Go vote. (Also voting problems megathread) Posted: 06 Nov 2018 08:40 AM PST GO VOTE Apologies to our international readers, but I'm gonna talk to our US peeps for a minute. This is a sub focused on legal issues, and many of you feel that some of the laws that we talk about are wrong and should change. Well voting is pretty much the best way to make that happen. I'm sure you've heard by now, but today is Election Day! If you haven't already, be sure to go out and vote! Whether you're a Democrat, Republican, Libertarian, Independent, or a member of the Green Party, voting is the one way you can make sure your voice is heard. Get out there! You can find your polling place by just Googling "Find my polling place" (dang, that's convenient!), and if you haven't registered to vote for this election, you can register for the next one at Vote.gov, although 17 states allow for same day registration (so you can vote there even if you aren't registered). Can I get in trouble for giving my underage wife alcohol? Posted: 06 Nov 2018 04:45 AM PST OK so long story short I'm 21 and my wife is 18. Recently my mother-in-law from hell found out that we both drink. She is threatening to call the police on me if I give her daughter alcohol in our home. Could I actually get in trouble for that? This is in Virginia. [link] [comments] |
Doctor gave me a drug test without my knowledge Posted: 06 Nov 2018 05:02 AM PST I am in Ohio and went for my first prenatal appointment. When I first got there, the nurse took me back and told me they wanted a urine sample to check for a silent UTI. She then told me three times during my appointment that the urine sample was to check for a silent UTI. Later, I look at my online chart and I see that they also ran a drug screen on my urine. (I passed.) I was never told there would be a drug screen. I am a cash patient so I specifically told the doctor I only wanted the tests done that were absolutely necessary. Now I received the bill for the drug test. Am I responsible for this bill? [link] [comments] |
Posted: 06 Nov 2018 09:06 AM PST My coworker and I each had two very weak drinks over a period of 2 hours after eating a ton and drinking water. We both went from not even tipsy to not remembering anything - I woke up in a random apartment building and her fiance took her home. We filed a police report and were tested for GHB (urine test) and they both came back positive. Neither of us were sexually assaulted, but the crime is handled by the sexual assault unit of the police department, so it's taking a long time for them to do anything. The event space was in a hotel and they have told me they have great security cameras watching the bar area where they make drinks and throughout the space. I don't expect to see someone actually putting something in our drinks (unless a bartender did it) but I want to know who was there - it was a very secure event and it was 2 bartenders and 75ish colleagues. I followed up with HR and legal at my company and they responded immediately, requesting that I contact the photographers to get all the photos from that night.....I work in engineering, not events, so I have no idea of knowing who my huge corporation hired to photograph the event. What should my next steps be? Do I find an attorney? Could they realistically do anything? Do I just let it go? I know it's unrealistic but I hate that I have to work with the person that did this to us. [link] [comments] |
Coworker gave me an edible and it took me to the emergency room. Posted: 05 Nov 2018 02:45 PM PST So i'll try to keep this as short as possible. I've always wanted to try pot and I have a coworker who works part time at a dispensary and he said he would bring me some marijuana to try sometime. I live in California so I know it's legal but I don't go to the dispensary because my wife thinks weed is terrible for you and she doesn't want me using it. My coworker came in to work today with some brownies he had made at home and offered me one. I ask him if there's any weed in them and he says "no". I grab one and begin to pounded it down with my coffee except I notice it tastes a bit funny. I ask about the flavor and he says "Its made from all organic, different than typical brownies" and laughs it off. Being the dumb ass that I am I shrug it off and continue through my workday. 30 minutes go by and my heart rate just spikes randomly and I start sweating bullets. I start to breath manually and I freak the fuck out. I have no idea what's going on and I end up asking my boss to call an ambulance. I end up getting picked up and taken to the hospital and the paramedics are asking me questions on how i'm feeling, if I took anything, etc. I tell them I didn't take anything and they tell me I was having an anxiety attack. I get to the hospital and my coworker texts me saying he put marijuana in the brownies and thought it would be funny to see me high at work. I tell paramedic I ingested a marijuana infused brownie and he tells me to just stay hydrated and relax. I feel like shit and i'm stuck in a hospital right now and i'm beyond pissed off. I dont know what to do and how to bring this up to my boss or if I should pursue a lawyer. Please help! Edit: He is now telling me I can't tell my boss or HR because I'd get fired for using marijuana on the job. UPDATE: Police report has been filed! I reached out to my boss and he has since then asked my coworker to not come in tomorrow. A meeting is being set up tomorrow with my boss and HR. Edit: People are pming me telling me I'm a dickhead for reporting him. Lol wtf. UPDATE 2: I am on my way to work. I'll let you guys know what's going to happen. [link] [comments] |
