calling, she was never coming to pick it up, and hers was put up front for sale.

The last time we tried to call was about 5 weeks ago, and last week someone came in and bought it off of the wall. Today, we get a call from her saying that she wants to come pick it up, and I recognized her name on the caller ID, and deflected saying that I had to track it down as we have our older finished work in storage, but really to buy time to contact my boss and let him decide how to handle this.

I was wondering if anyone had any advice for us: were we wrong for selling it? How binding is the '120 day' clause on our invoices? How should we proceed? I think my boss wants to try and buy it back from the cuatomer who did buy it, I think we should be honest with her, and tell her that this is the result of her ignoring us when we are just trying to get her to pick up her property that we had been storing for 2 years with a 50% balance remaining for the work we did.

Sorry for the long post, thank you for any responses.

TL;DR. Sold a customers artwork that we had been storing for 2 years with no indication that they would even talk on the phone with us.

Edit: I am in CT Edit 2: formating, sorry for the code block, didnt realize that would happen.

Ex from 26 Years Ago Is Demanding Money from Gifts Back (US/Uk)

    Posted: 08 Nov 2018 06:25 AM PST

I should start off by saying my friend is British, and has been residing in the United States for the last few years. I will refer to him as B. Using a throwaway.

Around 1991, B was in his early 20s and was enrolled in the seminary to become a Church of England priest. At the time, he was dating a slightly older and financially better off guy. The guy did what I think a lot of couples do for each other, buying gifts for their significant other, taking them on trips, etc. It was never understood to be a conditional for the gifts.

Their relationship, which was never made official via marriage or anything, ended after about a year, and when this occurred, the ex asked for some of his gifts to B back (which he obliged) and demanded compensation for the money he spent on B during the relationship, which apparently hovered around £5000-£6000. As a seminary student in his early 20s, B didn't have such money at his disposal, and under pressure from the ex, who was essentially threatening to reveal their relationship to the seminary's administration (at this time homosexuality would have gotten a person thrown out from the seminary), B was forced into privately signing an agreement with his ex to pay back the money purportedly owed once he was financially able to do so. Both parties kept a copy of the agreement, and this was the last time contact was made (1992).

Recently, after 26-27 years of no contact, B's ex reached out to demand the money, and is threatening legal action if the money is not paid. His ex is only requesting the original amount of money, with no interest. B is upset as he feels he was blackmailed into signing the agreement in the first place, and doesn't really know what he can do. As an Episcopal priest, he's worried that a legal battle will force his bishop to get involved and will affect his standing in the diocese. I want to be clear and note that B never took a loan from his ex; the money that the ex wants all comes from trips they went on together, gifts, presumably things like dinners, etc. What can be done?

I think it's absurd that the ex is requesting the money. If I give somebody a gift, and the receiver ends their relationship with me, I don't think I would have any grounds to demand it or its value in cash back. I think I have heard that you can't legally demand gifts back – a gift is a gift, though I'm not sure how true this is.

I'm especially curious about the following:

    • In Britain, how legally valid is such an agreement if there were no witnesses to it?
    • Could the fact that B was threatened into signing the agreement make it null?
    • Would B's ex have a valid case against B should he choose not to pay? Especially considering how long it has been and B's residing in the United States?
    • How much of a role does the nature of the purported debt, as coming from gifts from B's ex to B, play in this?

    Thank you so much!

Is it illegal to tie my car to a tree?

    Posted: 08 Nov 2018 06:18 AM PST

    Hey,

Yesterday my car got into a tiny accident and the front of my hood crumpled a little bit. I took it to a shop and they said it would be 3k$ to fix it. The car still runs fine and there was no internal damage. Off the record, the shop person says I could probably try fixing it myself by pushing on the bent sections. I decided to try this as I have not much to lose. In addition to just pushing down though I get a come along winch to try and pull the hood out at the same time, I'm pushing down on it. I need something to tie it against though. I decided to try and tie it against a tree on the edge of a park near a deserted road. In order to not damage the tree, I use climbing rope and tie it around it 4 times. Then attach the winch to the rope and my car hood.

Eventually, a driver comes along and asks me what I'm doing. This is after I am packing up since it only kinda worked. He stops for a bit and I can tell he is calling someone. I hastily pack up and GTFO since I'm scared of getting into more trouble than I already am with a fucked up car hood. I'm stressed about this and don't know what to expect. I am in Massachusetts.

Q: Was what I did actually illegal/a big deal and should I expect to have to deal with the police?

(WA) Brother used my identity to buy a house. Do I own the house?

    Posted: 07 Nov 2018 06:17 PM PST

Long story short, I recently discovered that my brother used my SSN and identity to buy a house and get a mortgage for $250,000 in 2017. I know I should've checked my credit report more often but here I am. He managed to do so by going through the papers my parents had in their home. My parents keep meticulous records in their safe, which include copies of our passports, SS cards, birth certificates, etc. from since we were kids. My brother got access to it and this is how he stole my identity. The reason why I discovered the issue was because I wanted to buy a house myself and my mortgage broker said I can only get a $270,000 loan. This was puzzling because my income is $178k and I have no debt. When he dug deeper, he saw that I have another mortgage taken out in 2017. After a week of digging, trips to the county clerk, and courthouse, I have hard proof of my brother's scam. I have not confronted him yet.

