Legal Advice I cut a tree down on my own property to save my house. My neighbor says he is suing

I cut a tree down on my own property to save my house. My neighbor says he is suing

    Posted: 21 Nov 2018 04:15 AM PST

I can't find any legal precedent for this. I knew where the property stakes were and the 3 trees that were in various states of decay were 3,6 and 20 ft on my side of the property line indicated by both satelite, gps and the actual property stakes. My neighbor - a litigator and attorney demands compensation for his trees. He then commissioned a survey that identified other stakes and the rest of the boundaries. The trees were actually further into my property. He accosted my wife at the mailbox saying we had no right to take his trees and they are on his property. He now wants me to pay for his survey, a new fence and "his trees". Should I be overly concerned about how this would play out in court. All 3 trees were leaning over my house in excess of 60-100 ft. All were dead with one in an advanced state of decay. When the tree company removed them I specifically had them left on my property in view in the event that something like this happened because my neighbor is a known to be against tree removal and cutting. So to reiterate. Trees are well within my property confirmed by "common sense" and an actual survey paid for by my neighbor in an attempt to claim ownership of them. Trees are dead and dangerous - considered a hazard by my insurance company . I paid a significant amount of money to remove them. My neighbor says he is going to file a lawsuit over it.

[NE & CO] My mom wants to have me "repossessed" from college and taken home by force over state lines. Can she do that?

    Posted: 20 Nov 2018 06:21 PM PST

For some backstory, my mom is a very controlling and rather horrible person. She has absolutely no tolerance for my sense of privacy, and it's gotten worse since I've moved out for college. She demands access to absolutely everything I have. This will be important later.

I'm 18 years old, and I'm a college freshman. I go to college in Colorado, but I was born and raised in Nebraska. In Nebraska, you aren't a legal adult until you're 19 years old. It was hell just convincing her to let me go to college, and it was much harder convincing her to let me go to college out of state. Like I said earlier, my mom is incredibly controlling and she hates it when I do things that are outside of her reach.

My mom demands my passwords for everything she knows about. Email, WhatsApp, Facebook (even though I haven't used it in years), Twitter (again, relatively unused but she always checks it and bugs me about random shit that shows up on my timeline), you name it, she'll demand the password for it and threaten me with grounding and "a good spankin'" if I don't give it to her. In the past, I've rolled over and taken it. It was a survival mechanism more than anything. If I'd stood up to her then, there's no way she would have let me go to college. She justifies this by claiming that because I have autism, I can't tell what's right and wrong and need to be monitored.

About a month ago, I changed all my passwords. Sure enough, literally less than two hours later, my mom texts me, telling me that I need to give her my new passwords. I tell her no. This is where trouble begins.

Over the course of the past month, she's gotten very difficult and agitated with me, and tried to guilt me into giving her my passwords. She's tried to force her way into the accounts, with no success. Although in the last week, things have gotten even worse. A week ago, she showed up here and I had to have her escorted out by campus police after a brief verbal altercation. That pissed her off a bunch.

Recently, though, as in last night, I was on a phone call with her, and she told me that she would have me "repossessed" by "the goons." I asked her to clarify and she said that because I'm still a minor in Nebraska, and I'm a resident of Nebraska, I have to abide by Nebraska's laws and as such, I am still a minor and she can do that. I wished her good luck with that endeavor, trying to act like I wasn't fucking terrified, seeing as I've been "gooned" (read: taken by force to a psych ward) before. It's not nice. I do not want to be gooned and taken home. I don't want to face my mother again.

So the question is this: can she do that? Is the Fugitive Slave Act not dead after all? Does my having autism change the circumstances any? If all else fails, what can I do to protect myself?

I do reviews, I reveiced a cease and desist after the publisher reached out for "ways to improve"

    Posted: 21 Nov 2018 10:05 AM PST

Hello, now I am not some big reviewer. I barely have 10k subs on YT and I do it more as a hobby and not anywhere near a job.

