NY - All elevators broken in 19-story apartment building Posted: 01 Jul 2018 05:46 AM PDT My husband and I live in a 19-story rental building in Manhattan, NYC that is very new - we're the first tenants to live in our unit, which is on one of the upper floors. It is a relatively small building with ~7 units per floor, with two elevators serving everyone. One of these elevators has been broken for the past two weeks. The management keeps claiming that a necessary part for the repair is coming "in a week." While it's slightly annoying to wait longer for the elevator, it's been fine. However, the other elevator is now malfunctioning. Last night, management shut down this elevator too. People coming home had to walk up to 19 floors to their units. It's running again today, but the maintenance team expects that it'll be down again, and they're not sure for how long. This wouldn't be the end of the world except that (1) I am pregnant and (2) we have an old dog who can't make it up all of those flights of stairs. If both elevators are shut down for any amount of time, we are going to take our dog to doggie daycare, and we might look into an Airbnb, neither of which are cheap in NYC. If this happens, do we have any legal recourse to ask for a rent reduction or other financial compensation? I know NYC requires that all newish buildings over 5-6 stories have a working elevator, but I'm not sure how it works if the elevator breaks and the management claims (accurately or not) that they're doing everything in their power to fix it. Thanks! [link] [comments] |
Bank sold our mortgage loan & the new bank can't find us in their system- CA Posted: 01 Jul 2018 12:33 AM PDT We just bought our first home in April. Our first mortgage payment was due 60 days after closing - June 1st. Before the first payment was even due we received a letter from our bank saying the mortgage loan was sold to "Bank B". We sent our payment to "Bank B" 2 weeks later we get a letter from "Bank B", along with our check, saying they can't find us in their system. We got a hold of them & they said that if they recently bought the loan it could take up to 3 months for us to appear in their system. They added to keep sending the checks in anyway as they back date them. So we already sent the check for July. Today we received a notice from a THIRD bank, "Bank C", saying we're overdue by two months. I thought it was some sort of scam at first but they have the correct loan number, balance, and payment amounts. We never have gotten any other letters from Bank C prior to today. The letter from "Bank C" stated we had until 6-15 to pay the 2 months, & afterwards we'd have to pay a $200 late fee. But we just received this mysterious statement today. I'd like to add that we didn't receive any notice about our loan being sold again. I'm calling all 3 of these banks Monday to sort this out. My question is, is this some sort of scam? Have any of you heard of this? Any advice? I tried Googling this but didn't see many results. All 3 banks are legit too. Sorry if this post was long I was just trying to be detailed. Posted: 01 Jul 2018 12:59 AM PDT So I recently applied for a cashiering position at a convenience store in Los Angeles. I put my soonest available day to work as July 2nd, the day after minimum wage in Los Angeles goes from $12 to $13.25 per hour. I don't know if this matters, but it's a japan-based company with thousands of locations so they definitely have more than 25 employees. Well, near the end of the interview they basically said to me, "I know people are saying minimum wage is going up in a few days but we haven't gotten any emails from HR about it. So if we hire you, minimum wage will be $12 an hour." Is this allowed? If they do decide to hire me, it would be after July 1st. When she said that I just kind of nodded and said "okay" and didn't question that further because I was kind of nervous, but I didn't sign any paperwork or anything considering I'm not officially hired yet. On the job application, I did list my desired wage as $13.25 per hour. So, am I missing something? Am I right to assume this is illegal? And what can I do(besides the obvious- decline the job)? Posted: 01 Jul 2018 08:09 AM PDT My husband and I just got our itemized payment notice from our landlord on friday. They are claiming almost 500 in cleaning and then an additional 600 for repainting due to smoke damages to the walls and ceiling. The problem is is that our deposit was only 700. They are asking us to pay 300 and some change to cover the rest. I cleaned and have picture proof of everything being cleaned and the biggest issue I have is the smoke damage claim. Neither my husband or myself smoke, we wiped all the walls down per our moving out checklist, and also have pictures of the walls and ceilings (ironically) showing that all the lights and outlets were working when we left. I really really do not want to take this to court, but this is a bogus claim. Should I lawyer up and run the risk of having to pay court fees over this, try to come to an agreement where we break even and don't owe, or should we fight this in the system? Also, if there's picture proof of everything being cleaned to the standards of when we moved in (or better in some areas) can those fees be dropped too? I have pictures of both before and after we moved out. [link] [comments] |
