Being sued for helping a choking victim (OR)

    Posted: 25 Sep 2018 11:19 AM PDT

I was eating at a diner with some friends at 3 am, the guy in the booth next to us started coughing and gagging. I realized he was choking and went to help him, I had Heimlich training at my place of work (I'm office safety manager for my floor). The guy managed to get the thing out and it flew across the booth. He looked really pissed, payed his bill and left. I felt like a little hero the rest of the dinner and then just kinda forgot about it. This was two weeks ago.

Today I got a letter from a law firm that I'm getting sued for battery, they said I bruised a rib, I have no clue how this guy figured out who I am. I thought I helped the guy seeing as he probably would have choked without help. How did he figure out who I am? I never actually spoke to him. Is this a real letter? Do I need a lawyer for this?

Edit: the language i used to describe him choking was wrong. He was choking, gagging sounds but otherwise silent and obviously distressing.

My school claims it has the right to search every vehicle parked on-property.

    Posted: 25 Sep 2018 07:06 AM PDT

To start off, I am seventeen years old, and I live and go to a public school in Massachusetts. My school makes us sign a contract during the yea, (for those who drive and park at school), stating that they have the legal right to search our cars without a warrant if they find it suspicious, gaining that right via the signature on the contract that we all sign. No parents sign the contract, it is just our names and our license plate. Since most of the students don't own our own cars, (our parents do), and are not adults, I was just wondering about the legality of this contract, if we even have that right to sign away, and if it can hold-up in a court of law.

    Thanks!

EDIT: Okay: Follow-up questions/comments: A) I never signed the agreement (my school is really badly organized, and therefore they never noticed . Plus, they never check the parking stickers anyway). Does that change anything? Furthermore, I happen to have a twin sister who also drives to school sometimes (we switch days sporadically). Does that make a difference? Thank you for all the helpful responses!

[UPDATE] [CA] How can I get my neighbors to get rid of their noisy chickens?

    Posted: 24 Sep 2018 06:17 PM PDT

I posted this post about three years ago, and it got very little attention, but some people did help and for that I was (and am) super grateful. Plus, I figured we all like update posts, and this situation of chicken warfare is finally resolved.

To recap: my neighbors had five chickens that would squawk at ungodly hours of the morning and night. They were actually my parents neighbors; I was crashing with them over the summer and have since moved out. We did contact the city, who came and determined that they were up to code. But the neighbors assumed it was us (my parents had been pretty vocal in the neighborhood about not liking the chickens), and they decided to retaliate.

First, they claimed that a structure on my parents' property was illegal, and my parents had to deal with a city investigation, which turned up nothing, because it was not illegal. Next, they claimed that our little patch of sidewalk front yard, which is right next to theirs, was actually infringing on their property and demanded a property survey. We actually discovered that their front garden was partially on OUR land, so that was nice. My mother e-mailed the neighbors letting them know they were going to put up a little line of stones just to keep the garden property line clear so that they could plant their side, and the neighbors went batshit. Started sending long, rambling e-mails to my parents, started calling and hanging up, started throwing trash on our side of the garden and they eventually left several dead rodents still in traps on our front porch. After that, my parents got a security camera.

Things quieted down for a while, and we soon found out it was because the neighbors were trying to sell the house. Their house is pretty nice, and we live in a high COL city in a neighborhood that has really gotten popular in the past ~10 years. Basically, if all went well the neighbors would be making 2 or 3 million dollars from the sale. They hosted several open houses, and this is where my dad decided to get petty. See, my parents deck directly faced the neighbor's backyard, which still had the chicken coop and was one of the main attractions of the open house (they were actually trying to sell it as an "urban farmhouse."). As people would wander into the backyard of the open house, my dad would stand on his deck holding a very large sign that said, "NO CHICKENS IN THIS NEIGHBORHOOD." The other side said, "THEY BRING RATS AND VERMIN INTO OUR LOVELY COMMUNITY." I was half horrified, half cracking up. I told him that it would only escalate things, but he was insistent that any new neighbors not be allowed to keep the chickens. He would periodically shout down into the neighbors yard (our houses were very close), "we will NOT allow new neighbors to keep chickens!"