Recently I posted a review about a newly released game, it was very critical on a lot of points in the game but no where was I saying anything that was a lie. For some crazy reason this video received a massive influx of views compared to my normal 8-13k views and received over 1.6M views.

The publisher reached out to me and wanted some of my personal opinion on how to "improve" the game and what they could do to make it more enjoyable. I was ecstatic, and extremely happy that the company wanted my opinion of all people on what to improve or change. I was assuming they reached out to a lot of people to get a pool of ideas and maybe hopefully implement them and improve the game.

Towards the end of our emails they asked for my name and address to mail out some "swag" for my time and effort in the emails. I sent probably several pages of ideas, and issues etc so thought cool, a poster or something would be nice.

Today I received a certified letter that contains a cease and desist about the game claiming if I continue to spread false information and affect sales I will be sued it also demanded I remove the review immediately.

I've privated the video but have yet to actually delete it, what can I do here? Are my opinions on a game not protected or can I actually be sued for this?

Edit: ahh typo in title, sorry on mobile.

I was fired for "violating the whistleblower policy" when I questioned why my boss didnt follow company procedure.

    Posted: 21 Nov 2018 07:40 AM PST

    Located in Alabama, USA

Long story short, I was fired for "violating the company whistleblower policy" when I questioned the location and transfer of some product that I was responsible for, I was told told it was going to a different location, specifically, to be sold to company board members only. When I questioned my supervisor about it I was told " thats for a project that Big Boss is doing for board members". When the fore mentioned products was posted for sale in a 3rd location I asked the manager of that store about it and was told it was above his pay grade, it was something his boss and my Big Boss worked out. He asked me why I was asking about it, and I said I felt like my Big Boss was "up to no good". Both of my managers lied to me about the location and status of the product. A month later I was called in to the HR office with an company investigator, HR and a company attorney and they questioned me about "building a case against Big Boss". 3 days later I was fired for "not following chain of command" and "violating the whistleblower policy".. which in the company handbook, says I am to go to the Big Boss to report any wrongdoings.

Several employees reached out to me after I was terminated about how wrong I was treated and have asked me if I plan on sueing the organization. I just dont know what I would sue them for? My 2 bosses lied to me to cover up some potential illegal white collar crime that I cannot prove? and had a month to clean up before their "investigation".

Any advice would be greatly appreciated.

Daughters mom refuses to cooperate and goes against visitation agreement.

    Posted: 21 Nov 2018 05:49 AM PST

A little back story. When my daughter was born, her mom refused to let me see her, so I took her to court and set myself up on a typical visitation agreement with me paying child support. The mom got married and requested to move in with the husband on the verbal promise that she would meet me half way. It's a two hour ride one way. Roughly a hundred miles. She refuses to meet me unless I give up some of my visitation and I am being forced to drive the entirety of the distance. That's 8 hours I have to spend in the car. Sho constantly shines me in a bad light and is doing a decent job of turning my daughter against me. I've been forced to call the police before because they refused to let me have her after driving to their house. They tried to tell the police that I abuse and bully my daughter. I've always done my absolute best to compromise and do what is best for my daughter. The mom refused to talk to me without her husband present and he is extremely aggressive. Has gotten in my face and shoved me because I didn't agree to me giving up my Saturdays completely so the could go hunting and fishing on a regular basis. They have my daughter call him dad and me first name Dad.

I can tell you about what terrible people they are all day but I'll try and sum this up. I have proof of multiple time that she has not abided by the visitation agreement.

I'm in Alabama. My daughter is nine.

Any legal advice of what my options are would be great. Am I required to handle all of the transportation? Do I have any benefit from taking her back to court? She doesn't abide by the paperwork now most of the time so how could I guarantee that she has to obey the agreement in the future? Or if I was able to get that she is required to meet me at a half way point that she will and be on time. (She's had me wait at the meeting point for 2 hours before without notice)

I didn't want to make this to long. If you have any questions I will do my best to answer them.

