    [Update][NC] Rear-Ended by Uninsured Driver

I realized that I never updated all of you -- and while this one may not have been a massive win, I know I always appreciate seeing some closure to the posts around here.

    Background:

I was rear-ended by a minor, and his insurance policy had lapsed months ago. His mom contacted me and offered to make things right.

    Update:

The mother of the driver and I went back and forth for a while. I went out of my way to provide quotes from multiple sources, and each one was "way too high" in her opinion. She asked me if I would be willing to go to a shop of her choosing. Careful not to blindly agree, I told her that I would be happy to consider anything she sends my way, as long as they're reputable.

Turns out, her "guy" worked out of what appeared to be a junkyard, and had multiple felonies for assault. I told her that I didn't feel comfortable with him working on the truck. She fed me some lines meant to make me feel guilty -- I don't hold people's past again them and I'm a single mom etc. This just put us back to square one. I would provide quotes, she would tell me they were too high, ad nauseam.

To her credit, she was a pretty good liar -- or at least creative.

Things that she told me were happening, but never did:

    • Insurance made a mistake, and they would contact me to pay for the damage
    • Her church was taking up donations for her to pay the damage
    • Her son was getting a job to pay for the damage
    • Her ex-husband was loaning her the money to pay for the damage
    • Her bonus was coming, and she'd use that to pay for the damage

It got to the point that I was allowing this to continue, more out of morbid curiosity than anything else. I had a slightly bent bumper, and a year's supply of stories from this lady. But eventually I got tired of the charade, and told her that if she didn't pay by December 1st [~5 months after the accident], that I'd be suing.

December 1st rolled around and no payment [of course].

December 2nd rolled around -- and I GOT PAID.

Was it worth handling myself, instead of letting insurance go after them? Maybe.

Would I do it again? Absolutely not.

    TL;DR

Kid's mom didn't pay for 5 months. Threatened with suit -- got paid. Next time let insurance deal with crazy.

[FL]Neighbors/tenants cutting down my magnolia trees w/o consent

    Posted: 06 Jul 2018 08:07 AM PDT

MS Paint Diagram (since y'all seem to like those)

I inherited this house & surrounding property from my great grandparents when they passed away. This includes two rental properties, which my great-grandfather had been renting out for years to two families. Relations between the three families had always been cordial, even when my great grandparents passed a few years ago and I became the new "landlord", though the "dads" of both families are only a little younger than my grandfather, and I get the impression from our interactions they chafe a little bit that their new landlord is a woman in her late 20s, but I figured everything is fine because I've never raised the rent beyond what my great-grandfather set it at, and I always have professionals over to deal with any issues on the homes within 24 hours of receiving a call from them.

About three years ago, a local kid was messing around in my magnolia trees, and broke his leg. My homeowner's insurance paid the settlement to the kid's family, but just to be on the safe side I had a surveyor come out and mark the property line for my "lot" (they also used the word "plat", but I'll be honest, this isn't my area of expertise) vs the lots of the two rental houses, and then had a contractor come out and put a white PVC fence at the property line, just to ward off a repeat incident.

Like some kind of fairy-tale, the kids of the families that rent from me fell in love and have decided to get married. They wanted to have a "block party" and the bride's father asked if I'd be okay with them decorating on my property as well, since it's part of the block. I admit, I took "decorating" to mean things like hanging lights or other traditional wedding decorations, so I gave my consent.

This morning I woke up to the sound of chainsaws, and went outside to discover the parents of the bride & groom were cutting down my magnolia trees (each tree is about 80 years old - this house was purchased as a wedding present for my great grandmother, and they planted magnolias there when they got married. If my great grandmother had lived she'd be turning 100 next year) because they didn't match the bride's "aesthetic vision".

I told them to stop immediately, I didn't give them permission for that, and I was going to call the police. They stopped, but when I went inside to grab my cell they started up again.