Drug Screening company has now lost 2 urine samples, resulting in company withdrawing job offer Posted: 06 Nov 2018 06:30 AM PST I'm in Texas. I went to take a drug test as a prerequisite for a job. I took my first test on the 26th of October. This company collects a sample onsite, then sends that sample to one of their labs to analyze said results, then to send to the hiring company. They have a policy where if their lab has not received the sample within 72 hours, that it's then voided, and a new test is needed. I took my first test on Oct 26. I was informed by HR of Potential Job on Nov 1st that they had not received my first test, and that I'd need to take another. Okay, whatever. I took my second test on Nov 2nd. I was informed by HR again today that, still, my test results have not been received, so they would be withdrawing their job offer. Naturally, this had me irked, so I called the screening company to figure out what's up. From what I was told, *both* samples could be verified that they had been sent to, and received by the testing lab, but after that, it's not apparent what happened with my sample. I'm not 100% sure, but I've been looking into litigation for negligence, or any other similar recourse, but I'm not entirely sure what options are available, if any. Thanks to anyone who takes the time to reply. Much appreciated. [link] [comments] |
$1000 rent increase. Less than a 30 day notice. Legal? Posted: 05 Nov 2018 11:51 PM PST Location: Bay Area, California. I live in a SECTION 8 house with my boyfriend and sister. Our rent was $580 and we were just scrapping by. Our bills add up to about $500 a month. I got a letter in the mail by HUD saying that they are increasing the rent to $1,526 that's starting Dec 1, that's LESS than a 30 day notice! We can not afford that, and this is a HUGE increase! And right before voting for proposition 10. Is this legal? I thought landlords had a limit to how much they can increase rent a year. What do we do?? [link] [comments] |
Posted: 06 Nov 2018 04:20 AM PST So my daughter's mother(we arent together) just had a baby girl. Prior to the pregnancy she had been taking opiods and muscle relaxers for a back injury she got in a car accident a few years before. When they stopped perscribing pain relievers to her she got them on the street. I would never say she abused the substance, and my heart goes out to her because all she wanted was her pain to go away so she could be a funtional part of society. When she got pregnant she stopped cold turkey and was honest and upfront with her doctor. Unfortunately the doctors hands are tied by the law so he informed DCF. 9 months later she has her baby last Thursday. The father is a scumbag and got kicked out and banned from the hospital hours after the birth for drinking. I stepped up to support the mother of my daughter, not their kid. The child is perfectly healthy with no withdrawals. Before they could be discharged, DCF had to speak to her for the reported opioid use. I stayed to hear everything out of concern for my daughter. What I was told is now because of her mother my daughter will now have her own separate OPEN case. I kinda expected this. But the extent of thier involvement is what shocked me. She claimed my house Will randomly be searched every month. And I had been in trouble prior to my daughter's birth in 2011 for class d stuff(possession of weed). I have no convictions and every blemish on my record has been dismissed. The DCF worker mentioned I could be drug tested just for being around my daughter. But the test would be for weed which is now recreationally legal. My biggest questions are, does she actually have the right to test me since I'm not in thier system? Can I be tested for something that your legally allowed to use? How can I get my daughters case closed and get her out of the system? My biggest fear is my daughter being a DCF kid. When I went to school those kids were veiwed as broken and became outcasts. I dont want that for her and me and her mother have even talked about transferring all of her rights to me in the hopes she will no longer be looped in with her sister. Edit to clarify. I had no knowledge of the opioid use until a few week's ago. The mother lives with her father (my daughters grand father). And yes I know my use of weed is my fault and I accept that Edit 2. Forgot to mention, the alcoholic does not live with my daughter Edit 3. I have stopped smoking weed. And her mother tested negative for anything throughout her entire pregnancy. I'm proud of her for that. Edit 4 anyone that Thinks she is a shitty mom can go to hell. I've known her for 10 years. She is an amazing mother to our daughter. But she was manipulated by some scumbag who promised her the world and used her for money and sex. I don't blame her for any of this. I blame him. I also blame myself for not seeing it and helping her due to my own love life. Stop messaging me to "take the junkies kids away" [link] [comments] |
