Posted: 08 Oct 2018 03:28 AM PDT Thanks to everyone's terrific advice, I got my university's ombudsman involved, and also reached out to a local survivors group (similar to RAINN) who connected me to a wonderful attorney who facilitated between me and the legal services team at my school. Within a day of meeting with the school's general counsel, my attorney and I were invited to meet with the deans who had made the initial decision. One of my professors also apparently saw my legal advice post and put two and two together (my professors were not previously aware of the full extent of what was going on) and he and my other professors submitted a letter on my behalf protesting the administration's decision, copying the board, ombudsman, legal counsel, and high level members of the administration, which was so incredibly touching I am still overwhelmed and trying to properly thank them. Between my professors' incredible gesture and my showing up with an attorney raising flags, at the meeting I was given carte blanche to work out the details of my absences between myself and my professors (I'll take them at school, just early) and two were able to give me modified assignments that could be done at home but still exemplified the same knowledge and skill sets. The ombudsman and the legal counsel assured me they are looking into the policy that caused this ordeal in the first place, the ombudsman in making sure the policy is being correctly and reasonably enforced (e.g., not used to coerce students into violating a subpoena) and the legal counsel is advising the administration on new guidelines for the policy so no one else has to experience this going forward. Posted: 07 Oct 2018 02:48 PM PDT Hi all, I'm in Florida and was pulled over for going 30 over the speed limit. I was perfectly nice to the officer, and apologized for my speed. He asked for my license and asked if the address on it was current, I told him no, that I had recently moved. He then asked me to write down my current address. I happened to have post it notes and pens in my middle compartment. I wrote down my address, gave him the post-it note and he then asked for my pen.(I don't know at this point if he knew he was borrowing mine, or if he thought it was his). I complied and gave him my pen. He came back after giving me a ticket and had me sign it (giving me back my pen). I signed and put the pen away in its usual compartment, handing him back the signed ticket. He said "my pen?" And I said "oh I'm sorry that was my pen" he then said "give me back my pen" and I told him "sir, you had borrowed my pen. My father gave me this pen". He insisted it was his, so I complied and gave it to him. Anyways, he left with my pen. Unfortunately, the pen was a silver pen (probably cost like 100 dollars, it was a nice pen) but it didn't have anything specific for me to point out it was mine. All in all, I'm just annoyed he was able to walk away with my pen due to his shitty memory and lack of listening to me. What if that had been a 300 dollar pen? (Mint condition tried on inside the house) The buyer has returned them two months later saying they are fake and PayPal has taken $1000 back out of my partners account. The shoes are in awful condition and we found the girl who's plastered them all over her Instagram before returning them. It's obvious what's happened. She got them, showed them off and sent them back to us. PayPal are saying we can't have a refund (of the refund?) and the people on the phone are no help at all. We have sent photos of the girls Instagram and they don't seem to care, it seems so obvious to me what's happened but PayPal don't seem to care. He says he's dizzy, nauseous, and feels "stupid" I told him I'll take him to the doctor, just talk to his boss. His boss just said "youre fine" and won't let him leave. What can we do? Accused of breaking into a car by a police officer who says he watched me do it Posted: 08 Oct 2018 09:26 AM PDT Like the title says... last night I was heading to a family dinner with my girlfriend when my Mom text me to pick up some sprite and Fresca at the store. I went into the grocery store and pitched 3 twelve packs and went out to my car. I put the cases in the passenger rear seat and then drove across the street to fill up on gas. A police officer pulled up behind me as I was pumping gas and told me to put my hands on the vehicle. I laughed at him partly because I thought he was joking and partly because I laugh when I get nervous. He tells me he watched me open a SUV door and get fully into the vehicle and rummage around in it then drive off. He is telling me over and over again to confess to make it easier on me. He runs my license and all that and it comes back that I have never been in trouble with the law except for a few speeding tickets, years ago. 3 more police vehicles show up with their lights going and they all come over to question me. I keep telling them I have no idea what they are talking about and the first officer tells me he knows what he saw and is going to arrest me. He goes back to the store to find the owner of the vehicle and comes back saying that the cars doors were all unlocked and there was a purse and wallet sitting in the front seat but the owner says nothing is missing. He repeats he saw me doing this and will arrest me. He heads back to the store and says he talked to the store manager about pulling the security tapes in the parking lot and says the manager said that will take a few hours. He says he is letting me go and will come to my house to arrest me WHEN the tapes show what I did. I give him my phone number , address and mother's address where I'm going and tell him I didn't do anything again. He tells me he was going to buy his wife flowers and ruined his anniversary now because he has to talk to me instead of