Before I do, I want to get my plan straight. I will obviously report this to the authorities and want him to be punished to the full extent of the law. But aside from that, what happens to the house? Am I the legal owner of it? Can I "evict" or kick them out since it's essentially my house (on paper) and keep it? Do I need a lawyer at this point?

    Thanks.

My landlord is blacking out half of my windows. Can I break my lease?

    Posted: 08 Nov 2018 09:53 AM PST

I live in Kentucky in a large apartment building. They're building a dog park for the tenants right outside my apartment. MY unit has huge windows. They put a notice on my door telling me they were going to install a privacy tint on my windows for my privacy. I e-mailed them immediately to find out if this would interfere with the natural lighting my apartment receives. They told me it would not. I came home yesterday to find the bottom half of one of my windows COMPLETELY blacked out. Essentially painted black. You can't shine a light through one end and see it from the other. They plan to do this to all of my windows, reducing the natural lighting by 50%. I've e-mailed the management and have yet to hear back. I'm a photographer and depend on the light to do my job. I also have several hundred dollars worth of plants that depend on the light from the windows. I had NO idea of this upcoming dog park when I signed my lease in May.

They'll also be putting benches for people to sit RIGHT outside of these windows, so I'll hear nonstop conversations from other tenants.

Am I able to break my lease without being penalized?

Got sold a fake iPhone on Let Go and not sure what to do next.

    Posted: 08 Nov 2018 09:37 AM PST

So I bought what I thought was an iPhone XS Max In Gainesville from a kid on let go. The phone looked a little sketchy when i saw it but the IMEI and serial number checked out so although i found some aspects suspect, I thought it was a real phone. When I got home, I realized the phone was emulating IOS and was running android. I messaged the kid and he immediately blocked me on let go. I reverse searched his number online and found his moms name. He was using a fake name on Let Go but i found his real name through his moms facebook. I contacted his sister online and she said she would help me get the money back. She was livid at her brother. I then made a new fake let go, found his other postings and messaged him as his phone appeared disconnected after I tried calling him a few times(his sister reported the same happening to her). He essentially told me that he could possibly give me a partial refund but that he had to pay bills and use the money from other stuff. He repeatedly implied that he gave me a real functioning iPhone and that I broke it upon it leaving his care. I told him he has until tonight to give the money back or give me some money and an item to balance what he owes me. If not, I told him I would report him to the police as I have a lot of his information now. He has not answered yet. I told his sister this morning what he was saying and she has not answered either. He is only 18. I am currently trying to find more info on his parents so that I can contact them. What should I do?

[Update]Home warranty+service provider lied about coverage/parts and demanded $900 for uncovered costs on a heat pump repair. We forced them to fix the system.

    Posted: 08 Nov 2018 12:24 PM PST

    Old post

TLDR: Warranty companies underpay contractors, contractors scam customers, escalate escalate escalate until they repair your system. THEY WILL LIE TO YOU. If carpentry/masonry/other cosmetic/structural work is required for access/replacement, that's on you. We got everything fixed.

Hi peeps, wanted to update not just b/c of the good news but also because no one seems to know how to deal with these companies.

Result: First of all, we succeeded in acquiring a full repair to our heat pump system at no cost to us(other than 2 $100 deductibles, an $89 diagnostic fee from another HVAC company, and non-heat-pump electric heating bills for a few weeks. I'm letting ~$200 that I shouldn't have needed to pay slide for now).

What happened: I was documenting in text every relevant piece of information in each visit/phone call, and acquiring information about parts(cost/equivalency), and what is and isn't covered(other contractors who have worked for home warranty companies know the system and have stories to tell). In this process, I had learned that you generally never have to pay anything out of pocket(except the deductible) unless the warranty company has to modify something which is not part of a covered system. This means carpentry, masonry, any extra work required to access/replace your system under warranty. In my original post I had specifically asked:

Is it reasonable/normal for a home warranty company to require costs associated with a repair ON the system itself to be paid by the homeowner?

The answer is a resounding NO. Other contractors used harsh terms such as "mumbo jumbo" and "hocus pocus" when I told them I was being charged for "modifications" TO the system.

Knowing this, it appears the contractor was purposefully attempting to install a differently-shaped part to save hundreds of dollars on part cost, then unload the required ON SYSTEM changes to line length/duct shape onto me as $800 dollars of extra charges. They also lied and said the $100 dollars of "disposal" was mandatory, even though you can take the old part to a scrapyard(after they empty it) yourself and get paid for it, apparently.

Finally, while on this quest for information, I called a RHEEM contractor for parts information, and he turned out to be an HVAC specialist who had worked with our warranty company for years and knew someone higher up. They got blanket permission to perform any and all repairs required and fixed everything.