Posted: 06 Nov 2018 01:12 PM PST So this just happened, and I'm not really sure what to do next. I looked online and haven't found anything, I'm not sure if it's identity theft or just a weird mistake with DPS printing my license. [link] [comments] |
Ex changed the locks on a house that I own Posted: 06 Nov 2018 07:36 AM PST I just got out of an abusive relationship, and when I knew my ex would be out of the house yesterday, I went there to get some of my kids' belongings from their rooms. When I arrived, I found that he had changed the locks. He wasn't home, and I didn't confront him about it because I'm leaving on business for a couple days and didn't have time to deal with the fallout of that until later this week when I'm back, at which point I plan to go back, with the police, and confront him about why he changed the locks on my house. I am the homeowner. He is not on the title, the mortgage, or any document whatsoever pertaining to this house. I want to start the process to evict him, of course, and I also need the rest of my and my kids' stuff out of there. He is not going to make that easy because he claims we were common law married (this is shaky and not likely to hold up in court, but it will allow him to jerk me around for a while and stay in my home rent-free, which is pretty much his goal in life). Is what he did legal, and what should I do about this? I'm in Texas. [link] [comments] |
Posted: 06 Nov 2018 08:07 AM PST Edit: the title was poorly worded. The debt is 8 years old, not the kids. Edit 2: Spoke with a bankruptcy attorney who recommended that we 1) pull her credit report and 2) Do a court record search to see if any legal action has been filed. He said the collections agency's ability to sue (and be successful) is way beyond the 3 year statute of limitations. He did say that even a promise to pay something resets the clock, so be careful what is said or promised over the phone. Title says it all. Ironically the credit card issuer (Citi) just approved a high-end credit card for her so clearly this debt is completely off of their books. I don't know how long this has been bumping around collections, but the guy I spoke to insinuated that they're going to attempt to recover this debt via a legal action. I'm a big DIYer and since this appears to be outside of the statute of limitations here in NC (3 years) I'm hoping to take care of this myself if that's possible. I guess what I'm looking for is a structured way to bring this to closure. Any help would be appreciated. Original Debt (Citi Card) Opened: Oct. 2002 Last payment: Feb. 19th 2010 Original amount: 17,945.08 Last amount: $41,944.02 [link] [comments] |
Posted: 06 Nov 2018 10:32 AM PST I have been dating my current girlfriend for 8 months. Her ex-husband is a Sherriff's Deputy. Their marriage lasted only a couple years due to alcoholism and domestic abuse (never reported/investigated) on his part. When I first met her I was not yet aware of exactly who her ex was (she wasn't being shady or secretive, we just weren't really at the point in our relationship of sharing everything about our personal lives). I did notice a squad car multiple times, either following me in traffic or even when I went into a store. I actually noticed this cop car so much that I memorized the 3 digit car number on the side. At this point I still had no reason to chalk it up to anything more than a coincidence (small town with low crime rates. The police depts are fairly small). Fast forward a few weeks and we are starting to open up a bit more with each other as we began trusting each other more. She was telling me about her abusive ex-husband and how shitty he was to her and mentioned off-handedly that he is a cop. At that point the wheels finally started turning. I asked her if he works for (county) Sherriffs Dept. She confirmed that he did. I explained that I had been noticing the same cop in my general vicinity pretty frequently and described him to her... yep, that's him. She even found him on Facebook and showed me his picture to be certain. At this point we are both freaking out a bit. She said he had followed her around in a threatening manner for a couple months after their divorce, but that she thought he had finally moved on. We ended up calling the town police dept (not the sheriff's dept that he worked for). They had us come in and give statements, they promised to look into the matter but it was fairly obvious it wasn't being taken seriously. Then the issue really escalated. I had just gotten off of work and was driving home. I was kind of on auto-pilot so when the red and blue lights lit up behind me I assumed that I had been speeding while not paying attention, so I was pretty pissed at myself. Of course, it's the ex-husband though. He walked up to the driver's side window and