Ex-girlfriend (20f) and her mom won’t stop contacting me (20m)

    Posted: 21 Nov 2018 06:22 AM PST

She recently broke up with me (about two weeks ago) and since then both her and her mom have contacted me multiple times with messages that are intended to cause conflict. I have not responded to these messages except to tell them to stop, and I have blocked the source. They keep finding new ways to contact me. I blocked the phone number and I got four emails. I've gotten a Facebook message. I've gotten an Instagram message. She also has a history of messaging people that I know and harassing them. It's been threatened in these messages as well. Is there any way I can make this stop? Can I prevent them from contacting me or my friends?

    EDIT: I am in Alabama

Roommate is turning heat off overnight, is she liable for a frozen/burst pipe?

    Posted: 21 Nov 2018 04:54 AM PST

I have a roommate who likes to keep the apartment as cold as possible and is turning the heat off overnight. I have asked her repeatedly to stop through text because the unit next to us has been dealing with pretty severe flooding issues and as the temperature drops I am worried about the pipes freezing. When I woke up this morning it was 38 degrees outside, 59 degrees in the main floor of the unit and 48 degrees in the basement. The outside temperature is supposed to be below 20 for the next few days and I am going away for a few days for thanksgiving. I have bagged all of my stuff downstairs and I have renter's insurance but my roommates do not/have not. If she turns the heat off while I am gone and a pipe bursts will she be solely liable for the damage to the apartment or can we all be on the hook for it?

so apparently my husband got in a car accident?

    Posted: 21 Nov 2018 10:47 AM PST

UGH so this is the most annoying thing ever. My husband is an international student from Colombia. Therefore, he could not get his DL until he was 18 or so. We have not had insurance on his vehicle for about 4 months and here's why. WI BASED.

Every place we call to insure the vehicle claims that because of this "car accident" he was in, they need to charge us a monthly premium of $200 for LIABILITY only on a 2001 Ford Taurus Wagon. Literally a stupid oblong car.

First off, he never was in an accident. Not a fender bender, nothing. When asked for the details of the accident, it actually happened BEFORE the date his DL was issued.

We went to the DMV and they told us "there is no record of you being in a car accident".

So we are in a game of the insurance companies saying, yes, there is a crash on his record, and the DMV saying no, you were not in a crash.

My parents are "sponsors" for my husband, as we are going through the Green Card process and I make less than 20,000$ a year. They are extremely pissed at us, because if something happens, they will be sued and financially responsible for any car crash.

So I don't know what the hell to do. Pay $200+ a month for a POS car? Maybe I should just give up and drive him around for the rest of my life?

4 months of trying to figure this shit out, and to no avail. Reddit, any legal advice?

[MD] Someone started a clothing line with the same name as my IG handle

    Posted: 21 Nov 2018 07:18 AM PST

Let's say my IG handle is cursively.

Yesterday, a guy reached out to me on IG with the handle cursivelyy and expressed interest purchasing my IG handle because his clothing line is called cursively™ (he actually included ™ in the real name portion of his profile).

I checked with USPTO and "cursively" is not trademarked at all.

My question is: should I decline his offer (which I will), does he have legal recourse? Say if he trademarked the name, would I have to give up my accounts? I have the name "cursively" on nearly all social media platforms (IG, FB, Snapchat, Twitter, Twitch, Steam, PSN, etc.) and have had it since early 2000s which is why I don't want to give up the name.

Web company “auto renewed” without my knowledge four days prior to renewal date, won’t issue refund

    Posted: 21 Nov 2018 07:57 AM PST

Hello all, I believe this is the right sub to get some advice about pursuing a refund.

I bought a years web hosting last year in a Black Friday sale. It was due for renewal on Saturday the 24th. Due to high costs I didn't want it renewed, so today (Nov 21) I logged in to back up and shut down my site and discovered they've already taken payment!

I contacted their sales team who refused to refund the $130 as I did not authorise this renewal and it was charged before the renewal date. They claim that auto-renewal is enabled by default and I have to tell them to turn it off before the payment is taken. They also said payment is taken early to avoid service disruption.