When I confronted them, I was basically told that since they're my tenants, I'd just be suing myself, so I could "suck it up, buttercup". I admit, I was more than a little intimidated by a group of men with chainsaws. I went back in my house while they continued cutting and called the police, who came out and told them to stop, and gave them tickets, but they started up again once the police were gone. I called the police again, and they haven't come back out yet. I've also already called an arborist friend of mine (I'm a florist), to come out and do an assessment immediately. I called my insurance company as well, and they're going to have someone call me back. But while I'm waiting, I thought I would ask here: Can I sue them? Or am I, as their landlord, liable for their actions against me? Needless to say, no one is getting their lease renewed, even though they've lived here for decades.

Sorry if this is rambly, The trees hold a lot of sentimental value to my family and I, so this is very emotionally draining.

[Update] Father trying to take child after little to no contact in past 2+ years.

    Posted: 06 Jul 2018 07:28 AM PDT

    Hey guys,

I want to thank everyone for their input, especially /u/Rob_Swanson. We hired a lawyer, and drafted up a new custody order, and filed a case to terminate Biodad's parental rights (so far we have had 4 phone calls from him in the past 2 years). The child in question has told both the police, and lawyer he does not want contact with his Biodad, and would like to be adopted by me :). We are set to see a judge in the near future to begin this long and arduous process, and I just wanted to thank this sub for all of the great advice that was shared with me.

Fire cause by neighborhood kids. ADVICE

    Posted: 06 Jul 2018 07:49 AM PDT

Story: Around 10:30 last night I was continuously hearing a car horn. Come to find out it was my car horn. I had peered out the window and look at my drive way only to notice my car was in flames. By the time I woke my wife and got us the front door the police and fire department were knocking telling us we had to get out the house your car is on fire. They stated that if it was 2 min longer without being touched it would caught then house next. So now 1 car is most likely totaled. The car next to it is melted and now has damage. So much to figure out. Sigh..... The fire department and police both come to the unconfirm conclusion that the cause of the fire was from the kids that had been playing with fireworks. The reason I say unconfirmed is becuase they said we dont know for sure you need to wait to your insurance person comes out in the morning They were fined and given some charge I guess. . So of course I have questions have to appear in court also. My question is now I have to pay my deductible for something I didn't even cause or do the kids parents? If the parents of the kids do have to then what do they use home insurance or car inurance ot whatever. Do I need to call my home car insurance since this happen on my property? Do I need to get my lawyer? Also it agaisnt the law for the time they were shooting the fire works in Ga if that helps. So many questions.

Ex wife messaging people to unfollow my business page on Facebook, and if they don't she says I'm a drug addict and run a shady business.

    Posted: 06 Jul 2018 05:47 AM PDT

I have a screenshot of my ex wife asking a mutual friend to unfollow my business page on Facebook. The mutual friend said no and that they were actually going to buy the product when I release it. The ex wife then goes on to say that I'm a drug addict, animal abuser, and am running a shady business.

Is there anything I can do about this? If not, is there anything I can do to get her to stop?

[Update] An r/legaladvice wet dream: neighbor cut down two of my trees. What should I look for in a lawyer?

    Posted: 05 Jul 2018 04:15 PM PDT

Original here. I forgot the password for the throwaway, sorry if this ruins continuity.

A lot has happened in the past 15 days. I wanted to provide a brief update, but it will be out of order. Thank you for all of the great advice. Sorry I was unable to comment in the original thread, but I am grateful for everything.

The first thing I did was delete venmo, scan and backup the letters left in my mail box (the ones offering to pay for the trees being cut down, and the one offering 2k), and called for someone from my local town to come and evaluate that the tree stumps were indeed on my land.

But before the land evaluation, I wanted to write a quick gospel in praise of my lawyer. I drove down to the big city of Nashville, and met with some real mean SOB. I gave him a quick rundown of what happened, and he literally quoted the helpful comment made by u/duderos about harming landowners trees. He told me that we should wait to file criminal charges until the stumps were without question on my land.

So I had a town surveyor visit, and this is where the story gets good. While he was out making his observations, my neighbor!!! came out and wanted to know when I would be taking the payments. I curtly said I wasn't yet ready to accept it, and he got mad, accusing me of being a shitty neighbor and not wanting to help his home. He then insisted that he had the right to cut down the trees, to which the surveyor confirmed my suspicions and told us no, the stumps were actually on my land. He could have trimmed branches if they were too long, but not cut the lumber down. He left in a huff.