asked to see my driver's license, which I gave him. He took it from me and didn't relay anything in his radio but read my address out loud to himself a couple times, like he was making a big and obvious show about memorizing it to threaten me. He then asked me if my information was still current and I said yes. I asked him if this had anything to do with (girlfriend) and he just smiled. Then he flipped the license like a frisbee through the window and into my face before walking away and driving off. My girlfriend and I are both freaking out right now. We both took a few days off work and left town and got a hotel room. I honestly am fearing for my life. The worst part is I have absolutely nothing to prove that he has been acting in a threatening manner, and as far as I know he hasn't even done anything illegal. After the first meeting with my local PD I am of the opinion that I will not be provided any help from local authorities, and that going to them again could just exacerbate the problem. Do I have any recourse at all? This would ultimately come down to a "he said, she said" but regardless, I am very afraid for the safety of both of us. We are feeling incredibly helpless right now. Any information or guidance you might have would really be appreciated, as both of us are so freaked out that its hard to even make a rational decision. This incident is taking place in Oregon. Edit: My post has been up for a while now. Does anyone have a suggestion of who I can contact for assistance at the state or federal level? I've never even stepped foot in a courtroom except for a speeding ticket i got when i was 16. Legal matters are an entirely foreign language for me. [link] [comments] |
Posted: 06 Nov 2018 07:22 AM PST Hello! My boyfriend (20M) and I (21F) looked for apartments all summer, and in late August we applied to a new apartment community in Utah that was being built - due to move in October 25th. We didn't sign a lease, but we signed an application with a description on how the security deposit works, and signed off on allowing them to run our background checks. We gave them the full deposit they asked for under their conditions - which were that we couldn't cancel the deposit 24 hours after submitting it. I have the document on file to refer back to for exact wording. Everything was fine until October 19th, when I emailed the leasing agent asking if there was anything we needed to do before our move in date on the 25th. She said the apartment wasn't ready yet and it would be pushed back until November 15th. Although annoyed, I understood it wasn't her fault the construction wasn't done but I was frustrated she failed to tell me sooner. My boyfriend and I were supposed to move out of our place at the end of the month, and didn't have a place to stay until the 15th, but we found temporary housing until the apartment is done. That being said, yesterday, November 5th, I once again emailed the apartment making sure everything was running smoothly for our move in date of November 15th. She told me our move in date is now mid to late December, leaving us homeless until then. I'm livid that she failed to communicate with us not once but twice, both within days of our projected move in date. I'm even more upset that we won't have a place to live after next week. They refuse to give our security deposit back, but I would have NEVER signed anything or given them a penny if I knew I couldn't move in until the end of the year. Is there some sort of legal loophole to get my deposit back? [link] [comments] |
Posted: 06 Nov 2018 07:33 AM PST Back story so You get the big picture here. We have been divorced for almost two years. During our relationship, he was an addict, alcoholic, and verbally and mentally abusive (as well as some physical abuse) and suffers from a slew of mental illnesses. After a few months out from under his thumb, I realized his behaviour wasn't normal and started the processes to have his visits be supervised until he got his addictions and mental illnesses under control. Around this time, (before he knew i was doing this) he also tried to kill himself after a 4 day binge. He then went to rehab after his parents staged an intervention. During this time, and after rehab, I tried to foster the children's relationship with him, by having them call, and going to his moms (as the supervisor), asking him to come to hockey games, etc. A week after rehab, he showed up with his mom to pick up the kids and threatened me -to the point where I had to call the cops - if I kept up with this "supervised bullshit" I stood my ground and said it was to protect the children until he was well again. Fast forward a few weeks and we go to mediation- he bully's me as he always does and pulls the wool over the mediators eyes, and we walk out with him having every second Saturday , no overnights. That was over a year ago and he did not exercise that ONCE. I continued to invite him to the children's activities, etc, ask when if he wanted to take them for lunch, etc. He declined, there was always an excuse. I realized that the only way the kids had contact with him was if I initiated it. Like so