How can I best try to get a refund? I've raised a dispute with PayPal and made a complaint to the Better Business Bureau (the company is registered in Delaware). My main points of contention are:

-The auto-renewal was not made clear and is not something I would ever knowingly authorise (for example my domain registrar which I bought the same day is set to off - whilst I can't recall clearly I can't imagine why I would turn one off and leave one on but realistically this can't be proven)

-The money has been taken before the renewal date, logging in today to shut everything down should have provided plenty of time (3 days) to avoid this situation

-No service charged for has yet been provided (as the service starts on the renewal date)

I feel that a refund is completely reasonable; am I being naïve and am not entitled to one? I live in the UK and am fairly sure this would be covered by our consumer law, is Delaware significantly different?

(Apologies for layout posting on mobile)

My dad is filing bankruptcy and trying to put the house in my name... help? (US-VA)

    Posted: 21 Nov 2018 08:16 AM PST

My father had surgery a few months ago which cost him his job and most of his savings. Because of this, he's been behind on his medical bills for the sake of trying to stay on top of the utilities, mortgage, etc.

Apparently he got served and now he's begging me to put the deed in my name for the house while he files for bankruptcy. I am incredibly weary, have no idea what any of this means, and can barely afford my own lifestyle as I live in DC and it's pretty expensive.

Can someone here please ELI5 and give me a nudge towards what I should do, how to avoid this if it's bad, things to know? I'd really greatly appreciate it.

[MD] Friend's wedding photographer shot the wedding, went MIA for weeks, now refusing to give photos and only offering 50% refund

    Posted: 21 Nov 2018 11:39 AM PST

This just happened to a couple of friends who are too upset to even deal with it until after Thanksgiving so I figured it couldn't hurt to get some advice for them.

They were married in September. As a guest at the wedding, I thought everything with the photographer and her team looked normal enough. This wasn't a "friend who takes photos" situation - this was a proper wedding photographer with fancy equipment, assistants, etc... and from what I understand the night went smoothly and everyone was happy.

Weeks go by and they cannot get a hold of the photographer. She won't return calls or respond to emails - just total silence. They even had friends and family call her.

Finally, yesterday she emails them out of the blue. She has no explanations about anything - she just apologized (didn't specify for what) and said the best that she can do is give them back 50% of their money and no photos. As you can guess, she hasn't responded to any of the follow-up questions.

That is it - no idea what happened to the photos, the weeks of being MIA, nada....

Obviously there is more going on with the photographer than we know about (and will probably never know) but if there is a chance they can get their photos back or at least 100% of their money via legal action I think they need to act quickly.

Fortunately even if the photographer lost everything the guests took thousands photos and videos that night and I'm sure we'll be able to round up a really nice collection of shots to capture the event but geeeeez, what a bummer, right!?

I was fired for a pedicure, New York

    Posted: 20 Nov 2018 04:41 PM PST

To say I'm shocked is an understatement. I'm an account rep for an advertising agency and for the for the last 15 years I have always been in their top 5, most of the time top 3 reps. Rarely ever taken sick time off, and always been there to serve my clients. I was famous for being a savior of accounts that have gone wrong.

Well 3 months ago I was in a motorcycle accident fucked up my leg pretty good. I was told it was going take at least a year for me to get back to normal.

I took a month off from work after talking to my boss, during that time I did do limited work/did take client calls etc.

After that month my boss and I agreed (who I've worked for 15 years now) that I would be work from home dealing with clients. Even with all those challenges in the last 2 months I've stayed in the top 5 of all our sales people (we have about 25~ sales people) so with a fucked up leg, and mobility issues I've outsold fully able employees. My leg has been improving and for some of my bigger clients I've made the trip to go see them in person.

We are also encouraged to do business with people who do business with us. My dog groomer? She's a client of mine. The dealership I bought my car from? Client of mine. Lawyer who handled my divorce years ago? Client of mine. You get the picture.