Posted: 01 Jul 2018 10:24 AM PDT Location: NYC Last weekend, I brought my twin 3 year olds to a local playground that has sprinklers for the kids to run in. I have 1 boy and 1 girl. Neither likes to keep their clothes on, so I dressed them both in board shorts and t shirts so they would inevitably strip down to just their pants instead of being completely naked (as they would if I put them in 1 pieces.) I was trying to corral them at the playground but they kept taking their shirts off and eventually I gave up on trying to keep them clothed. One of the other moms saw my daughter topless and freaked out. She screamed at me about child abuse and pedophiles and threatened to call CPS on me. I grabbed my kids and left. This woman works in the same building as me (different companies) so we see each other a lot. Every time this week, she has threatened to call CPS on me for letting my "dirty children run around half naked." (Note: my children weren't dirtier than is normal for kids running around outside and they are always well groomed, so I think she might be referring to the fact that they are mixed race -- she has called my children/husband the n-word before.) My question is: Does she have a leg to stand on if she reports to CPS? Will I get in trouble for letting my 3 year old girl go shirtless/is it illegal that I did that? Also, what can I do to get her to leave my children and me alone? Thank you in advance. [link] [comments] |
Tow company trying to hold me responsible for stolen van Posted: 01 Jul 2018 07:34 AM PDT I bought a cheap fixer-upper van in California for $900 last year. I was in the process of getting it registered, but it needed some work to get smogged. The van was stolen in December before I could get the work done. I called the cops to report it stolen, and they came out and took my story. They said they could not file a stolen vehicle report as it was not "fully" registered in my name. Nonetheless they filed a "lost" vehicle report. I moved to Virginia in early March. In late April, I got a letter from a tow company hundreds of miles from where the van was stolen, saying they had the van and had mailed the last registered owner and me as a "person of interest". At this point, the charges on the van were well over what I paid for it, so I was not about to fly out to California and try to reclaim the van. In June, I received a debt collection letter trying to collect $2700 for the cost of their "work" with the van. I contested the debt in writing, on the grounds that 1. The van was never registered in my name, and 2. I reported the van stolen in December to Oceanside P.D. I just got a response from them. They did not respond in writing, they just sent a picture of DMV records showing that I initiated a registration on the van. Legally, what am I looking at here? The van was stolen months before they towed it, and I wasn't informed the van was in their custody until the charges on it were somewhere around $1500. There's no chance they will see any money from me. [link] [comments] |
Wife's work issue, assault or not? Posted: 01 Jul 2018 06:13 AM PDT Throwaway account… Location USA My wife works with a coworker that told the office he has tourettes. He has said and done things in the past that have given my wife concerns but she redirected his behavior. Yesterday he walks up behind her and hit her in the back of the neck several times. When she asked what he was doing he said he was "stabbing her in the back". He then did it several more times saying "doesn't that feel good" … She said this was hard enough to hurt but not leave a mark or bruises… Later he made a comment about his lunch saying "you had better not have touched my lunch or it will be the last thing you ever eat". He is asking personal and probing question about her personal life and asking for family photos. My wife keeps redirecting his behavior and defusing the situation however I am feeling his behavior is escalating. I pushed my wife to tell her boss about the issue and goto HR in Monday. She did not want to escalate the issue fearing it may just make her more of a target of his. Her boss said he would be moved to a different floor for tomorrows shift and to write down an account of what happened. When she came into her shift he was not moved to the other floor. I feel like the company keeps passing off his behavior as a part of his disability (yes he has ADA accommodations for the tourettes). I think this was assault and if she wanted to push the issue she could file a police report. She of course is afraid for her job, afraid for her safety and doesn't want to make herself more of a target. How should she handle this with HR? Update1: They made things worse, instead of moving him to another floor, one manager came up to the floor and told him he could not work with my wife anymore and he should stay away from my wife, then left. My wife contacted another higher up manager, and demanded she come up to the floor. She moved the employee to another floor, but she is already starting to blame my wife for what transpired. She demanded they take this to HR, which will happen tomorrow. [link] [comments] |