many years of our marriage, I was holding it all together. I realized I didn't have to take care of him anymore, and stopped initiating hoping he would start. Instead, he impregnates his new gf, who he met in rehab, 2 months out of rehab. He then relapses, hard, quits his job, and drops off the face of the planet. He didn't show up to court, even when they pushed it back a month, and they awarded me basically sole custody and supervised visits for him, at my discretion. We have heard from him three times in the last year. The first two times I let the kids talk to him, but because it broke them when he ghosted again, this last time I said I needed to protect them, and had the local third party visitation place contact him to arrange a visit. He declined. Twice. I stood firm, and now he sends an email saying he can't do this anymore and if I want him gone, to get rid of child support and the arrears, and he will sign over his rights. This would be best case scenario for us. As he was toxic and cruel to them. How would I answer this email, and has anyone approached this before, what would my next steps be? What if he's trying to trap me? [link] [comments] |
My counselor says my volunteer hours at a private summer camp do not count. Posted: 06 Nov 2018 06:26 AM PST I volunteered over the summer at a non-profit private school/summer camp. I went to go turn in the hours to go towards Bright Futures Scholarship, and my counselor said the hours wouldn't count because kids paid to go there. (i've heard some are on scholarships, but i am not sure of the facts) I'm not looking for a lawyer, but i just want to know if she can say that they don't count. This is Florida.Receipt for hours Thank you so much and i apologize if this is the wrong sub. [link] [comments] |
My father passed away, now his will is basically nullified. Posted: 06 Nov 2018 08:27 AM PST My father passed away recently, and his will lists me and my brother as the only beneficiaries. He died of bladder cancer which he knew was terminal for a long time coming. His will was last changed about 7 months before passing but two weeks before he died he got married, during these 14 days before death he changed the beneficiary of his savings, social security, and life insurance to solely her, while leaving the will exactly the same as it was, listing me and my brother as the only recipients of property and belongings that my father owned. His home was built in 1994 and solely his name has been on the deed since then, along with 12 acres of land attached to the house. I'm wondering if this would qualify as separate property from everything else because she was never an owner of the property. She also wants to settle, the widow now wants to buy the house and property for around $270,000 while the estimated market value is around $450,000. So basically she is attempting to buy me out of the estate. Now I'm in Washington state and I'm only 19 so I feel as if I'm being taken advantage of by her and her lawyer, and I know the omitted spousal laws here in WA are contradictory but any advice would be so greatly appreciated. Edit: I already have a lawyer and he's telling me to take her offer of my father's firearms and the "remaining" amount of about $5,000 from the estate after and she buys me out. My mother however is backing me up financially so I can fight this in court if need be. [link] [comments] |
Posted: 05 Nov 2018 11:16 PM PST Hi, I'm a student who just moved to California and I am currently renting a room in a house that an older woman currently lives in. She is a renter, however she is subleasing the room to me. She is not the owner of the house, however I have met the owner of the house. This has been an interesting few months so far. My landlady, (not the actual landlady of the house) who is subleasing me the room, started off requesting that I allow her biweekly maid to enter my room and clean it thoroughly. I am a very clean person and perfectly capable of keeping my areas clean. I'm 25 years old, for those wondering. I told he I am not comfortable having a stranger come into my personal space where I have expensive belongings and she finally accepted that. However, she is now requesting that I allow her to inspect my room and she is "stressed" because she thinks "her" house isn't clean. She is concerned (her words exactly) that my bathroom is not being deeply cleaned. I told her I keep my bathroom very clean and wipe down all the counters and sinks almost weekly. I also know that she has a tendency of going into my room when I am not here, as she has expressed concerns about the issues with the toilets and sinks in the house and "noticed" that mine were behaving oddly sometimes. She is the only person living in this house aside from me and she is a bit eccentric and clearly somewhat obsessive with cleanliness. On another topic, when I moved here, she told me that there was no parking here and I would have to walk a block down the road and park there. However, she did not mention that there is a second garage detached from the house (this is sort of a condo-like area) and the actual house owner is using that garage for storage. I