So now I am waiting for Wednesday, when the certified Arborist will visit and tell me the tree value. Thanks again for your help.

Received a letter from US Customs and Border Protection

    Posted: 06 Jul 2018 05:44 AM PDT

    [TX, US]

I am worried about a letter I received after ordering from an online pharmacy. Instead of getting my package I got a letter from US Customs and Border Protection telling me my package was "interdicted". What next? The letter indicated that was the end of the issue but is this really the case? Will my name likely go on some kind of database for future use and make it more likely my post will be inspected?

16 Year Old Girl Repeatedly Violated by Mom's Boyfriend and Trapped in Home

    Posted: 06 Jul 2018 08:11 AM PDT

My girlfriend is 16 years old. She lives near me in Pennsylvania. She's been deeply suicidal since late March. She started complaining about a voice in her head telling her to stab herself. Since then she has started to have massive panic attacks that left her scared and hyperventilating. Her mom is anti-medicine and anti-vaccine but when I told our school counselors about her attacks, they made her go to a counselor. Nothing has happened from that, however, and it keeps getting worse. She's started to panic and now her eyes roll up into her head, she stops breathing for thirty seconds, and she reports visions (most of her killing me or her becoming abusive towards her future kids) to me after the episode. Her mom still refuses to get her help other than the mandated counselor who doesn't even know the full story because she refuses to talk to him. So her head is bad, and she dizzy and she's fallen so much, and she's suicidal at least five times every day. She often tries to choke herself, even when I'm holding her, and she's been cutting. She told me she's tied things around her neck and tried but "chickened out" at the last second. I'm worried about the suicide but right now I'm even more worried about the abuse.

She says she's been getting hit and pushed into walls and choked. She lives with her younger brother, her mom, and her mom's boyfriend (they're not married but they have a one year old son, who they seriously neglect judging from my girlfriend's texts). Last night she texted me about the boyfriend. I always got a distinctly creepy vibe from him, and he once called her sexy in front of me (he's in his 40s and she's 16). Last night we were texting secretly and my girlfriend was hiding under the covers with her phone, and at 2:40 AM, he entered the room, stood over her, squeezed her ass firmly, stood some more, and left. She was terrified and told me it's happened before but it's usually her breasts. She's a heavy sleeper but she'd wake up with one breast sore and know it happened. She said further she thinks it's just about every night. Last night at 4:30 AM, he entered the room, removed the covers carefully, and stuck his hand down the front of her pants and inserted his fingers into her carefully. She said he applied a lot of pressure and it hurt her a lot. He stayed like that for three minutes and left. I immediately reported it to our school, which told the agencies they are required to tell. She went through another night and he inserted his entire hand then masturbated in her room. The authorities then got involved, but as far as I know, they haven't done anything, as her mom silver-tonged her way through the questions. Her mom doesn't believe my girlfriend at all, and cleaned the entire room before the cops inspected it. She's facing two more years of the same. She's terrified he's going to rape her entirely and repeatedly. What scares me more is she won't fight. She is completely and utterly under the control of her parents. She said she deserves it, she won't scream, she won't even move, she'll just stay still. If he tried I do believe she would let him rape her. And though she does hear voices and see things, I sincerely don't think this is delusional.

The police and child protective services were told, but nothing happened. She is in the same situation, and now her parents took away all of her electronics so she has no way to tell anyone anything if and when it happens again.

My question is this: what other options are legally available to me? If I help her run away, get an apartment, and get a job, will she be able to legally remain apart from her parents? They would definitely file a missing persons report as soon as they could. Is there another option or agency I'm missing, or a way out for her? She won't survive this for long, and I'm scared.

    Thank you all in advance.

My Employer does not believe there is a difference between bi-Weekly and bi-Monthly Payroll, what can I do? Help!

    Posted: 06 Jul 2018 07:36 AM PDT

Hey Reddit, Need some help and advice here...