Well my toe nails got kind of nasty, and one of my clients owns a nail salon. I asked her if I could get a pedicure, we agreed. So I went to her nail salon, we signed a new advertising contract and I got a pedicure since I'm unable to currently cut my own toe nails. I paid etc, client and I were both happy. Unbeknownst to me my boss saw me getting a pedicure.

He called me, very upset and he asked me why I was getting a pedicure. I explained that I needed to handle their account which I did, and that I'm unable to cut my own toe nails because I can't bend my leg at the moment. He said (I listened to the recording) "If your too much of a pussy to cut your own toe nails, then you don't need to be working for me, your fired I'm tired of your shit"

So I went home and saved all the emails he's ever sent me, some of the emails include:

    • His agreement that I am to stay employed and I decide how much I go out, etc. In that email he described me as an essential part of his organization and understands my injury is a temporary setback.
    • His praise for my sales, he even bragged when I placed 2nd that a crippled sales person (me) is out performing the young bucks.
    • Emails in which he encourages his staff to do business with those who do business with us
    • An email in which he says we aren't working a 9-5 and he doesn't care what hours we work, so long as we bring in results.

I also have several phone recordings of him and I talking about my injury, how its going impact my work, how he's happy I'm willing to do what I can, and the phone call in which he fired me.

I got the pedicure because of a medical condition, I'm unable to cut my own toe nails because of my injury. Do I have a case? I'm pissed and if I can nail this fucker to the wall it'll bring me joy.

What to do about crooked cops in town?

    Posted: 21 Nov 2018 08:32 AM PST

I am not one to be complaining about drug dealers as I believe each person has their right to make money as they see fit. My neighbors have been selling pills, heroin and cocaine to people for quite some time. Their activies never poured onto my property and they keep to themselves so I never saw it to be my concern. However, the past 2 months or so they have been selling to kids. As in middle school kids and I am officially not ok with their dealings. My uncle is a police equipment salesman and has made freinds with numerous police in town so I ask him what to do. He said he will make some calls to his friends in the PD and they will be arresting these people shortly. I also talked to my other neighbors and they said theyve called the cops atleast 5 times already for what has been going on at that house but nobody ever comes. This is where things get wierd. The very next day after I called my uncle, all the drug traffic that was coming through the front door is now coming down the alley way. I find this very peculiar. So I decide to follow one of the local buyers home from the dealers house (I knew he had to live close by because he walked over) and wouldnt you know. One of their daily buyers is the husband of a seargant on the police force. I know this because when he was walking up to his house, she was coming out, in full uniform on her way to work and they did the whole "love you honey. Have a good day at work. Be safe out there" and got into her township police vehicle. The only thing that makes sense is the police tipped off the dealers that they were being to open with their business and to have people come down the alley so atleast that way people outfront dont see everyone coming in and out of the house all day everyday.

After a few weeks of the drug traffic going through the alley, its going through the front door again. My question is what can be done about this? What can you do when something like this happens?

Doesn't a lawyer need my permission to add me as a partial owner of an LLC

    Posted: 21 Nov 2018 10:00 AM PST

Approximately ten years ago my father started an LLC in NY. He told me at the time that he would make me a partial owner along with my siblings. Because I live in subsidized housing where I am required to report owning businesses and the like, and I didn't want to deal with having to redo my paperwork, I told him no, don't add me.

Cut to 2016, I received some type of paperwork for taxes showing my partial ownership of said LLC. At the time I told my dad in person to remove my name! All these years my name being on there and not knowing and mis-reporting assets on my housing forms! I was still recovering from surgery, so I left it at that and assumed it was taken care of.

Now, my dad calls me to say the lawyer is needing my mail address and whatnot for closing the LLC or something, I don't even know, cuz I'm furious.

I called the number on that tax paper I received two years ago and asked the guy if he has some paper that I signed giving permission to put my name on there. Basically told me that I need to take it up with my parents and he won't take my name off till he gets their permission. wth?