learned that here was a second garage by calling the actual housing development and asking if there was a way I could get a permanent parking permit to park in the lots here, which apparently is not possible. He told me that there was a second garage and that they have a very strict policy on not allowing storage in the garages for this exact reason. There are too many people and not enough spaces for parking. So basically, the homeowner is violating their policy, the lady Im paying rent to got very upset at me for talking to the housing development, claiming she could "be kicked out of this house". Meanwhile she has the garage and I have to park down the road a third of a mile and walk along the highway to get home. She also has requested my personal day-to-day schedule in various emails. When she has an issue, she tends to email me even though we live in the same small house. I was sick for a week and didn't go to classes and was home. She noticed that and emailed me claiming she "needs her privacy" as she likes to "listen to music and watch movies and practice her piano songs for a Christmas show coming up". I rarely every leave my room as it is. I am always in it doing schoolwork and rarely do I go into the living room unless I'm getting something from the kitchen. I never intrude on her space. However she said "I need to know you're schedule since you told me these were your school days". Honestly, she is stressing me out by giving so much guilt for just being here and I'm not sure what to do. I have my window open often and I heard her tell her neighbor "he's here a lot and I need some privacy to practice my Christmas songs" meanwhile I'm trying to do important schoolwork to establish a career. With the strangeness of this situation, I'm not sure what I should do. I really enjoy living here but she is stressing me out by guilting me over nonsensical things. I don't know if I have any legal grounds on any of these matters or not. I apologize that this was so long Edit: I should add that there was no contract signed. It was a verbal agreement. sued by a membership gym, part 3 (victory?) Posted: 06 Nov 2018 09:37 AM PST part 1 and part 2 which I'm sure nobody cares about! :D We are in Kansas. Again, thank you to this community, especially /u/--MyRedditUsername-- and /u/kcsuburbanite for your help. On November 1, 2018, the day of the court hearing, we get a phone call at 8am from the prosecuting collection agency who is also an attorney. They say they want to settle out of court! They say that the client company, Genesis Health Club, wants to retroactively offer the *new* terms of its updated contract which allows an early termination for a $100 fee. Plus court filing fee, totaling about $200. This is payable in two payments of $100 in November and $100 in December, payable to the collections attorney (literally just to his personal name), resulting in a "letter of satisfaction". I'm surprised, because both Genesis and the collection agent had always told me that the account had been sold to the collection agent, with Genesis completely unable to respond to our requests for remedy the whole time. We ask for this offer all in writing ahead of time and she declines, saying that they never do that. We have no choice but to go to court and risk losing and having to pay $1000 or whatever. So we accept. This shady lawyer has sued a zillion local people on behalf of this predatory client, so we know about three defendants. They all said they didn't get a settlement offer! Even the one who had a lawyer (a lawyer who basically gave up and did about nothing anyway) lost in court and must pay big bux. Why were we offered this? Is it just because we called the Attorney General of Kansas, the District Attorney of Wichita, and the BBB and requested a debt validation letter, and they're concerned about public record? I'd think they don't care about their public image, when their business model is to sue hundreds of customers for costing them nothing. And because of the fact that they failed to respond to the Attorney General and BBB altogether! Is it just because we showed up in court with papers that cite a copy of the consumer protection laws of the state and nobody else showed up with anything in hand (not even the one who'd gotten a lawyer)? Their client has a say in how this is handled even though both parties told me the account had been completely sold to the collection agent and Genesis doesn't handle it anymore? Should we consider this to be a best possible case outcome? Must we comply with this payment now, with the only possibility of followup being to file a countersuit to get our $2000 in bogus gym fees refunded or to await the Attorney General's investigation after a few months? Is there any diligence we should perform other than writing a personal check and getting a receipt in the mail and then a letter of satisfaction in the mail? I've asked them what all we can get, and they said that's it. Nothing up front in writing, nothing at the moment of payment, just waiting for the mail. Thank you! [link] [comments] |