WhatsApp sent me C&D for an app that doesn't even interact with WhatsApp [Crosspost from r/android] Posted: 01 Jul 2018 09:27 AM PDT [India] Hey, I want to highlight this issue to you as soon as possible as it seems WhatsApp have been going too far in banning apps that doesn't even interact with their own app in anyway. I have an app on Google Play called DirectChat with close to 500K downloads which was even featured on XDA, AndroidAuthority and many others. Basically, this app uses Google's Notification Listener API to listen for incoming notifications and displays it to users in form of Facebook like ChatHeads and also lets you reply to those notifications within ChatHeads. This makes it easy for users to read & reply to different messengers on the fly without ever opening another app. It doesn't interact with any third party messengers or take their datas that may involve illegal methods, it simply fetches notification and displays it in bubbles form. There are hundreds of similar apps available on Google Play that performs the exact same function including Google's own Android Auto and widely recognized PushBullet app. Now I don't see anything wrong in how these apps works and function since they are using Google's own public Notification API to fetch and display texts but WhatsApp lawyers just sent me Cease & Desist letter that I am violating their Terms & Services and should immediately terminate its service. I can understand them shutting down WhatsApp+ and other such modded apps that directly interfere with their service but how can a simple notification manager application is against their T&S. I don't know why I am getting targeted when these kind of apps have been available for a long time along with Google's own Android Auto app. Now my question is, how I am obligated to or violating their ToS if I am not interacting with their app or using their service. My application only uses OS interface and Google's public API to read notifications which is what WhatsApp uses it too to send their notifications. Do I have a case against WhatsApp for sending me Cease & Desist for something my app never uses to function? [link] [comments] |
Posted: 01 Jul 2018 07:29 AM PDT Here is the story in a Nutshell. I have a past with alcohol and I was divorced 10 years ago. The initial agreement was for visitation under supervision with my daughter which I have just recently filed to change and this included reducing weekly payments from $180 to $100. My ex has a lawyer and they are not fighting the weekly support change but they are basically trying to deny me any changes to visitation. Here is a quick background: I have an 11 year old daughter with my ex wife which this court case and post is over, I have a 7 year old son with my ex girlfriend and that relationship is very good and steady with no problems at all. I did have problems in the past, a few arrests which ended in dismissals which I spent time in jail for due to not being able to afford bail. I have all proof of said dismissals. All of the info they provide is simply hearsay with no proof of anything, I have documents proving my last rehab in 2012 with a graduation certificate and I have not had a drink of alcohol since August 16th, 2012. I have a son with my ex-girlfriend whom I have visitation with due to my agreement with my daughter but that changed in January 2017 and I am able to drive him and have him for the day when I visit when his mother and I agree, we have a great relationship (his mother and I) and I want to keep things amicable so we do not go to court all of the time we just agree to progress as we are and it is working very positively. I also agreed to random drug tests from the county and also agreed to to take one if she ever requests it or thinks there is a problem which she has not had to do since the agreement. In the paperwork objecting to my request for my changes my ex-wife is accusing me of having serious mental problems which I do not, she states that I continuously threatened to commit suicide when we were getting divorce which I did not. She states that I have come to her house recently under the influence of what she suspects are opiates of which I have never abused in my life and I have proof