My parents got many furious calls and e-mails from the realtor and the neighbors. Apparently my dad was making people hesitant to buy the home (I don't blame them, he was acting like a crazy person), offers were dwindling, and they were going to have to lower the price. My dad said he would stop his chicken protest if the coop was removed; the chickens stayed, so my dad stayed on his deck for every single open house.

To make a long story of chicken subterfuge short, the neighbors sold the house. On their last night in the house, they egged my parents entire backyard and deck. I asked my dad if he wanted to report it, and he said it would be better to be rid of them. A lovely family has since moved in, and the first thing they did was dismantle the coop.

TL;DR: petty neighborhood chicken drama results in fowl play, but new neighbors are eggcellent.

Can I be held responsible for my neighbor’s cat attacking someone on my property? [GA]

    Posted: 25 Sep 2018 04:57 AM PDT

My neighbors have a cat that they let roam outside quite a bit. This cat bites and scratches, and will hide in the bushes and attack people's legs as they walk past. She has given me and my daughter minor injuries (scratches) several times since the neighbors moved in last spring. I have informed them that their cat is aggressive and keeps scratching and biting us, and I asked that they keep her out of my yard, but they still let her out to roam nearly every day.

Last week, the cat jumped out of the bushes and attached herself to the pizza delivery person who was walking down my sidewalk, and she left scratches on the man's leg. He was really mad, which is understandable. I told him the cat belonged to my neighbors, and pointed out the house to him, but now I'm wondering if I can be held liable for injuries caused by their cat on my property.

Expedia changed the date, location and price of a cruise booked over the phone then treated it like it was our fault

    Posted: 25 Sep 2018 07:48 AM PDT

My mother had found a 4 day vacation from Miami to Cuba leaving October 1st on Expedia.com. She called Expedia to book the cruise last night and they had a nice conversation about how excited they were to finally visit Cuba and how this was for her big wedding anniversary with her husband and once they were all set Expedia sent her a booking confirmation via e-mail... except that the booking confirmation they sent was leaving October 6th and not for Cuba but to the Bahamas and a significantly higher amount then the offer they agreed upon over the phone and what was advertised on Expedia.com. Her card was charged this higher amount and the entirely different cruise at an entirely different time was booked. My mother immediately called Expedia to rectify the issue. The customer support representative informed her that they were no longer offering any cruises to Cuba that week and that their website was not up to date which was the reason this happened but no explanation why the woman still booked it. They offered a refund which they informed her would take a month to process. This was not a small amount of money and my mom does not have any additional money to book a new vacation while she waits for the return money. She and her husband had already requested this time off in advance and cannot change their time off. Additionally my mom booked a flight from New York to Miami and back for this cruise date. My mom requested a supervisor and the supervisor told her that once it was booked it was out of her hands and that they could try contacting Norwegian. My mom called Norwegian who advised that if you book with a third party company that they would have to go through the third party company to rectify the issue. By the time she receives her money back she will no longer have any ability to book anything last day. Is she stuck with this cruise she ultimately did not purchase and paying a higher amount then she agreed upon? Is there any other options my mom might have to settle her issue and possibly get a refund sooner?

TLDR: My mom booked a cruise over the phone for Havana leaving 10/1/18, got a confirmation for a cruise to Bahamas leaving 10/6/18. She is out thousands of dollars and informed that it will be up to a month to get it back and cannot change her days off and flights. Do we have any options or recourse?

My mothers boyfriend of 10 years just went on a rampage and made me fear for my life.

    Posted: 25 Sep 2018 03:45 AM PDT

I don't usually post on Reddit and am quite new to this but less than 2 hours after the incident I'm sat alone with no where to go and need somewhere to get advice. I live in the UK Cambridge area.