My grandfather used my name to vote, what options do I have? Posted: 06 Nov 2018 09:02 AM PST I have the same exact name as my grandfather and we live in the same voting district. The only problem is that he has always migrated to Florida by election season so that is where he is registered to vote. Unfortunately he has taken a turn for the worst mentally, and will not be going to Florida until at least the new year, if at all. So instead of absentee voting by mail, he went to our poll location bright and early, signed in under my name, and voted for me. I cannot make it to the polling station for another few hours when I'm on my way in to work. I want to know what my options are when I get there and what kind of trouble my grandfather could get in because obviously I don't want that. Any help is appreciated, I'm sorry if this isn't the best sub for this question. Edit: I'm in New York State [link] [comments] |
Trying to get out of a horrible marriage situation, I have no idea what to do, please help. Posted: 06 Nov 2018 07:47 AM PST Ok- This takes place in Florida: So I met/fell in love then married this man I met through a mutual friend, he's from Argentina and looking for love and ultimately US citizenship.... This was back in Oct 2007. We go through the interview process with immigration and I find out (there) he was married before and that all of our papers, pictures, interview checks out, however they want proof that the first marriage was legitimate and real. I'm blown away, first because he never told me that info and secondly how does one prove a legitimate relationship besides the obvious sharing bills, insurance etc. apparently they didn't add each other on insurance, all the bills were in her name, etc. basically looking like it was fraud because she fell out of love and ran off to New York which totally happens to US citizens and non. Nonetheless we were told his papers and green card would not be processed until some kind of proof was brought forward. We try to get a hold of her and surprise, surprise she's changed her number, we try to track her down and nothing, zero zilch. 2 years pass and I eventually find out he has a secret girlfriend that he had a child with and was pretty much using me to gain his US citizenship. We broke up, he said he would handle/take care of the divorce and I never hear from him again. I'm getting ready to move to California and I stop by the courthouse to get a copy of the divorce, he filed the papers but we were supposed to appear in court and everything got dropped so here I am still married and now living in a state where after 10 years the law is 50/50 I'm freaking out, I work hard for everything I have and now I might have to split what I busted my ass for, what can I do? Where do I even start? Any advice would be appreciated. Long story short: I married someone who was looking for citizenship and ultimately lied to me about who they were, looking to get a divorce even though I moved from the state where we got married and he is nowhere to be found. Girlfriends Traffic Court was Scheduled Election Day and was Closed Posted: 06 Nov 2018 06:21 AM PST ***Sorry for the typo, it was scheduled FOR election day, today. Hello, Sorry if this isn't the right place to ask but my girlfriend received a parking violation ticket, for her registration being expired, a couple of months back and received a court summons for it. She thought it was weird that it was scheduled for election day but thought they wouldn't have it scheduled for a day they are closed. So fast forward to today she gets to the court house and sees a sign on the door stating that "this building is closed all day due to election day". She made sure to stay there till a bit after 9AM, the scheduled time and took pictures of the sign. I just wanna make sure that she can't be held responsible for missing her court date or something like that and was wondering if anyone dealt with a similar experience to this and could provide some guidance on what she should do. All of the phone numbers related to the court house that we could find all state the building is closed and none let us leave a voice mail. Sorry if this isn't the place to ask this question, it was the only subreddit I could think to ask. We live in New York [link] [comments] |
Son's mother's new husband may be relocating due to military (CT) Posted: 06 Nov 2018 06:53 AM PST The title is basically the issue. We only have the default custody arrangement in place, no court ordered custody because in CT at least custody and child support are two separate hearings and we've only ever done the child support. I see my son at the least every other weekend, very regularly, have been doing everything possible to go to parent-teacher conferences and the like. In other words, I am involved. I love my son, and my wife loves her step son, and he loves us. My ex told me today that her new husband of about two years is due to submit for new duty orders in March, and could be required to relocate somewhere else. I intend to contact a lawyer and get the ball rolling on a formal custody arrangement to head off losing my son to god-knows-where, but I'm basically just asking if anyone knows what is likely to happen in this kind of situation? Do I need to worry about him getting stationed in Guam or something for three years? My son's turning 6 this month, I really don't want to miss out on anything, much less the next three years. I'll admit I'm a little panicky over here. Any help or advice you can offer is hugely appreciated. Thanks in advance! [link] [comments] |