So In January, I started my first salaried job at 26,000 Per year (have it in writing). Previous I worked jobs that were hourly so this was a pretty big step for me. So i'm excited because it's good job, good opportunity, and im working for a Small franchised business owner who is just getting started in owning her own agency. (Insurance sales, for a company that does insurance in every state. like All of the States)

So things were OK at first and this being my first salaried job, I didn't really pay attention to the hours or the pay, except to know that money was coming in and it was enough for me to live and put away some for a rainy day. We got paid on the 1st and 15th. Good times.

This past week, My employer shorted me on a very successful month in sales commission and delayed our payment until the 5th (Due the 1st) so I was frustrated. I called my Boyfriend and started to vent to him and I told him that Im mad even with taxes, I was looking forward to the first paycheck I had that would have a take home pay of over $1000 but because she screwed up the commissions, My take home was about $950(ish). He asked me to clarify what I meant of over $1000 and I explained that my gross pay per cycle was $1000 and With taxes I usually get about $850.

He stopped me at that point and asked why I was only getting $24000 a year. It took a bit of explaining but I finally realized what he was talking about. (First salaried job, sorry!)

She was paying me a Bi weekly rate on a bi monthly schedule. It turned my 26K into 24K.

I go into work and I shoot off an Email to her and explained that I should be getting paid 26K and her response was

    "Your base pay is 26K. 52 weeks in a year. 26,000 divided by 52 is $500 x 2 is $1000"

I sent over this huge spreadsheet with the differences between Bi month and Bi Weekly pay cycles, Showing her what she should be paying and what she's already paid. (She's been doing this since I started) I broke everything down and explained it like I would to a 5 year old. I Also included in my email a reminder of reimbursements that she owes me for tests and Exams, as well as the remainder of the commission that i'm owed. In all, it's a pretty nice sum

Her response was "we will discuss this when I return" (she's not back until next week)

I also found out that one of my other colleagues was being shorted as well.

Now, My questions is.. What are my options? I know for a fact that after all of this, I do not want to work here. However I want to make sure I get paid and am employed before I leave. What are her legal grounds for doing this? Is this something I need a Lawyer for or is it so open and closed that I shouldn't have to worry? is this something I can be fired over? Do I have a right to demand payment immediately?

    Thanks for reading!

I have everything in writing and have printed copies for myself of everything.

TLDR: Employer is paying me bi weekly wages on a bi monthly schedule.

I work at a doggy daycare/boarding kennel (MN), I'm seeing abuse and negligence, what are my options?

    Posted: 06 Jul 2018 10:15 AM PDT

-My goal is not to get people fired, I just hope to see some kind of change for the sake of the dogs we are being trusted to care for.

We have 24/7 webcams in the playroom, everyone who works here knows where they are and where the blind spots are. There are a lot of things going on at this place that need to improve, but I'm focusing on the things that I believe I could realistically do something about. Some examples (I can share a lot more if it would help, I have tons of notes on my phone and on a Google doc, seeing more every shift): *dogs being carried by their collars with their feet not touching the ground *constant violations of our shock collar policy (dogs wearing them when their owners choose not to give us permission) *violations of timeout policy (owners sign an agreement saying we can put their dog in a timeout for no longer than 20 minutes, dogs are left in timeout for hours, even full days) *dogs being kicked in the face, slammed to the ground, slapped in the face, usually because they bark a lot and my coworkers have no patience I know that opinions differ on how to discipline dogs, and I've learned that its pretty widely accepted that hitting a dog to discourage a behavior is ok (imo, there are about a million other, more effective ways to communicate with a dog), so I'm trying to keep all the information I've recorded unbiased. I think that bringing my own views into it if/when I talk to my bosses about it will result in me not being taken seriously, so all I record is the date, time, location, and what happened ("6:35 am, 7/5/18, boarding room. A coworker picked up a dog by holding it off the ground by its collar, carried the dog from the near the window in the boarding room and through the door to the playroom.")