My mother's boyfriend who is roughly 40 decided to wake up this morning and turn off the WiFi whilst me a 17m who pays a reasonable amount of money for rent was trying to relax and drink his coffee. Long story short. After I confronted him.about it I agreed to what he wanted from me but he still refused to turn it back on. I got irritated and swore at him and at that point he launched himself up from his chair and dared me to say it again and me being a stupid 17 y old said it again. But he had a complete overreaction and ran at me which is when I ran back into my room and held the door shut.

At that point he was going absolutely insane and I was shouting through my door that he needs to calm down and then we can talk about it. But this angered him even more and he started throwing glass plates at my door. And screaming "I'm going to Fing kill you" and "I'm going to wring you Fing neck" I was shaking and quite scared but decided to go out there and just tell him I'm sorry and he needs to calm down because I think he's overreacting but that's when he grabbed a large plant pot and threw it at me however I managed to close my door which is where it hit. At this point he was screaming you better hide and I'm going to Fucking kill you whilst trying to bash my door down but I was holding it shut and shouting at him to stop. I packed a few things and climbed out my window and jumped off my roof before going to my father's friends house and climbing sitting here whilst they are at work since I know they'll understand.

I'm sorry if this is jumbled and I am still shaking. What do I do in this situation what can I do?

We were the only 2 people in the house

The reason I'm posting here is because I'm sat in this empty house with no one to turn to

[OH] Landlord will not send me any proof of damages after move out, and threatened to countersue me if I go to small claims.

    Posted: 25 Sep 2018 07:25 AM PDT

Located in OH. I lived and worked at this apartment complex for almost 3 years, 2 of which were in management, small staff of 2 managers. About 6 months prior to the end of my lease there was a change of ownership. Typical in this business, but with some nepotism and my boss, the general manager, being demoted to a maintenance position, I quit very abruptly with a 5 day notice and definitely burnt some bridges.

My lease just recently ended and I received an invoice for $900 which I greatly disagree with. My main question is about this code regarding security deposits. Specifically, sections B and C about the 30 days the landlord has to deliver the invoice for charges against a security deposit. My understanding of this code is that the landlord must deliver the invoice within 30 days or I'm entitled to my whole deposit back. I received the invoice 37 days after the end of my lease. Some help interpreting this code is greatly appreciated!

Secondly, after weeks of attempting to get ahold of management about my charges, I finally received a call back after I threatened a small claims suit and cited the Ohio code above. They said they felt they were generous with the charges and that if I go through to small claims they will countersue me 3x my original charges. Can they really countersue me for something that wasn't in the original charges? I'm still waiting to hear back from ownership/management about a potential middle ground. I still haven't received any proof of the damages that I was charged for despite repeated requests. I just feel like my back is against the wall and would appreciate any legal advice. Thank you!

New apartment management claims to have lost my lease and is trying to get me to sign a new one with a added pet fee. [NY]

    Posted: 25 Sep 2018 07:56 AM PDT

I am a college student in my senior year and I am living off campus in an apartment with my girlfriend and our dog. We signed our lease in August, the lease includes our dogs information and it clearly says that there is no monthly pet fee. The original management company that we signed a lease with was replaced. Shortly after I received a call from the new management telling me they lost my lease and I needed to sign a new one. I didn't fall for it and I politely informed them that I had a saved copy of my already signed lease that I would be happy to send them. I thought that was the end of it but when I went to pay my monthly rent I saw an added $35 pet fee. I paid the normal rent except for that extra 35. I then received an email from the apartment management and they stated that it was against their policy to not charge a pet fee and that I had to sign a new lease. I am very uncomfortable with this, I'm a college student on a pretty fixed budget and this $35 is a lot for me. How should I go about dealing with this and what can they do to make me sign? I definitely don't think I can afford a lawyer if they were to try to evict me.

[WA] My parents have had a legal first-right-of-refusal on neighboring property. Neighbors sold land to someone else without notification. Any recourse?