of 3 recent drug test negative results for jobs which I have been working (I have been doing IT contracting recently). I will be providing those drug tests and stating that I have not had any problems with any substance for years which is the truth. The information submitted about my legal past was provided by I suspect a local police officer in her town as she grew up and is related to a few. The information is not publicly available and was provided with a Program called "PolicePro" and I know this because they cut off only half of the stamp of the program name at the bottom and I matched up the Font and held them up together and it is an exact match. The GUI also matches up with the program as it is on the website from what I can see. I have dismissals from courts for all of the issues and related charges that were submitted but I think that I should ask that the court remove all of that paperwork from the record but first I am thinking I may have to go after whomever gave her this information to protect myself and anyone else who may be a victim of this in the future. I am wondering the following: In my rebuttal to their objection, I am going to give proof for each bullet point they give citing court paperwork for dismissals and also I am trying to have co-workers write letters of character about my conduct while working, I am also stating that they are proving no proof and just basically spewing lies (not in those words) which are the facts. They are demanding that I get a risk, psych, and drug evaluation and I would be willing to do that but I should not have to. I would be willing to submit to drug testing due to my past with alcohol which is no problem but without proof I do not think they can demand such things especially if there is no record of me having problems or any admission as such.Would this most likely suffice to properly counteract what she has accused me of? The judges are apparently very strict and favor women in my area from what I was told by two lawyers who frequent the courts and gave me free advice. For the illegal submissions of my history directly from a program that only a police officer would have access to and improperly obtaining said information what should I do? I do not want anything bad legally to happen to my ex even if that is possible but I do want to go through all legal avenues possible to find out who, why and how this information was obtained and do something to prevent it from happening to me or anyone else again. Any help here would be greatly appreciated, I am a single father of two children paying child support for both having to rent single rooms not even being able to have them over if the court chooses due to paying too much child support which is changing and will allow me to rent my own apartment. I still frequent AA and NA meetings weekly and I will continue to do so as it gives me tools for life that are invaluable and connections for support which help me greatly. I just would like to be able to be part of my daughters life as I am with my son and support her in every which way that I can and be there for her every step of the way. I believe that I have these rights as a father but I cannot afford a lawyer to fight a good fight here. [link] [comments] |
Posted: 01 Jul 2018 01:45 AM PDT So I used a pseudonym for shipping some embarrassing things I don't want anyone to know about, including my neighbors that work at the post office. The package was not delivered to my house like I wanted and was instead held at the post office for pickup. I don't have ID that says I am the pseudonym on my package. Would proof of residence be enough to retrieve my package? And is it illegal to ship things to yourself under a pseudonym? Not really clear on these points. [link] [comments] |
Posted: 30 Jun 2018 08:09 PM PDT Location: Ohio My sister is in her 30's with a 4-year-old son, she also has a dog and a cat. She was evicted from her house 7 weeks ago. She doesn't have a car anymore either, nor a job. She has since been living under my mom's roof with her son and both pets. I am 21 years old, and we all live under my mother and stepfathers roof in Ohio. Neither of us pays rent, it's strictly my mom and stepdad paying the bills. So currently it's me, mom, stepdad, sister, and her son. Its a 2 room/bath duplex, no pets allowed. My mom is the nicest person in the world. She wants the best for everyone, even if she knows discipline and boundaries are in order. I think over the months, even years, she was hoping she would learn from her mistakes and really try to turn her life around. My sister hasn't shown a single effort to change, for years. She doesn't listen to anyone's advice, she only takes offense to it. She constantly feels attacked. When my mom tries to get through to her all she does is tries to make it about mom or someone else. She often makes her son speak for her, and we have seen her multiple times