Why it's so hard to deal with warranty companies: Warranty companies underpay their service providers and (possibly on purpose) force them to treat the customers badly on the premise that every claim successfully denied and every "uncovered cost" paid is more revenue. AKA "bad faith insurance". There are current lawsuits going on about this. I did escalate to a "supervisor" without any luck near the beginning of my efforts, so I have no idea how far you need to escalate to reach my result, given the fact that I got lucky and skipped steps.

Hopefully this post will help the next clueless customer.

Someone Is Threatening To Kill Me and the School Won't Do Anything About It

    Posted: 08 Nov 2018 10:52 AM PST

I am sixteen and I live in the state of Texas. This girl is also sixteen.

Over the past few weeks, this girl has accused me of stealing her stuff (and I didn't and would never do such a thing) and she has been belligerent and threatened to call the police on me. I calmly explained to her that I didn't have it, and if she wanted to call the police then she could. But lately, her and another person have been talking about beating me up and 'taking me to Brazil, killing me, and then leaving me there'. I went to my principal about it and he didn't do anything except say to not talk about it.

This girl has a violent and mentally unstable history, and I'm genuinely scared for my safety. Is there anything I can do about it?

My nurse deactivated my business IG Account, and refuses to give me access.

    Posted: 07 Nov 2018 08:41 PM PST

Background: i am a physician, own a solo practice. I hired a new nurse a few months ago to help out as my practice started growing. We decided to create a main practice IG page- with my business name, logo, business contact info etc. All posts of my patients were hipaa compliant and I had consent from the patients to post.
This week, she was on vacation while we were relocating offices. I changed all the passwords to the email accounts. she messaged me asking if she was fired Bc She doesn't have access to her email and my response was call me when you get back from vacation. She proceeded to delete my Instagram business account for which I spent months working on with all of my intellectual property and patient pictures. She did have access to the account as she would post too. She is refusing to respond to me, and she has (my) patient pictures on her page- for which she does not have consent for since she is no longer associated with my practice. Is there anything I can do about her having access to my now deactivated IG and intellectual property? And is there anything I can do about the pictures on her page? (This is my first post- thank you in advance)

Tree on my property snapped 3 feet from base, now hangs precariously over neighbor’s house.

    Posted: 08 Nov 2018 12:04 PM PST

Tree on my property was blown over by wind. Roughly 75' tall pine tree, rotted on the inside, but rotting not visible prior to falling over. The tree snapped near its base and fell over but got hung up on other trees and has not fallen all the way down. As it is, it will probably remain in position until more very heavy wind or the first snowfall. Top 1/5 of tree is hanging over neighbor's house. No damage has occurred (yet) so insurance companies will not get involved. Neighbor has called about the tree and knows I am aware. Neighbor tried to tell me that I am responsible for the tree, but everything I have read says that the responsibility lies with wherever the tree falls. Am I bound by the law to remove the tree or attempt to remove the tree before it falls completely onto neighbor's house? Could the neighbor come after me for reparations if I take no action? Thanks. State is MA.

Paid a lawyer to start my divorce through PayPal, he died three months before I made payment, PayPal is saying there is no way i can get my money back even though it went to a dead person. Help!!

    Posted: 08 Nov 2018 10:17 AM PST

I live in Pennsylvania. In April I contacted a lawyer about handling my divorce. He told me it would be 3,000 and he would need 1850 to start the process. He said they take credit cards but i really didn't want to charge it as debt was part of the reason my marriage failed. We were not in constant communication but would touch base every now and then. Last i heard from him was the end of June. I sent him a message telling him I would I send him the 1,850 as soon as I had it as I had just started working a part-time job in addition to my full-time job. Mid October I sent him $1000 through PayPal when i saved ip enough. I didn't hear anything from him And i thought maybe he needed the full 1850 to get started. I sent him another 850 and got no response. Come to find out he died in July. Obviously I was unaware and this is a huge amount of money that i worked REALLY hard for. His office probably didn't contact me because technically he hadn't started my case. I contacted PayPal to see about getting my money back since the receiver is dead and his office is no longer in business. They told me there was nothing I could do. I don't see how they can't make this right. No services were rendered and the receiver of the money is dead. Isn't there someway I can recover this?

Note On Car Says I Damaged Another in Parking Lot - Except I Didn’t.

    Posted: 08 Nov 2018 02:26 AM PST

Last night, I took my mother to see a movie. I parked in between two other vehicles, and off we went. When we exited the theatre, there was a note under my wiper stating I had hit this persons car with my door, there was a dent and a scratch, and they had pictures of the damage and my license plate. Now, I know most people would deny anyway, but I truthfully did not hit this woman's car (she left her number and email, which stated a female name). And being realistic, most people would not remain in a space after hitting someone's door with theirs. My concern is of any legal recourse she could take against me using my license plates. I KNOW I didn't do it, but I can't prove I didn't, nor can she prove I did, which I understand. I'm hesitant to contact this person, simply because I'm sure she will not listen or believe me when I say I didn't damage her vehicle. She's found someone to blame, and it will probably be hard to convince her otherwise. I mean, I get it, I'd be angry too, but in this car she'd be vilifying the wrong person. Any advice would be appreciated.

    Edit: located in Ontario, Canada.