    Posted: 25 Sep 2018 11:58 AM PDT

My parents have a 2 acre lot where they now live. Their neighbors have a 1.5 acre lot that would've fit perfectly with my parents' land. About 8 or 9 years ago, my parents approached them with a first right of refusal and offered them $2000 to ensure that if they ever sold the property my parents would have a chance to buy it instead for their best offer. They had a local attorney draft a contract and it was signed by everyone and they got the money. Unfortunately, the attorney passed away a few years ago. The neighbors believed that since the lawyer died, so did the agreement. There was also a disagreement between my dad and the neighbors on how to maintain the shared private road. This led to some general dislike between them all, so when the neighbors refused my parent's offer made through the real estate agent, my dad went over there and the husband literally told my father to "F--- Off" and he doesn't have to sell to him because the agreement is void.

Is this true? My folks found out today from the real estate agent that an offer has been accepted by our neighbors and they are in escrow. The real estate agent knew about the first right of refusal and she said that even though my parent's offer was slightly higher (only $1000), the neighbors decided to go with a different buyer. She said that the first right of refusal contract doesn't matter and that they can choose to whom they sell to and that my parents should have offered much more.

Is there any recourse for my parents? They have a signed contract. They gave their neighbors $2000 in 2010, I think.

They are looking for a new real estate attorney now. In the mean time, what chances do they have in stopping this sale?

[FL] Closing Sears Store Sold Us a Display Unit That They Won't Take Back

    Posted: 25 Sep 2018 07:22 AM PDT

A Sears store near where we live was going out of business and was selling (working) appliances on discount. The merchandise they were selling were in boxes and were still under manufacturer's warranty. We purchased a Samsung cooktop and we were told it was still under warranty. We were told all sales were final. When we got home and got it installed, it did not work. We contacted Samsung and they sent out someone to look at the cooktop and we were told that Sears sold us a display unit (that was not supposed to be sold) and that if we wanted it to work, we would have to spend upwards of $300 for a part and even then, it may not work and would be considered out of warranty. At no point during our purchase did they mention this was a display model.

Now, we are in the process of getting a return or at the very least an exchange to purchase a working model. However, Sears says that all sales are final and that they are not responsible for stores that were closing. They don't seem to care that the cooktop was not even supposed to be sold. I would understand if they wouldn't take back a working appliance, but this was a display that was never meant to be installed in a home or sold. They basically conned us. What are our options? Any help would be much appreciated.

UPDATE: We spoke with our card company and filed a dispute against the charge. They placed the charge on hold and they are sending the paperwork for me to fill out in 7-10 days. Samsung has put all the information regarding the cooktop on our file and they are willing to provide it to our card company should they request it.

[Pittsburgh, PA] Am I being blackmailed or something similar that's illegal???

    Posted: 25 Sep 2018 06:52 AM PDT

Long story but it comes down to this:

Ex-wife and I had an MSA that we both agreed upon with one exception. We owned a campground with my mom. My ex and I owned 55% and my mom 45%. After we separated, my ex decided to sell my mom's cart and stuff that didn't belong to us. My mom had paid $1400 for the cart and made it very clear that it was hers when she bought it. My kids have verified this as well.

My ex has crushed me in every step of the divorce proceeding because my income is considerably higher. She walked out on my and the kids but in a no-fault state, all that matters is how much we earn. Because of this, she has taken the stance that my mom is "shit out of luck" and shouldn't get her share. She wants to give us $2000 to share when the camp is worth $12,000 which she'll keep and then sell. I refuse to budge.

SO, my mom went to the state police and they confirmed it's a theft and they filed charges. The magistrate filed civil charges(?) too so she can try to recover her money.

My ex's lawyer sent this yesterday:

We have been notified that my client is being charged with theft and being sued for her share. If your client does not get his mother to drop all charges and accept the $2000 buyout, we are taking the MSA off the table and we will take him to court to fight for every inch.

How is that legal???? Drop the legal charges and accept our clearly shitty offer and ignore that my client legitimately broke the law and stole from your client's mother, or we'll crush you even worse in court.

Please help. I am in a bad place.

Is it legal for my school to do this?