go home. Before he lets me go he again tells me to confess before he gets the tape or it will be much worse. I went home to family dinner, talked to my family about it all and just was a little shaken up. He calls me a few hours later and starts the convo but saying " guess what I just saw on the video" and I responded with "nothing because I didn't do anything" he replies with " actually the cameras were broken so I couldn't see anything but I know what I saw, I'm putting you on a list and if there is any damage to the vehicle I'll find you and arrest you, I know where you live". The phone convo went on linger where he said I seem like a good guy and don't have a record and next time I want to break into a car, I should rethink it. I have this whole convo on tape with my phone on speaker. He made some remarks earlier like he's watching me and all that and he will catch me. I didn't do anything wrong and don't know what he thinks he saw. Is there anything I can do? I was so nervous I didn't get his name or card but I know someone in the PD that is trying to figure out who it was. I'm nervous that if I complain, he will know and start to fuck with me... It is just blowing my mind that the professionals are taking the word of a 4 year old and the accused over mine. My daughter told me she was afraid of being "wiped in the way that hurts her guts", she acted out his foot fetish on me and her brother, she had two poop accidents which is unheard of for her, she bragged about learning not to hurt her father's balls, she acted out oral sex on her toys and attempted to do it to me and her brother, she repeatedly put a pillow under her pelvis and asked me to tickle her butt and when I did she freaked out, flipped over, and said "you really made that go by quickly", she suggested her brother had "come all over" his diaper when I said it was warm, it is SO OBVIOUS that something happened and NONE OF IT MATTERS I am devastated. I just want to start healing and instead I can't even be confident I won't be having to bring her to visitations with him and leave her alone with him. I can't function, I need to be getting my life as a single mother together and instead I spend my days medicated for stress migraines that are taking away the vision in my right eye. Is there ANYTHING else I can/should be doing to see justice for this? Someone told me that every single time she brings it up I should file a new police report but that seems like such a waste of time and police resources because she's not suddenly describing things in the "explicit" way they want/need her to. Posted: 08 Oct 2018 10:25 AM PDT Hello LegalAdvice, Earlier today my husband came home for lunch and discovered a tree removal company erroneously and negligently removed (cut down and grinded up) the 25-30 year old Red Maple in our front yard. The owner of the company is currently outside trying to talk my husband into taking $1000 and calling it quits. I have been a reader of this sub long enough to know that is not going to cut it. I have already taken pictures, called the police, called our insurance, and begun looking for at least 2 different arborists to come out and give us an estimate of the tree. In addition I know we will more than likely need an attorney (my dad is looking into that). My question is for NORTH CAROLINA what are they on the hook for? I have no idea what they did with the wood and we are also in an HOA that you need permission to remove trees if they are in the front yard (which this one was, and obviously we did not have permission). They were here to remove our neighbors tree, they are saying they mistook our address (which is on our mail box virtually next to the tree). (WA) Neighbors ramming car to squeeze in parking Posted: 08 Oct 2018 01:04 AM PDT Seattle, WA There's a small street parking space right in front of my place. It can fit two small cars but gets tight with standard Sedans. I park close to the end to allow for my car and a small car to fit, but a lot of the time bigger cars try to fit, which usually results in a partial blockage of our driveway. Friday night my neighbor tried to fit in the spot with my car. Despite me parking at the very end of the curb, they backed into my car and parked it pushing into my license plate and damaging it. The next day I parked in the middle so that no one would be tempted to further damage my car or block the driveway. My neighbor now rams my car until his car fits. This happened Saturday and just now. What's my best action at this point? My only goal in this is for people to stop blocking the driveway and from damaging my car. From that moment on, I could not access my Tinder account. I kept getting a prompt that the log-in information was inaccurate. Stupidly, I ASSUMED this meant my Tinder account was also deleted; I was okay with this and went about my life. Fast forward to August and I'm going through my checking account (admittedly, this doesn't happen often enough) and notice that Tinder is still taking 14.99 from me every month. I called the number on the posted transaction immediately (Google) and they tell me that unless I can provide an associated g-mail account, they cannot do anything. "I never registered, nor was I prompted to register, for a Gmail account at set-up...it was all done through Facebook," I explain. They were insistent that there was nothing they can do. I asked to speak with a Manager, I was put on hold until the line eventually went dead. I call back, told them the transfer never went through and was promptly hung up on. Feeling defeated, I sat on the issue and waited to see if they would charge me again. Come September, sure enough, another 14.99 is deducted from my checking. Call the number again...same thing. "Sorry, there's nothing we can do." Hangs up. Today, the new 14.99 charge was