I am not a minor and was not a minor 10 years ago when this all started and my credit has been locked for a while and there is nothing on my reports that should not be. (I can't access Equifax online but I think that's unrelated)

Question: doesn't this lawyer have to have my signature to use my SSN?

Edit to answer some questions that came up:

as I have not had an income for at least 10 years, I have not filed taxes.

I have this K-1, however the only one I have is the one mentioned above, from 2016, and I do not recall receiving any other paperwork of any sort referring to this LLC. I am listed at having less than 25% ownership.

Regarding the LLC making money, um. It didn't. According to the 2016 doc, it's in the negative, and any anecdotal talk with my family it's always operating at a loss.

I will have a look at the Secretary of State website and see what I find.

2nd Edit: I can see the date formed but no important documents on the Sec of State website

Had incident with ex wife. What's the correct move here?

    Posted: 21 Nov 2018 01:31 PM PST

I have joint custody of 2 of my kids (age 8 and 12) with my ex wife. We live about 40 miles apart and the kids live with her during school and with me during any school breaks.when it is time for me to pick the kids up, I generally do it at her house and drop them off at her house. I drive by her house on the way to work most days so it's not a big inconvenience that she doesn't meet me anywhere. School was out for Thanksgiving break starting last Friday and as usual I picked the kids up on Friday evening on my way home from work. I was planning to keep them all Thanksgiving break as I usually do. It's worth noting that the Mom doesn't really celebrate holidays at her house. Last night (Tuesday) my 12 year old daughter tells me that her mom wants them home the next day. Usually this wouldn't be an issue but I'm working in a different city and direction this week. I told the 12 year old that she can go to her moms for Thanksgiving but her mom would need to pick them up as I wouldn't be able to drop them off. Also, worth noting that in general my ex won't talk to me and trys to direct all communication through our 12 year old, but that's a different issue. The ex text me last night saying that if I wouldn't bring them home the next day she was going to assume I was with holding them for thanksgiving and she would just keep them and take them out of state for their Christmas break. I responded saying "you're just being unreasonable. No one's holding them from you. I just can't drop them off tomorrow but you're more than welcome to pick them up". She responded with "glad we agree that you have them on Thanksgiving and I get them on Christmas" This was the end of our conversation.

Here is where all the drama starts.

This morning I'm in the shower getting ready for work and my current wife comes to me and says my ex is in the driveway honking the horn. I hop out of the shower and see I've missed a text and call in the last 5 minutes from the ex. I start getting dressed and then I start hearing yelling from the living room. My ex wife and current wife are screaming at each other. The ex wife is yelling to get the damn kids and my current wife is yelling at her to get out of the house. I come to where they are in the house and they are both yelling at each other in front of my 8 year old and my 1 year old that I have with my current wife. I came in and saw my ex wife hit my current wife in the throat. My current wife is telling me that she just walked in our house (door unlocked) and is refusing to leave. I told her that she needed to leave and I would get the kids ready to go but she needed to leave my house immediately. She then told me she wasn't leaving. I responded saying that if she didn't then I would throw her out physically. Ex wife says "I'm not leaving mother fucker" The 8 year old and the 1 year old are screaming and crying so I lost it. I picked up my ex wife and threw her out the front door. I don't know if that was the right move but I did not want the situation to escalate any further. My current wife then called the cops and explained what happened. The cops arrested my ex for burglary with attempt to commit assault (I think that's the charge).

I know none of this is good for any of the kids involved and there is a lot to mend on that front. My concern right now is what ramifications could come from this in regards to our custody situation? Also, I think the police are calling CPS because this happened in front of children. What could come from that?

Sorry for the long post and thanks for any help and advice.

    I am in Austin, TX.

Teacher lost almost everything, we raised a lot of money

    Posted: 21 Nov 2018 10:16 AM PST

TL:DR Raised about 4K for a teacher. Didn't realise that it might be illegal to give the money to him.

I am from a High School in Illinois.