    Posted: 25 Sep 2018 11:51 AM PDT

Hey guys, so recently my school has had a string of fire alarms being falsely triggered by people smoking in the bathrooms. In response to this, our principal has installed security cameras in our bathrooms. I feel this is a violation of personal privacy and shouldn't be legal but I'm not too familiar with laws behind privacy especially for minors. Also, is there a way to complain about this to some authority so it can be dealt with if installing cameras is indeed illegal? Thanks My school is a school in California by the way.

Can you press charges on someone who instructed their child to perform sexual acts on you?

    Posted: 25 Sep 2018 10:16 AM PDT

    ARIZONA, USA

So long story short... my ex-neighbor from my childhood was arrested about 10 years ago for sexually abusing his children and making porn out of the abuse. He got a 10 year sentence and is scheduled for release at the end of this year.

WELL admittedly my neighbor never did anything sexual to me, but he would tell his son (who was also the about the same age as me, but one year younger) to perform sexual acts on my brother and I. We were like 8 at the time and my brother and I didn't really know the seriousness of the situation until we got a lot older. Heck, I didn't know the guy got arrested until 2 years ago.

I honestly dont know if I can press charges since it was his child who did the acts and not him.

[NJ] Land Use, Right-to-Farm, Tree Law: Neighbor is destroying my backyard

    Posted: 25 Sep 2018 07:05 AM PDT

Allow me to apologize in advance because I feel this is going to be long post, but I would appreciate any assistance.

I am a resident of New Jersey. My family and I moved into our home three years ago. It's a sizable lot and happens to be next door to a garden center (GC). GC sells trees, bushes, flowers from spring until fall and then switches over to a seasonal shop for Halloween and Christmas.

There are mature trees along our shared border (~900 ft.) with one exception. There is a ~30 foot gap which is now filled with tall grass and stagnant water and extends out from the boarder approximately 40 ft. Directly in front of this area is where my neighbor has installed irrigation and stores trees and bushes once they are offloaded from trucks. He has also paved most of his property and, to my knowledge, does not have any storm drains or catch basins.

A little background on GC. Approximately 20 years ago, our town cited the owner (Owner) for erecting buildings without permits, putting up signs, developing the land, etc. Owner and the town went to court and the town won. Owner appealed the decision and Owner won under Right-to-Farm. Since then, he has pretty much done as he pleases without guidance from the town. I will explain how I know this later on.

A little background on my property. My house was built in 1999. The lot was once part of a larger lot that was split into two. The other lot was vacant until this year when it was sold, and they started building a home (New Neighbor). My home is in the center of the property with a walkout basement. According to the original site plans of my house, there was an "existing swale" that ran along the shared boarder between GC and me, around the back of my house, and off through New Neighbor's property to a storm drain. GC no longer has a swale on his property. He has leveled it out to the boarder and is approximately 4 feet higher than my property in some areas. Also, the point where the swale originally crossed from GC's property to mine is approximately 40 feet away from the problem area I spoke about. The original swale (which is a dry shallow vee) is still visible around my house, but there is now also a new 4 foot wide and 2 foot deep "river" of standing water and reeds from the problem area straight across my backyard and meets up with New Neighbor's swale. I used use New Neighbor's yard to cross over because his swale was shallow and dry but I cannot do that anymore because of the erosion over just 3 years.

Approximately 1 year after we moved in, I saw Owner at GC and made small talk. He asked how we liked our home and the neighborhood and complimented on the way I was maintaining the land. He then very awkwardly segued to the standing river, saying that it was naturally occurring and not to get rid of it. The conversation immediately ended and I instantly became skeptical of him. Shortly after I started digging and found out his history with the town.

I've spent a lot time cutting down tall grass, getting stuck in mud, and I built a bridge across the water. And one day I got fed up. It was lightly drizzling and the water coming onto my property was like a waterfall. I took a video of it and photos. That day I called a family friend who is on the zoning board of the town and he came to see it. He noted that they actually dug a channel to direct the water from their property onto mine (took photos). I asked if there was anything the town could do. He offered to speak to Owner on a personal basis. Owner's response was he was unwilling to do anything unless I hired an engineer. My friend filled me in on some of the issues the town has had over the years with complaints and how he uses his status as a farmer to do as he pleases.