lie to her son, saying things like we locked them outside, which never happened, etc. Shes very manipulative. But this is just scratching the surface. This is daily behavior, consistent. But it gets worse. Usually at night.. Over the past 2 days, I've spoken to 3 police officers, on 3 different occasions. Let's talk about some of the reasons the cops were called lately: 1.) The first time she called them on me, I had woken up in the middle of the night to pee and she stops me on my way back to my room, and says something along the lines of "if you don't turn off that fucking music we will have problems". This was a few weeks after she moved in. I had no music playing, I was watching Friends on near mute, and had been asleep for hours. I lost my cool here, the only time I have. I confronted her and asked her what she was on about, and showed her there was no music. At which point my mother wakes up and gets involved. My sister is screaming, getting in our faces and literally spitting on us with the way shes yelling. She then threatens to kill me and my mom and calls the police. While she was in my face I had aggressively shoved her off of me, nonviolently, but in my eyes, it's okay to push someone off you whos in your face spitting on you? The cops showed up and heard both sides and they do nothing for their situation, but we didn't even mention her suspected drug/mental problems, it was after 4 am and we wanted to sleep. It was my mistake at not telling them she threatened our lives WHEN it happened. 2.) More recently, my mother called the cops on her. She went to bed and my sister was texting her nonsense and telling her she needed to come out and see a video she took on her phone of her and her son's skin "crawling off", and heard footsteps on our roof, shadows stalking her from outside. A few days before this my mother called the crisis hotline and spoke to a very nice lady, she told my mother if she acts that way again to call back and let them hear exactly how she's acting and would send help. So before calling the police, she called the crisis hotline, a man answered and told my mom they NEVER do things like that over the phone, my mom hung up and called the police. Now, we tell them nearly everything, all of our suspicions and all about her actions, even her threatening us. They again were no help, the cop said her eyes were not dilated and she did not seem high. They tell us if we admit her to a hospital the doctors will ask 10 questions, told us my sister will lie, and then she will be sent on her way. They told us the system is basically broke and there's absolutely nothing they can do unless she is in danger or putting others at danger PRESENTLY. This is a girl who wakes her kid up in the middle of the night and steals my mother's car keys and tells no one where she is going, the same girl who I witnessed locked her child in a dog crate and sat in front while he cried. But you have to understand something, my sister is not dumb, she analyzes everything and is very methodological. She now knows we are waiting for her mistake, shes being very careful. Today, my mom lost her car keys after my sister left unexpectedly, all her life she has never lost her car keys, hard for me to believe that's a coincidence. 3.) Later that night, the same day as above, she wakes my mom up and tells her she needs to take her son to the ER immediately because his skin was turning blue, I don't have to tell you by now that this is far from reality. While leaving she cant find her kindle, accuses me of stealing it, and calls the cops on ME. 2 different cops came, and we had to explain everything over again. They said the same as the last, they cant do anything about it unless shes endangering herself or her son. This was at 11 pm, she woke her son up to take him to the doctor when hes perfectly healthy and trying to sleep. In my opinion, this "doctor" thing could be an excuse to leave to have no questions of her whereabouts. But, who knows. That's the entire problem...we don't know.. She used to be addicted to Klonopin and used to have seizures from I assume withdrawals. She lost her vet job from stealing drugs from them and went to jail for it, this was many years ago. Like I said before, she has shown no signs of changing her life, finding a job, getting help, nothing. There is no way to approach her with the situation, she will blow up and go on and on about random things until we just can't try anymore. My mother talked to the baby dad today, and found out he is buddies with someone from child services. He told the baby dad to file for emergency custody, and that way she will have to be evaluated before having a chance to see her son again. Currently he is with baby dad, and she was told she's not allowed to contact either of them. You have to understand something here, everyone in this house is scared for there life. I myself, since the first night cops