Last week one of my teachers had his house robbed by a gang of people. They made a violent entry and took a lot, like a lot of stuff, pretty much cleaning his family out.

Two students decided to create a gofundme with a goal of $500 about three days ago. We raised about $4,000 in those days from the community. He has been a teacher at my district for a while, like 30+ years, and is loved by everyone. So we all wanted to help his family.

So today they told him and he was speechless. He then realised that it is kinda illegal, or just not really condoned by the school, for him to accept the money during the school year. What can we legally do? When can we give it to him legally?

Grandma in law denied access to see father's will

    Posted: 21 Nov 2018 12:46 PM PST

My wife's grandmother was denied access to seeing her father's will by a brother and his two sons.

She was told that the house she has been living in was given to the brothers and not her.

Now that she has taken sick and won't be living in the house for a while but still paying rent they said she will be evicted.

The state is California. What should she do?

Chiropractor broke 2 of my friends ribs, and damaged her back. How does she go about this ?

    Posted: 21 Nov 2018 11:07 AM PST

Around a month ago she felt something break when the chiropractor put his weight on her back(accidentally of course). She started feeling pain in her back and lower ribs, when she got an xray done at the hospital they found two of her ribs were broken along with a damaged spine where the chiropractor applied weight. What can she do ? This is affecting her current day job as a supervisor because of the pain she gets from walking around all day. I would want her to get compensation for this as this WILL affect her job and her health. I won't force her to make any decisions of course just asking for her the potential options she could go with

Cleaners stole checks and deposited multiple times, stole $3500

    Posted: 21 Nov 2018 06:00 AM PST

tl;dr - two checks that we were sent have been stolen by our cleaners, who deposited them again in their names for $3500. What do we do?

My wife and I live in NYC for the part couple of years, but we are from Europe so have very little experience with checks (they are practically phased out in Europe)

Back in July, we were sent a couple of checks for us to deposit - a gift from a colleague for our wedding, and a payment to my wife for a mentorship programme she had participated in.

We immediately deposited them through our banking apps, and (foolishly it appears) left them lying around our house. Important to note that the checks never left our apartment. The only people who had entered our apartment around that time were 2 cleaners that we had booked through an app.

A couple of weeks afterwards, we get an email from the mentorship programme which sent us the first check, letting us know that there was another attempt to deposit the same check (this time for $9000), by a different name. Thankfully this was caught by the bank.

At this point, we reach out to the app to let them know that we strongly suspect that one of the two cleaners had stolen this check. We get completely helpless canned responses which indicated to us they want nothing to do with all of this. We do not report this to the police, as the collective wisdom of the Internet suggests that they would do nothing about it.

We also reach out to our colleague to let him know that the check he sent us was probably stolen too, so that he warns his bank to block it. He said he would, but doesn't seem too concerned.

Fast forward to today, he sends us a super worried email saying that $3500 was taken from his account through this check, which is again on a different name.

At this stage, what can we do to help? Is the bank legally compelled to refund this? And who should be making a legal case against the thieves - us or our colleague?

Financed a Honda, now they want it back.

    Posted: 21 Nov 2018 12:36 PM PST

I went into a Honda dealership to finance a vehicle. My credit score is poor. They offered to have my old 2003 Jeep be traded in. They offered over 3k for it so I financed and left the lot with the used Honda Accord without putting anything for a down payment (they just added the value of the Jeep to the total price of the Honda) 20 days later they are calling me telling me I have to bring it back because no bank has approved me. (Even tho I signed all papers for apr and payments and everything)

Also I did go back and look at the contract, and when I was signing papers, the lienholder was never any bank. It was Honda Finance group. I signed and agreed to this term without knowing because during the time the seller had a bunch of papers and was just going thru them having me put down signatures as he is going thru each paper. They were just trying to push off the car onto my hands as quickly as possible to snatch the sale before closing.

I haven't called them back yet, just wondering if anyone knows any tips or can suggest an option as I am trying to still keep my vehicle.