I decided to turn to the NJ Department of Environmental Protection (NJDEP). I filed a complaint with the storm water division citing the erosion and water runoff onto my property. NJDEP send over a representative who noted the water, the irrigation water flowing onto my property, the diversion of runoff onto my property, etc. He met with Owner and Owner promised to fix the runoff issue and to plant water absorbing plants on his property by the spring. It sounded promising but I was disappointed that nothing was captured in writing. I was right to be skeptical. Spring came and went.

I followed up with NJDEP and decided to push the issue with Land Use. Again someone came out and she was pretty surprised about the extent of damage. She pulled up satellite images dating back before 1999 through today and noted that it is clear that there is a change in the flow of water since he developed his land. In late August, she sent a letter to Owner outlining her observations and asking him to respond. Of course he has not. What's more frustrating, I cannot seem to get NJDEP to give me details such as a copy of the letter sent to Owner, what the procedure is, etc.

So, I'm stuck with a mosquito breading ground and a backyard I cannot enjoy with my children, and I am out of options. I feel I have given Owner enough time to, at the very least, stop diverting water onto my property. I don't really have the money for a long drawn-out legal battle, which is why I asked NJDEP to help, but I am getting desperate at this point. What are my next steps? Thank you in advance.

My father wants his corpse to be blown up. He's serious.

    Posted: 25 Sep 2018 10:35 AM PDT

While visiting my parents in Wisconsin I asked them about their will and preferred "final resting arrangements." They are both in their mid-fifties and good health. My mother wishes to be cremated and her ashes scattered around the trees in their yard, but my father wishes to be blown up in a field on his hunting/fishing property, letting his biomass return to his favorite ecosystem. He owns 50 acres in a wooded northern Wisconsin county with very distant neighbors.

He has rather severe claustrophobia and is adamantly against burial, and the cremation process and (temporary) storage in an urn also makes him uncomfortable.

If it is in his written will, would blowing up his body still be considered desecration of a corpse? Hopefully we have many years before he dies but I would like to figure out how to honor his wishes without committing multiple felonies.

(CA) Withholding my last paycheck, what to do?

    Posted: 25 Sep 2018 07:08 AM PDT

I worked for a very popular store that I call "the B". It's going under and for the last year I would work 6 hours a day and was denied breaks because management said they don't have anyone to cover that. I quit 2 months ago and have not received my last paycheck. I called the other night and asked that they mail it to me, but was told no, I have to show up and fill out more paperwork. I do not have the time as I am working full time now and I walk to and from work, walking 3 miles a day and getting there is another 2 miles. Am I crazy or do they have to make sure my pay is gotten to me? Can I file a claim with the state or should I seek legal counsel?

Doctors office didn’t tell me that they don’t take my insurance and now I owe $1500

    Posted: 25 Sep 2018 01:51 AM PDT

After my son was born I received Medicaid through my state. I called Medicaid to make sure the IUD I wanted was covered and went to my doctor to have it put in. It was my first time back after being approved for Medicaid. I gave them my Medicaid card (as well as my Medicare card) and received the IUD. The next time I went to the office for a check up they asked if I wanted to pay anything towards my $1500 balance. I was shocked and they proceeded to tell me they don't accept Medicaid from Kentucky because they are located in Indiana. Is this something they should have told me about before I got my IUD at my previous appointment? Do I have any case to have the cost reduced? I can't afford a $1500 bill right now and would not have proceeded if I knew that.

Wife and I had IVF done recently. Possible HIPAA Violation?

    Posted: 24 Sep 2018 02:02 PM PDT

Edit: Thanks to everyone for their replies. We decided to file a complaint and let the investigating agency decide if there was a violation.