came, have had a growing feeling of her trying to hurt me, every time I leave my room I literally fear shes standing there with a gun. I sleep with my pull-up bar behind my door so she cant come in my room if she decided to one night. My toothbrushes have been moving all the time, now I have all these suspicions that shes spitting on my things, and simply just trying to make our lifes miserable as possible just because we dont want to put up with her shit anymore. My uncle told the police the same thing, that we are all literally scared for our well-being, he didnt care. For the past week, me and my mother's lives have been utterly miserable. I sat next to my mom today while she sobbed, feeling like shes at a deadend. This entire situation has torn a hole in me and I have absolutely no idea what to do about it. I just..want help. I want to know our options here, legally speaking. I dont want to see my sister destroy her life, I cant bare to see my mother like this. I feel utterly useless in this situation. I thank you in advance for reading [link] [comments] |
[WA/US] Cutting hours considered retaliatory? Posted: 01 Jul 2018 10:29 AM PDT My GF is quitting her retail job. She's seen instances in the past where, if an employee turns in their notice, their hours are cut drastically for their remaining days of employment. Is this considered workplace retaliation? I feel like there's an indication of intent, as the hours schedule has already been released, and it's modified after someone submits notice. [link] [comments] |
Posted: 01 Jul 2018 10:44 AM PDT The language in my lease says, "should landlord and tenant find it agreeable, landlord will occupy unit for a few weeks in the summer, pro-rating the rent for the time tenant is not in the unit". My job is seasonal, and I was hoping my landlord would want the apartment during the off season, so there would be no overlap. Unfortunately there was about a two week overlap between when they wanted to use the apartment, and when my job starts. I had to find a place to live, because I would be fired if I didn't show up for work. I found an apartment, but they insisted on a season-long lease, so now I'm renting two apartments until October 1. Do I have grounds to be let out of the lease, considering this situation is HARDLY "agreeable" for me? PS. This situation is taking place in Vail, Colorado, which is a notoriously expensive and competitive housing market. [link] [comments] |
Jobs trying to make me use money out of my own pocket for my bank at work. Is this legal?? Posted: 01 Jul 2018 01:02 AM PDT Is this weird?(new job) So at my new job as a server ;my restaurant (which is not a chain restaurant I mind you) Has been asking me to bring my own bank, which means I use my own money from my own pocket to help give change to our guests when they're paying the restaurant.i dont feel I don't feel comfortable doing this . my boss and many other co-workers said I should bring (from my own pocket, not the money I make there )at least $40 in change to use during service.when I asked why do we do that, all they said "this is just the way we do things here "and I just want to know is this normal? I think our landlord is using our electricity Posted: 01 Jul 2018 12:36 PM PDT We live in Pennsylvania and rent from a private individual. We've lived in this house for several years. The house has an inground pool that is fenced off and not available to renters. Our landlord's family uses the pool. We noticed the breaker box has a pool pump switch. Last winter I turned the switch off. It seems like the landlord switched it back on when he was over making an unrelated repair (he had no reason to be in the breaker box). I had assumed before that our electricity wasn't being used. There's nothing in our lease about it. Now I'm almost positive it is. This probably only amounts to maybe $30 a month on our electricity bill, probably around $100 a summer (depending on the horsepower of the pump), but it feels really wrong. Especially switching the breaker back on without telling us. My husband says he thinks he remembers the landlord saying the pool pump uses our electricity at move in, but that it used 'barely no electricity.' I don't remember this, however. There is no mention in the lease. What are our rights here? [link] [comments] |
[TX] Mechanic intentionally unplugged my O2 sensor during inspection Posted: 01 Jul 2018 08:20 AM PDT My normal mechanic doesn't do inspections because his emissions test machine broke a while ago. So I have to go somewhere else for inspection. Shop B passed my inspection, however as soon as I got into my car, I noticed the airbag light was on. A few ways down the highway and my check engine light comes on as well. I take it to my mechanic (whom I've known and had a great relationship with for 4 years), tell him about my inspection and the two light. He takes a look and fixes the seatbelt light, saying it's possible they tugged on it too hard or something (don't remember exactly what he said, but he was able to set it back correctly). Next, he asks me more about the inspection and then tells me "There is no way this came unplugged on it's own. This was intentional." He tried to reset the sensor twice but the connector was damaged while unplugged and no longer works. He did all of this twice without charging me anything and told me to let him know if the lights came back on. They did both times and now I will have to get a new connector and have it installed. It's a small chunk of money, but it is slow season in my industry and I have been dealing with medical bills with my dad and a few other stresses, so need to be very frugal. I feel angry about this companies shady practices, and so even more than the money, I want them to face repercussions and be called out. What are my options? [link] [comments] |
Posted: 01 Jul 2018 05:39 AM PDT I work for a tech company in New York State. I am a waged employee, not salaried. For the last several years, they have been making a group of waged employees, including myself, take home a cell phone a few weeks per year to answer pages to fix products that are stalled in production. At first, we were only reasonably expected to be called on weekends, during evening and early morning hours. However, the last two years the on call "program" has expanded to the point that we get called much more often, many times when the actual office is still open and there are employees that could fix the problem already on the clock and present. Recently, we had a meeting with this on-call group and were told that this is now a 24-hour expectation that we will answer the phone. This means that when we are on call we basically need to stay sober, we can't stray far from a Wifi point, we need to stay in town, and we can't ever turn the phone off. Our only compensation for this on call time spent is the exact time spent fixing the error. IE if I am woken from a dead sleep at 130AM and it takes me 30 minutes to fix the problem, I get paid for 30 minutes. That's it. Also, if we are on-call during a holiday week, we get 8 hours of vacation time. Is what they are doing legal? We are having our lives disrupted by this damn phone ringing constantly and we aren't getting paid except for the time spent fixing issues. They have recently confirmed in a meeting that it is a 24 hour expectation for the weeks we are holding the phone. [link] [comments] |
[UPDATE]My kid bought a brand new car and dealer now says financing fell through. Posted: 30 Jun 2018 02:32 PM PDT Original post here https://www.reddit.com/r/legaladvice/comments/8upq7i/california_my_kid_bought_a_brand_new_car_and/ This story has a happy ending for everybody involved. The finance department wanted either a co-signer or a larger down payment since my kid is a first-time buyer. We went in today and increased her down payment by $2,000. Her monthly payments have gone down, she's still at 2.9% financing, and her first payment is due in 45 days so she basically got a free month of ownership. For those curious her credit score is 771. Im glad that this was easily resolved and not some bait and switch. While she could have walked away and was prepared to, the situation wasn't as nefarious as we originally thought. Thank you all for your replies and input! [link] [comments] |
Can A Vindictive Employer Really Do This? Posted: 01 Jul 2018 04:24 AM PDT Been 2 years since I was employed. Employer heard I was doing well in a competing field and filed arbitration stating that I could not be doing well without misappropriating undefined trade secrets. Everything is very nonspecific and I honestly don't know what they are even referring to because they didn't define any of this. I don't have very much money so the thought of having to hire a lawyer for arbitration that may take a year is daunting. It seems like they are just trying to get me to cry uncle because in my field it's impossible to market myself and get a job somewhere if I have an ongoing arbitration. So even if I could afford a lawyer, I certainly won't be able to now because I won't be able to attract work. Is the system really this messed up? What options do employees have ? Even if I win the arbitration, I still lose a lot of wages and lawyer fees. Location: New York [link] [comments] |
Posted: 01 Jul 2018 05:08 AM PDT 29/6/18 Or for Americans 6/29/18. My mum was cooking soup, I was in the next room over when I heard an explosion, and my mum started yelling in pain. The pressure cooker had exploded and thrown boiling soup and water all over the room and my mother and a small amount on her girlfriend. my mothers girlfriend instantly got a bowl of cold water and immediately put her face in the water to cool it down and attempt to stop it from getting worse, but then brought her into the shower to ease the burns on her face and arm. We called an ambulance, and the paramedics quickly took her to the hospital seeing the burns and her general condition. When she arrived home again, about 3 hours after she was taken to the hospital (about midnight), her face was noticeably swollen. Although described the burns as being similar to a "severe sunburn" the next morning her face had completely swelled up beyond recognition, and she could not open her right eye at all, she also had multiple small to medium sized blisters all around her face, ranging from the size of a fingernail to a tube of chapstick. She then went to the hospital again, where they then said the burns were far worse than they had initially believed, and prescribed her with painkillers. Although this morning the swelling has considerably decreased, her face is still painfully swollen, and red. We are now wondering what we can do in the form of compensation. This is in Victoria Australia. Edit: Still 2018 for Americans. [link] [comments] |
Posted: 30 Jun 2018 09:28 PM PDT They'll make me clockout for a few hours then come back later. This is really inconvenient for me as I walk and there/back takes over an hour. They don't warn me this will happen and justify it saying I'm scheduled for two different shifts, one at 12 one at 5. My 12 will be cut short but I'm still required to come back for the 5. These breaks aren't paid and I don't consent or sign anything saying I want it. Do I just find a new job? [link] [comments] |
Posted: 01 Jul 2018 01:13 PM PDT This is all come down in the last week with no previous warning. It is overwhelming and I don't know what to do, as we live paycheck to paycheck and now will have to move soon. Is there anything we can do? [link] [comments] |
Posted: 01 Jul 2018 11:49 AM PDT So I'm not sure how to come about this. So here's what happened (located Los Angeles, CA) A month ago my mother's 14 year old cat got diagnosed with kidney failure, my mother decided to keep him at home and let him pass on his own as opposed to putting him down. Well last week, he went out at night with her other (4 year old) cat, and didn't come back that night, nor the next day. My mom left for work, and stopped by at lunch to see if they had come back. The younger one was home, but the older one wasn't. She asked around to the maintenence man, who knows my mother's cats, and and he said that he had seen him dead so he threw him in a dumpster, but refused to tell her which one. I called the apartment's office and the woman working was shocked, but understood the logic of the maintence man, I asked her to get the body back because my mother wanted him cremated, she agreed and made it happen. So I told my mom to stay at home and that the maintenence man would be coming with the body soon. I made arrangements at a local vet for cremation so she could take the body in. About 10 minutes after speaking to the receptionist at the apartment complex, I get a call from my mother who is hysterical. She tells me that her "dead" cat is actually ALIVE. The maintence guy had put him in a garbage bag and thrown him in an open dumpster. He was in the sealed bag for about 4 hours, and was clearly suffering. I called the vet and told them it would have to be euthenasia and the cremation service. My mother then took him to have him put down. Now my question is, what do we do? I'm not sure how to get my mother compensation for this trauma. I understand the logic of throwing away a dead animal laying in the open on the premesis of the apartment complex, however this man KNEW he was my mother's cat, he has talked to my mom and he was definitely more than an aquaintance. She cried to him while I was on the phone with her, asking him why he didn't tell her if he knew the cat was hers. He didn't respond, and my mother has avoided him since. Can anything be done? Need help with landlord charging exorbitant fees upon move out... Posted: 01 Jul 2018 09:06 AM PDT I recently moved from Louisiana to Indiana and just got a bill in the mail threatening legal action. My deposit was $600. They are keeping that and charging an additional $500 for exorbitant fees, such as $365 for general cleaning (cat hair, but they don't site the cat deposit anywhere, which they also kept), as well as $100 for stove cleaning and $100 for fridge. This is a small, 1-bedroom unit. There's no way they should be charging $565 for cleaning fees. Additional charges include $50 for 8 light bulbs, $200 for replacing "corner" of stove (no mechanical damage, just a slight dent), and $200 for "repair various doorframes" which is ludicrous. They are fine. Keep in mind that this was a low-level unit, costing only $700 monthly. And I'm pretty sure they're doing this to all former residents. I've rented for 15 years and never had a landlord come after me for fees. Finally, since I'm in Indiana, can I fight this without travelling to Louisiana should it go to small claims court?