deducted. Again, I call....same damn thing! What is my recourse here? These withdraws need to stop. I know the bulk of the charges are technically on me for not noticing, but surely there's a way to recoup the last three months of charges that I've disputed & brought to their attention...right? They agreed to replacing it, but they don't want it to be 100% free. Is legal action recommended here? The twist is that this roofing company is the only company in the area, so if I do go the legal route, I'm likely going to be told that I'm not welcomed with doing business with them anymore. He has been dating her on and off for the past 8 years. She is definitely after his money because she only gets back with him when hers runs out. That is his business and I stay out of it. The problem I am facing is that I run a family corporation that was started by my grandfather. My father father is currently the only stockholder because the company bought out the other 2 a few years ago. I am currently president and my father has very little to do with day to day operations anymore. The plan was for him to retire and me to buy him out. I assumed it would happen within the next 5 to 10 years. The problem I am facing is that when he marries this woman and he becomes incapacitated, would she be able to make decisions on his behalf? If so, is there anything I could have my father sign that if he is unable to make decisions as a shareholder, that decision goes to me, not anyone else? The reason I question her is because my father has a few hundred acres of land that has been in our family before Texas was even a state. So there is a university in serbia (a private one) which founder is now in politics since about 2 years. The whole time u could already feel the politics there but not as now. Next voting for local mayor are coming and the founder has somehow gotten in the election list. To come quick on this, without giving away much information, the university is holding sanctions if anyone is against them for that, they hold classes and call students to come to some kind of sessions with them where they mostly explain how we the paying students have to give something back to the private school (2nd most expensive here) in the way of voting for them. At this point im already pissed like most and just quit on them fully, they seem to felt that and came back with another shot by telling us we're gonna "Change" a lot of stuff here if u dont vote. So the first thing they did was give their undergrad son a subject to teach to every student whichever class u are to control you with that. And by knowing them i dont think thats the end. i never been in this situation before i have tons of proof of everything but no idea where or how to send this to any authority or can i even do anything against them with all this. I passed the qualifications and the interview easily, but my job offer was rescinded after information was found on my final background check. As it is a federal job, federal background checks have information that cannot be made public, so I wasn't told why ideas denied, only that I could not be considered. Obviously I fought for the position, but the background checks were non-negotiable so I decided to accept another job offer. I attempted to contact the background check organization that was contracted, but that information too was kept secret. My main concern was that causing a stir would lower any future chances at that job. The only explanation my supervisor could give me is that the denial wasn't related to my references. Two years later, I'm still working for for state. The same position has finally opened again, and I applied to it. Theres a new supervisor and new management, so I was hoping for a fresh start. Three weeks later after exchanging phone calls and messages, I was denied citing the same background check, with no recourse. I think I should clear up that this background check is entirely inaccurate. I have no debts, no morgages, no student loans, no leases. I have no criminal record, no friends or family with criminal pasts, no drug use, no underage driving history, no mental illness, no domestic disturbances, no fingerprinting, never went to jail. I have one speeding ticket, from 2011, when I ran a stop sign. I am completely sober, volunteer at church on the weekends, go bike riding on the weekdays. I don't pirate music, and always tip. I did not mislead or lie on my resume. Nothing that I have done in my personal or private life could possibly serve to disqualify my background check, and I am running out of potential accusations to defend myself from. I am the most milquetoast, boring, inoffensive human being in existence, which makes these bizarre innacuracies all the more jaw-dropping. Before I was rather naive and decided to roll with it, but now I consider this background report a blatant insult on my character. I have been working my entire adult life to get this position and I've just received confirmation that I will always be locked out of it, for no apparent reason or fault of my own, with no way to contest these false statements. When I recently searched for my name in my state's online voter database, however, I couldn't find it. Just to be safe, I sent my registration papers in again. I later realized what the problem was with the online search. I have a McLastName, and my name was spelled in the voter database with a space after the "Mc," so it only appears if I search for "FirstName Mc LastName." It did not appear when I searched for "FirstName McLastName." Will anything bad happen because I registered to vote twice? Will I be kicked off the rolls? Have I committed a crime? Not leaves or root issues, just shade. We're in the Seattle area where it's cloudy 8-9 months a year. I've already had to cut down 3 of the 4 trees along that neighbor's fence line in my back yard, as they were dying and couldn't be saved - I tried. There is one tall tree left there (a cedar) and I'd really prefer this one stay intact and not be subjected to some butcher job because my neighbor wants more sun. In Seattle. (sorry - sarcasm is hard to avoid at this point, I'm just flabbergasted by this whole thing). Do they really have a right to complain at all about this? What rights do I have to protect this tree? Mary is a single mom to 3 boys, the oldest of which has juvenile diabetes that requires a lot of doctor visits. Though she has asked many times, there is no flexibility for the hours in Mary's office even though she is a salaried employee. When one of the boys has to stay home sick, she has to stay home as well since she can't afford last-minute childcare. She is not allowed to work from home in these situations (yes, she has asked). She is therefore forced to use her vacation and sick days to be able to care for her family. She has been with this employer for almost two years. Last week, they came to her and said she was 7 weeks over on her sick days and owed the company $6000 dollars for that time. They want to arrange to take it out of her paychecks and get it "paid off" by the end of the year. She can't afford reduced paychecks. She has been talked to about her sick days before, but was never made aware that she would have to pay the company before now. Note: this is in Florida. Is this legal? Negligent ER Doctor Results In Lost Testicle. Posted: 08 Oct 2018 08:58 AM PDT Hi all. Rather than inundate you with needless backstory I wanted to get straight to the point. 9/27 - Right testicle becomes engorged and extremely painful very suddenly. (This has been a reoccurring issue for 3 years with no answers) make my way towards urgent care, pain becomes so severe I instead go to the Emergency Room. I'm taken immediately back, writhing in pain, have my information taken through tears. My doctor walks in and says, verbatim, "what do you want, man?" After explaining my symptoms he looks at the chart and remarks that "I've been here before for the same issue." And after lightly grazing the area tells me he can "feel no difference between the two" that he "can't help me" and that I need to leave. I do. Dejected. 9/28 - in the morning I visit an Urgent Care facility. I have a repoire with the doctor there about this specific issue. She prescribes a round of antibiotics and a shot as per usual. 9/28 - 10/2 - I spend the remainder of the week in chronic pain with exactly 0 change in symptomology. Too scared to go back to the ER both for financial concerns and due to the fact that I was turned away so callously by the first. The morning of the second the pain became so bad and so worrisome that I spent the greater part of my day desperately trying to be seen by a urologist to no avail. After hours and hours of juggling phone calls, rejection, being accused of chasing pain alleviating drugs - my Urologists nurse begrudgingly schedules a scrotal ultrasound for that day. I make my way there - it's torsion. My testicle is dead. I drive to another ER immediately. They perform surgery on the testicle that evening and remove it. What's my best course of action here for my original ER Doctor? Sorry for formatting errors as I am on mobile. Posted: 08 Oct 2018 06:38 AM PDT I have filed for divorce and have submitted the necessary paperwork, had him served, and have received a case management date which can suffice as the final hearing if all documents are received an in order. I received notice from the court that three documents are missing from him - the financial affidavit, notice of social security number, and the mandatory disclosure form. They are going to send out a notice to him letting him know that he needs to submit these documents, but I am concerned about my options if he does not submit them. I asked my case management person today what happens if he doesn't file them, and she said that is up to the judge but wouldn't answer any further (which I understand the reasoning for). I am wondering if it is still possible for me to be granted my divorce, ideally at this upcoming case management/final hearing date. He replied to my petition and has waived everything, including being at the final hearing so I am the only one required to appear. I obviously cannot force him to file these papers, and we do not have contact nor is contact possible between us. We have no children together, no shared assets or liabilities, and I am not seeking anything (monetary or otherwise). We've never had a shared bank account or even been on the same cell phone plan - this may actually be one of the "cleanest" divorces in history from this standpoint :) I am waiting for this to be complete so that I may move out of state - since I have to appear, it will be easier for me to just stay here until this is over but I am less than thrilled about this being delayed even further than it already has been. This has been going on for sometime now, possibly over a year. He lives alone and has been sending all of his money away. My brother and I are starting to suspect that he is opening credit cards to send more money. He recently sold his vehicle and my brother and I were able to convince him that he isn't responsible enough to manage that money. So we were able to get control of that money and are paying his bills with it. We are keeping records of the bills we're paying to make sure it doesn't look like we tried to take advantage of him. He is receiving social security payments every month and we are sure that he is giving them away. We are considering getting a PoA and trying to make sure he can't give that money away to more scammers. I'm wondering what our options are, and is there anything we need to do to protect ourselves?