A few months ago, my wife and I recently went through IVF. The fertility clinic makes it part of their process to test all patients for gonorrhea/chlamydia. No big deal, I guess. Our real issue is that the lab company sent the bill to my wife's workplace. It was addressed to her, but her workplace opened the bill. This was really embarrassing for my wife, because the HR lady saw the bill; it only showed a line item for "Chlamydia/GC Amplification". In an attempt to save face, she had to explain our infertility issues which is hard for her to do.

After making some phone calls, it appears that the fertility clinic filled the forms out correctly and the Lab company sent the bill to the wrong address. When I called them, they apologized and said they'd look into it. They followed up with us by sending a copy of the form the clinic sent in (which was filled out correctly). They claimed it was the clinic's fault, but the formed showed otherwise.

We were upset with this, but decided to just move on. That was all a few months ago.

Well, today, we received the other bill (I guess one for each of us. I don't know why this one took so long). This was, again, sent to my wife's workplace and again opened. Is this a HIPAA violation?

    Thanks.

[CA] My ex-wife appears to be hiding income and assets

    Posted: 25 Sep 2018 02:38 AM PDT

I'm going on 3 years of divorce proceedings and my ex-wife, backed by her millionaire father, has decided to make a piñata out of me forever. I live paycheck to paycheck even though those paychecks would be pretty great - she just takes about 60% of my net spendable, which isn't so much when you're dragged into court 4-5x/year.

In discovery with the last round of stuff, we found mortgage docs reporting 300k in savings claimed/verified (19 days after telling the court she had 50), and while she claims her income has gone down by about 35% in the last 2 years, we also found she's been hiding multiple accounts and credit cards showing truly out of control spending (average of 2500/mo, peak monthly at ~10k).

She works for her father, so, dropping income but being compensated by him paying her CC seems the plausible here.

Keep in mind, this 2500 also has nowhere to be found: $3,800 mortgage, federal/state/property taxes, what must be enormous legal fees, her half of the preschool, her half of the sitters, etc

So that's all coming from somewhere else.

She's claiming a 60k income supporting all that. My problem is that after bringing it up repeatedly, the judge always just shrugs it off and rolls her eyes. The ex is living a very charmed life, and I get made out to be the bad guy for not wanting to fund it, and all I want is to pay something fair and live my life.

How can I help the judge to see the very clear falsehoods she's propping up as her finances? I don't even want a slice of what's probably rightfully mine, I just want them to stop he abuse so I can just be able to afford to live.

    Thanks for any insight.

Supports under our house are pushing through the floor, landlord says it's out fault for running the AC. In the middle of the summer. In South Louisiana.

    Posted: 24 Sep 2018 07:53 PM PDT

About two weeks ago we noticed a small bump in one of the bedrooms in our rent house. We noted it and let the landlord know the floor was having an issue. He tells us he will come by and check on it.

A few days go by, and the floor is noticeably worse. Before, there was just a bump about 5ft long and 4 inches wide, maybe raised an inch or two. At this point the boards were starting to come apart and the bump became about the length of the room, a foot wide, and about 4 or 5 inches tall. We also noticed a new bump starting to appear in the living room, which is next to the room the original bump was in. The bumps are parallel to each other separated by the wall between the living room and bedroom, about 8 feet apart. Again, called the landlord and let him know, said he would come by, still didnt.

Fast forward to today when we heard a loud snap in the living room, go check it out, and now the bump went from the small bump to the much larger bump. Again, called the landlord and he said he would be by. He showed up about an hour ago(9PM now) and said that it was our fault for running the air conditioning and sucking the moisture out of the boards. I've had two people come in and look at the floors and tell me that theres no signs of water damage to the floors.

Everyone has said it seems like the house is sinking (very muddy underneath and the house is raised up on brick pillars about a foot) and that the supports are pushing through the floor.

I guess my question/concerns lies with can he actually try and blame this on us? We have a lawyer at the ready in case he tries to make us pay for it or try and hold our deposit(1k) but we were looking for just some insight or anything as to the legality of this. Thanks in advance

    Workman’s comp?

    Posted: 25 Sep 2018 07:38 AM PDT

Sorry this is long but I tried to just say the salient pieces. It's been such a mess. I work at a desk job. It never has been physical in nature. I started working at a new place a month ago and was doing my normal job when suddenly my supervisor told me I was going to have to go to another building, empty out about 2 dozen tall file cabinets and a few shelves of misc stuff, plus the rest of this room, pack it all up, take the stuff on a dolly and put it in my car for as many trips as that takes. Then take it to my building and do the reverse. Again, however many trips I need to make to get it in the building. It's a lot of physical work. The worst part is that I have to dress very nicely for my job. So I always wear a skirt and heels. I was dressed like this the day she told me I had to do it. Of course I twisted my ankle but didn't say anything. Yesterday I got to work and she called me and wanted me to do the same thing. I asked her if I could at least dress down to do it and she said she wasn't comfortable with that and I could do it in my skirt/dress and heels. I tried to come up with another solution and told her I don't want to twist my ankle again bc I'm trying to move heavy stuff. She wouldn't have it and told me I don't have a choice and I have to do it. Heavy implication I would be fired if not. So I started to do it and sure enough hurt my ankle again. This time I needed the dr. Called the agency that placed me here and asked for the forms. The HR guy immediately flipped out about me calling him and referenced how I call him every day with problems and I've only been there a month. I've never called him before and I told him that and he just said "I recall differently". Then he told me he didn't believe me that I needed workman's comp forms before I could be seen bc some clinics won't see you without them for work injuries. I had gone to 3 places and they all told me they wouldn't see WC cases no matter if he believes it or not. Anyway, after berating me for 45 minutes he said he would email me the papers. I still didn't receive them 2 hours later so emailed to remind him I needed them. He called me back and told me he had set up an appointment with my supervisor that assigned the physical labor tasks and himself. I said that he seems to have some sort of feelings about me and I'm reluctant to go to a meeting that would make things worse. He said "oh yeah I'm going to make it worse". He argued with me a bit more and I tried to redirect by saying I just needed the WC paperwork. He told me to look it up online and hung up on me. Now I don't know what to do. I still don't have any WC paperwork, I now have to have a meeting where I know the people are striving to make things bad for me, and I'm supposed to work there the rest of the year (I guess. Can they fire me for asking for WC forms?). I don't know why this HR guy freaked out but I'm terrified of this meeting. I just need some advice; are they allowed to change my contract so drastically different than my job description? Can they deny me WC paperwork like this? Suggestions about how to handle this meeting? Anything else you could suggest? Thank you in advance!!

TL;DR Completely against my desk jobs description I was suddenly asked to do some heavier physical labor in my dress clothes consisting of a dress/skirt and high heels by my supervisor. I ended up getting hurt and the HR guy has been resistant (to say the least) in getting me paperwork. He also is setting up a meeting with my supervisor that he guarantees will make the situation worse.

Edit: Oh and I am in Ohio. Thnx.

My parked car was involved in a hit and run by an Enterprise rental truck. I just received a letter from Enterprise denying all liability because “the alleged operator of the Enterprise vehicle did not have expressed or implied permission to operate the vehicle at the time of loss.”

    Posted: 24 Sep 2018 08:32 PM PDT

I was parked in front of my parents apartment complex (San Jose, CA) waiting for a couch to be delivered to them. We heard the delivery truck arrive outside, so I go to the balcony and watch the truck back up in attempt to re-park. I guess he overshot because he completely side swiped my small car and took a chunk out of the back left side. Realizing what he did, he took off quickly. Upon calling the furniture company that the couch was being delivered from, the delivery guy claimed they skipped my parents house, and that they were never there in the first place. I filed a claim with Geico my insurance company and received a letter today from Enterprise denying liability. The gist of the letter was that the person driving never had permission to drive the vehicle in the first place, so Enterprise is not responsible and they will not reimburse me. Do I have a chance at getting my money back if I take this to small claims court? Even with full coverage insurance I am out $1600. This is a huge loss for someone in my financial situation. Any advice is appreciated, thank you!