My coworkers told me when I started last spring that after working here a while I would get used to this shit and "harden my heart". My heart still mushy and sad and I'm having trouble sleeping at night, please give me some advice. How should I approach my boss with this? Should I leave names out of it? Can they fire me for speaking up about it? If the bosses aren't willing to change anything, what else can I do without getting in legal trouble?

Dealership sold trade in before deal was done

    Posted: 05 Jul 2018 07:57 PM PDT

    Arkansas

Have a kind of weird situation.

TL/DR: Dealership sold trade-in before deal was done:

So the boyfriend went to buy a car on Saturday. He traded in his vehicle as down payment (they gave him $2750) He signed a contract that had the interest rate and total cost, and let him take it home. Well they called Monday and said that they couldn't actually get financing for what he signed the contract for and they said they wanted him to come up and agree to a much higher interest rate. He wasn't really in love with the truck so he said no.

They said they would keep "working the numbers and financing" and call him back. Today has been 5 days he has had the truck, so he decides to kill the deal and get his truck back and be done with it.

Dealer calls after I text them to have the GMC (his trade in)ready because we are coming to pick it up and drop the Chevy off. Boyfriend gets to dealer and has to talk to finance guy. Finance guy is great, we really like working with him. Finance guy asks him what he can afford, why he doesn't want to do the deal as it is, just a bunch of stuff trying to get him to agree on something. Boyfriend says nothing can be done, I just want my truck back and I will try again some other time.

Finance guy says, yea well about that....we sent the truck to auction and now some guy in town a few towns over, let us try and make this right. Lets keep looking.

Can they really do this?? Send his car to auction even though the first contract he signed fell through and he hasn't signed another one? Now they want him to find another truck from the lot.

If you have gotten this far, thanks! Any advice?

NYC Renter - Can the City use my patio to store large construction equipment without permission or warning?

    Posted: 06 Jul 2018 07:45 AM PDT

NYC renter, living in a co-op building but renting from a private owner.

I came home one day to find what looks to be a large window washing elevator in my patio and my patio furniture moved to an area of the garden I dont have access to.

I have asked my Super who has been incredibly unhelpful and all he shared was that the City is in charge of this contruction work.

I am pissed that my patio is unusable for the summer, considering we a paying a boatload in rent to have an apartment in manhattan that has private outdoor space.

Am I entitled to compensation? Is the city just allowed to take over private property? Is it my building/Super's fault for not sharing the information they have with me the renter?

    Thanks

Father Passed - 401k - His employer wants me to sign a blank sheet of paper...

    Posted: 05 Jul 2018 08:27 PM PDT

My father passed away and his employer is withholding all information regarding his 401k. They will not give my any bank information or contact information for a representative to speak with. I am the main person over seeing the will and estate. They are also saying that the 401k and how it was negotiated was between my father and them and I do not need to be any part of it or know anything about it.

What they have done is asked for an account number to deposit funds into and asked me to sign a blank piece of paper to give to the third party that is handling the account. They will not give information about this third party either.

The amount they are saying is in there is about 5k but will not provide any statements or documents what so ever. I have no clue were to start or who to contact other than attorney and came to reddit for help. Thank you in advance for any advice.

To please the bot I am located in the USA.

[California] Ex-boyfriend of girl I hooked up with is trying to blackmail me for making “nonconsensual advances”.

    Posted: 06 Jul 2018 11:02 AM PDT

A week ago I hooked up with a girl for about five seconds and thought it was over. Then yesterday her insane ex messages me threatening to break my arms and "reveal" me as a rapist if I don't cooperate with him. There must be something illegal about that. Supposedly the girl had told him and all her friends that I pulled her into a bush and forced her to kiss me. This is not what happened at all, in fact I have a friend who was ten feet away and could vouch that no pulling was done. Then she says she was scared and ran from me, however in reality she actually offered to call me an uber with her in it and I have a witness for that too. Then, we actually Snapchatted for 2 or 3 days after and then this mess happens. It seems like she just is regretting hooking up with me which is fine, but threatening legal action is insane. Right now it would be her word against mine plus my two witnesses so I'm not worried about that in court. But if he were to label me as a rapist online that would have to be libel, correct? Also she must have a weaker case because I have witnesses and proof she wasn't scared because of her later actions. Thanks. I think the biggest thing I am trying to avoid is him lying online which would damage my reputation. But as some have already said, there isn't much I can do about that.

Fired for not telling my boss about my sister’s medical condition Illinois

    Posted: 05 Jul 2018 06:18 PM PDT

I work as a bartender for a restaurant in Illinois and my younger sister works in the same restaurant as a host. Last week my sister had a break from reality, and my parents helped her take medical leave to get her meds straightened out and make sure she wasn't a danger to herself. My boss kept asking what was wrong with her and when she would be coming back, and if I knew what was happening and I told him it was private and I didn't want to speak for her or anything, that she'd let him know when she was ready to go back. He told me that he knows I know what's going on since she's my sister, and since I refused to tell him he's writing me up for insubordination. This was my third write up because I'd come in late twice in the last two years or so, so I got fired yesterday.

Is it legal to fire me for refusing to tell my boss my sister's medical condition?

Roommate leaving their stuff in house (MN)

    Posted: 06 Jul 2018 05:36 AM PDT

So I live in a house with multiple roommates. One of our roommates moved out months ago, but really she just broke up with our other roommate and moved in with the guy she had been cheating on him with. She left all her stuff, and would stop by a few times a month or so, but for all intents and purposes she was gone. We told her multiple times that if she just got her stuff out, we'd find a sub leaser (luckily we had a spare room). She declined, left all her stuff, and continued to pay rent. Whatever, works for me.

Now our lease is up in a week and a half, and she has only moved half her stuff (she has a lot of stuff). There's multiple boxes, a bed, mini fridge, some kitchenware, and a few other odds and ends still here. She didn't pay July rent and has been ignoring our text messages since. We need everything out a few days prior to the lease ending so we can get the carpets cleaned. If she doesn't come back for her stuff, or contact us about it, what can we do? Can we post a "free stuff" on Craigslist just to get it out? Or another roommate said we could bring it to the dump, but that seems wasteful. We don't want to have to deal with moving all of her stuff, but we also obviously need it gone.

EDIT: She lives a few hours away, and we don't have any contact info for any of her friends/family. So we can't bring it to her or ask someone else to come get it.

CT/MA - girlfriend's bank doesn't know where her money went

    Posted: 06 Jul 2018 08:46 AM PDT

My girlfriend recently moved and went to close out her accounts at a local branch of her bank in CT (now living in MA). When they were closing her savings account, apparently the computers "went down" and after waiting over an hour at the bank she had to give up and leave due to time constraints. The bank employee said they would continue working on closing her account and contact her to work out cutting the final check.

2 weeks later now, she's heard almost nothing from the bank. She tried contacting them after a week and they said they were still working on it. This week she contacted them again, and was told that the employee who closed her account is no longer an employee with the bank and that they are launching an investigation into where her money went. They told her to call back again next week.

At that point it will be going on 3 weeks since closing her account that she has not had any access to her money. Is her only course of action to sit and wait for the bank to sort it out?

Assaulted in my own residence. I was charged with disorderly..

    Posted: 06 Jul 2018 09:58 AM PDT

Location : Ohio I got assaulted by one of my ex's guy friends at my residence yesterday afternoon. He grabbed me by my shirt and threw me to the ground outside (I was inside the back door, no stairs out back" he threatened me and basically told me if I walk through my door he is going to slit my throat. The reason the cops showed up is because he threw me into the neighbor's yard and she called them. As soon as the cops showed up I told them I wanted to press charges on him and I was assaulted by him. They said they will talk with everyone get statements and everything. Another sheriff came up and she was talking to everyone separately. Before they left after 2 hours, they gave him and I a disorderly conduct and I NEVER laid a hand on him. I was inside my own home, didn't even defend myself. We have court on the 16th and made sure to include every detail in my statement.

Any advice would be amazing. Should I get an attorney and plead not guilty? I think it's bullshit that I get charged $175 fine for being assaulted. "Protect and serve" doesn't mean what I thought it meant.

    Accommodations for jury duty

    Posted: 06 Jul 2018 07:44 AM PDT

I was recently summoned for jury duty in Indiana. I am a stay at home mom (4 kids), no alternative day care available and currently am breastfeeding my 13 month old 6x a day. Although I requested a deferral, I was denied. I want to bring my breast pump along but was wondering if I should call the county clerks office and ask if this is permissible before I do so. If I should call, can I ask if I would be allowed to leave the court room to pump? Also, I am a Type 1 diabetic and have a continuous glucose monitoring system. I can silence many of the alarms on the device, but cannot turn off a loud 3 alarm beep if my blood glucose drops below 55. Would I be permitted to carry this into the court room as well? On the paperwork I received in the mail there was information about contacting court staff if services were needed through the ADA. Would my CGM fall under the ADA? Thanks so much for your help.

My manager threatened to call my probation officer if I went to her superior for the way she was treating me. Would this be considered retaliation?

[NM]I am currently receiving monthly SSI payments. I am going to be receiving $20k, and am looking for options in regards to what to do with the money in relation to my SSI payments/health insurance.

    Posted: 06 Jul 2018 08:34 AM PDT

    Location: New Mexico

TL;DR: I am going to be receiving an amount of money that will disqualify me for my only source of income (supplemental security income). I would lose my health insurance, as well. I am hoping to follow the best possible path to minimize my time without health insurance and a steady source of income (which, because of my disability, would only be available through SSI for the foreseeable future). What options are available for a person who is currently receiving SSI and will be receiving a sum of money that will disqualify them for benefits?

I am currently receiving $500 per month in supplemental security income.

I received ownership of a portion of land this year. The land was sold, and the profit from the sale was split between me, my paternal uncle, and my step-grandfather. I will be receiving $20k for the sale of the land.

The problem I am facing is this: in order to receive SSI and health insurance, I cannot have over $2k in "resources". Resources include cash, personal property, life insurance, and pretty much anything that I could easily turn into cash. Once I receive the $20k, I would lose both my only source of income and my health insurance.

My current plan is to deposit $15k (the annual deposit limit) into an ABLE account (an investment account that does not count against you in regards to SSI eligibility), then deposit the remaining $5k into my checking account. I was going to spend the $5k down (house repairs, mostly) until I am under the $2k limit and eligible for disability payments and health insurance again.

I made a post on /r/personalfinance asking for advice on how to invest the money with an ABLE account, as I personally feel that this is the best option. However, a user there mentioned asking here to see if there might be any additional options in regards to placement of the money and its impact on my disability payments and insurance eligibility.

The only options that I can think of are:

    • Opening an ABLE account. This is currently the option that I am leaning toward.

    • Spending the money all at once on a large purchase, like a car. A few people have suggested "spending it all on a brand new car." I would prefer not to do this, for two reasons. I already have a car that still has a lot of life left in it, and I would have to give it up in order to purchase a new one, because I am only allowed to own 1 vehicle under the SSI guidelines. I would also prefer to be able to save/invest some of the money instead of spending it all at once on a single purchase.

    • Depositing the entire $20k into my bank account and spending it down until I am eligible for SSI again. This option feels like the one I would least like to pursue. I feel like I would be more focused on spending the money down to the $2k limit in order to be eligible for health insurance/steady source of income, rather than spending it wisely.

Are there any other options for someone in the situation that I am in?

Please let me know if there is any information I could provide that would be helpful, as I would be happy to do so.

Thank you very much for any help you can provide. It is greatly appreciated.

(UPDATE) (KY) Issues with Sellers and Land Contract

    Posted: 06 Jul 2018 11:53 AM PDT

This is an update to this post I made quite a while ago. https://www.reddit.com/r/legaladvice/comments/65p06l/ky_two_years_into_land_contract_and_sellers_are/

The gist of it was that my husband and I had attempted to purchase a home on a land contract. Two years into the agreement the sellers got cold feet and tried to use a plethora of imaginary problems to have us removed from the property. Also, in the OP people were assuming that lack of credit is what was keeping us from financing, which kinda hurt my feelings, but oh well, lol. The reality of it is that my husband is self employed and so was I. His business was only two years old (work history included 12 years at the same job before hand though) and my business was just getting off the ground. This was concern enough for the bank to refuse us a mortgage. So anyways, on the with the bad (and I do mean bad) news. This will be long.

The original complaint we received had about 20 bullet points of complaints/issues. I did hire a real estate attorney to respond. When I spoke with him, he named his price, I paid him in cash and got a receipt. He assured me that what I was paying him was enough to cover everything, even if we did end up having to go to court. I was happy to have some help. Fast forward 2-3 months after we have sent our response, the sellers reply back with another answer that requires an answer from us. Well, wouldn't you know, the attorney I hired now wants another $7k to respond to these people. Are you kidding me? I say no, I can't afford that. I end up having to go to court alone so that our current attorney can remove himself from our case. He's using the grounds of nonpayment. I explain to the judge, with my receipt in tow, that yes, I did pay him but now he wants double what I've already paid in order to continue representing us. We all agree it's best if we part ways. So I find a new attorney to represent us and we basically start all over. Yay. Now, here's the fun part. My husband and I know we own less than $20k on our house. We want to quit this back and forth BS and just pay off our contract and be rid of these people. The things they were doing while we were in the midst of these court dates was insane. Examples include : putting baby gates up in our driveway so we couldn't back out without either running over them or getting out to move them, staying outside until daylight cackling and screaming with video cameras (we both have to get up at 4 and 5 am respectively), putting up no trespassing signs on our side of the property and calling cops when we come home from work (that was a fun one), the list is endless. They were crazy, but I LOVED my house. So, I just put up with it. I recorded their craziness with my phone when I could, and I took photos of all their attempted booby traps. Fast forward to our next court date. Our attorney mentions that we would like to pay our contract off and move on. Judge agrees and asks sellers attorney what they think. They don't agree and proceed to go a little off the rails in the court room. Judge explain they have two options. They can either accept our pay off or the property can be treated like a foreclosure and auctioned off to the highest bidder on the courthouse steps. The only way option 2 would be viable is if we were returned our down payment and everything we had paid in the last two years because we were not in violation of the contract in any way. The sellers didn't like that either cause it would've been a fairly expensive burden. They agree to take our payoff and call it a day. Judge gives us 30 days to pay it off and sets a "show cause" date for next month. Ok LA, here's where I screwed up...BIG TIME. So, I'm feeling good, we finally got a win in court, I'm hoping I can pay off my house and build an infinite sized privacy fence so I don't have to see these people anymore and be done with it. But, I'm also feeling kinda petty after being jerked around by these people for a year. So, I (stupidly) decide that I'm not going to give them a cent until the 29th day. I am so stupid. On the day before the money is due, my husband and I go out to see a movie and have dinner to celebrate our anniversary. We're in the middle of watching "IT" when I get a series of texts from my best friend letting me know my house is on fire and is a total loss. I lost my 13 year old cat, my son lost his 10 year old lizard and two fish tanks and a his degu. Thankfully my dog was able to escape. The house was an entire loss. We had nothing but the clothes on our backs. That was 9 months ago. We had really good insurance coverage but we haven't received a dime of it yet. Know why? Because the sellers are suing is for our entire insurance payment, nevermind the fact it was about 5 times what we owed. So, there we are. Homeless and in the middle of another legal battle with these crazy people.

Are phone conversation recordings legal in divorce court? Wisconsin

    Posted: 06 Jul 2018 07:50 AM PDT

Hi there. A friend of mine is in the middle of a divorce and custody battle in Wisconsin. Multiple Children. He has limited means so is relying on a public attorney.

He has been audio recording his conversations with his ex because she will lie about their interactions and attempt to manipulate him for his perscription drugs i.e. you can't see your kids unless you give me Adderall. He also has saved his text messages with her.

The lawyer has only said "keep all of it" in response to what he should do with it.

Will the recordings be admissable in court? Thoughs, concerns, resources?