Posted: 06 Nov 2018 11:58 AM PST My grandfather had a will at one time, he left all his belongings to his eldest son, but said son died before he did. Now my other uncle who isn't on speaking terms with the rest of the family has appeared to be the owner along with my grandfather. Is it legal for him to somehow add his name? My grandfather passed away 7 years ago. [link] [comments] |
Gift card not accepted after company changes system Posted: 06 Nov 2018 08:45 AM PST Hi all, Located in NY. Recently I tried to redeem a gift card for an online store where you can maintain a balance to be used on products available in the store. I was unable to redeem the code on the card through usual channels and ended up having to contact customer support. The store in question used to track store credit using an arbitrary "credit" system instead of tracking in real dollars. (for example - 1000 credits would equal $1.00). The card I bought uses the old system - say it's for 50,000 credits. I am being told that they cannot honor the card because they have changed systems and my card uses the outdated system. My questions are: Are they legally allowed to not accept my gift card? How can I pressure them when two months of emails led nowhere? Would filing a complaint with the Better Business Bureau be worthwhile? When they transferred to the new system, all the existing credit was converted to real dollars, so there is a conversion factor in place. The applicable law, I believe, is New York State General Business Law 396-i. Which, if I'm reading correctly, if there is no expiration date stated, they are required to accept the gift card for 5 years. After which, they are allowed to claim the funds as abandoned. The system change took place less than five years ago and the point cards were available for some time after as well. It's not even about the money at this point. I just feel like I'm getting pushed around by a big corporation because they can. Thanks for any help. [link] [comments] |
Do I have a case against my apartment complex? Posted: 06 Nov 2018 11:54 AM PST I live in Mesa, AZ. I was gone for the weekend and came back Sunday Evening to an incredibly strong and moldy smell in my apartment. I found parts of the ceiling in the kitchen had broken away and there was clearly a bad flood in there. When I called maintenance, they informed me that the upstairs neighbors washing machine broke while she was asleep and it must have flooded in. According to him, this happened at 3am Saturday morning. The guy I was speaking to in particular said that since they had not heard anything from me they assumed all was ok. They never called me to inform me of an issue nor did they check the apartment. We could not spend the night in the apartment mostly due to the smell. Monday moring maintenance came by and called in a company to assess the damage. I was updated Monday night that they were waiting for the report from the company they hired and would let me know Tuesday how bad it is. Come Tuesday afternoon, they called me and said the damage was enough to make the apartment uninhabitable and they gave me the following options 1) They could give me a new apartment in the complex to move into but I had to have the next months rent right away. I would not have it until Friday. 2) We could mutually terminate the contract. I asked for a day to think on it and they then informed me that I didn't really have time to do that and that they needed me to be out by the next day so that the company could get in and start doing repairs. They offered no assistance on moving out for either option. They then threatened that if I was not out within two days they would need to do an emergency eviction but they don't want to do that to me. Something I also can not afford to have on my record. I told them for me to make all the arrangement, box up the entire house, get an alternate place, and actually move it out within two days was impossible. Plus I am a single dad and had my kids that Tuesday night. I was able to talk them out of evicting me right away and to give me at least the weekend but I needed the Kitchen, Living Room, and Dining Area completely cleared out by then. This was an enormous task and I ended up having to take days out of work to complete it. Luckily my girlfriend has given me and my kids a place to stay until more permanent arrangements can be made so we are not out in the street. I was able to be completely out by Thursday Evening since most of the work was done after clearing the required areas.
When I went to turn in my keys on Friday, I asked for a copy of the maintenance report. They informed me it was already deleted from the system and they could not print it up for me. They instead opened a new on in my name that evening. So my questions are:
