    exboyfriend tried to get me committed to keep me pregnant (California)

    This is a long story but I'll try to keep it short. Throwaway for obvious reasons.

    I got pregnant with my ex boyfriend. He wanted me to stay with him and raise it but I wanted an abortion. I left him and told him I was getting one and thats final.

    A few days later, I got arrested at work and they took me to some sort of psych eval. My ex had told them that I was threatening to kill his baby! He doesn't have any kids! He lied to them. I was held for about 6 hours and then released.

    The next day, I got fired from work for "causing a scene." Now, I'm jobless. I know the police and the state didn't do anything illegal, but did my ex? Can I pursue some sort of action against him?

    My immigrant, deaf father was choked, body-slammed, arrested and had his sentry card taken away at the border for failing to comply to an audible demand. I want a copy of the video and his sentry card back.

    A little background:

    My entire family and I are naturalized citizens from Mexico. We were all born and raised in Mexico and we tend to visit a lot of family and friends on an almost daily matter. We live in San Diego and in order to avoid hours of waiting at the border, we applied for and received Sentry cards. We are hard-working people, engineers, educators, pay our taxes, etc...

    My father was crossing back across the border into the US in one of the sentry lanes during labor day at around 7 PM. My father was driving, my mother in the passenger seat, and my pregnant sister-in-law and my niece were in the back of the car. According to the accounts of my family, there were two border patrol officers on the passenger side checking sentry cards before the actual booth. One of the officers made a hand signal in the shape of a license, implying that my dad flash the sentry cards, which he did - but the officer did not see it. The officer starts walking in front of the vehicle towards the driver side door while making the same motion and yelling something out which my father does not make out (he is deaf). He starts banging on the drivers side door. My father once again flashes the sentry cards and says "Here it is!".

    My family says that the officer did not like the tone my father was using and said "OK. I'm gonna get your sentry card taken away". My father opens the car door, confused and interpreting the banging on it as the officer asking to open it up. The officer then proceeds to choke my dad, drag him out of the car and handcuff him. My mother tried to explain that my father was deaf and wasn't understanding what the officer wanted. He replied with "I don't care".

    Afterwards, my father was taken to a processing facility and released without any charges - except the officer was successful in taking his sentry card.

    For obvious reasons this angers me - it really complicates our way of life here in a border city. I'd like to recover my dads sentry card.

    I also would like to acquire video of the situation if possible. Border crossings are high-security environments and I know there must be video of the incident in possession by the BP officers. How would I go about getting video of the incident?

    Thirty day notice of rent increase was sent to the wrong address. Arizona

    When I logged on to the website my management company uses to pay rent I was shocked to find that they had raised my rent by $150 plus taxes and were also charging me an extra $150 plus taxes for the month of august without notifying me. All of this together coming out to nearly $400 more than what I had set aside to pay and essentially all my money. I called them to ask what had happened and they were very hostile with me on the phone, they said that they had sent me a certified letter in June with lease options but my rejection of the letter meant that I was agreeing to renew my month to month agreement at the $150 increase starting in august. I asked them to send me a copy of whatever they had on file saying I "refused the certified letter". They sent me a scan of the envelope that was returned to them. My name was correct on it but they sent it to the wrong address and the letter even had a sticker on it from the usps stating "undeliverable, insufficient address.". Do they legally have to send me a new letter with a new thirty day notice before my rent can be increased? I was genuinely shocked when I saw my balance due and when I confronted them on it they treated me like I was attacking them personally and essentially said "you were notified, you declined, we don't accept partial payments, pay tomorrow in full (today) or start incurring late fees. Click.".

    I have not yet notified them that my address is wrong on their letter as they sent me the scan yesterday at 4:30pm and I didn't open it until after office hours. Just trying to figure out if I have a legal leg to stand on here. I was on a month to month agreement in Phoenix.

    Edit for clarification: It's a building of five units. All of us have been here on month to month leases for years, me being the newest at three years. The building was sold a year ago and put under control of a management company. I'd say give or take it's been a solid year since and thus they issued everybody thirty day notices informing us our agreements were expired. In the letter it gave four options a lease of 12, 9, or 6 months with the final option remaining month to month. All were tiered so that the longer lease you signed the less your rent will increase (of course remaining month to month being the most expensive). I have no problem with this and will gladly sign a lease to stay where I'm at. The issue is that they mailed my certified letter informing me of this to the wrong address. I log in to the portal on the first of September to pay and to my surprise my rent is up $150 plus tax and it says I have other unpaid charges of $150 plus tax that were due august first even though my ONLY option was to pay in full on august first, so at some point during august after I had already paid my rent in full at my current rate they went in and added $150.

    So essentially with no notice, my rent has increased and my balance is ~$400 more than anticipated, which I don't have. I certainly could have rounded it up and budgeted had I had thirty days notice. When I called, as I said above, they were very mean to me on the phone, they essentially told me pay in full tomorrow or start incurring late charges and then informed me that I was the only one who "denied to accept the letter at delivery". I asked them to scan what they had and send it to me to look over and low and behold they sent the letter to 123 WEST streetname and not my address which is 123 EAST streetname. The letter was stamped by usps saying "undeliverable, insufficient address, return to sender". Im just confused as to how I'm liable for these charges when they sent my notice to the wrong address.

    Edit: Also, am I really responsible for backpaying them $150 for last month even though they invoiced me for my old rate and I paid it in full on august first?

    ------- UPDATE----------- I emailed her informing them my address on the certified letter was wrong and that I was not notified of my options. I told her I was prepared to pay my old rate this month and then start with my new rate next month and her response was "notice was also issued through regular mail, please pay your balance in full. If you need to we can do a promise to pay for your back charges". I informed her that in my original phone call I asked if they had made any other attempts to contact me and she said no "a certified letter is what's required and you failed to sign and return it"

    She met with her union rep who helped her file an appeal. The district has now said they're opening a full investigation. (I feel like maybe they should have done that before they fired her.) If the district decides to reinstate her, the union rep says she should get back pay to her release date.

    She's currently applying for jobs in the counties around us.

    [CO] Corporate landlord withholding ~$250 from deposit for "cleaning". Condo was left spotless. Reddit, help me get my money back.

    As the title says, my corporate landlord withheld ~$250 from my security deposit for cleaning. According to the invoice, I was charged for "minor cleaning. refrigerator, blinds, light fixtures. window sills and vents no more than 4 hours."

    I cleaned all those items.

    As a reader of this sub, I knew to do the following:

    • Request a move-out inspection. The landlord declined via E-mail. I have that saved.
    • Take pictures / record video of condition at move out. I have direct pictures of the window sills, light fixtures, and refrigerator. I also have approximately 11 minutes of move out videos. I included a newspaper in these and uploaded them to my Google Drive, so the dates on the videos can't be contested. I don't have pics of the vents, and pics of the blinds won't show if they were dusty or not.
    • Create a thorough move in inspection report. I have that, but none pertain to the cleaning items noted above. I was not charged for anything on the move in inspection report.

    According to the cleaning invoice, the "cleaning" was completed five weeks after my move out videos were taken and we returned our keys.

    I looked at Colorado law. I know I have to send a demand letter (via certified mail, return receipt requested) and give seven days to respond. I also know that if this goes to small claims, I can sue for triple damages, court costs, and that the burden of proof is on the landlord to show that the cleaning was necessary.

    So my questions are as follows:

    1. What should I include in my demand letter? I'd rather not have to take this to court, so I'd like to word my demand letter in a way that's most likely to get the "cleaning" fee refunded.
    2. If I go to court, what's the best way to present video evidence?
    3. Should I present the fact that the "cleaning" took place more than a month after I moved? Wouldn't quite a bit of dust accumulate in one month? Would that detract from my main argument that all the items that were "cleaned" were already clean upon move out?

    My guess is that this corporate landlord automatically charges cleaning fees to every tenant when they move out, assuming that most tenants won't contest. Well, reddit, help me hold them accountable. Help me so that I don't anything stupid and ruin my case. Thank you.

    There is a child, 10 or so that comes with his parents to various events that I participate in. He regularly hits, slaps and threatens me when nobody is watching. I've talked to the parents, but nothing has been done and the child just says that there is "nothing i can do because he's a kid and you can't hit me back." What can i do? What is wrong with this country that there is nothing i can do to stop this harrassment? I'm not in fear of my safety, there is no reason for "self defense", but I just got punched in the groin and legally I just have to accept that?

    [MA] Last winter my facility forced us to stay overnight threatening we would get fired if we left, and mandated us to work the morning shift the next day, is that legal?

    I work as a nurse at a 24/7 facility but work 8 hour shift full time. Last winter my facility forced us to stay (I was working 3pm-11pm) overnight until the next day. They provided "beds" and "showers" and "meals" this consisted of dirty mattresses that were to be thrown away in the basement that were taken up by many other workers (there were not enough provided think of a ratio of 4 beds per 40 staff forced to stay overnight) and showers that were for patients and had no privacy curtains (it's a mental institution so for patient safety we have to have them visible) and the meals consisted of cans of broth. Then my supervisors called us at 6:45am the next day and asked us to pass medication! We were appalled but were told the next shifts were not coming in due to the snow. Isn't that illegal? We were told since we were not working the night we were not working over 16 hours and it was necessary since we were on grounds and being mandated!! Unbelievable! So we were then we were forced to do 7-3 shift and then our regular 3-11 shift the following shift and do a double. We were starving, thirsty, and all exhausted. It was so unsafe I was shocked non of us got medication errors. We were not paid for staying overnight but we were paid for working the 7-3 shift. How is this legal? We were threatened to be fired or I would have left but I didn't want to loose my pension and benefits I have worked so hard for. I am terrified of working this next winter.

    TLDR: I'm a nurse, worked the last winter during a snow storm and was told I couldn't leave or we would be fired. Wasn't provided with anything close to what we needed on short notice. We all stayed overnight and got MANDATED to work 7-3 the next day since we were on grounds and then our regular scheduled 3-11 shift. We weren't paid for staying overnight but were paid for working 7-3. Is this legal? I am worried with the upcoming winter.

    After my mom's passing, I called her cellphone provider to cancel her contract. They asked me to pay a cancellation fee.

    I told them that I won't pay it and they responded that I might suffer further charges and a collections agency to come after me if I don't.

    Again, my name wasn't on the contract, nor the house that this was sent to, nor they have my new address.

    Can I just ignore it?

    My sister died this year in Washington State. Her death was ruled a "suicide", which our entire family disagrees with. This also means that the police have declined to investigate what is clearly a suspicious death. I've left numerous messages with the county Medical Examiner and the Washington Department of Health, but no one has gotten back to me.

    I know a lot of families are in denial about suicide, but in our case there are too many missing pieces to let this go.

    Surprise Collections Fee

    So 5 years ago a "friend" brought me to the gym he worked at. He knew I was interested in losing weight, but I couldnt really afford a membership to somewhere. He insisted that I come out and just see the place, so I did. I remember he asked for my driver's license and had me sign a "liability form" because I wasnt a member, but he wanted me to try some machines. I hung out for a few hours, told him thanks for showing me but like i said, I cant afford a membership, and I left. I haven't thought about this in years. I signed up for Credit Karma and began trying to monitor and better my credit, things have been going well with that for about a year when all of a sudden last week a 900$ charge from a collections company shows up! It says the original debt was to Genesis Health Clubs! Now I already sent an email asking the gym to address this issue, but the dispute I filed with CK already got declined " Account information disputed by consumer, meets FCRA requirements " so I'm afraid he scanned my DL and signed for me! I really can't afford a random 900 dollar bill, I have a family to feed!

    TL;DR A 900 collections fee showed up from 5 years ago, I think my "friend" signed the contract for me when he worked there so the dispute is declined.

    Update: I had the gym send me over a copy of the contract. All the fields are hand filled in with my info and the email address and name are misspelled. They claim they "attempted to contact me" but the mail got returned and the email was invalid. I said of course it was it was all forged. The signature looks like a bad copy made from my ID. The rep said she is emailing her management and they should be getting back to me.

    (OR) Survey and seed don’t match. What do we do?

    Ugh, mean deed, not seed.

    I'm posting this for my step mom.

    My step mom had a survey done on her house that she has owned for a 7 years.

    The idea was to replace the old fence, that was falling down. But since the fence was not straight my step mom decided a survey would be a good idea.

    Well it took over a 6 weeks of active work for the surveyors to finish their exhibit map( it cost over $2500). We learned the delay is because almost all the monuments in the town the house is in are "wrong." We learned this info from the county, not the surveyors. Apparently the town used to use road monuments as the bases for property lines, which is a problem when roads get widened such as the roads around this house have. This info is very clearly documented in the county PLAT system, like 25 pages of reports.

    Well my step mom looks into the PLAT system and kinda gets a rough idea of where her property lines are. When she finally got her survey back it seemed okay.

    Until she decided to calculate the square footage of her lot. Per the mortgage on the house her lot should be 7,840 sqft, this is also what the county record states as well. The survey says her lot is exactly 7500 sqft. She knows that they are using a monument found out in front of the house. This monument is the only monument on the entire block, and even the other side of the street doesn't have any either. Also the road was widened in front of the house and a new side walk was added about 15 years ago, and the city never did a survey.

    She knows that the length of the lot is correct. All houses have a 100ft deep lot, which hers is. But it but the survey calculated lot size on the only monument is only 75 ft wide. Which would put the houses underground utilities on the neighbors property ( the one with the only monument). If she adds the extra 3.feet 4 inches. Her utilities are on her property, but her neighbors place is only 2.5 feet from the property line. She has looked, I have looked neither of us can find that their is an easement, adverse possession anything in her mortgage paperwork.

    The survey map was completed about 2 weeks ago, and the issue was realized this weekend.

    Is it worth bringing this issue up? Who do we bring it up too?

    Social security administration is claiming I received $75k in past benefits, and have to pay an attorney fee of $20k...

    I just received a letter from the SSA claiming that I owe a $20k attorney fee for receiving past benefits of $75k. I had received a check from the SSA for $20k several weeks ago which was mysterious to me. I don't mind returning the $20k at all and am completely able to. What I'm confused about it that I never received any SSA benefits, and especially not $75k worth. I looked at the local office hours, and they're 9-4 on weekdays except on Wednesday (today) which is 9am - 12pm.

    I cannot make it to their office in person because I work during those times. Clearly I can wait until tomorrow to call, but legally what's going on here? I'm very confused. I'm a 30 year old student who has been independently living on my own since I was 20 years old. When I was 14 I had received a diagnosis of autism. Later, as an adult, therapists had confirmed they thought the diagnosis was incorrect, and that the records should have been destroyed after 7 years. I suspect the money has something to do with this diagnosis, but again I have no idea and have seen no such money. Is it possible my parents have claimed to be guardians of me for the past 10 years when they weren't?

    I flaired this post with disability issues since the letter says "Retirement, Survivors, and Disability Insurance". Any insight would be helpful.

    [UPDATE][AR] An anonymous person is threatening to leak my roommate’s nudes. How to proceed?

    Good news! My roommate has found out who is threatening to extort her sexually for more inappropriate interaction. It was her ex-husband on the website, posing as someone else with nude pictures of some dude that was obviously not him. Gave her "hints" as to who he was although all information was false. The police are involved and she is pressing charges. It was disgusting.

    The guy's fiance is calling her a liar and asking for screenshots. My roommate told her that the police have the screenshots and that's all that matters at this point. I've advised my roommate to tell her to stop contacting her and that any further contact adds an account of harassment on her part. The police said her ex-husband has committed a felony - And if he decides to post these pictures, it will add another felony, accounting for 2.

    Thank you to everyone for the advice. It's a scary ride but I hope he learns a very valuable lesson.

    Dine and Dash question

    An etiquette question for meeting with our attorney

    Do I have to dress up (business casual) every time I meet with our attorney? He's helping my husband and I with an ongoing legal issue so this isn't a first appointment. The appointment is in the middle of the day and I would like to fit the gym in afterwards before I have to pick my children up but I'm not sure if it's appropriate to wear gym clothes to meet with our attorney? He typically wears khakis and a polo so not anything super formal. Thoughts?

    Cat stuck in neighbors shed for hours in heat of AZ need help!

    My indoor cat got out and is now stuck in the neighbors shed. I have called her every ten minutes for the past hour(as well as knocked on door) but being elderly she has no cell phone! His cries are growing weaker and I don't know what to do!!

    Update: Called police non-emergency line and they didn't say to enter the yard but did say they would let anyone calling about intruders know the situation. Yard and shed were unlocked and he is safe! Thanks reddit I don't know why I didn't think of the police department.

    [MO] Landlord was late returning security deposit; forgot to deduct carpet cleaning, now wants his money back

    Hi Legal advice, long-time BOLA lurker here, with my own little legal quandary.

    My lease ended on 7/21. Due to a fairly complex personal situation, I tried to negotiate a short term extension, but the landlord wasn't willing to do anything other than a full year extension despite us leasing from him for years. Frustrating, but fine. Needless to say, this puts me in a situation where I'm not willing to do him any favors.

    Our lease indicated that we would be responsible for carpet cleaning. Since the landlord wanted to do renovations on the unit after we vacated, he suggested that he just deduct the $165 from our security deposit and use that for the carpet cleaning. We have this in email. We vacated on time, and the walkthrough went fine, with no issues requiring other deductions.

    Our security deposit was postmarked on 8/28, 37 days after our lease terminated. This was after having to inquire about the security deposit 30 days following the end of the lease. In MO, the landlord is required to return the security deposit within 30 days of the lease termination. The check was written for the full security deposit ($840).

    Today, my wife gets a text from the old landlord, saying that the employee that wrote the check messed up and didn't deduct the cost of cleaning, and he wants us to mail him a check for $165.

    My question is: would my landlord be able to take action against me for not returning this amount, considering that he returned the deposit late, and failed to deduct the cost? I am fully able to return this amount, I just really feel like being an obstinate stick in the mud right now.

    If my student loan was sold, can they change it from a fixed to variable interest rate?

    I'm in the U.S. Great Lakes student loan services sold one of my loans to a company called Firstmark. They lowered my monthly payment to the minimum, but I'd like to switch it back to being slightly higher so I end up paying less overall. It's easy enough for me to change it, but I'm nervous about agreeing to their terms and conditions to do so.

    Part of it says, "The required monthly installment amount can change for reasons such as interest rate increases, changes in the repayment plan, and capitalization of interest after deferment or forbearance." But since I have a fixed rate (which sucks, but that's a whole other thing), they can't change it to be even higher, right? Or does that all go out the window once they buy my loan from someone? Thanks for your help! Loans are the worst.

    Ex-boyfriend suddenly asked me to "re-pay" him money I didn't borrow and is threatening to take legal action against me

    A few years ago, my boyfriend (locating in Boston) at the time offered to help support my living expenses by gifting me less than $200/month for approximately a year. He never mentioned verbally that it was a loan of any kind (I would not have taken the money otherwise). He voluntarily offered, and I accepted. It was as simple as that.

    A few days ago, out of the blue, he messaged me (locating in California) saying he wants all the money back. I never signed any written contract with him saying it was a loan, nor was it previously discussed through verbal agreement that it was a loan. He also threatened to take legal action against me.

    So now my question is, will he be able to successfully take legal actions against me?

    [ON, Canada] My mom is legitimately sick but her employer has declared that she must return to work immediately. All the medical paperwork from several doctors have been provided. Does she need a lawyer? What can I do to help her?

    Hello all. Right now I'm feeling pretty helpless. I can't help alleviate my mom's physical pain and I'm not well-versed enough in the legal aspect of the workplace and injuries. I am just looking for some help and the options my family and my mom have. So thank you in advance. It is so appreciated.

    My mom is sick and certainly not well suited to return to her labour-intensive job. She's had two surgeries to remove cancerous lumps were from her throat within the last year and a half. She still takes pills post-op. My mom's last visit at her otolaryngologist was reassuring; the doctor stated that everything dangerous has been removed. My mom goes once in a while for check-ups. Although, my mom's voice isn't the same and she doesn't speak as much as before. It hurts for her to talk for prolonged times.

    Not only that, but she has had trouble walking for several years now. She can walk but at a very very slow pace. My mom also cannot walk for very long without feeling aching pain and discomfort. We've gone to our family doctor and there's not much medicine can do at this point but taking vitamins, medicine and taking it easy. Our family doctor is well aware of her current, worsening condition and fully supports the fact that my mom should not return to work as of right now.

    My mom's current physical state: swollen all over, has been in bed all day. Likely due to the meds (?) and exhaustion. Her knees get swollen from time to time and isn't able to stand without feeling pain. It varies from day to day and her level of activity.

    My mother is in her early 60's. She has only had to ask for a leave of absence once and that was for her recovery from the surgeries to remove the throat cancer last year. She's been employed with her company for at least 10 years.

    • My dad spoke with her employer today (my mom does not speak fluent English) and was told that my mom has to return to work immediately. Does this mean they do not believe my mom and her sick condition?

    We have provided everything they have asked for including the signed paperwork, the official doctor notes (from three doctors) and have provided prompt, clear communications with them.

    My dad has told me to start looking up for personal-injury lawyers. I want to help my mom in any way that I can. But where do I start? Is it time to look for a lawyer?

    I'll gladly answer any questions if needed. Thank you so much.

    Edit: Her job involves with her standing on her feet for most of the day as she works on the line.

    Neighors shed runs into my poroperty

    As the title states. They are new neighbors with a new shed. They just had delivered. It's already filled with their tools and keep sakes. But it is also 3/4 into my property line. Our houses arent but maybe 20ft apart. I just had the property surveyed there are steaks pointing out the line. How should I go about having them move it? Breif talks have not lead to anything on their end. We are in Georgia.

    Towing company took my car before the 24 hours they had given me on the notice

    I'm a student at a college in Charleston, South Carolina and yesterday at 3 pm I parked my car in the library parking lot because I mixed up the hours for free parking (it's free after 3:45 pm, I thought it was after 3:00.) So they booted it. This was my mistake and I acknowledge this and had no problem paying the fee to have the boot removed, however I saw this at 4:30 pm and had to be at work at 5:00. So, under the impression I had until 3:00 pm today to have it taken care of I went on to work and knowing I'd be on campus this morning came to the parking lot at 11:00 am, the car already gone. So I went to the office of transportation and complained thinking there must have been some mistake. Nope, their attitude was essentially "not our problem" I explained that the notice specifically clarified I had 24 hours to pay the fines before it would be towed and they said that the 24 hour notice on the cars is "just what they do-but because I was parked there they are free to tow whenever they want" and that it doesn't matter what the notice says because I shouldn't have parked there. I think this is absolute bullshit, while in the office I paid the parking and boot fee and Im waiting to get a ride out to where the towing company is based, but I'm sure the towing company will want me to pay them too, is there any legal grounds for this? Legally, is there any way the school would have to pay this fine or the towing company waive it considering they towed it before the time limit they had set for me? It's only 11:50 now, even still less than 24 hours. The office told me I was SOL and had no standing because being parked there means they can do what they want, I just don't understand how you can post a misleading notice on the car giving me the impression I have more time than I really do. I'm a broke college student waiting tables to pay rent, I have no money to pay a towing company 100-200 for what seems to me to be their or the school's fuckup. If anyone has any advice it'd be greatly appreciated, I know these matters depend on location so once again I'm in downtown Charleston, South Carolina (and am a resident of SC).
